there is a couple of issues that i have. i am kind of neutral, but i would like to have a possible continuance. first is -- overhead. first is, half a block away, there was a murder, and i think the suspect is still at large, and this shows that -- this happens between the hours of 2:00 a.m. and 3:00 a.m., and it was a popular person that got shot on larkin street. also, i am a paid member of the lower pole can neighbors, and this has never been on their agenda, after hours is a big issue, and this is in your pocket. it shows this month's agenda,

also, points of consideration, is sergeant mcauley's park, which is a block away, and that is a todd park, and a lot of things kind of happened about that. also, in front of the park is a pit stop, but it could be called a lot of things, and people hang out there because of that. also, there was a bus zone which is alongside the restaurant which will cause people to hang out there, and my main question is, where will the restaurant -- will be restaurant be allowed to have the alcohol go out the door clap i don't know -- go out the door?

i would suggest having this business open for an additional hour could actually put people in a better environment, versus having a dark street that seen active, and those few walking along it are vulnerable to predators. with my comments been concluded, i would make a motion for approval with the staff recommendation. i believe and just a good neighbor policy. >> second. >> it has been continued to. final permit tonight. >> onto the next. of all final permit applications are for a place of entertainment and mechanical amusement device permit for 3910 a lounge in the enrichment. this application would can -- was continued from our last commission hearing on february 5th, 2019. the commission voted to continue this item to tonight's hearings of the applicants could revise their security plan pick previously we heard from officer bryant from richmond station on the concerns about the safety issues that have occurred at and around the premises, however, the officers did wish to permit the application with added conditions. since the last hearing, they submitted a revised security plan that was revised by the station and entertainment commission staff. they provided feedback to the applicant in ways to strengthen the security plan, and ensure it coincided with the p.d. recommendation's discussed at the last hearing. all parties involved with the

[laughter]. >> i don't speak for everybody, but just for myself, i would like to hear what has been done since the last time you were here until now, and then i would love to have the police come up, and asked their opinion as well and we can vote. >> i will try to make it brief. commissioners, again, i am here with henrik -- henry chang who is the owner of -- he is now actually purchasing from his father avenue called 3910 lounge on gary boulevard. as we talked about it the last time, this is a very problematic block.

if i could just get the overhead, just to refresh your recollection. we are only number 3 in a problem incidence on that one block. there is a four hour burger king , a couple doors down, there is ireland's 32 which is basically right in front of my client's door in the same building, and we understand, and we really look to this with every new security plan. we actually made a couple versions. i would like to thank kaitlin for helping with that. a lot of comments, a lot of changes, i think we've got it right. despite all that, i had one table on page 4. you should read that we will cultivate improved relationships with richmond police station and request their help in disbursing crowds, when it is necessary. we understand the police aren't there to move crowds along.

our security staff will do it when it gets to be too crazy, or it creates a life safety issue, then we will call richmond station. i would like to bring this up. this kind of bothered me. i've heard, mostly from the fire department, he doesn't have any permits, he doesn't have any permits. so i did some permit history and went through henry's stuff, and in february of last year, 2018, it was issued. this was to fix and n.o.v. from 2017, and construct two new storage premises, or two storage rooms. that went right into a revision plan which is at this permit

ending in 3,220, and if you can see this, this one specifically was to provide -- to revise that other permit i just showed you. to provide new hallway for second exit, and revised upward to the occupant load. there are two doors, two fire doors. this is a fire core door coming into the premise. the front door comes in here, this is a bar area, this is a fire core door with two double doors going out. the scope of work again, this will be 157 occupants. the scope of work is to provide a new second exit hallway. that particular plan, we are waiting for the roof to get

fixed to put in the sheetrock, but this one really got to me. and other permit, this was to add a fire suppression system, very sophisticated, i don't know if you can see that. but that is waiting for the sheetrock with its -- so they can finish the electrical. these are very expensive systems. this is the fire exit door, the second doorway, and this is looking down the long fire corridor towards that same door, again, waiting for the roof to be fixed so they can put in the sheetrock. but, if you notice, this is what got to me. this is for the sprinkling system and the fire suppression system. you'll notice that the sprinklers were signed on the

