and have twotal ons on top. we want two buildings with footprints similar to the buildings around and have pedestrians to walk in the central space in the middle. we have the four buildings to create density for housing. we do the setbacks and merge the two conditions of the ground and the tower and the aggregate, the setting back floor by floor is creating a different scale at ground level than at the top. it is mainly a rental housing with a hotel and offices in the back that is accessed by people walking through the site. we have a number of

sustainability things that we are doing, both social and community level, but also have reused the grey water and tried to reduce the energy consumption as much as possible. this is an urban space where people can go from the caltrain, from the neutral stop, and for the alleyways behind. we have a single curb cut to take care of the traffic and putting the loading and parking on the ground as soon as possible. we have retail storefronts throughout the site. >> thank you, sir. >> we are now going to open up to public comment. anyone from the public wish to comment on this item? public comment anybody?

>> commissioner richards: can you finish the presentation? when i looked at the building it looks like the holiday inn on kearney street. it became more interesting. could you give three minutes more to walk through the rest of the presentation. >> i am not sure how to get it on your screen. >> it will come up in a minute. >> this is where we left off. these are the alleyways leading into the central square, the alleyway from town send and fourth street. this is a view across from the caltrain station and when we started to look at the skin of the building, we wanted to not do a glass building, a building residential but things that fit into the skyline of san

francisco which is different from a lot of other cities because it has more heavy looking building with punch windows. it is a precast stone or metal. we wanted to refer back to the warehouse district of central soma with a clear distinction of the structure and big window openings and masonry and stone work and some of the other materials we find so it really feels like an extension of the district and the sky. we want to work with depth so the line is back from the out of the face of the opaque material. we want to work with the hue and the color. it feels like four buildings into two main volumes.

there is a lot of open space on the ground and private terraces on the lower apartments. some of the shared amenity spaces on the top of the lower towers. the ground floor space ties to the other open spaces in the district, both the alleyways and the parks. we have in here the walk through that the plan department has done the neighborhood walk which will pass right by our site. you will see how there is lane ways that the project can tie into. the open space is not just urban oasis in the middle but constitutes the alleyways, gateways, there is a park facing fourth street and there is where we want to make sort of diverse face that can take a lot of

different activities from the local pop ups, music festivals, retail spilling out to have local art fairs and art will be a big part of the project where we have both open spaces that can take sculptures but also have wall spaces and s frescoes. one of the entries into the project, the sort of community park that is right on to fourth street and the tram stop. this will be planned in a way that is flexible. it can have activities and markets and so on, and when you pass that square, you get into the gateway and into the main space in the middle where all of the residents will come through to get to the lobbies.

family district. the project site is located east site of ninth avenue within the inner sunset neighborhood. within the immediate area there is residential two to three story single and two family dwellings. there is a great variety of styles. the subject lot is half lot wider than the typical lot 37.5 feet and lot depth of 120 feet for total of 4500 square feet. site slopes down towards the rear developed with a vacant 222 gross square foot two family dwelling. it has a site set back of 3-foot 8-inch on the north. the proposal is the demolition of the two family dwelling and conduct a horizontal and

vertical condition to conduct a three family dwelling with a dwelling unit. 1072 two bedroom unit on the first store. 1150 bedroom unit on the second floor. the proposed structure enlarges 90 square foot -- 950 square foot. known common access to the rear. two bedroom units and the second of 1835 square feet. a 948 square foot two bedroom unit on the fourth floor. fourth floor provides 15-foot set back at the front and 10 back at the rear wall. height at the front is 30. total height 40 feet. 62 feet depth with 12 feet poppit on the first floor.

it retains north side wall set back 3 feet 8 inches. this was continued from the march 21st planning commission hearing without being heard. during that period the product sponsor noticed a three building unit. the project has been replaced to replaced storage with accessory dwelling at ground floor. it proposed to remove vertical and horizontal elements. therefore, the project is requesting conditional use authorization from the commission pursuant to 317 to allow demo listing of residential unit. because of the age and the multi family nature it is assumed rent controlled. by not fully demolishing the rent control should remain. it is in rh-2 zoning.

