[roll call] >> the motion passes, the minutes pass. we'll move onto item number three, which is the report from our acting director, ms. weiland. >> good evening, commissioners, president tan. i just have a very brief update. i just wanted to say that we are really excited because we began on boarding our new sound inspectors who are working part-time, so i just wanted to point out that one of our new sound inspectors is in the audience right now. inspector fiorentino, we are

very happy to have him. i didn't want to bring him up here to put him on the spot with lots of questions while he's in training. and we do have a second part-time inspect time who will be beginning on monday, inspector lee. so between the two of them, they have experience in the music industry in different ways, and we're just very happy to have them. >> great. welcome on board. is there any public comment or commissioner comments for the director report? all right. seeing none, there's nothing to move, so we'll go onto item number four, the report from our senior analyst, mr. dylan rice. >> good evening, commissioners. dylan rice, senior analyst for community and cultural events. pleasure to be here. i just wanted to touch base about a few items. last night, we had our fourth

mixer for the event producers, the sf outdoor events network, and we always have a topic or a theme that we present at these mixers, so i was inspired by the presentation that -- that health and harm reduction coalition did at our summit. it was very brief, but i thought we could take the idea of harm reduction and special events and really go more deep dive into it and it's especially topical because there is a lot of data to show that opioids are actually -- use of opioids, whether intern intentional or unintentional are on the rise nationally and in the bay area. if you heard the news about 420, there were some opioids that were laced with fentanyl that sent some people to the

hospital. so it is a concern, and producers are legally responsible for their participants at their events, so i just feel like the more knowledge and awareness about this, the better. so we hosted a really dynamic speaker from the harm reduction coalition who talked about the signs to look for in overdose and how to respond. and it was very powerful. we had about 25 people show up, and everyone was really glowing about it. so i'm really glad we did it. we did it at 111 minna, who was very gracious to host us for this event. and i'm very excited that we had representatives from recreation and park department there, as well as the sf parks alliance. it was really nice that they came out to support, and we had some people participate in the new haves and needs wall that we're starting to do. i think we're going to continue to try it and do it on-line and see how that goes in terms of

resource sharing across the industry. moving onto the next thing, the outdoor events guide and permit fee estimator is still trucking, so it's still being reviewed by deputy city attorneys across seven different departments. our deputy city attorney, lela, is doing a really great job helping to facilitate it, so i i'm grateful for that. we've already heard back from a few departments. i'm especially pleased with the feedback we've gotten from recreation and park department. i think their feedback is going to strengthen the guide, so i'm really excited about that. and then, i am also in conversations with commissioner bleiman and commissioner lee about the next bulletin that's going to be promoting this idea of starting the permit process early and the advantages or benefits of doing that.

there is very low awareness about some of the benefits of contacting the police department early in terms of applying for a liquor permit. if you are one day less of 90 days before -- i'm making this up, but there is a deadline, and if you are one day late, it puts your notification of your decision way back. so we're trying to raise awareness of that, things like mta's tiered deadlines for their applications, things like that. so that is going to be going out by next week, and i'm hoping that we can also get the cannabis fact sheet done by then, as well. we're still in the process of having it revised and reviewed by the cannabis office. so -- and that is all i have. any questions?

consend calendarient. the first is for dogpatch wineworks, and that's a wine bar located in the dogpatch that wants to add entertainment. and then, the second is jamestown premier, which actually is ghirardelli square. they're going for a limited live performance permit to have entertainment and outdoor amplified sound within the square. so that is outdoor, but we did not receive any complaints about either of them. we did receive support for both, and the police department did not have issues with either, therefore, they are on the consents. >> all right. like to entertain a motion to approve the consent agenda. >> i'll make the motion to approve it. >> great. there's a motion. is there a second? >> second. >> all right. is there any public comment on

our consent calendar? no, that's fine. why don't you come on up and go ahead and speak. please state your name and you'll have two minutes. >> my name is terry meyerson. i live at 1000 north point, which is across the street from ghirardelli square. i don't object to the license or the permit, however, i object to the procedure because nobody knew about this until yesterday from -- in the building. the posting was on the inside of the square, which i don't know how any of you go into ghirardelli square. it's -- they're trying to be more local, but it's current time -- there's not much there for a local to go to. so this posting for this permit and the permit for the san francisco brewing company, nobody even knew about it in the building. i asked the building manager. she knows nothing about either of them -- we were notified at

