>> and there's a plan then to have them come to us to ask about acdc? >> that is my intention to agendize these amplified sound permits. >> okay great. >> okay moving on. an update on staffing changes i threw in here and blackstone is on vacation today this week as she was last week but she she is leaving the commission i thought you might all know that already so we'll see her next week week briefly and then she will be leaving. i have the h.r. in motion and i have a potential candidate to fill the position hopefully. you know, the latter end of june we'll start training someone new
1:08 pm
but there is some turn over so this is happening. and i think i had updated the commission previously about the addition of a position we're still waiting for an indication by the budget process that we will possibly be adding to the staff a person to basically work full-time on outdoor events based on the work that was done so the mayor's budget was released yesterday or announced yesterday and that position was not in that but we believe that it will be what's called an add back by the board of supervisors so i'm poised and ready but it is another h.r. process so we we won't literally see a
1:09 pm
human being probably until october or november or even possibly december and that's the way it works and so that you have that expectation. i don't have any corrective actions to report. i can hand it over unless there's more questions for me. >> no, thank you very much. >> thank you director. good evening commissioners. >> two things of note we issued a one night pardon me two night permit for gray area art and technology theatre on 2665 mission i was there throughout the night and noticed their opening and stopped by once for a walk through during the event on friday and then again at closing and everything was smooth inside fire
1:10 pm
fire marshal was there and as as far as sound goes i think they are still a bit of a work in progress although very interesting old hvac venting systems boiler rooms and they plugged most of the holes i think at this point and as as far as i'm aware of or was made aware of there were no complaints after this past weekend. pardon me, two weekends ago. chambers at 601 eddie at the phoenix hotel they applied for the first of a couple of events for their annual pool party season. we wanted to stop by and make sure that they had some guidelines in place for where to be decibel wise speaker placement and all that good stuff and we are working to confirm that they
1:11 pm
will be getting their own sound meeting and be getting a limit er and i plan on going back for their next event. complaint wise, we did get a call from a resident who has just recently moved a top the homestead at 2301 fulton he was there 1 week spent a couple of nights and realized that live up above a bar wasn't going to be the thing he thought it was going to be and at this point i've spoken formal and he's currently in discussions with landlord and operator and it seems like that will get worked out on its own but i'll be following up and i hadn't heard from in quite a while the conference center i did get a call the past two two saturdays and i've yet to be
1:12 pm
able to confirm the decibel levels that we are hearing inside. by the time i was able to get over there this past weekend, the complainant informed me the event had ended and i was actually on vacation so i was unable to visit. i did want to talk about a particular story you may remember the park cafe coming in. i had a phone call after many months from a neighbor and i think it goes to show kind of when everything falls into place and we do a little bit of hand holding and a lot of communication as everything goes right the neighbors really feel like they have direct access to us so i was out in the field had a nice conversation with the neighbor. she was, i think, , pleasant ly
1:13 pm
surprised she was able to make a phone call and reach someone and we had a chat and proposed she call directly to the venue and i let her know if she had any kickback or issue or push back to let me know and i'll be following up with the operator to see what we can do in the future to prevent that situation from occurring again. >> that was i remember there was just one family or parent that -- >> yes, sir. >> did you have a conversation about have things generally gotten better for them? >> i did. she said things had cropped up again and i hope to figure out why that was allowed to happen. >> okay thanks. >> same as previous
1:14 pm
complainants. >> other questions? for inspector burk? >> all right inspector pauley. >> good evening commissioners i'll speak to the most important items i have. i received a complaint from the sergeant that he had gotten complaining about crowd noise in the alley below. i stopped by i think it was friday night and i stayed for about a half hour i parked in front of the venue and camped out so i could get a good hold on what's going on and basically i think that their noise is normal. it's anything that would be expected when you have patrons coming out and waiting for taxis and so i found them in compliance and i'm still going to follow up and see if there's something we could maybe do
1:15 pm
to help the hotel operate and not have their patrons bothered but i found that the vessel was basically in compliance. similar to what shaun was talking about during regular patrol and getting these kind of like phone calls or notification in the field about situations going on the same thing happened with the basement the basement had a hard opening you know we dealt with the basement potential noise issues and i received an e-mail from faithful fools that it was loud i think basically what with the venue being full it changed some some of some of the dynamics of the sound so it got away from larry. he turned it down. i stopped by and i talked to him and i think we'll be able to lock it in definitely this weekend i'm not going to allow it to get
