you going to do that? >> so there is an actual e-mail campaign that we have to identify which identifies individuals that have not utilized their dental benefits. specifically cleanings, in the last seven months. that's what the data looks at. and then what we'll do is that campaign will specifically go out to that member and say, hey, we noticed that you haven't had a cleaning. do you need help finding a dentist? do you need help in understanding your cleaning benefit? click. then if they do go and have a cleaning, we actually reward them with another e-mail saying, congratulations, we see that you did go to the dentist. do you want to have us send a reminder e-mail to you in the future to set your secondary

cleaning appointment? and they can elect to either, yes, have that third e-mail, or, no, not. so that's just one of the e-mail campaigns specific to cleanings and driving that behavior and increasing that behavior. however, we're continuing to work with the hss team in order to identify other methods, other avenues to continue to get that message out, get a cleaning, it's so important, prevention is so important. >> i have a question outside of this presentation. if that's okay -- a meeting in last may, whoever presented -- i don't know if it was you -- they said the premier option was available to all including new dentists and then it was explained to me, no, it wasn't

open to everybody, you had to also join the ppo. and then they also said at one point that they were definitely not planning to eliminate the premier status. so is that still a case, or are you considering eliminating the premier status? >> we are not planning to eliminate the premier dental contract. we are going to continue to contract with dentists in ppo and premier network. >> but you only have -- you only have one ppo network. no, a ppo contract, i mean. >> hss has elected how the plan design works, it's a ppo plan. so your dentist and where the most savings is with a ppo provider, however, there are multiple contracts, so we've got

our old contracts legacy that still some clients that only offer a premier network plan. yours is a ppo, which 97% of our clients offer a ppo network. and so, again, the providers, we've got a lot of ppo premier providers and then old legacy contracts just premier solely. >> but you can't -- they can -- the new dentists cannot sign up for just premier? >> that's correct. >> they have to be ppo and premier. i find it confusing when you say it's one contract for two different benefits. >> president follansbee: okay. other questions or comments from board members? >> commissioner scott: i wanted

to thank delta for this first quarterly report. it was very informative. and it at least gives us a basis for which we now can see any ensuing communications or emphasis that we want to use with our members around these benefits. so, i'll look forward to seeing, hopefully, with the plans that you've outlined some improvement in a number of these areas over the next quarter. and this is information that we've never had exposure to before. so thank you very much. >> president follansbee: i'll add to that and concur completely. and just acknowledge that i think there is a lot of dialogue that has been going on through our h.s.s. personnel, including abbie, in order to help clarify what we're looking for, what

benchmarks we want. and as commissioner breslin has accurately outlined, where we would like to go in terms of seeing improvement in utilization for all the programs at all levels of care. and so i think that i want to congratulate also abbie and the staff for working with delta as well as delta for being engaged in these conversations. and the outcome that we saw today. >> thank you. >> i was just going to say, thank you, commissioner. i think it's been an educational-year for all of us -- journey for all of us. the end goal is to provide the services at an affordable rate to improve oral health of our senior population in particular. and that having the transparency both to the board as well as the members, so that they understand, since members are purchasing this benefit at 100%, we're working really hard to be

sure that they're informed about what they're buying. and what the benefits are, the cost benefit is. so that they can make an informed choice. so, that's a journey that we're not there yet. but we've made significant progress. >> president follansbee: any other comments or questions? >> yes. >> commissioner zvanski: i do have some questions, because i think dental care is very, very important. and i really find this very compelling and interesting report. but part of my concern is a lot of what i've heard from a number of our retirees, and that is during covid, getting preventative services such as cleaning and other kinds of nonemergent dental services has been challenging. that a lot of seniors are reluctant to go -- you know, you

can have video meetings with your physician, but really hard to get a video cleaning or preventive services with your dentist. and i wonder what you discovered during this time, this last year, year and a half, that we've been going through all of the restrictions when we look at the utilization. as karen pointed out, these low percentages. do you find that impacted by the whole covid thing and how do these statistics compare with prior utilization? >> great question. that's why on that dashboard we were showing 2019 data. and specifically quarter 2 of 2019 to compare apples to apples quarter 2 of 21. you're correct.

