you should be proud of yourself. thank you very much. >> thank you. next item, please. >> item five. presentation on the out reach and education program to smalls businesses on the accessible business entrance program. the presenter is rh rhean auginaldo. welcome. >> i have a powerpoint presentation. >> it is so clear now. >> all right. good afternoon, commissioners. thank you for the opportunity to present to you today. my name is rhea august innal do, assistant case manager for the office of small business. in addition to staffing the business assistance counter, i help the office support business programs. i support rick with the legacy business program and the
4:05 pm
accessible business entrance program to create and implement outreach and education program. the purpose of this presentation today is to give you a background, overview of what the program is, and our goals in terms of outreach in education for the program. please note our office is in the early stages of outreach for the program. we are still developing materials, we are still actively reach you go out to stakeholders, including business organizations. given the first date to compliance is may 23rd, 2018, we wanted to make sure you understand where things stand with the program and our goals going forward. a bit of background about the accessible business entrance program. ordinance 51-16 was develop in part from a white paper by the office of small business that
4:06 pm
was drafted september 23rds of 2013 about significant accessibility issues faced by san francisco small businesses. the paper outlined recommendations at federal, state and local levels to advance accessibility and protect small businesses. supervisor pain worked with our office in partnership with the planning department, department of building inspection, san francisco public works and the mayor's office on disability to develop this legislation, and the mandatory disability access improvemenimprovements, the offe was introduced in july of 2015. passed by the board of supervisors, april 12, 2016. signed by may or ed leo
4:07 pm
april 22, 2016. >> what is the program? the accessible business entrance program is the official name of the ram. it requires property owners and buildings with places of public accommodation to make primary entrances and entrance routes into the building accessible to people with disabilities. as a building code addition, the program is directed by the department of building inspection in consultation with the planning department for historic preservation, san francisco public works for sidewalk modifications, the access appeals commission for unreasonable hardship and technical and feasibility requests. the office of small business for outreach and education and resources to small businesses and the mayor's office on disability for experience in accessibility standards.
4:08 pm
compliance for the ordinance is required for places with public accommodation. all buildings with public accommodation fall into one of four categories. ranging from fully accessible, to having major barriers to entree. i will in the next couple of slides go over in the compliance categories, steps and schedule. there are four exemptions to the programming. buildings built on or after 2002, owned by religious organizations and private clubs and buildings that do not have public accommodation. here is a list of the 12 categories in title three of the federal ada as places of public

works, sidewalk modifications which is more information on that is on department of building inspections website. important to note here, too, we do have a list of certified access specialists. in that step two, consulting with a certified access specialist there is a data base our office created as resource for profit owners looking for inspectors to serve san francisco. now here is the compliance schedule and categories. all buildings with places of public accommodation fall into one of four categories listed here. ranging from fully accessible to having major barriers to entree. quickly going over these. category one. compliance.

no steps or barriers to the entryway. category two. no steps but minor barriers. a minor barrier could include narrow doorways or door handles that require gripping our turning of the wrist. step three or category three, the entryway has one step. category four, then industry way has more than one step and other major barriers. based on which category compliance the the falls under, they with need to su submit the checklist by that date. those in compliance would have to submit the checklist by may 23, 2018 to the department of building inspection.
