12:32 am
focus is on folks that can't apply to the police department people are interested if the career over 21 innovative the police department we're trying to put back the 3 hundred we're down in the last 4 years. >> next this is police officer memorial month the events were this sunday and monday last 13 sworn offers were killed in the line of dude the 10th through the 13 in washington, d.c. especially this week we lost lieutenant to cancer those officers were killed not lion of duty it is a hard time and slow it is a hard time for the men
12:33 am
and women in law enforcement upcoming effort oh one more thing the president obama task force as well as members of the public have spoken of the establishing reestablish communities advisory committee board using using the model the chief advisory forum invitations went out i it s sat a commissioner marshall and the invites are going out and hopefully by friday having hope to have our first african-american orientation meeting to work on various issues with the committees as soon as next week i'll report how we do with our r.s.v.p but we have a good commitment and finally event that were upcoming
12:34 am
and i'll hold the rest of any time we have other issues senator clipping is in town we're working on that and sunday streets in the ethics commission i'm sorry she's no town next week. >> chief were you going to update us on beamers. >> in their brown we've discussed the implemented to get body cameras you. >> you said mayor brown. >> he was here for a long time. >> yes. he was so mayor ed lee my mayor, mayor ed lee removed the impede that was cost found the money between
12:35 am
three and $4 million to equip the entire san francisco police department with the baermdz i know that we'll be establishing a working group to look at several the policies and then hopefully at this point in time that will sort come in certificate with the contracting mechanisms as far as getting the cameras themselves that is a large project but i think a good project and we look forward to who the working group will be made up and commissioner president loftus alu your leadership is the focal point of the group. >> i am sure the commissioners know the job is to conduct the policy for the department and obviously by the name require a
12:36 am
policy so chief i need you to set up a working group to advise you through this process of setting up the policy i have reached out to folks the good news there are other plaza places that have drafted like the alu we have to make sure we have the best information i've reached out to the aclu the bar association obviously the the bar association actually created the criminal judged task force many of us are members direct examination and a sub group on baermdz that work has begun a representative the ocii obviously is critical in stacey policy so they'll play a role and including the o fj and other
12:37 am
groups have a voice this is a something that will effect day to day duties and i have asked supervisor breed to identify a community men that is not otherwise in the player group a human being that has thoughts and finally susan quickbites coffee christian i've asked here to play a role chief contact them i'd like to report in thirty days and have a final draft policy in thirty days that's ambitious it if mean that everybody agrees i've been known to say reasonable accident can differ but to a have draft policy where there is the various positions on that cases
12:38 am
and benefit from the analysis after 90 days take the draft policy and have two scheduled meeting e meetings we'll hear if the community and come back to us for considerations and other considerations in the process with the city attorney's office and labor laws this commission will finally be the wunz ones to decide i want to be clear give us the input the information that decides but having the best genocide in front of fussy will ask other folks that wanted to be in on this i ask that information that goes through this working group and i'll get on others website and - >> yes, ma'am do you have names or your direction i reach out to the
12:39 am
groups for information. >> we were good at yes, ma'am but, yes, i have names. >> fair enough okay. you can continue with our report. >> i think that's (laughter) that's a wrap we'll move on to the presentation i'm sorry i didn't mean to steal the madam secretary's. >> the presentation for the first quarter finding and recommendations for o i f investigative summary and presentation regards the ois project sergeant.
