[laughter] >> i just have a brief update this evening. i have two things i wanted to bring to your attention. the first is we are moving along with our hiring process for filling our vacancy for what used to be inspector burke's role here in the office, and this is an 1844 classification for a senior management assistant that would essentially

be our senior inspector. i attached the current job description for your review that we pushed out to candidates, just by -- just i thought i should call to attention that the position is going to be slightly different than it was before. within the realm of this person 's job duties, they will actually be managing the residential development review process from now on, especially since there's so much relative to sound mitigation and management in that process. we thought it went hand-in-hand with what this role already did before. also we will have this person help manage our move to our new office at 49 south venice over the next year, and help us streamline our digitization process that we have been working on since inspector burke 's leave.

so if you want to discuss that at all, i'm happy to answer questions, but we did hold interviews just this last week. we had a four candidates, and it was very competitive, and i'm hoping to make an offer to somebody this week. that being said, we are hoping that this position can begin at the very beginning of june. so with no questions on that, the other thing i wanted to bring up is that i went to austin a couple of weeks ago, it feels like it was a long time ago at this point. it was a very fun, personal trip , but i spent five hours at the austin center for events while i was there and i met several people who do similar work to what we do there, and dylan has definitely met a lot of them before, brian block

really helped me out in setting up interviews with people in the office there. he is essentially my counterpart in austin, and we met him in philadelphia. he is a great contact to have over there. they have a streamlined process for permitting outdoor events, so we are hoping to use that as a model for looking at ways in which we can potentially improve our process for permitting events in san francisco. we are actually going to put together a video documenting those interviews and we will work on it. i'm really excited. i'm trying to get creative, and in that same vein, the inspector has expressed interest in creating videos for the entertainment commission, so potentially, you know, we can have some kind of a fun, this is who we are, this is what we do, video. we've also floated around other ideas amongst ourselves here

about potential, you know, concerts in city hall that we could videotape. just fun ideas. any questions about that? okay. >> is there any public comment on executive director's report? seeing none, public comment is closed. thank you very much for that. next on the agenda is number 4, which is a report from the deck treat -- deputy director. >> that evening, commissioners. i just wanted to mention two things before we dive into the report. the first being that i've broken out the sound inspections into their own section, so you can see the sound test that was sent and were performed in a different location here in the

report, so there were 11 done since our last hearing, i thought that was kind of neat. that will be broken up separately because that is a whole different visit that the inspectors are doing out in the field, and then okay, let's go through the yellow ones here through the new complaints. a couple here i want to run through. for silverstone café, this is an unpermitted venue by us, and we received three sound complaints from them. and inspector went out to check the location, and he wasn't able to go until the following weekend. they were closed both friday and saturday. he went the following friday and saturday and he was able to speak with the owner and just explain that although they have the occasional d.j., they still require a permit, so he explains the permitting process there, and i will work with them if they do decide to pursue a permit.

moving on to page 2, the bindery or -- this is unclear about what this location was. we receive four complaints about a similar vicinity with sound that was disrupting the neighbors. the inspector went out and determined it was not the bindery, but the other location. they are playing streamed music from an ipod or a computer, and he spoke with the owner and let them know that multiple sound complaints have been coming in and asked them to close the door this is a fall under our jurisdiction, so i've notified us fpd park station officer wu about -- i've notified us fpd park station also -- officer wu and we will be allocating any complaints to their station. it was determined that the bindery is not having live entertainment. bringing to your attention arena s.f., since our last hearing, we have had four complaints from them.

and inspector was able to respond to three of them while he was out in the field. two of them more about the front line control, and the inspector determined that there line was in great commission, the crowds were controlled, things were orderly, they were following their security plan and in compliance. he did receive a complaint about noise in the back, and upon entering the venue, he found upstairs there was a door that was open. is not an exit of any sort, it is just a door. when it is open, it goes straight into someone's apartment. he asked them to pleas close it and to put a lock on it because it poses no threat for it being permanently shut. that was on a friday, he went to the following night and they had padlocked it shut. that is great to see they are complying with that. the fourth complaint was on cinco de mayo, they had a daytime party, and i reminded the owner that they do have to keep their door shut even if

