three, report from our acting rect, ms. weiland. >> thank you,enttan, commissioners. it's been a crazy election day. so i just wanted to talk about some housekeeping items i'll actually just start with scheli e-mailed you all today, so go ahead and take a look at thatf y ien't already. main items are just that our upcoming hearings are going to be june 19, and then, again june 17. witi president tan, and he agreed that it would be wise to cancel july 3 due to the independance day holiday. in the same vein, we are trying to reschedule our retreats since that's the saturday prior to the 4th of july. it didn't seem like that was a possible date for the retreats.

i sent out an e-mail. the choices would be saturday, august 14 or august 18. i just wanted to say d recei a couple of responses, so thank you for that. please let us know in advance if you can't make a meeting, because we are down one commissioner, so it's a little more challenging to get t that quorum. other item i wanted to bring up was just around our sound inspector hiring an on boarding. first of all, i wanted to welcome back inspector burke. we are so happy to hve him back, and again, this is inspector fiorention. mike, raise your hand. he may not always be sitting up here with us, but he is, you know, the man out in the field right now and still in

training, and so everything you're going to be hearing from inspector burke tonight is a collaborative effort between those two. we did star on boarding a second part-time sound inspector recently who rtaty is no longer with ourfiorentino started

before the fiscal year starts, so he's been working almost 40 years a week, but once the new fiscal year starts, he'll be working 20 hours a week to maybe sure he's at 1,040 hours a year, and that'll likely be the schedule of the next inspector, as well. at. thank you. is there any public comment on our acting director report? okay. it doesn't look like there's any. public comment's closed. we'll move onto item number

five. police department comments and questions. once again, i don't see anyone here for that -- oh, i'm so sorry. item number four, i'm getting ahead of myself. the report from our sound inspectors. >> sean burke here, happy to be back, and i've got a big long list of things that mike and i have tackled. we'll start at the top. lobster fest in civic center plaza, you may not have heard about it, comedy and music. we did get a couple of complaint via 311, and there was another complaint via the hotline that the promoter setup. i was able to call into 311 to give them the number to the

cluster fest complaints. there's a whole list of inspections that mike and i have done since -- mike did about half of them, and then he le and i did the oth half t two weekends. >> sean, really quick, with cluster fest, were they all sound complaints, and did the planning -- >> i'm going to refer -- [inaudible] >> -- once they heard about the complaints. >> we'll still waiting on a full rundown of the full complaints from another planner. maybe mike can give us a rundown of the other ones. >> they were all sound related, and it was related to not the comedy but the music that was being played between the acts. >> and do we know if there were adjustments made -- >> we don't know. like sean said, once i kind of

got the idea that we were going to saturday getting more complaints. that was probably around 60 last friday, so we had to go out on patrol, so sean was able to set that out, aer planet hotline, so they were able to field those other calls. >> great. thanks. >> i'll see if i can bring more details at the next hearing. >> a bunch of sound tests, you'll see on the back of the page, these are all places that passed the sound , and they're our newest permitees. two citations at 3910 geary. this is a place that has changed ownership many times -- well since i've been on, i think there's been three owners. none of them, i don't think, have been permanent -- one has been permanent, and the current oer hasno permit.

they've been cited twice in the last two weeks or hosting entertainment without a p.o.e. >> i just wanted to add into that that this is actually a night that we wer training inspector fiorentino, and we were out, and we went there, this was due to several complaints to the richmond police department. we went with richmond station police officers and the fire department, and the department ended up actually shutting them down that night. we're letting you know about this in advance because these folks might actually try to come into compliance so it's good to have that background. >> which one was that, again? >> that was 3910 geary. it's under the citations -- >> thank you. >> -- category. >> there's no name? >> yeah, they just called it

at 4:00 a.m. >> we're going to continue it monitor this because this is one of the permits that the commission vote today revoc. as a part of that, they're not allowed to have live entertainment ever again, so the city has been in contact with us regarding these complaints, so we're working with the police department as well to see if they're having entertainmennot.r >> there's a group of ongoing complaints. if you have any questions about those, please let me know. i did want to point out that we visited hue friday night to inspect the most recent changes to their security plan. unfortunately they were closed by the time we got there for the 2:00 out. i think we arrived at about 1:45, and security gates and doors were shut, so we weren't able to verify the new security

