then press pound and pound again. if you haven't done so, press star 3 to line up to speak. >> supervisor peskin: thank you. as you will recall, we heard this item last week, there were originally five applicants, one of the applicants withdrew prior to the hearing last week. we heard from the four applicants, i want to thank all four for their willingness to serve. and i don't want to put words in the mouth of the committee, but i think we were particularly impressed by two of the applicants and continue the item for one week and it is scheduled as a committee report in the intervening week, i believe we have gotten some letters of support, particularly for jesus gabriel yanez but also for david rizk. i want to remind my colleagues on the committee and members of the public, there will be

>> supervisor peskin: thank you mr. young. colleagues, this hearing was initiated by board president walton who is joining us this morning, back in october i believe and co-sponsored by myself, supervisor chan, supervisors ronen and preston and introduced in the wake of allegations in the local media in this era where we are all walking on eggshells relative to any number of unfortunate discoveries that have led to this hearing. i don't want to put words in the mouth of our board president who called for it. we'll turn it over to president walton. >> supervisor walton: thank you chair peskin and members of the committee. as supervisor peskin stated on october 19th of this year, i introduced a hearing at the board of supervisors to seek

additional information regarding allegations that mr. honda participated in discussions and decisions at the board of appeals in which he may have had a financial conflict of interest. i did ask supervisor peskin to make sure we scheduled this hearing today at 10:00 a.m. and requested mr. honda's atendance. i do see commissioner honda is here. i do want to state for the record, i have no personal knowledge about the substance of such allegations and i make no assumptions about their reliability. so the primary purpose of this hearing is to gather information about the allegations and allow mr. honda the opportunity to respond to them publicly. i did send mr. honda a letter on december 2nd of this year electronically and by mail

requesting documents in advance of today's hearing. we did not receive any of the documents. again, i just want to be clear, today's hearing is to hear from mr. honda and get a public response to allegations previously stated. i'm not sure if he brought the items in today or sent them over today but i will pass it back over to chair peskin. >> supervisor peskin: just a few minutes before the beginning of the committee meeting, we received from mr. honda's laura letter signed by mr. honda setting forth that he is in the process of procuring the documents and asking for a

continuance. i will let mr. honda speak for himself. the floor is yours. >> good morning. again, i sent a document over and i'm going to read from a prepared statement. i'm submitting this letter in connection with today's hearing before the board of supervisors rules committee regarding certain votes i took in 2015 and 2017 on matters before the board of appeals. i want to emphasize at the offset that i have been honored to serve on the board as an appointee of the mayor and the board of supervisors. i take the position very seriously and spend a significant amount of time every month reviewing documents and

talking to city staff and attending hearings. i'm proud of the work i have done at the board of appeals. i want to emphasize i take compliance with all the ethics and transparency laws seriously. and pay attention to whether i need to recuse myself. and i have requested guidance from the city attorney from numerous occasions and noted several times i have done work with the party's representative and recused himself from numerous matter from the years i have received income from the party within the prior 12 months. >> supervisor peskin: not to interrupt you, i think you mean myself, not himself. >> sorry, myself, correction, thank you chair peskin. since the mission local article appeared in october, i have started going through my records and reviewing videos from 2015

and 2017 meetings to determine if i should have recused myself on the matters. i believe i acted properly in all of the matters, to the best of my recollection, i have not received income from the parties in the prior 12 months. i look forward to closely reviewing this to make sure i complied with all legal requirements. he sent a letter 10 days ago asking for certain documents. i have started looking for these and asked my brokerage firm to do the same. they are allowed to keep them for three years and generally keep them in storage after that. since these documents date back to 2013, i'm not able to provide them at this time. some of the documents may not even be able to be reproduced. i respect the committee's interest in getting to the bottom of the situation.

