tv   Entertainment Commission 121515  SFGTV  December 19, 2015 5:00am-7:01am PST

5:00 am
>>[gavel] >> welcome to the tuesday, december 15 at damon commission. my name is brian kim. i'm president. before we start with a roll call a few housekeeping items. if you're a member of the public, like to speak on any item you see on the agenda we have these pink slips up here that you fill out. and it to our staff and alcohol new ones were open for public comments. second, if you could please turn off your cell phones or put them on silent so that we can not be disturbed during the meeting. finally, thank you sfgov tv for your services and producing and airing this lab to the public every time we meet. organa go ahead and start with local. >> commissioner frost commissioner lee commissioner joseph commissioner perez
5:01 am
caminong president tan >> for house. we'll start off with public comments. this is for public comment on any item you do not see currently on the agenda but does relate to the work of the entertainment commission. a public comment? seeing none, public comment is close. leon to item 2 approval of minutes for november 10 meeting. commissioners, if you want to-hopefully you have reviewed them and if you have any edits or motions? >> i moved to approve >> moved and seconded. any public comment on our minutes? let's take a speedo. >> the minutes pass.
5:02 am
>> i've seen because i was absent for the last meeting. >> november 10 with the last meeting. were you present? >> yes, i was. >> okay. there you go. >> the minutes pass. item number three report from her executive director and staff. do you want to take it away because >> i will take away. good evening, commissioners. we have a written report which i don't often do but i sent allot attachments. i want to give you a proper memo. just a brief update on what we're going chapter 16 or in other words, the protection ordinance which sounds much better to me. all the letters have been sent to the planning department. as you
5:03 am
may recall was a very long pipeline that we had determined would meet the criteria, so it took a while in a big set of letters that has gone out. so, all those are out there and slowly but surely i'm getting kind of e-mails and phone calls from private sponsors sponsors asking me what they need to do next. so, the committee has met several times and i guess over course of a couple months we've come to the conclusion that we needed a form. one of the things that is attached here -it's three pages at the moment although it's a work in progress, is a project sponsored form for projects within 300 feet of places of entertainment. you can take that home and take a look at
5:04 am
it. especially those of you on the committee, to see if it's comprehensive enough. ask the right questions so that we get a basis for if they come to you at the committee level. you know, the basic sort of discussion. so, next year we are in a proper hearing room to my thankfully for the committee which is far late and i put together a schedule because the president and i discussed the need for the frequency of the rvr meetings. we determine once a month is adequate based on, again, how many of these projects are coming in the length of time it's taking to get them analyzed. so, there is a schedule here that i sent out to you guys last week, and for those of you on the committee, if there's any issues with the schedule but let me know for the year 2016. what things moved around. space is really hard in city hall. so, i think
5:05 am
that is it pretty much. i started-i just want to tell you- it had been discussed and particularly, when charles--met with a committee we should come up with a best practices kind of guide for sound studies being done for residential projects within 300 feet of places of entertainment. so i started to jam something out and spoke with charles on the phone as well as connected with the health department sound folks. so, i guess we are halfway through that, but again i think that can also be a work in progress. something that we can send to people because, ideally will see these well before the sound-where those tonight that will get you later
5:06 am
is enough space. we have an opportunity to influence how the sound study is done and make sure it's done in a way that's adequate or better than adequate. >> i have a question. for best practices how is this done done or how the jewelers use? >> how to conduct a proper sound study. >> okay >> the other item under the policy update for the commission is related to the cannabis task force. the supervisor wiener created a task force, and a rules committee finally met to determine who would be the members of the task force last thursday. it was like a monumental, all day, literally nine-hour meeting. there are 14 seats. there were 40 odd candidates. entertainment commission is involved because we sit as a nonvoting member of
5:07 am
the task force and will be involved obviously heavily in terms of how organic interact with nightlife and nightlife businesses if and when cannabis becomes legal in 26 and get this is the city's effort to be prepared for something that seems somewhat inevitable although it's not clear in what form. so, there are 17 possible ballot hedgers and at the state level, when and if something gets approved, the city wants to be prepared. so, the group is being staffed by the public health department, which i think is good. i think they're going to be really on their game and supposed to meet in january for the first time and have maybe quarterly with some subcommittees as well. i'll keep the commission informed as we go along. as we need for the
5:08 am
balance of 2016. on the topic of commission seats and vacancies, you see are missing somebody here and that's because as you know, commissioner-left the city. so we had to step off. we tried very hard to find the time at the board level to get another appointment in this calendar year but was not going to happen. so, we expect to be on calendar rules committee with whomever applies to early january. i also attached images for the heck of it, the announcement which is been up on the web since november 19. the vacancy announcement is there. it's a publicly held c. if you have anyone that you may know that might be interested, you can point them to the web or give them this piece of paper. in addition, the ever so
5:09 am
slow hr practice in the city is moving ahead and the position that we were funded with in the last budget cycle is nearing the point of announcement, and filling. so, again, this is an outdoor event analyst position. with an emphasis on analysis. it's been classified as an 823. the position announcement is final but will won't be posted until after the holidays because i wanted to get the most attention it can get. if we put it up now i think you would get lost in the shuffle. so, the intention is to post from january 4-18th and then we will land on interviews and some kind of higher in early february. so, we are looking forward to that that will be exciting. the last thing that i want to do is tell you about a
5:10 am
corrective action it's been a long time since anything under the heading of corrective action has taken place and that was a good thing. unfortunately, or not, we did issue a direct order on november 20 based on the incident that i think you may heard about. that happened that the seller on saturday, november 14. based on that incident, and the concern we had , that or maybe some reaches with security protocol, we basically included a revision of the security plan, which then basically puts a bunch of new conditions on their permits. so, in a memo. it tells you what those are and essentially eliminated one weeknight of operation provides the security plan in writing
5:11 am
which they did. adding a ratio of 1 to 25 which is a lot we think it's important right now to help with end of the night crowd control and dispersion, which is where this problem happened. adding at least one long-range night vision camera to the outside of the front door . and having all those be functional which we know that's been a problem. then, letting the commission, as well as the police department know about anything out of the ordinary during special events. so, we feel pretty good about-they were receptive. they signed document and did not argue with the city. it comes and goes at that location it's a tough location. they're doing a brisk business. things happen. so,
5:12 am
that concludes my part of the report. if you want to take questions now about what i said or i can hand it over to the inspector >> let me do that. any questions for the director commissioners? thank you. i have a couple minor but i'm glad you guys produced the actual project sponsor form. i think it's going to be super helpful when we start reviewing those. let's go to inspector inspector burke or inspecto holly which everyone. >> good evening, commissioners. just a few items to cover tonight. it's been a while since we spoke so i want to kind of cover some trends i've seen out in the city the past few weekends. we did get our first complaint since i've been on, i've been inspector for the regency center. the complaint