conditions. let me see if there's any other inspections that i wanted to point out. lusk is a new rooftop that we will be bringing into compliance after a complaint. flywheelster is a little coffee shop in the haight that we'll be bringing into compliance. that was also a neighbor complaint. bistro sf, noise complaint. we're going to try to bring them into compliance. there's a lot of compliance checks that are happening based off of sound complaints through 311. and then, two more that we -- one, ken cholla's, you'll see that june 1. that was one that came from a complaint, and tiptop bar, we're going to be bringing them into compliance, as ll. so one we discovered after a complaint, and then, one, we

discovered because of that complaint across the street. >> and what's up with great an mic hall? i don't usually see them with ing complaints? >> we don't. we have visited great american music hall. we've talked to them abo keeping doors closed, keeping drapes closed. they have an updated drape on the order. last time mike and i visited, they had a very quiet show, so it was not a true test to get a plan of how much sound is escaping, so we're planning on stopping by this friday to see what the show is. all of the complaints, i t it's -- it's half crowd noise outside and then half sound escaping the venue.

>> so tell me how -- h you plan -- there's going to be a lot more rooftop bars opening, a lot. and i'm just curious, how do you plan to -- i know we don't have, really, any standardset for rooftop bars, right? >> we do, yeah, and that was a part of the changeso code that happened last summer. >> right. >> with jobs one work. so as a part of that process, we created six place outdoor amplified sound permit. so that's one path forward. that just if you're doing amplified sound outside. or if you are a place of entertainment or a limited live performance space, you can amend your permit to include outdoor. we've already been seeing that happen, or as the ones you've been seeing recently, ghirardelli square went for an amendment. 25 west is just amplified sound

outside, and the way that it works is those folks actually had to go to planning commission. they wound up going to board of appeals. they had a really long process. as a part of that, theypteddo a motion that included conditions regarding outdoor and fud sound. you become essentially an outdoor activity area, so that is kind of the path forward. if you pass through planning and you're approved for that use, you can come and get that permit from us as an overlay. >> is there a cutoff, like, 10:00 -- it's up to plg, in right? >> so not necessarily. planning did definitely place irin the conditions hours for amplified sound, so that's something for that, it's case by case. you could adopt those conditions and just say we'll go exactly with that, or you could just scale them down. if they don't have any conditions regarding time, place, and manner from planning, then it is up to you all and it is dictated in the

code what the standard set of conditions are? which i think i should just e-mail you guys to make you fully aware of that because the standards are10:00 p.m. cutoff, and they require a sound test, and you basically can't have sound audible 250 feet past the property plane. there's a couple others in there that are, like, the tandar but you can always condition otherwise, and that's what i think we're going to see when we see the giants comeo us for a permit, when we see the warriors because they're quite large, and they're probably going to have to abide by a different standard, different set of conditions. >> so i take it it'll be our discussion at the summit? >> yeah. what i've heard fr commissioner bl commissioner bleiman is he really wants the city attorney present, and just go through a lot of code questions. >> yeah. >> that's a good idea.

>> i rest. >> the -- there's, like, a last sentence, we received new complaints from playland and other venues? is that just 'cause you ran out of time? >> right. >> what is that? >> so this is an area where we had a bunch of new complaints, and a whole lot of time since we were last here. so instead of having a whole nother sheet with date and time, i just wanted to make sure you were aware that these places got complaints. most of it was just a space saving effort. i think it's really important to -- moving forward, we'll go back to the old standard of, you know, having all -- all they're permitted, description, date and time. i think that's helpful for you guys to know when things are happening, but just to safe

about 1.5 blocks away to the closest residential. i do have two karaoke rooms out there, so maybe one of those i'll be ren out enever it's possible, of course. i did look at the security -- well, the police conditions. the security camera, i did update all of them. i have a total of 16, two on the exterior door, one at the back door, and one at the entrance coming in, so i kind of took care of that condition before this evening came up, because of course i want to make sure that all my stuff is up to date, too. and about the two security on friday-saturday, which i can work with, so i don't have any issue with the police department there, what they put on the conditions, yeah. >> okay. great.

