director, she was very first about not having any music until the -- the whole process completed itself, and then, if it was approved. what was great about that meeting is the executive director provided some guidance by saying why don't you just apply for one-day permits, so he applied for various one-day permits as he went along. that put him on solid ground leading up to today. in the course of this whole process, he was pleased to get the support of the greater geary merchants and associated businesses. also, the people that live in that area also expressed to us that there was a need not only to have food because it is a large space, but the nice thing about it is wesley had experience in the restaurant industry. he also had a very good

an area where we're seeing a lot of limited live performance permits coming up, which is exciting. the only reason this is on regular agenda is again, because of one complaint that we received at the end of last week as a part of the extensive neighborhood outreach that the owners were doing in the area. a nearby resident reached out, saying that they, you know, took issue with sound coming from patrons exiting the venue, and to the owners immediately addressed that complaint with the complainants and are working with them, but again, since there is a complaint, i wanted to put it on regular and let them speak to that. so without further adieu, i'm going to bring up the two owners. and this is josephine and

kevin. >> hello, commissioners. how are you? we're from rock bar. we are on the corner of tiffany and -- is that -- okay. we're from rock bar. don't let the name fool you. it's named after all the rocks that are on the outside of the building. someone swept in in the 70's and conned everybody into the thinking you'll never have to paint your building with all these fake rocks. when we took over six years ago from the woman who had had it for the last 30, we thought about getting rid of the rocks, but it was cost prohibitive. so we owned it, and we're more geo -- geology than we are super rock and roll. we're a neighborhood bar whose purpose is to give the neighborhood a fun, safe, and delicious place to belly-up and cool their heels.

we've been on this corner for six years, like i was saying, but there has been a bar on that corner for 116 years, since 1902 when frank p.caulfield ran a tavern up there, and i've heard it was quite wild back in the day. while we can't guarantee that no noise will occur, when we did get that complaint, you know, to be honest, it -- we took it to heart. we're here for the neighborhood. i live in the neighborhood. josie lived in the neighborhood until quite recently. we run the front porch across the street, and we're here for the neighborhood, and so we immediately reached out and are trying to -- trying to make it better in the neighborhood. yeah. i live in the city, on the second floor. and even when -- even when the korean restaurant next door

closes at 11:00, i hear the conversations out there, so i know what this woman's talking about, and we're trying to -- to make it better. we've placed signs up, and we've trained our staff more on limiting those noises. the good thing about it is we probably know those people who are talking outside, and if we talk to them, they will most likely stop that activity, have a good time inside, be quiet outside. we did a really nice youch reach to -- there was -- eventually timed was a tiffany ave. block party. it was the second time, and we donated fried chicken from the restaurant, and i got the chance to handout letters and to interface with a lot of our neighbors. and then, we held a happy hour,

so if people ahad any further questions, they could come in and talk to us. i was really humbled about the amount of people that wrote in to support us. people say can we use your space as a -- to raise funds for this chavalos, or the movement, and we say of course. they're our friends, and it's the right thing to do, and it's a fun party. but when you see it fun paper coming back at you, it was really gradua real really gratifying, and that was why i moved back here 20 years ago. we are fun, but we're a cause-based fun. we're really only hoping to do more of these d.j.'s until 10:00 unless -- well, i w -- te

so who's responsible for managing the sound levels? >> good question. we bought a decibel meter, which they're really cool, but we are going to kind of ask for guidance on what those outside decibel levels need to be, and that will be the main way that we go about it. i personally have, from my own rock and role days, a little crate 30-watt amp that will just be a house -- a house amplifier. we have -- i have the -- the specs on the powered speakers that we have, if you're interested. we have two 8-inch powered speakers and one 10-inch powered speaker, so it's not -- we're not trying to blow the house down, but we do want it to sound good, so -- >> you'll be able to do some kind of a sound test or sound

check and then do the meter -- yes. >> -- and then determine what's the appropriate level and then communicate that to the performing artist? >> yes. and in the case of d.j.'s, we'll be able to just go over and push the knob down on that. >> all right. thank you. >> so you -- your fried chicken is the bomb, i have to say. >> thank you. >> and i really appreciate that you guys attended a block party and distributed food and gave everybody your letters of intent. i did have a question about the happy hour? how was the attendance about that and was there any anecdotal feedback in terms of support? >> hi. i'm josephine white. i personally did a lot of outreach where i went and talked to every business and talked to maybe 20 neighbors in the neighborhood. the happy hour wasn't as fulfilled as we expected, but you know, a couple people came

opportunity, you know. >> yeah, that's great. you actually answered my question next which was what additional sound mitigation have you done, so that's wonderful. i'm also asking -- so you're asking for a limited live performance permit. is there a reason you're not going for a full permit? you're open until 2:00 in the morning? >> we are. two thirds of our business happens until 11:00. we're a neighborhood bar, and we're sensitive to our neighbors. it would be nice to be able to do that. it's -- the permit is cost prohibitive to us right now. perhaps if this goes well and some neighborhood goodwill is reached, we might think about expanding our services, but it's a residential -- it's a residential area. people are stacked on top of us and right across from us.

