realm plan. thank you very much. >> president hillis: thank you. >> thank you, neil. just also wanted to acknowledge the rest of our team, the urban designer at planning department, as well as kelley, karly, belinda, and david. commissioners, we were before you earlier this summer to initiate the general plan amendments to adopt by reference the central waterfront dogpatch public realm plan. since we were with you, we also presented to the port commission as well as the architectural review committee of the historic preservation commission. the latter did provide some comments, which has -- which has resulted in some minor amendments to the plan. their memo, as well as some attachments with the pages to the plan that we actually amended were just handed out to

project development agreement. we were last here on july 26 where you considered a whole slew of actions related to this project, including adoption of ceqa findings, planning code amendments, zoning map amendments, shadow findings, and lastly approval of the design standards and guidelines document. the last piece of this is the development agreement which as you know brings together all of the obligations of the project and of the city in carrying out this project, including everything from the housing obligations to the transportation obligations and a whole host of other transactional items. my colleague from the office of economic and workforce development will walk you through the highlights of the development agreement in just a moment. just to recap the project details, the project would

propose to build up to 1575 housing units, of which 25% would be affordable. slightly over 25,000 square feet of nonresidential. the big piece of this is a substantial open space program, over 14 acres of new, public or rehabilitated public open space. building heights, as you know, range from a couple stories up to about eight stories with just two buildings up to 16 stories, and a total, maximum site wide up to 1800 parking spaces, which up to 225 would be public. the development agreement is a massive document which you have in your files, and we'll go over the highlights. there will be a few minor technical edits that will need to be made following any approval to cleanup various minor generally inconsequently

details related to the phasing plan. so with that, i'll hand it over to hannah. >> good afternoon, commissioners. ann topia, project manager from oewd. i know you've heard my presentation on this a few times, so i'll try to be efficient. a quick reminder, this is one of the projects that the city identified in the southern bay front strategy, and as such, we use that guide work to guide the public benefits negotiations. it seeks to maximize the public benefits across the entire neighborhood in seven principle areas: housing, transit, jobs, open space, sea level rise, sustainability and project facilities. the affordable housing plan has

been designed to facilitate development of 25% of all market rate residential units built within the project site. this includes below market rate, inclusionary and in lieu fee units. developer will satisfy the 25% obligation through a combination of the following options. either by constructing at least 139 on-site inclusionary developments, for construction up of up -- of up to 180 b.m.r. units. i want to emphasize that this number caps the number of affordable units that may be built off-site. the remaining 319 below market rate units will all be built at this 700 innes project site, and 180 of those will likely be

in pardon nership with 100% affordable housing partners. mayor's office has committed to committing all inlieu fees for all housing projects in district 10. all of the affordable units are subject to the city's 40% local preference program to encourage community stability. on open space, the project proposes a mixed use development on the project site that will include a new publicly accessible site of new parkland and open space incorporated throughout the urban village. at full build out, it will include a total of 14 acres of publicly accessible parks, plaza, and pathways. 12 kaerz will be comprised of improvements to the six existing acres. this new five acre park will be

dedicated at no cost to rec park to become part of the city's southeast waterfront network of public parks. once completed, these open spaces will connect the nearly 1.5 mile continuous waterfront parks beginning at her on's head to the north and terminating at the southern waterfront park. the city has reserved the right to draw up to $750,000 from these c.f.t. dollars to use toward job training, in the areas of landscaping, sustainable infrastructure, and building and open space management at the site. like pier 70 and mission brock earlier this year will be required to create a community facilities district which establishes a site specific special tax. this will ensure the city captures these future dollars

to address shoreline stablization and protection of the areas beyond the borders of these projects. additional benefits for this project include approximately $10 million contribution to off-site contribution improvements. the sponsor will neighborhood neighborhood, transit and pedestrian improvements, including class one bicycle line through the project site, and in the hunters point shipyard and north lieu rec parks 900 innes, and eventually, connecting with existing bike lanes along hunters point boulevard. in lieu of paying the child care fee the project sponsor will deliver a 3,000 square foot warm shell to a certified bayview child care provider. the developer will establish annen doumt fund to be used for tenant improvements, rental subsidy or discounted rates for the first five years of occupancy on the site.

