joined by my colleagues rick senior planner and alien inspirational planner and the technical specialist members of the team and the project sponsor is forest city and the port of san francisco are also presents the project sponsor kelly for forest city will provide a brief overall of the project. >> overview of the project. >> thank you melinda good afternoon commissioner president hillis and members of the commission thank you jonas my name is kelly with forest city and along with the port of san francisco we're project sponsors for the pier 70 mixed use project we'reer were recently before you in november of 2016 for the informational presentation to the commission on the overview site plan

as you recall it has been in the making for 10 years with the master plan the mayor and the board issued an issuance for forest city forest city has been working on the pier 70 project for the last of years over that period of time there have been dozens of events with thousands of paternity influencing the gilding principles most recently open houses in october and november that drew over 5 hundred folks this feedback from the community members fwloez flores into the land use plan to share what is created an urban waterfront district in san francisco those included uses you don't find in master plan with pdr and

opportunity to make that a special spot in the neighborhood and from what i've seen they'll wall it off on 3 sides i'd like to say that i'd like to see this city and the port request alternate plans i'm sure we have alternates we have skilled architects working on this project a playground with a place it would be a very commendable and wonderful asset to the neighborhood and i just want to say that i think that is wonderful that we're saving pier 70 it is about time and i hope that it is i've studied pier 70 as cultural landscape important and

president of the jay hill boosters and remind you of the situation we're facing in that area with the neighborhoods in dog patch with written co-comments to the draft eir by the issues the draft eir get a full hearing if they're only addressing pier 70 to be a success we want it to be a success it is a positive roll model and thank you for the time for - when prop f sets the height limit of 72 percent with the support of boosters and the dog patch neighborhood association and that design for the development document will be coming will draw rave reviews in that document with all the good things that gone under the boundary of pier 70 didn't

eliminate the stresses outside of the projects borrowed i've gone on how dog patch and mission bay feels inadequate to fulfill this is dog patch has doubted it's populations and that's in the eastern neighborhoods ambulance not counting the mega projects as pier 70 which include mission rock and chase center and the redevelopment and the power plant and the public housing that is within the study area for transit for the project and that's in addition to the usf the dog patch neighborhood with the impacts to the university is exempt if mitigating the tools and taxes and fees so my neighbors have gone in detail and hear more before the transportation and

submit our written comments it is important there are issues that needed to be addressed i believe they can be addressed for a city working with us to address them that helps at the end of the day a lot of it is into forest city issue to address but the city and county of san francisco no fleet or private shuttles are alleviate the one hundred thousand trips from pier 70 in light of the other projects i ask the planning commission to look at the comments and providing those resources necessary to mitigate the impacts this and permitted for the assets on the waterfront thank you. >> thank you, mr. smith. >> good afternoon, commissioners corey smith on behalf of the housing coalition. speaking in support of draft eir here today and nevertheless, it is 10 years not making and certainly a planning process

the subway you know and god knows it seems like to take forever when sfmta has money for them to spend that i think there is a recent article on that so what i will ask and add my comments to the formal comments that came to raise our attention to the issue of pacing and the fact that we've got as far as i'm concerned, a wasted asset down with the t line instead of mitigations sfmta will continue with this program and tps let's get specification in order for this project to be built they'll have sfmtas required to as a mitigation to put x number of trains you know what whatever 15

and those who have contributed thus far to the draft eir i'll be looking forward to seeing the response document i do believe there are a number of things that we've heard today and the commissioners will have to say and the written comments are substantial i'll be presenting written comments but today just a couple of things i'll highlight they hearing so we got a memo sometimes, we get things passed up to you say that was from the historic preservation commission and just sort of summarize their discussion and there was one dissenting commissioner that said that discharged the analysis of historical analysis impacts are mitigated through the proposed mitigations and i think i'll have a tendency to agree my on the only thing i'll

say i don't know if it requires changes to the project but for at least we'll be looking at having a statement of what are we called oh, what it is we'll be looking at a statement of overriding consideration i don't believe that the mitigation are proper for the historic resources for the amount of changes i feel the new development will be contextually and that's not the same thing as keeping those historic resources so a couple of things unclear and looks like the planning commission when i look at the list of approvals that need to go through the city it looks like the planning commission will be seeing the design for development i look forward to seeing this but it was not clear from my read of dir whether or

not the two paralyze that are set aside for parking structures are the only parking allowed on site that finding not clear so there's a table that says a different project option how many on-street parking and off-street parking will be allowed in the clear the off-street parking is 100 percent in the set aside for parking if they're not certainly that will be impact the traffic study and impact the month of it i think i'm sure there is seeing from my personal externals growing up in a place island near a city they have the set up the entire project and the only parking allowed in the site was one parking structure in the i'd like that 6th district at large impacted folks in a way when all