and we do want to be sensitive to that, not just for rock bar but because we are owners of front porch, as well. it's in our business, it tends to be sensitive to that, also, because we're neighbors, and you know, we have coparents at fairmont elementary school are across the street, and i see them every morning, too. if it's too loud, i wouldn't want to face them in the morning. >> okay. great. thank you so much. >> real quick. so i -- it's a small bar. it's the two of you running operations most of the time, so there's no doorman or anybody to control the -- you know, like, if people are talking a little loud. >> no, we do have a doorman. he's there thursday to sunday, through business. josie and i are either at the rock bar or at the front porch. we also have a general manager

mission bernal association? i live on tiffany where the rock bar is? and i'm on the ground floor, and i barely hear voices coming down the street. walking home, i'm always greeted by the doorman if i'm walking in my neighborhood? i noticed the signs recently educating you to be quiet? in our neighborhood in the last four years, we've had a five-alarm fire, we have had m.t.a. come in with the red lanes, we've had construction, and i've been open 11 years. we had, like, nine years of construction. a lot of the construction have happened around rock bar and front porch? they were majorly impacted by the fire? so i feel like getting a limited live entertainment permit, they are able to kind of explore different ways to

entire space, which would include both indoor and outdoor, and so at the back of your packet, you'll also see conditions of approval from the planning department as well as the police department, and i want to just bring up michelle n naughton to speak more about what he's proposing to do with the business and also speak to what we see in the back in terms of the approvals from planning and the police department. >> good evening, commissioners, good evening, executive director and other members of the commission. very excited to be here tonight, of course. i wanted to give you a little bit more detail about virgin hotel san francisco and what we're going to bring to the neighborhood and to the city.

so our any objectipplication i place of entertainment permit. [inaudible] >> -- which is on the 12th floor, overlooking the great city of san francisco. it's got some great views, and i'm very excited to get that place open. these locations, the hours of operation for every area differ. the club starts with breakfast, lunch, and dinner, ranging from 6:30 in the morning until about 1:30 at night, mainly as a restaurant but there's also a bar component to it. the mezzanine, it's mostly an indoor mixed use space, but there's also a location where we can have some entertainment

in the various different forms, from house music to d.j. bands, but also to standup comedians or poetry shows or whatever art we can program that location to. the rooftop lounge is an indoor and outdoor bar. the hours of operations are listed there. it's mainly going to be there from, say, 11:00 a.m., noon, until 1:30 in the morning. the indoor space can be completely enclosed, but it can also be opened, so you can truly enjoy the view of the city from every location in the restaurant or in the rooftop. the music that is playing up there, again, it's house music. potentially, at times, it will be activated with d.j.'s, bands, artists, but at the same time, very aware of the neighborhood that we're in. that will bring me to the -- to the next step, which is the

neighborhood outreach that we've done. 250 for development has previously met in various locations with various groups, and we've stayed in touch with these organizations from the planning phase of the hotel to where we are today. we have -- you can find in the packet, as well, the various letters of support. i've met, over the last couple of weeks, with the yerba buena community benefit district, met with both the executive committee as well as with the board -- all the board of directors, presented there the

plans of the hotel, the activations. the plan of the venues. the same with the yerba buena alliance. this meeting was actually held at the children's creativity museum across the street from the hotel. i believe there was a good outcome of attendees, about 25 between businesses, neighbors where i was able to share information about the property, provide my contact info, both e-mail and cell phone to make sure they can contact me in the future, of course, for every question they might have -- might have. at the same time, very excited, as well, to look at potential partnerships in the neighborhood and within the community. and go here to the next page. we also have the letters of support attached. we met with the police department, did a follow -- a good walk-through with them and explaining exactly what we're

going to do, making sure that they are aware and continuing that outreach once we open the hotel, and making sure that we're within the community, that we're present, that i'm there, that there's a face to the hotel that can answer any questions or remedy any of the concerns that might arise. as the executive director mentioned, the planning commission has been, of course, involved with the development of the hotel as well as with the place of entertainment permit. we are aware of the conditions set forth by them. of course, we want to be the good neighborhood and comply with those conditions. so if you have any questions regarding that, i'm here to answer any of those -- those questions you might have. >> i have a question. is this permit also for the rooftop bar?