because of their diversity and their outreach, and their good intent, and i think their history of being area to the communities in which they built in. thank you. >> president hillis: thank you, miss perry. >> good afternoon. todd david on behalf of the san francisco housing action coalition. we spoke previously about this project, and just want to reiterate our strong support of it. you know, as the presentation showed, there's really kind of a lot of things to like about this project. the affordable housing, the community outreach, the opportunity to, you know, add -- opportunity to add a -- you know, a grocery market into a neighborhood that's really been looking a lot of ways that's been a food desert for a lot of years. i want to point out that the creative thinking around the affordable housing is something that i like and something that i see organizations, groups like build did interesting affordable housing around 1

oak, and i really hope that we as a city, like, really support kind of this out-of-the-box thinking. a lot of times we'll do that around affordable housing and say it doesn't check the box, and so it's confusing in that. so as our needs for -- continue to grow, i hope that we embrace creative solutions like this for it. and just one final thing, just as a reminder, i know that often, we ask how does community input affect projects. i just want to remind people that this project, a lot of it is -- the beginning is based on the india basin neighborhood association's plan to pull back development from the waterfront, and so that's something that is -- was embraced here and put into -- into action. so as i said, lots of things to really like about this. thanks.

>> president hillis: thank you. >> good afternoon, commissioners. my name is michael hammond. i'm a neighbor and a member of the neighborhood association. and soon after bill purchased the project, they came to us and started a collaboration that has lasted through the various iterations and resulted in what you have before you today. and some of the folks in the neighborhood are disappointed that the project is bigger and taller than originally imagined. however, most of the neighborhood and the neighborhood association embraced this project because we get so much of -- of what was included in our neighborhood vision document that we produced ten years ago. and key among these features is build's commitment to install abundant neighborhood serving

retail so that the folks who live there can have their daily needs met without getting into a car. i know i have to travel four miles to the nearest grocery store, and i can't wait to have that kind of walking neighborhood that is emblematic of san francisco. we support this project because of that and other things. with the unique setting of india basin and the huge amount of open space that they're creating, and the community facilities that they've agreed to build, this is going to be the kind of intimate walking neighborhood that san francisco's famous for. it's going to be another neighborhood. another star neighborhood. another star in that constelation of stars that we

4,065 square feet of replacement. as permitted, the project is seeking exceptions through the planning code, dwelling unit exposure for five units and grand floor active use. the department has received one comment from the public on -- from property owner in the adjacent live-work building at 249 shipley. they are expressing concerns about the loss of their property line windows that are along the shared property line. staff recommends approval of this conditional use authorization request as noted in the executive summary, the project is in general compliance with the applicable compliance of the planning code. on balance consistent with the objectives and policies of the general plan, the project is consistent with the respects of the varied neighborhood character and provides an appropriate massing and scale for the adjacent context. the project complies with the first source hiring program, it

will produce a new mixed use building with ground floor p.d.r., significant site updates, including landscaping and common open space. the project is consistent with and respects the existing neighborhood character and provides appropriate massing and scale for mid block sites. the project adds 24 new dwelling units to the city's housing stock, including five studios, three 1-bedroom, and 16-2 bedroom. and three units as part of the inclusionary affordable housing program, and it will fully utilize the eastern plan controls and for the development impact fees. this concludes staff presentation, i'm available to answer any questions. the project sponsor is also present and i believe has a presentation for you.

there we go. 255 shipley is a mid block site, two 25-foot lots on shipley and three on clara. a building is built on each lot, with slots of open circulation connecting them. these five buildings become a village-like ensemble with light in the slots. a shared rear yard is an open space at the center. on both shipley and clara, inside bays create balconies for the units while maintaining the flat street walls typically of selma alleyways and the facades of typical larger streets. at street level, porches and stairs connect the units.

the shared rear yard is bridged by a link that connects the buildings. on clara, a half sunken p.d.r. space of 4,365 square feet is provided, with parking occupying the remainder of the site. each floor of each of the five buildings is an independent detached dwelling. there are studios, one bedroom, two bedroom, and two bedroom plus den units. actually quite generous units, compared to a lot of the other things that we have been working on. shared rooftop space at the top. these are the section shows light wells and the bridge that spans across the center of the rear yard. and ok, you can see the elevation on clara and the elevation on shipley.