they are having daytime events with entertainment. i wanted to bring your attention to page 5 that we did have a complaint about jones come in on a sunday afternoon. i spoke with the owner, it was confirmed that jones was closed that day, so i just want you to see that we did follow up and that the complaint must have must have been coming from somewhere else or -- they were closed. on page 6, you will see -- they were just recently granted their permit, and tuesday -- excuse me , thursday, may 2nd, was the first time using one of their 32:00 a.m. extensions during those days that you conditions their permit to allow. they did follow their permit conditions by notifying the heartland hotel management and the entertainment commission, as well as the other parties out there at the extended event by

sending a calendar out. we did receive one complaint come through 31. and inspector was out on thursday, so he responded to the complaint and asked them to turned on the music, which they did. i spoke directly with the complainant today and i was able to clear the air there and encouraged him to speak to his property manager or the manager of the heartland hotel who is the recipient of that tenant. we had four complaints come in about how weird festival, so our resolution is we have contacted the event producer, and requested they dropped responsibly can send out to the complainants that left the contact information. we will be doing sound testing here for the event, and ensuring that and inspector is on site for the event, that is what i

wanted to bring to your attention for complaints. i think it is important to mention that director weiland has already spoken with dylan about having him compile a list of the upcoming festivals and fairs that worry are entering into festival season so we can ensure that we have inspectors out in the field during those big events, and i just want to mention that there was one -- it wasn't really a site inspection, but the inspector was nearby halcion and they drove by and they were in compliance. i just want to make mention of that. lastly we did issue a notice of violation on the last page here, page 16, to revolution café. they were operating with a live band with all of their doors and windows open.

happy to answer any questions that you have. i know that's a lot of information, it has been three weeks since our last hearing, so a lot has occurred. >> i have a quick question. the arena, can you remind me, did they just go through a rebranding, new ownership? >> they did. it is the same owner right now. they have added a new operating manager, and they have done a complete rebranding. so that was previously mission street sports bar, and now it is arena s.f. and they are operating as a very large nightclub, a very popular nightclub, i should say. >> okay. in terms of the three complaints that have come in, that is since the new ownership? >> yes. it is. >> thank you. >> i've definitely heard quite a bit of buzz about it. they know how to throw big parties. i hope they learn something from

that so they can run a good club >> on that note, i've spoken again that inspectors have been really responsive to these complaints. i've also been in contact with the mission station and highly commend their security. he is out there often and he says that he feels they are doing things correctly. there is just a lot of people turning up on thursday, friday, saturday nights. >> and must be the wall of working that they have. >> that's real. amplified sound permit for the screening of the 1993 film " toilet club" located at waverly place. from seven taught to 11:00 p.m. on saturday, may 18th, 2019. this item was continued from the april 16th, 2019 hearing due to the fact that the applicant had -- that their street closer permit was pending approval. it is back on the agenda because event producer has now received their approval letter which you will find in your files. the permit application is on a regular agenda because event producer hoped to amplify sound past 10:00 p.m., which requires commission approval. the event producer has distributed flyers to their neighboring businesses and residents in chinatown. we have not received letters of opposition for this permit application. central station approves this with no added conditions. the director request director request that the commission considers adding the standard

conditions for approval for outdoor events. the conditions are listed under the staff recommendations on your commission memo for permit. i'm here to tell you more about the permit is the other crystal. she is the evidence protection master -- manager for asian-american media. >> hi, i'm crystal from the center for asian-american media. i've had the pleasure of working alongside crystal. thank you so much for your help. the center for asian-american media is a nonprofit organization that helps to create a platform for asian-americans to help produce media content and screen it. on this day, we would like to screen the club film. our festival takes place from this thursday, the ninth, until the 19th. the movie is a film that is local to san francisco, and we

are celebrating the 25th anniversary of it, as well as the 30th anniversary of the book. we will have multiple people, cast members, in attendance, this will be the first time in the last time that they will ever be together as a group. it is an exciting thing for chinatown, for local chinatown san francisco. we will also, that day, of representatives from the mayor's office come to issue a proclamation for the day. the reason why we need to go past the 10:00 p.m. time is because it is an outdoor screening, so we can start it until the sun sets at 8:30 p.m., which means it will end at 10:5. it will go 50 minutes past. there will be remarks that have been before, so some of the cast members and other people in attendance will make some remarks starting at 8:00 p.m., and then the film itself will

