tv   Entertainment Commission 2216  SFGTV  February 7, 2016 3:15pm-4:36pm PST

3:15 pm
commissioner president tan. >> we have a full house for we can have a full house all right. commissioners, that places you under your is public comment general public comment so this is for items business recommended to the entertainment commission you don't currently see agendized any. come on up and state your name and again not for on item on the agenda so you have 2 minutes >> how you doing i'm paul i'm one of the partners at the night club. >> can you speak a little bit louder. >> i'm with the seller night club we wanted to bring out to the commission and everyone involved the fact that we would like to petition and keep the
3:16 pm
discussion going about the central district program. >> 10 b. >> yeah. i noticed it is utilized in san francisco and an ongoing conversation with the police department in central with district but not conformed anything love activities downtown i think it will help us the operator and neighbor and the public to work with the police department with other districts as well. >> great can i just clarify you would like to use 10 b as the seller. >> i'd like to use an option you know, i speak without owners in the district not that many less than half a dos dozen that are active and busy not something to discuss on a daily use but have an option we know with we have special event and so forth not something that is
3:17 pm
needed or required on a long term based but an option for we feel is needed. >> have you not been able to get through with them. >> that would be helpful thank you. >> is there any additional public comment? >> all right. seeing none, public comment is closed we'll move on to item 2 approval the meeting minutes of december 2015. >> commissioners i know if there are any edits or changes you want to make if not. >> move to approve. >> great. >> second. >> there is a motion and a second any decision comment? all right. public comment is closed. let's take a vote. >> commissioner perez commissioner caminong commissioner joseph commissioner lee commissioner frost
3:18 pm
commissioner president tan. >> the that motion carries item there are no 3 report from the executive director. >> good evening it's been awhile since we've been together so i'm going to try to be brief we were in a long committee meeting before this update on the implementation of item 16 upcoming item regarding the meeting we had we're not meeting monthly instead of twice a month based on the number of projects coming through the office meeting in 408 like a proper hearing room and today was the first trial run it went well we are getting much closer with help on the disclosure piece and being able to present that disclosure and do it online on
3:19 pm
to a 24/7 assess so as those projects your revealing getting closer to finishing and getting people into them we'll be ready and prepared to take those disclosures and have it back to make sure that everyone who comes and goes from the apartment whether renting or selling have those proper disclosures other than that you know we are communicating with individual planners still project sponsors are somewhat slow in my mind to be communicating the law requires the project sponsor initiate the communication around the project in many cases the planner is doing that and in many cases like acoustical sound
3:20 pm
we're not aware of so whatever comes to me you know we're going to tackle it and i think today indicated for those of you not there a roomful of night life operators this is the first obviously projects that are abutting with the residential and butt place of entertainment but a wideningness to engage in coming to the committee meetings and speaking for themselves not for them you can see is a lot better then us making up reasons you know to send something to planning so there was at initial task force meeting on january 13th
3:21 pm
this is the state legalization task force to create rules and regulations for the city and county of san francisco and in advance of the adult use legalization of machinery marijuana while we have 20 years of experience in medical marijuana in san francisco not experience in recreational use a lot of issues to tackle and we're much better off doing it before legalization so i am a member of the task force but unknown voting as the rest of the city agencies as well are non-voting but there to assist the folks that vote on the task force in understanding what our processes are the next meeting is in march i will keep the commission up to date i'm excited it will be interesting i think they're looking me the healthy in charge of staffing me
3:22 pm
to be engaged the process of deciding public use something that the san francisco when is public use mean from the state indulgence that what did this go look like for the city and county so that's kind of cool so we are still missing a commission should be 7 of you, we have a vacancy, however, last what was it thursday the rules committee met there were two applicants one of whom was moved out of the rules committee his name was joaquin and i expect
3:23 pm
this to be next thank you at the full board not sure what will happy but have someone here the next two meetings so we can have a full commission that is really obviously important and this seat a seat number 3 and it is basically the rest of the term that would have been commissioner moshoyannis term so we'll be going introduce this again in july of 2017 a year and a half so look forward to that the position that was opportunity the last year's budget is finally moving ahead with should speed notice and posted for two weeks and there are to date 19
3:24 pm
applicant which i'm happy about they have to be vetted for the minimum qualifications we'll continue to move through that process if everything goes well we have the channel interviews hopefully by the end of march so, yeah cross our fingers that we have a good system in place i can choose the rule of 10 to say this is a civil service commission we can't choose money but pick the top 3 that was the consideration and i am hopeful that a person will be on board soon the last yeah, so the last part of my report is corrective action and i almost never have to talk about corrective actions