the image of the building is microchasm of the image of the city, and ongoing exploration for a language to build a contemporary san francisco. the design condenses the sweeping views of the wide city with streets wrap the hills like some encrusted mat or the boxes along hill sides. gives san francisco its mythical character. this is the kind of breakdown of the project, 24 units in total, five studios, three one-bedroom, five two-bedroom, and 11 two-bedroom and den. and five parking space, 28 bicycle parking spaces. so, that's the project and i

restaurant and bar within the mixed use office zoning district. the proposed project includes new construction of a 14th story with a seven story podium, 130 foot tall tourist hotel building, 2,975 square feet. 297 guest rooms, 11 class one bicycle parking spaces and 15 class two bicycle parking spaces. also, measuring approximately 2,350 square feet. the 350 second street project would also understand streetscape improvements, sidewalk extensions, introducing a new sidewalk along dow place and installation of new street, trees and landscaping. some brief points of clarification, mark loper is the authorized agent, k.c.g. hotel

is the project sponsor for the c.u.a. and the l.p.a., and some minor inconsistencies regarding the bicycle parking counts but 11 class 1 and 15 class two. 303 and 842.49, the project requires the c.u.a. from the planning commission to establish a tourist hotel within the m.u.o. zoning district. additional findings and market demand analysis for new tourist hotels are required by 303g, and the aforementioned have been included in your packets. since the project would construct more than 25,000 square feet in mixed use district, it does require an l.p.a. however, it is not seeking any exceptions under the l.p.a. to date, the department has received numerous public comments about the project. all of which have expressed support for the proposed hotel.

within the packet are letters of support from several unions, including local 2, 38, 104, and 483. and since the publication of the planning commission packet, four additional letters of support were submitted and including support from the hawthorne place h.o.a. at 77 dow place, blue h.o.a. at 631fulsom street, and good jobs for all collaborative, latter of which is a coalition of local community groups, jobs with justice, community together, and south of market community action network. all correspondence in writing forwarded to the commission secretary and printed copies have been provided. the department recommends approval as the project is on balance, consistent with the general plan and the planning

before the architect starts, a quick word about the sponsor. based out of the washington d.c. area, and collectively the development group has about 150 years of real estate experience. and completed over 20 hotels in various cities throughout the u.s. some of the recent projects including a hampton inn near the d.c. convention center, a hyatt place hotel in baltimore, and homewood suites in the river front area of d.c. this is the team's first project in san francisco. with that, mark shaletman from som. >> good afternoon, commissioners. thank you for the opportunity to present this project. out of respect of your calendar, brief. the serial diagram, 352nd street, dow place to the north, second street to the east. in the east soma neighborhood,

shown in the blue outline. directly to the east, marathon plaza, an office building. to the south, a smaller office building. to the north is an at&t switching facility, and then the buildings to the west are residential with blue to the north and 77 dow to the west. the site is currently a parking lot. it is fenced on all sides with curb cuts from second street. a view looking west on dow place, and looking back out towards the city and then from second street towards the site, the site shown in yellow. the proposed massing of the project is completely compliant with the eastern neighborhood guidelines, features a slender 60 foot wide tower on second street and horizontal podium along the west to the site. diagram shows the podium has been significantly set back and shaped to comply with the 45°

sky plane requirement. and the vehicular circulation and loading to the far west end of the site, eliminating the curb cut, and handling trash loading and other service in the building. so one of the happy results of the hard work we did with the neighbors to ensure the bl was respectful of their residential neighborhood. second floor plan, guest rooms and amenity space. typical podium level, upper podium showing the setback, and the terraces on the north. the tower is the maximum allowable diagonal. very efficient tower. and we think that the architecture of the building is very appropriate to the site. it is understated about but elegant. we think it is strong and simple. it features finally grained masonry windows in a neutral gray precast concrete, with

subtle shaping and sculpting of the window frames. this view from second street shows the simple mass of the tower. and we have paid particular attention to the ground plane. as staff mentioned along dow place, a sidewalk where one does not currently exist. we have gone to great pains to shape the building and utilities to allow the planting of street trees along the narrow frontage. set back by various amounts to allow for that. similarly along second street you see the widening that's part of the second street plan. and then the hotel lobby is highly transparent, but screened by green to mitigate somewhat u -- we have screened the portico share. and the usable open space which fronts second street. we have placed this space between the hotel lobby and

