like to make a statement? >> i would be honored to serve as your vice president for one more year. >> commissioners would you like to comment? or have discussion? >> i would like to say, commend commissioner adams for his long standing commitment to this commission. it is work and people don't really think about what it takes for all of us to come to these meetings, participate and to be as engaged in the public in particular as commissioner adams is. he goes to lots of events, he is very engaged. i am always amazed by how many people he knows out and about and especially as we had our legacy businesses not sure there is one he didn't know personally so great to have people on the commission who
10:01 am
know the business owners and know the districts the way that commissioner adams does so i think-and it makes him an effective leader here on the commission. >> i personally admire commissioner adams for involvement in the san francisco community. every time i come i learn from him, the information he gives about the neighborhoods and meetings he attend, so i think he plays a essential role on this commission and i would like to see him as the vice president of this commission. >> thank you. >> i like to add that in addition to his commitment and long standing of serving on the commission, he is out there everywhere. everybody knows him and he knows everybody and i think only absent once all
10:02 am
these years. >> only once. >> congraltulations. >> probably in hawaii. >> i was. >> i just want to say after the conclusion of my first year on the commission, i want to say thanks vice president adam frz showing me the ropes in the beginning and i'll extend that to president twite, i learned lot from you guys so thank you. >> any other commissioner comments? alright, i would like to epien open up to public comment. any members of the public who would like to comment for steve adams for vise president? seeing none public comment is closed. i will conduct another role call vote for the nomination. adams, yes. dwight, yes. sorry, commissioner dooley, yes. dwight, yes. ortiz-cartagena is absent. commissioner tour-sarkissian, yes. yee riley, yes.
10:03 am
zouzounis, yes. by vote of 6-0 with one absent stephen adams is aprointed to vice president. >> congratulations. [applause] >> next item. >> moving to item number 9, approval of meeting minutes and this is the january 9, 2017 draft regular meeting minutes and action item, and motion? >> motion to approve. >> commissioner adams motions. >> i second. >> we may need public comment first. first off, any commissioners have comments about the minutes as presented? any members of the public like to comment on item number 9 approval of our meeting minutes from last session january 9? seeing none public comment is closed. motion? >> i motion. >> approve the minutes as presented. >> i second.
10:04 am
>> thank you, mr. president for catching that. we have a motion by commissioner adams and second by commissioner yee riley. all in favor? >> aye. >> opposed? that motion passes 6-01 absent. #50i89m 10, commissioner report. allows president rks vice president and commissioner and commissioner tooz >> i don't have any knowledge to report other than beer week in dogpatch. we have 3 brewers doing a collaboration brew so that is exciting t. is a big deal for the city to host beer week and just as a side note, if you are familiar with a brewery that does a beer called
10:05 am
plenty the younger or something like that in sonoma i think it is, that single thing and the event every year to go and try that beer has brought i think well overa million in additional revenue that community. the opportunity for these sort of experienceal events whether it be arounds food which by the way it is rist restaurants week get a deal on a meal at participating restaurant the ggra sponsors, but likewise beer week and other things are the modern day attractions to our neighborhoods and can have very significant impacts on local revenue and therefore success of our small businesses as well as implication for tax revenue and things like that. anyway- >> i will go. >> you heard it here, beer week is coming up. i think the more
10:06 am
of the things we can support and promote, the better because it is kind of the one thing that really adds vitality not only to our neighborhoods but the specific industries >> the small craft breweries are small businesses. >> absolutely. that's all i got. commissioners any other- >> i am now representing the castro merchants on the council of district merchants. i went to my first meeting last week and president dwight was there and i had never been to one of those and what a eye opener. >> i'm representing the new dogpatch business association at council district merchants, so commissioner adams and i are two new seats at the table for cdma. and i will say that cdma, i have said has the
10:07 am
potential to really be the chamber of comperse for small business in san francisco. i have been on the board of the chamber of commerce on and off for the laest 10 year jz i took a break to found sf made be its chairman for two years but after concluding i went back to chamber of commerce. cameber of commerce has done great thing tooz support small business but the chamber of commerce is not the home of small business in san francisco and cdma is a billbit of a misnomer because it says merchants but it represents all small business in san francisco and especially as-we are getting more and more small businesses as we know a uber driver is a small business. a individual consultant is a small business and this gig economy is actually causing a explosion in small businesses as they must be registered with the city and so i think that
10:08 am
the cdma as the sort of place where merchants and now more small businesses come to talk about doing business in san francisco, that the cdma has to the opportunity to take a leadership role for small business in general so i think commissioner adams and i both acknowledge that opportunity for cdma and are there at the table to try to move cdma to the next level and next generation in support of all small businesses in san francisco. any other commissioner updates? >> i attended the district 3 mta summit and then i was followed up with that and now part of the mta working group which will meet monthly. >> good. >> fantastic. >> outreach and all the things
10:09 am
that need to be addressed. >> lack there of. any other commissioner reports? alright. we have public comment on the commissioner reports as presented this evening? seeing none, public comment is closed. next item. >> iletm 11, new business allows commissioners to introduce new agenda items for future consideration. >> i would like to based on our public comment earlier today i would like to recommend the office staff to do a little research for us about this ordinance. the ordinance for point of sale registration and inspection. first off, to determine how much of it is san francisco specific and to what degree is this also a california state and/or federal regulation, i don't know the answer, i just put it out there. sometimes we are simply acting in response to state and federal regulations, so it
10:10 am