3:25 pm
i didn't brick the file a month ago there was an incident sincerely and we sat down the office with sfpd as well as our staff and came up with basically a list of conditions that were put in including reducing the negligence of entertainment commission and the security issues and put them into the permit via the directors that came before and so those are part of permit now and you know we're keeping our fingers crossed that changes will you know make a difference. >> so president's report if you have any questions otherwise i'm going to turn it over to jordan. >> would you recommend we
3:26 pm
review the seller and ask them to come in a as a commission or the directors order will be effective. >> so it is my intention to have the seller here at your next meeting that will be on the agenda. >> great commissioners any other questions or comments. >> okay. >> sorry one thing when you met wet sincerely and central was the discussion regarding the 10 b that the gentleman brought up. >> i think that the operator and the sellers brought this up before and in general the response has been over time that the police department by policy isn't assigned to be licensed holders they feel a conflict of interest but a way to have assigned by a different entity like a cb or the administers
3:27 pm
association that would be possible but i don't recall an agreement they want the presence of a black and white as a detergent i understand that can work it is difficult i think in what is here. >> in the super bowl is going on so the responses have been staffing is even tough and they couldn't guarantee having someone there so in a car so he would do his best that will leave it to them to answer questions when they're here i don't want to speak for them. >> i have a question for commissioner frost years ago if you had a large group of people that would exist all at once and
3:28 pm
spoke to the controls they'll send a car or a quarter to 2 and ask everyone to disperse to you went are. >> when we walked the beat your near robins is there we're there that he bar closings but a smaller district where you had the amount of personnel to do that. >> the southern they did that southern was overloaded with officers their calls for service boo-hoo now every station as far as i know they're low but, yeah this is exactly what you want you want the high profile. >> the only problem the shifts changes at 1 o'clock others two they're getting their act together so a drive by they're not available that's the problem as well the shift change around
3:29 pm
one. >> not a shift change but the officers get off at 2 o'clock so they're doing their paperwork and at substations an overlap two officers that are working from 6 to four to handle the bar clorgz and things like that i know we did that at central but strait is broadway broadway takes a lot of that. >> they used to call the night club. >> but southern has it definitely like i said central most of their resources you know went to broadway so sad to say the outline businesses didn't get the kofrmgz because the broadway when i was there you had the motorbike copies and the units were told to go to broadway that has slacked off
3:30 pm
but, yeah i'm sure that captain mathis talked with the night calendar for the problems they've been having. >> i'm happy to see from the captain would come and have this communication commissioners at the next meeting it is legitimate to have them come up with commissioner lee it comes up all the time and as far as the police officers resources they they implement them obviously every station call and calendar is different a change in policy and practice so it's great to talk about what used to be but you never know until the ask the captain so you'll ask him to come if he's available we don't call it drive by but a passing call the drive by is a
3:31 pm
whole different thing (laughter). >> and investigating 10 b is not always the answer security to say has to do their part just because of 10 b they don't do all the work. >> but having this at the next meeting hopefully, there should be a police representative and maybe a captain officer let's move on to the sound like inspector. >> did you ask. >> i know who you are. >> actually. >> i mean. >> so several items been a while since we met the happy new years party was major and having several thinks things that happened in the past month a lot of complaints received a complaint about the irish pub
3:32 pm
and like the several complaint in the past patron noise and messy sidewalks patrons catching louvers and being disorderly open windows but nevertheless, i've been in contact with the major complainant so i'm working to figure out his main concerns and i was able to go by this weekend but not been or be able to impact it's been a busy night on saturday and just the general busyness of some of the venues on saturday night so action is pending on that one i'll more to report the next meeting most likely a complaint was received an unanimous complaint about the financial a
3:33 pm
window was open the back and noise i guess was coming out nonetheless we haven't received any complaint about the fillmore auditorium i'll stop by and just mention to the management there and hopefully it will solve itself and another complaint received around new year's around the tunnel i mean at this point, i on the best option for the complainant is dealing with the venue whatever is happening no egregious but is consistent service be interested i past by all the time and stop for two seconds didn't take much to figure out what is going on i don't see an issue but i directed the complainant to deal with the issue and hopefully, we'll see
3:34 pm
