[laughter] i mean, really hot. on a regular basis in the bayview, and potrero hill neighborhood and the mission, we know that those are the hotspots in san francisco. i just came from the sunset and it is hot in the sunset. i knew it was going to be even hotter in the bayview. i'm really excited to be here today because nothing brings the community together like food,

and here is an incredible opportunity to really not only enjoyed the delicious food provided by some amazing vendors , but this is also an opportunity for the community to come together. when i was growing up in san francisco, we had food houses. remember? we could go to somebody's house and buy some nachos or some chicken or some banana pudding, but times have changed. we don't have the grandmothers and the folks who are the ones that were taking care of the community the same way that we do now. things have changed. the community has changed a lot. we know the bayview hunter's point community has a thriving african-american population here , a community filled with love and excitement, and the need for us to come together for occasions like this. especially because we know that as there is a lot of work that is happening in the bayview

hunter's point community, there are a lawsuit -- also a lot of people working in this community , a lot of people living in this community. having amazing food options for and by the people of this communities critical to the success, the long-term success and stability of the bayview hunter's point community. i cited eight. there are a lot of folks who are going to be working on the sewage plants and other projects we just broke ground on one of the public safety buildings that is not too far from here, so i was just thinking to myself, what was that building that we just broke ground on, the forensic building and some other something, the traffic company. thank you. anyway, we were breaking ground over there and i said i wonder where all these workers are going to eat. where are the restaurants? so we have café envy, we have other places here and we want to make sure that, you know, we know that there are places to go to to eat in the bayview hunter 's point, places to hang out in the community and our goal is to do everything we can to make the right investments so that this community continues to thrive. i want to thank all of you for being here today to support these incredible businesses and

to make sure we have a vibrant corridor where businesses get to thrive, not only for folks in the community, because we want to make sure we have a place to go like supervisor maxwell explained, so we can talk, we can spend time with our families right here in our own community, but we also want to make bayview a destination place. we want folks to come from all over san francisco, from all over the bay area to enjoy the culture, to enjoy the businesses , to enjoy the food that we have right here in our own community. so as we look at our own businesses activating space outside and an atmosphere like this, that is an exciting thing for us. that is something that we should all be celebrating and be excited about. i want to thank everyone for coming over today and spending time to get to know our business owners who i will introduce in a minute, but i also want to talk about the public, private community partnership. as you know, the sewer system improvement program is coming.

community. >> we have a ten-person limb elimination match. we have a full-size ring with barside food and drink. we ended up getting wrestling here with puoillo del mar. we're hope og get families to join us. we've done a drag queen bingo and we're trying to be a diverse kind of club, trying different things. this is a great part of town and there's a bunch of shops, a variety of stores and ethnic restaurants. there's a popular little shop that all of the kids like to hanhang out at. we have a great breakfast spot call brick fast at tiffanies. some of the older businesses are refurbished and newer businesses are coming in and it's exciting.

number three which is our report from the executive director. >> thank you. good evening, commissioners. this evening, for my director's report under the legislative and policy update, i wanted to share and an update with you from oewd on the project he has been working on to research and develop the san francisco music strategy along with sound diplomacy. just an update on that, last year, the organization found a project supported by oewd to developing the strategies for san francisco, in which the entertainment commission took part in, and facilitated some focus groups with a lot of our constituents, either from the event side or from brick-and-mortar permitted places of entertainment. the strategy will map the city's music related assets and will identify recommendations for

ways the city can better support local music. as part of that work, there is an online survey that is open right now for music businesses, venues, musicians, and music fans to offer feedback on the strengths and weaknesses of the local music ecosystem. we will be pushing some messaging out about that online through our various media channels and we will encourage you to do that, as well. we will provide you with the link as well as some social media language so you can share with your friends and people, just because we want this to reach far and wide. the deputy director is also going to be reaching out to folks from our parroted venues to help them engage, as well -- our permitted venues to help them engage. moving on, we wanted to bring up our commission retreat at this

evening's hearing. just to get a little feedback on where we are in the planning process. you should refer under the director's report to the details that i have provided their there see can follow along with me. our retreat will be on friday, october 18th. we will start at 11:00 a.m. and go until 4:00 p.m. we will have lunch until noon and then that is one the real agenda will begin. we are looking at a four our retreat. again, i will be reaching out for lunch orders shortly, as well as asking you all for some song recommendations because we'll be putting together a music playlist this time around. >> i can't wait. >> we want to make it fun and speak to our love of entertainment, and i've gone over some of these discussion topics already with the board,

so i already have their feedback and collaboration, but would love any further advice or thoughts on where we are at with our topics. so really a meat of what we're looking at. we are looking to have a strategic planning session. last year we had a fun session where we threw up ideas on the wall of what our mission, vision , and values are. we are going to rent that out for you in draft form for you to take a look at this meeting. we can play around with that. we will also get updates from ben van helton a little bit -- he little bit further detail on the sound diplomacy project, and then we really want to talk about something that the president has made is near and dear to his heart, is talking about this piece of promoting entertainment and nightlife more we do a really good job of regulating in san francisco, and

we are a model across the world, but we could definitely work a little bit harder on supporting our venues and promoting the good work that everybody does in our ecosystem in san francisco. so how can we do that? we want to focus on the how and what we want to convey to our constituents. another thing that's been brought up several times is the desire to clean up our residential development review process, so that something that the senior inspector jordan roberts will be helping me with. we will talk about that at our retreat, and finally, we will close with, you know, anything else that you want from us. we want to learn from us, or have us do better. you can go over your binders for your hearings and walk you through how they work a little bit better if that helps.