jamesto jamestown friday that the meeting was happening today. the comment to post about it was the 11th. i'm not saying i'm against it personally, and i haven't talked to anyone in the building, but i am asking that jamestown does do some sort of plan to -- for us in the future as well as noise abatement. currently, i live in the 10th floor, and it's like sitting in the square listening to the music for some of the performers, and that's basically all i have to say. >> thank you. yeah, i think it's a unique site just because the storefrontages don't necessarily face the sidewalks, but we'll make sure we can try to speak to jamestown in the

just state kind of what you're hoping to do, and i think there was a specific question about what your community outreach efforts were, so if you could respond to that. >> yeah, the general, we're just looking for a permit to be able to have family friendly live music within the square, and we'd want to be doing that in a way that's working with the city and correctly permitted. so we're going through the process to make sure we're doing everything correctly. so in terms of outreach, we reached out to the fontana towers in terms of our neighborhood next door. internal tenants like ghirardelli chocolate, the fair mon fairmont, which we have a joint agreement with them. we -- partnership with. we have an agreement with them with hours that they are okay with music in the square. so we're working with them to make sure that it works with their hotel guests and their procedures, as well. we had three other tenants, as

well, bottle creek winery, san francisco brewing, and i believe that's it in terms of relative tenants within the square that we reached out to for support for the permit. is there a second question in terms of kind of the agenda and what our intent is with -- with... >> i think family friendly programming is okay for now until we get -- unless there's another commissioner that wants to know more. i think the youch reach is mainly having a resident come to us and say we didn't hear about it until a day or two ago is not appropriate in our eyes. i know you came up to say we've gotten in contact, and there is communication lines open, but yeah, i guess what other

additional kind of outreach, community outreach do you plan to do, besides what you're doing now? >> you know, we continue to work with the community. we can -- i don't -- i'm not sure we'd want to -- we'd want to reach out to the community as needed. we're in a unique space in that we're on beech street in terms of the sound levels are not really reaching -- i think they're reaching the residents on the fontana towers side, but beyond that, happy to walk around the community and come to russian hill community board meetings if -- as need be. we haven't really received any complaints previous to this other than fontana, and we're working with their management team just to make them aware of how our noise management works

with their residents and in the square? >> can you tell us more? >> in terms of the hours that we're allowing music to be on, and music being live musicians that we've scheduled in the daytime that we are working with and are in touch with in terms of noise level. they are not playing without or consent and us monitoring their noise levels, and then live music just family friendly low music playing for the visitors in the retail space. >> and are you planning to provide a calendar to those residents with as much notice as possible? >> yeah, that's a great idea. yeah -- whatever they want in terms of communication and more knowledge about our events, i think we're happy to provide and work with them to make sure it's not disrupting their

residence. so i think it's a learning process for us to learn the best way to do that and outreach to their community and also just knowledge of what's going on, what their needs are. so i don't know. i think we had a conversation with terry, and i'm glad that line of conversation has opened up so we can continue to check in from here on coming forward. >> commissioner perez? >> good afternoon. i'm glad you guys haven't had any complaints so far, but in the future, what is your policy for addressing the complaints should they come in. >> yeah, so far, we've had internal -- if there's complaints from internal tenants, like, there's spaces with different kinds of acoustics where noises would reflect off walls in different

ways? working with those tenants is like let's do some sound testing or see what decibel on a sound meter does that disrupt your business? and working with them, checking in after we've fixed those acoustics, not just moving on. i think the residences, the same procedure. i think once we understand what the problem is, how we can fix it, and keep that line of communication open, when we try something new or just a circumstance in making sure that's met. so sound levels, i think time, hours that the music is playing, i think those are the biggest kind of pain points of understanding when we should be playing music and at what level is disruptive. >> at the time you receive the complaint, how quickly can you respond? >> within the hour. i have an open line on my desk

that you can call, the ghirardelli square line, that we can respond every single day. i think the latest would be day of. >> okay. how soon on the day of, because by that time, the event may be over. >> of course. i mean if we're continuing to respond, yeah -- i guess i misunderstood the question. >> okay. thank you. >> and have you read our good neighbor policy? >> yes. >> okay. 'cause one of the points on that policy is that you have to have an open line, a cell phone that can be immediately responded to. >> yes. >> so that's something that we can hold you to, and that's something that, you know, if a resident came to us or a neighbor came to us, we could also see if you're complaint with your permit. commissioner frost? >> do you have anything scheduled on the schedule between now and our next entertainment commission schedule meeting which is now

and june 5? >> yes. >> you already have entertainment scheduled? >> yes. >> i'd like to make a motion that we conduct sound tests between now and the next meeting just to make sure they're in compliance with their amplified sound. >> we can add that as a condition to the permit. we get tips all the time, especially for outdoor sound systems. i think just take into account wind dynamics, and i know you guys are right along the water. you might think it sounds fine, and guess what? it's blowing the sound up ten stories, and you're getting those complaints. so even though we will do a sound test, it may vary depending on the weather conditions and if there's cloud cover and fog cover. just be cognizant of that. if you coudo have that spirit being able to respond immediately, just be aware of that.