a couple of compliance issues checked in with the basement and the main complainant she said it's been a little bit better the management has been more responsive what we have they have complaints and keeping it down to start with still night life issues the owner is the process or supposing the process of making moving or selling it whatever we'll see i'm keeping tabs on that regular item additional 1015 fulsome new year's was the most businesses it parties for new year's and really streamlines a lot of activities but i saw the security hustling i want to point out that out sometimes security sometimes not so active and symptom for active keeping
3:35 pm
things under control the last was the melrose i thought that might be operating out a permit on new year's but the management they don't plan on doing a lot of entertainment you know they wanted to but so, yeah it looked fine for new year's that was really busy inspections that should say january 23rd i mentioned the date stopped by the grant to talk about super bowl they have major partyers but i did a walk through and well-managed situations they're in compliance i don't for see anything actions regardless of super bowl but - i did a walk through an hugh at
3:36 pm
new year's same thing busy lines the police officers their apprehensive at that location but nevertheless, their declined nothing interesting to report similar story for city negligence on new year's there was a couple of incidents that happened one was this past weekend at fort wayne we don't have so much information the police department was busy this week i haven't talked about with captain mathis there was a shooting across the street from fort wayne in relationship to what was going on there that night i was able to talk with security on saturday and talked with the management open monday and he gave me a synopsis of
3:37 pm
what their involvement they said what happened across the street didn't result from something that happened the club i don't know but that's what he said and basically, they didn't see anything happen but saw the guy running after he got shot and the police called we're waiting for more information and there was a shooting at dna lounge on the 28 of december that was not their regular programming and i think that you know it was dealt with pretty swift they're not going to do that program and a better job obviously dna lounge didn't run the type of bar with wishes it is a nominally but nevertheless, something that happened that's it i'll be happy to answer any questions you may have. >> and respond to them. >> i have a question for staff
3:38 pm
after years and years and years not having any shootings now have two in this report. >> one on the 28 and november 29th and december 28th a month apart okay nevertheless, a month apart; right? this leaves me to make my ears go up and maybe we need to institute some kind of i know industrywide security meetings or wait for the submit or so what happens i just do want to go down the road like 4 years. >> i don't know we can draw conclusions one just happened we don't have any information
3:39 pm
awhile jordan says seize it happened at the dna those were outside of the dna. >> a nexus to dna. >> i don't believe there was but i don't know i'm not ready necessarily to draw that conclusion your drawing. >> i'm not i just wanted to do a avoidance. >> i think after the swift action on our side with the police departments assistance obviously we're going to do what we have to do. >> my concern so many good years and people are lax on their door policies. >> i don't believe that is the case and if we continue to see violence in any way happy to bring it up at the submit i'll
3:40 pm
not say that is a trend we've not met in a long time but we've not been here in months you're hearing a lot the other thing i want to mention jordan said in relation to the super bowl we've been making lists from the internet and the police put a list together of the events that will begin to happen starting tomorrow night in places where you don't normally see fence tents going up everywhere and celebrities here in san francisco there are going to draw large crowds we've been out there we'll keep on doing that and communicating with the managers and security around what their steps they're taking to insure
3:41 pm
the in the that feature a lot of urban celebrities are you know staffed up and ready to handle what is happening because it is crazy already out there. >> cross our fingers. >> other questions for inspecting pauley? all right. any public comment? open up for the directors or inspectors report close that thank you very much for the report now police department questions or comments no police officer here i think they're all busy laughter busy with the football thing the football thing >> yeah. the football thing item number 5 possible action
3:42 pm
for permit under 9 entertainment commission tonight only one i will pass it on the deputy director. >> thank you so this evening we're hearing one permit for the limited live performance space this is at 3318 mission the outer mission area the place has been in operation for i believe 20 years, 20 plus years the venue is here today to come into compliance their entertainment which includes performances by mary ahf abandon this is the complaint i'll get into and prior the dowel - the sound like
3:43 pm
levels by the mary ahf - they have a lack of responsiveness a letter from the complainant that contains a log the complainant to the view pd and the commission the complainants have asked in their letter the commission deny the permit or grant it with the notion we need the 6 months in order to assess the data and lastly if you grant a permit you're required entertainment to end at 9:00 p.m. on week days we've gotten a couple of letters
3:44 pm
of for the from supervisor avalos business partner carlos is here i believe he has snachdz in favor of the permit and from the station approves 2 here to talk about this this is the owners son and also general manager sanchez the owner couldn't be here because of family emergency so - >> you guys want to come up. >> good afternoon. i'm mr. sanchez i just like to start off by saying i have another letter of support by mission administers association a come up of letters from the neighborhood. >> want to pass it up to us.
