11:00 am
and it is dumped in san francisco the person has 20 minutes to retrieve the vehicle from the police on site if they don't get there within 20 minutes it is a challenge the vehicle is towed and then the person has a lot of 4 hour window to retrieve the vehicle and after twenty-four hours the storage fees accrues and other fees so as someone that is has been victimized is then effectively victimized again by having to pay hundred or thousands of dollars to retrieve their car from the tow lot even though the person didn't do anything wrong they're on the hook for hundreds of thoisz thousands ever dollars we've seen situations the thieves
11:01 am
amount to a value higher than the value of the car so the person simply bans the vehicle the vehicles a awkward to pay off a portion and the owner is responsible for the rest this is an unfair system last year you recall i relayed e held a hearing and had a lengthy discussion what can be done i introduced a resolution which colleagues you passed unanimously calling on the mta to address this issue of towed stolen vehicles when the contract is up for rebuttal and to treat owners of stolen vehicles more fairly i want to give the mta credit for taking the request from this board seriously and coming back with the contract extension for the long term contract with a different approach to the owners of towed stolen vehicles
11:02 am
specifically the mta's administered through fee of $266 is waved for only san franciscans can be reduced by 50 percent by non-residents of san francisco the mta will wave their storage fee that is a daily fee and also the contract towed fee of $228 will be waived for san franciscans and non-residents in addition the storage fte fee is $68 plus a day instead of having a 4 hour grass period to retrieve the vehicle san francisco residents will have a 48 hours grace period and non-residence twenty-four hours grace period those are all movements in a positive direction which will give the owners of stolen vehicles sixth
11:03 am
more time to retrieve their vehicles without having to pay tow fees or reduced so colleagues, i ask for your support and this contract extension thank you. >> thank you supervisor wiener for your work on this contract. >> supervisor kim. >> i just wanted to articulate why i'll not be supporting in i understand we do need a contractor to provide this type of service over the next 8 months as the mta has rhd out the service but why today two weeks before the contract is set to expire another minimum this should have gone out 8 months ago and so mta knew that that is a 10 year contractor starting in 2005 this should have been done i understand one of the reasons
11:04 am
that mta has given the changes in the policies around stolen vehicles they needed additional time for an rfp if it was valid it would have been the appropriate time this one giving the board options when's we have time and also how it impacts the option at this point, i feel that you know the board we have to support this otherwise the service will not continue to be in existence we have to pay one hundred and twenty-four hours thousand dollars because no leverage of this negotiation so again, this happened from time to time with the departments for me it is a philosophy option vote i want to see this come to us sooner and why this can't come to us the does want should
11:05 am
let us count i know it is not possible to get out to bid i venture support the polar it was outrage for a person to pay the tow vie fee and the incredible inconvenience of getting their car stolen i think the fees are outrageous for anyone the fees are way too high we've had this conversation both supervisor carmen chu we want to examine the tow fee for any of the residents it is a fixed fee regardless of your income and has extraordinarily problems with the low income walker and the middle-income those fees had should be reexamined and the tia
11:06 am
key process our fees compare to other cities our fees are way higher than other cities the example the city find a way to give more warnings to debiting give residents the change awareness this is penalizing way to enforce the parking laws i understand we need to make sure that cars are not in certain lanes during rush hours i would like an overall reconcentration but not supporting this together it should have been brought to us 8 months ago. >> thank you, supervisor kim. >> supervisor campos. >> thank you madam president i do want to thank supervisor wiener for the work i will be voting no on this for the reasons that supervisor kim
11:07 am
outlined i do have concerns about the process and the timing of this and i worry that because of that we'll end up paying more than $400000 more i have to say that i share the concern in terms of the amount of those fees i paid those fees before and i know that was not an easy thing for me, you can imagine how this impacts lower-income folks that i think will have a tough time so i think that reimplication of the level of fees that should be charged is appropriate so for those reasons i'll be voting no day today. >> thank you, supervisor wiener. >> first of all thank supervisor kim's and supervisor campos for their remarks i think we all agree tow fees not only
11:08 am
in san francisco but a lot of the cities are excessive in terms of the impact on people we've made improvements around people that trial video no culpability because their cars are stolen and dumped there are also plenty of people their cars are not stolen but they missed a sign or whatever the case and ends up being a problem in a number of areas in the country my understanding is that tow fees are pretty high in the bulk of the bay area not only san francisco i think that has to do at least in part with land values and labor costs are higher than in the bay area than other parts of country but especially when iuoe i look at
11:09 am
our towing lot the rents is steel high this is not to say that the fees couldn't be lower but the partial examination i want to say i've been critical in the city's approach of the towed stolen vehicles not have auto return auto return does what we ask them to do automotive return we have a bad history of tow contracting with rampant corruption in terms of the previous contractor it is a terrible, terrible situation auto cleaned it up and everyone's views of the fees the operation has been professional listed and well run in addition the mta drives the revenue from the tow counteracting and to changes to the tow contract have revenue impacts on
11:10 am
mta and muni 80 percent of parking revenue goes to the public transportation system so what i'll say to colleagues now we have actually grate tuesday an 8 month extension over the next 8 medias they've think finalizing the krashlt with auto return that's an 8 most window for the members of the board to express their views of how the fees should be different and part of that conversation where the money should come from when we had our negotiation is mta around the approach to stolen vehicles part of the conversation if you go with this option we lost one million dollars if you go with this we'll lose 5 hundred and so on and so forth so trade offs for
11:11 am
public transportation so colleagues i'll encourage you to be involved in that conversation and gnaw our views to the mta and be unproductively involved to have the best contract every. >> thank you, supervisor wiener madam clerk can you please call the roll arrest commissioner avalos supervisor breed supervisor campos no supervisor christensen supervisor cowen supervisor farrell supervisor kim no supervisor mar supervisor katie tang supervisor wiener supervisor yee there are 9 ids two nos with supervisor campos and supervisor kim isn't descent okay. this resolution is adapted madam clerk can you please call item 45. >> item 45 through 47 were by the audit and oversight