5:13 am
came in for the regency ballroom and right now working with the complainant's and management and monitoring the situation to figure out exactly where the sound is escaping from. they do have a new dining in the basement called a social hall. i have a suspicion that maybe some of the doors or windows that are facing sutter towards this new--ish apartment complex maybe it's the cause of the issue. humanitarian has been very responsive and have been in touch with the complainant's overtime to work together to bring this to conclusion. i have been working with mission district pd at --trying to monitor a situation in which neighbors are complaining about jukebox mariachi band and although this does not fall necessarily
5:14 am
within our jurisdiction but i'm trying to monitor with the help of pd to try to bring some closure for the residence. there's some confusion around permitting. confusion around jurisdiction. the operator now is attempting to obtain permits . they just don't exist for it. so it's a little bit of organization and a lot of communication and event agencies working together. there is a block in upper haight . a complaint came through mary ellis trophy room. there's a couple different establishments on that block. the complainant is on the other end of the block and i'm trying to right now establish this complaint just came through this week-which i do establish the source of the issue. if there are any permits that need to be updated or apply for, and get to the source of that problem as well. a quick update
5:15 am
for-that i mentioned recently, i believe there are some new -this is on mission street-across from the new--ish complex called beta. i noticed recently some new security staff, new promoters and were trying to work it work together to make sure that stay safe and quiet and in that corridor of the mission. a lot of new residential. a lot of new it seems like some changes in entertainment, new promoters with new venues and new venues popping up. so, we'll keep an eye there as well. >> it wasn't a complaint or something? >> we've had complaints come in about balance walk but there've been anonymous so it's hard to coordinate an anonymous complainant regarding when
5:16 am
things are happening. so for me to be on call and witness something as it happens has been difficult. the particular incident that i mentioned here was something that i drove by just on patrol. >> commissioners, other questions for sgt. burke? all rights. right along. >> good evening, commissioners. several items to report to you about. we'll start with complaints. i received another complaint. we've had ongoing complaint with the basement, 222 hide. i received another noise complainant that i'm probably can i go by this weekend to see if maybe another violation can i suspect that i might. it's been maybe about five weeks since i've been by there. our
5:17 am
issue the citation form. i've reported that the previous hearing. it has not been paid yet, so action is pending, but i do think were going to continuously have problems with the basement. i mean i been doing it with it like eight months now and it's pretty clear that's going to be the case. so i will report to you whatever action that we may want to take. i'll report to you about whatever happens you can decide what action you want to take. >> are the complaints going to you? >> directly to me. i think a couple times they may have went to 311 or something. >> this ever been police involved? >> no. not that i'm aware. >> in your estimation by these complaints about? >> the complaints are valid. i been by several times. they are valid. basically. i could go on and on but about. neighbors and
5:18 am
the building. >> other residents? >> residence above him. >> the equipment he was getting when he was first applying is already overkill. >> it's huge. >> have eight attempted to take any the out? >> he actually added baby like two months ago at a sub water in the bar area so i told him, first of all, it's a violation of the permit anyway. also, i told him to turn it off when he first got it. they, you know you need to fly under the radar basically because there was a lot of issues in you getting the permit because of this. you need to fly under the rape. he turned it off for a little while but nevertheless it's
5:19 am
back on. i dropped in a month and a half ago. it was at 20 db above. grossly out of compliance. so, we will see going forward and i'll report to you about that. update you about it. >> i received a complaint about the doing a covert location it 917 fulsome. there's an issue with a neighbor could obviously it's just opened last month, so i talked to the neighbor. i talked to barry. i put them in contact with each other, so i believe it will get resolved. barry is responsive so i think it'll get resolved. i'm just going to wait and see how that plays out but i think it will get resolved. i received another complaint about hawthorne, 46 complaint about hawthorne, 46 dear st. i been receiving a lot of complaints about hawthorne but i've been by. it's on my regular route. i'd never hear what the complaint complainants
5:20 am
are hearing. i stood out there and talk to security for 10 min. in attention to what i'm hearing. i never hear sound issues in regards to noise coming out of the venue and they're saying it's coming out of the venue, this type of thing. patrons are lucky i never witnessed that. i'm not sure what's going on there. a reader something else going on. maybe it something where this and interior noise issue. i'm going to follow up and see what we can buy, but at this point, i really-with my experience in dealing with a lot of different venues in these types of issues i don't think there's an issue there, but we'll treated fairly >> what about the basement of the building? they are belowground >>) >> is there a lot of presidential run their? i think mostly commercial, right? >> osa it's mixed. there's a little bit of commercial and residential also. this am across the street. people
5:21 am
always in and out of the building across the street so there's names from taxis or whatever. people standing across the street. there's a lot of stuff going on that. >> art galleries and clothing stores. >> and the market is right there. so, i mean, i'm not sure what they are hearing but hopefully we'll get more detail about it. we were doing with it last year and i don't think i could we did not find any compliance issues. >> what about maven lane, in the back? this sum was coming there from other places, but are they confused? >> i don't think they are confused but i'm not sure i've not gone back there. >> they used to connect. they used to smoke out in the back but i don't know if they sealed off now. >> now people smoke maybe two storefronts down. >> can go down there no more. speak >> people smoke in front. >> they probably bought
5:22 am
blocked it off now but it's weird. >> two different complainants. one of the complainants was in contact with inspector burke last year so they been affording new complaints, and then i had a separate complaint that i believe came 2311. i too look in my e-mail to figure out exactly the details but two different complainants right now. two or three. so, it'll be on my regular route but we will see how that turns out. i received a complaint about audio . nightclub noise issues. i went by. i went to the gm. i went to walk through inspection. they were compliance. really i think there's a bunch of been using
5:23 am
it even if every venue was more than compliant, there was to be a noise issue for people because there's multiple venues. nevertheless, will treat the complaint as we treat every other complaint. we'll do some follow-up investigation it will start with her residential. see if we can isolate noise to anyone venue. i suspect we can't but >> audio and beatbox are literally next door to egypt. you have a beatbox complaint also? >> i do. >> you can't distinguish from a right? >> this person is on the corner towards--what is the cross street. fulsome. 4 howard st. the audio complainant is on howard street. are easily dna- >> a complete city block away? >> reichard doesn't >> howard. and-yes, beatbox and audio are located between
5:24 am
harrison. it's not harrison. >> there's butter. there is dna. there slims. there's a bunch of venue. so, i don't know she's attributing that to the venue but nevertheless all check it out. we'll get to the bottom of that. i also received a complaint from a neighborhood is located behind 11 street on norfolk and he was complaining about beatbox kid i went by on the night i tempted to do a santos. my meter was not working get a minor issue but nevertheless it was not critical to what i was trying to discover anyway. where he is located, he is adjoined with wish lounge. there is holy cow.