>> yes. >> so -- and it's open -- open air? it's an open-air rooftop bar? >> it's a combination. it's a combination indoor space, outdoor space that can also be enclosed. >> this outdoor sound permit -- >> so it's a place of entertainment permit that will be both indoor and outdoor. >> indoor and outdoor. >> just like we saw with the warriors, just place of entertainment, as well. >> okay. can you tell me about your security? >> yes, sir. >> are you -- i mean, are they an all in-house team for your security or -- i mean, i'm -- how many rooms is this? >> it's 194 rooms. >> 194 rooms. >> right, but we will have our own security department. >> can you explain to me, like, how many, you know, a little

planning for the acoustics in that environment is making sure that the speakers are mounted in a specific direction. currently they're all placed at knee height or lower to make sure -- >> well, you're going to have to do a sound check for us any way, so how your engineers plan it to pass. i'm more concerned about the security part, okay? >> okay. >> places like the w, they have d.j.'s, they have security in the lobby. places like barbarossa, they have security for free. they're all lounges. i just want to know, are you running a similar situation? you have security in the lobby? >> we will have security 24-7-365. we will have security center in the hotel where we monitor all the premises, answer phones if needed, but we will have officers on the premises,

including guest quarters and exterior surroundings in the hotel. most of the time, but we might have to contract with some additional contracts outside officers or off duty police officers to come in and assist. those will be positioned mainly at the entrance points and exit points at where the location is happening, and at the front of the hotel to manage what's happening at the outside of the hotel but also what's happening on the exterior side of the hotel. >> okay. >> hi. i have a few questions. the first is about your programming. it sounds like most of the entertainment is in the background, so there's -- it's not like you're going to have a headlining d.j. where tickets will be sold and people can

attend an event like that. is that correct? >> correct. i would say so. there might be times where there might be a headlining d.j. or, like, an end d.j. coming to the hotel, but it doesn't mean it's a full-on show that you could see, for example, at the golden state warriors, in a smaller. >> even on the mezzanine level, which sounds like a smaller -- >> yeah. and that's mostly an indoor space where we would want to plain a d.j. >> okay. another -- plan a d.j. >> okay. another question. i know there's a lot of senior housing in the area. what has been your sort of interface with the immediate neighbors and just the residents because they're not accustomed to versus a rooftop bar? >> 250 development has been in touch with the various organizations, neighborhood organizations around the property. this is something that i'm definitely going to take over as the general manager of the

hotel. besides that being frequently visible at this type of events, voicing any concerns and also making sure that we as a property team and management team, that we adjust the operation as such. like, our intent is never to cause any nuisance of our neighbors. i think i do have to refer to our virgin hotel in chicago, where we also have a rooftop, where we also have entertainment activations. we've actually never received any noise complaints, any citations or any such, and we want to continue that -- that trend, for sure. >> and specifically about your rooftop, how are you abating noise other than just the positioning of the speakers? do you have some sort of screens or walls? i know for some of the rooftop spaces, there's glass walls trying to enclose it a little bit more. is that how it's going to be,

also? >> yeah. there's glass walls, and there's glass blocks in front of the rooftop areas that's activated, and then, the amount of speakers that are placed in those areas. there's going to be a lot of testing involved, so i would work with -- i would work together with these organizations, probably go and be there while we turn on the music and start feeling what is the noise level that we should be at. >> great. one more question for you, and one for staff. when are you planning to open? >> midto late november is currently the time. >> okay. so actually not too far from now. >> okay. look forward to that. and then, just a question to staff. because they're looking for sort of a wholesale permit for the entire building, are -- i mean, i think the answer's

present to you on why they would like you to consider a potential change in their permit conditions. specifically, the purpose of this hearing is for you to consider revising the conditions listed on their permit as hours of entertainment are limited currently until 12:00 a.m. sundays through thursdays and 1:00 a.m. on fridays and saturdays. and so in your packet, as well, you will see a letter from mr. bloom, who is the attorney for permit holder bennett montoya, who's here this evening, as well as documents from central station permit officer steve matthias. he has included two cad reports here and one arrest report from may 27th, 2018, which was just after we heard hue the last time. i also sent you video clips from