3:45 pm
>> as you may know we've been in business for 20 plus years we've never had any complainants about conducive of music or any thing that matters the reason we believe there might be noise going going into the other building is due to the construction right now so i've been in contract with officer and at the very beginning i tried to make contract with the neighborhoods when police was called out but i was told by the police to not make contact with the neighbors at all this is a couple of my goodness months ago o months back i was told by two separate police officer not to make contact officer beckham was one of them as far as the responds to the neighbors i
3:46 pm
couldn't make contact because he said not to make contact so with that said, we have done. >> can you explain why they said that? >> why. >> they said they wanted to be the middle plan so if i have anything to say leave to sfpd. >> what was the officer. >> officer beckham was one and the other officer one of the neighbors was outside i thought that was a good opportunity to introduce myself and let i am had know he said go back inside and not make contact with any of the neighbors so. >> inglewood station. >> correct i had the meeting with officer yesterday and he told me again do not make contract with contact with the neighbors and that's interesting.
3:47 pm
>> i couldn't do anything about that. >> so have you had any contact with the neighbors. >> no. >> the neighbor came in ones or twice but i was either downstairs or the kitchen and his or her talked with the people there. >> not the manager or owner. >> i've not made any sort of contact. >> with your father. >> no, not with him either they can make contact with me my cell phone is on the application anyone that feels wants to call feel free to call i'm available. >> okay. that was poor advise by the police officer. >> that was i did not understand.
3:48 pm
>> unfortunately they're not here to explain it is what it is. >> so can you talk about the like the why you're here what you're trying to do. >> basically, i'm here to so let the commission and the neighbors know we have done certain things to either reduce or eliminate the music or the noise that is leading into the other buildings i have several examples i can go through them if you guys want me to the first one which i think is really big to us your customers are know the mary kvetiachi our clinic t
3:49 pm
there was one of the customers called the mariachis to come in for an hour music but the mariachis said they couldn't play inside the customers said just colonel we'll play outside so they went up the street by safeway and outside for an hour playing mariachi music. >> it is not amplified they only play their music. >> right. >> okay. >> so that's one thing we did and another thing we also lowered the music on the jude box everyday i'm checking it to the far end to the doors to make sure when i'm out on the on the street can't hear it as far as
3:50 pm
the volume i check it evidence. >> you can control the volume on that. >> yes. the only thing it the not like a body number. >> do you have any meter to check it not based our ear but the noise level. >> i have a question have you ever told police officers that you have a sound like permit. >> i did the very first time but i thought he did and turned out we didn't i--i don't know that. >> did you know you needed one. >> no, i did not. >> so you thought you had a permit. >> i don't know we didn't have one. >> but you - i'm sorry good evening commissioner president
3:51 pm
tan i'm carlos the secretary of the business partnership the beginning of 20 years old when we applied for the first time permit and everything we was asked if by the need the permit and sometimes you know sometimes the mariachi is work and get inside we asked them to an number and they said no, they come in and playing one hour and leaving and sometimes this customers like the jude box. >> what was that 20 years ago. >> yeah. we never have troubles because we trying to be good relationship with the neighbors
3:52 pm
months ago we started the renovation the contractors need to remove the installation on the second story we believe that right now the nation need to be provided the next two months to put it back with the construction plans to show you exactly how we will finish with this and put the outdoor walls with the apartment like to be small so we get to keep more cover on human resources. >> at mariachi band have you paid them. >> no. >> at your place. >> we never paid them. >> as far as the mariachi i tried to limit them to only saturdays and sundays when somebody comes in you think announced i ask them to leave if
3:53 pm
they leave they leave and if they don't i can't physically remove them i try to have the mariachis on friday's and saturday. >> the jukebox considered a mechanic thing so there's nobody operating it, it is coin-operated so not entertainment commission; is that correct. >> not entertainment but not operation exempt specifically. >> okay. >> the other point we are having the complaints not just no the night but all the time having complaints around 11:00 a.m. are 2:00 p.m. >> so you play the jude box at 2:00 p.m. >> only when the customers play the music sometimes a period of time no reason but if you put money in.
