neighborhood association was very very involved in market are taking the max we hold it in extremely high regard and the emerald fund was fully respectful of all almonds and the spirit of market octavia is very early supporters of all their projects 100, 150 and the poultry building. it is gratifying to see the activation of this area and we look forward to the third building going in. we know that they have done a very public and open process. on posting their plans for this building and that these proceeded and have been purchasing their building. again, given always in compliance we see no reason to not support the seven note decision of the planning commission to uphold emeralds rights to do this that they are offering some other alternatives that will bring even the grant compliance and.

registers the flexibility and creativity public spirit tests that they have in being good developers and having healthy project. at the planning commission, you know, one of the things we were talking about just need time to work out with and have all the details so the kids are protected that obviously these have been done and you agree that is unprecedented that we all care about protecting kids and we hope that all the efforts of emerald to do that will be successful. that you be able to in good conscience go forward with upholding moving forward matt and quick >> clerk: next speaker, please >> testifier: hi. my name is

that is buzzing with energy that even if few years ago were not even looked at preschool this neighborhood because there was no neighborhood there that i would not have felt comfortable same much out to school their. alder development has created a vibrant neighborhood and now the neighborhood feels safe. i am here to support to voice my support for the project to mac i look forward to being completed the can should getting to a safe environment for my child mac >> clerk:: xp for, please next speaker, please >> testifier: good afternoon president was arrested and commissioners met -- she offered to hand a letter to you to read that today represent this invisible barrier [inaudible] federation two years ago cost for page 1 bedroom one bath apartment today's 600,000 along the way to build more inflation and continues to rise on the construction cost direct plus some apartment seven built in

time, and i start in 2011 the standard is in her countrymen this change and its in store for market were to be the oldest new neighborhood in the city but is kind of interesting. we supported from the beginning the 100 venice project and 150 and 150 but because the spiky housing in this community. about the stuff that is happening lately in the mission, it is important to note our person wantonly been displaced by the development that the lease being pushed out that this an area that needs be rude about that literally within the market octavia plan. the school that opened in january was not there when they start the process is methodically taught the property owners back in 2011 2012 and 2013, it was a tomato in a tower there connected applications to tear that building out the tower in that space. so, it is kind of hard to note all the parameters the could of been it would have been in that space going forward. i think it is not a problem that current applicants should have to go back and
4:37 pm
retrace it did not happen that they did not know was can happen kind of thing. it is one of those odd circumstances, but i think that it is important to note we do need housing and this developer is also putting the below market rate housing on properties. not try to push it off to another neighborhood were incorporating it into it is important. thank you. >> clerk: next speaker, please >> testifier: good afternoon commissioners on gabe gabe goldman president of spur. i guess the narrow question you are considering is whether the zoning administrator correctly interpreted and applied the planning code. i wanted to speak maybe the bigger question you are considering. jimmy, what this boils down to is whether the planning process matters. we spent, as the

city, we spent more than 10 years working on the market octavia plan. the idea was that instead of having site by site battles over what to build, we would come up with a plan and respect that. it is the alternative to a free-for-all. which sometimes has existed in this town. i am here to argue that it needs to matter if a project comes along that fits within the vision of the market octavia plan back if we invest that kind of time, go to that kind of process, thousands of hours, all those committee meetings all as board of supervisors meetings and we zone the city, we need to do our best to welcome in a direct and simple way projects that fit within a plan. thank you.

clerk >> clerk: next speaker, please >> testifier: good afternoon tim: on the 170 member organizing the semper cisco housing action coalition. members endorse this project last year after detailed review mac we determined that it conforms perfectly to the market octavia plan which as a city is gabe has noted, are the rules we set out this area that the project informed to it, hud approved. i might ask of you that you would defend the integrity of the market octavia plan tonight. it is a little painful being here to speak. first, because this project was in the queue sooner. it was there earlier it was their fault and no. there quite public about what they were doing, but second and more important, in the middle when unprecedented housing affordability crisis, we discovered yet another delay

for housing that we so badly need. i am often the planning commission hearings in the evening and after the hearing i walked out onto polk street, turn right what is on procedure market, take the train home and i walked by this neighborhood at night a lot and the best that could be said about it is that it is on inviting. it night is dark energy and writing. the audio being here today is that this project makes a better neighborhood. it makes better neighborhood exactly this use, ever preschool.it is an ideal use as sort of testament to where this neighborhood is evolving this project together with 100 venice in the poultry project are changing the neighborhood. it would be great to see that the residents of these homes would become -- would be going would attend this new school and in a perfect world, you can

