state law is limited discretion how to regulate the medical cannabis dispensaries like places to serve alcohol this is not whether with i support mcds looking at the planning code compliance it says pending legislation criteria the the project explicit meet criteria and the mcd will bring the medical benefits to the area didn't meet criteria and second one mcds have demonstrated public safety by activating the community by applying and designating community liaisons with the parkinson's meeting of criteria and the staff report is
3:01 am
this project necessary or a compatible with the community the project didn't meet criteria furthermore talking about the exterior treatment given predicament like landscaping and parking especially the project didn't meet criteria that will provide the development in enforcement with the performance of the applicable use it didn't meet criteria i'm an neighborhood activity and support what the neighborhoods want so speakers said this is not an election i agree i wish it would end up differently but based on the rulings we've been here for the project the project was denied in the court and the community outpouring i'm getting
3:02 am
not going to support it 2016 is coming we'll have the cannabis legalization and how to have this a dry county i use a poor definition we so have 70 or 80 years after prohibition i'm inclined not to support. >> commissioner johnson. >> i'll definitely support commissioner hillis that is unfortunately, we have a higher standard in one neighborhood i almost think that was based on the staffs finding or of the project my own it would have passed bar or dr it is unfortunately, that higher bar a has to be set to try to prevent this i'm hoping the supervisors about go back and make the
3:03 am
decision process for mcds and the sunset as we have the same in the rest of the city thank you commissioner richards. >> commissioner moore. >> i observed at commissioner hillis said we have a clear base position that interpreted the rules and regulations that is total consistent with the 7 or 8 years the director knows that the confusion with when we came to the critical junction it is your of defining green zones and not a a clear discussion with the board of supervisors and double messages and for some reasons like in the reverse the issue became political from law and the rule of law
3:04 am
so at that jufrn it is your where we stay and whatever the state decides in 2016 will set a base i'm equally attorney to support or novelist support the consistency and the banner high or basically saying the tools we used to have are coming into a shadow of multiple expectations which don't give me clear guidance anymore. >> i'll echo a number of comments that have been made the larger land use challenge the chagrining challenge of cluster and we've been asking the board to look at legislation to increase the number of places that mcd can go so there is not cluster what happened what the higher bar the cu we've taken outline alu the sunset out of
3:05 am
that eviction the legislation thas has to come to the prevention i'm not sure i'll support the legislation we're under the cu day deceased can you especially the fact that the staff recommended did disapproval and the criteria that commissioner richards read around bring the measuresable boar i don't know that is met or proven i ago that the sunset will need to figure out how to deal with that in 2016. >> move to disapprove. >> second. >> second. >> there is a motion and a second to disapprove that project on that 0 motion commissioner antonini. >> commissioner hillis commissioner johnson commissioner moore commissioner richards