12:40 am
>> ready. >> yeah. thank you good evening sergeant. >> good evening all i'm sergeant john one of the investigators with the office involved shooting team i'm here to give you a couple of presentations we've been talk the discharge review board and the updates on the investigations i thought i would kind of we were talk about some overview information just kind of go over the packet you've received and what the information contained throw in the chiefs cover letter this is produced for you have the cover
12:41 am
letter any public comment? the memo and basically an internal memo justice department captain of the officer involved investigation we maintain year running list of the status that goes back to when this ois team started in the years behind years and years and years behind so we've kind of updated the status on a 5 year basis in our packet and running description or summary of officer involved shooting date back to 2000 there's basically the adjudication of each case mabel available >> so you have to all have received a letter regarding the
12:42 am
discharge review board the summary it was dated april 10th recapping the board and summary report produced by sergeant jam i didn't campbell that did the presentation on the case that was presented farm discharge review board xhoejd in 2015 and it previously the last convention was january 20th, 2015, the fourth quarter but this is of the first quarter of march 21st and one completed investigation f t rb for 2014 was comprised of the four deputy chiefs listed the chair of the administration
12:43 am
dope chief redman and hicks were in attendance and as advisory members commissioner commissioner dejesus arrest captain greg lee and sergeant andy the sfpd range master saith campbell presented the investigation the chief that was conducted for the officer involved shooting to give you a belief recap in 2012 on the hundred block on and on of washington street on that day approximately 1027 uniformed police officers responder to a stabbing in the area of pier 17 victim was located with slash injuries the officers located
12:44 am
the suspect on davis street he was carrying a achieve and didn't respond they attempted to contain the suspect the suspect came towards the officers and her path was blocked she fired at the suspect that was mortally wounded that was in police and sergeant campbell had a recommendation that was accepted for the e r i w train the e r i w our expended range impact weapon the common term a two officers deployed system to officers to load and to utilize
12:45 am
the recommendations were made to making adjusts so we'll have those out not field carried by single officer and develop the emphasis of train so we have two officers able to deploy them the next scheduled is tentatively subject to changes in the commission schedule there's thursday june 18th the second quarter we'll get into what we anticipate with the f t rb i'd like to go over the status of open officer shooting investigations at this time there were update and changes since february 40 4 investigations have been closed that includes the one present as
12:46 am
well as the other 3 cases all the final documentations was completely on all four investigations all the dot all the i's and cross the t's and as i said one investigation was presented and two investigations new investigations have been opened since i spoke as of april 2nd i put this together there are 18 open ois investigations those are in the 3 different phases generally speaking 3 will have implemented criminal investigations with the da charging decision and anticipate those for the next meeting 12 cases are being conducted have a criminal investigation
12:47 am
being reviewed by the district attorney and we'll talk about that in the second presentation about the sfpd administrative homicide investigation was wrapped up up and turned over to the da 3 cases are active sfpd chronicle investigations as well as the administrative investigations so going by year all cases were open the last name from 2012 were now closed. >> oh, that's good. >> 3 years later and that's good 2013 two cases closed and the status of those the many cases we've received the charging letter on to 0 dash 6 and the
12:48 am
charging decision letter 13 dash 003005, 007 and 8 are under review with the district attorney's office. >> 2014 there are 8 cases from 2014 we did receive a charging decision letter that will be prepared for the next meeting and the remaining 7 kraiz cases are under review with the district attorney's office and then for 2015 all 4 ois from this year are open it is wrapped up the detail for those 3 cases are active investigates we've had those since the last
12:49 am
time i spoke 15002 we had the return of duty the last time i spoke you with and return to duties on 15 dash 003 and 4 since the last time i spoke those are open that's the status of the open investigations. >> thank you so much i have a few questions so i feel liquor i asked this question a lot so it is entirely on my end the term open is what i find confuse there's a point the police department passes on the investigation to other entities we have no control the one doves and the district attorney's office is responsible to the medical examiner's office what confuses me, you referred to those 3 opening open and
12:50 am
active investigations i think 4 and that seems like it is distinct where our passed it on to the district attorney's office so if you talk about we try to avoid the final situations happened in 2012 and 2014 that's; right when we are looking policy can you walk me through it how we're defining when we're done and how we've changed how process to learn what we know in the moment as opposed to waiting for years. >> technical there are two investigations we're going to cover that extensively but two investigations that automatically happen in an officer involved shoot the protocol the homicide detail and the criminal investigation and
12:51 am