that is happening here, and i almost want to assume that this is the first outdoor screening in history. >> i think that we have done one a long time ago, but this will be the first one in the last decade. >> excellent. we all have our memories from this movie. i mean, it was 25 years ago, i was just graduating from high school and i watched that movie and i couldn't stop crying. and very curious who from the cast is going to be there. >> i can tell you off the top of my head that there are some who will be there. there are a number of other people who will be there. there are a couple people who are not guaranteed just yet

about the project is michael lee and jordan roberts is here too. >> hello, members of the commission. i am with sutherland and we are the sponsor and the developer of the project. it is a mission development. we have 100 units over retail. the height of the building is about eight stories. in the process of our planning submittal, we have been informed we need to conduct a noise study and outreach to the neighbourhoods, and in the last couple of months, through our consultancy group, also working with maggie, i have personally tried to reach out to the two venues, encore, which is right across the street from our site was able to talk to and meet

with chris amber, the neighbor -- the owner of the karaoke, and spoke with him in person about what we are doing in terms of the noise study and the purpose and intent of the noise study. chris is very nice and very supportive of the project, and i think he is very well aware of it. as for playland, we tried to reach out to the owner. i didn't know who the owner was, but i tried to call them on several occasions. finally i went to the venue myself in person and talked to the manager, carlo, and he just had to say that the owner, i believe, name is angela, has several places. she is not there all the time. but i did inform carlo of the intent, the purpose of doing the noise studies, and how we will integrate the result of it into our project to mitigate any concern with future noises coming from the places of entertainment. so i think in both cases it went

pretty well. the manager just said that if there's any more questions, to let him know, but so far he has not contacted me back yet. the consultant, valerie, jordan, and nathan are here if any members have any questions from the noise study report. thank you. >> what kind of retail are you thinking of having on the bottom are you having more retail, more bars? >> the far, they will be two locations that we feel are very appropriate for restaurants. one is right on the corner of california, and there is another one facing polk street, right adjacent to our adjacent building. there are two locations where we feel that would be very suitable for restaurants. there is only -- there are two smaller spaces facing california

, again, we haven't determined what those will be, but probably very low profile, very quiet activity, but nothing very loud. >> and then the entry is on california, or on polk street side? >> the residential entry would be on california. we are going to keep the polk street pretty much activated as retail. there will be an alley that will be accessible from polk street going back to a rear courtyard that we have in the back. >> is that open to the public? >> it is not. >> but it is gated? >> yes. it is currently being reviewed with planning. >> i always have to ask this, you have a lighting plan, right? >> we will, definitely, we will. >> okay. it is kind of dark right now, because you are right across from crustaceans, right? right on the angle there.

have windows. i guess the purpose of this study is to find out the noise level. based on that we will properly design our window and door systems to properly insulate from noise. >> i'm sorry if you said this already, but are these going to be sold off individually? >> this will be rental apartments. >> okay. >> part of them would be below market rate. it will be affordable. >> what is the percentage? >> i believe it is 18%. out of 100 units, it is really complicated. we need to find out the base project. i think the base project is 93 units. i think it is about 17 or 18 units that would be affordable. >> one more. so in your restaurant space, are you planning to do any kind of soundproofing on your own between the two floors?

let's say it the future, the restaurant wants to get a limited live permit, and, you know, they are going to have music, but the crucial part is insulating between floors, and it has to be done before the sheet rock and everything. i am wondering if you have any plans. >> it is still quite early. we are not in the process yet. we are barely in the. >> design his, but it is a point will -- well taken. >> something to figure out. >> again, the podium is concrete , so i think that helps the situation. we have three levels of concrete , and above that, the five floors above will be woodgrain. >> do you have some airspace, then sometimes it helps. >> okay. okay. >> anything else? thank you, you can have a seat. and we would like to hear about the sound study.