5:25 am
there's beatbox. there's audio. it's the same issue. i'm not sure how to isolate the noise to anyone venue, but nevertheless it's the same thing. i went by and so one of the venues is working to try to bring their level into something that's reasonable for him and if it works and works but i suspect it won't. will do everything we can to respect his complaint and try to do something to help him but >> this is the beatbox complaint? >> yes. the night i went by there was no issue at beatbox. so, it's the same as the audio situation. i don't think there's really- >> did he just moved to the neighbor? >> he did get six months ago. he said he knew about the sound issues but nevertheless this is the situation. it's a minor issues, minor compliance issues. a bar on bush street maybe two books from the seller and other
5:26 am
nightlife establishments. about windows open, pager noise or whatever but since it's got cold, there has not been any issue with them having the windows open. so that's a non-issue. and the vessel, open back up under new handle 11 propaganda i've not had a chance to do a walk-through inspection but to security. he came and seems like things are going fine there. i will be by to check it out and i'll report to you blog about what i find >> is it the same management their? and a bunch of issues i vessel >> it's the same. and it knew security team. it's right over there. >> two avenue sound system? >> on archer of the details >> their old sound system was a functional and without a box. the speakers were free hanging
5:27 am
speakers, wrote speakers, not ones that were in wooden boxes. they hung. pretty powerful system. >> i will check it out. i will report back to you about that next time when we need. if you have any other questions of a happy to take them. >> a lot more incidents that we had a recent. or complainants. any questions for inspectors? no. any public comment on either executive director or executive reports? seeing none, will move on to item number four, police department questions and comments. we will move on. then to item number five which i believe are permits. we have four permits tonight and i'll hand it over to our deputy director. >> thank you. good evening, commissioners. tonight we just have a regular agenda. our
5:28 am
first item on the agenda is the midway. they're going for both the place of entertainment and extended hours premises permit. . they're going for both the place of entertainment and extended hours premises permit. that 900 merrin st. the owner, jordan later of enterprises proposes to use the space is a multiuse arts and entertainment venue. it's 8000 square-foot main room is going to host bands and djs, but also farmers and art markets. as well as community events. there's also nine art studios of their teaching kitchen art gallery, café, lounge so it's very unique. they plan to be open seven days a week with varying days and times of entertainment. they view a station approves the entertainment and disapproves the extended hours premises permit. they're still in conversation with the applicant regarding this. so, the midway actually today is requesting to continue their
5:29 am
application for extended hours premises permit until commission meeting next year but will still hear their place of entertainment. this notice is actually attached in your file for your reference. take it away is owner jordan later. >> hold on a second, jordan. if were going to do the extended hours, should we vote on that now the quacks to continue it? when we treat them different. so, can we take a motion that? >> i moved to them approve the continuous extended hours permit until the applicants request. >> moved and seconded. any vote i'm sorry. any comments? any public comment? let's think about. >> on a motion to continue the extended hours to a later date, proposed by the applicant,
5:30 am
commissioner caminong perez speed joseph lee frost presidency 10. >> that motion passes. we will hear the place of entertainment application. go right ahead. >> good evening and happy holidays commissioner get my name it is jordan later. i'm one of the three principles here representing the midway this evening located at 900 merrin st. myself beat--jeff whitmore. in front of you, i believe you should have a packet that is fairly large with a bunch of information about what the budget is. i'll run through it for those in the audience to follow along to the extent. the midway is a
5:31 am
29,000 square-foot row house and we are looking to convert into a multifaceted entertainment complex. which things together a number of san francisco's unique and creative community. we plan to support and involve not only local artists positions but also nonprofit organizations that focus on music art and the community. below that introduction paragraph you'll see a couple book points about what the project is. looking to do an 8000 square-foot performance and event space that was everything from bands, djs, music, and fun committee art markets hopefully farmers markets and to me that. the weekend artists studios of the 100% subsidized by us. we'll go to a local san francisco artist to come in and have a here in residence potentially six months-a year for free space to them to continue their art to make san francisco to make it attainable for the artist. well three gallery spaces in the midway. one of which being a the actual midway. we'll get
5:32 am
there in a minute on the map that i can show to you. two other spaces that will be specifically designed for showcasing local and international arts. there will be a bar and lounge which again will showcase local and national music talent and auditorium teaching kitchen which personally i most excited for. so, all tangent away quickly about that one. the teaching kitchen is going to be a live kitchen sort of space that will be bringing in talent,, talent being chefs around the country and the world to showcase their signature dish. we are working on now to be the chef to showcase the first time being -we just signed eiko-michael
5:33 am
nina. michael nina is going to be doing being the first chef is going to be coming in and demonstrating at our teaching kitchen. we are also working trying to to treat some of the chefs were celebrities as are viewed on tv and in the public at this point. and routing them through as you would a dj, a ban and all that stuff. so grooming a completely different form of entertainment. i do know for requires a different permits or not. we'll discuss that later. but, really getting in and showcasing not just a typical nightclub that does bands and djs on friday saturday night. willie changing the way that folks are looking at entertainment here in san francisco. after that were looking at having a café which is going to serve breakfast and lunch and dinner as well as a late-night menu. lastly, as that's not enough already emerging technologies room. a room that we showcasing all the cutting-edge pioneering technology of light and sound inside of the space. so, as of right now, a group called the
5:34 am
--is doing 3-d sound and light. to give you an example what that is, you may withstand the middle of the room. train drive around you 365°. honestly very much oversimplifying it. also able to take any notes out of any song but really in a corner or any direction of the room. some logistical things about the space. there's plenty of parking all throughout. there are very very little to no residential anywhere around us. we do not have to send out a single mailing which is interesting. i do believe there's been any complaints on our 3-4 postings we've done so far which is great. i kind of says that we been trying to continue to do our community outreach was all get into you. the next page you'll see is a bit of a aisle on myself, jeff and pete. it is couple pages long so i won't bore you with all the details but some key points to point out are the number of different venues that
5:35 am
we have currently here in san francisco. the empire room. pier 70. the old san francisco meet which is a new addition the myriad. they're all successful spaces. here in san francisco. five of which currently hold entertainment commission permits. to move on to the next, i guess two pages after that, you'll see a list of 15 different committee organizations and events we've attended to do our community i reach for this program. a number-for the space. a number of these organizations and community groups we present to our regular basis because were in the neighborhood already. so many of them write a monthly basis as it is but we made it a point to make sure folks in the neighborhood know were coming. hope we are very excited we are coming and been able to answer and alleviate concerns the neighborhood has. the next page, you will see a very
5:36 am
small-i cannot print out the big sheet for everyone-a fairly small layout of the space. i can kind of walk everyone through it. so, right here is illinois street. third street is obviously directly above that. that they would be to the right hand side. so, over in this area. this is our main engines right here into the club entertainment space that we are naming ride within the midway. this is just under 8000 square-foot space. you see a number of bathrooms shared this is our mainstage writing. the art gallery consist of the main midway right here. an art gallery space right there and then some gallery space in
5:37 am
this area. the artist studios consist of this area right here. so, always individual small spaces that we fortunately enough were able to put skylights in which a little bit of attention but pretty cool for folks want to get natural light for doing their artwork. some office they said things like that along the side. the community room that were going to be hosting a number of the local labor organizations and community groups and no cost, and the space that is needed in the bayview area. and the dogpatch area. i give it, the teaching kitchen, right there. the teaching kitchen is directly adjacent to the café. another bathroom there. an outside area right along here and kind of the whole rest of the space, this area here consisting of the lounge and bar area. is there any specific questions regarding the layout while i have it up? no. okay
5:38 am
i'll keep on going. the next page is a google map shot of where the location is. this one is to represent the baxter with little little residence around the neighborhood, around our area could the primary intersections that we are on michigan and maryland street. our direct neighbor is a construction company across the street is a lighting company and it's all very martial commercial and light industrial diamond. are other neighbor across mary street is pure a.d. which is a once held oracle racing book is currently not utilized as of now. leon to next page is our transportation goods to show folks were parking and where the bus stops are and where the t-line is and were expecting the unruly cats
5:39 am
to congregate and that folks off. moving onto the next page, there are-i won't go through everyone up one by one, but our 20 letters of support for our place of entertainment permits. they range from everything from the exploratory to pdm eight, india basin, and bayview residents improving the environment. lastly i would like to take a second to chime in about our committee benefits program. as some of you may know, when we presented peers 70, one thing that was very very important to us was to give back to the community as a whole and also in our direct area. the model we've adopted in all our venues now and have taken really strong approach on
5:40 am
being able to give back directly. so, committee benefits program is something that, if we bring in an event or corporate event or promoter, want to be looking back and subway. as you can see with the layout of the entire space, we were thinking about that with the artists but on a bigger scale we want to be able to be- get back to it in the directly. not just writing a check to a local nonprofit but getting involved, supporting both our time and efforts and our energies into being able to get back. we now have a number of different businesses in the area and think it's incredibly important not just in that neighborhood but san francisco as old to make a significant positive impact with what we are doing. thank you so much for your time happy to answer questions. >> thank you. does a very thorough presentation. i think chose a much experience you have doing this. you covered lots of community outreach and appreciate the thought and careful planning there has been for it. thank you.