would be nice to know to what extent that is the case. if be are on our own on this one, i think it would be worthwhile to consider whether this regulation is a sustainable regulation, whether it is something that we should take as a action to find a sponsor at the board of supervisor s to perhaps change it in a way that is more favorable to smalt business in san francisco. >> i would agree with that one. >> okay, do we-the other new business item i proposed last time and want to keep on the radar screen is a presentation about the small business registration for non-profits of all kinds because i suspect there is knowledge that we should get out to the public about how to register your non-profit in the city of san francisco including business associations, neighborhood
10:11 am
associations and non-profits in general. >> we were going to talk about too and want to stay on top of this, kathleen you brought about planning come in and talking about the changes in the neighborhoods regarding formula retail. >> the first hearing is the third of next month. i try today contact the merchant associations and contacted council district merchants about it, so you know, there are major problems with it, but >> yes, that came up at the council district merchant meeting, your presentation and steve cornell said we need to do something and agree. i think they are way moving way too quick on this. >> i suggest the merchant association stand up and say slow down on this because there are problems that will have a
10:12 am
substantial impact on >> the neighborhood corridors, yes. >> and spent many many many many months going over this with the planning department and at this point i'm-their attitude is he who has gone to them and complained will have a adjustment only for their mcd, so- >> case by case basis. the squeaky wheel gets the grease. >> yeah. the mcd i tend to represent we were able to get a lot of things straightened out. nobody one stepped up to say they had new problems. >> richard was clueless at castro merchants on this. >> it is a big deal. >> i agree, so- >> there is a lot of loop holes and they are unintentional loop holes but when you remove a
10:13 am
entire section of the planning code and replace it without looking at how therefore the references and other parts the planning code relate to what you are removing versus what you are adding >> right, >> there are big differences and those kind of things can cause unintended consequences and i clearly see them coming our way. i don't really know what to do at- >> maybe at the next meeting get someone from planning to come and talk to us about this. >> their position is their minor and there is no need to go over it. >> would it be a benefit to publish the changes that you were able to lobby for in your mcd to the other merchant- >> i did send that out via council district merchants. >> minimally they can lobby for
10:14 am
the changes you got. >> they should. in the north beach mcd we asked and received additional food category which i think is one everyone should have now, which is you know, the special food manufacturer that has retail. that should not be considered a limited restaurant. that would have a lower bar in a good way, which would be that type of business is generally very welcome. >> absolutely. >> and so we insisted having that added to the north beach. >> will that include businesses like confection tion makers and >> absolutely. we should make because we have them in my district. >> this would just be to fill a hole that we have right now and in my opinion it is increasing area of small business folks
10:15 am
that bake the gred bread, sell whole sale and have a counter and sell retail. >> case in point, neighbor bake house in my neighborhood, a huge success started out whole sale{abandoned whole sale because they retail business is so strong and anyone, myself included as a manufacturer prefers direct to consumer retail because you don't go through a middle man to sell whole sale so that is proof positive a business we think of as a whole sale business becomes retail is far more sustainable. the number of employees they hire, they have out grown their space and become a institution in the neighborhood in 3 ourfore short years and should encourage those type of businesses. >> i would argue that it is a lower impact business than lumping everything in the world under limited restaurants.
10:16 am
>> i agree. >> absolutely. >> completely agree. >> i would like to request the commission just to send a letter to planning and say, these are the issues, i outlined them and can send them to you. there is also problematic things with formula retail, which is article 7 has a big list of what is considered formula retail and then that's is erased and the new change has half of what was under there. once again, we re quested can you add the previous on to it, they are not like they have become suddenly non formula retail possible businesses. that's again something that is unintended consequences of not-they added- >> that very list is a-minded
10:17 am
numerous times on the basis of hard work to get it amended and this whole sale revised it as part of a general revision seems like rewriting law without go through the proper channels. >> may i suggest commissioner dooleys comments be put in writing and sent to us so we can efficiently communicated. >> let's get those comments and maybe have staff prepare a letter to be approved by us pending our review of those changes, but i think delivering a letter from the commission from the small business commission to the planning commission alerting them of our concerns in these very specific areas including but not limited to the following list. >> it is a 350 page document. i myself have looked all
10:18 am
through 350 pages numerous times but i have to admit there are some things in different mcd's that i am might not catch and that is why i have been trying to urge the mcd to take a look. look at yours and see if there is something there. this is the time to do it. happy to snd that. >> thank you, please do. alright. great. >> the guidance is prepare a or schedule a presentation from the planning department at the next meeting subject to their availability as well as start preparing a letter from staff on the basis of commissioner dooley's notes. >> i say we need to send a letter prior to the first hearing at the planning commission which will be february 3. >> and so just to get the process down, they will have a hearing, that hearing is that a
10:19 am
hearing to approve it in its entirety or the first hear toog hear what people have to say about it? don't know. >> i'm not sure. the thing is these types of things are so-it is very easy and i have seen this before in other issues where the person comes up from the staff and says it is nothing. >> february 3? >> that thursday. >> maybe this is call to cdma to get represented from each district. >> you were at the- >> i just want to chime in here for a second. all you are doing now my understanding is you are putting new business on the agenda for a future meeting of the small business commission. >> we can't take action on anything. >> right. >> i'm not- >> can we ask the office of
10:20 am
small business to give us materials for the next meeting to make decisions, correct? >> that is- >> we are not taking action, we are asking the tools to make a decision at the next meeting. >> that sound right to me. >> great. and maybe just simply making a observation that concerned parties would be advised to show up at the planning commission meeting not knowing whether the outcome of that meeting is to accept these new rules and regs as written or whether there is discussion still to be had. >> as far as i understand it, you are-any member the commission could also attend as a member of the public and give public comment. >> we have presence of two neighborhood associations here on the panel.
