4:35 am
i believe i was present at that meeting. >> i believe we were present at that meeting. >> with that, amendment schauft commissioner lee commissioner perez commissioner caminong i abstain i was not present commissioner thomas. >> president tan those minutes pass is there a motion for the march first meeting minutes. >> there's a mistake i don't know it is a mistake present at the meeting dorsey absent were dorsey so- incorrect march 15 should be the first.
4:36 am
>> i'm looking at my says march first. >> mine said march 15. >> i have 15 on it my name is not on it. >> i think we should postpone or get the same copy of minutes. >> maybe we have 3 sets? no. >> i have march 15. >> yeah. i have the february 16th and march 15 minutes. >> you don't have the march first minutes. >> i have march first not the 15. >> i don't have march first at all. >> march first is on this on
4:37 am
the agenda if you don't have march first, you can't vote on march first. >> let's continue that is there a motion to continue. >> move to continue the minutes for march first. >> i second same house, same call? no public comment i can't do same house, same call? commissioner frost commissioner lee commissioner perez commissioner caminong commissioner thomas and president tan. >> all right. that motion is continued the respect the staff and executive director. >> commissioners hello i will try to be short update on prevention introduced i've spoken we issued some legislation by supervisor wiener's office to clean up the codes sections mostly related to
4:38 am
the 9 month time it takes i think i've described before it is basically clean up language i wanted to report the commission met on the april of 18 no issues and again wants a copy i'll be happy to but we've heard nothing from anyone that is a simple clean up language and the other update is regarding the chapter online submission of disclosure notification which is live i don't know if i've sent this on our website it is ocean 8 now we had a meeting with the apartment association who handle a large number of these buildings who
4:39 am
are going to be required are required to do notification now whether there are residents that move or turnover within three hundred feats of an entertainment issue and folks in this department are able to do this and keep our fingers crossed it wouldn't e won't crash so if someone calls to complain we'll see if their notified properly that is good news it weighs on me heavily and i wrote into the report an update on non-traditional alcohol licenses want to mentioned that while there's not been anything before you
4:40 am
formally heartens some time ago with the lieutenant sorry i'll not get that right was in large part responsible for with supervisor mar office to talk about the chief financial officer breach or beverages like starbuck's and taco bell fast food could be anything their businesses all over the country are looking to increase revenue for us if we set a staff level and again at some point i imagine we'll come back to you formally this is more of a small business concern than it is to determine news alcohol those businesses came to san francisco and many of them and all over the neighborhoods and one thing now they'll turn it into
4:41 am
something else there is a resolution in front of the board of supervisors talking about urging the abc to deny those licenses not something the city can do much more that resolution at this point is scheduled for the 12 of april i understand and again, it is an o.j. kind of resolution staff is planning on meeting with the planning department so see if anything can be done by land use essentially so maybe find a stronger way to send a message for not allow this kind of thing to prolific we've sends them move the slush i didn't see in place their business model are advertising the delivery no
4:42 am
concern for the outcome and it is not a good thing as far as i'm concerned, i wanted to let you you know and nothing to report on the corrective action side. >> justin one thing we want to talk about now how to deal with the violation the armory had with their event so is there a course of action is planned around that at this point? >> well, i i mean i work for you from the commission feels that it is important to issue notice of violations or citations we certainly can do that we did that prior to events many times. >> any thoughts from
4:43 am
commissioners. >> just the normal if this happens has it happened the past someone has come in before us asking for a permit and they through an event prior to getting if permit has it happened in the past. >> it absolutely has happened. >> what action is taken against. >> like typically we don't necessarily through a notice of violation the mail for the event we take it at the commission if in this particular case something more egregious or problematic go down that road of corrective action that's why it is called corrective agency we're trying to get compliance and all the agency work towards compliance we're not trying to punish anyone with the notice of violation it is a notice again,
4:44 am
i serve at our pleasure if there is a corrective action you times the staff to do. >> i'll feel comfortable issuing a citation because we do want people in compliance that is one of my main goals here but on this thing they knew what they were doing it was a business decision i understand it is like the delivery guy decided to double park but i think that i personally don't feel okay with letting it pass without issuing them a citation. >> just to clarify it was 3 unpermitted one permitted and 3 unpermitted; is that correct. >> i think that was two. >> two unpermit.
4:45 am
>> i was looking at the paperwork the only permit was for the 12. >> not the 13 and not the 26 and 27. >> right so it sounds like there weren't the permit issue. >> one permit for one night and 3 events. >> so. >> i am not four events. >> they violated the code twice is that what you're trying to clarify. >> they have 4 events and one permit for one event. >> 3 events. >> one but two was not - >> i was with the understanding commissioner thomas i thought what it was they had a permit for the one and then they did. >> two more. >> yeah, but i think one of them was a two-day events maybe that's why we have the xhuchgs. >> to clarify from the armory
4:46 am
told me they had an events on the 12 which we permitted and also after the fact on the 26 and 27 rumor from the neighbors it was on the 13 i was not able to verify that i didn't get a noise complaint after the 12 or 13 if they held one on the 13 i honestly don't know. >> another question it happened in one month would we issue one citation one or how do we generously go that. >> generally, if we are referring to the 26 and 27 if i notice an event being held without a permit on the 26 i'll issue a notice of violation and then for the following day a citation and the amount of $50.
4:47 am
>> that's it. >> that's it. >> yeah. i feel more comfortable with a historical memory they were taken action against. >> we have that power it is what it is so. >> i don't think we need to voted i wanted to direct the staff to issue a notice of violation and a citation i brought it up to discuss it we didn't get to discuss but but let's move on unless other things people want to ask great. >> thank you president tan. >> commissioners good evening a few things to notify you about we have a new complainant in the
4:48 am
complaint didn't column on 21st street browns this meeting he received a complaint questionnaire back didn't go both a lot of detail but follow-up with the operators as the complainant to sheds light on what they're doing i'll do that and refer back to the next meeting we have are formal complaint about 13 polk and have been but as you see from the sounds like inspections i went by the past two weekends and trying to track at what level they need to be in compliance with city code i determined this past weekend they'll need to renovate, upgrade their sound