11:12 am
committee and forwarded item 45 an ordinance to authorize a lawsuit by marshall and swift against the city for $395,000 in august 1st for the district of california. >> roll call vote. >> on item 45 commissioner avalos supervisor breed supervisor campos supervisor christensen supervisor cohen supervisor farrell supervisor kim supervisor mar supervisor tang supervisor wiener supervisor yee there are 11 i's this ordinance is passed unanimously on the first reading item 6. >> was to amend the administrative code to allow the
11:13 am
civic engagement to provide interpretation services at every boards meeting for the board of supervisors for july 2016 and to require the average office of civic engagement to reduce the reports at each meeting. >> supervisor yee. >> thank you supervisor breed that creates a pilot program for spanish and tagalog and chinese at you'll board of supervisors starting in 2015 currently, we honor the request for the interpretation 48 hours in advance but all requests the staff goefd above and beyond, however, difficult to provide the services sometimes we're not able to get an interpreter and other times to rely on the staff
11:14 am
for their supervisors for support we have come across this a few times just in the past few months with a constituent requiring interpretation and had to find one because an interpreter was not provided we have residents from every corner of the world approximately 36 percent of the city's residents are immigrants and of the total population identified as limit english speakers we have one of the strongest language assess policies in the nation and this pilot could help us get more people involved in the political process i remember over 10 years ago when i was at a fellowship and foundation one of their key
11:15 am
exponents was a language access and i was in baltimore they said we'll host a meeting on the language access and in the bay area they said why the bay area they especially\know where i was they said informs san francisco has one of the strongest policies around this we should be proud at every supervisors meeting the average office of staff and civic affairs will be available to owe offer of the languages in tagalog and chinese and spanish and provide the interpretation of the legislation introduced or the pilot will last until july 2016 to see the results of this if staff at oc m to work with the protocols to see the accessibility i want to make sure we respect the staff time
11:16 am
and set reasonable exceptions for that the public implementing some of the meetings are long and we can't expect that someone will be here and need the tagalog transportation authority plans & programs committee translation but i want to acknowledge and thank the office of occ executive director adrian working on this proposed pilot and thank the staff of the clerk of the board of supervisors who worked tirelessly to help and especially hard to accommodate those with language niece and finally after our economy meeting we continue to work with the office of the city clerk to expand this to the interpretation of hearing nos for example the required
11:17 am
translation nos under the administrative code chapter 31 regarding environmental review depreciation there are additional languages that strengthens the proposal finally i would like to thank the co-authors supervisor president london breed and supervisor mar and supervisor campos and supervisor campos and supervisor christensen and supervisor tang and especially my staff jen who worked hard to put this together to make sure we have the input of all the offices so in in front of you i don't think i have to read it thank you very much. >> supervisor yee has proposed amendments that that have been complicate seconded by
11:18 am
colleagues colleagues seconded by supervisor mar can we take those amendments we'll take that without objection. we'll take that without objection. those amendments pass supervisor mar. >> i wanted to thank supervisor yee for streamlining the city of our language equality policies i wanted to acknowledge that in 2001 which santa fe san francisco and oakland passed the language access ordinances that was updated in 2009 by many of us including assemblyman david chiu but also a number of us in the room because of the strong community-based last thing access be network and wanted to thank from the chinese action and the others 78 organizations from 2013 we passed the african advocacy network and bruno heights and the reach center and
11:19 am
the chinese and the filipino action center and self-help for the elderly i want to acknowledge this is about strengthening the voice of immigrant communities to be present and engaged in our board of supervisors meeting i i know that the various forevers over the years for increasing the language access are important for los angeles monitored communities when supervisor yee and i and supervisor kim were on the school district i know that our language and interpretation office office of translation services was a good model seen by other school districts seen by large english limited populations i'm gladly our city is moving forward i know the translation of documents is expensive i am appreciative of
11:20 am
the one of the steps that increases the language for immigrants and limited english populations so i really thank the language access network and supervisor yee for moving forward thank you supervisor mar and supervisor cohen. >> thank you very much supervisor yee and i also want to acknowledge the staff jan leo for the work i was wondering if there's a representative from occ here today. >> definitely not i've been supportive of language assess and taking taken a vote in the past my comments are not critical of pretending language access but only questions of evaluation of the pilot program i'm curious of the tools to evaluate and who is which entity going to be evaluating the pilots program through the chair
11:21 am
to sdmooe i'm going i'm not sure i have the answers fully backside but i'll be interested in the other fact the office of civic engagement is one i use often when it comes to interpretation for the neighborhood members of the committee so i know how they're very stressed in that capacity so i'm wondering because i didn't hear in committee and there is not one here today i'll entertain a conversation how if there's able to actually perform and execute the pilot program to insure that will be successful and to make sure they have the resources staffing budget equipment technology i don't know if we need prescriptions to different translation software
11:22 am
to help to execute the pilot program to provide a seamless opportunity for a hundred percent engagement and the other thing what happens if we're here and have folks ready to go in terms of translation but no displaced how do we account for this i'm not longing to allows or lose precious resources so this really stems to my original question how to evaluate the pilot program and will there be an opportunity to get february from our end users the people that are coming to utilize the service is there ways to strengthen all four through the chair thank you. >> thank you supervisor cohen. >> supervisor campos.
