5:00 am
the homes were built their two story has a 7 foot ceiling not able to convert it to usually space and sometimes a little bit sometimes, the height ceiling height would be too short even for a 7 foot high ceiling because of the foundation we had an basement think the first floor as well as a garage on the second floor is where the 7 hundred and 50 square feet and in that home before the fire was a two-bedroom one bath the bottom floor basement couldn't be a legal living space because of the ceiling height
5:01 am
requirement the new home on the other hand, is third floor and has 8 hundred and 50 square feet versus 14, 11 there's the living space is one thousand plus square feet instead of 7 hundred and 50 in addition three large decks that come out of the back of the piers from the third floor 14 feet out in addition to being stuck to at the previous line the second floor goes out past the current line and another deck on the one story i have a picture showing if you can look at the foundation that we all kind of thought that was the house burned down as you can see
5:02 am
all of their foundation stopped at the same place of the neighborhood property they're all similar around that area on january- we were - oh, i'm running out of time the architect met us in january 2014 i had only talked about new issues and in order for him to address those new issues that he gave me a new seismic schematic showing he made changes to the property in order for it not to obstruct my view we were to look at the picture of my home this is not the case because right here this
5:03 am
is - i put on the groin where the building goes up to and an obstruction but in addition a deck where mile proposal i have privacy concerns because someone will be on the second floor eye level at my bedroom window sorry i'm sorry. >> okay. you'll have time for a reasonable person. >> any members of the public in support of the dr requester. >> good afternoon. my name is anna i live athens from the family i say that because it is 3
5:04 am
started house and then all the house is the same shape over there and then that i'm concerned i'm very concerned because that house my house gets sun only in the afternoon and this house the 3 if they build there the 3 stories will block any house sun they build that house my house will be medical do in the house my house didn't get sun because the other rows of hosing houses in the backyard i don't get sun in the bedroom and backyard i'm concerned because i don't get you live over there in peace for thirty years i hope you understand me thirty years peace i like the house because the sun in the
5:05 am
afternoon i planted i will retire there and get the sun in the afternoon over there but now i feel something no coming because they build the house the house over there is always like this one behind to the other one i don't know if you want to look as you can see that or no or no. >> you can see one one one and nobody blocks anybody i want to tell the architect please build the house the same way as the other ones because everybody be happy and peace we had our neighborhood the block i live
5:06 am
for thirty years is like brothers and sisters one thing he don't have problems with nobody welcome to the athens but leave the house same as before thank you very much that's all i want to tell you. >> okay project sponsor. >> your team has 5 minutes. >> thank you. i'm alex the project architect we've been working think on this from march from last year and working with the projector o project owner that wants to build a building legal 7 hundred and 50 square feet that people use that bottom floor as an illegal bedroom how design take advantage of the
5:07 am
legal units the overly size is 4 leonardo da vinci square feet larger than allowable to have a third floor and following the combvlz with setback we take advantage of this opportunity to use that space we've met with the neighborhoods that are 311 meeting and we addressed the series of questions the neighbors had at this point she had significant concerns of her view to the side might be affected and at this point we modified the project setbacking and taking the corner a diagonal bay at the back of the house comes to improve her view if you're standing in her space the photograph you saw i'll not see our edition there
5:08 am
was additional concern from the neighborhoods across the street we look at the project and lowered the project a float in height and squeegees it a little bit more in terms of the light she's on our south therefore not shading her okay. so let's say our main concern the feel of the project will disturb the tip lodge she provided me this photograph if i could have the screen first, let's start with that one that is the photograph this is where the house is not existing we had it demolished by a demolition order
5:09 am
i provided to her this image that should have been included at this point back here is actually all the third floor as you're looking at down the street as this photograph was provide by her we think this works well, the space and the third floor allows us to get a rear master bedroom space for the owner to use as such we hope you'll take a look at it and approve the project as is thank you very much. >> thank you anyone else from the project team any members in support of the dr
5:10 am
requester sponsor. >> i'm a homeowner on athens street i wanted to oppose this i have big concerns with the structure size. >> i'm sorry right now the members in support of the project as opposed to the dr i think the chair will reopen. >> let's first see if under is anyone in support of the project okay. he think there was confusion go ahead and speak now members of the public opposed to the project. >> that's all i wanted to say and parking concerns. >> thank you. any additional comments >> good afternoon, everyone
5:11 am
i live across the street of the proposed building and one of the reasons why my husband and i bought the house was the view building a third year home in front of my house will block the view without the view i believe that it will lower the value of my house and another thing looking at the loan at all house in between the row of uniform houses of 2 story houses is to me it awful i oppose the building of the third floor house. >> thank you. any further
5:12 am
public comment? public comment is closed. >> dr requester a two minute rebuttal. >> sorry we're all different neighbors in all different homes we were not discussing anything we were going to discuss but i wanted to make the point that is another picture i have that the architect had given me previously from the looking up the hill you can see this here there is a balcony so deck railing it doesn't seem to be in that picture i'm not sure why but decks on all 3 levels this is a very big home double in size of the legal living space it does create privacy issues the back of the home people on
5:13 am
those decks are standing anyone of average height can look at my bedroom and we're concerned i'm gridlock concerned about the effect that the change in view has on my property value the homes across the street are all about 11 hundred and 12 hundred liveable square footage on their side ours is 7 hundred and 50 our home values are less than hundred and $50,000 because of the advantage of being on a hill and having a gorgeous view with the deck it goes back across the fence in any backyard as well so i can't see that not having a significant value i'm going to ask you to presidential you know take a second look at those are