4:14 pm
inspection. our objectives at the office of small business. given that the ordinance impacts a wide swap of small businesses. our aim is to provide obligations for compliance. i won't go over all of these. i want too highlight a few we are focused on. first, educating businesses and property owners about their obligations for compliance. educating business and property owners about legal and financial obligations that could be triggered in the leases by the accessible business entrance program. thithis is an important be given the interesting overlay with
4:15 pm
state and federal access quilt laws. it is important to note the way the ordinance was written it is not meant to change the relationship between the tenant and property owner or affect any existing leases. our office wanted to get ahead of that to make sure we understand thelem implications and provide resources about the steps going forward. then the last one here that i will highlight provide access to legal prep sensation and assistance to business owners in need of that assistance. a bit more about our outreach materials as well as target audiences that we are looking to
4:16 pm
provide education to. we are working with the inter agency group, department of building, planning, public works and the mayor's office on disability to host workshops to businesses and property owners. we have actively identified organizations and steak holders to present to. our office beyond the compliant steps and taking the lead more so on mapping the legal implications. around the overlay of the accessible business entrance program with state and federal accessibility laws. we will conduct outreach through e-mail blasts, both inhouse through our office and distributing information out to our partners, business
4:17 pm
organizations, chambers to share with their business members. we are also putting together materials, informational handouts and handouts on the legal rights and responsibilities of property owner versus tenant. talking points how to communicate with the landlord around accessibility obligations and identifying leal and tax researches for businesses that could be available for them to cover this. to cover accessibility obligations. also listed are target audigen audigenss, organization -- audiences we are reaching out to. the merchants association, san francisco economic development,
4:18 pm
development, golden gate business association, golden gate restaurant association and the san francisco chamber of commerce. so with that one last piece that i do want to bring up in regard to our outreach. we find that it is very important in the messaging of the ordinance and the director can expand upon this. it is important to message around the civil rights component of this ordinance. it is our intention to highlight that through the ordinance. the city is taking a stand ensuring the rights of those with disabilities are upheld. it is seen as compliance
4:19 pm
litigation. we aim to tie our messaging to making sure individuals with disabilities that their civil rights are upheld. that will conclude my presentation. i am happy to answer any questions you may have. >> thanks for the presentation. question about the timeline when the outreach and all of that is going to start. what the timeline of outreach is going to start. >> our timeline we are now reaching out to business organizations. we are putting together materials and we are slated to do presentations mid-march, mid to end of march for the workshop. >>ra the certified professionals do they have to be privately higher or is the city supporting
4:20 pm
through those individuals as well? >> for the certified access specialists if you are referring to that step two where the property owner needs to consult with the cast. that would be done between the property owner and the certified access specialists on their own. we do have at our office some guidance that we have put together, resources on how profit owners and businesses can identify a cast to work with. the certified access specialists arestert certified through the state. it is important to note our city has unique guidelines around the building code. when they are searching for and doing research to find an access specialist there is certain criteria they will look for.
4:21 pm
>> commissioner aretes. >> i wonder there will be any increase in funds sabl availablo the program the city currently has. >> i will answer that question. we currently we do have -- there were some cash infusion to subsidize the inspections for small businesses. there is some of that funding left. we both oawd and i made the decision to retain that funding for small businesses so property owners would not be able to access that. property corners would not be able -- property owners with not be able to get the inspection. we will promote the property owner is responsible for the
4:22 pm
checklist and dealing with the remediation. there is the inside of the business that -- there are many businesses that have not done the inspection to insure the inside of the business. meets accessibility standards. if not what do they need to do? welatin that to encourage the inspection for the inside of their business. does that make sense? >> that makes sense. most leases have anything with ada on the lease. is that correct? >> from the city's perspective, and this was the law was designed this way, under the federal law, both the property owner and the business has a legal obligation.
4:23 pm
with the ordinance designs with dbi can only in terms of dealing with any building improvements. they can only work with the property owner. they can't work with the tent. they can only mandate it. we were going to help provide legal assistance. we do anticipate there will be property owners that say we want you to meet this obligation. there will be some probably legal assistance that small businesses need to have to meet this. again, because of that legal obligation of the property owner at the federal level, should they push on the responsibility to the temperaturenant. the ten -- tenant. the tenant may not be able to afford the level of degree of
4:24 pm
accessibility remediation as the property owner could. we want to make sure property owners understand if they meet that direction what kind of position they could be putting themselves in as well. good again this is a self rights element. when our office came to understand the difficulty of navigating dbi, historic preservation and public works and remediating the entryways. it is a opening. we are not doing our best to uphold individual civil rights with individuals with disability civil rights and making the entryways accessible. i think we are a city that promotes and are proud of the self rights that we promote.