10:21 am
>> if you are done with the new business i like to- >> please. >> about the cannabis policies in the city and county of san francisco. january 11 we got from the office of small business and specific a number of documents including but not limited to the state regulation task force report and just to sum up-we had prior to that a presentation from two prominent experts in our state, mr. cur shid and tumar who made presentation and got a summary the notes which was [inaudible] work and i appreciated that. it looks like 2017 will be the launching year for setting these rules in our county and
10:22 am
it seems appropriate-a lot of agencies will be involved and regs will come out and it will effect small business and i find it appropriate mr. president that the office of small business be involved in that process and specifically also the commission in a sense we should have-be involved in the process because these regs will effect small business come 2018, so i strongly recommend to my fellow commissioners that we invite the office of small business to bring us experts. people working on these regs so we can bring our contributions to the shaping of these regs. >> we also have someone sitting on that task force from the office of small business. i
10:23 am
think we do or at least regina- >> i have to report to you that- >> there is no one from the office sitting. there is a representative a small business owner and there is a person representing business interest but we dopet have staff on there. >> so no staff. >> i was surprised and maybe that is another issue beyond my new business discussion that the office of small business nor the commission is represented on the task force. the task force is behind this and need only 3 hours a mupth. what i'm talking about is to be aprized of the shaping and isn't that a unusual opportunity for our commission to be part of that. >> okay. >> so my proposal for small
10:24 am
business is first that the commission be involved in the shaping of these and then that we have regularly experts who would kind of aprize us of what is going on in the city so we can chime in and give our contribution. >> okay. i would propose that those presentations be well thought out in advance and very specific in their analysis and recommendation to us. and not a general overview of the situation. okay. any other-so, we should get ahead of this cannabis legislation as it effects the city and our small business for sure. alright. any other new

regional fund to tricks pedestrian safety as you see bicycle and pedestrian safety resurfacing our streets and signs and the like in traffic calming for vehicles this is a push helping mta to replace a generation of light rail vehicles and then we have maintenance and other capital facilities such track and infrastructure at the neighborhood level the fund program that is available to you to respond to your priorities at the neighborhood level one of them is the transportation improvement program that allows for supervisors in each district to name in their priorities with the planning perspective so we began this program i believe in 2014 after the adoption of our initiative than supervisor

we're proud as the chair mentions to implement the completion of one of the major, major capital improvement plan projects that was led intensify i the transportation authority under the director eric who is the westbound ramps that were opened in october of 2014 that reason cooperated with the bay area authority and the transportation authority with a whole host of activities with the procurement and this ultimately will help the island by making the one and off-ramp easier rather than the left off-ramp that was there for many years and moving forward the project their smaller but significant project these that west side in phase two that will be delivered with what we call pedestrian contractor camtc

a win district but how to have the best so i'm a representative of the west side i deeply appreciate that comment so i will nominate you. >> thank you commissioner yee is there a second seconded by commissioner kim on that item a roll call please. >> take further nominations. >> seeing no other names on the roster, the nominations are closed and second a roll call. >> any public comment. >> oh, this right public comment on the election of the chair seeing none, public comment is closed. mr. stamos. >> on the motion for chair
10:58 am
commissioner breed commissioner cohen commissioner farrell commissioner fewer commissioner kim commissioner peskin commissioner ronen commissioner safai commissioner sheehy commissioner tang commissioner yee the motion is approved. >> thank you for that colleagues is there a motion nomination for vice chair of the ta? commissioner kim >> yes. i would like to nominate commissioner tang for possession of the vice chair of the transportation authority i think that actually, it is a great balance to have someone represent the west side of the city and county and commissioner tang has been a thoughtful advocate not only for her district but other districts
10:59 am
that don't get resources around public transit and many of the other district do i think she'll be a great balance as a vice chair i'm honored to nominate her today. >> is there a second for that motion. >> seconded by commissioner breed she beat you commissioner cohen are there any additional nominations for vice chair? seeing none, nominations are closed is there any public comment on the vice chair position if so seeing none, public comment is closed. and why not take that same house, same call? congratulations vice chair tilly chang and now that you guys have all made the mistake of nominating and electing us let me tell you was on my mind (laughter) >> so what i have the honor of being elected to the intern
11:00 am
position after chair wiener went to sacramento in his role and a as the state senator i said a few words about that body and agency that is actually a remarkablely important powerful agency i have to say many of us whether we're members of the public or members of this body is not as engaged as we could be and i would venue to say as we should be i'd like to try to change that i think we have very important decisions to make and as we are looking at multiple billion dollars projects actually multi multi billion dollars projects we have to get our housing house in order relative to priorities we have caltrans electrification and tip of the iceberg they owes
11:01 am
