12:08 pm
the commission and director hicks and chief kaplan minus capt. gregory mark from the forensic service of vision on the current commanding officer to my left is when bailey was the commanding officer of scu. tonight we are giving a presentation and reporting update on the sexual assault kits. the reporting period is will take place between july 1 and december 31 good that our extraction. we are reporting a. received a total 20 kits to the crime lab. as through this extraction period 102 have been completed 26 are in progress. the spreadsheet was submitted last week. are some open lab numbers. those are the cases represented they are in progress. i'm happy to report during this extraction period we met the owner 20 date uploading period. 42 dna profiles were developed. 38 were uploaded to code this and
12:09 pm
we obtained 14 hits through the state. the lab also is a different set of metrics. i was able to review these statistical analysis. they report a total turnaround period which reflects the time the kids come into the lab until we do a complete reporting out to the appropriate details. the average time was 53 days. we also didn't look at some other issues. there were if you look at the spreadsheet, there were about six cases that were not transferred from the property clerk to the crime lab in time.. that is due to the fact that some of these cases were outside agency cases that were partially investigated by them. were some internal cases where instead of-we had received it kits six days after was
12:10 pm
collected since the time i reach out to my counterpart, capt. venture of the property clerk division and we were able to collaboratively work on this issue through retraining and procedure changes. we think that this will issue will be resolved itself in the future. with that i like to turn over the rest of the information to capt. daily. >> thank you capt. mark. >> good evening commissioners, and chief kaplan. so i'm capt. would've bailey with the special victims unit and just to piggyback on greg, the database showed 128 cases. that was the we presented to you on friday and after reviewing that data we were able to figure out that 15 of those cases didn't come under a investigative jurisdiction should so ashley looking at 113 cases. so 15
12:11 pm
cases and the were 10 outside jurisdiction case. three cases that did not have a sexual assault kit that is the survivor do not want a sexual assault kits to be concluded and one was not a sexual assault kit that was included in the database. and one was a related case. so we were essentially doing with 113 cases . to review the notifications on those cases, we determined that we have nose success successfully notified 72 of the 113 survivors. in addition, we had attempted and continue to attempt, an additional 15 survivors and we had 26 survivor requests who did not want aany notifications made. of those 26, 19 originated in
12:12 pm
sfgh at the same at the initial point of contact with the survivor and eight they basically communicated that they did not want any police involvement in the case and then sfpd investigators an additional seven, survivors informed the investigators that they did not want to be notified. of the 113 cases thus far, 42 profiles were developed. 38 were uploaded and we have 14 hits. meaning that we got identified persons through the dna upload. those 14 hits in terms of the notification regarding those, we were successful-succeeding notifying and nine of the survivors. three we have attempted and continue to attempt and then we had to who were the survivor who requested
12:13 pm
the contact. now those two survivors had originated the communication of no contact at sfgh and we have reached out to the nurses there could on the off chance they may be able to contact the victim but on both cases they tried and the victim the survivor did not want to continue with the case. that is my submission of the notifications. >> i've a simple question is what does sr mean? >> that is survivor requested no notification. we just to ensure that we had complete communication, i guess, we could show in the data are attempted this basically, everybody was attempted to contact either be executed or attempted or we respected their spiders request of no notification. >> sr, if i understand correctly means they don't want to be notified.
12:14 pm
>> correct. >> what does it stand for? >> survivors requested so they requested no communication. no notification. >> so >> capt. bailey i'm looking your spreadsheet. i get the attempted sr now but which are the blank lines mean? >> what happened now since we've updated that sense. when we looked at our when we printed out the database we realized that we were only deporting, yeses. so that made it appear like we have not succeeded though we had not been attempting and we had not identified the survivor's response request. so, therefore we since filled them all in in that manner so that you become
12:15 pm
-we haven't updated it i can definitely summit that again later in the week if you like. but we have as i said we've had 72, yes, we've have succeeded could we've had 15 attempted and continuing to attempt to notify and in the 26 who requested no notification. >> so everyone has either been attempted attempted to notify them. we have notified him and gotten a yes, yes or we've gotten a common know, basically >> we are respecting their request, yes. >> okay. any other questions? commissioner melara >> just educational for me. could you give me a sense of why the investigation or the analysis would take 2.5 months from start to finish?
