cancer program. we have 11 of those and they want to not amend the charter but include a cancer and heart pneumonia presumption which i think is identical to the heart and pneumonia that exist in the police and fire plans. the third was a request of then president request that i provide a briefing memo to the retirement board related to what we expect to the the impact of the california supreme court decision denying the petitions for review of the appeals court decision for the benefits program. this is the information we have at the current time. until we have the opportunity to review a final order and make sure that we understand how to administer that final order. we can't really
6:31 pm
give an estimated timeline as to when these pajs will be made. we really don't even know when we can expect the final order coming from this in this case superior court. we assure retirees when we have the order we will make those retroactive payments to those as soon as possible. >> any discussions on this report? yes? >> a couple questions of the executive director. first of all i see the blackout list that you provided for various service providers including public equity and global custody. we talked about the hedge fund and that's been on the list for a few months. can you give us an idea how long they have been on the blackout period especially for the local custody. how long
6:32 pm
have they been on the blackout list? >> at least 18 months. >> 18 months is a long time. >> it is, we initiated it and we need to reengage callen as a consultant. and the board had approved finalist for just the custody piece and not the lending piece and the next steps we need to give all of them the opportunity to renew their bids or update their bids because they are now stale bids and we intend to proceed and get that going. securities lending piece of the business was not initiated and again we have rfp's responses but we have taken no action on that. >> when would you guess this would be on the blackout list. how long do you think it will take to accomplish this task? >> it will easily take us
6:33 pm
beyond this calendar year. >> next on the list when will that be done? >> that has been on the less probably less than a year but it is suspended and my direction at this point but it's still an on going rfp. we are not canceling it until we have hired a permanent director for the program to determine whether these services are necessary. >> and the hedge fund has been on there for 2 months and looks like we are moving forward for that. the last one governance consultants? >> that's been on less than 2 months. it closed before the last meeting. we got three responses. >> okay. that looks like it will be resolved quickly.
6:34 pm
>> i'm going to draw everyone to the minutes of last meeting where it states: commissioner report identify specific funds by name. this has been 1 month later. i have not gotten a response yet. i have also sent e-mail to staff and have not gotten a response on that. so when may i get a response to this? and what i'm asking for is simply the names of the private equity firms that the board has invested during this period. this report was presented by torrey cove. >> it was my understanding that you had been provided the information. >> no i have not. i will acknowledge the receipt. >> did you? >> it was on the e-mail. >> yeah, i was on there too. >> i apologize that. i don't recall getting it. >> i understood it had already
6:35 pm
been provided. it was not under my radar. >> i didn't recall getting it. thank you very much. >> thank you very much. i have a question for the executive director. the supreme court made a significant ruling that people can get married. i was wondering if there are lgbt folks can get married and their marriage would stand equal before the law. i was wondering if that has an impact on our city employees ability to get benefits or to enroll their partners? >> i'm proud to say san francisco was a good 15 years well ahead of the supreme court. back in 2000, we made sure that our plans conformed to when it mentioned spouse it included spouses of same sex. legal marriage was

always recognized for continuation benefits as well as for continuation of health benefits in the event of retired members death. >> all right. that's good to hear. let's take public comment. is there any additional public comment? seeing none, public comment is closed. please call the next item. >> any board members have anything they would like to bring up? >> i want to keep things moving along but we spent a lot of time talking about the hiring issue. the point i was trying to make about the use of the consultant without their participation when i was doing my own due diligence on the strategies. among the groups i spoke to was one in new york city. i spoke to them for a couple of
6:37 pm
reasons. they are a rather large and rather sophisticated. they took credit for the work done there. it's one of the reasons we wanted consultants who had experience and knowledge and depth and capacity. that is in the bullet points that we'll bring up next time. i bring that good order of information now. >> thank you very much. >> one quick comment. we were talking about getting this position filled. i just want to temper that and acknowledge that all the people that you have been hiring and all the searching you have done is very time consuming. i didn't want to do that and bringing all of these changes. i want to say i see a lot happening here and
6:38 pm
it's all very positive. thank you. >> okay. we'll take public comment. is there any additional public comment? seeing none, public comment is closed. could you please call the next item. thank you. >> no. 19, discussion item retirement board members report and comments. cohen, bridges and mac ras has reports. >> my report stands as is. would you like to add anything to the report? >> no, except the board should review the strategic foundation as a partner to the board. >> by way of reference, the foundation is an organization that's been established for 20 years now that looks to identify women and people of color and help them advance their careers in the financial industry. as we
6:39 pm
have this discussion about hiring we want to make sure we reflecting our values and hiring in diverse as well as qualified a pool of folks. one thing i'm personally interested can developing a relationship with the foundation to welcome a fellow in our system in our staff to get some experience with the public fund. so i will be setting up a meeting with as well as with commissioner bridges with the executive director of the foundation to develop a stronger relationship so that we will begin to do our part in bringing diversity within the financial market. let's take public comment. is there any additional public comment? seeing none, public comment is closed. this is just

>> now we are going into closed session. item 20, discussion item. -- reflect there is no public comment on the closed session. >> we are ready to go. thank you. i would like to acknowledge that we are going to continue item b and not to disclose discussion in closed session. >> so moved. >> let's take a vote on that motion. >> the motion is not to disclose and discuss closed session. >> i made the motion. i was seconded by commissioner mei berger. all in favor say, "aye". >> aye. >> any opposed? the motion passes unanimously. thank you very much. we are now in open session. thank