two units per lot and permits one for every 1500 square feet of lot area. because of the subject lot is 4500 square feet it is requesting conditional use authorization to allow three units on the 4500 square foot lot. it proposed a dwelling unit at ground floor per a.d.u. waiver under 207 c 4. it will require administrative swear waiver. i have received five comment letters with concern on the height of the project and impact to light and air. it was presented to sunset heights association of responsible people, a neighborhood group on march 19th before the initial hearing. since the notice of this hearing additional letter was received

terms of four story buildings? >> the context of the existing mapping of the block face was definitely a consideration when the design team reviewed the project. one of our commonly used approaches to make the building if it is taller to be more compatible with the existing structures in the neighborhood to provide set backs on the fourth floor or upper floor. this project provides 15-foot set back. anyone close to the project it reads more as three story. at further distance you will see the fourth floor. the building to the right, that would be the south of this project is a larger building, one of the larger ones on the block face and provides transition to add that corner as it gets taller, those buildings. there was consideration.

the residential design but the team found the building compatible with the neighborhood. >> commissioner richards. >> commissioner richards: quest. i see what you see on a2.2 and the strangeness of the entryway. it looks like illegal unit. how it is buried in the back. how do you recommend it is reconfigured so it reads as a unit and not have this way to get into it. >> i am asking staff whether or not they brought that question to the applicant. there is a designing architect engineer here. this should be flagged by staff in the discussion in reviewing the project. that is a question we raise again and again. in addition to that given the height of the building we need to look for a fire stair, the fire department will require roof access. we could see where that is

located. it will make an effect on the appearance of the building as we see it. mr. warren do you have any comment on the entry situation there? >> i agree there could have been more consideration to the entry of the building. this is a new change to us. our intent was to get this a.d.u. in the structure. i think the sponsor is available to discuss design approaches that he thinks could work for the project. >> one possibility looking at the diagram to put the entry into the new garage the pedestrian entry further to the west to bring the bicycles somewhere in the general garage area. i do not have that to see how it works. put the washer and drier

someplace else and potentially bring the a.d.u. further toward the front of the building, perhaps in line with where the stair goes up toward the main unit. that is one possibility. to have a bicycle in the garage you have to havetic spacing how the cars it is in the garage. that is one sketch by which that could be achieved. >> did you want to say something? >> elizabeth junk here on behalf of the team leader. the commission could condition if you are inclined to improve the condition we would work to make it more visible from the street as part of the conditions of approval. >> i think it can be done without disturbing the setup of the building.

>> good afternoon, commissioners, i am steve lee, president of hoa. i am here to state eight out of nine owners of the building are in strong opposition for the following reasons. this will be in strict violation of our ccnr. no activity which causes any insurance policy to be cancelled or not renewed. no person may sell distribute to tobacco other main. we have been confirmed they would cancel our master building insurance if the dispensary opens in our building. they have been claiming they found an admitted insurance to work with our building, but that was not true. we talked with their insurance

agents a couple days ago. she had no idea what we were talking about. she was scrambling to get insurance for their business which had nothing to do with master insurance. we are left with sub par assurances we have never heard of and are not protected by the states. a dispensary is specifically restricted by the last sentence stating marijuana may not be sold or distributed from the property. second reason is that the project would violate the san francisco police code and does not meet mandatory requirements set up by the city. the police code requires the applicant to provide written verification the owner of the real property where the cannabis business wil will below indicatd consents. the owner does not have the

authority to consent over a matter that violates the declaration she is bound by. only the hoa has such authority through a majority of votes or amendment of the ccnr. it requiring the owner to be responsible to providing a copy of lease showing it complies to declaration. the owner refused to do that after multiple requests. for us it seeming to be clear it will violate a declaration of the building and police code which is why we hope you deny permit. we believe iter would benefit by saving them time and money on lawsuits that could have been avoided. thank you. >> you are representing the hoa?

admitted she noticed we had more entrances. we let her know that. we also let her know there was children that would be living above her, one of the owners has a daughter that is roughly 18 months to two years old. that would be a problem mainly because we have had issues in the past with people who are extraordinarily heavy marijuana smokers. you wake up in the middle of the night trying to figure out the smell and it usually was marijuana. we do not want something that is going to be a smoking den for marijuana people. as well as it makes no sense to have a lounge where people it is and eat gummi bears and put on balms and salve. it has gone back from smoking, no smoking, open these hours.

we are willing to work with you certain hours. there is no real communication with the hoa except for this one meeting that we had on the 25th. shshe has been communicating wih itna which has nothing to do with india cove hoa. it is totally wrong we have had one meeting and she hasn't taken more time-out to include the residents in terms of the owner residents she would encounter every day of her business as well as we have asked her who is going to protect the property when it is closed? she said some random friend of a policeman. that gives me no security somebody is going to randomly look at the building. we have asked for a lot of things we haven't gotten. >> next speaker, please.

