>> good afternoon. my name is kathy bloodworth and i have a letter here from allison, a tenant on the street that cannot be here today. dear san francisco planning commission, as a colleague and sacramento street neighbor of kendall wilkinson i am writing to support her application for content notional use permit. as a retail store owner i have known kennel for the last eight years and can say first-hand that she is a stellar figure in our sacramento community whom we all love. she has always proven to be a leader with a vision for our street. she, her staff and her client support our local shops and restaurants. it is worth considering the synergistic relationship on sacramento street. designers, architects and builders bring in the high-end clients who then support the retail businesses. it is a clear business pattern we all see and very much appreciate. i would like to add as an interior designer, the sales tax revenue per design firm generates far exceeds any retail

seven vacant storefronts in four blocks. the item before us today is how do we make sure there is not going to be an eighth. i have reviewed the sales tax payments for the first and second quarter from k.w.d. they are strong. they are unsustainable without the design professional use in the back. judging from the testimony we heard today, not only will her numbers drop, but the other retail numbers will suffer as well. kendall wilkinson design has been a part of the fabric of this community for over 20 years

total, right. from my understanding there is like design professional office use, and then upstairs is more for the portion of it for the office use. >> the majority of the space is actually the design? >> so it exceeds 30%? >> that's right. >> i am very in favor of keeping this multi- decade local business running. i'm not trying to create a vacant storefront. i think this is exactly where this type of business belongs. i really like the way she's kind of taking her business and combining in a way that will enable her to stay where she is. just the supporting comments with the landlords and the many other merchants is very compelling.

i am very supportive and i think this is necessary and desirable. >> thank you. commissioner richards? >> we need to look at retail different lee. i think we all understand that things are changing and we have to be symbiotic with uses that are combined. i love it sacramento street. somebody said they could buy their whole house there. it is true. i think it is fantastic. i and i do support this business staying there. my only one comment is it doesn't quite read when i looked through the front window is a retail space. you have a table with fabrics of things. it's not as as inviting as someone could go off the street wonder in and buy a i would hope that the set up could be a little less office he and the front, and a little more retail looking so that people feel like

they can come in off the street and browse. that is the only comment i have. i do support the conditional use. i would hope we can condition it on having the front part look more retail. >> i am also very supportive of this project. i don't want to fix something that is not broken. if this works as a retail space i don't want to put any conditions on it. just my 2 cents worth. i think, you know, stepping back more like the 10,000 square feet we have controlled commercial corridors for a reason because we want them to thrive. we want to add to the neighborhood. sometimes our controls, you know have unintended consequences. i think someone through you

[reading notes] a commercial kitchen at the rear of the ground floor and existing

commercial space at the front of the ground floor which is currently occupied by a nail salon. this building was constructed circa 1900. the site is located next to a s.f. rack and park. [reading notes] to the east, across noe street is the market center that fronts on market and noe street. further to the south, on the east side of the property, on the east side of noe street at the corner of market is café florida. the product proposes to establish an adult use cannabis retail use doing business as the floor store. within a 798 square foot existing commercial space at the ground floor of the building. the proposal will involve the interior tenant improvements are

no expansion of the existing tenant space or the building envelope. there will be alterations to the exterior of the building. the project proposes minimal design changes to the exterior materials. as an age available resource the sponsor worked with the departments preservation staff to design rehabilitation of the structure in compliance with the secretary of interior standards and exempt from ceqa. another issue with the design of the building as the project sponsor is proposing to construct an off-site improvement of a 10-foot tall fence along the southern properly line of the adjacent rec. & park property. visually screen from public view the existed wall mounting equipment and provide security to the mini park. attached to this case report is a letter from department of rec. & park preliminary accepting the design of the strengths and it is included in the last sheet of

the plan set. the department had concerns on the visual quality of the existing structure due to the exposed utility box and other conduit. the sponsor is unable to build a solid wall or fence on their side of the property because the internal width of the existing trade would not meet read minimum requirements for the fire department. the department supports a solution of providing visual screenings of the utility box with a solid fence being constructed on the adjacent property. this project sponsor has verified -- been verified by the city's office of cannabis that they meet the cannabis equity program requirements. the subject parcel is not located within 600 feet radius of a parcel contain an existing public or private school or within 600 feet of an existing or proposed cannabis or medicinal cannabis retailer.