in covid and what we reported in march, the mid march and then all of april and may of 2020, we saw a very significant decrease, almost nonexistent, of claims coming in. and that was the trickling of dental claims that did come in during that two-and-a-half month cycle was really just emergency dental services. so there were dentists that were still open during the shutdown, but, of course, only for emergency. what we've seen, though, as we came out of that june, kind of july of 2020, the claims actually went right back to norms. so norms when we look at 2019 data. and when we finished out 2020, we really saw that -- of course, those two-and-a-half months definitely dipped, but we were

back to almost normal levels. and as we've gone into now 2021 -- and i know there has been that rise of covid, of continued on and off restricts restrictions, our dental offices have remained open and there has not been another shutdown. so members are able to seek services and get that cleaning. and in a very, very safe environment. it changed drastically going into a dental office compared to pre-covid to now. and so they're taking huge strides to make sure that office and that experience is very safe for the member. so i want to assure the membership, the sfhss membership, that it is safe to go to your dentist. and there is a number of protocols that they're now doing to work within the covid

confines. as far as 2021 data, again, going back to that conversation, very slightly we're seeing there is a decrease in overall claim utilization, but really we're back to normal. and when we say normal, we look at 2019 data. we do have a tele-dentistry to give and afford members to have that dental exam virtually. one is toothpick and other the tele-dentistry or -- i'm forgetting the name -- but the toothpick, you take, download app, take a picture of your teeth, fill out a form and a ppo dentist in 24 hours would provide analysis of those

pictures and that survey. whereas, if you wanted a virtual consult -- that's the name -- you would actually sign up for an appointment with a ppo dentist and you would actually be face-timing with that ppo dentist to talk about your dental concerns. that has been put on to your micro site. there is a link to both of these virtual consult and tele-dentistry as a whole. they can call the contact center. and we put information about this also in your guide. and this, you know -- as we continue to communicate and get information out to members, we're hoping that they'll take that as a kind of safe approach in just an introduction to get an exam, but from the comfort of their own home, in case they

>> how i really started my advocacy was through my own personal experiences with discrimination as a trans person. and when i came out as trans, you know, i experienced discrimination in the workplace. they refused to let me use the women's bathroom and fired me. there were so many barriers that other trans folks had in the workplace. and so when i finished college,

i moved out to san francisco in the hopes of finding a safer community. >> and also, i want to recognize our amazing trans advisory committee who advises our office as well as the mayor, so our transadvisory community members, if they could raise their hands and you could give a little love to them. local policy and make sure that that is implemented, from all-gender bathrooms to making sure that there's lgbt data collection across the city. get to do a lot of great events in trans awareness month. >> transgender people really need representation in politics of all kinds, and i'm so grateful for clair farley because she represents us so intelligently. >> i would like to take a moment of silence to honor all those folks that nicky mentioned that we've lost this year. >> i came out when i was 18 as trans and grew up as gay in missoula, montana. so as you can imagine, it

wasn't the safest environment for lgbt folks. i had a pretty supportive family. i have an identical twin, and so we really were able to support each other. once i moved away from home and started college, i was really able to recognize my own value and what i had to offer, and i think that for me was one of the biggest challenges is kind of facing so many barriers, even with all the privilege and access that i had. it was how can i make sure that i transform those challenges into really helping other people. we're celebrating transgender awareness month, and within that, we recognize transgender day of remembrance, which is a memorial of those that we have lost due to transgender violence, which within the last year, 2019, we've lost 22 transgender folks. think all but one are

transgender women of color who have been murdered across the country. i think it's important because we get to lift up their stories, and bring attention to the attacks and violence that are still taking place. we push back against washington. that kind of impact is starting to impact trans black folks, so it's important for our office to advocate and recognize, and come together and really remember our strength and resilience. as the only acting director of a city department in the country, i feel like there's a lot of pressure, but working through my own challenges and barriers and even my own self-doubt, i think i've been

try to remember that the action is about helping our community, whether that's making sure the community is housed, making sure they have access to health care, and using kind of my access and privilege to make change. >> i would like to say something about clair farley. she has really inspired me. i was a nurse and became disabled. before i transitioned and after i transitioned, i didn't know what i wanted to do. i'm back at college, and clair farley has really impressed on me to have a voice and to have agency, you have to have an education. >> mayor breed has led this effort. she made a $2.3 million investment into trans homes, and she spear headed this effort in partnership with my office and tony, and we're so proud to have a mayor who continues to commit and really

make sure that everyone in this city can thrive. >> our community has the most resources, and i'm very happy to be here and to have a place finally to call home. thank you. sub stake has ever come before you. i was astonished when i read the thereport. those are usually not the ones that go deep into the strongest reasons why preservation should be done. it was astonishing, you know. i knew it was important to the q lbgq district where i live in 69, really. when it was at the time it was appropriate for gay rights and the place where people from knob hill went, where everybody went from the community we women would have not gone to the gay bars. it is still there. it was charming. we understood it hasomething to do with a railroad car. in 75 next door to it because