system and components to insure this we have the proper control over the system to equalize and prevent djs from sxooed the limit we're currently in discussion and ho hoping to have that prepared by this weekends a couple of sounds tests trolley california and the recording studio we have finally gotten a complaint about someone from someone not claimed unanimous status 311 hoping to get more information from them and sent auto a questionnaire to that complained working with a neighbor of the regency ballroom across the street sutter street at the apartments so two 3 big ongoing

investigations one right now with the ballroom and working closely with the neighborhood and operator there one that public works on eerie and mission and duo boss and working closely with the operators we're going to go in this weekend and i've done residential testing there and then at playlands as well with the residential testing so pretty intense thorough investigations for those 3 venues and then i continue to work with the mission police department with the players on the sidewalk varies by weekends sometimes nothing and sometimes a four piece band and someone playing in front of the restaurant
4:51 am
i do believe that wraps for me i'll be happy to answer any questions you may have. >> anyone has. >> have you heard from players. >> i've been by there is not thank you. >> good news. >> laura. >> all right. inspector pauley you're up. >> good evening, commissioners inspector pauley reporting the in the interest of time i'll kind of you know just quickly go over the compliance stops i've about say quiet in my district so basically what i've focused on is looking at issues or checking for inclines were there
4:52 am
were issues before for instance, the basement had noise i've recorded about you know went we there several times and stopped by in in front i've not received complaint usually an issue i'll receive a complaint but nevertheless, stopped by multiple times on the 26 most recently and otherwise in compliance the same with eden beggar castle and one of the issues a lot of noise on the sidewalks or whatever i checked for if everything was fine we received police complaints about hugh in regards to foot traffic and things to of that nature during the layout it is normal what goes on there the broadly foot traffic and they're in compliance with tsame thing
4:53 am
neighbors complaining about the noise of the venue exclaimed about after hours they're committed to it it that is a non-issue and the complanlts they're starting to talk and hopefully the action is pending if it didn't resolve someone will sway the situation with one way or another one violation 1015 fulsome did an event they did a regular night and accident a popular urban artist and the sidewalks were swam i didn't and one of the streets were blocked it is in a regular curtains but nevertheless, i wrote them a notice of violation for that and we talked to them stein and the
4:54 am
security personnel and the general manager and the owner of venue we're all in agreement that maybe the program they should try with without due diligence whatever taking more time they don't have a situation i'll be happy to answer any questions you may have. >> thank you any public comment on the staff report. >> all right. seeing none, public comment is closed move on to item 4 any police questions or comments today all right. we don't have any we'll move on to item 5 thank you for your patience everyone our first permit our next permit is at the water tavern i'll pass it to the director. >> all right. how second permit this evening is for a limited live performance for a new restaurant and bar think port property on franzwa calls

4:58 am
good neighbor policy to begin with i don't know if we need to include them. >> but you, you guys pick out the ones you think we need to add. >> commissioners any, any thoughts about changing this i don't think so do we normally includes all of these if their redundancy we try to strip them but. >> you guys have adopted this is - yeah, the same person does those conditions for almost all. >> i'll make the motion to accept the - approve