that evening, just to let everyone know i have provided all of this documentation and information to the permit holder, as well. we also did receive one letter from a neighbor nearby from the diamonds that you'll see in your packet, as well as one complaint from the same complainant from within that time period since we last heard hue here at the commission. and finally, i did receive a letter that i passed out to all of you about a half hour ago from supervisor peskin's office, so that should be taken as part of the file, and i did just provide that to the permit holder, as well. we should note that they weren't a party to this agenda item. i did ask both the police department and the permit holder to provide any comments on this

item at least a week in advance, which they both did do. and without further adieu, mr. bloom and bennett montoya. >> thank you. good evening, i am robert bloom. hello again, nice to see you. i have a few things to say. what's this about? what's going on here? 15 months there have been a limitation, a devastating limitation on this man's business for no reason. he has done everything he's supposed to do. he's done it right. he's done what he can do. it has devastated his business, and there is no reason to continue this. i'd like to know why it should be continued. and i want to say what i think it's about. he opened this business during business's atmosphere ten years ago in 2008. it's in the central station of the san francisco police department. the same station, by the way, that former commissioner frost's

son has a high-up position. something that should have been an issue, something that should have been disclosed 15 months ago, but it was not, so let's leave that for another moment. since 2008 to 2014 there were four, count them four separate captains from that precinct, from that station. not a problem with any of them. he, mr. montoya, got along with all of them. there were no warnings, no complaints, nothing, until captain comes along, and captain lazar said on more than one occasion to bennett and the presence of one other person, your hip hop music that you bring here, it is bringing in the wrong crowd, a crowd we don't want. that's called racism. that's racism in san francisco.

that's what this is about. captain lazar is a racist person, who did racist things. and one of his underlings is here, and he implemented certain racist aspects of what happened here and the punishment that has been forced upon my client, all my clients. that's what's happened here. and you know how we know that? not just because i say it, but a few weeks ago, the avc appeals board made a finding and expressed opinion well detailed, well documented, that hue and mr. montoya were selective prosecution, selective enforcement. that's the finding, that is the only finding so far in this case. now it is pending, as you know,

a federal civil rights action, 1983 action, that we filed before district court judge dinardo. he has been considering the city's motion to dismiss, and he has not decided yet. there are three defendants in this case. the city of san francisco, captain lazar, who's now been promoted to commander, and officer matthias. those are the three defendants, and there has been, as i say, i repeat, there's been a finding of selective enforcement against this club, against my clients, for the reason stated as expressed by lazar. wrong crowd, a crowd we don't want. basically, niggers, that's what this is about.

this is the 21st century. a real decent, wonderful city of san francisco, and captain lazar and the police department want to stop black people from coming to the 400 block of broadway. that is what this is about. face it. you may not like it. nobody likes it. i don't like it. mr. montoya doesn't like it, but that is what this is about. now, the mechanisms used by captain lazar was he stationed a manned police car in front of or across the street from this club. two-fold purpose, one, is to intimidate black people, because as you are aware, there's been a history, including a recent

history, of san francisco police department acting in a racist manner against african-american people. that has happened. you may recall there are two, let's call them, texting incidents, where hilariously, and i say that in quotes, san francisco police officers texted racist messages to each other. that happened. that was whitewashed by the city of san francisco, swept under the rug. well, fortunately, the united states department of justice had a report more than a year ago where they found extreme racism on the part of the san francisco police department consistent with what has happened here. that's what this is about, and you'll have punished by your order 15 months ago, you have punished mr. montoya and the club and everybody associated with the club.

and it's been done based on particular false documents. the second reason the police car, manned police car, was located by captain lazar was utilized in the efficacy -- sorry, the actions of the defendant in the federal case, matthias. he submitted some 52 reports to you and to the abc. the abc appeals board eventually after evidentiary hearings before an administrative law judge found that only four and a half of 52 complaints against this club could be validated. that's 92% not valid, 8% valid. and that was a part of a decision of the abc appeals board, that what was submitted

by mr. matthias to you, for your consideration, that you considered or were available for your consideration in june 15 months ago, that was before you. that's what happened here. and as a result of that, and other things that i'm going to talk about, you decided to basically devastate the business of mr. montoya and his club. that's what you did. and if it can be argued that at the time you didn't know those 52 reports, 92% of which were false and invalid, if you did not know then, you know now that those are fake reports, false, fraudulent, fake, phony, dishonest. moving on to another subject. weiland has indicated that mr. and mrs. diamond have a complaint about noise.