5:14 am
not parties and it is being done at the rest of the neighborhoods expense and takes away the co-heaviness of our homes. >> okay project sponsor two minutes. >> for this chance to responds the photograph was, in fact, an earlier design the design i brought to the initial meeting and lowered the view so actually now if i could have the screen the view of the house missing with the scaffolding that was having the house demolished so she could do the repairs after the fire
5:15 am
we went ahead the house is lower now it can, seen the step up of the hillside a concern that is about to change the space they've been architecture efforts to making the project fit in with the 15 foot setback coming up the hill i hope after the house is built there will be a feeling more successful than people are concerned we've stepped in and tried to address the issues i've offered to provide the images across the street, i believe there will be blocked by the sun and additionally i ask you to review the project as provided in the zoning departments suggestions thank you. >> the public hearing portion is closed. >> commissioner antonini. >> thank you. yeah, i think this is a well-designed replacement home
5:16 am
it is the third floor issue a lot of time we talk about the floors it is about the flight and setback 15 feet in accordance with our design criteria and if you take into account the pictures that were shown and you look down the street with the building empty and the proposed building in place you really hardly see that at all and not bearing on the view that was shown there so i think that although views are not electricity of it interferes with the view we'll not change because of a interview the privacy issue is the same in san francisco you're going to have people in adjacent homes looking into our windows you have to pull the blinds that's
5:17 am
all you can do in a dense environment it is well done and well done conceptually because of the severe slope of the hill the edition is covered by the home is quite a bit higher so the hose house to the south at drerns house looks at over the top of edition i can't see anything exceptional or extraordinary circumstances. >> i'll move to not take dr and approve. >> second. >> commissioner richards. >> i see the notch out so it i
5:18 am
look at number i guess 5 number 3 on that page if you look at how her bedrooms the deck next door it the representation it would be really hard so have someone will they'll have to try to be peeking into our bedroom to try to see in that looks like enough of a space from the sideline i can't tell how many feet but it is significance 20 or thirty feet from here to here maybe commissioner moore can help me out i wish i - the project was go taking into consideration with the project in mind we have dr deductions around houses that are three or four or 5 thousand square feet i know the surrounding
5:19 am
neighborhood is 7 hundred 50 but it is reasonable to educated code. >> commissioner moore. >> i'd like the architect to talk about the philosophy about the decks explain that to the commission. >> there are one deck the main living space on the second level and as such the space blow is an get a business man to have a open space for people to be out in the open air weighing we've put a deck directly we needed space for a dining room we added the dining room and above the dining room it seemed like a good opportunity to have a upper
5:20 am
floor for an upper deck the lowest deck actually as the street slopes goes down stepping we've proposed a deck 5 feet above grade. >> could you comment on the fence by which the project sponsor delineates that who several times mend if you're going beyond what constitutes the end of the property. >> along that entire block a series of events where it begins to drop about a 50 foot space for almost every property on that block is left completely unused by everyone that's the
5:21 am
space we put the lower deck to get more area. >> so the fence is not delineating the end the property. >> it is a fence. >> someone put it there it got steep and not worth at the time adding a deck. >> so a personal decision to put the fence there. >> it could be yes. >> thank you. >> there is a motion and a second not take dr commissioner antonini. >> commissioner johnson commissioner moore commissioner richards commissioner wu so moved, commissioners, that motion passes unanimously 5 to zero. >> commissioners that place us on item 17 and we have arranged
5:22 am
for an interpreter louisiana are you back there thank you louisiana for saving the day she's here so thank you lou lou of course. >> lou lou does everybody for the department without her i'm not sure where we'll be in the dr requester can come forward for this case on 45 after a discretionary review she can speak in there and you can speak in there.
5:23 am
>> (speaking foreign language.) >> i think we're going to have to translate in shorter sgralz. >> how high or how tall of the building didn't care the main concern is the door where they put that
5:24 am
continue. >> (speaking foreign language.) >> lou lou you should - >> sorry. >> lou lou you need to in the micro. >> she didn't want the door do move where the window is here daughter is working here right next to the front door it is too noisy people go in and out and she needs to concentrate on her
5:25 am
work and then the backyard she objects on building the backyard because her kitchen is looking right at the backyard and she has some objection to it. >> (speaking foreign language.) >> okay
5:26 am
one of the reasons she objects to have the. >> (speaking foreign language.) >> i think is the what do you call that? a platform or deck sorry because if people are on the deck they can see right into their kitchen so she feels it is invading her privacy they usually their age closed it is trevor to their lifestyle
5:27 am
>> (speaking foreign language.) >> she says they already have the big deck but she suspect in deck has no permit but already have a permit and building another deck her concern. >> thank you. >> thank you. >> okay. any speakers in support of dr requester? >> lou lou maybe i can translate that. >> any speakers in support of the dr requester. >> (speaking foreign language.) >> she's the only one here. >> okay. great thank you okay project sponsor. >> good afternoon. i'm jason
5:28 am
shields the project sponsor and owner and designer etc. so there's been a couple of concerns bought up that is the door was originally moved closer to they're building and then the last design has been moved back to where it was in the photos that were shown before in regards to the deck in the back our original project my wife said has been changed to make that smaller in scale for financial reasons and consequentially the house has shrunk in size and there is a deck out back we live in the
5:29 am
city with three children and we tried to get our kids outside as much as possible noise is a concern for the neighbor i don't have much else to say i'll answer questions anymore specifically thank you very much >> okay. any speakers in support of the project sponsor any speakers in support of the project sponsor. >> if i may add i went around the block on our street and have signatures from multiple neighbors who have no problem with the project. >> okay. thank you. >> okay. any speakers in support of the project sponsor didn't appear to be
5:30 am
