woest co-esto the west coast with the family to operate. he is the general manager. joshtia peero is a former employee on the east coast who lives here who will be the [inaudible] you will hear from bow today but not josh. you asked a question about the transfer of the license and i think our attorney will address that in some detail but the short answer is we did everything we could keess the issue and she can give the details. i thought maybe i would take a few minute to talk about who we are and wrawherewe come from and what our business model is. speaking why we are interested in coming from new york to san francisco given we are small family operators. we started to learn about wine and learned the business of wine

operating boutique wine stores in bookland. these are not liquor stores like package stores in new york, they are small shops that are devoted to small producers. a focus on artesianal procts. we don't so tobacco and no products of abuse. after a few years we had the idea it would be fun to try and take everything we learned and open a bigger one in manhattan. we wanted to go deeper into wine and wine education. we found a space on broad way between 21 and 22 street in the flat iron district. >> isn't that where the first sky scaper

>> exactly. we are one block south of that. that is neighborhood gone up and down over the years. it was one of the most fashionable neighborhood. this building had huge potential but was abandoned for maybe 10 years. it was a former joke shop, nauvalty shop. the block had a bunch of empty space squz it was the kind of block people cross the street to avoid at night. we saw the potential, our landlord rehabilitationed the build{did a build we are proud ouf and laurched the store and now the block is-the neighborhood is transformed from there up through the next neighborhood up through nomad. our contribution to that has been opening the shop. as i

said before, the shop which is the model for what we want to do here is not what you consider in 94 new york a package store. it is devoted to small producers, lots of sustainable wines, biodynamic. in particular we have become the advoicate for what people call the new california wine. i don't know if you are familiar with that term [inaudible] called innew california and this is [inaudible] we have very close relations with many of those producers, a couple submitted letters of support which should be in the packet >> we may lose our quaurm if we don't move more quickly >> let me try to cut to the chase. so why san francisco?

the support of the sfpd but to understand what the issues were and know wree up a we are in a position to help and not hender. we spoke with supervisor kims office and they gave us various sessions to meet associations to meet with and met with them. we spoke with neighbors and sent out mailings to over 1 thousand neighbors and got lots of support. we have-wree in [inaudible] and also next to the financial district and you'll see we have numerous letters of support from people there because they feel that is a vastly underserviced market. there is no store that does what wree doing there and it is to their benefit their veerns to have us there. they want to

this issue where the license is coming from and the idea of not wanting to add another liquor license to this area, why not get a license from within the neighborhood? >> we tried to do that. we spoke with several brokers my attorney will be able to speak to this in more detail, i wasn't party to that. the other thing i would note is the location itself, the number of licenses technically may go up. the location itself was licensed before so in terms of square footage there isn't an addition licensed area to the neighborhood. >> thank you. >> thank you for your time and consideration >> did your attorney want to make a comment? >> just briefly supervisors in deference to your time constraint. we did attempt to

>> good afternoon. appreciate the opportunity to talk to you. my name is nob nab at flat ion wines in new york and plan to move here as owner and operator of flat iron wine san francisco. i'm moving here because a couple years ago my wife and talked hch we lived in new york 9 years and most years i worked with josh in the wine industry and want to move back west to be closer to friends and family. my wife graduated from business school [inaudible] knowing that i went to josh and said i love the wine industry and it is what i do and love. how can i make this work and work with you and go to san francisco so this is the project we came up with. we flew out here many times thoerfb past year and met with

naulty. i'm executive director of wines [inaudible] i'm involve would the business owners selling off sell liquor in the following business. bristol farms, [inaudible] dean, fine wine and liquor on market street, target and wall greens various location downtop town. we are concerned about security. it is right near the montgomery bart station and transbay center. this is easy for people to take the alcohol and take it to another part of the community. the business owners have no track regard in california so don't if they are aware of the laws in california as well as the-i don't what their affiliations are bayed on the board packet to the

downtown area. i wonder about the community outreach and how much was done because i don't see letters of support from community organizations. i hear some might have come in later but they were not in the board packet that was posted to the public. the names on the liquor license are all from out of state and this is actually-put down what it is. this is a superstore selling 4 thousand selectionoffs wines and spirits serving the public-there are 3 outlets within a square block socthis isn't necessary >> thank you for testifying and-just to cet to the trace you have no recommendation? >> the think is we would like continuance because i don't know what outreach they did and we want to be neutral. we just