with cannabis retail uses, there is a potential for on-site consumption. cannabis may be consumed or smoked on-site pursuant to authorization from the department of public health. the project site is currently not proposing consumption lounge on site as part of the project authorization. however a consumption lounge with accessory use limits may be added under filled -- future building permit are prohibited by condition of approval for this project. added by the commission on the sponsors' in support as the staff of the commission being added to this project. the planning department has received 27 letters in support of the application from neighbors a local businesses. three letters in opposition have also been received with concerns about compatibility of the use adjacent to residences and the eviction of the existing tenant. additionally letters of support will received by the castro community benefits district, the san francisco filipino chamber of commerce, and the

neighborhood association. these letters were included in the case report provided to the neighborhood association letter contains conditions of approval that have been requested of the project sponsor. many of these conditions are outside the curfew of the planning department or the planning commission. to address a few though i stated prior, the sponsor has reached an agreement to construct a 10-foot tall fence on the property, on their shared property line for the sponsor is also in support of a condition to have on-site consumption pivoted by the commission. the letter requests that there are several yearly look backs attached to this project or condition. for the publication of the case report, one letter in opposition when letter in support have been received and i'm submitting those into the record today. the department finds that the project is on balance inconsistent with the objective and policy of the general plan and the project activates an existing retail space and supports the city's equity program. administered by the city of cannabis.

the department finds the project to be necessary and desirable and compatible with the surrounding neighborhood and not to be detrimental to persons or adjacent properties. therefore, staff recommends approval with conditions including the addition of a prohibition of on-site consumption. this concludes my presentation. i'm happy to answer any questions. >> thank you. we will now hear from the project sponsor. >> thank you very much for that mr. horn. you are very complete presentation covered most of what i needed to say to you today. i want to thank him for all of the work that he put into this right from the time of our application. he's been very engaged in working with us and the community, helping us affords the best application possible which i think is what you have before you today brett i want to thank mr. washington as well also to the trial neighborhood

association, mr. bush mr. trooper mr. white who put a lot of their own time into working with us. since our first first neighborhood outreach meeting in the first quarter of 2018 they have put countless hours into working closely with us. it has not always been easy but it has arrived at a situation that will lead to a better business at this location. i'm going to run you through a few pictures if we can go to the overhead, please? this is the existing project site. it is a disaster. we've got vinyl siding, which should have been considered an act of vandalism in any decent community. the exterior mechanical and electrical was done in the most haphazard way possible. this is what we want to do with it. this faces a closed community

garden that provides visual enhancement to the neighborhood. i think that this new fence and a new mural there were really go along way to showing the way we really feel about this neighborhood. the improved exterior, we would have liked to have gone a little bit more extravagant but the planning department preservation team felt that this was the most appropriate window design for the period. just to point out the location this is looking down at market and noe street. the café floor is at the actual corner the point of that corner that is where this business grows from. across the street, you see the mark for 258 noe street. years ago, a commissary kitchen was created there to support café floor. we are going to be using the

commercial space in front of the commissary kitchen. there will be no activity related to this in the commissary kitchen at all. again, a shot of the location this shot of the overall space. the space at the rear on the floor plan is where the kitchen is, you see there is a hard separation. it is not going to communicate in any way. through the process of meeting and working with the neighbors, and coming up with changes from where we originally started. we agreed to not make any changes to parking or to request a green zone or a white zone. we've eliminated of using the upstairs dwelling unit as a hotel, of sorts, that would support visiting chefs for the restaurant. it is going to be maintained status as a residential unit for long-term tenants only. there will be no consumption

on-site. there will never be any consumption on-site. we have designed the interior of the space to make it so it could easily be adapted to ever use that in the future. we would support inclusion of an exclusion of on-site consumption and a motion to approve this conditional use. we would ask that you do that. i'm going to invite luke bruner to close me out. >> hello my name is luke bruner i'm sorry about this, i am the general manager café floor. this is a labor of love for me. i moved down here three years ago to work on this. i was previously the business manager of a successful dispensary where we hosted the tour of humble county. i really got my start a public policy served on the state industry association. consulted for prop 64 and worked in 20 different jurisdictions. i wanted to settle down in the

>> hello. my name is dr. shelley fernandez i have been very active in's community for very years. i am the founder of a shelter of battered women for the united states. the president of san francisco now and did a class action with chinese for affirmative action and naacp and an organization. i'm also the founder of guadalupe health center which helps poverty people. as a free clinic for 18 years among i am here today to urge you to grant the permit to terrence allen. i met terrence allen in my chronic pain management class. i am now an older person, i will be hitting 90 pretty soon. i am disabled. it's very hard for me to travel.

it would be very important for me to have accessibility in the neighborhood where i live. i really can't go other places, i would always have to have people go with me and it's a big problem. i do need to use cannabis products. i don't smoke but he will offer other things, other options like a syrup edibles things like that which i do use. he is an two amazing person. he's done a tremendous amount in the city. he not only as an activist an amazing person, he's very kind, and he has given heart and soul to many causes, as i have. in this case even more things. he will provide a variety of options at this dispensary. you can get anything basically that you need there. i would say, the other thing is