5:41 am
commissioner caminong. >> that's an amazing addition to that neighborhood and an amazing addition to the area. i'm assuming the artist studios are fine arts or not artists that are musicians? >> yes. claeys, some digital all sorts of different mediums. less musicians. >> west music more art? >> correct. >> that's what i thought. because we have a lack of musicians in the city. just in case you did not know that. this sounds amazing. i can see why you're excited about the teaching kitchen. it sounds fabulous. sounds like a great space. i'm sorry. i cannot find apart what is your occupancy load? >> were looking raindrop 3000 people utilizing every square
5:42 am
inch of the space. the main room is around 15 handle 1500 or so >> that is great. it sounds like a wonderful great project. i'm excited that it's going to happen. >> other comments? commissioner perez >> thank you. i'm impressed with your committee outreach. thank you for the work. it takes a lot of time and effort to go through all that. looks like you got so many winners of support. so, thank you for doing that and taken the time. i'm also very excited with your plans for the teaching edition. san francisco been such a foodie scene i think this is something we really need to have. so, thank you and good luck to you. >> thank you. i think earl might be able to chat about the food scene and one of our partners in the neighborhood once we get to that. >> commissioner lee >> so, you have a letter parking areas. are you renting
5:43 am
those yourself? open-space parking? there some lawsuit. >> significant amount of openness street parking in the area. that is i mentioned it's very light industrial in that neck of the woods so after 430-5 pm in the afternoon parking galore. the number of the lots i guess it's kind of take it as it comes. but something we need to do we would look at partnering with some sort of parking agency or something along those lines. >> are the way across the way is pretty still undeveloped. it started today of any street lighting? when you park your car do people feel safe enough to walk? >> absolutely. there's more lady now in that direction since america's cup was he. pure a.d. was a pretty prominent place for america's cup so there's info structure changes that. there's also been some recent develop without
5:44 am
port and things goes along so lighting and things putting the area and were also going to be larger shows running security outside not just in front of our doors but the whole block. no one wants to come back from their joyous night to find a window broken. we know that having peers 70 we know illinois street has been hotspot for that >> is everywhere there's a big party. you will have a lot of that. i'm just wondering, are you have any more outside security just checking things out or is this pretty much focused on the inside? >> outside for sure. we will have folks-depending on some of the other. it's 100 people it'll be less likely, but being an enabler for the past 1-2 years, were very comfortable and know when it's time or not time. we also work closely with a new police station to help curb some of this-these awful break is good i think it was one event we do that sfpd arrested four or five
5:45 am
people breaking into cars. >> thank you. >> did you want to say something? >> other comments? >> i have to say i'm really impressed. it's really having him come. that is impressive. >> were hosting a holiday party. it's going to be great. fantastic. everyone will get an invitation. the two >> one other comment also before, as our city grows we been talking about where do we add new nightlife in the city and of the guys are doing an amazing thing going to that part of town. i think you're kind of going to a no man's land in some ways and i think that is great. i think we want to make people feel every part of san francisco is the more they can go and be joyous. i think we need good owners and good business. so, thank you
5:46 am
not just doing good community outreach and doing all the right things to make it well-run business but actually being a leader and a trailblazer where people probably would not look twice. so, i think that's incredible. did you thank you so much. my partner pete and geoff are very much to blame for that. so, thank you. >> by doing bring up the police. then we'll open up for public comment after the police voices there thoughts. >> good evening, commission to dr. ramirez from bayview station at bayview station's recommendation for the place of entertainment's approval. of course, with a good neighbor policy and also the monthly event calendar sent to me each month. >> that was easy. questions from commissioners? can i ask,
5:47 am
i disagree thing about going to an uncharted territory. are you -how do you feel about this area developing? >> it will be interesting. >> okay. enough said. let's open it up for public comment. is there any public comment on this? i think there's at least one but if you have a sheet filled out go internet in. if you don't, you can still speak. just please line up on the side will have you go one after the other. >> introduce yourself, your name and your 2 min. >> my name is earl shattuck. i'm a residence of third street
5:48 am
in the bayview. other probably about a half-mile away from this venue. i'm also the founder, cofounder, bayview underground food team to the first ever food and pop-up market in bayview hunters point. we start about four years ago and also i serve on neighborhood committee called -economic development on third and i chair the committee. i'm here to really back up what you deserve from jordan. first off, as a resident of third street of attended two events at the midway. both events were invite through social media. there were many many asks for public transportation to go to the event itself. the were many many opportunities to link you with all the car sharing services so that if you wanted to take a car or hire a car to the event, you could. but the most important thing which stood out to me, they gave the name and number of an on-site manager so that if we heard any noise or if we had any issues
5:49 am
we could call this on-site manager directly. there were no issues. i've no complaints at all. it's a beautiful space. i've only seen the gallery part of it but like you said about the kitchen as well. as far as the bayview underground we had the pop-up market at the opera house which is been under renovation promise two years now. once the opera was shut down we were without a home and without asking jordan approached us. he approached us and said, hey, i'm willing to help you guys. a lot of you are space to your pop-up market. that just sent a loud message throughout the bayview hunters point community that these guys are for real. they're coming into the committee will be meeting what they say so here to tell you the direct result of that and we so appreciate that happening. as far as community benefits go, i do agree. i've seen already in action the artist in residence program that is offering or they are offering the open kitchen which is really really
5:50 am
excited. i think it's going to be cutting edge and i think we're going to see that been one of the first in the city and will see a lot more of that . the two galleries, exhibits a scene were from local artists and that really spoke volumes to the fact they were focusing on our community. of course, they're committed to the local hire. so it's a great project. i think these guys come as you've already commented on, commissioners, they've done everything right. i'm just here to gouge for them and say everything you've heard is legitimate. thank you commissioners for your time and your service. >> thank you. looks like someone else's here to speak. is there any others these, and stand on the side? go ahead. you have the microphone. >> my name is jeremy linden. i'm a member of the von minnesota sioux. why speak in support of this project. as you probably know, this neighborhood opened the past several years has changed from being white sleepy mix of industrial residential to having a lot of dining options and other opportunities for residents to stay in their neighborhood while
5:51 am
instead of going to other neighborhoods. one thing that we don't have as of yet, is more entertainment type options. we are sort of having to go to other neighborhoods to do that and i think this is a really great addition to the neighborhood. two of entertainment both music as well as other cultural events that people can enjoy at all hours. i think it is great. one thing that is, as you guys i'm sure you know, happening that artists are having a hard time staying in the city. i think these artists studios are great addition to the neighborhood and allowing those artists to live and work in that community . i think it's a great opportunity for the neighborhood and will continue to develop as a neighborhood that all san franciscans are allowed to live work and plan. >> thank you very much. any
5:52 am
other public comment? seeing none, public comment is now closed >>[gavel] >> commissioners, happy to entertain a motion if there is one to be made? >> i motion to approve. >> moved and seconded. any further discussion? let's take about >> on the motion to approve the midway for place of entertainment, with police conditions, commissioner caminong perez joseph, lee, frost frost tan. >> the motion passes. congratulations. >>[gavel] >> will move right along to our second permit.
5:53 am
>> this is a change in ownership for a place of entertainment permit located at 358 >> this is a change in ownership for a place of entertainment permit located at 358 ocean ave. the new owner is marco meza. he barco the premises from his mother who is also here. he plans to use the space as a nightclub so very similar as was used before. entertainment with jesus and occasional band. plans to do entertainment thursday, friday, and saturday evenings. ingleside station approves this permit. attached are police conditions in regard to gays and times of entertainment. but they are allowing and also security commission. here to tell you a live it more is our owner, marco meza >> thank you, commissioners for the opportunity. this place is been in operation for 25 years and we have a we had a fire last year in the next building and we were forced to repair the whole building.
5:54 am
there is a 50 month we were trying to open this with the city planning. it practically is not change ownership because i'm the manager of this place for the last 10 years. it's only 2400 people. it's less than 4000 ft.2. we used to have a live band before. which, now, we will have only djs and for the operation we have a prior time was [inaudible]. now we will work it from thursday-sunday. which we do not have a restriction before and actually, we remodeled this place and it's in better condition. we improve the
5:55 am
bathrooms. we upgraded all [inaudible]. nothing new in management. it's been a quiet place. we don't have much neighbors because two warehouses in a gas station and a church in front. so practically, it's just a continuation of the operation of this place. >> thank you. commissioner lee >> so, the previously, have you experienced with having bands and djs and things before? >> yes. >> you had this experience so it's nothing if you? >> yes, nothing new. >> you be doing this stuff in-house or somebody was to have a birthday party no loud to bring a dj? >> no. we have everything in-house.