security plan, we have talked about it a little bit, i did one change on it. he does have good security. this company is now expanding into nevada and southern california. they have 300 employees, and you'll notice it costs a lot of money every night for security. outreach, january 9th we held a community meeting. we posted a flyer around the neighborhood. it was also slips under the doors of everybody in the neighborhood. ten people showed up. and we provided a great buffet for the folks. he also canvassed out to his commercial neighbors to discuss his new business model, specifically going from dance club to karaoke lounge. and on that block, or nearby, are two large toyota -- one is the toyota dealership, and the other services. he talked to tony wong over at toyota service and sabrina who

runs the toyota sales. bear with me. we understand that this is a very problematic block. my client is well aware now that this has been a problem -- been problematic since karma lounge about five years ago. it has been a very problematic venue. we got to talk to the sergeant for about ten minutes outside, and talk about fire safety, when you call the police, certain things, and he will speak to whatever, but one thing i said to my client is, look, you are in the whole, you have four or five years worth of bad actions, and that's why people seem to be coming down hard on you right now, but you will get beyond that. number 1, you need a safe place,

number 2, given the block, you have to have really good security. and i do think they have really good security. if you have any questions for my client, otherwise i would request a tentative grant. >> i just want to clarify. on the fire department, that's not really a fire suppression, it is a fire evacuation system. it is usually connected to the pole station of the sprinkler. so -- >> i didn't want to go too into it -- >> don't be so upset, because a fire department works two hands. the building inspection fire guy checks off certain things, and the public assembly fire guy, i think they are trying to blended together now, but it's almost double inspection, double the fees, but the guy from assembly

thinks differently then the guy from building, so i think right now i heard that the fire department is trying to speed things up, and try to combine these services together, but when you apply for public assembly, the fire marshal is different, and that's why it maybe the fire marshal is giving you grief, or the building guy signed you off. there maybe confusion there, so i just want to clarify that. >> i get it, but i have had a million inspections. i can tell you, i will represent this is a pretty safe space. it does have an active sprinkling system, it will have a central monitoring, you saw the box, there are two big exits, and the exit may not have sheetrock on it, but this fire exit does have the proper illumination, and when they are open, he keeps it clear. this fire corridor is about 30 or 40 feet going into the end of the place, and it is sort of

safe now. we were told that we couldn't open period. my client is living with that because we are getting our sign off soon, and we want to make everybody happy. >> first of all, i wanted to say thank you for taking all the concerns that were raised seriously. i appreciate that you are trying to keep this business going, and that you are trying to work with the police, work with us, so i really want to say thank you. thank you for redoing the security plan and trying to continue to provide entertainment, and look out for the health and well-being for the folks that are there. i still feel slightly uneasy about this, but i am prepared to support it, largely because i

appreciate all the work that has gone into this, and that you are able to have the sfpd review the security plan, after working with them, and hopefully this will lead to better partnership, and keeping the whole block safe i realize the block is not your responsibility. your business is your responsibility, but that is part of what being in community means thank you. >> thank you for coming again. in light of the problematic history of this particular then you're in the past, i was wondering if you had considered creating an incident logbook so you can keep track of the incidents in the future so you can look back and see what is the pattern, what are the issues going on, if things are recurring again and again then you can come up with a strategy for the issue. if it is coming back over and over again, versus just

the specific section, it requires one per 100. what that means if there is three people in their 8:00, you will have two -- >> i think my client has two security guards. i have looked at his records. >> but it starts at 9:00 p.m. >> right, okay. >> monthly calendar number 2 of the proposed conditions is fine. entertainment will end by one pete -- 1:00 a.m. we asked that that be extended by 130 a.m. just on the weekend. number 4 about the security cameras, this is good for my client, good for liability issues, and good for everybody. >> okay.

that is it. that is all i have. >> i just have some general thoughts. >> one quick question. before these doors to the karaoke rooms, they have windows, correct? >> yes. >> i just wanted to make sure. >> it did seem to me, from the our last meeting that maybe you had some reservations of working with the entertainment commissioner a police and fire as partnership, and maybe felt that the recommendations they were making were recommendations, not report -- not requirements. i just hope that the process that you've gone through here has changed your mind on that, and that you are seeing that having a sergeant, and having a station that would recommend you forward for approval, even given some egregious things that appear to happen, whether they

allegedly happened to, i thank you have partners here, your partners with the police, and you have partners with the entertainment commission. i would encourage you to work to consider us your best friends here. we are trying to help you, and we need you to work alongside us, rather then against us. and that means if we ask you to do something, with the police ask you to do something, that maybe your first reaction can be to do it, and then also, that if there are issues that you are having that you can't handle, we don't know the answer to, you can use this as a resource as well. public safety is our concern. there are sprinklers, their -- maybe the fire situation is a little less terrifying than it was made out to be, but in general. the other thing that i say is having a 24-hour burger king might be a scorch on that neighborhood, but it also could be a huge positive for your business.