4:25 pm
the messaging that i am hoping that we as a city do is to our property owners. we really want you to take pride in upholding the civil rights by you taking care of the entryway. this ordinance is designed to have the three departments work together. there will be times especially when we deal with the staff or properties that are on hills and things of that sort, it may take both public works and altering the entryway a bit so that it makes that collaboration easier for the property owner to engage with the three agencies. thank you. commissioner riley. >> why are the buildings built on 2002 or after except? >> my understanding is that the buildings that were built on or
4:26 pm
after 2002, the entryways are already in compliance. >> they had to meet the compliance requirement to be built. >> they are already in compliance. okay. thanks. >> commissioner doo leveled ey. >> i have spent a lot of time with supervisor tang on these issues and i appreciate all of the work our city is putting in with helping small businesses understand what their obligations are and you are doing a great job on this. thank you. any other questions before public comment? any members of the public who would like to talk about item number 5? seeing none, public comment is closed. beñi-9çó onñiñrñi the panelñi

that section of the property would not be subject to the commercial rent increase. the other one is one that will be put on by the board of supervisors and that one is covering housing and homelessness in terms of the -- what the increase in gross revenue and that is projecting 1.7% gross receipt increase for commercial rent. again, that chart highlights what is subject to the commercial rent increase and what is exempt. so just want to highlight. that one does require a super majority. so -- and then at our next meeting, the march 12th meeting, you will be receiving
4:33 pm
presentation and i'll be sending materials out. they did analysis on commercial rents and vacancies, so you will be receiving that presentation on march 12th. >> great thank you. >> that concludes my report unless you have questions. >> any commissioner questions? ok, seeing none. do we have public comment on item number 6? seeing none, public comment is closed. i'm only going to make a thing, item number 2, with these two taxes. i've never had as many small businesses concerned with this probably since i've lived here. a lot of them are saying, they're done. they can't afford it here anymore. so it will be really interesting
4:34 pm
to see what happens here. so, ok, any other questions? seeing none, next comment. next item. >> commissioner's report, allows president, vice president and commissioners to report on recent small business activities and make announcements ta are of interest to the small business community. discussion item. >> i have two things, i attended the nun awards on january 29th and i want to give a shoutout to daniel homesy for what he's done with the network. this year is probably the most diverse awards i've been to in their ten years. it wasn't just certain neighborhoods, he had representation from all over the city, so i want to say congratulations to daniel on that. and then my second item, we all have new boards in front of us today, folks.
4:35 pm
so it would help me out, please use your request to speak button now, i know half of them didn't work, we were like, ahh, that would help me out a lot. that's all i have? any other comments? commissioner reilly? >> i just wanted to let you know i attended a walk in chinatown. the highlight of the walk was mayor farrell. we visited the golden gate cookie factory and the mayor make a message and special fortune cookie for his wife and wished a lot of happy lunar new year of the dog. i worked with the mayor and welcomed in the new year in the chinese new year parade on saturday. busy week. >> i attended our regular market
4:36 pm
business association meetings and our samba is going to be joining with the south beach business association, and also i attended an event, cosponsored by the arab american grocer association around ice raids in a time when businesses are being visited by ice in the city. >> great. >> so your two local business groups are merging? >> south beach and south -- >> and what was the reason for doing that? >> south beach had some infrastructure issues and we just decided to merge forces. >> share expenses and what not? >> yes. >> do we have public comment on
4:37 pm
item number 7? seeing none, closed. >> item 8, news business, new items for future consideration by the commission. >> i want to suggest we revisit an actually spend time researching the concept of helping small businesses purchase their store fronts. a number of business i know have done this and i feel like this is really the ultimate way to protect a small business from being evicted, is if they own their store front. some folks are doing it through a tic and i think with the crisis we're in right now, we really need to look at this seriously. >> i'm glad you brought that up, i agree with you 110%. this is probably before mark's time and yours, but we did this
4:38 pm
6-7 years ago and we had success with this. you're right, now the is the time, because some of the people we helped own their store front now and they're here and doing good. >> i know some would be happy to come and speak and tell us what their process was and you know, go through the department and move something like this forward. >> excellent idea. >> is that program, the t.i.c. -- >> that's if you have a commercial building and apartment on top, the landlord wants, he could sell you the scare footage, so what you're renting he could buy the square footage. >> what is the other part, the small side acquisition? >> that's for residential. we have bought mixed use
4:39 pm
commercial, but it's primarily 4-6 unit apartment buildings to keep rent protected people in their homes. >> is there a way to inquire about a program like that? >> i think we can -- i mean, rick and i have been discussing this in terms of looking at it as one of the components to develop with the legacy business program. so there is -- we can look at what programs there are for residential, where we do have a first-time homebuyer program, assistance with a loan with that. we have the small site acquisition. we can take a look at that and take a look at some of the programs that we currently have and draw parallels of what can work, might work, develop it slightly differently for commercial space. and we might still -- i think
4:40 pm
another thing on the agenda is also on that list, would be to sort of take a way to modify back the legislation that prevents condos and allow commercial condoization. so that it's easier to get 504 loans. >> ok, any other new business items? do we have public comment on new business? seeing none, public comment is closed. next item, number 9 adjournment. >> before that, please show the office of small business slide. and remember the office of small business should be your first stop when you have any questions about what to do next. you can find us online or in person here at city hall. best of all, all of the services are free of charge.