3:54 pm
>> do you have external speakers for your jude box does the jude box play through the speakers e.r. external ones. >> external. >> could you explain the speakers would size. >> around 5 inches but on one of the things we did we disconnected some of the speakers one of the main ones i think that was macro noise into the other building we disconnected a box that was this big mounted on the wall the back of the speakers facing the wall so we disconnected that one all the other speakers are on the roof open the ceiling pointed out down. >> so to staff the jude box ♪ i take it own case is exempted a
3:55 pm
jude box that is overtly amplified by speakers is also exempted >> i don't know the specific the code but i think the point here is not technical whether it is effected or not but the points on the applicant making adjustments to changes to manage the sound issues whether or not the permitted placed obviously it matters with respect to how the businesses are regulated the over arching issue if there is to be regulation we regulate what we can and like i said earlier we have access to regulate the business as a whole in many other ways that ordinance still remains the police department is indicating this business operator shouldn't work with their neighbors without a permit we don't have
3:56 pm
the ability to help this business operate better. >> i hear you. >> great. >> i just wanted to suggest with the speakers you ought to get a 5 inch speaker a couple of them around the bar and take the rest out you jude box is you don't have a separate amplifier they are chained together. >> they are disconnected or connected to the jude box. >> the jude box is amplified your amplifying those speakers with using volume control. >> it didn't give you a number. >> you need to take some of the speakers out. >> if i called the jude box and asked them for a different type of volume levers would that be a solution.
3:57 pm
>> i don't know what your building is made out of or the sound like effects but a jude box with external speakers the judy boxers and the other speakers you're creating all this sound how big is your place how much secret. >> 18 hundred. >> not that big why do you need all those speakers? >> i mean you know if you come up for a permit i'll put a permit on two, 5 inch speakers on the jude box. >> i mean, i'm telling you and the mariachis are not amplified if in their indoors of they don't get paid they're considered entertainment you
3:58 pm
need a permit and this permit you're applying for you must and end all treatment at 10 o'clock at night. >> we don't want it past then. >> it didn't stop you from having to sound proof your place oars the main construction is sound proof so, so don't play any music while the construction is going on. >> i want to trace what is going on it sound like prior to the construction there were not complaints or few that's correct a; is that correct that started in november. >> april. >> august. >> august it start last summer and still going on who is doing
3:59 pm
the construction. >> obviously it didn't doesn't matter. >> there's a situations hopefully, will be the situation as complete temporary situation you'll have to make arrangement for how you make arrangement for our hopefully sound proofing we've not test that but ultimately any permit applicant comes to us they can play the loudest music loops it didn't effect the neighbors you have to make sure the sound materials with good enough to block out the music doesn't make sense what do you do now how many speakers but the bottom line you
4:00 pm
shouldn't be yes, ma'am latino noise when the doors a vent that is yes, ma'am latino sound liem ultimately we want businesses to have entertainment you have to do it right and talk with our nightclubs that's why i don't understand why the police officers said not to talk with the neighbors i'm going to turn it over to commissioner perez more questions stay tuned. >> so you're the manage i manage the entertainment; correct? >> right. >> this mariachi band that comes in how many people are in this band. >> there is usually one or two
4:01 pm
guys to any place they walk around and have a lot of years past but since i've been there every time they come in we kicked them out they basically stopped very rarely will one come we kick them out one mariachi group we have and 6 to 8 people like i said only saturdays and sunday it used to be thursday through sunday it was too much i only wanted them there an saturdays and sunday. >> your ware the 2 member mariachi band listening to you; correct? >> sometimes they listen sometimes they don't if and when you get this permit are you going to work with them in the future.