12:16 pm
>> that was at the crime lab so handed over to capt. mark. >> so when these rape kits come in with a sexual assault kits come in, they come in and they can be buried. it could be several swabs were it could be hundred over 100 different items to the examiner so goes through an intensive screening process and each item has to be looked at carefully and with fine detail. if it's just a swap our investigation is focused but especially that the clothing we are looking for three sources of genetic material. could be from saliva. it could be from semen or other types of bodily fluids such as blood. when we do the presented testing it goes through-it requires different chemicals. so when we are looking at the item like the closing of the joke of the author color or off the shirttail were anywhere but we have to examine that whole item
12:17 pm
in totality and then once we get the claimant rate hits, then that item is actually photographed and then collected or extracted and it goes through an extraction period. it takes a while. then after that it goes through all these fancy machines and then the information that the criminal that they would have to go through a statistical analysis and that takes quite a bit of time to develop that information so that before we can probably upload it to code us because there's a specific requirements for the state and also the federals government before we can actually upload the data to code us. >> got it. >> just so you know, not only are we lucky to have capt. mark because of his excellence and is police work but he also brings a specific background to the medical knowledge being an
12:18 pm
oral surgeon is looking so thank you for that information capt. >> thank you >> so i have a question. i'm looking at the 16 0526 and 0606. there are code its hits but they don't seem arrested i'm just wondering-was a code as it means we have someone identified? >> yes. it does mean that there's been somebody identified and in order for the case to proceed we have to have the survivors commitment. they get to choose whether they're moving forward with the case could so sometimes the survivor doesn't want to go forward with the case. sometimes they would bring the case to the district attorney who based upon evidence presented may determine that the case is enough to go forward because many of these cases are one word against the other. those are two examples of why you may not necessarily see an arrest.
12:19 pm
>> okay. this one looks 5 to 6, 16 526. cisco to sit get it doesn't say arrest the victim. the victim it says yes. that just means the victim has notified them is all? >> yes. >> additional questions for capt. mark and capt. billy? >> i just want to say the public we've come a long way with this. we've improved since this was first in instituted. so i just want to say, just continue to do circuit were making great strides and i want to note that. thank you >> thank you >> thank you for your continued support. >> questions? any additional questions for the chief? actually i have one. but go ahead commissioner
12:20 pm
>> so i was traveling here and i got a lot of phone calls. i guess there was a press conference today. i was in income but i guess there was a preference press conference today andapparently, from 48 hills is a credentialed journalist. she has credentials and she was in the journalism. she was asked to leave the journalist room. basically indicating that she's not from a print journalist so therefore it's not real or valid and she was asked to leave. i guess the question i'm thinking is, why would-we are looking for transparency and trust and journalists are journalist get your press conference and why we make a distinction between the printed press and an electronic press and apparently she was-this was a woman of color as to leave the room and she had credentials, but
12:21 pm
[inaudible] in the room primarily an activist group not a journalist group and i don't believe they are credentialed and primarily white. so there's an uproar going on about why this woman of color are credentialed woman of color was asked to leave the press conference and i'm just wondering who made a determination in the person was going around looking at the credentials are within making it essential between the credentials in terms of whether it's written or electronic. what do you think we doesn't really go to building trust and transparency in our community could see was that was a present press conference you think keep using the term credentialed to hers apparently were not the credentials that press typically have. they do not look good credentialed about it with some document that said all access on good it was my understand your mother look into it a little more deeply the minor stated she was utterly because she was not properly credentialed and when
12:22 pm
they asked about the credentials they were told they were not proper credentialed she was asked to leave the room. he was you need to look at a because minor sin is she has credentials of all the other journals up and you need to look into what [inaudible] and are not credentialed. they're not charles. their activist. so you need to because the only person singled and removed as a woman of color. >> the people from code pink are just that people. they now present their members of code pink that are credentialed press just like 48 hills mayor people credentialed and not it showed up with improper prudential's. we will find out and try to get upon >> yes. do you see the credentials? >> i did not judge is given and sought to the press conference spews i appreciate you look into that because it appears to feel like to the community members about discriminatory and a woman of color being the only person removed and somebody going to the room deciding who can stay in camp they were deciding what is the real credentialed pass