it is busy, there's another bar there. what we found, in areas like this that can be problematic, is there are benefits to that, but at the end of the day, you are choosing to do business there, and that means you have to operate at a higher level then somebody does doesn't operate in a neighborhood that is problematic. i found that in my own business is over and over again. you want to be on a busy block, in the mid to outer richmond, then that comes along with that. it is a responsibility you have. what we would love to see is you working together with ireland 32, with burger king, with the police, with us, to make the area safer, make the area later. if you do that, you can turn this whole area around and you will be successful as well. those are just my thoughts. you can have a seat unless there is any other considerations. >> yes, you can have a seat. >> his or any public comment on this agenda item? public comment is closed.

we will entertain emotions. >> can i suggest some conditions >> in a couple of these -- some of these are unique and they are being sensitive to our first experience with this operator. let me read them, and maybe we can explain. the first condition i would like to propose is the permittee acknowledges that at all times a premise is open to the public, that the permittee is solely responsible for the operation and conduct of the business. number 2, at any time, excuse me. at no time shall the permittee allow a third party for mote -- promoter of any control over the marketing, management, operations, staffing of this business. number 3, at all times, the premise is open to the public, and manager -- excuse me, a readily identifiable manager it should be site. can you quickly speak to the first two while technically under the letter of the law, we know that you are responsible for your business, for some of

the earlier comments by this applicant -- on the rarest of occasion, we can and should add a condition when it highlights an area of concern that might be a more in their face reminder of these concerns that we have. that is why i am proposing the first two. just reinforcing the fact that this is his business, he is the responsible party, you can finger point about private events in them being passed off to somebody category brought in the promoter and they did their promoting, i didn't know this would happen. these are all things i've experienced in the past with similar operators. the only other comments i have is i would like to proposed also a condition on lighting. it would read, the exterior premise should be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of all persons on or about the premises efficiently. lighting shall not disturb the

normal privacy, and use of any neighboring residents. i bring that up because this is an area -- in particular that is very busy, anything some adequate lighting really helps to keep people in check. the only thing i was going to bring up was i do have a lot of experience in seeing places get overly conditions. so far, everything i have talked about does not have an economic impact. i would defer to my fellow commissioners, but i am seeing some flexibility at the a.t.m. for security if we are going to consider that's. i'm very familiar with that area. i have dunn's tons of enforcement. that little corridor there, that my experience does not kick off at eight. i would entertain considering a later time, and then the rest of the conditions i would actually support. those are my comments. >> are you suggesting a 9:00

p.m. start for security? >> i am. indifference to the sergeant, i think that would be a good compromise, considering i don't even know if he would be at capacity and 9:00 p.m., and we would still be stepping up the standard above what would be expected under the police code section. thank you for mentioning that, that was in my notes. i would like to also add on the back end the security remain on site 30 minutes after the closing of the business. this is a very busy corridor cat that is when it is busy. just to help quietly disperse the crowd. >> is that the cloak -- is that the closing propose that 1:00 p.m.? >> you are right. entertainment will end at 1:00 a.m. every night of the week. i don't have a comment on that one.

i will defer to my fellow commissioners. >> if it is just karaoke, i am thinking 1:30 a.m. isn't a problem. the lighting, you know, they kind of share that airlock with ireland 132. if they have to lighted up, with that affect the bar in the front? >> that is exactly my intention, commissioner. they are not in front of us today. my intent is to illuminate the area better than it currently is >> and you are just talking about that airlock, right? not the outside of the building. >> i'm not looking to make it a spotlight. the spirit of this condition allows a flexibility for the applicant. i know he is very familiar with this condition. the spirit of it is to illuminate it in a professional manner. we are not trying to make it so bright that no one wants to go there, i think -- grant did a

very good job when i worked with them, whoever they may have been, finding middle ground of adequate lighting where everyone queued up cackle at not being obnoxious were people didn't want to come, or it didn't interfere with neighbors getting beams of bright light in their home. >> ambient. >> that's fine with me, if it is just like a chandelier, or some kind of light, not a floodlight. we don't want his neighbors complaining to him, or some kind of thing on that, but i'm thinking 1:30 a.m. for a karaoke bar is okay with me. 9:00 p.m. is good, so what do you guys think? >> i am fine with the amendments i'm also fine with the 9:00 p.m. and the 1:30 a.m.