5:56 am
>> what kind of liquor license do you have? 47 or 48? >> 48. liquor license, 48. >> have you had incidents at your place before? >> no. >> have to call the police for anything? anything like that? >> no. were pretty quiet. for the last five years i'm dealing strictly with the dress code and a person feels like a arty have a few drinks before beginning we don't allow that person in that. we are really strong and that particular case. >> are these your people that are doing security? >> not a company. we have in-house and although security,
5:57 am
we send them to have a special training for a card. including myself. i did the training also. >> are you licensed by the state of california? do you know you have to have a license from the state of california have your own security in-house? >> yes. that's what we did that licensed web >> your venue has a license? >> yes. then we send them to this particular place. >> i'm not talk about the individual security guards. that is a garda card. it would be good if they did lead trading which is for algol, as well but are you licensed, sir, to have in-house security? >> no. >> that something you have to get from the state of california and after your hearing you can get a card from one of our inspectors and they
5:58 am
will give you the name of where to apply for that but you must have that in order to have in-house security. >> okay, because i took that particular training in order to train the rest of them. >> what your business has to be licensed to have in-house security. one of our inspectors will be happy to give you his card and give you the name and how to contact to get that permit. >> okay. >> let's take a few more questions. >> i live [inaudible]. i'm sorry i've not been able to stop by to your venue but i'll be there soon. you are required to do neighborhood outreach. it's part of your application. did you get a chance to cross over to, there's a church across the street from you and
5:59 am
there's also an action group? >> as a matter fact i talk to the church today. we were informing with the association to be a part of it, yes, absolutely. >> so, your neighbors on nothing but did you get a chance to talk to any neighbors about what's going to happen? biju we don't have any neighbors. two warehouses and- >> down the block of there are neighbors. >> no, not at all. [inaudible] >> there are neighbors there. >> there is a warehouse right next and it's the whole block until the end it's a building. the residential building up at the corner, yes. >> on ocean avenue there are neighbors there? >> ocean is a gas station and then the city cops. >> i know that neighborhood. there are neighbors that.
6:00 am
>> it's pretty quiet over there. >> all rights. you still are required to outreach to local organizations. >> i will. yes. the other thing is, we didn't have any restriction before the last 25 years since the time of opening. my intention is only to operate from thursday-saturday, but i want to have [inaudible] because one of the patrons will be on wednesday or sunday i don't want to be limited to those days. we didn't have any restrictions before. >> i know, but as part of our policy, everybody is required to do a neighborhood outreach just so the neighborhood knows. >> is not required. it's highly suggested and can influence how you view the
6:01 am
venue. i think what we want to say is, ultimately i knew you been running it for 25 years, but a standard we have within this commission is to have all of our venues talk to the neighbors within the surrounding block. if right next door you have warehouses, that's great. that helps you a little bit because of not going to be bothered but a few doors down from that there's a family or other residence that might hear even just people walking to their car, we get complaints about that all the time. >> we have a recommendation. the officer, which i feel comfortable with all this. according to my experience, we practically all the requires requirements a good neighbor policy and we are aware of that. we strongly for 21 years [inaudible]. enforcing exactly
6:02 am
the more capacity and more people. we have a camera inside and outside the building, which is one of the things we upgraded. practically, we close [inaudible] because we all know this type of place people stay longer. so we've taken out all the drinks before people stay longer. so we've taken out all the drinks before 30 min. >> the staff know if there has been any reports? i don't feel i've heard anything coming from them. all rights. any of the questions from commissioner? we like to bring up the police to hear their conditions. >> have you read the conditions that the police would like to have? >> yes, twice.
6:03 am
>> you're okay? >> yes. >> thank you. >> good evening, questioned officer robert--ingleside station. ingleside station approves for the permit,, but given the fact that they haven't been open for at least a couple years i'm concerned with her lack of neighborhood outreach with the neighborhood. it can change quite dramatically and depending on peoples who moved into the neighborhood that hasn't seen a nightclub on their street before, they might be cause for complaint if noise or traffic issues or conditions change at certain times of the night so that is a concern. also, on his
6:04 am
application, he mentioned for the security, the liability insurance that would address security action of his personnel. he mentioned it was workers compensation, so pending seen proper proof over probate liability insurance for the business, i would like to see what that liability is. it just allows us to see how serious a business owner is in operating the kind of venue. >> all right. thank you. the state commissioner questions. commissioner caminong >> i know we don't get a lot of permits from ingleside. i have a bunch of questions and i the little bit of information for you. it would be in the
6:05 am
best interest of this venue to have a general liability policy on trip and fall and a liquor liability policy. they are not required to have an assault and battery policy. if they want to but they can buy it. it's not required by anybody. probably not by the building owner if they don't own the building. that's number one. so, that can't be a condition of any condition. secondly, to assume something may happen that is not already happened, this commission usually does not allow that. you can't assume something may happen in the future by bad behavior if it is not occurred. so that's convicting somebody of a crime before the crime is committed. that's how we look at it. in looking at your conditions, give limited them to thursday, friday, saturday and sunday between 9 pm and 2 am. if they don't have a problem with that, i don't have a problem with
6:06 am
that. all the windows and doors to remain close. that is a condition of our good neighbor policy are you familiar with that? because that is automatically attached to all of our permits. so, to be redundant with the good neighbor policy something we usually strike because it's a condition anyway. number two, your captain does not have the right to discontinue the permits. the only way the permit can be discontinued it to be brought before this commission for suspension or revocation hearing. so the capt. can no longer do that and has not been able to do that for years. so, that's just for your edification. i don't know what this planning code section is, but in order for him to be heard today, he had to posted his permits and sign an affidavit as such. so, having him we post is a condition of
6:07 am
the permit is-doesn't make sense to me unless that has a different idea about that. it's not a change of use. as far as i'm concerned, it's been his business for years. you are asking him to have the sf 21 because he's a 48. but in my correct in assuming that for 224 people you're asking for five security guards mount 1-50 and could you please tell me what you base that on? >> on the applicant's paperwork, 40 application, he mentions five security guards. >> that's his prerogative. but it's not our requirements. our requirement is 1-100. unless he's a bad boy and comes back here for something else and are director decides to recondition his permits, it's one-100. so going over number h did her
6:08 am
digital surveillance cameras, 30 day storage, he said he already has 16 cameras. motion sensors. that will run 24 hours a day. we like to think that an incident that happens around a nightclub has a nexus to that nightclub. asking him to run his cameras 24 hours a day but is not open, i don't know that we could require him to do that. i mean we could certainly ask him and he might as a good neighbor to the police do that to monitor the neighborhood, but if he's not open he does not have to surveilled. i don't think it has to do that. cool down period is a good idea. i don't know if we can require it. it depends on his liquor license. suddenly the entertainment commission does not require that. monthly calendar is fine. notify the police of the promoter's name
6:09 am
or the gigs that are happening is good. abide by abc conditions. sure. permit holders so bye-bye san francisco in a small code 10 six. this commission's license under 1060, so that is a good neighbor policy and doesn't need to be repeated. and the telephone hotline is also part of our good neighbor policy, which it was redundant. so, in approving this permit, i would strike every one of your conditions that is redundant or is not permissible. i'm sorry. i know you're new at this, right? this is not a criticism. it's kind of like an education on your part if that's okay. thank you. >> other commissioner questions? >> i like to tell you i appreciate all the work like