>> testifier: i will hardly support responsible residential growth in the market area. muslim favorite much-needed quality which report school provides. la porte school made 11th hour agreement is but the project sponsors development next-door allegedly committed to provide some background there will essentially show this agreement was last moment and not without reservations on la porte school to act as you might imagine it was quite shocking to learn about the details of the project sponsors than just a few weeks before the public and when the diet plan would repack -- judgeship the front do not communicated plans with la porte administration arrest the parents is deeply concerning to me and many others. i went to one of to peacefully arrange meetings held by la porte and the project sponsor just three days prior to the hearing became clear this meeting project sponsor not considered the school at all. until a few parents received a document from the planner. and then
4:43 pm
share them with a portable port reach out to the planner was already late in the game. after renegotiation buses la porte reach an agreement by some mitigation measures only one hour before the planning commission hearing. at this point, right for the hearing, other parents e-mail discussing the reasons for signing this agreement. having been put in awkward position the school came to this trust agreement based on the fear that "the most fun would back out of the mitigation if they are not willing to make such as keeping the noisiest construction outside of school hours unit that impacts the construction, drives up the cost" to continue with the coat, we believe the agile fun should we judge last early in the game by not doing so they created that time crunch. we found ourselves in. is not the school is happy with the risk of the city medications be taken off the table they refused the order. addition the project sponsors because the million dollar donation to the school was
4:44 pm
contingent on la porte not opposing the project. sony and the school support the project sponsor only because they are afraid that the pushback at this point is the spot to resign the building way that would protect the labeling of the child moved a while back, this would lose the mitigation production opportunity to gain much needed funds. so, not a wholehearted agreement for this and other reason prison by the pound service is that they bless the appeal be granted and the board withdraw the project entitlement. thank you. >> clerk: next speaker, please >> testifier: hello to my dom is on at the -- the parent and the poor have two kids and i want to specifically -- [inaudible] untitled claim from 155 that assists unsafe man on beach one of the project sponsors they note the motion of -- and 155 haight avenue office buildings. in meeting with la porte preschool parents the project sponsor reported

of a child la porte school long-term residents and visitors are seen the skyrocket of housing prices as well as the -- and i think we can do better on both fronts. at the outset i want to say this provides -- am here even though this provides no benefit to my son who belonged under the time the construction is finished. despite that i am a time to meet with the pounds the developers try to find compromises and sharp it is hearing. addenda because it think it is real important for the future children within the school kevin option. that option does not involve looking at a wall 5 feet away from them less than half the distance between us year. were leaving the city for other options. secondly, i strongly support high-density housing in mass transit environment and i think this can be done without negatively impacting neighbors as well as children. to just a couple of the oddments made respected the market octavia plan, that specifically substitute the section 309 rear yard coverage for the -- will
4:54 pm
and it is media percent coverage rule and also tracy's dissection through nine exception so the argument this is in compliance with the plan and we should at this moment thrown out just are not valid. secondly on the lot coverage the developer tried three different calculations over time that an present commission without of approved this. there is no way no backtracking going up to 83 been saying now word 84 is a little bit maybe it is okay. at this point we need to go back and look at what we are at. nor to meet the law developers reconfigure the first floor to meet with some byzantine rules in the calculation and also potentially reduce the size of the pool and that they can do that they could also go back to me with the pounds in the good options providefor the school. even those options to meet the delay to project extensively the sony all the objectives the arts fund can so get its money back the housing units can still be dealt. this building will be when our percent rented unit the amenities are less
4:55 pm
than luxurious it will meet when our percent in all the units will be available, so there is the commission to think about and consider having the developer go back to me with the pounds their reconfigure the space different mac thank you. >> clerk: next speaker, please >> testifier: my name is vanessa -- had twin boys that are three years old enrolled la porte school. we are associated to find the school. after discovering that living in san francisco there is a dearth of quality childcare. we live in south of market neighborhood and we live in this neighborhood for over seven years over eight years actually met so we really appreciate all the change the cities going through. since i first heard about this project from the pounds i did not very upset that high-rise apartment would be so i am happy feet from itunes classroom. after reading both briefs i was
4:56 pm
dismayed to see the project sponsor submit to your board alternative plans that will comply with the planning code, but not mitigate the concerns of the parents had with the 14 story apartment building so close to preschool children's classrooms. in particular i was disappointed with page 11 of the brief with a note that is on change would not modify the mapping of the project where it [inaudible] well but materially diminished the quality of the open space and pull m&a's expense by the residence of the project in 100 van ness. this indicates that the project sponsors concerned about apartment residents who may spend nights and weekends this building have less luxury amenities, while our small children who spend more than nine hours of their day will be staring at a wall outside of the classroom windows. the city talks a lot about trying to deep families and i think that tolerating projects such as this,, where the sponsor is
4:57 pm
justifying taking light away from classrooms in order to justify hot tubs and swimming pools really frustrates that point. i also like to point out exhibit k in the appellant's brief which consists of several studies about windows and daylighting in schools. based on the lot coverage discrepancies are respectfully request this board to grant the appeal and not prove the alternative plan. >> clerk: any other public comment? seeing none, will go back to the appellant for rebuttal. >> testifier: thank you. to him what about housing all the time. even with the fiction i faced this year, still now,