1:16 pm
out of hand i'm going to be there probably twice this weekend to make sure we don't have the issue anymore so all that to say it is useful to be able to have you know these conversations with neighbors here in the hearing process and then have some communication rather than maybe like anybody can call us because then you know we runaround the city but when we have these specific issues it's good to have direct contact with people to solve issues before they become a problem. i mentioned the cellar a couple of weeks ago doing their own security now. they have established a security plan and have a p.p.o. license i've seen the license and they will be sending me the actual draft of the security plan over soon and the last thing was the bamboo hut the central police station issued them a notice of violation for
1:17 pm
loud noise and i think it's important to mention now because it came up with the issue of the the 300 feet or whatever. the people complaining were up on the hill a quarter mile up the hill and it was kind of interesting that the noise complaint would be coming from there and it's so far up the hill so food for thought. if you have any questions. >> thank you joseph. >> are all of their doors and everything still opened? >> yes. i think they just turned the sound down basically i mean the police are out there you know if they have an issue they usually deal with it i guess. i talked to the officer on the right across from bamboo hut saturday night and he said everything was fine. >> the other thing -- have you heard in your travels that vessel was closing?
1:18 pm
>> i have i'm not sure because i haven't asked the actual owner. >> it's true they are closing . for good or just remodelling? >> remodelling. >> so the other place will get a rest for a few minutes. >> one more for cam ton place, new manager there? >> i'm not sure. that was about 5 weeks ago the last time. >> all right. okay. >> just one more thing. with regard to what joslyn mentioned about the summit the reason why this is really important to the industry one of the two subjects we're going to talk about is the board of equalization and anyone in the business that sells anything knows that they have to pay sales tax and what do do
1:19 pm
the audits look like and i think it's a really important thing and anyone that's listening to me out there this is approaching some really good subjects and boe is one of them and the importance of a and b insurance so i think it's really important that people attend because the break out sessions are going to be to be really informative. >> thank you. >> is there any public comment on our staff report? seeing none public comment is closed. we'll move onto our next item which is police comments and questions. are there any police comments and questions tonight? does not look like it. all right we'll move on to item number 6. permits. >> hello commissioners i'm doing lots of jobs tonight. so bear with me a little bit because i don't initiate
1:20 pm
the work with these permittees but i'm going to pickup from where we left off and the first permit here is tim ryan doing business as the willows and this is for i think a pool table that's already been there and this is a compliance permit so -- is he here? no? no tim ryan. well, we can proceed or. >> we can continue. >> we can do a continuous. i'm in the camp of if you want something you should show up to get it but that's just me. >> we'll take commissioners would you like to continue? would you like to approve or disapprove? >> it's just a pool table we're talking about? >> it is. >> it's a pool table and the hours they list on the back of
1:21 pm
that application. >> so mainly just a restaurant and a bar the one at folsom and 11th? >> correct. >> there's no reason to think this would cause any concern given this is just compliance? >> correct. >> if the pool table has been there forever. >> right. so i would move to approve. >> there's a motion and a second. >> second. >> all right. 2 seconds. is there any public comment on this or police comment on this pool table? [laughter] vote yes. >> commissioners good
1:22 pm
evening lieutenant from the police we have no objection to this license. >> great thank you. any public comment? i don't see any public comment. let's take a vote. >> commissioner frost. >> aye. >> commissioner lee. >> aye. >> commissioner joseph. >> aye. . >> commissioner perez. >> aye. >> president tan. >> the motions passes we'll move onto the the lab. >> commissioners this is an item for the lab at 2948, 16th street. this item was put on and processed and noticed for tonight however we did receive a request for continuous from supervisor cam pos's office and i was able to talk to the applicant and she sent an e-mail
1:23 pm
agreeing with and requesting a continuous as well as not for quite as long as the supervisor's office had requested it. her e-mail indicates please accept this e-mail as our request for continuous and it does affect our programming and like to reschedule this hearing for as soon as possible so there's a little discrepancies there but as you know, there is a time clock when this commissioner continues as opposed to at the request of the applicant so this is now in your hands obviously we should continue at least to the 16th but there's some confusion around some other tenants in the building that needs to get unravelled and -- >> i move to continue until the applicant requests for hearing.