6:10 am
the commissioner said, you did way too much work. you guys want to prove this and that his grades. there's a couple of things here. maybe with the recordings 30 min. after the closure for the dispersal crowd on something like that, but like commissioner joseph said, if the order once it do 24 hours a day which definitely would help the city and the police department if there was anything going on in the area, but talk to lieutenant-about this. i'm sure he could give you some insight on how to do this. >> thank you, commissioners. >> clearly, you put thought into this. were not here to chastise you. were here to make sure that it's a burden for us and our inspectors to make sure
6:11 am
that permit holders are meeting the requirements of their permits. we have excessive ones with things that we can't reasonably enforce those become a challenge. so, just know that's part of the motivation of what our commissioner of the saints. >> understood. thank you. >> any other questions for-- >> sorry. while there open 30 months ago, did you do a check to see if there's any complaints were any issues with the establishment while it was running? >> i get a check and there were no complaints. >> thank you. >> the record of history really speaks to their own management and security and their patrons. i think like commissioner joseph said, we can assume something that is can happen because anything could happen but we want to give the benefit of the doubt and also look at that record. i'm glad there's no record of any reports. i think that would make us think twice. i'm can
6:12 am
open it up to public comment. any public comment on this any? no public comments. public, and is close. >>[gavel] >> commissioners, i know the conditions are torn apart a little bit. so, let's make a motion. >> i would like-this is complicated-i'd like to move to approve i guess with its conditional approval without good neighbor policy. please condition number one, striking out all doors and windows shall remain close. police condition number 4g, 4j4k and 4a group
6:13 am
sorry. that's a jkl. that's my motion. >> so the motion is to approve with police conditions one, 4g, jkl. >> can ask for a friendly amendment? >> i will second it. i'll ask that we can add a neighborhood outreach that has to do- >> as a condition for the permit? >> we have done that in the
6:14 am
past. not quite [inaudible]. do it within a time frame. then, as the permit is approved they need to show some kind of outreach. >> yes, we have done that. >> we've had conversations to this effect. it doesn't end as a bullet point on the condition. it is a directive that then staff can follow up. >> so, rather than a condition, can we make it a directive? >> yes. >> i accept that. >> is a clear to our commissioners? >> question. even though they're not required to shut the doors and windows, >> they are required as part of our good neighbor policy. it doesn't have to be a police condition it is already a
6:15 am
condition of the good neighbor policy. >> i want to make it clear it is on one but [inaudible]. >> right. okay. commissioner frost >> commissioner joseph, you brought about their in-house security and meeting the license and the insurance. can we approve a permit if we don't have that in place? >> the state of california the entity that regulates the issue of licensing and security guards and in-house versus out of house. i don't think it's our job to do the bidding of the state of california. in addition, we as a business decision in terms of an insurance. it's not something this commission has regulated as in how much and what kind of
6:16 am
insurance a business has. >> so be sis license security establishment, security guards, so, the way it works is the weight it works if you're higher a security company they re: have everything. if you do it in-house, you are a security company because we were hiring and put on payroll your security guards. you must have this permit from the state. we don't enforce that. but the state does. they can go around and bus them for not having it. i don't know we have the authority to do that. as far as insurance goes, you know, they don't have general liability or liquor liability then that's just nuts. in the assault and batteries and insurance policy you take up for security. it's completely
6:17 am
up to the venue whether they want to carry it. it has its own restrictions. we've never-since we don't have that say over security on that level, we can require it's not even think the state of california can require it. so, that's where the insurance goes. bite you don't have to buy general liability policy if somebody gets killed after leaving their bar they are done. it's foolish not to have insurance but it's not a requirement. >> it's kind of like st. do take liability on your cart would you want the full coverage. >> yes. would you not want to ensure your cart >> any smart businessman wants to stay in business has have the right insurance in nevada are doing security in-house the workers comp will cover two point 2.2 >> assault and battery is a coverage for patrons pursuing
6:18 am
pretty much. is what that means. assault and battery. >> let's go back to the motion , which is i don't know if i need to repeat it-let's take a vote. >> on the motion to approve commissioner joseph conditions, commissioner caminong perez perez frost and pres. kim >> the motion passes >>[gavel] >> good luck and there was a directive to have our staff make sure that you do community outreach so make sure you do that. our next permit is extended hours.
6:19 am
>> so-is here for an extended hours permit. there look at 3140 mission st. this currently a place of entertainment. they're actually coming in to just extend the hours of entertainment. on friday and saturday nights. the owner is -he's not here tonight but the general manager is here, tony oriana. a plan for entertainment to kids you knew to have djs with occasional jazz, salsa and elizabeth. sometimes fashion shows. ingleside station has also approved at an conditioned this permit friday incentives permit friday incentives until 6 am. you can see the attached conditions here for further details but here to tell you more about their plan is tony. >> thank you. i'll make it as fast as possible. we are
6:20 am
actually trying to keep it open not all the time but we do a lot of private stuff. there's times for late-night parties. we do a lot of salsa parties. there by 1:30 am everybody goes home but there's occasions we have a pretty bad epidemic on street there with hotdog vendors out to. which i do open up the restaurant later because of the time everybody gets off at 2 am with bars it just gets congested. so 70 hours a little bit means we don't have to release everyone so that's why were trying to extend the hours. >> to have a restaurant in their? >> yes >> stearic senate hours premises permit be primarily for the food component? >> mainly for the entertainment. the same time, when the club closes with a little bit more extended hours to go >> will you have food at 2 am in the morning?
6:21 am
>> yes >> 2:30 am >> currently 230 >> we close the restaurant about 12:45 pm. by 145 everyone is out. >> so would you let patrons that are not in the club in for food afterwards? >> no. not go outside and eats. >> antidrug, okay. >> more questions? commissioner? no? have a seat. i will ask the police to come up, please again. >> good evening again commissioned. permit opposite from ingleside station. it also station approves the
6:22 am
after-hours permits and i apologize again for the redundancy but i do appreciate the education that commissioner joseph has provided tonight. >> that very sweet of you to say. thank you. >> i don't think we have questions, do we? thank you very much. >> is there any public almonds on the extended hours are met application? there is not so public comment is close. >>[gavel] >> will move on to a motion. commissioners, two guys have a motion? i assume there's going to be edits to the police conditions. >> i do have one question. serving the food after 2 am used to need a cabaret permit >> not anymore. >> not anymore. thank you. >> commissioner frost >> extended hours is a cabaret
6:23 am
permits. >> that's what it is now. thank you. >> it's really anything that happens after 2 am. >> i want to step aside and recuse myself from this one because even though i have no financial interest in the business, he is a shareholder open among other businesses. i'm recusing myself from this. we do thank you for doing it. other commissioners were not recused, let's take a motion. >> i moved to approve. >> would you like to many conditions on that motion? >> about the same conditions as previous. >> a repeat that so we have that very clear. for the record, i think the motion is to approve the good neighbor policy and police conditions one
6:24 am