12:23 pm
mean because my understand she was told she just a blog. she has to leave and i don't know the distinction between electronic or a written press journalist took a journalist is a journalist of ever proper credentials. i appreciate if you look into that. it's very disturbing and upsetting not only to celine but the other journalist as well >> it just for the record we won't distinction somewhat the press covers were not. there properly credentialed they would allow the minimum. >> we need to look in that i appreciate the report that. >> colleagues, we are going getting request from the back of the room that to have you speak more clearly into the microphone so backs folks in the bathroom can hear. it's not just you. all right. chief, i just have one question there are a lot of activities this weekend and i'm concerned about staffing levels,, overtime expense and other issues, but we want to ensure safety protection and open atmosphere so people can exercise the first amendment writes. how are
12:24 pm
we handling those particular staffing issues? >> we don't go to much into detail for safety concerns for the officers in the appointment but we took advance notice of the inauguration date and anticipated the issues that may arise the suite canceled discretionary days off and so we will have everybody working. >> okay. all right thank you, steve. anymore questions for the chief? thank you, chief. next line item please >> item 2-b this items to other directors report on recent occ activities and make announcements. presentation of the occ statistical report from november 2016 summary cases of received november 2016 mediation of complaints in 2016 discipline proposed in by the
12:25 pm
chief of police in november 2016 and complaints sustained by the occ and comparative cystoscope ports for november 2 2015. presentation of the occ says that purport of december 2016 summit of cases received in december 2016 mediation and complaints in december 22 and complaints sustained by the oc could please commission decision in december 2016 and complaints sustained by the occ. a comparative success reports from the summer of 2015. >> good evening director hicks >> good evening resident turman vice president mazzucco, commissioners. chief tony, members of the public, the occ the most recent activity or occurrence is that we are now the department of police accountability. as certified by the secretary of state and is entered into the city's administrative code. however, for some time you may still be
12:26 pm
received correspondence on opposite citizen complaint stationary as we make the transition. we have many documents that we are in the process of revising from our complaint forms. additionally, we will be revising our website. but we are the department of police accountability. the commission has before the two reports. there are conference of statistical reports as are required by the charter and by your rules good one is for november. one is for december. it will not read it through of the reports and just give you brief summaries and of course answer whatever questions he you may have. but by the years and committee occ had mediated
12:27 pm
46 cases compared to 45 in 2015. 601 cases were filed in 2016 compared to 673 in 2015. the sustained rate in 2016 was 11% compared to 9% in 2015. you have as part of each of these reports the chiefs proposed discipline on occ sustained complaint. so in november there are summary of the recommended discipline by the department of police accountability and the discipline imposed were proposed by the police chief. because officers are entitled to cheese hearings and administrative process. there were seven. moving to december, again, there were seven cases
12:28 pm
of where discipline was proposed by the chief and then in additional case which involved the matter before the police commission and there is a typo in that paragraph which is it says san francisco police department heard a motion. it is san francisco commission heard a motion and in that case motion was heard upon a fourth amendment case sustained by my office and the police commission granted the motion to dismiss. that concludes my report. >> just for the record we granted the motion to dismiss without prejudice. i believe there's been a decision made not to refile that matter just to be clear. >> absolutely. >> it was a motion to dismiss
12:29 pm
it as a tumor without prejudice >> we do not get rid of the case. that was an option to refile. >> right. >> commissioners we did receive a letter from the occ sine made a decision not to refile the matter. >> it says dismiss >> we should correct it to be request for demurrer was granted without prejudice. >> right. >> so noted. pres. turman >>[laughing] so noted. >> is that it? >> that includes my report >> okay. any follow-up for director hicks and the department of police accountability? >> actually i did have a conversation prior to her report because i was concerned about a couple of reports where in the neglect of duty cases where was a child abuse case and was
12:30 pm
also a domestic violence lep related case and just she gave me additional information and that the domestic violence case , since the report was not filed the first time, it took a second incident for that aggressor to be arrested you're so that goes to show that it could be very dangerous for police officers not to take reports and to take seriously consideration in these particular case. the young woman is now in foster care. >> yes. good commissioner melara, in that two separate cases in the juvenile case, a chinese i can't comment on the juvenile case. in the juvenile case, the young--the juvenile