there was the customers in the lbgq district at the time they added next door a charming dining room that is part of that era. the arguments made against -- by people opposed it the developer who bought it to teardown, obviously, were, number one, the dining room which was part of the lbgq era made the railroad car not important. then it was a lunch car. when i read about that it goes back to 1950 in that district. it mist have come directly after the earthquake. moving to the location where it is now before world war ii, been there ever since in the neighborhood. there have been changes to the

lunch car, which turned into our diner, you know, went from historic lunch carbs to the historic diner business, it changed things that any restaurant would happen. no restaurant has the same kitchen over 100 years of the same toilet equipment and minor changes like light fixtures at the top or things of that sort, you know. a charming place. in every other district all of the lbgtq landmarks are proposed everywhere except nob hill. it is play to play. we have the operation where you pay to get recommendation. these people were told the $1,000 unit for the building they planned to build were not enough because there was too much opposition. they had to pay more, $40,000

was recommended. i don't know how much they paid or did not pay for letters from other organizations. you know, because this had been an lbgtq welcoming place. >> your time is up. >> hello commissioners, i reside in calhara. i am calling about clay theatre built in 1912. the clay theater is one of the few remaining single screens in san francisco. architectural jewel original design from 100 years ago is intact today. supervisor catherine stefani who represents district 2 has introduced a popular land mark resolution for clay theatre

u.c.s.f. awarded a san francisco based firm to remove murals and preserve it. at the same time to create a task force for a new location. h.p.c. requested to be part of that and that was granted. h.p.c. also asked because a member of the public was interested in seeing the task force be expanded to other members of the community to consider other names submitted. we still have not received a response from them. in the interim, a legal suit was filed, injunction was filed by various groups opposed to the expansion of u.c.s.f. what that means is that everything stopped. meaning any preservation, any plans to reuse the murals

can i just confirm, first, that the slide deck is up right now? >> yes, we can see it. >> okay. great. thank you. good afternoon, commissioners, planning department staff. the item before you is the state mandated accessory dwelling unit for a.d.u. ordinance introduced by the mayor. today i am joined by our team manager and coordinatetor as well as peter from the city attorney's office. this is the same ordinance that appeared in front of you last year in november of 2020. some of the changes were referred to you that is why we are back today. the goal is to align our a.d.u.

program with changes to state law which clarified the ministerial review process for a.d.u.s. the focus of the ordinance are things we are required to do to comply with state law. the ordinance now incorporates recommended modification moved by you and planning commission to retain the preference to the objective architectural review standard. the ordinance now reduces the permissible site for a.d.u.s in response to planning commission concerns 1200 square feet would impact the space. lastly, this version of the ordinance includes clarifications for things required by state law. mainly one new bill requires the city to ministerially consider

application to consider a.d.u. on a lot containing an existing or proposed single family home. last year before this applicants to only choose one or the other. additionally, the ordinance imposes a new 16-foot height limit on certain a.d.u.s. original ordinance listed 16-foot height limit for attached a.d.u.s. to emphasize the 16-foot height limit is still required by state law and amendment would list this requirement out similar to how it is listed for detached a.d.u.s. under state law there are two buckets of state mandated a.d.u.s rebranded since the last hearing. first, state a.d.u. program previously known as streamlined

a.d.u.s. they also have the hybrid program previously known as ministerial. under this bucket we also have a new type of a.d.u. called junior a.d.u. which can convert 500 square feet of single family home. calling for each with a few highlights on the slide with different buckets in mind and our local program. property owner may qualify for more than one type of a.d.u., and in that case the staff will work with the applicant to clarify what they qualify for. ultimately it would be up to the applicant to decide what type of a.d.u. they want to pursue. ordinance includes a few big picture changes on the slide and discussed in the staff record. the primary reason this ordinance is in front of you today is because it amends

article 10 and 11 to explicitly say proposed state man datessed a.d.u.s in article 10 and 11 would be except from permits to review so long as they comply with state law. the change to article 10 and 11 is required. in this ordinance, there are three clarifications made to the local program not required by state law. these are all non substantive and clarifying of the code. the only change here that was not included in the original ordinance is that detached a.d.u.s located in the rear yard are measured from grade to the top of the flat roof or mid

point of a pitched roof. state law did not define how high is measured. this clarification requires us to measure similar to other structures in the rear yard. after the packets per published the permit received one e-mail which included general questions regarding the state law and urged support of a.d.u. construction within the rear yard. to close this ordinance covers the same item from last year which focuses on bringing our code in compliance with state law changes. staff recommends approval of the ordinance with modification and the modification is listed on the slide for you today. recommended modification relates to other local programs.