>> my name is max. i am the owner of the unit 109 which is right before the proposed business site. i am going to take it back. my key objection, the key question was about the consumption of cannabis on site. from the beginning we were told that is not going to happen. we are finding out otherwise. i am opposing to posh green moving to our building. i didn't think it is the right building to be in. it is a relatively small business with mixed use and my main objection is for the health related reasons. as someone who lives right above her. there are a couple cases of someone consumed cannabis below and i can tell you the smell goes outside through the windows

or through hvac. the building is not suitable. the whole layout is all open, and that smoke will circulate throughout. i also think i am going to kind of take a step back a little bit. as a former cigarette smoker, i can say as a nation we have been very successful at dealing with cigarette smoking and second hand smoking. we are winning the battle. there are casualties dying from lang cancer. i am concerned if we are not careful with cannabis consumption, we are setting a precedent. we won one battle and we are creating a new one for us. she was there to tell me we aree

not going to have cancer from cannabis smoking in that unit. this business is open more than 12 hours a day seven days each week early morning to late night. the exposure to the fumes, lung exposure is going to cause effects. i don't want to stand here later and talk about the adverse health effect it is having on everyone in the unit. thank you. >> thank you. next speaker, please. >> good afternoon, commissioners, i am charles corey owner and hoa board of directors. steve mentioned legal reasons why it should not be permitted. there is common sense we need to take into consideration. when we look at cannabis dispension res there is a high crime rate. at hunters point there is a high crime rate.

then we add this to a building with nine entry and exit points. i as a resident in the building feel vulnerable. there will be criminals to enter to get the money or product. when we look at other dispensaries throughout the state, this is a common problem. there is no retail probably because of high crime rate. when you go one mile down the road there is a walgreens with everything in the store under lock and key. you have to press the button to get toothpaste or shampoo. they now close on the weekends at 5:00 p.m. due to thefts. there is a security guard at the door. theft and retail is a huge concern. no way to stop theft. security guards don't stop it. lock on the door will not stop it. living in the building i do not feel comfortable with the

product and money and cash in the building as a prime target in a neighborhood with a significant amount of violent crime throughout the history of the neighborhood. thank you. >> thank you, next speaker, please. >> i am paul lee one of the lawyers for the homeowner's association. there is discussion about the amendment recently filed. before the amendment was filed. operating a cannabis dispensary was unlawful under the ccnr8.4 states you cannot have illegal activity at the association. like it or not cannabis is a schedule i drug illegal under the federal law. the controlled substance act. whether there was an amendment or not, the opening, selling or distribution of cannabis would have been a violation of the

ccnr. regarding the insurance, if consumption is allowed, i don't see any insurance company insuring this homeowners association. they may insure the business but definitely not the building. one of the arguments we heard is the recent ccnr amendment is not enforceable. that is incorrect. the california supreme court has said that retroactive enforcement of ccnr provisions are allowed. i can give you the case if you want it. the supreme court already made the decision that it is allowable. thank you. >> next speaker, please. >> good afternoon, commissioners. i am angel alexander on behalf of posh green. to address the concerns of the

consumption lounge to pay view is an opportunity. some might see it as a risk with respect to theft, but i also see it as we are here to change the perception and stigma of this business, the industry is o involving, laws are evolving. the opportunity to have a consumption lounge which is for residents but also a tourist attraction. this is the beginning of changing what the bayview is. since we are at this point where we are evolving and cannabis is becoming more accepted and everything is changing, it makes sense insurance carriers, hoa. laws are not written to forecast what the changes are going to be in the future. i would implore each of those entities to work with the sponsor. there are insurance companies that cover cannabis businesses.

still exists. i have witnessed two deaths, one active as it was happening. gunshots at night. drinking at the shoreline park. you can't walk down there. if i go down there there are people partying and drinking and acting erratic. sexual activity in cars. myself experienced a gentleman in my car broke in night. my daughter woke up in the morning to go to school and she screams. we run back to the condo. this still exists in the community. i don't think anybody is not in favor of the cannabis dispensary but this neighborhood is not ready for a dispensary. when i come home from work sometimes, sometimes i workdays, sometimes nights. i think about ducking in my car

the formal review, we do differ that to part two. we don't want to charge the police department with reviewing a security plan that does not get approved. we do consult with the police department. >> this is not the first time i have been through this. i actually have a state license from the bcc, grower delivery service, we are just turning it into a storefront. so i followed all the guidelines , and you know how hard it is to get a state license and we actually have a provision on it. we have to provide security plans, we have to provide -- it is a long list, as you can imagine, and we have to provide everything. it is like 89 items. the actual b.c.c. in the office of cannabis knows where everything is out. they are the only people who know where this place is added know where the product is at and everything, because they require us to submit that.