commissioner lee and commissioner frost? >> is the sound system going to be provided by the entertainers or are you going to be providing sound every single time? >> the entertainers often bring their own sound equipment, but we always do a sound test -- >> so you do a sound test each time? you have your own meter? >> yeah. we have reoccurring people that would be scheduled, and so they can -- >> okay. and so -- >> -- like, i'd know what the general sound is, but they can also continue to test. >> well, when they do a sound test, they'll give you a number. >> okay. great. >> the question is, too. i know ghirardelli has residents on the top. so do you actually engage and hand fliers to the individual apartments and say we're going to have a hearing or do you just go through the property manage ner. >> it's the fairmont hotel is responsible for those residences, so we've account kaed them, and i believe they reached out to the residences. so we very often hear everything that happens with

the residences there with what's going on with the square. >> so the gentleman today who also got the notice yesterday -- >> that's in the apartment complex across the street. >> oh, across the street. >> yeah, the towers are across the street. >> i see. and is that within 300 feet? >> i believe so. >> and so you -- >> might be exactly 300. >> so you haven't ever reached out to the ones across the street, then? >> we have. >> you have? >> yes. >> and that's my -- >> we're in touch with their property office or we'll hear from them directly regarding various issues with our tenants and other issues going on in the square. >> okay. in this case you went to the same procedure -- >> in this case, we went to the property manager. she passed along the message late last week, and then, we talked to terry today. >> commissioner frost. >> commissioner perez talked

about somebody that has an issue at the time. in the application, it says there will be music from 9:00 a.m. to 10:00 p.m., in those hours, some variation. what hours are you looking to have live entertainment? >> so that's outdoor entertainment. i think that was like speakers, low outdoor volume in the retail space. i don't know if they had changed that in the application. for application, they put 10:00 a.m. to 5:00 p.m. >> and you'll be working on-site on all those hours all the time. >> correct. >> how will the community know to call security? will the number they call for you roll over to security? >> we have a general 24 hour security number that kin can contact to reach someone that's

on-site 24 hours a day every single day of the week, and so that is a public number that we've passed along to residences and all of our tenants. so if we're ever off-site, they -- over night, on the weekends, we always are in contact with everything going on with them if we're not. >> perfect. thank you. >> all right. anymore commissioner comments or questions? don't think we have any. you can go ahead and have a seat. thank you for entertaining our questions. i'm going to open it up for public comment. is there any additional public comment on jamie town's permit application. you can come back up. it's considered a new item. >> again, i just wanted to reiterate, i'm in favor of their permit. i just want to make sure it's in control. that's all. >> great. >> and again, it's speaking for me alone. i know there are some other

ownership, the new owner is jimmy lamb. we did receive a fair amount of support from neighbors of the premises. he has been managing the venue for i believe over a year now, so he's gained a lot of experience, and he's almost completed all of his signoffs, so good job, jimmy. come on up. >> thank you, commissioners, good evening. so we have been change of ownership for about, like she said about eight months now. >> thank you speak into the microphone. >> we have been change of ownership about eight months ago, and the previous ownership, like, has been in this establishment since 1988, and our ownership should be strictly follow their legacy, so we did not change anything. the hours of operation is from 2:00 p.m. to 2:00 a.m. in the

morning, we never close. basically, we learn everything from the current staff in terms of security, how to make sure the neighborhood, not, like, being disturbed by song. and a few years ago when they -- the next -- the next door when they're building, like, kind of a high-rise building, from that point, actually, like, the previous owner hire sound expert that's on 1516 lombard street. with his recommendation, they have removed the foam sound proofing on walls and have replaced with minimum 1 inch duct liner covering at least 20% of the floor and wall areas, but the previous owner exceeds this requirement by covering all the back and front wall with the required materials. and besides that, the all frontage upper and lower windows replaced with double

paned soundproof glass. and the entrance door was replaced with double paned glass as well. lastly, we installed a canopy over the front entrance. and from now, we also have a handheld sound frequency test device, so that we also hire our in-house doorman, so that we make sure that the door always remain closed at all times so people don't just open the door and stand there so the sound doesn't come out. so we do some proactive things to make sure, like, the neighborhood is quiet. >> great. commissioners, any comments or questions? are you planning to maintain the staff? it sounds like -- >> yeah. like, actually, pretty much, like we only hire one more