4:41 pm
the small business commission is the official public forum to voice your opinions and concerns about policies that affect the economic vitality of small businesses in san francisco. please, we want to hear from you, come to our meetings. the 2nd and 4th monday of the month, we want to hear from you. if you need assistance with any small business manners, start here at the office of small business. >> item 9, adjournment. >> moved, seconded. >> all in favor, aye? meeting adjourned.
4:42 pm
>> all right. well, first of all, good afternoon everybody, and in case everybody is wondering, today is not only valentine's day, but ash wednesday, hence the marks on my for head. [ inaudible ] in sro here in san francisco are available for every single resident. i am incredibly pround to be standing can supervisor ronen and supervisor sheehy. it is incredibly important for so many of our constituencies here in san francisco, both in
4:43 pm
terms of gender, our transgender community, it affects so many people here in san francisco. i think as we continue to see push back from our federal administration in washington d.c., just this week, our department of education announced they're no longer going to be investigating transgender student bathroom complaints, which is a step absolutely in the wrong direction, but in san francisco, we are different. we are not going to allow hatred todom namt, we will continue to standup for our communities here in san francisco. we will be a beacon of hope. i do want to thanks tha severa individuals for being here today, as i mechanicsed, these issues take a lot of leadership
4:44 pm
outside of city hall, and this one was led by two incredibly courageous supervisors, and so i want to introduce the first one, supervisor hillary ronen. >> thank you so much for being here. i'm very, very honored and excited to be here. i also want to extend a special thank you to jordan davis who brought this legislation to our office and said, when you were supervisor campos's chief of staff, you forgot sro hotels to include that specifically in this lemggislation, so it was pleasure to correct that mistake, which we would have put in the original legislation but accidently left it out. so thank you, jordan. i just want to say what we've learned about this legislation about making bathrooms all gender bathroom is when the
4:45 pm
traps gender stands up and fights for itself, for recognition, for dignity and safety, it ends up benefiting everybody. i don't know about you, but every time i'm out in public, and there's an all gender bathroom, that benefits me as a woman, it helps disabled individuals who might have an opposite gender caretaker. it just makes our society better, safer, and more welcoming to all of us. so i just think we should look to the transgender community fore guidance on all policies that we work on in san francisco, because it always ends up benefiting not just the community but all of us. so my deep, deep thanks to everyone that's here today, to claire, to the mayor who made an unprecedented move of joining us onto the legislation before he even signed it because that's how much he
4:46 pm
supports this community. and to the only out member of the queer community on the board of supervisors, jeff sheehy, who always is the first to standup for and advocate for his community. thank you. [applause] >> so first, i just really want to thank jordan davis. i've been in your chair. that's how i started. i hope i'm still considered an activist, but when someone can come to city hall this change, that's brilliant. thank you for your leadership. i also want to thank mayor farrell for his supporting this and signing this and leadership along the way. i think this is really very important that sro's are brought into the mix. you know, this is where many
4:47 pm
people live without a lot of resources, who are marginalized, and making sure that the dignity of our trans and gender nonconforming community is recognized, respected dignity of this community is recognized on all level in our society is absolutely critical. i'm very proud to sponsor this, and i just want to make one other point, since mayor farrell brought up what's going on in washington. we need to, every time we come together, with one of the communities that have been particularly targeted by this administration, they have sought to target the most vulnerable communities in our mix: immigrants, muslims, and the trans community because they think they can get away with it. so even though every time we come together, even though we're making headway and we're leading in san francisco, we have to remember that around the country, people's rights are being taken away, and in
4:48 pm
this city, immigrants' rights are being threatened every day. we have to align ourselves with other communities in solidarity, that are particularly targeted in these times. so again, thank you to jordan, supervisor ronen, to mayor farrell. this is great work today. [applause]. >> sorry. claire. i was just supposed to introduce claire who's so great, really doing a tremendous job in filling the shoes and taking on off tereaf teresa sparks, so i'd like to introduce claire farley, who's senior assistant to the mayor. >> good afternoon, everyone. i'm so happy to be here with all of you today in this historic moment, and this would
4:49 pm
not be possible without you, mayor farrell, for your continued support of making sure that our city is committed to lgbt folks. also, thank you to supervisor ronen for your incredible leadership on this, as well as your office, and specifically, also to supervisor sheehy, and all the cosponsors on this important legislation. i also want to take a moment to thank joerd on and the -- jordan and all the members on the sro task force. this victory really does belong to all of you, so thank you. [applause]. >> as trans and gender nonconforming people, we are all to familiar with the stress, the violence that comes with trying to use the bathroom that match our gender identity and expression.