11:23 am
>> thank you madam president colleagues i'll respectfully schizophrenia we resend this item to vote for it my apologies. >> supervisor campos has made a motion to resend the vote on the amendment is there a second sejtd by supervisor cowen colleagues, can we resend this we'll take that without objection. we'll take that without objection. the vote has been rescinded and supervisor yee would you like to make the motion again. >> yes. >> on the amendment. >> like to make the motion to amend the legislation. >> so supervisor yee has made a motion to amend the motion and seconded by supervisor mar and colleagues can we take that without objection? without objection the amendment passes >> supervisor yee. >> there the president i guess
11:24 am
the high-level sort of we are for the purpose of the evaluation was to make sure that whatever i mean we put affordability a fungal and doable so it is not in stone but wait for a year to see what happens we anticipate in needing more resources but would that anticipation be the right anticipation and not for instance, it took while to get it we talked about staffing a lot because there were other supervisor tang's ordinance also requires some staffing so it was a combination of those two things where we were working in the average office that office to figure out what would be appropriate and so in the budget process that just been taking
11:25 am
place we added some fund or the mayor added funding to that office to have more staffer members to hopefully not to cover what is required in to ordinance but supervisor tang's ordinance in the no demand piece you pointed out that's a good question i suggested that the model by the used for the given by the school district that is pretty-pretty successful but they do they come the translators come at the beginning of the meeting and make their announcements in the appropriate language just to say you need us to translate or interpret please let us know we have translators and wait around
11:26 am
for a while and at some point some of the people are a member it to could be of mowers o hours they are not going to stick around for 6 hours that would be the model as what's needed so that's why it is a pilot so if that models works well here. >> thank you very much supervisor yee. >> on item number 46 as amended colleagues can we take that without objection? same house, same call? we'll take that without objection. item 46 passes on the first reading unanimously as amended madam clerk call item 47 >> another motion to retroactively the servicing to
11:27 am
sick leave to the healthy work places for the family acts of 2014. >> colleagues, can we take that same house, same call? this is approved proved an amazing. >> 48 considered on july as pursuant to the boards rules of order as this is the proposed charter amendments first appearance that shall be continued until july 21st when the board considered it order a chartered amendment to allow the city employees to take leave of the same child to receive the maximum amount of paid leave for the employees to retain 40 hours of sick leave. >> thank you, colleagues i'll
11:28 am
keep my remarks short and since all 11 co-sponsored this i believe you, you all know as madam clerk said the charter is so i want to thank my colleagues and look forward to the yearlong effort ahead of us as we look at other ways to make our paid leave for family-friendly thank you very much. >> thank you supervisor tang colleagues can i entertain a motion to continue this to the meeting of july 21st 2015. >> motions by the colleagues can we take that without objection? we'll take that without objection. this motion to the meeting of july 21st, 2015, >> madam clerk can we go to roll call vote for introduction. >> commissioner avalos is first up to introduce new business. >> supervisor campos. >> thank you, very much.
11:29 am
colleagues i'll be brief i know it seems odd as we're facing a severe drought but hopefully the rains will return and there will be issues of flooding and today i'm introducing legislation to help small businesses and residents in any district who are impacted by flooding in the area of 17th and fulsome this area being the lowest part of the city therefore the cities worse flood zone specifically my legislation will amend the public works code so if it property owner is doing a floodwater management program that is if you wanted through grant it received his or her receives from the public works they'll not be charged an ascertainment right-of-way fee on march 19 of this year i held a meeting we talked about public
11:30 am
works staff and local residents and business owners have worked together to go look at because of mitigating the flooding two ideas have come down to kilogram news the flood program this grant program is assigned to encourage the project sponsors that lowers their risk of damage harm due to flood costs by rainfall originally only certain types of promissory notes programs and with this the grant program can meet the specific niece of businesses in thereby area the second proposal which is what i'm introducing recommended to waving the fees and get those projects involved in the minor encroachment accepting the projects makes it easier for residential