the city and county while we're wearing our 09 hats a quarter of a million dollars and the central subway we've got in ambitious subway plan we need to have city attorney a exemption with the public and our staff about our priorities where that is van ness brt or not going to be able to have it all it is good to plan four the future but given what we all know is a seat change at the federal level that will profoundly impact high speed rail to you name it so i wanted to i want to put that out there and want to commissioner tang and i have had those conversations suggest that we start considering having some third party vicinity oversight at this body we consider working
11:02 am
with our staff to create and put out a request for proposals to have something that is akin to the role that the legislative and budget analyst praise for the board of supervisors i think this agency would actually benefit from that. >> and then finally as chair i want to collaborate with all of you to do the following things which is as our san francisco transportation authority has become an extremely independent authority as a matter of charter law i hear hear from you sometimes you're not getting what you need and our constituents are demanding in large part not a funding agency i want to use this body and work with you to insure that the mta
11:03 am
we give hundreds of million dollars is meeting your needs in your district as well as all of our needs citywide so those are the comments i want to make and also think we have a role which we all see on our agendas as we monitor and support and oppose various pieces of state legislation we center much more regular much more in depth czechs e checking and let me leave you with that on thought i'm not agnostic about but thought about who we will be better served to meet trice a month as a full body and maybe our committees are not doing we we need to do but spent a couple of hours what has traditionally gone to finance and programs as a full body food for thought
11:04 am
let's check in on that formally and informally we can see ahead and thank you very much fewer confidence and support and supervisor president breed the floor is yours. >> thank you. congratulations chair peskin i want to say i appreciate your thoughts and leadership on this body i also am really existed about the opportunity to have an independent oversight body similar to the you budget analyst for the board of supervisors that could really help us to dissect a lot of the layers of what we're doing in terms of providing funding resources to some of our many transportation projects and i know this body also does strategic planning but i think that taking the opportunity to have a robust decision about strategic planning pea how we
11:05 am
look at the bigger picture that is exactly what you're talking about i think could be helpful to make sure that with those many complicated layers we can basically take them and put in in a large picture and start to move towards progress simultaneously for all those various layers of projects that exist all over the city rather than responsive to independent projects how those projects will impact others and make sense to layer those on top of each other to those can help us to understand what we should or shouldn't as 12 relates to what we'll be damien e dealing with around transbay i'm excited and glad you thoughtless what was on our mind this will help us moving in the right direction and make the transportation in
11:06 am
san francisco a lot better for those who are here and travel around the city we want to be a transit first and want to make sure that our infrastructure is in place in order to accommodate it congratulations to you and commissioner tang i think you guys are working really well together this will be a great committee or commission and i'm excited about that thank you and congratulations. >> thank you for your comments commissioner breed and vice chair tilly chang. >> congratulations chair peskin i want to congratulate you as well and using form supervisor avalos words i hope we don't sleepwalk introduce the transportation authority it is incredibly important and so many money that goes before us so i'm existed to be able to work with chair peskin in that capacity and i think that you know you
11:07 am
being transparent with our thoughts i think that was refreshing one thing you mentioned how it is we can also utilities this opportunity with the mta to work with other sfmta agencies and there has been times i have turned to ta staff the wonderful ta staff to help us whether or not initiating the studies that work you, you know push other agencies i want to thank you for that and hopefully, we'll continue building on this incredible work together congratulations. >> thank you commissioner tang if no other comments from members mr. stamos call the next item. >> allocate the $6 million plus in prop k fund with conditions for the downtown rail extension subject to the task force distribution schedule an action item. >> ms. lombardi.
11:08 am
>> congratulations chair and vice chair welcome to the new commissioners this is the nice allocation to start off with given several months have lapsed this my idea why this is coming to you today and turn to michael to give a brief synopsis this is related to the electrification program with the boulevard study and the high speed rail not to mention a significant caltrain effort that is going on in the area this is a request for that $6 million in prop k sales tax from a line item in the voter expenditure plan specifically for new transbay terminal and
11:09 am
the downtown expansion project that item came before this body in september commissioner peskin doesn't have a level of comfortable by i'll not go into two of them are related to the special conditions to allocate as we often do one of them is that a condition of receipt the fund if this body proves with an oversight protocol it is a written oversight models that staff - and is electrification it is in place we like to codify that when we get the funds the second condition the planning department rail yard boulevard study has a number of components one is alignment of downtown and
11:10 am
who one we prefer or leaning towards the second condition states if that body enforces one of the alternate alignments that grant can be put on pause to renegotiate the scope or work on that with that, i think i'll hand this off unless there are questions. >> before i turn it over to transbay joint powers authority we have one of our members who sits on the oversight body that transbay transbay joint powers authority board which is commissioner kim here so i want to point out that out for those of you who don't know for the new members but wanted to put that in a little bit of context as to why in september and until now including now that i have been nervous and reticent it is
11:11 am