don't understand this kind of >> thank you. seeing no other public comment i'll close public comment >> . let me weigh in i appreciate the presentation from the flat iron wine squz appreciate the thoughtfulness in the proposal. there does seem to be significant community concerns raised. lutenent [inaudible] walked us throthu through the transfer of license to west port al to their yiria of the downtown area that is raised by the concerns. i feel as a public policy that when you have especially areas that are with large loincome populations that surround it like soufth market or the tenderloin we shouldn't increase the number of licenses in those areas. as a public

policy that is a concern of mine. that is one of the main reasons besides the community concerns about this that i'm not supportive of this transfer. i think to move this forward i'll motion that we table this item so i move we table this item for those reasons j. supervisor christensen >> this is all most in my district across the street. we did investigation so i have a empty store front which we don't like in a hotel #23u silty. i have spoken to supervisor kim who didn't object to this. we established this isn't a off sale liquor situation and i am sympathetic to mr. mick noltys concern but we remember the controversy about bristol farms and had more problems in the wall green south of market than we are likely to have hat this

location. i look as this a business that is appropriate in this area and i take very seriously the concerns about another liquor license. i understand from supervisor kims office they made attempt to actually help the applicant find a existing lice ins in the district and not able to do so so there is a attempt to do that. i watched people make earnest efforts to do business and been twarted as t at this stage. because of for visor kim's lack of objection my imication is approve thix or send to the board >> supervisor campos >> i think i want to go now because it comes down to me and this committee. i think it is not a clear case from my

perspective. i understand what lutenent fal zone z saying and i think that in many respects the argument makes sense. the bottom line for me though and i have said this from the very beginning of my role on this committee when i was chair of the committee that that thofend day to me it all comes down to community support for a license and i think that for me that means that there has to be a yes from the community to make smns happen. i am concerned in this case you have a neutral supervisor not saying one way or the other and i'm concerned so many members of the

community have come out. i appreciate there may have been letters subsequent to putting together this package there is no one from the xhunty who is coming here and saying we support this in this hearing. i do worry that in the end this will culminate in one additional license in the neighborhood. for me and i guess what it comes down to to support a license there has to be support from the district supervisor and community. in this case there is no objection, but no support from the dist rth supervisor or the community for that matter so given where it is i will be inclined to agree with supervisor mar. i think that if there is a opportunity to get another license from within the neighborhood that i think

and multiuse use buildsings >> supervisor campos >> thank you very much. i want to thank our representatives from the department of building inspection who have stayed here for this very long long meeting. the ordinance before you which is cosponsored by supervisor kim and want to thank her is to create a interagency emergency fire task force that will meet over 3 months to review and develop legislation and other solutions for the purpose of improving fire safety in the city. i would thrike thank president breed for waving the 30 day rule when it comes to the legislation. we need to do everything we can to protect it people or city and county of san francisco from future fires and we can't stop every fire but i know that we can do a

better job and the goal is this task force will play a critical role in making that possible. the 7 member agency task force includes representative from the department of building insmeckz rsh the fire department, public utility commission and want to thank the represent thv from the puc who staysed the meeting [inaudible] as well as department of public health. as you know we have seen a disproportioninate number of fires in the mission including the death of 3 people and believe by creating the task force that we will do a much better job. the task forbs will focus on 3 areas, one, review and make recommendation tooz the board of legislation to improve fire safety in multiunit residential buildings and mixed use buildsings including legislation that allows housing

inspectors to asite owners when fire alarms are out of date [inaudible] the vecd goal is for the task force to suggest new amendments to the municipal code to improve fire safety regarding prevention emeasures post fire investigation, the process and resolution of complaint with code violations and interagency coordination and information sharing. third we ask the body to make recommend on the feasibility requiring the snaugz of fire alarms and fire spring lers in multiunit buildings. this issue is a particular concern to supervisor kim who haeld hearing on this very important matter. the task force will meet at least once every 2 weeks for the next 3 month and the meet rgzope toon the puck