4:50 pm
as our rights continue to be attack in the country and under the federal administration, it is important now more than ever that san francisco continues to be a leader in the movement towards fair and quality rights for all. no one should have to worry about facing the stress of going to the bathroom in the place that they call home, so all gender sro ordinaryians will extend our existing protections and will ensure that our rights are extended to the full community. furthermore, it will increase access for people with disabilities, residents who have caretakers. this resolution is important to make san francisco better. of course we know there's more time to be done, and together we will continue to advance the initiatives, the policies and programs that support a thriving trans and gnc
4:51 pm
community here in san francisco. we will work to implement policies like this, future policies and programs that help sustain the livelihoods of our communities. let's make sure that san francisco continues to be the beacon of hope and change that the rest of the country desperately needs right now. depend, thank y again, thank you so much for being here today and for this amazing step forward. i hope you will join us in the work ahead. thank you. [applause]. >> all right. we're going to get to the signing here.
4:53 pm
about fire safety. we are here at the urban center on mission street in san francisco. it's a wonderful display. a little house in the urban center exhibition center that shows what it's like in a home in san francisco after an earthquake. one of the major issues that we are going to face after earthquakes are fire hazard. we are happy to have the fire marshall join us today. >> thank you. my pleasure. >> we talk about the san francisco earthquake that was a fire that mostly devastated the city. how do we avoid that kind of problem. how can we reduce fire hazard? >> the construction was a lot different. we don't expect what
4:54 pm
we had then. we want to make sure with the gas heaters that the gas is shut off. >> if you shut it off you are going to have no hot water or heat. be careful not to shut it off unless you smell gas. >> absolutely because once you do shut it off you should have the utility company come in and turn it back on. here is a mock up of a gas hear the on a house. where would we find the gas meter? >> it should be in your garage. everyone should be familiar with where the gas meter is. >> one of the tools is a wrench, a crescent wrench. >> yes. the crescent wrench is good and this is a perfect
4:55 pm
example of how to have it so you can loosen it up and use it when you need it. >> okay. let's go inside to talk about fire safety. many of the issues here relate to fire, for example, we have a little smoke detector and i see you brought one here, a carbon monoxide smoke detector. >> this is a combination of smoke and carbon monoxide detector. they are required in single homes now and in apartment buildings. if gas appliance is not burning properly this will alert you before the fumes buildup and will affect you negatively. >> this is a battery powered? >> this is a battery powered
4:56 pm
and it has a 10 year battery life. a lot of times you may have one or the other. if you put in just a carbon monoxide detector, it's important to have one of these too. every house should have a fire extinguisher, yes. >> one thing people expect to do when the power goes out after an earthquake about using candles. what would you recommend? >> if you have a battery operated candle would be better to use. this kind of a candle, you wouldn't want it in an area where it can cause a fire or aftershock that it doesn't rollover. you definitely want
4:57 pm
to have this in a non-combustible surface. >> now, here we have our stove. after a significant earthquake we expect that we may have gas disrupted and so without gas in your home, how are you going to cook? >> well, i wouldn't recommend cooking inside of the house. you have to go outside and use a portable stove or something else. >> so it wouldn't be safe to use your fireplace to cook? >> not at first. you should check it by a professional first. >> outside should be a safe place to cook as long as you stay away from buildings and
4:58 pm
doors and windows. >> yes. that will be fine. >> here we have some alternative cooking areas. >> you can barbecue and if you have a regular propane bark could barbecue. >> thank you for joining us. and thanks for this terrific space that you have in this exhibition space and thanks for helping san francisco stay safe.