>> if the entertainment ends at 1:30 a.m., that does not necessarily mean that people leaves at 1:30 a.m. e-mail around for a bit. is ireland 32, do they have everybody out at the location at 1:30 a.m. exactly, or do they mill about until 2:00 a.m. as well? >> i don't know specifically. i was just reading it off of the security plan here. they let out seven days a week at 1:30 a.m. that is two clubs, or whatever you guys want to call them, letting out at the same location at the same exact time. the crowd would be bigger. >> that is unfortunate. that is the nature of the beast. the reality is my recollection has an unrestricted liquor license. they are just releasing at 1:30 a.m., so they are in compliance at 2:00 a.m., but nonetheless, it is a valid

consideration. >> but it also puts responsibility in the hands of the operator, with having the security to then monitor that situation, and then you have to take care of it, you can to watch -- wash your hands of it. it is added responsibility on the operator that we are giving. that is the way i see it. >> i think it is just like anywhere, like broadway, they all get out at 2:00 a.m. it is great to have staggered closing, but obviously, entertainment has to stop, and you have to start getting people out. but as long as the doors are shut at 2:00 a.m., it is their legal right. >> so, it sounded like the makings of a motion. unfortunately we will probably need a commissioner to reiterate. >> the only thing i am concerned about is a comments that the deputy director made regarding

[laughter]. >> i will go with leaving it at 1:00 a.m. for now, and we will take it from there. the last condition on security cameras will remain. strike condition number 1, 2 through four would remain with this motion. the second part of the motion, and i can provide these with you after the hearing so you get the real language, is that a condition regarding the owner being an active and responsible operator, number 1, the permittee acknowledges that at all times a premise is open to the public.

they are solely responsible for the operation and conduct of this business. number 2, at any time, at no time shall the permittee allow a third-party promoter of any control over the marketing, management, operation or staffing of this business. number 3, at all times, the premise is open to the public, a manager readily identifiable shall be on site, and lastly, a condition involving lighting, the exterior of the premise shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and content of all persons on or about the premise, additionally the position of such lighting shall not disturb the normal privacy and use of any neighboring resident. with these conditions, that is

[laughter]. >> let's remember this. i did have one thing to say. i think that there were extenuating circumstances in this specific permit application which would warrant the sergeant's request for 1:00 a.m. i think the police have shown themselves more than willing to work alongside this operator. i also would say that i would encourage the operators, if it does go through, to take six months, or however much time, and prove a track record, and prove to us why they should be extended, and i do think with the track record that that is something we seem very open to, and wouldn't create a problem for as provided there is no major incidents. >> was that a friendly second? >> yes, that is a second. >> the teams really, really went above and beyond and is continuing to do that today. this past year, the san francisco public utilities commission water quality division started receiving many more requests to test for lead in the public school system

here in san francisco as a result of legislation that had passed from the state requiring all of the public schools to do lead testing. and so as a result, the public utilities commission and the water quality team in particular was asked to meet with the san francisco unified school district to begin to prioritize which schools to test to meet that state mandate. >> the team that tests, we're a full service environmental laboratory, and we take care of both the needs of the water quality division and the waste water enter price. and on the water quality enterprise, we have to also have drinking water that meets all federal and state quality regulations. and lead in schools, we're playing a problem in remediating this problem of lead in schools. >> our role here in communications is being able to take the data that we have that we know is protective of public

have been here 30 year. we were notified from the landlord he was going to sell the building. when we realized it was happening it was no longer a thought for the landlord and i sort of had a moment of panic. i heard about the small sites program through my work with the mission economic agency and at met with folks from the mayor's housing program because they wanted to utilize the program. we are dealing with families with different needs and capacities. conversations were had early in the morning because that is the only time that all the tenants were in the building and finally when we realized that meda did have the resources to buy the building we went on a letter writing campaign to the landlord and said to him we understand