12:31 pm
was a social worker at the hospital. reported the matter to help child protective services and then appropriate action was taken. but it was a matter of the officers not believing the responding officers not believing that the juvenile had been abused. the juveniles one of the juniors juveniles took the juvenile to the hospital and then the wheels began to move and attorney-can go into a little more detail >> you have a special specific question commissioner melara? >> no. i just pointed to the fact that was of these neglected duties that it might look very mild, but the results
12:32 pm
be very-it can be very life threatening situation. >> definitely agree with you. >> thank you. >> further questions of the director of dpa? >> office or department, which is agreed >> yes. it is the department. dpa. not dpw. the department of police accountability. >>[inaudible] [off mic] >>[laughing] >> all right. thank you director hicks. >> you're welcome pres. turman >> next next item >> item 2-c commission reports. commission president support report on action taken in close
12:33 pm
session for the appointment of chief of police pursuant to california government code 54957. >> colleagues, in accordance with our charter, we have to make a partial disclosure of some items and some issues we took in close session and i will do that now. as the public is aware, this commission conducted an extensive search for the selection of the chief of police could under the charter the police commission is charged with 40 names to the mayor and the board. his for his appointment of the chief of please get the commission has an obligation under that charter. the commission voted unanimously to forward william scott application to the mayor's office for consideration. the mayor then in december of 2016 selected
12:34 pm
and appointed william scott in connection with that process and he is to be sworn in on january 23 as the chief of police for the city and county of san francisco. the commission is obligated to make this report once the appointment process is completed. we are therefore do that today. i do not believe any type of vote is necessary. just confirmation of the process. is that correct? >> that's correct. just a report >> without report the mayor's office can now move forward with the january 23rd 2017 the swearing in.with that we would also recognize this is chief chaplin's final meeting. with that, i believe that we want to
12:35 pm
first of all, state, chief, you stepped into san francisco and did an admirable job during very very difficult times. you have steered the ship. we appreciate it everything you have done. there is more work to be done and you have never shied away from that. he pointed that out and i am glad to inform the public and everyone knows that you will be here to help chief scott into filling those duties. on behalf of the rasul commission and the city and county of san francisco, it is my pleasure to honor you with this plaque
12:36 pm
>>[applause]spears interim chief [inaudible] >>[laughing] commissioners, thank you very much. you know we don't always agree with each other but one of the things we do is try to keep it as real as we possibly can. we dialogue and talk about things and as rev. brown always has, we can agree to disagree without being disagreeable. i think with the commerce that most of the time. with that said, i want to address specifically the folks that come religious week on wednesdays that continue to try to hold us accountable whenever they can. keep coming and keep doing it you would've no problem with that at all. the whole process is imperfect by its very nature and the goal is for us to get better with each incident that happens the way
12:37 pm
you do that is people have to call you and have things that are not done correctly 100% of the nominal think will be ever be 100% but were trying to get there. i would tell you, it's been an adventurous last eight months and most like today can your surviving on a couple of protein bars because the days don't land for full meals most of the time. the good news is that gone down about 2-3 pan sizes. >>[laughing] the bad news is that about that type of weight loss is good for you but it's been an adventure in a great learning experience. i've learned a lot about a lot of adventures. made a lot of interesting people. and i'm going to continue to forge ahead with the department of justice as is the rest of the san francisco police department under incoming chief bill scott. i think of the end of the date we are going outside, we could not have picked a better person for the position
12:38 pm
did so as soon as i found out and learn about this gentleman that so far, of course you know the proof is always in putting soap restarts to get >> we will see but with that said our think the commission again all the help drug payments with dealing with some of the cases, discipline cases, and the late nights. sometimes one-2 am. and the staff for the police commission, thank you guys very much. this is been an awesome adventure could i would not trade it for the world, but time to slow things down for tony chaplin and scepter beside a little bit enemy not just personally but as far as work goes, i think the wheels are going to keep turning were to wrap things up and get those reforms taken care. again, thank you very much and appreciate the honor. the clapping >>[applause] >> we all have to say something. so personally, the cityfor myself but i can't thank you enough. what you
12:39 pm