-- memos of the community. for ten years now and i can and health improvement that they have found with the options of cannabis. for me, accessibility is critical. having legal clean safe and affordable cannabis. for me, having confidence in terrence as an active social justice activist and advocate. it kind and passionate member of the community. someone who authentically cares and understands what it is like for someone to have accessibility to them is on and have the options, no this is a safe space that will educate folks and give them opportunities to learn more about this ever evolving and growing industry that is inevitable for most of us who see it that way. all of this i find much relief in.

a lot of cannabis dispensaries in the q and i want to encourage the commissioners to accelerate the process because we have a big black market. and one of the reasons is we don't have enough competition. we don't have enough cannabis dispensaries. and we also need locations to consume. so along with terrance in this application i strongly encourage you to look at that issue and we realize, you know it has to compete with other important things. but given we are just starting out, i would encourage that. so please, i would like to see unanimous consent to this to show the community that people like karen who spent their life here, dedicating -- terrance, who spent his life here, that that is rewarded by unanimous

vote of the commissioners. >> thank you. next speaker please. >> good afternoon commissioners. my name is joseph reese. and i'm here to read a letter on behalf of state senator mark leno who was unable to attend today. dear sf planning department and district supervisor, terrance alan and i have known each other for over 20 years and worked together on many community and business projects while i was a member of the sf board of supervisors california state assembly and senate. we collaborated on legislation that created the san francisco entertainment commission and he became the founding president of that commission. terrance satireless satireless advocate. his proposal to add cannabis retail to the upper

castro is worthy of serious consideration and support. as a business dating back to the 1970s, floor is a great location for a small neighborhood serving cannabis retail store. after eight years serving on the entertainment commission, terrance knows how to operate such a business without creating problems for the neighborhood. i am confident that terrance will embrace the kind of community review and participation that will make this idea successful for all who are involved, sincerely mark leno. thank you. >> thank you. next speaker please. >> good afternoon commissioners. my name is guy carson. when they purchased the cafe in 2003 the intersection of church and market street was sometimes referred to as the gateway of the castro. no one talks about that anymore. people talk less and less about the

castro. the sad real reality has been declining over the years. i know this because i'm a commercial realtor i'm in the business of businesses and commercial leases. the last year san francisco lost 300 restaurants. it will lose more this year. just on my way here i counted seven restaurants in the castro and upper market within the last nine months, that have gone out of business, are up for sale and two have been completely abandoned. so it follows to me, i think the city of san francisco and this commission particularly should embrace new innovative retail concepts and do whatever they can to lower the barriers to entering the marketplace because it's currently prohibitively

expensive. it's in this context that cannabis legalization comes to us as a bit of a blessing and lo and behold despite some protests i think our dispensaries have proven to be great community partners and have brought wealth to the city coffers and communities. i've known terrance for 15 years. i echo everything that's been said in the last few minutes about terrance. i have no doubt that he will be a responsible operator. he's proven it so far already as an owner operator of cafe floor. i know his dispensary will bring increased foot traffic and increased security to this very strategically

important intersection. i strongly support this dispensary and urge you to vote in favor of this application. thank you very much. >> thank you. next speaker please. >> hello i've lived in san francisco for the past 28 years 23 of those in a home in the middle of the castro. i've been asked to have everybody in favor of this proposal to stand at this time. i speak today in flavor of the floor store and its impact, its vital impact on the business i'm more familiar with, cafe floor. more importantly a community gathering place that is a cross roads in its history. whenever i hear a business bemoaning threat its financial downturn my question is what have they done to stay relevant? too many restaurants open their doors day after day with little regard for changing demographics or other

current trends. how many slap a fresh coat of paint on the building every once in a while. everyone with floor has seen this evolution from exterior improvements product presentations and special events. now it's embracing the cannabis revolution. as we have grown to accept and recognize cannabis for medical reasons and recreational use putting aside reactionary rhetoric, so floor is a gathering place for the lgbtq community and the desire city. how many decisions have been made over a cup of coffee at floor. how many dollars have been raised for charities large and small at events at this venue. and how many of us have found a home away from home at this location. i ask you grant their

>> thank you. any other public comment on this item? . >> good afternoon, president melgar and commissioners. david, land use chair for the neighborhood association. a few months ago i stood before you on behalf of dta and offered support of another proposed cannabis dispensary in our neighborhood, praising the project's sponsors transparency and outreach to the community. this project is a little different. there exists sadly great distrust and skepticism about this project in our neighborhood.