staff because one part-timer, like, he went to school, so other than that, the staff are the same people. >> so as a customer, i probably wouldn't notice a difference? >> yeah. >> great. >> all right. thank you. >> and do you have any tips on how to get higher up in the music cue? >> you can look for me. >> okay. got it. all right. thank you very much. i think, you know, the mint is a long-standing institution here. i think people locally and from out of town really love the venue and to be able to sing on stage in front of lots of strangers. >> we look forward to owning this for many years to come. >> all right. great. it looks like commissioner perez has a comment or question and then we'll open it up for public comment. >> hello. i do love the mint. i've been there for many birthday parties. just want to ask you your

experience in operating something like this in the past. >> my experience is more like in the restaurant, so a restaurant with just, like, bar, but bar with, like, restaurant and karaoke. but the same is, like, customer service. like, we make sure you don't have conflict with the customers, especially when they drink alcohol. so, like, we have the doorman always look for, like, theft, for example. like, we -- we -- like, whenever, like, people come onto the stage to sing, they always like to be -- left their belongings on the -- on the chairs or -- so we try to be proactive by doing security as well, so make sure, like, no conflict, sometimes, like -- like, before, like sometimes my previous owners told me some people like to stole people's belongings, so that's why we have been very proactive by, like, doing, like, extra customer service to the people. >> and who's available to

>> the motion passes. good luck, thank you very much. we'll move onto our next agenda item, item number seven, which is a review and possible action to change the conditions on a place of entertainment permit for cue. i'll pass it onto director weiland, and i think we have a lot of support materials here. just so we know how this'll work, once it's introduced, i'll go ahead and have hugh come up and present why they would like -- which conditions they'd like to modify, and then, i believe sfpd is here that will also be presenting, and then, we have, i believe, a lot of people in the audience who would like to speak with public comment. so we'll have hugh first, and then, the pd, and then we'll have public questions. >> okay. i'll just speak more to the terms of the process in terms of what i did to prepare here. so i did receive a request from

bennett, along with mr. blum, his attorney, to come to hearing this evening as they want to change some of their conditions, and this is coming off of our previous hearing on february 6 where you as a commission essentially said they could come back in three months and request a change -- further change in conditions at that time. in the interim -- and then, president tan allowed this hearing to occur tonight based on that request from the permit holder. and then, just in the interim between february 6 and now, what we're seeing here is we received notice from the police department as well as neighbor complaints regarding an incident that occurred on the 400 block of broadway. this is march 18, 2018. it was right around 2:00 a.m. st. patrick's day night, so i think we need to hear from

those concerned parties regarding this venue as they had all named hugh in their complaints regarding the incident that occurred. so in your packet, you will see -- you'll see permit documents so that you can refer to the actual conditions as they stand from our february 6th hearing, along with the current security plan and that is a condition of their permit to be in compliance with. further, you'll see documents from the permit holder regarding this item. and beyond that, you'll see all the items from the police department as well as neighbor complaints regarding the venue. so let me know if you have any questions about that before you get into your process. >> no. sounds pretty clear and straightforward. thank you very much. why don't we have mr. montoya

come up or a representative of hugh come up and talk about what you'd like to present today. >> hello, commission. bennett montoya. only conditions that we're really asking are conditions of the live entertainment to go to 2:00 a.m. it's taken a hit focused more on our corporate and private events during the week and on the weekends and on sunday mainly because we are not able to book those events because we're not allowed to have live entertainment, as well. as far as the improvements or updates, as far as the continuing -- our continuing process to improve sound improvements for our neighbors, been in constant contact with

our neighbors on roland alley. we communicate and update them as soon as we have an update. we did find that a sound leakage that was not brought to our attention before. it's basically a door that goes to the roof of our building, and it was never really brought to our attention because about two years ago, the roof was replaced by the landlord. and in order to get in to, i guess, put in roofing material underneath the door to the roof, which is a good flight of stairs up that we never really go by, they were -- they had to cut a hole into the door and basically reach in to open the door so that they could put the roofing material underneath the door. that was brought to our attention when we went upstairs

to do our sound test -- normal sound test, and we noticed that, you know, that there was just a piece of wood basically covering the hole. we did do our sound test, and we are still in compliance, but, you know, there is improvements that we can do there to make it even lower for our neighbors. we have reached out to the property management company and as of last week, they sent a contractor over to do an estimate, and we're in the process right now of that estimate being approved by the property management company, which we were informed today that they'll be sending -- scheduling someone to come out next week to replace the new door. as far as being in constant contact with our neighbor, andrew diamond, in the back, we do every night we are open take readings three times a night,

make sure that we are in compliance. he has reached out, i would say, about four times to us -- me personally and my staff through e-mail or text messaging, let ting us know tht the sound he feels is a little bit louder than usual. we then immediately take a sound reading test and confirm that we are still in our limits, but we, being a good neighbor, still turn down the music just a little bit more him. as far as all the other conditions, we're already continuing practicing those, and we plan on continuing on practicing those. >> okay. so it sounds like with the time, you want it to just be a blanket 2:00 a.m. every day of the week. >> yes. >> okay.