stepped into was i would not wish it on anybody. just the way you handled it, to me, is -with your attitude,, good i been a lot of meetings with you i talk to on the phone a lot. and the only way i can describe it i think, commissioner turman it said is common things i'm probably more anything we need was to calm things that we could not have gotten here like president loftus and her guidance we cannot gotten here without used during ship pre-much learning how to do it. i really can't-i just cannot thank you good looking back from where we were a year ago, to what you have done, thank you. i only know one way to do this could this is what i do when i being an old teacher

thank you for your family for all they put up was i know you have young children you have adult children you have an incredible weight was incredible prosecutor. so thank you and thank your family. i appreciated. >> commissioner melara >> i personally want to say i could give an a+. one other things that i think i definitely appreciated from you was your complete honesty and we be willing to step in and do whatever it took and tell us, and tell us, why and how. for me, that is extremely important because a leader needs to take that step and those qualities are so important. so i appreciate that. thank you. >> commissioner dejesus >>, thank you for all your hard work. i want to thank you i couldn't you say what you think and you mean what you say. we spar but i do appreciate-i do appreciate the dialoguing

to wait until the end of the week to collect everyone's feedback and then pick it but seeing as we are here, >> what was that again? >> friday the 24th or saturday, 25 february. so i really would like to i think we've got to your point commissioner, we've got logistics to sort out afterwards, location. i need to finalize the agenda i have sent you all draft agendas. please if you look at the second version i've tweaked it a developing know what you think of also working with sfpd and will be meeting with director hicks and the dpa to ensure their feedback is also included. i'm working on that. but i did want to kind of get your take first and make sure that all stakeholders are involved good >> the target date is friday, february 24. i also need to double check. >> okay. any other questions epistemically >> any other questions for ms. adwan. >> thank you >> these have a look at the agenda things. i'm here >> thank you all right.

commission secretary >> public comments. >> commissioners thank you for scheduling the gtd f item on separate first. february for dominick a couple comments briefly about this. the groups first on speaking for myself as usual but i have a working close with agent-asian law caucus care and some of these issues up in work on time at six meetings with the command staff this past year. was easy complaint saw the process through. i had meetings with fbi. this issue needs to be resolved in its long-standing and indeed we had all collaboratively try to really altogether six before donald trump took office on friday. there's great urgency and great concern in the community. so we are a little bit concerned is being propped until february 1 >> we don't meet again until february 1. >> i understand that. nope disrespect commission president but this was not necessarily directed at you get we had our conversation with command staff that are been led to believe they would get back to us. so
12:50 pm
that mean to suggest this had to be addressed by you. so let me just finish my comments. i hope on february 1 you all have a chance to look carefully at the letter so you brought up to speed and i would respectfully suggest that you invite the fbi to attend the department hasn't invited the fbi to attending the past and they have just not shown up. i invited the fbi personally to attend when i met with him recently and might help to go ahead and send a request to a sector and see what he says about you do not say yes he did not say no to me. specifically, it's not just the urgency. related to drum you also have to number there is a legal obligation under the ordinance for the department to do a public reports on the compliance with ordinance and the gtf by january 31st. he buys the that talk went to happen but hopefully that can be on the february 1 agenda complaint i been in touch with
12:51 pm
adwan. we all want to get this fixed it out the shift command staff first were close to getting fixed we cannot drag this out long the soil look forward to discussing this awfully resolving a fund. lastly if you have any questions at all, about where things stand i hope you will not hesitate to reach out get any questions about the letter or anything was we are fully prepared to deal with this good take you so much for your time. >> thank you. next number of the public, please. >> good evening president turman, commissioners director hicks chief chaplin get my miscreant christina-staff attorney in the national security and civil rights program the asian law caucus. i was one of the authors of the letter that commissioner hing mentioned that although i worked as an advocate on this issue for number of years tonight on wednesday just as a community member on behalf of the many community numbers were not able to come here tonight but would nonetheless like to express [inaudible] unvisited san francisco has been very

unequivocal in its denial of the sort of rhetoric the racist xena phobic and homophobic rhetoric that is come out of president-elect trump and his administration. that is much to the credit of the san francisco. but the fact of the matter is, we have heard from resident colette trump himself what he plans to do with the police, with the fbi, and with it other law enforcement agencies regarding the surveillance of muslim communities and therefore, the factor we have a ordinance in san francisco that protects these communities, that is in conflict with what the fbi wishes to do and what pres. trump use wishes to do something that needs to be addressed. the fact that the ordinance that's been in place for a number of years still is being consult complied with is greatly troubling. this is troubling for a number of years but it should all the more