1:24 pm
>> the applicant has asked for as soon as possible. >> then i move to continue until -- on the applicant's request i move to continue until the next meeting. >> second. >> any public comment? then you need to come up to the mic. i didn't see you. >> sorry i just got 6 hours of hearing i came out here to speak on behalf of the lab so it's somewhat mute i see it's going to be continued. the program is fantastic i think there's internal things and i hope they get on p on top of it i know they are a well-run organization and very responsible. and there's other great ones tonight too so -- >> great. any other public comment? all right seeing none,
1:25 pm
public comment is closed let's take a vote. >> so this is a vote to continue to the next hearing. can i do same house same call? >> yes you can all right. next up is code word. >> commissioners, i do have an applicant here. this is the location of of the infamousfamous saloon, key lounge, this applicant is applying for a place of entertainment and an extended hours premise and i'm going to let the applicant come up and explain the project to you or and or do whatever else he sees fit. >> president tan and commissioners thanks for having me. it
1:26 pm
looks like we'll be spending sometime together over the next couple of weeks for the for the for the summit and the 16th as well. so with the promise that we can move things as speed ly as possible i'm willing to accept that kicking and screaming of the continuous and thank you for your time. >> just as some background the request was made by the police department and i'm sure they can speak for themselves but there's been a lack of communication and the police were unable to review the application properly so -- >> supervisors good evening i'm have i'm elevating you all tonight. so i apologize. lieutenant david -- unfortunately i don't want to do any finger pointing the folks and the
1:27 pm
leadership here is willing to accept a continuous but the short answer is the police department didn't receive these documents until today and there does appear to be a paper trail but it wasn't in the police department's hands and it got lost in the shuffle and i think the key that really did he that really deserves acknowledgment is that the leadership gives us a chance to give this a look over and please put this onto the next meeting so we can keep this moving and back on track and i will tell you i've been out there and barry reached out to me when this project started so on the abc side we've got a really tight handle on what's going on i wanted to give the captain of the district a chance to get up to speed with the entertainment and the after hours so we greatly appreciate that continuous. >> great. thank you. it
1:28 pm
seems like the applicant has requested the continuous so so thanks for the correction. let's take a motion. >> i move to continue this permit to the next meeting and more pizza, huh? >> second. >> there's a motion and second. >> did somebody second it? okay can i call same house same call? >> yeah. >> okay. pushing everything back tonight. >> i know. >> finally. >> commissioners this was before you april 7th i believe and at that time there was some neighbor concerns around the operation of the facility so the applicant did request
1:29 pm
a continuous and we're back here today and there was a temporary permit issued to the gray area gallery for an event that had been previously scheduled and they had limited their hours for for that event to midnight -- we did that in the permit so in any case we've had a little experience now and the applicant is here again to -- i think that she sent me today some more information about outreach to neighbors and so if if you can find this, front and back, take a look at that. i'm going to ask josette to come up. it's toward the back of your packet. okay. i don't know where it is. looks like this.
1:30 pm
>> yeah. >> thanks for having me back again and i'm happy to be here. it took us a little while to do all the outreach necessary to reach all of our neighbors. we've logged all of the communication based on some consultation with joslyn as well as mr. pauley. we were in the tenderloin for almost 10 years and we never experienced this before and this is our first time and we got a lot of feedback on how do on how to do this and how to reach out and we kept a log on every single time we talked to a neighbor or sent out a letter or had a facebook exchange and i have our acoustic