4:02 pm
>> if i get the permit like i said i'll only want the mariachi saturday and sunday might be friday and another thing that happened open thursday they had a birthday they'll call the mariachi to come in and play an hour and then leave as far as like the week goes. >> that's fine assuming you get this permit as long as the sound didn't leak and bug the neighbors again, we don't want to detail when and who you bring in. >> time to make sure the noise a contained and so your sound like inspectors are here i'll recommend step outside and listen that's a good test but not the best test you're not necessarily living in the same
4:03 pm
unit absent the person complaining sound travels so with the officer you if you're at the restaurant the volume seems low we don't live at the apartment so we don't know what is loud and node loud we've not been this this situation we don't know we've done certain things we thought might lower of reduce the volume i don't know if they worked. >> when is your construction as opposed for over. >> hello, everyone i was with speedy construction. >> (laughter). yes, this is has been on hold for 10 years because the permit now the last couple of months the revised drawings the building when it was drawn there was mistakes by the engineer and architect so i'm clarify that i
4:04 pm
know we are proud of our name the problem is this building it is a problem this is second story restaurant and living space so in order to have it done properly we need the proper installation in our crew we have hired our engineers we've done some things the city bars and restaurants we were required to have as much continued sound from getting out of the building we're going to use more installation 3 inches we do the channel and the gap between the walls and the major channels with the soundproofing of the drywall all the things to do together the ceilings will help the buildings next to us we have
4:05 pm
to sound proof the living unit on the third story so it will be tied up and we're trying to get the sound down but right now only 6 speakers there are - i mean smalltime speakers not as loud as the new speakers their older one second we bring the sound we open the whole building we created the second story and the third story all the sound in the restaurant is through the waltz we have met last week with the dbi to get our approval for our amendment and they said there is going to be approved in two weeks we've been on hold for 3 months >> ones it is approved two or three weeks how long. >> we're talking about the building to stabilize we are in
4:06 pm
april. >> april part of why i'm asking for this permit we will set a condition you can't have entertainment whether april 1st or 30th we'll consider that because the problem you're not sound-proofed and we're getting complainants. >> it could be one or a thousand someone is complaining and it is not something. >> we're doing things eliminating things trying to here on behalf of the appellant. >> great we want to survive as a business so i think we have heard a lot enough to make a decision only a couple of more questions commissioner lee and commissioner caminong. >> where you are right now with the construction have you. >> all the frame is done. >> no sheetrock or
4:07 pm
installation just - >> on the second story and third story we have the second story finished. >> all the channel is in place. >> we have to do our revised drawings requires to remove things and sound proof that we need to run electrical. >> what you have existing what are you using for installation. >> the ceiling in the restaurant it is there we've been removing installation but from the second story we have - >> no installation stalltion. >> r thirty. >> so the paint stuff. >> that part of installation we're trying to use that installation. >> (laughter). >> so alright okay. >> is that all your questions.
4:08 pm
>> are you going to use the pink do you have it out the rest of the building. >> in. >> commissioner caminong and commissioner. >> refusing e reviewing the complainants from the neighbors it started in november you have no direct conversation with the neighbor and no one at all. >> none they come into our restaurant and try to talk with the staff. >> they have talked with the staff but not me. >> you've been told not to contact the neighbors. >> around nova the first or second time the police officers came in i went outside they told me to come back inside. >> i guess are we bring officer because he. >> not sharing. >> so he and another officer -
4:09 pm
yeah. is seems strange and in our process talking with the entertainment commission have you been advised to speak with our neighbors. >> by the sfpd or. >> sfpd. >> our staff. >> i don't think so unless i said can we have the contract from the person making the complaint we can talk with them. >> actually carlos i asked you if you received complaint you said no, i told you about i said you needed to talk with our neighbor that is the first i've heard the police officer told you not to talk with the neighbors. >> maybe we were confused maybe need a permit to give you her phone number. >> thank you. >> let me finish.