very simple when this project started out it was a large and expensive project i'm talking about not the extension i'm talking about the building of transbay at the $800 million that was what it was supposed to cost when i was a member of this body a decade ago we're north of $2 billion not all of that was local money all taxpayer money but that also includes a short term actually not that she remember several years likely commercial paper loan from the the city and county of san francisco to the tjpa the tjpa is actually a kraefrn of state law all be that the city and county has 3 members on the governing board part of what makes me nervous was we're in the process of making a decision for san francisco that is a
11:12 am
decision for the next 50 or one hundred years relative to rail alignments relative to bringing this kind of infrastructure into our downtown core that those of you who might be on this board in a decade or in government or politics in a exactly know we go in with our eyes wide open by the way, this extension is what a $4 billion project didn't become a $12 billion project those are the kinds of things we as elected people need to be extremely concerned about given the fact that the transbay costs a bloody future with that, sir. >> good morning, commissioners congratulations on the election chair peskin and congratulations
11:13 am
commissioner tang for being the vice chair i'm mark the disorderly conduct with the transbay joint powers authority i want to start by taking a minute to give a department on pier one will reach the completion on this year and current work together the bus operators to operate shortly after we hope to get them into the transit center within a timeframe if 9 contractors can't accommodate we'll on the transit center for operations we're trying to get a manager to get the contract next month and the contract manager will lease out the retail we have one hundred thousand square feet of retail that's part of their duties and
11:14 am
in charge of - we have one hundred screens we hope to generate revenues and work with the community and activating the sponsoring at the park and also seeking - we're hoping to maximize the revenue for any gas for the operations of the transit center i'll start with the items. >> sir my understanding i think our understanding is that it is still going to require an operational subsidies even if you sectucceeded. >> there will obtain operation gap and we'll work with the transit to cover that gap right now we are trying to close that gap as long as by generating
11:15 am
revenues at the same time achieving the goals that the board asked us to do and the community by bringing robust and activating the part with the community. >> and has staff at the transbay joint powers authority indicated they're willing to subsidies that operational funding gap. >> they're good listeners we continue to discuss that currently mtc is providing $5 million to help us with updating the temporary terminal and thoefl to increase that amount. >> what do you project the gap to be. >> i wish i can share that but, but each of the seat managers have numbers and once we have someone under contract i'll be happy to share that information with you.
11:16 am
>> please proceed. >> the downtown extension dtx will extended underground with the high speed rail with $1.3 million from the caltrain into a transit center the construction limits $2 million the extension is 1 point miles. >> today's allocation with the use of the thirty percent drawings and the design with the requirements we will use to money to estimate to today's conditions and also the ridership study to have an active amount charges to light rail in order to fund the extension the money will perform risk
11:17 am
assessments for the construction and program such that when a budget is adopted by the mtc board that budget are reflect the conditions and not have a difficulty so and we're also working with our funding partners in order to secure the funding from local and regional levels later in the presentation i have a slide i'll show you how we intend to do that overall the next steps we have outlined we'll come up with a 2 to thirty percent engineering accruing a program budget that 89 regional can stand behind and move forward the scope of the dtx extended the box to accommodate high speed rail and this accommodates caltrain and high speed rail to
11:18 am
use two screens and the links is longer than than the train box we have to extend the train box since we're extending the train box we are using the reality for greenhouse and amtrak buses that includes providing a connector between the center and the bart station we'll have direct assess from the transit center to include bart and this includes the train box itself that was built as part of phase one and build the tunnel between the train box and the station on 4 and king it will be a combieng of open excavation we have a - at the end of the alignment that will allow us to further ground
11:19 am
the tunnels into 22 street and in the future to continue the undergrounding. >> ever since it started in development we've been working closely with r e b t this shows the relationship we discussed by the team and the dtx is in green this is a basic alternative with the avenue alignment in orange is is an estimation while the dtx is under operation and moved the alignment to the third street alignment which is a third alignment under consumer price index and continue to work with the team and as mentioned we can land what how best to advance dtx and bring trains to the transit center that is a draft schedule we put together
11:20 am
for the dtx it shows we can bring trains to the transit center in funding is available and the ridership position - currently our ridership schedule is started the process in the middle of 2018 that is predicted on securing the funding from r o-3 if it passed also predicted on the r and b study to determine what the best alignment for the dtx. >> and that slide is the funding slide we developed our draft estimates are approximately $4 billion with the city's allocation we'll be able to up that estimate and be sure that that estimate is the right estimate moving forward we currently have identified the potential funding the amount
11:21 am
blow theblast imply box between 6 hundred and 8 hundred plus million dollars at the include 20075 to plus million dollars for the between 200 and $4 million in tax increments the blue box is the amounts for the current area plan under consideration approximately 2 med $2 billion one billion dollars is for the sfmta parts program and $3 million for the funding $350 million for the san francisco county tax and $575 million from high speed rail that equals the business plan and one more parcel to be sold that parcel is currently the location of the temporary terminal once we on the transit terminal that parking becomes
11:22 am