giving people in the neighborhoods and people who need extra help in terms of taking access to our jobs, access to that. they have given us, they'll give us some money for work force development and then some procedures on how to get some of these people, if qualified, to get the jobs. so, we are very excited about this. we really strongly endorse the project. you have seen our letter i think in your packet. i want to also mention that this is not in central soma, but talking about it with you for a while, and as the plan moves forward and going into the city we are still, great enough to include language about good jobs in central soma, now working on an m.o.u. to solidify it even stronger, with jane kim's office. excited about that, always thinking with the great disparity of jobs and people and wealth in this city we are really trying to give those with not so many advantages access to

not only good jobs for the construction of the hotel and once the hotel is built, but pathways to allow people access to those good jobs who have traditionally faced barriers to getting access. and it's a life changing thing to get a union job, especially if it's new, so underscore the project sponsor has made this commitment. and i also want to mention that you know, we work on projects all around the city. one of the things that hotel employees really do want to do when they have the ability is they want to be able to leave their cars behind, they would like to be able to use public transit, and when projects are situated in an area like this, they at least have the ability to do so when their ships allow them to. so, it's another example what we hope will set the standard for hotel developments across the city. thank you. >> president hillis: thank you. next speaker, please. >> good afternoon, commissioners.

i'm the president of the homeowners -- also the developer since 2002. i work with the developers, i brought slides. i don't think i need to get into it, just knowing that it will take a lot of time and late in the day. two main issues, use the bulk for 21-story project to 14-story tower, and gave us a lot of light and air back from their initial proposal. also we had a serious trash issue, trash on dow place. dow place essentially in front of us and their trash room, recycling room is under the podium. essentially just next door to us. so, they worked with us quite a bit, as late as a month ago.

mark shaletman from s.o.m. architecture, very professional group, they worked with us. we met with the developer ten times over trash, over the bulk, over sound issues. i, worked with two planners, they both cooperated and waited for us, answered all our questions. we put all this, and we got a few concessions such as a green wall, facing our project. a living wall. which they'll maintain. so a lot of issues, from the sound, and we are happy to support the project and we got all this into a memo of understanding which is signed and to be recorded on the land. so we are happy with the outcome, so we are grateful for the process and also i'm thankful to the developer. they are who they say they are, and they did what they said they were going to do. so, thank you.

existing one story industrial building and construct 60 dwelling units, 25-two bedroom and -- and approximately 4800 square feet of common open space on the roof and on a courtyard deck. and then 24 off street vehicle parking spaces in a below grade garage, along with 84 class 1 and 13 class two bicycle passing. required 17.5% as affordable, 11 units, and additional unit at 150% a.m.i. this project has been continued a few times. the last time it was discussed in front of the commission was in january of this year.

it was continued to allow the sponsor to finalize commitment with the spon or and the package. since the january hearing, some change, including foremost the proposal of 10,000 square feet of p.d.r. on the ground floor instead of the retail and restaurant space. additionally, the project sponsor entered into an agreement with the current tenant, fitzgerald furniture, to occupy that ground floor after construction. as a result of this change, the project no longer requires the modification to transparency as street frontage, previously requested. however, as part of nine large project authorization, accept exceptions from rear yard, planning code 134 and dwelling unit exposure, code 140. compliance with the criteria for the modifications is described

in the draft section 321 motion in your packet. staff believes these requested modifications are warranted due to the overall quality of the design and the surrounding context and the massing for corner parcel. over the course of the hearing, the department has received significant opposition to the project. the concerns centered on gentrification and displacement in the mission, level of on-site affordable housing, the loss of existing p.d.r. space and business, hiring union labor, and the amount of on-site parking. additionally, there were neighborhood residents concerned that the height and density of the project were out of scale with the neighborhood. the department also received letters in support of the project and these centered on the creation of new housing and the proposed benefits package. since the january 25th hearing, the sponsor has continued discussions with united states

mission and other community groups and hosted two meetings between the project sponsor and representatives of u.s.m. in summary, the department finds the project on balance to meet the goals and objectives of the general plan mission area plan and the intent of the urban mixed use district, to create a mixed use neighborhood, maintain the characteristics of a formerly industrial area. the project will add new housing units to the city's housing stock and replacement p.d.r. space. noting the exceptions requested, the project is otherwise in compliance with the code. this concludes staff report. >> president hillis: project sponsor. >> i'm with the project sponsor, thank you for the opportunity to present updates on our proposed project. we have worked to make significant changes to the project since the last hearing,