>> hello, jordan roberts with salter. just a quick summary of our analysis. we may two long-term measurements, when was a long california, and the other along polk, from thursday afternoon until monday. that captured the overall noise environment and established our ambient noise levels. then we returned and made attendance measurements. we went along polk and also another one a long california, but they were closer to the entrances of the places of entertainment. we noticed that those levels

captured the people attending the nightclub will -- that people entering the nightclub and leaving the nightclub. we did not notice too much from the karaoke. >> we did conduct measurements outside of both locations, in both did capture some, although low noise levels. they were pretty quiet, but some noise from both. >> thanks. so playland is the nightclub that is further away from the site, and karaoke is right across the street, which is beneficial for land-use purposes we recommended ratings up to 37

to mitigate the noise from entertainment uses. twenty-eight ratings were along the back of the building, and 31 was recommended along polk closer to playland. >> when people come out, what kind of ratings do you get at 2:00 a.m. in the morning when people are coming out? >> the instantaneous levels, i don't have that in front of me. we report the ten minute interval that we captured while some voices were audible in the measurement, but the overall ten

minute noise level doesn't really speak to that instantaneous, that one second of someone talking. i'm not trying to skirt around that. >> so your recommendation for the sound, i mean for the music sound, do you think it is adequate enough for, let's just say that encore becomes this really busy karaoke bar for some reason in the future, and suddenly there's 100 people outside, does your windows compensate for people noise? we can't really control people noise, but we do get a lot of complaints at 2:00 a.m. in the morning when people come out. >> right. our analysis is based off of the ambient noise level, so it is the allowable rating, or the rating that is back calculated from if they karaoke bar was exceeding the noise.

>> ambient, though, that is the current ambient. >> yes. >> right. >> it is not really accounting for entertainment uses, because if they were to exceed it in the future, then it is a whole other ballgame. >> i'm just curious. if it is just normal busy, is that, in your opinion, is that adequate enough? >> the 37 is the significant window construction, and a lot of it is be car because it is a long california street, so the sponsor will get some added benefit from traffic noise, mitigating the traffic noise level, as well. >> definitely pedestrian noise as well>> tt is our main concern

because we can't do too much about it for the freedom of speech, but it says -- since we're here talking about it, it would be nice to be prepared for it. your expertise on it, and whatever you are recommending will cover that part in the future. >> yeah, we consider that. >> okay. >> i don't have anymore questions. thank you very much. >> suggest help me guide hear the recommendations, the options that we have for going forward with recommending this, or to go forward as the rating as is, without any major changes, or that is basically it. >> you have a standard recommendation in front of you, they are right in the top of the pile. if there's anything different, or anything that you want to add

on, this is your opportunity. they have already conducted their sound study, so if you want to make any specific recommendations regarding those, or just say to adopt this specific ratings that were offered in the sound study, you can always, you know, ask questions about placement of bedrooms in terms of how close they are. the to the closest place of entertainment. that kind of thing. although this appears to be fairly thorough. >> i did have one more question for the sponsor. what is the timeline on this project? >> if everything goes for what we project with the planning commission hearing which will be the summer, we will most likely break ground a year from now, about may or june of next year, and it will be about two years,

so it will be relatively faster then a project with the basement we anticipate about 20 months for construction. >> got it. you don't have to say this, but are you intending to stay on as the landlord? >> the owner of the land is the partner to our company. >> got it. for me personally, i don't think we need to require any suggestions going forward, which is knowing how annoying it is for landlords to mitigate -- mitigate noise issues and building managers, i would just recommend accepting this recommendation and maybe even kicking it up a few ratings, especially commissioner lee bringing up a great point with future uses for the ground floor that might involve entertainment , et cetera. i've had to be on both sides of that, and it is not fun way to

statue for chinese real-world workers up in the sierra nevada. we are the first 500 -- where the first 500 chinese were tested to see if they could do the job of building the railroad , to finally where they said, well, they built the great wall of china, they can build the railroad. eventually 15,000 chinese were hired. anyway, the monument got built. it was shipped on a boat from china, and it got here, and now it is at the california railroad museum temporarily because our commissioner from the planning department now designed a plaza, and i have to raise more money for a plaza. anyway, at least that part is done. we will raise some more money, and we are all going to utah this thursday for the big celebration or the reenactment of the two trains coming together. they do this every year, and the

single day san francisco is an amazing photoy town historically been base on evolution and that applies to every single professional field including philanthropic arts today what i do is photo based art manifests traditional forest and some colonel lodge and other frames of digital forest is a meeting that has been changing like super rapid and the quality is not extended by the medium if you took forest in school or you get a job in a newspaper they'll give give you a list of how to create a philanthropic story my goal to break down that model and from a to b that is unique and allows the ability to incorporate different types of i believey about propels someone through the rise and a fall of their own experiences