available that value is approximately 200 and $45 million we also have district between $865 million plus with discharges they'll be leveled for passengers that terminate their travel at the transit center currently caltrans riders stop at fourth and king to reach tare district they'll get on muni or other means so with charging equal to what they're paying between two or $3 million and charging caltrans between 8 and 11 explores that and $26 we generate between 8 hundred plus million dollars that concludes my presentation. i'll be happy to answer any questions you may have. >> thank you, sir are there
11:23 am
any questions from commissioners. >> are there any members of the public wyoming like to testify on this item? >> please come forward. >> we're in receipt of our communications. >> there they are quite a few of the issues i have them attached to the legal mandate on the legal mandate you have two the first one is the funds that basically means that must include the ability of the transbay and the east bay no two ways about it. the second legal mandate is properties 334 you need to have a non-stop train to
11:24 am
translate in thirty minutes if you don't, you basically don't have access to any of the prop a bonds because if you look at this $557 million that is dtx but you see you can't achieve that figure and jeopardizes that you talk about - small business at some point has to ask the question how come we can build the central subway one .7 miles and then somebody said well, we'll get one .3 miles for $4 billion is goes down the construction you have a lot of
11:25 am
construction with the costs and the impacts so in closing my recommendation to you to limit the appropriations to one million dollars for the sole purpose of basically wrapping up what needs to be done some point in time you will understand the issues thank you very much. >> and with regard to your letter your contention it is that those 3 sweeping terms will end up which the trains will have to slow down at 25 mile-per-hour will there beyond thirty minutes. >> yes. just going from town to the translation about - >> so what you're saying the alignment is wrong. >> yes. the alignment is wrong and actually, the there is another alignment that is
11:26 am
missing that can't achieve that is not discussed right now. >> thank you, sir. >> mr. has. >> commissioner i'm jimmy have been before you several times to appoint the dtx plan will go off the west side of mission bay and jeopardize the campus you and the city and you the board of supervisors and this commission needs to take control over this project and coordinate it as you may know the planning department has the study which i'm on the citizens workshop i our report will be available in march no square feet confirm the inadequacy of current plan and indicate the only vicariously
11:27 am
way to get the train downtown is on the west side of potrero hill either parallel to 7th street or third street now what needs to be done is not to fund this project as you were asked for but to fund the work around the terminal and second street and the study to develop the final tunnel plan to bring the train downtown that's the only viable way to get the train downtown so this work needs to be coordinated and right now and by the way, when you put the new tunnel together with the existing tunnel we're talking about $6 million budget thank you. >> thank you, mr. has any
11:28 am
public comment? that wants to testify on this item seeing none, public comment is closed. commissioner sheehy the floor is yours. >> so obviously the chair has spent more time on this to continue this public comments we need to think we should be much more involved before the money i've worked down there i know the configuration and don't know as the gentleman noted when you look at the high speed right a karate's configuration we have i know we had the warriors going in we knew we would increase the capacity beyond what we had so i don't know what options are available but certainly completing the r e b study that
11:29 am
the way in which they're planning on going both this is crazy to me. >> is a commissioner sheehy part of the reason the previous delayed this was an interest in seeing the results of arab study and part of the reason he needed to put it on this particular agenda was because we now have four new members of this body relative to the motion their 3 we vote it up and give them their 6 point plus million dollars option two vote it down and option 3 we can continue there is actually a fourth option that the gentleman suggested within the purview of this body we can give them less money in order to allow them
11:30 am
pronouncing to finish their supplemental document those are the of your choice you as a new commissioner, i think have ever right to spend time not an easy decision and maybe we should look to some of the other new members as to what there will is and perhaps if you need more time to look at it with all due respect to the tjpa executive director he may differ given that high speed rail is not going to get there until if everybody is luke w8 /* /- lucky. >> i'd like to do that to understand this before i vote on this this is is a multi billion
11:31 am
dollars the configuration doesn't make sense we have people analyzing this. >> you know you have more experience you continued is one i'll respect the judgment of the chair. >> it was in committee and came to the full commission and got continued this is the first time it is heard why not hear from commissioner ronen and then commissioner fewer and then visit with staff unless anyone else wants to weigh in commissioner ronen. >> commissioner ronen if you turn that microphone on. >> that would be helpful. >> i'm feeling the same way i have a question for you what would be the impact if we continued this a month or 2 down
11:32 am
the road. >> we have the distributions with the tilly chang in last year and brought it to the commission commissioner peskin had a lot of questions at a time and responded to all the questions if we take another month almost a 9 month delay given we're almost done with phase one i'm eager to move forward with phase two all the allocations is the design for the 40 percent completion and we're not - we're going to wait to finish but not including anything else happening as part of the r e b study for the baby steps for the project if you look at the r e d you have the alignments of the dtx then the
11:33 am
avenue and the third street alignment you work along second street the work on the box and the pedestrian connector for bart if the r e b study stays essays this is the alignment it shown in orange those are extension active and could happen while the dtx is under construction if the 85 percent of the work along second street and the box and the green box as well as the pedestrian connector that work will think e be preserved for the fourth street alignment 0 i urge you to move forward to continue on the project and come back with the r