nevertheless we support approval of the floor store project but only with specific conditions. conditions that were crafted after 16 months of extensive discussions to address the serious concerns that the neighborhood has regarding this project. the project sponsor agreed to the conditions but they member memorialized to ensure they are observed. there are four primary concerns. number one the project sponsor of the floor store is a corporation, which is majority owned by another corporation and corporation is owned by a long list of investors. the largest stockholder is from los angeles. the ownership structure make it important that the agreed conditions be included in the cua and that the planning commission revisit the project in coming years to ensure that it is abiding by its conditions and its impact is benign. number two, 258 noe

street is located at the end of a short side strip off the main market street commercial corridor at the enters to our residential neighborhood. some time ago, much of the wall separating the property from the garden was removed leaving ugly panels and cables exposed to public view and allowing inhindered access to the community garden as the gate can't be locked for the fire department. the project must mitigate these issues. number three the project will displace a long established neighborhood that has strong ties to residents and might not be able to relocate nearby. dta had never before been asked to support a project that would displace an existing business. this was troubling given our many retail vacancies. it was important to us that the floor store help us relocate which they agreed to do and we thank them for that. number four. past behavior

beaver street. the neighbors are directly affected for the floor store as we dealt with years of trouble on that corner and around the community garden. the noe beaver corner has a long history of being stressed with drug use. the community garden was a mini park which became a gathering point for homeless and drug use until at one point a fight broke out that ended with a homeless man being killed on my neighbor's front steps. then it was a community garden but continued to be a place for drug deals by the fence. it's also been a magnet for homeless that shoot up in front of it, trash being dumped along with public urination. our concern about our neighborhood safety, security and cleanliness was evidenced by the large number of beaver street numbers on the may 22 and august 19, 2019 community meetings regarding

the floor store. neighbors are doubtful a pot shop will be an improvement to our neighborhood. in community meetings the floor store tried to address our concerns by cleaning up around the community garden but the majority of my neighbors remain skeptical. in the 26 years i lived on beaver street i witnessed the past owner telling us he was going to do one thing and once he got approval did another. in order to get my neighbor's direct input instead of just their comments i sent out a survey to beaver street neighbors on august 30. i needed to have their feedback before the september land use committee meeting. so in just three days, 25 responded. the results, only one neighbor offered complete support with no conditions. five supported with conditions eight were neutral but felt if approved, the proposed conditions were essential, 11 were completely opposed but if approved wanted conditions therefore 24 out of 25

beaver street neighbors who responded wanted conditions that were proposed by the land use committee that the floor store has agreed to. my neighbor bob bush will go further into detail about the conditions representing all the dpa not just beaver street. beaver street neighbors continue to be doubtful about whether floor store will keep their promises and comply with these conditions. so we need it in writing and we need to have the planning department review the project before compliance one two and five years after use of approval. my neighbors were feeling helpless when they got word the planning commission might approve this project without the conditions proposed, which is why we have asked that i would represent their hopes and views and that you take into account our dedication to making sure this project is not a further nuisance and downgrade to our neighborhood. thank you for your consideration. we ask that you act favorably on our request for conditions on the approval. >> thank you. next speaker please.

to the store or on the external portion of the building or in the mural that's to be painted overlooking the garden. we would like to be sure the commercial kitchen at the rear of 258 noe street remains separate, operatively and physically from the store and that there be no use or preparation of cannabis-containing products in that commercial kitchen. for security we've asked there be a security person there when the store is open and that there also be 247, 365 days a year video surveillance of this store. that the gate be, the wall be funded, and that the improvements that they have presented in their plans will actually be performed before the cannabis sales begin. some of

mission for 25 years. and we are members of the corridor association. and we are very involved in the community. and i'm here to support mr. alan because i know that the cannabis thing is an inevidentability and i know there are commissioners here, commissioner fung that have been against cannabis but i see it as inevitable and i see it as innovation. i see san francisco as a city of art and innovation and a city of people and they are artists and innovators. i lived in neighborhood i live one block away from the proposed site. i have two kids, and we walk by that site sometimes four times a day. we are there in the street right in front of that location every wednesday night for the community farmers market and stuff. and terrance allen and the whole cafe floor community is an integral

sports bar and i've even been to the cafe a number of time it is. i know mr. allen has been a pioneer in the night life, entertainment and recreation industry in this city, and he paveed the way for a lot of the things that we have here now in the city. this is a very tight little knit neighborhood. just look at the farmers market and you'll see an example of what holds this neighborhood together. cafe floor an iconic establishment in the castro. with terrance here and the castro merchants i'm leaning towards supporting this project today. what i look at most is beside the location, what's nearby and whatnot is the operator. so if it's a good location and a good idea with a bad operator that's not going to be a good business so i'm confident with who i'm hearing from today this will succeed. i do also still want