buildings have their own set of parking spaces i think that is for the impact how we look at the traffic study and hopefully clarified in the description great points on recreation typically for a large project like this don't necessarily very specific programming of the specific sites and open space at the this point that was not experience with mission bay and hunters point you don't see the exact programming, however, there are very few recreation facilities outside of site and hopefully, maybe an opportunity to do it different than other projects and think about that programming a little bit sooner so if we were have things like a baseball slashing volley ball

court maybe sort of pencil those in a little bit earlier than normally norman you'll see the programming later but a reason to do it earlier if we can and with that, i think a great job and it is adequate to move forward with the eir and looking forward to seeing the responses from some of the comments today and looking forward to seeing if writing. >> thank you. can you give an overview of the schedule and what ultimately will come back to the planning commission i know we have a fairly complicated traction with the lease development sorry >> commissioner president hillis yes, so in march we're anticipating the first round of reviews on the design for review and substantially my and all the

design document i think that that will be critical you show great renderings in the presentation how the design fits with the industrial aesthetics and the shaping it is important as we move forward special in keeping the aukt it's. >> commissioner vice president richards and i'll be submitting my comments in writing, however, the beauty of public comment and public testimony we get preserves from many lens i recall the discussion an oak and the vehicles miles traveled how that fits where it fits and shipped to the averages, etc. and into the finding the analysis the summarized how current are they are they dated

infrastructure coma decade later and getting the ridership up to the average on public transportation we have something to think about we already have in the eastern neighborhoods the infrastructure has not - the demand for infrastructure and we're adding more load to a burdened situation i think in terms of mitigation? the exact number of fewer cars needed to get those people in and out to understand regarding the recreation space you know we already have a bans the projects we've heard a burden recreation system with few public amenities with the playground and rec center i think one of the publics point and maybe commissioner johnsons point finding how the open space will be to understand what the

load is on the other open spaces an actual program and if i want to play ball in an open space that kind of thing i look forward to moving this along and wait for other comments. >> commissioner moore. >> given the size of this project and the people that work on that the eir is sparse i attribute that to the thoroughness of the work into the planning and to the many questions that enormous numbers of people in various working groups have brought to the project that makes it more clearly structured eir and easier the one comment that the request to dig a little bit deeper into the history of the

from the public today and sort of probably some of the responses that will be get based on - for eir i think that is important for people to realize their based on the project sponsors project and the mitigation is based on the intention that the project sponsor can do when it comes time to talk about the city and county mitigations will reference laws or the regulations or rules that did project sponsor can put in place that may mitigate certain impacts but the eirs will not require the creation of a new bus line as as mitigation to a potential transit or traffic issue i think that is a little bit of a short coming of the way this process was designed but want to say that a lot of the points are well-taken and hope that our sister agencies are able to take those comments and especially the mta and really

think about the circulation of the some of the newer or improved especially bus lines in 3 area when i look at this thing i'm reminded of the hunters point shipyard originally the 49ers stadium a place all the busses comment come and the 49ers moved to sacking so no longer make sense i think that pier 70 is worth having the same conversation what is the circulation pattern looks like and make sure it didn't overlap with the plans and other transit agencies they may have. >> great seeing no other comments we'll public comment is closed. and comments will be accepted in written form thank you to the planning department and the city in getting us here its been a

district is a special place that attacks tourist from all around the world and a place that became a regional hub for the community and people come back for social services and all the weekly things their families may need and connections to a lot of cultural pieces like their churches and community-based organization but this place is hope home to many residents that live in the district and right around there and that's why supervisor hillary ronen in collaboration with the mayor's office so excited this was first piece of legislation she introduced to preserve this neighborhood what that cultural district so toxic in terms of mix of businesses that are there that that preserves legacy businesses and incentivizes they're prejudice

and for the unique features the district like small storefronts and mom and pop shops and the latino community and the rich history and it is a place that also is looking for ways to attractive and support new businesses on the corridor so with that, i also wanted to thank the planning department and particular diego sanchez and the mayor's office of housing and community development and folks in particular (calling names) and also the city attorney's office mirena burns for helping us with that work and bring to your attention one thing we learned in having conversations with the zoning administrator they found that the way they were interpreting it that looks like the controls on eating and drinking establishment might pertain to limited restaurants