11:34 am
e b study will be completed next month and adjust as needed. >> one thought before we hear from commissioner fewer perhaps a will to continue this to our next meeting that at that meeting we actually get susan who is in charge of the r a b study to present at the same time to see all of that before we make a decision with regards to this allocation commissioner fewer. >> thank you chair peskin i also would like to see p continued i have a question about the capital actually, the money part of it i actually have more questions about the design i would feel more comfortable postponing this vote until we get the adequate research thank
11:35 am
you. >> thank you commissioner fewer commissioner kim. >> i just want to say i'm glad we have new commissioners on board and think that is important for the four new members to said understand this - and, of course, it is complicated is involves several agencies caltrain and caltrans and high speed rail and the connected for the original terminal project will be the new transportation thank you, everybody, u hub for light rail and the downtown extension and now through many years of delays and a complete divestment for the transportation for light rail we're seeing phase two
11:36 am
continuing despite the fact that a box is constructed in phase one with the terminal ready for the train to come into 9 downtown area i want to see all this happen and the high speed rail in san francisco and in many ways the terminal will help us get there and many want to see this in san jose we have a lot of deinvestigating with the points an alignment that was approved back before i was on the board of supervisors and now there is a question about whether this alignment for the new light rail and caltrain downtown extension i want to currently the new members to understand this project and a lot of questions i think at some point we need to move forward with the funding on the skwien i'd like to see that happen but acknowledge that i mean this is a complex project and going back
11:37 am
in time there were many decisions i would have made about those those two phases would have occurred and recognize the executive director for leading the helm there are there's a lot of moving parts and a lot of actors and players thank you commissioner kim. >> commissioner safai. >> hi yes. i'd like to echo what my colleagues have said new commissioners i think that is important that we're briefed on this i'm sure a lot of requests for funding given the level and magnitude of that project it would be nice to have a better understanding of how that will be looked like and effects the decisions and have an opportunity we don't need a lot of time but you suggested next meeting give staff the opportunity to come and talk
11:38 am
with you individually and then move forward thank you. >> commissioner safai and commissioner tang i wanted to announce the planning department staff reached out to all our offices to offer a r a b tour their take place at 2:30 one of my aids will be going and if any of our legislative aides their meeting at the northwest corner of b street will take an hour and bring walking shoes and end i believe fourth and king the rail yard station if you need another details but that same from the planning department and i did ask myself to ask the staff to point out this is in the middle of our board meeting most of our staff are otherwise
11:39 am
disposed but thank you for appoint and i do acknowledge that is a process that staff wants us for familiar recalled of how we vote on sxheshz for a continues we'll clarify in a second many any role as chair will work with our staff to bring the r a b study head here for our next regularly scheduled full commission meeting for a presentation at least any desire that everyone is engaged is proving true we're off to a good start maybe the gentleman doesn't feel that way but commissioner sheehy would you like to propose this be continued to the next regularly scheduled full

11:42 am
seeing none, public comment is closed. colleagues, can we take that same house, same call? the resolution is adopted we have done item number 9 mr. stamos could you please read the next item. >> 10 introduction of new items. >> are there any in any items commissioners seeing none, any public comment on this item? seeing none, public comment is closed. and general public comment are there any members of the public who would like to make general public comment, sir >> thank you, again supervisors so as you may know we have a new executive chief washington and the same advocates on the private sector involvement and i'd like to talk about that in context of a new translator
11:43 am
there is the way it works in the private sector you have the ridership and we have ripped we've got a two capacity so if you go to the private sector if you build another translator that is a good chance they're going to be taking the new one and even there will be extensive shut downs and that is the private sector will step in your job as supervisors is so work on the book end to make sure that on the san francisco side you're able to make the translator on embarcadero and the private sector will take over you have to work with them and my advice in oakland to look around the whole plaza it is where you need to go to satisfy the sector that brings us to the dtx
11:44 am
because now there is no way to look at those numbers they don't add up okay. but the reason for that we have so many people but if you have traffic in the east bay a lot of traffic will not stop they'll carry on with the dtx, etc. now you may be able to have a meaningful conversation about the dtx with the private sector thank you very much. >> thank you, sir are there any other members of the public for general public comment seeing none, public comment is closed. and we are

[inaudible] was something that people on the cac had issues with. regarding cost increases, we wondered why the engineering estimates were as low as they were in comparison the the ultimate contractor bids, increase ins the scope and change order with also of concern so, nr the end, we wondered whether it was the bid environment or staff engineers and contractors not scoping a project budget or a combination of all of these things. this item passed 2347 favor, one abstention and three members not present. >> great, thank you so much. with we get to that item, i'm go to literally play around with chairs here, one second. thank you. so, when we get to the staff presentation, i'm going ask them to address the concerns you raised, thank you, so are there any members of the public who would like to comment on item 2 then? seeing none, public comment is closed and item 3.