since this incident -- we will not be setting up on t.v., in a stage like setting. we can have a little bit more fun and get more in the lead. is there anything else you would want at the treat that we are missing, or anything you don't think is necessary that is on there? you can always talk to me at a later time, as well. i will keep moving. finally, we are dealing with an appeal right now. this is an appeal of a citation, so it doesn't go before the board of appeals. this is going to be heard at the controller's office, and so that hearing is on september 9th, and there are several deadlines that we have between now and then, in the deputy director is managing this process, which is great, and our prehearing

statement is do this coming monday. it is pretty basic. it was a one-time event permit that we issued, and the permit holder was out of compliance with one of the conditions that was provided by the police department that they shall not block sidewalks. they wound up blocking the entire street, and the police department had to respond to the event and sent several officers out. we will keep you apprised of how that appeal process goes. any questions? >> i have a quick one. going back to the project of the music strategy, is part of this that we would identify areas of the city that are lacking entertainment components and hopefully work towards developing those? >> yes. they are doing some geo- mapping as part of this. >> awesome.

>> this will be a great tool for this office and hours to make policy recommendations to the mayor and board. >> also eventually to land-use? >> absolutely in the cards. >> thank you. >> well, the report include this place of entertainment or and outdoor events and festivals? >> it is inclusive of anybody that hose entertainment or is involved in the music industry in san francisco. so we connected the folks from sound diplomacy with a tone of our constituents. they held focus groups already speaking directly to the source, and then there is going to be a survey. if there is anybody else that wants to provide feedback, that survey is a -- survey is a great opportunity. >> can i ask one more question? have you heard any more about the possible funding for

soundproofing grants? >> the soundproofing program is moving forward. we just need to work on implementation. that was approved in the budget. >> right, so it will happen? >> yes. >> nice job. >> that is an oewd thing so we should thank director torres and thank everyone that approved the budget. >> outstanding. thank you. >> thank you. any public comment for the report? seeing none, public comment is closed. the next item agenda is the agenda from -- the item report from the deputy director. >> thank you. good evening, commissioners. the enforcement report this week is fairly lengthy, but there isn't too much to report out to you. you will see what i have highlighted in yellow throughout the report. there was a lot of site

inspections that took place and dropping off new good neighbor policies. so if you look at page one, you will see club 26. we had a handful of complaints come in about this venue over a short period of time, and they were the same as the couple who lived -- lives directly across the street from the club and their complaint is that every single night at closing time at 1:45 a.m., people come out to the street and they are disruptive. both of the inspectors have been out. i have spoken with their head of security and since last weekend, we haven't had any complaints. they are being very diligent in adhering to their security plan. basically it is just moving people along. we have seen an improvement and i'm happy to report that. i've also connected with mission station about the problem and he himself said he would drive by at 2:00 a.m. i asked him via e-mail and if he had done that and i did not hear

back. if there any updates i will let you know. on page two, i have highlighted outside lands. we did get seven complaints on 311, and the director forwarded those along to the recreation and park director. not too crazy. on page ten, i've highlighted the blue light. i just want to bring this incident to your attention. we did issue a notice of violation for them exceeding their sound limit, and there was an incident that occurred where it was a little bit of a mixup about the issuance date of their permit for a one time to go past 10:00 p.m. for their regular issued l.l.p. permit. so the inspector did believe that the permit was for saturday night, and upon going, they found the door open and took a sound measurement. they were exceeding their sound limit. it turns out the event was actually for friday night, so we issued in n.o.v. or their sound

limit being exceeded. the next step in the enforcement escalation would be a citation or sound. there's a lot in here and i'm happy to answer any questions, but those are the highlights that stick out. >> question, when the 311 complaints come in, do you guys respond the next day? you get the 311 complaints, or does it come live? >> it comes live. when they are in the field on friday and saturday nights, they are receiving them in realtime and responding in realtime. in the events where they happen where there's nobody in the field, we respond to them the next time someone is in the field or we follow up in the office with a call or an e-mail. >> have any inspectors gone there and there's music playing and they don't have a permit and they actually shut them down and say you have to turn it off?