the internal investigation and personnel investigation it has a dependency on the adjudication of the chronicle investigation particular with respect to the offers no with respect to the suspect so there's that town hall period that happens we consider that open until all the pieces are submitted that is sort of how i think the department had issues that end up causing the ois team to make sure all the pricing pies are done it is misunderstood the policies or training or issues have been identified and often dealt with not necessarily you know sometimes protocol sometimes not but make sure all the different
12:52 am
piece we'll talk about more extensively in the acceptance presentation so there are a number of places where the investigation transitioned a hand off from homicide to the district attorney's office the don't does their own separate investigation but in conjunction with the homicide investigation at some point and i'll show you some proximate timelines approximately 4 months later the they've delivered it to the district attorney's office and the da reviews that in conjunction with their own independent investigation that's part of their investigation and process it and prepare a report and turn that report around and it is sometimes 24 months approximately we get that report in the meantime, we're obviously
12:53 am
the i a investigation so there's a provision where we have a time limit to complete the investigation according to the california public safety officer bill of rights a one year time limit with on of the exceptions an active chronicle investigation so obviously the day with the o i f that clock that deadline causes it is called town hall that town hall until the session is concluded it in presented e prevent the investigation to do what we had to basically move our investigation along that includes train review and may make if this is something clear and event we'll move forward we
12:54 am
may recommend modification of training we're getting february we have be careful in doing it in a manner that protect due process the officers right so i don't know if it addresses that. >> i look forward to our presentation on how the entire process works i know our job commissioner dejesus is not here we've been in 0 meeting with the officer shooting occurred and mar make sure that is understandable i look forward to our presentation and thinking of more ways to make sure that the people understand how the cases are investigated. >> any questions. >> yes another term open
12:55 am
inspector next line item. >> oh, i quickly i want to say. >> the my case. >> oh, the mike just objective compliments on the body cameras everything has done that and there's a lot going on with the policing with our own department but the body cameras are a step in the right direction just that figure out how to use them and also the cadet program is great i think there is you know we look at the future and look towards any sports teams know that is going to have a great following into
12:56 am
the future this is our chance to you know help change and shape attitude and give the young folks perspectives about the police say is important particular those communities that should a distrust will give them a chance to see a set of law enforcement hopefully down the road they'll become officers so thank you. great. >> i appreciate that commissioner, i think that is important as long as we're. >> they're getting paid. >> to that end kids in high school not old enough to be in the cadet program the mayor's office has hundred jobs anybody that want to keep a young person busy other than interested in our unpaid cadet program a month
12:57 am
long program there's a lot of opportunities some paid some not but what we have we can do to get young people to be busy during the summer and it gives them a chance to do something that is an upside. >> presentation regarding the ois process. >> get into the question we'll talk about the process of san francisco police department officer involved shooting. >> the reason we've asked as a reminder we have commissioners and a lot of questions from the community it is a good refresher and how we do things in san francisco this is one the things
12:58 am
the commission identifies the issues of the portions and how we handle this is a timely presentation thank you. go ahead sergeant. >> officer involved shooting it is self-evident this is a study on the san francisco police department officer involved shootings no greater than responsibly than to use legal force in the line of duty those are european charged incident they involve people we know there's the investigations might want lard and sensitive have a lot of enacts into the office rights and, of course the public's interests in the cases air the department reputation is
12:59 am
scrutinized and rightfully so it is a great responsibility they require thoroughness and objective activity just we'll get into a little bit more a similar process almost dental for the in custody investigations this is par parallel discharge officer investigations i mean, i'll talk about that right here our definition of we use the term shooting and discharge in the police department and there is a difference and don't think on the type of use of firearm it will have a determination how it is investigated an officer involved shooting is an intended use of a firearm at the suspect or an you think
1:00 am
intended discharge it relates no injury or death that occurs when this occurs in san francisco in the city and county of san francisco it will be investigated by san francisco's homicide daily and the officer and the district attorney will conduct a parallel investigation administratively the first investigation a by san francisco police departments internal affairs grigs i division the ocii will be no evidence of the investigation the discharge is a little bit different maybe an intelligent use of a firearm but - with a dangerous or wounded animal or an authorized use of a firearm to signal assistance we when no other means exists that are an unintended discharge