were incidents on the morning of march 18, as well as the morning of march 25, and when we got a an e-mail from hugh the next morning -- on the 18th -- well, sometime on the 18. i believe it was sent to the entertainment commission. and in reading the security report -- let me pull that up. -- and this is regarding the night of the -- the morning of the 18. at roughly 1:54 a.m., a fight occurred under the brought way studio sign entryway of the parking lot. some of our security operations staff and management staff were assisting on breaking up the

fight when then we then called for our staff to come or to stand down. at approximately 2:00 a.m. to 2:10 a.m. while closing up the front of the venue and bringing in the barricades into the club, i saw a dark black car drive a little bit on the wrong side of the road where swerving back into the correct lane headed towards columbus on broadway. that is when i heard gun shots. we immediately went inside and ordered all staff to go inside. one of our operators managers, cory saw someone reach out of his window and shoot a gun in the air. i believe the car i saw is the same car the gun shots came from. a few minutes later sfpd arrived. i wanted toic ma sure we did our part in reporting what happened, so i asked my security officer to flag down

sfpd. cory then gave a statement of what he saw to the officer. then, another statement, which i believe i got this one a little bit earlier. this was from their head of security, earnest carrera. amarch 18, at 1:54 a.m. a fight broke out. due to the fight taking place off property and involving patronage from other venues, i instructed my staff to stand down. after several minutes the crowd dispersed in other directions -- after several more minutes, the crowd disbursed in different directions with no injured parties including venue staff. approximately five to ten minutes after the fight disbursed at 2:00 a.m. when we were moving the barricades into the property as the club was

clear, i heard shots coming from across the street. the timeline here is actually pretty important. they stated that it was at 1:54. the actual time was 1:59:15. this is when the first tight started. at 2:09 the shots were fired. so this was not a fight that went on for five minutes or ten minutes, it was actually very quickly. at 206 was when the first 911 call, and at 2:09 was when the first unit responded. after reading the statements, it looked like the club was -- appeared saying look, we're closed. and we don't think it was our patrons. i think after showing the clips

that we show you -- >> take a look at the video, a brawl in south beach this morning. you semen and women going at it. the fight spills out into the street in the early morning hours. it's the type of scene that has neighbors in the area saying enough is enough. >> we have video from last weekend when fights broke out one after another, followed by gun shots. >> closing time after st. patrick's day. surveillance shows a peaceful scene on the sidewalk. it's just after 2:00 a.m. when suddenly violence erupts. another guy comes out of nowhere and employs a sucker punch. two other guys start kicking the man. a woman helps him to his feet but he falls back into the street. a brawl eventually breaks out

music at 10:00 p.m. on saturday. >> they tried to give him another chance and see what happens. i don't think he should be open again. >> i wouldn't say that hue is necessarily causing those incidents. >> the owner, bennett montoya says the fights are caused by a lot of other factors. also, on late weekend nights, there are a lot of young people just hanging out on broadway, some inside the club, others on broadway, many looking for social interaction, but some are clearly looking for a fight. >> these fights, a lot of them aren't even our patrons. >> why are so many people blaming hue? he says skin color is a factor. >> we are definitely being targeted, and we are held i would say to a higher standard than other businesses here. >> why do you believe they're targeting you?

>> okay with that, we're going to go over a couple different videos that show the patrons. until i determine that it was actually hue patrons that were actually involved in this, i did not even mention it to anyone because if i don't know, i'm not going to accuse anybody. when i did determine that it was, indeed, hue patrons, i sent an e-mail over to mr. montoya voicing my concerns to redouble their efforts because there had been a fight -- a major fight on the 18, there had been a major fight on the 25. both of those -- actually, i didn't even know that the hue patrons were involved in the 25 one. i hadn't looked at those yet, and at that point, it was just the 17 or the 18. i asked him to redouble his efforts. we talked about the serving -- kind of the things that we've been going over and over. i got a response from his attorney basically saying to go through him because he's his