>> where are you referring to. >> any time. if there's a 311 call where the inspector found they had no permit. >> the process that the inspectors have been following as we received lots of 311 complaints for sound, and if we determine it is an unpermitted venue, then they go in and explain the permitting process. they are required to have a permit have live entertainment, this is considered live entertainment. they get contact information then they provide that to the director and i when they returned back to the office, and then i sent an intro e-mail stating -- >> if they're in the process, let's say they go there and they are in the beginning, and 70 complaints are you guys go there and say, hey, you are not permitted, do you take any steps to shut them down or you just -- >> when you say shut them down -- >> you don't have a permit, we have to turn off the music. >> that is a little severe, i would say. >> i don't know what the procedure normally is. i know in the past that we go

after the fact and we have extra inspectors. is anybody come across -- >> the goal is we want to bring you into compliance. so if they are operating entertainment without a permit, sometimes they don't even know we exist. if they are a repeat offender, then we have to start taking further action. we could use our enforcement tools, and then we can always bring the police department out with us, which usually is how we would do it if it is happening -- if it has happened a few times. we have one right now that we are likely going to have to do that with. >> okay. >> if i can add a comment, generally speaking, at least from the police department's perspective, we do not shut businesses down because you have to be careful you are not becoming a judge judge and making a final determination.

we have to do it through due process. at least for the police department, especially when i was doing this, unless there was significant exigency, we would not shut things down. we would certainly document and follow up after the fact. >> right. and then the only department that has the authority to actually shut a place down entirely as the fire department. >> that is your backup. you can always call fire out. >> i was just wondering -- i know we didn't have enough night people, and i know these things are coming up where there are 311 calls. i'm just curious if we happen to walk into one and say, you don't have a permit, and his 500 people in there, they will say, shut off your music. you have to wait for the next day to contact them.

>> we usually take the approach of education first. >> okay. >> you also don't want to create an exigency. >> right. >> question, with regards to blue light on page ten, if they were given a notice of violation , i am just wondering, can you remind me, notice of violation is not a preferable warning, and what is the escalation -- do they get a citation, and then the directors just something happened? can you remind me with the process is? >> the first step is a verbal warning, and then -- it is a verbal, notice of violation, then citation. if -- it is -- if three citations for center issued within a 90 day period, the director can suspend their permit for up to two weeks. the reason why this went straight to a notice of violation is because we have had a lot of conversations with the blue light about being in compliance, and so they've had plenty of verbal warnings, but this is their first time being

reason is because the next memo here, the next two applicants, it is very long in there is a lot of follow along with. there with me, but here we go. the first permit on the regular agenda is for a limited life perform it permit -- performance permit for a zeitgeist. the applicants have held a b.p. permit in 2001, and regularly apply for one time after entertainment event permits. they have decided to apply for a permit to continue hosting their annual outdoor events and give them flexibility to host other indoor and outdoor events year round. due to residential units located above the bar at the direction of director weiland, the senior inspector conducted outdoor sound measurements before tonight's hearing to provide recommendations to you. based on their findings, staff is recommending we categorize entertainment events at zeitgeist is nonspecial events and special events to clearly distinguish the permit

conditions for each. for nonspecial events, the senior inspector recommends overwriting the standard m.p.c. and set the sound limit at 88 d.b. measured 15 feet from the nearest loudspeaker because they are sensitive receptors to residential units, closer than 250 feet to the outdoor performance area. the sound limit will be for all nonspecial events. samples include but are not limited to movie screenings, and dj's and can happen any day of the year between 9:00 a.m. and 10:00 p.m. for standard regulations about sounds for l.l.p. his. for special events, senior inspector roberts recommend setting another sound limit to keep them in compliance. special events will include all events that may exceed the non special event sound limits. examples of special events are including live bands and musicians. the special events sound limit has not yet been determined but

inspectors will schedule a sound test to be taken at the onset of the live performance in accordance with this. furthermore, the entertainment commission staff recommends number of special events be limited to 306 per calendar year and can occur between the hours of 9:00 a.m. and 10:00 p.m. for standard regulation of outdoor sound for l.l.p. please note the location of the performance area for special events can help inside with the doors to the patio open, or outside on the patio. staff recommends the permit holder notified entertainment commission and the residents living above the venue prior to hosting special events. please note, this information has been shared with the permit applicant and they are in agreement with these conditions. in your file, are seven letters of support from current tenants who live erectly above and two letters of support for staff from the tattoo parlor, and 30 letters of support from patrons who live within the city, many of whom are mission district

residents. seven station approves this permit with the following conditions listed below. here to tell you more as the manager. >> good evening. thank you for letting me speak before the commission today. my name is lara and i am a.g.m. i am here recommending the owner for applications. it is a 42-year-old business in san francisco. we are a bar with a large beer garden and kitchen. zeitgeist is a historic legacy business within san francisco within the registry. over the past 30 years, we have had a long history of posting performance events from live music to film screening dj's and other m.c. events during the 80s and nineties. it was a popular place like monks the punk scene during that time. moving forward we have hosted a number of live music events. most recently, we hosted the official tamale lady day celebration on june 23rd,

celebrating virginia ramos' life bands played during a saturday afternoon and it culminated with a screening of a documentary about her life. each time we hosted events we have been diligent in obtaining the proper permits from the entertainment commission, staffing events to make sure the safety of our clientele is maintained and informing all neighbors with adequate notice and manager contact information and having managers present to handle issues during the event. with the limited live performance permit, we intend to continue these practices fully complying with the good neighbor policy. our intention is to host a variety of cultural events and occasional live music. we maintain an excellent relationship with our neighbors, especially the tenants of the hotel above it.
