to the board of directors on b o s file health code improvement bathroom requirement and fines presentation by sunny and richard lee. >> thanks guys i apologize for my towardness so i wanted to give you a little bit of background on the legislation the last year the land use and economic development was asked to consider amendments that insure that gas station boardrooms can be unany not only more male and female this as enabled the gas stations to maximize their space and cost savings at that time we considered actually making those amendment that i'll be
6:54 pm
talking with you today instead supervisor kim decided to go ahead and watt wait to talk about what the department of public health the existing law in the health code requires that galg gas station provide a clean and samaritans washroom for the use of patrons during the business hours although the current law authorizes the department of public health to insure the compliance with the law there's not a denied mechanism by which to enforce is it after communication with the department of public health the supervisor is proposing to amend the law to permit the administrative fines for violations of the law it will authorize the director of health or his or her designee for the

fines the tier system will be $500 for the first and up to one thousand dollars for a third violation also rectifying it should be easy to kinder there's a provision or flexibility that's given to operators that are cited for other structural type of violation like plumbing or electrical wiring or you know other types of building kind of violations they have at least twenty-four hours to cure that violation or it will be up to the suppression of the inspectors in twenty-four hours proposed ordinance will also clarify the duty to make a bathroom available is it only when the service station is

open, i.e., negotiations for patrons i'm available to answer any questions and i think richard can speak to sort of the inspection process commissioners may have had questions about what triggers on inspection. >> okay how do i define patron. >> well, actually we don't the current law ticht the department of public health the health code itself actually has no less than 10 different references to patrons that are undefined in the code there is actually, only one spot that has a more specific definition of patron that is in article 20 of the health code which provides a definition of the term patron as a person that enters a business with the intent as a spokespersoner or purchaser
6:57 pm
that's the only place in the health code that the patron is actively defined if you look it up the intent it is someone that activity purposes goods and services so if a business is pagan american people employee to receive money from a patron that is someone that would be a patron so - >> for example for a restaurant there is language that speaks specifically to immediate consumption so the idea that it can't be someone that comes in to buy a stick of good morning at the current and uses the restroom you have to sit down and eat so you actually are pretty specific here ♪ legislation that it is people that purchase gasoline and put it directly into the motor

vehicle so if i combine a convenience store with one way or another with my service station it is common as a patron as specified here someone that comes and buys a bag of chips >> i believe this to be in the jurisdictions of the inspectors that is addressing the violation maintaining of the definition of patron as outlined in you know if we're going to go with merriam webb stores distribution someone that pays for goods and services if it is offend by the business if not offered they're not offering goods to purchase during business housed that's taken off the table that's my understanding of what the definition of a patron. >> i'll august the definition needs to be refined there are
6:59 pm
patrons noted provides water with restrooms i'm sure i don't think i'm required and my retail store is to provide a bathroom a restaurant i'm assuming i see signed to refuse service to people and post a sign the restroom is for patrons only so rather than leaving it up to the experimentation of individual not and no legal means to determine that it feels like that should be specifically specified if we're going to pass a law. >> so just to clarify commissioner so we're not actually amending the existing definition of performance that is the law and consist with the public health code the - this is
7:00 pm
merely trying to clean up the legislation by the mechanism by the department may enforce you you know being in compliance with the existing law. >> we're going to inflict onerous fines $500 is expensive thursday offense rather than to have someone levi a $500 offense what's going to happen you'll spend a lot of time and money disputing this so this is an because you are amending the legislation and some opportunity to address and what is nothing like that an obvious short coming of the existing legislation and relate to the business specific