for some context, the hybrid program understate lawal laws up to two detached structures up to 16 feet tall with 4-foot rear and side setbacks. they need to require with the required program. after the staff report was published we realized this would be difficult to construct two detached a.d.u.s in the rear yard. the recommended modification today is to allow up to two detached a.d.u.s with the same height and set back parameters within the required rear yard. this proposed modification for the a.d.u.s under the local program to yield more rent controlled units. this concludes our presentation. i am available to answer any questions along with the rest of

i don't know and if any of you can answer that would be great. are there any ways in which cities can petition the state to address rent control and preservation concerns specific to sf? you brought that out in the text of the packet. then, you know, at the end of it you said that you are thinking of things to incentivize the local program. i wondered and these are obvious. something related to property, taxes or, you know, promotion of property values with compliance, you know, the mills act for preserving properties to encourage multiple ways in which

people can get something out of it. even though they may not be under the rule for the state for the a.d.u., maybe they would be encouraged to kind of fit whatever they wanted to do within the parameters within the mills act. obviously, the big thing is streamlining the local program so that it can compete with the state program. i don't know enough about it to say that, but just putting those ideas out there. if you have any answers to those. thank you. >> thank you, commissioner. i will go ahead and start with general information for you. i will invite some of the team members to join shortly. i believe your first question related to if there are ways to

petition or lobby for the state to accommodate more rent control aspects here. for that question, we are able to lobby for general restriction where the a.d.u. would be allowed or not allowed on the property or any other input on height or setbacks. however for the rent control that is nonnegotiable for the state-mandated a.d.u.s. i will invite our city attorney to provide the technical response why rent control is not permitted then jump back in for the other questions. i will pause here for a moment. >> or even, you know, besides rent control, even petitioning for preservation aspects.

>> thank you. just quickly. for the preservation aspects, part of the reason why we elected to include the reference to the objective architectural review standard that is more immediate input, and as we described in the staff report the delegation agreement you saw earlier this month or last month, rather, incorporated those architectural standards applicable to a.d.u.s and other dwelling units really. the delegation agreement has resolved the conflicts between state mandated a.d.u.s and the state law.

in exchange for direct financial contribution or some other benefit that the local entity is providing to the property owner. if that benefit is there, there is a contract, bargain between the property owner and local entity, then the local entity can impose rental rate restrictions on that property pursuant to that contract. in order for that to work, the city has to have authority to deny or modify the proposed project. so they have something to bargain with with the property owner. otherwise it wouldn't be a valid contract between the property owner and local entity. that works in the context of the city local a.d.u. approval because that is discretionary. city has authority to deny or condition or modify construction

>> thank you. i just want to start out very quickly by giving a little shout out to staff. one of the challenges of being a planner in california is the every involving state laws that we are required to comply with. the process of compliance of each of these changes is complicated. you have seen several attorneys involved and there is this roundtable or whatever departments in the city. this stuff takes a lot of staff time and takes them away from other important programs. in the past code and policy changes related to housing related every five to eight years as the housing numbers were to each city. in the past three or four years this stuff is coming in so fast and these are just housing changes. there are other state mandates

staff have to manage. still they are cranking out routine applications and developing problematic changes. they took over a.d.u. review from the department of building inspection last fall to help during covid. having said that, it is what it is. we need housing and these changes are definitely needs especially in communities resistant to changing single family laws. they really resist even a.d.u.s. i appreciate the pilot program for using state funds to add a.d.u.s. that is the target we should look at. i support a similar city-wide program to look for other funding sources as the state funds will deplete for. i support supervisor mandelman's

proposal mentioned in the report. i like the junior a.d.u.s as a means of providing additional housing types for extended families. that works for lower income families and those who need caregivers and those who need to supplement their income. obviously, i share the disappointment concerning potentially inappropriate modifications to landmark buildings. you know, with the intent of trying to get a lot of housing built and built quickly, matters like preservation take a back seat. it would seem to me based on the conversation we had with the city attorney and staff, it occurs there could be collaboration between san francisco city leaders and some other city leaders to lobby the state to address preservation

planning department staff. i would like to address some of the questions you have raised. in regards to the topic of preservation, since state law requires we approve the a.d.u.s in administrative process they are not subject to ceqa. state law does allow us to impose standards that prevent adverse impacts on any real property listed in the california register of historic places. they are not required to go through the process they are required to comply with the standards, specifically for real properties listed on the california register. we also can recommend and often do the design modifications. even though applicants are not required to comply. we suggest recommendations to