, with the second sentence struck that there is all doors and windows shall remain closed during hours of entertainment. including also, for g for gjkl. so, there's a motion. moved and seconded. let's go ahead and take about >> so, on the motion to approve the extended hours permit for-with those conditions, commissioner caminong perez joseph frost pres. kim >> the motion passes >>[gavel] >> congratulations. to our final permit tonight, mezzanine. place of entertainment and extended hours >> president tan, before mezzanine comes up i think for the purpose of transparency, i
6:25 am
have to say that at one point in time i owned mezzanine. i have not owned mezzanine in 12 years. i have no financial interest in it until certain i can sit on this commission and vote on this permit. >> thank you very much. can we actually have commissioner lee comeback. i don't know if he can hear me. commissioner lee? you guys can go ahead and still come up. >> we are all here now. >> president tan
6:26 am
>> i was can introduce you but i guess not >> ashley can we have our deputy director. >> sorry. so, this is a change in ownership or place of entertainment and extended hours permits for mezzanine located at 442 jesse could undo owner here is debra jackman. they plan to continue using the 12,000 square-foot place. it's been in operation for 13 years as a concert special vent and i club venue with events ranging from small group gatherings to large productions. the entertainment includes djs, live bands, photography, video shoes, fashion and art shows. film screenings and best of all dance parties. the venue will continue to be available seven days a week for booking. tenderloin station approves both of these summits with attached conditions. here to tell you more is debra jackman and mark fenney
6:27 am
>> president tan, commissioners, happy holidays. my name is mark ronnie. i'm here today with debra jackman who is the new owner of mezzanine prior to this particular date she's been the general manager of that establishment the past eight years. i'm also here tonight with john-president of security intelligence specialist and john, as you know, one of the best security companies in town and has been the security arm of mezzanine for the past five years. we previously passed out a brochure. i hope you got it. this gives you a little idea of the corporate event facility that mezzanine is and also live entertainment venue. it holds approximately 1000 people but the specs and sound specs and everything are in this brochure. i am going to discuss a little later the community outreach,
6:28 am
but debra is going to talk about the entertainment factor in what her plans are and maybe take some questions about where mezzanine has been and where it's going. john is up next with discussing the security plan. you should have that in your binders.. is a very thorough security plan. so, john. >> good evening, commissioners. i'll take as much time as you need but i'll start at a high level. i want to participate in today's hearing in order to rewrite that mezzanine has had and has always had a very robust security solution. which you're looking at a security plan. the security plan although its version 5 and the latest security plan all it is is a plan. with two critical areas for any plan is a competent and trained security team and the most important thing is a
6:29 am
dialogue and open communication with their management. which we have. this security team there between 8-14 strong. only two changes of head of security six years. that attrition rate is extremely low for the industry which goes to debra and her team. my security personnel are both connery and secondary are very happy. they don't like leaving. we now show up to work and i goes to, again, and efficient security team. that's why they have relatively few incidences. i can answer any questions on security plan itself at this time. >> commissioners, any questions about the security plan? >> commissioner joseph >> the security plan is pre-much the same we tweak? >> yes. >> other question? i been to
6:30 am
the mezzanine many times was recently last wednesday i do have to give credit to your security team. i was super professional. never overly intimidating. in a very good control of the crowd because you guys have a good lineup of people coming in all the time. so, kudos to you guys. >> thank you very much >> let's hear from someone else could they do next up is debra jackman would as i've said been the general manager of mezzanine for the last aid one of the founders of cmac. extremely well respected in the industry. she could tell you a little bit about the entertainment at mezzanine. >> hello. thank you. so, basically, nothing is going to change. it's only going to continue to get even better. we are going to continue to have amazing indie artists and dance parties, electronic djs. our
6:31 am
corporate event clients list is growing and we been doing some amazing holiday parties. we have some super bowl parties coming up. we are except excited about that. i have a new talent buyer an amazing team and honestly, if it ain't broke am not going to fix it. you are going to keep going the way we've been going and continue to dominate the san francisco music scene. >> dominate. >> yes i have been running it for 80. at 25 years of management experience. and i'm open to any questions you may have. >> commissioners, questions? >> i like to know your lineup for the next six months. no.
6:32 am
i'm kidding. >> i can tell you about this we can. >> usually a quiet commission means good things, actually. commissioner lee >> what about the apartments across the street? >> hotel that is open >> hotel? >> we've had zero issues knock on wood with the opening of the hampton inn. i've committed with the general manager and assistant general manager god might information. i'm not bringing in a new general manager. i'm still doing my job. i'm the owner, operator some still typically there in the evening as well as during my office hours during the day as well as having my house manager many other managers. so, we had no problems. >> i would also like to discuss a little bit community outreach because i think it's important. debra, as i stated, is a very solid member of the
6:33 am
entertainment community in a particular neighborhood. has been for a long time. i don't debra-i love you no debra-i don't think this they got omitted from the package but we have a letter discussing from cmac recommendation talk about what an ex-on committee member they are. >> we got one. the two okay. she >> okay. she tends to run a lot of events. the toy drive for the san francisco fire department and a lot of events for axis institute which raises money for mental health services. in terms of other outreach, average of two the alliance for better district 6 and tenderly scheduled the calendar for the next meeting is actually february 6. they were not having any meeting before starting after november. so we got lost in the middle that. debra has reached out to

our neighbors also. the nearby neighbors specifically bluebottle coffee, 54 min., the hampton inn, blue room on jesse, the restaurant which is a new restaurant, giant pixel company and is also met with toys the new permit officer of the tenderloin but she switch between southern station and tenderloin station. so they met and she's done our reach to them. i guess, were here for any questions you might have. i request his attentive grant tonight on this amendment and i think everest in a great job and i think should continue to do great job for san francisco. >> thank you very much. i don't think this more questions from the commission, so happy to bring up the police to speak on this. >> good evening, commission
6:35 am
did unlock certain torres permit officer for the tenderloin police station. as counsel when he mentioned, the tenderloin district absorbed the mezzanine club about six months ago and we've had nothing but good things to say about the club. we've met with the operator of the club and she gimme a tour of the place. we've been working together for some time with various current events that she's had. so, we recommend approval. if you have any questions regarding this, more than happy to answer them. >> it looks like no questions. thank you very much. thanks for making the not making the condition super complicated. is
6:36 am
there any public comments? public comments on mezzanine? no. of the comment is closed. let's move on, commissioners. happy to entertain a motion. mainly us with japan issue. >> i moved to approve and police conditions two and three could i'm striking police condition number one because we can't possibly approve unless they do have a security plan. so it's a redundant. just lower the wording. that's it. that's my motion >> moved and seconded. any discussion speak at no. let's think about >> on the motion to approve the place of entertainment and extended hours permit for mezzanine with those conditions, commissioner caminong perez, joseph, lee,
6:37 am
frost and pres. tan. >> the motion passes. congratulations. i look for to many safe nice. >> moving onto item number six which is a new staining item on our agenda. i'll actually has to do director came to introduce it. >> commissioners, so in my report i talked about chapter 116 and the implementation. the language in the miss rate of code does require that the commission in its entirety approve, if you will, the recommendations that are to be forwarded in the cases that these projects get heard by the committee. so, what i mean to say some of the projects based on the roles you guys set won't come to the committee so they won't come to the commission.