4:10 pm
>> no, i'm going to take our commissioner caminong any more questions. >> commissioner perez was next i'll wrap up i think we may need one of the officers here to. >> i don't think - not at that point. >> i was going to ask if you happened to review the good neighbor policy. >> that means anyone that calls you, you need to respond and engage with our neighbor and we talked about that yesterday with the officer yesterday and . >> just with this particular neighbor or anyone. >> anybody that wanted to contact me we're willing to take any suggestions that the commission we're willing to do anything. >> you need to if you're going to be in business and go a be a
4:11 pm
good businessman check with the regulations of the businesses have changed this is a good bypasses 20 years ago no entertainment commission and maybe there was no permit for a jude box but there was a trace of entertainment a dance hall permit in order to have these kinds of treatment so that might have been what you think but nothing happened in 20 years not good business practices from now on you need to check with with the business practices have changed. >> i wasn't aware i thought we had the proper permit. >> foe you're aware we're trial court to figure out any more commissioners questions or comments why not have a seat
4:12 pm
we'll open up for public comment. >> thank you. >> any public comment on the permit. >> go ahead whoever wants to come up state your name and you have two minutes. >> thank you very much i'm lisa i was one of the people that wrote this letter in our possession i want to thank you for giving this consideration and for the entertainment commission that has been helpful its been a living nightmare no other way to describe it i'm hardly sleeping there because the level of noise from 9 o'clock in the modern to maintained 15 hours a day and going through the walls as you see the document in front of you 6 complainant prior and
4:13 pm
gone through that called them and complaints with the police officer after 11:30 at night they say we can play as much music as they want when we've called during the day generally to call the manager to get the manager not to complain about this music the expectation is unreasonable this is a condition that people live around the businesses don't expect others to have music the issue is about community respect we can't listen to music that loud for 15 hours a day and so we need you to put something to give this permit we beg you you know to 9 o'clock at night from sunday to thursday and friday to 10 it is an issue
4:14 pm
of construction causing exacerbating the situation and to the construction is taken care of we don't mean to be unreasonable but it has made your lives very, very difficult thank you. >> other public comment come on up. >> hi, i'm audrey and another issue that is around the trust worthiness to follow 0 through would go rules around the sounds because the officer went but out to talk with them and tloichl to turn the music off at 10:00 p.m. and turn it adopt at the continued to play it loudly all day and actually midnight sometimes past midnight it
4:15 pm
continued to make complainant let me let him know and logan that that is stressfully and hard to deal with not being heard or just considered are respected in our homes and you know just around the construction too it is also difficult to live next to one an unsecured blue tamper behind the second story that flaps loud all day and night that violates the rules from 7:00 a.m. to 10:00 p.m. i've cuddle 36 and that's other sound violation coming into our home not being able to sleep and just like the visual impact that the construction with the scaffolding and when we walk out on the sidewalk we walk around it and people lecturer
4:16 pm
underneath the skaifl it unpleasant but get the sound proof how trust worthy or can we spend time and energy to call the police officer and the entertainment commission it is a lot of work we're busy people and so that adds more stress so thank you for hearing us today. >> is there any additional public comment? >> all right. seeing none, public comment is closed commissioners, i i don't know if we have enough fog here to make a decision today given there is a little bit of a conflict the story telling we can condition the hell out of this. >> i have a question that the
4:17 pm
neighbors has this have you been living there can one of you step up to the microphone when this started with the construction you know is that what happened when the walls opened up prior to that. >> i've been living in the apartment for 5 years i've also heard the sound the bedroom next to the wall that shares the living space at the time at that time, i was not spend a lot of time in the house it wasn't necessarily impacting my sleep and quality of life but for me things changed i've been working from home i i'd like to take this opportunity concentrate the living space is in here bedroom now. >> but i feel like - it
4:18 pm
definitely seems like for amplified and louder since the construction for destructive. >> thanks so so i want to make a motion i don't think i can do this why are we granting them limited liability nothing startles until the construction is over why don't they come back with the construction is over that would be reasonable thing to request the commission discuss. >> okay. >> continuance only given also questions around the police department and their instructions and i believe that is very vitally that this clarity around what they meant if they've not said that i
4:19 pm
personally want an explanation. >> okay. i'll move to deny the permit on until ca i can't. >> there're a difference between american people denial and a grounds for denial or do you want to do a continuance. >> can we continue more than 45 days. >> yeah. >> so a limit live we can more than 4 days. >> the issuance is the place of entertainment whether you ask the applicant where they would like to continue this. >> so here's the deal if we deny you come back and pay the fees i'm asking you to agree with me and continue this permit until you can show a certificate of completion and in the meantime you can't have any music because don't raise your
4:20 pm