>> item 3, approve the minutes of the december 6, 2016 meeting, this is an action item. >> alright, can we get a motion to approve the minutes? >> so moved. >> alright, thank you, and we'll do that without objection then. sorry, do we have to go to public comment, yes, item 3, public comment, minutes, seeing none, public comment is closed and we had a motion and we'll do that without objection. >> roll call. >> we're a mess here, sorry, so item 3, let's rescind that and let's do roll call vote. er >> item 3, commissioner fa tsai. >> yes. >> safai, aye, commissioner sheehy ?frjts aye. er >> commissioner tang? >> aye. >> the minutes are approved. >> alright, thank you t minutes are adopted, i'm supposed to be the veteran here but i'm messing up, item 4? >> recommend allocation of 653 thousand 101 in prop k funds with conditions to the bay area rapid strans sit district for if ball bow ka park station

eastside connection, additional scope project subject to the attached fiscal year cash flow distribution schedule, this is an action item. er >> i'm mike pick flooder, we have one request as you know this morning, bart is requesting prop k funds to exercise a contract option which is not relate today the base projts but -- and expand the scope of its existing project, the balboa park station eastside connections project and that is kurntsly under construction. so, the base project will create better connections between muni and bart station by constructing a new accessible muni platform and walkway and head house that would connect to the bart station. we have an illustration of the base project here, so the transportation authority has allocated 2.2 in prop k and 1.9 in program transportation funds to the project since 2010. the work that bart is requesting funds for today

would improve the appearance and comfort of the station by refitting glass window ins the clear storey, as you can see illustrated, where there's currently deteriorating opaque panel, this will increase natural light nr the station as the original design intended. the additional scope will also construct a new ceiling and light ining the concourse of the station. this work package was a contract option in the contract to do the base project and was authorized by the bart board subject to finding availability, so now prop k is able to leverage other sources including measure r-r bond funds that were passed by the voters in november and some state funds to get it done and the entire project will be open for use by june, 2018. and with that, i can take any questions. >> great, can you -- would you miepd addressing some of the comments that chair wad ling addressed through the cac and cost increases or at least i

guess the bidding, he had a question around that too. >> we were hoping bart staff would be here but i don't see any at the moment, one thing i will say is the request under consideration today is a contract option that is separate from any of the costs involve ined the base contract itself. i think what we've referred to in the scope in terms of the cost of the overall project was the last time that the transportation authority saw a request related to this eastside project, so it was less well developed at that point, you know, i can't get into details about every single element of the cost but i know that the budget was less well developed at that point and as you've seen with other construction contracts around the city, this is a very competitive time to be building anything here and if [inaudible] would like to add anything to that. >> good morning, commissioners, welcome, i'm anna law ford,

director for policy and programming with the transportation authority, apologies on behalf of bart staff, they are stuck in a bart delay, but [laughter] so i'll pinch hit for the -- this was also brought up at the citizens advisory committee meeting, the original contract was put out to bid over a year and a half ago and may have been longer before because the project is well under construction and this is a contract option that was originally bid on when the contract was originally let or issued if you will. we did follow up with bart staff about the reason for the overall project cost increase a portion of it is due to this additional scope, a portion was due to the bid environment at the time of the contract being out on the street. it is typical of what we have been hearing from some of the sfmta projects on the transit projects, sometimes there is a
11:53 am
single bidder for several contracts so we're left to negotiate with a single bidder or reject a bid and take a risk that you're going out to a more favorable bid environment. i don't know for sure if -- the number of bidders on the original scope of work, we can find that out if the commission is interested in that, and then so there were -- so, there's the additional scope, there was the contracting environment and then there's corresponding contingency amounts and projts management costs that go up when scope increases as well, so naoez are the corresponding costs that go along with the scope increase. >> okay. great. and then in terms of -- i can't recall, did you have an issue, mr. wad ling, about design as well. i'm not sure if bart can address the design. >> this was also brought up at the citizens advisory committee meeting and bart staff replied that there had been many, many
11:54 am
discussions about the design at the time that the head house was being designed and one of the -- including with the architect that was involved with the new features so there was the sentiment that the station needed a front door, if you will, some kind of an access and entry point, there was also the sentiment of wanting to stay away from the concrete that existed now, so not setting up more concrete, to put up light and glass and recognizing that it was a contrast but that that was where it ended up with the then bart director and with the conversations that took place at the time. >> okay. alright. well, thank you for your presentation and answering those questions, colleagues, do you have any questions or comments on this item? no? mr. safai ?frjts yes, i think this is an important step in helping to really open up and
11:55 am
redesign a poorly designed station that gets a tremendous amount of use, particularly from people that are pedestrian nas are trying to connect to the other side, i commend you and this is a great project for our part of town, thank you. >> alright, okay, great, so with that, then let's open up item 4 to public comment. >> as i mentioned, chris wad ling, cac chair, i spoke with the architect who helped design the head house, i wanted to enter into the record what he communicated to me. he was basing his designs off of one of the brutality architectures by the name of james sterling, sterling design, crystalline glass forms with rough concrete, it was from their varied works, because his environments were overcast, he designed more glass forms into his

architecture, similar to bart's beginnings and the main reason is function, the groan house is compatible with many overcast days of marine environment, roof format is the existing v over the station, it and its glass walls differ from concrete and are a complement to the heavy forums, the head house incrude thing v that looked like too much v, they considered the passions of the original design architect who was earnest born and he was more into a medievalist type churches, he *f you figured he would introduce [inaudible] those were his design comments and as commissioner safai mentioned, the community agreed those were well worth it. >> any of the members of the public who wishes to comment on item 4? seeing none, public comment is closed. i do agree that i think probably almost any change
11:57 am
under the current conditions will look way better so, with that said, then can we get a motion to approve item 4. >> so moved. >> okay, and we will do that, same house, same call without objection. alder, item 5? >> item 5, introduction of new items. >> great, so i'm guessing that ta staff have already briefed the new commissioners on new items, i don't think we'll have any today. we'll go to public comment on item 5. okay, seeing none, public comment is closed. and now item 6. >> item 6, general public comment. >> yes, good morning, andrew here, the haubl u [inaudible] of human heart leads to the recovery of holy heart and [inaudible] with good conscious for once knowing the capabilities of uses and pathways, one [inaudible] well-beings for the [inaudible] people, helping hands for people in the days of difficulties, the pitching of