from the cesar chavez festive to programming and brav have or finding st. francis fountains the sales coffee and pops that is a special place it is in large part due to the characterization of latino cultural district is an asset to the city that corridor is stable we've lost businesses to rent increases but many have stated a real pressure exists to the stability of our existing businesses we've seep it from the we talk with and needs to be thoughtfully and the and tailored to the changes and experience regulations we don't take lightly we believe from a balanced approach will help to preserve those characteristics

point out to a few things that clarify the boundary and between the cultural latino cultural sdrifbt that was recognized by the board of supervisors and the special use district the special use district is the red mar are an line the blue is where - it excludes properties facing mission street it folks on the character and the surrounding 24th street we'll be undergoing a different assessment for mission street but for those sets of regulations in particular that will focus around the character along 24th street and the surrounding area so some of the existing

characteristics that make up the district are varied and small storefront and the history and institutions they part of history a big part is working-class neighborhood that have had many waves of immigrants throughout the generations and in the lesbians some of them have been in operation for over thirty years and still there those types of businesses provided the opportunity to buy our property and be able to operate our business downstairs and live above that's part of character that exists within the district. >> now in terms of the latino cultural and why is that a latino cultural district why 24th street it is because of history small businesses as you can see i point to some of the things that exist we have 11

different cultural institutions that high concentration of murals and the cultural and the many cultural events that happen while the concentration is apparent there are other characteristics that are part of it with the small storefronts, etc. to preserve and retain those unique - it is not meaning we are overlooking improvements public safety or planning there are examples of the special use district the commercial district that developed their own set of procedures to protect chinatown has protected itself from financial institution and north beach from restaurant serving businesses the mission al colonel prohibits liquor store from coming in the late 80s

institutions that have been in operation important thirty years four on the legacy business registry it united states of america is a new program that has been established through the city in order to be recognized part of city legacy business through two commissions historic preservation commission and be approved small business commission so in terms of the historic nature that exists we are using the cultural district as an economic streaming attracting events created by business institutions the cultural district bathrooms a catalyst visitors and creates opportunity across the sectors so this timeline is just a representation that in terms of what brought us here and what has guided our process we began in 2013 engaging with residents and businesses and institutions and then the recreation of the latino cultural district in 2014 a six months process for feedback from businesses in the area about what they thought about the latino cultural district that was a recognition that didn't have restricts then we mondved on to 2015 with

the interim controls to protect small storefronts so there is is on the storefront the suv will replace this 3 meeting we introduced the conception we didn't say the legislation we were building up to it we held 3 meeting in on that but in between that we've engaged with numerous stakeholders one the neighborhood that led to the introduction in january. >> the businesses a high priority for the area for us we spirit it up into two with the investment we hired a full-time corridor manager to engage with the businesses with the lease negotiation and inspections or even facade improvements in addition to supporting the efforts around the cultural

district. >> so just to kind of give a quick overview in terms of the diversity that exists within the corridor in part a inspiration for why the regulations we have 23 percent in retail and eating and drinking is 32 and personal services 34 percent so we consider that a pretty health and safety existing mix in terms of storefront trend this spans a pretty wide range of eaters diane and cafe and bars have increased and displayed some of the types of uses in the pipeline it seems moderate has been at a health and safety pace, however, a

trend of taking over retail formula in the pipeline 4 new restaurant two of which are in existing vacant sites sorry and goes to what are we pope the main regulations can be split into two categories one threshold for eating and drinking establishment a cap of thirty percent along the corridor to try to preserve the uses that exist within there and the other is administration of the conditional use authorization so we're asking to trigger criteria that relates back to the character of the area and asking to add 3 new triggers for conditional use authorization one storefront morgue and one legacy business and one medical service for legacy business is if you're occupying a site that was

previously occupied by legacy business these are geared at trying to preserve the diversity of the businesses and protect the small storefronts the legacy businesses and provide an opportunity to contribute back to the characteristic of the area. >> so as a point of reference the next slide shows what triggers the conditional use in the current are triggered the conditional use authorization and in the blue are the 3 additional we're recommending as part conditional use we're proposing how to contributor back to the district they meet 4 out of 6 purposes those are important to the character of the that he represent many of

richards the letter provided by the project sponsor is not sufficient for me so i once worked but with the mayor's office of housing gave a permit to a property owner not to evict a tenant and all sorts of stuff and nevertheless, you know as soon as the project was finished they evicted the tenants it went to court even when you have a bunch of stuff there it is still you know doable so for me a letter just not going to cut it so i can't support the project. >> i would echo what the dmeshgsz my fellow commissioners have said i think that if we were looking at i mean, i go either way a 3 story building