6:38 am
they will be approved or recommended to planning at the staff level. those that rise to the level that you have agreed is important to hear. they will first go to the committee and then come to full commission. so that what this long-standing item is. these are two items underneath that, because we could not formally meet on the first because of a quorum issue just like this commission did not meet on the first, these are honestly like for your review again per the code. i think i'll let commissioner tan go from here but that's the background for this. to give you guys some information on both of these so you can take a look and see. you should have a
6:39 am
sound study or preliminary sound study in one case and you should have a map with some kind of visual aid the project on the other. >> so, the thing to remember is this is going to be a standing item. it's not always going to look like this, i believe. we have-all introduce these two items. what we have today is a matter of timing and the fact that we could not actually meet formally as a commission nor as the committee . prior to this meeting. so, what we have in front of us is to projects 950 market st. and 1567 california st. let's talk about 950 market st. first. in terms of our regular procedures, the format is that we have artie our committee and the project sponsors come. and we sent invitations out to the
6:40 am
affected poe holders within 300 feet and then we sometimes they shop and sometimes they don't. i mean sometimes goes permit holders shop and sometimes they don't, then they are at that meeting at the committee is where we negotiate the terms, but we learn about the project, we primarily asked questions about committee outreach and about sound studies. so, that's what you kind of see before you today. what we need today is an action to approve what is recommended. we were not able to have the committee meeting so we can review it as a full commission today, but after what we were able to do, i was able to meet with the staff in the project sponsors and some of the affected poe holders. to negotiate those terms. was in a formal hearing but we got to learn and understand those projects after each of those,
6:41 am
we i think stephanie felt like we do not have extra conditions to add upon the standard ones we've already approved as a commission. so, that's what we are asking to forward on today. so, i can go into the specifics of the project if you want. for 950 market, it's a very large project. in the meeting were only both get the word feels theater to come out who is directly adjacent to 950 market. as you know, they were with the huge live music venue. they did not have major concerns that. there probably concerns were around construction. they've artie been in contact about the design, about what to do in terms of mitigation. if you look at, let's see,-if you
6:42 am
look at this page, which has pictures on them, they are actually buffered a little bit by crazy horse which is right next-door than the warfield is there. on, i believe, is that turk street on the church street side, i think ashley on the taylor street start with the warfield theater does about this project. is going to be a little alleyway that separates them so they're not actually adjacent to each other. there's no windows on the warfield theater side where he would face the project. so, long story short, i think they felt pretty comfortable in terms of having direct communication with the project sponsor with 950 market. they currently share sort of office space currently because they're in
6:43 am
the same building. so they've had to negotiate terms of how to deal with music is just neighbors renting the same offices now. so, like i said, the biggest concern was around construction the possibility of things like infestation. we felt like that level of detail was too far down the line from what were concerned about. they also presented, not a actual sound study but of limitary one. that's what i think our staff has presented to us today. so, again, i think because the facility-unsightly poe holder the warfield theater themselves felt comfortable with the project we do not have any extra conditions do apply to it. if there's any questions about that the village and pn oh fight did not show. they were definitely notified >> i can add, i've been contacted by the acoustical
6:44 am
consultants who asks further information of us with respect to a proper sound study as her legs and places of entertainment. so, that was a great outcome in the kind of thing we are looking for across the board with projects that have between entitlement and finally being built and populated, but there's good communication throughout that process and we facilitate the places of entertainment. also, just you know, 950 market has been a project was a whole different formats for some years. as part of the midmarket redevelopment in the mayor's office assistant, does a lot of meetings. so, i feel as if the village and the pn oh flight folks are comfortable with the
6:45 am
project sponsor is a met with them many times. even though this project has changed in the last iteration, intrusive les arts and more residential and hotel and commercial, there's open lines of communication. so i didn't feel they didn't show up, i think, because they felt comfortable. if they have a concern they know where to go to. >> with that, but we are hoping for is a motion to approve with the standing conditions, , item 6a. i don't know if there's questions or happy to answer them? project sponsor is not here today because they asked him. we saw this more as a procedural measure than to actually hold yet another hearing. >> so, the only thing is if we are supposed to review all this
6:46 am
it would like to get it a little bit earlier if possible, but i'm going based on what the committee has artie gone through. they've artie read the surrounding neighbors. it's in your mind that whatever you guys can [inaudible] then obviously the subcommittee-i mean the committee would be the ones that support. but i like to get a list of little earlier. what i see looks pretty good already. >> totally fair. this is a little unusual tonight. >> i'm getting old. sorry. >> absolutely. i think because again we cannot have the committee meet we wanted to-but we are able to have an informal discussion. we want to still have been the full commission
6:47 am
approved. >> i think at the end of the day the people surrounding that music envelope to you guys to say, hey, you're going to have to trust us. i trust you guys because you guys are the experts. i would be on the other side. trying to [inaudible] the complainants. >> point taken. any other questions or comments? if not, i like to entertain a motion to approve 6a with our standing conditions, which i don't know if there's a formal name for them >> standard conditions. >> are standard conditions. for residential development projects. moved and seconded. moved and seconded. any public

comments? >> i'll be brief. i was impressed with croup i. they know they have to improve lighting. have surveillance cameras in the exterior and also in the parking lot both personnel and other things i was pretty impressed with the fact the very proactive and they were very-i thought it was excellent communication between them and the warfield. just might observations. >> thank you. any other public comments? of the common is close. let's take about >> commissioner frost joseph caminong tan >> the motion passes. this

ubuntu six 6b. six and 57 california st. is a residential project. they complete a sound study across all hours of the day which you see in that packet. there's two place of entertainment that within 300 feet. one is playland and is the other encore karaoke lounge. either responded or showed up to what we thought might be a hearing, and a long and short of it, these guys have done a lot of community outreach. at lots of support from the businesses around them. we made sure to drill the point that businesses are not the same as the residents. residents are the ones that generally will complain about when entertainment or sound coming from the venue or people are walking past in screaming or whatnot. that's about it.
6:50 am
there's an outdoor deck area that we sort of want to make sure they were aware making complaints from that dependent with the program is there. but, they seem very well equipped with doing other homework in terms of making sure that it's reviewed. they spoke with all the necessary committee members planning to run and have another box is checked. the very last box. for them to check. so, i think that is the gist of that. i don't know if there's questions? >> if not, let's do another most. again, like i said little bit of an unusual ask. i don't think we'll do this for every single project every time. is
6:51 am
there a motion? moved and seconded. any public comment on 1567 california st.? i don't see any good public comment is close. >> on a motion same houston call? >> looks like every when isn't it the motion passes. organ move onto item 7 commissioner comments and questions. any comments or questions commissioners? commissioner frost >> i just saw your beautiful form. unless client may be learned to do pdf firms. so if you want to do that. i'm now an expert on that. i'm having to convert all forms into an online

so everything will be legible. no more chicken scratch. i'm happy to do that >> that his grades. thank you. other comments or questions? no? >> julia notes anything? >> absolutely. this is the time. >> so, this thursday for operation dream with the police department cmac is having a toy drive and a party collected a bunch and if anybody wants to come on thursday 6 pm at the press club it's open. no charge. if you want to bring a toy for the kids. then will release all the toys to the sfpd. what they do with it, hopefully it goes to all the children centers in san francisco. so it's the press club under the four

seasons hotel. >> is santa coming this year? >> i don't know. >> any other comments or questions or announcements? we are not having another meeting until january 5 and >> in a case happy holidays >> happy holidays. just a quick question for staff. i know that we released the new year's eve permits like announcement saying apply early. without looking like right now? as an applied early? >> yes, actually. i do know that helped or not. it's hard to say. we did have a few before we said that notice out. there's probably seven or so.

nothing out of the ordinary one-time event which is what we are trying to bang out of the bushes. the regular list of events that we know happened every year not just in venues but in hotels another event spaces are all being sort of works into a plan for the inspectors who will be out and about. we expect it to look a lot like halloween did this you. howling was a whole weekend long. so, we are prepared, i think, and by the end of this week if i don't have it it may not happen. speak up not getting approved. all rights. go-ahead commissioner >> june we have to reschedule our retreat was that still kind of- >> we've not rescheduled that. thank you for reminding me that. is there any public comments on what we just talked about?
6:55 am
no public comment is close. last item is new business request for future agenda items. anything to add besides our growing list of standing agenda items? seeing none,, i think that means our meeting is adjourned. >>[gavel] >> >> i have 2 job titles. i'm manager of the tour program as well as i am the historyian

of city hall. this building is multifaceted to say the very least it's a municipal building that operates the city and county of san francisco. this building was a dream that became a reality of a man by the name of james junior elected mayor of san francisco in 1912. he didn't have a city hall because it was destroyed in the earth wake of 1906. construction began in april of 1913. in december 1915, the building was complete. it opened it's doors in january 1916. >> it's a wonderful experience to come to a building built like
6:57 am
this. the building is built as a palace. not for a king or queen. it's built for all people. this building is beautiful art. those are architecture at the time when city hall was built, san francisco had an enormous french population. therefore building a palace in the art tradition is not unusual. >> jimmie was an incredible individual he knew that san francisco had to regain it's place in the world. he decided to have the tallest dome built in the united states. it's now stands 307 feet 6 inches from the ground 40 feet
6:58 am
taller than the united states capital. >> you could spend days going around the building and finding something new. the embellishment, the carvings, it represents commerce, navigation, all of the things that san francisco is famous for. >> the wood you see in the board of supervisor's chambers is oak and all hand carved on site. interesting thing about the oak is there isn't anymore in the entire world. the floors in china was cleard and never replanted. if you look up at the seceiling

you would believe that's hand kof carved out of wood and it is a cast plaster sealing and the only spanish design in an arts building. there are no records about how many people worked on this building. the workman who worked on this building did not all speak the same language. and what happened was the person working next to the other person respected a skill a skill that was so wonderful that we have this masterpiece to show the world today. good morning and wo