urgent now than operation just a few days away. people in the committee quite frankly are terrified as to what is going to happen did they want to know that the officers were there to protect and serve them as well as numbers of community members of san francisco will and they will be protected by the police and police are not going to be used by the fb i in that manner. for that reason, we would like our officers were in this jt after be properly trained to we know they are not that needs to be fixed as soon as possible. i am still hoping sfpd will get back to us and ask-allow us to train those officers before january 20 but that does not happen, we will look for to commissions assistance in getting up to happen along with the other-- >> thank you. next member of the public please. >> good evening commissioner john david-san francisco for police accountability of i just would like to make you aware that-was not the wanted person was rejected ejected from the press conference today. karen flashman were also banned from

the press conference. identified myself going into the door is a new op-ed writer for the sf examiner. my article will be published on somebody would alleviate that i've written for the sf examiner. karen flashman identified herself as a blogger for huffington post. after the press we spoke to several reporters who said they had never seen a credentials crackdown before by sfpd. we are hoping that sfpd does not now have an enemies list. the critics are not not now going to be unwelcome and very hopeful that sfpd is not circling the wagons on the sean moore case. i will speak about the body cam video at the next opportunity. thank you. >> thank you. did ms. fleischmann and mr.-percent credentials? at the press conference? i'm asking the

chief. i'm sorry. >> i don't know. again i will take a look and see. >> okay. >> i presented my credentials i don't have an idea with huffington post but i showed them that i'm listed on the huffington post website as a huffington post blogger and presented my identification. is this the appropriate time to comment on sean moore or- >> no. but you can do that on general public comments. >> okay. >> no. i'm sorry we did talk about that officer involved shooting. pardon me. go right ahead. >> so commissioners, i was very upset to see that none of you were present at the community meeting other than you, director hicks. yes, you are not a commissioner because the story that was presented by sfpd
12:56 pm
is contradicted by the body cam video that we watch today. and the entire situation up mr. moore points to the need for crisis intervention team, data improvements, time and distance , use of force, everything that we are trying to move forward was not applied in that situation and the consequence for mr. moore is really terrible. he is being held on $2 million bail for assaulting an officer whereas, when sfpd shoots and kills, no one it takes 22 months for george gascon you decide not to indict. in the case of mr. moore, he is very verbal and very assertive but it almost appears like a high school fight where
12:57 pm
the gentleman officers, instead of saying, okay, this is a gentleman we know has mental illness and there's a temporary restraining order and we need to engage someone with mental health experience, instead, start to initiate aggression with this man and it leads to this altercation in which he gets shot twice. i urge all of you to watch that body camera and to ask pointed questions because this is exactly what we want to move away from. this is a case study in i think, extreme unconscious bias of those officers about seeing this black man who is very visible and agitated and released beats eternal consequence. >> thank you. any other public comment?
12:58 pm
>> good evening commissioners, director hicks and chief chaplin i just really want to say chief chaplin, you always struck me as being someone approachable. not someone to suffer fools lightly. and i wanted to say that as a citizen and a frequent attendee at these meetings that i would've had no difficulty had you continued as the permanent chief. thank you very much. >> before our next speaker i just went to clarify that. when members of the public are being asked questions in response to commissioners questions or commissioners, that time is not towithin your public comment time and your public comment time is frozen and continue once the common is made. thank you mme. city attorney. any further public comment? seeing none, public comment is closed. >>[gavel] next item

1:01 pm
doesn't always happen and so thank you. you got all of us into a room early on that you give us the respect due us and respect will dialogue ensued as a result of it. it's all those things that were rebuilt the public trust and i want to thank you chief and you commissioners, for all of the hard work that's getting us there. thank you. >> welcome back to mr. >> thank you i also have my thanks for acting chief chaplin for your service could take your family for giving so much of your time to ensure the glad to have you back and i also want to say you certainly have been welcome in free to disagree with me and you never been disagreeable. in fact you been directed you have not been someone that's told me what i want to get you told me what you thought and appreciate that for transparency. i've been disagreeable i try not to buy to appreciate that because this leads into what i want to talk well yet again is transparency.