hand you can't come up and talk anymore if you can't contain the sound like you're in violation anyway and we'll grant you a permit and restrict it to no sound i suggest with our permission that we continue the permit until the middle of april or with whichever you come back with a construction that is completed and have a certificate of completion and we'll move forward about combrantd i say permit in addition at that time, this is unusual for a limited live i've ask for a sound check from an officer that's my motion. >> you move to continue this until april with the proof there is some certificate of construction. >> and a sound check and
4:21 pm
correct. >> commissioner frost. >> can i make a friendly amendment having a certificate of completion has to be done after the installation for the soundproofing they may do enough were the soundproofing but more construction before the completion it will be okay if they have the sound check with our inspector prior to getting the certificate after they've done all the work they say needs tobacco done. >> i don't care about the apartment or anything i care about the place where the music comes from and that the walls are completely closed and sealed and the soundproofing is in place. >> that's i thought. >> right so how are we're going to know when the bring to your attention in what manner what we
4:22 pm
make a depreciation it is complete yovp i don't have an answer. >> leave it on and have the inspectors once the manager decides that the - >> he's not a building inspector or sound like officer. >> he can do a sound test whether of they don't have. >> staff what do you think. >> they need to be clear you need to be clear it has to be pulled from the applicant to indicate that our office they are ready for testing. >> okay. >> we don't have a way to know. >> so the trigger was the certificate of completion was my trigger 0 so, i mean i can withdraw the motion and restate
4:23 pm
that the apply it as dual part not the apartment or anything because- but i'm not confront with that there is no way for me to know see i cannot put it to make sure that's not his training inspector pauley it is complete and done with the soundproofing and take the tests and if it last week's i am not i don't know. i don't how to do that. >> commissioner lee. >> why don't we continue and we also like to hear in the police officer and if they're going to engage i would assume the neighborhood reps agree they engage with the neighbors and come back to us again and see where they're at with the completion and if for the
4:24 pm
comfortable put out a conditional they didn't engage with the neighbors we didn't hear from the police officer so there's a lot of questions. >> i'm going to. >> i'm going to change the motion. >> we have a meeting two weeks ago from now and continue it to this is an i want to withdraw that motion and i move to continue this permit to april 19th which is the regular meeting day for us april 19th and they can come back with police officer and the neighborhoods and prior to april 19th complete with the construction and call our office for a sound test that's continue to april 19th. >> without any stipulations to
4:25 pm
construction or completion it's on them to complete their construction and call our office and get the sound test but i don't think the sound test needs to be part of that they can continue it again and after that once we've permitted it. >> we don't sound like test limited live. >> were we conditioning. >> i move to continue to april 19th period. >> great (laughter). >> simple. >> we need the applicants agreement. >> do you agree go to that yes or no do you agree are disagree okay. they agreed. >> so there's a motion to continue until april 19 second? seconded let's take a vote >> all right. commissioner
4:26 pm
perez commissioner caminong commissioner joseph commissioner lee commissioner frost commissioner president tan. >> the motion is continued until april 19th hopefully, we'll see you they know then and good luck with our construction and please does not play music until you see us again if there are complainants to the police you're breaking city code and we can't protect you from that. >> can i say something no. >> you i am not if their mit sound complaints. >> you can't say anything i apologize we're going to move on to item number 6 ; is that right. >> which is discussion and
4:27 pm
possible action to adopt written comments and represents to be submitted to the planning department and/or the department of building inspection for the probably projects per chapter of the administrative code that's a mouth full this is a consent calendar item so i think that we're kind of getting the protocols smooth as we have each meetings i'll pass it to the director to say more. >> i don't know what to say there were 3 prongs at length today and there was we sent recommends our standard with additional recommendations with each project with the things we've heard to the planning department, planners that hopefully, will improve those
4:28 pm
projects to which of which are abutting mraefks make that go away and the venue so as the president said we're getting this down to a better rhythm and these - we need to listen separately here but i'll ask the commission certainly ask questions if you feel the need but a long discussion is not appropriate because we've had it if anyone is interested they should come to the monthly rdr meeting or other than a motion of consent is in order. >> a notation motion to
4:29 pm
approve the oation motion to ap the ion motion to approve ton m consent. >> i approve. >> you move. >> i move. >> (laughter). i'll second it >> great there is a motion and a second that i am on this? not seeing any, let's move on to a vote >> commissioner caminong commissioner joseph commissioner lee commissioner frost commissioner president tan that item passes as the director said if any of the commissioners not on the committee are interested those meetings happen prior to the 18 they're only once a month you should get the agenda but today's was interesting. >> the most lively interesting. >> very exciting and
4:30 pm
interesting i think that it will make more sense just leave these on concept there's a lot of details all right. so item 7 commission questions or comments anything. >> i have to say every time i see rdr i don't know what we're going to a different meeting. >> i hope we seem excited. >> (laughter). any other comments >> no? anything about the super bowl you want to say no? all right. >> forget me that's all i say i'll coming with you any public comment on those two comments moving on to item 8 new business requests for future agenda items. >> any? none >> oh, yeah, the 90s okay