me. meet with the director, told him kind of what's going on there. they're actually pretty excited, too, they said oh, we can probably have some of these elderly event for karaoke. the system that i have, it has japanese karaoke songs, because karaoke, it's more japanese elderly, so hopefully we'll have a chance to work with them. besides with me doing the a.b.c., sending out the letter, no, but i did some light outreach in the neighborhood, but i did speak to my neighbors next to me next door at the playground. they do the same thing. it's a karaoke sports bar. kind of restaurants in the area. 'cause i don't serve food. i said my concept is just basically a bar. hopefully, i can bring them

some businesses, when they come over to enjoy a night, yeah. >> so you're taking over this venue right from -- can you tell me, do you have any experience managing a karaoke bar before or place of entertainment? >> no, not on the entertainment side. i do have law and management manage san francisco toyota for year so hopefully, i can bring some of those sales skills over to this side. >> thank you. >> i think it's great that we're asking another karaoke addition in japantown. >> i hope so, too, because part of when people do come to japantown, the first thing they k oin is either the food or karaoke, so karaoke will be pretty much the thing they talk about in japantown. >> i hope you do some fundraisers for kimochi. >> we're actually in talks, so

i'm using co-one security. >> regetting the same clientele that they've been having? >> no. actually, i've been getting a lot more from the kabuki hotel, because they do have a karaoke, but they close at 9:00, so i've been getting a lot of out of town you customers. >> i'm -- out of town customers. >> i'm questioning -- because milo, we had a l-- they always maintained one guard in the front. >> we could pull back on that. that would save a lot of expense on my end, but if it's something, i just have to go with it. >> do you know the square footage of your venue off the top of your head?

the last page for this item. i actually received these verbally today from permit officer medina from mission station, and so i have shared these with the owner, and she just has issue with one of them, in regard to number four. they're, you know, limiting the days and hours of entertainment here on the front end, and they're doing that because of the fact that they have told me that they received several sound complaints from this particular area? and i think that they are concerned with receiving more due to live entertainment occurring at this premises, although the owner really only plans to have the entertainment occasionally. so she has said that she's okay with this, but providing prior notice would be very challenging when her business model is to do this on an

they've suffered enough, and they should have something from their culture because on sundays, mexicans celebrate, and they call it tadiada, which is they come and dance and have a few drinks and stuff, and i'd like to keep that in. i get upset when i think of all the displacement, and for me, being moved after 31 years, i didn't like it at first. i hated it. i was upset. me at 75 years old having to pick up and look for another place, but then, i've come to realize that i think it's a good thing. i think it will cleanup the area and the neighborhood, and i'm happy to be getting out of that corner because i have been a slave not only to the front of my business but to the half of the block which i have continuously painted, pressure

to be able to respond to our complaints for permanent establishments, you should let us know. she said oh, okay, and i also asked for a list of any current complaints, but i haven't received that? so i don't have the data for you all, and i know you love data. i don't know how to respond to that. i tried my best mediating with the police department. they actually started off, the captain wanted an outright denial of the entertainment permit in general because they feel as though residential -- there's so much more residential, and we need to protect the neighbors, and i said that's what the planning department is for -- okay. so you get the point. >> yeah, interesting. >> i think what they mean by that, the noise, because from 16th and allie, up towards valencia, that's where all the

kind of blanket condition in areas that they think they should or should not without any real hard data behind it. so not that ien b this, but i think that we have to take what they suggest here in the light of how they suggested it and the lack of data. we've seen manition situations where the police bring extensive data for what they're estiqu and verbally communicating the director the day of, and blanket requiring us to do things is not the way they should be doing business. it's not the best tng for us. i don't think we should hold this against the police department. one thing that comes to my mind, this is a long time business owner whoualifies as a legacy business owner in san francisco. female color owned businesses, it's exactly the type of businesses that are diing right now, that's been forced to move to a new space.

to me, entertainment that she's suggesting right now, it seems really important to her, but what if the business isn't working out the way for her that she intends in the new space. i would be apt to provide for flexibility in the area. even limitiono four days a month, she says she's only going to do four days a month, but wt's the harm if she wants to have a mariachi band on saturday, and maybe there's a new team that wants to come in on saturdays? to me, i don't know what's the harm on that if we're j ntertament to people seven days a week constantly. to me, if i were to entertain a motion in this, it would give more flexibility for sure, not to throw it in the police department's face, but for the reasons i just said so. >> yeah, and i think we haven't done a lot of edited of police

sustainability mission, even though the bikes are very minimal energy use. it still matters where the energy comes from and also part of the mission in sustainability is how we run everything, run our business. so having the lights come on with clean energy is important to us as well. we heard about cleanpowersf and learned they had commercial rates and signed up for that. it was super easy to sign up. our bookkeeper signed up online, it was like 15 minutes. nothing has changed, except now we have cleaner energy. it's an easy way to align your environmental proclivities and goals around climate change and it's so easy that it's hard to not want to do it, and it doesn't really add anything to the bill.