1:02 pm
which is something this obama needs to continue to aspire towards good transparency is not a slogan. it's a statement by the absence of truth freely volunteered in the situation today caused some concern in that wake of the sean moore video. to me just say for a second on the press credential issue, historically speaking press credentials issued by the police determined that it useful and necessary for the crossing police line covering a fire special event. minor staining historically sfpd issued credentials haven't been necessary to attend press conferences. this report was an office in city hall works for a publication that is in fact a successor [inaudible] i think most of you remember the date garden. so the well-known publication that's been reporting quite a bit. perhaps whoever was doing without do not recognize the of the smartphone you can see all the stories usually known as the pd good press when you get back this can be clarified. i need to say the body camera video released i spoke last week is directly contrary to the statement the boa put out about this incident. i spoke about
1:03 pm
that last week. it's very disturbing. there is no relationship whatsoever to what the poa put out. unfortunately that is part of the transparency issue did when they on the same date that the shooting happened tries to spin this for their political purposes and clouds the public information that is out there. so that's why it is so very important to be transparent and clear and consistent. i want to congratulate the department resuming the practice of holding a town hall meeting. we still need some information about jessica williams i really appreciate you restarting that process. even if a was uncomfortable. >> >> thank you. her of the public please. >> hi. commissioners. the body camera footage on this more cases are really quite revealing. we hope you will all
1:04 pm
have a chance to take a look at it may be several times because part of it are little bit confusing. public defender believes that the footage shows were retreating into his house when he is shot. which contradicts what the officer said and what the sfpd put out at the community meeting. myself looking at it, i felt that the officer tried at times to diffuse but they were very inconsistent. they were both coming at certain moments and then they became aggressive at other moments. which may have further confused a bipolar schizophrenic. so i think that the fact that more was left for 90 min. to bleed out inside the house when an ambulance showed up to deal with the cop was kicked in the face and was apparently bleeding, that footage was shown at the sfpd news conference i was not allowed to be in, that to me is borders on depraved indifference for a mentally ill community member. i mean the guy could very well have died inside his house. there was a lot of blood that we saw in the video that the family talk etc. so i think that something that
1:05 pm
ought to be adjusted the fact that the family has so far not been allowed to visit mr. moore either in the hospital ward in county jail where he's been taken now is again really the kind of indifference to mentally ill people that is really shameful and actually quite shocking. we have a very long way to go to fully implement cip and i'm hoping that we will move forward in that direction. thank you. >> next public speaker please. >> thank you i'm gilbert francine also in san francisco's pecans for police accountability at the want to bring up today something pertinent to san francisco that's in the national med media. this article from [inaudible] invites they'd collect information about different videos and which police were found to be lying. jessica is very relevant to other comments made just now. that story leads with story of
1:06 pm
nicholas buckley san francisco police officer who was found perjuring in court. has not been charged with perjury and still has his job eat months later. in that article, a san francisco police commissioner, peter king said line has been endemic in the history of the american police system for the last three or four generations and why do they do equate the main reason they do it historically enough they can get away with it. this commission is serious about getting police reform this chief al fleagle scott when he comes in are serious about getting police reform that will necessarily firing officers lied about what happens, who cover up actively their misconduct. if we can't take any action against him and why she should we expect them to start tone the truth? >> next speaker of the public please.

complaints reports. on the january 18 reports the first case, the occ director recommended commission level discipline for the sgt. and the officer in on this reports it says that the chief of police propose a one-day suspension for one of the officers who fail to serve the other officer. i am wondering if the occ brought that case before the commission if there was a challenge to the police chief's recommended discipline? then on the other report i am very concerned about the level of discipline that was needed out. there was at least two cases on this reports where officers, one officers were made false statements. in that case the

recommendation is a 30 day suspension. in the other case, lying and deviation in internal affairs interview. in other departments, i have worked for the office of citizen complaints. the berkeley police review commission the city of san jose and i'm former president of the national association for civilian oversight of law enforcement. lying is typically termination and the fact that we are keeping officers on the force who have lied there really is a matter of concern. >> thank you. her of the public please.spears may please the commission i like to briefly announce that there is a camper protesters in front of city hall camping two and police impunity in san francisco. the request is made to lease consider dropping by