i'm interested as you are in making sure that i understand the conflict of interest rules and that i have recused myself when legally required to do so. i also want to emphasize that i will of course cooperate with the rules committee inquiry, however i'm not in the position to answer any questions at this hearing regarding specific board of appeals matters or specific financial transactions. because the committee is looking at whether i complied with city law, i could potentially face legal liability and enforcement matter brought by the ethics commission, city attorney or district attorney. in light of the potential liability, my attorney, who is actually here with me now has advised me i should not answer specific questions in a public meeting at this time. in sum, i'm requesting more time to compile the relevant

documents and review the facts and law with my attorney so that i be in a better position to answer the questions about the 2015 and 2017 votes. i expect to be able to provide committee with all relevant information about the votes after the holidays by friday january 7th, 2022. i respectfully request that the committee reschedule for a date in late january which would give the committee full opportunity to review the information and therefore have more productive discussions in a future hearing. i look forward to assisting the committee in understanding all of the relevant facts in the board of appeals matter and appreciate your cooperation in giving me more time to comply with your request. thank you. >> supervisor peskin: thank you mr. honda. let me start before we hear from president walton by saying a few things.

one, in the spirit that president walton said outset of the hearing, i come to this with no bias of any kind whatsoever. i think our job is to conduct a thorough investigation of the facts wherever that leads. and as the chair of the rules committee, i'm committed to doing that without bias and impartially. i do want to note, however, that i have a long, good personal relationship with you mr. honda and that your daughter was an intern in this office for many years who i enjoyed working with and one of my star interns and i want to disclose that mr. sutton has served as a lawyer for at least one of my campaigns. so i have a long and good history with your counsel in this matter.

i wanted to put that on the record. and say that i think there are two things that this committee needs to look at. one is the facts as they relate to the obligation to recuse when there's a financial conflict of interest. the other is the obligation to disclose when there may be a financial conflict of interest. i think those are the two areas that are important for this committee to look into. i will also note that i had an actual telephone conversation with mr. sutton yesterday and in that conversation noted that president walton introduced this hearing request back in october on october 19th and wanted the item scheduled at the rules committee shortly thereafter,

but accommodated actually mr. honda's schedule and so far was going to be i believe in france for some period of time and hence president walton ask that it be today. in my conversation yesterday with mr. sutton, he indicated that those documents could be produced by the end of this calendar year which would be almost a month after president walton requested those. i think that would be preferable to hear this not at the end of january, but earlier in january which i know president walton would like to do. with that, i'll hand it over to president walton. >> supervisor walton: thank you supervisor peskin. i agree with you on the timeline. i do have a question through the chair and after reading the letter and hearing from mr. honda, i just want to at least

unmuted and you can start your comment. i believe we have four people listening and one person in line to speak at this time. >> supervisor peskin: first speaker, please. >> good morning supervisors, i'm scott sanchez, a former employee of the planning department and speaking as a member of the public. from 2007 until last month, i had the privilege of being the planning representative at the board of appeals. i worked with almost 20 different board members and three different executive directors and i developed respect for the work of the board of appeals and have been impressed by the integrity of all board members, including commissioner honda and all board staff. in my experience, i have seen

commissioner honda prioritize honesty and fairness at the board. and doing the right thing means a lot to him. these characteristics and his skills and knowledge make him an asset to the board of appeals and city. i just wanted to share those thoughts with the board. i appreciate the ability to speak on the matter and strongly support the continued work of the board of supervisors to provide oversight and accountability over all city functions. thank you and have a good day. >> supervisor peskin: thank you mr. sanchez and for your service to the city and county of san francisco. i for one am very sorry that you are no longer working at the planning department but i am delighted you are staying involved. are there any other members of the public who would like to comment on this item? >> clerk: that completes our public comment list.

>> i would like to comment. sorry, i would like to comment and i did submit -- >> supervisor peskin: go ahead. >> hi, how are you by the way? i am an attorney in san francisco, i have been dealing with darryl honda for i believe it is nine years now, both personally and professionally. i have gone up against the board of appeals several times. i have always found him to be extremely professional, extremely unbias and i feel that this and what supervisor walton is doing is horrific. i am appalled that the board of supervisors would feel it necessary to bring this up when

walton, the matter to the call of the chair, our desire is to hear it on the 10th. is that acceptable? >> supervisor walton: yes, sir, thank you chair peskin. >> supervisor chan: thank you chair peskin. i want to respond to the caller's comments specifically about the matter, why this is before us. let me be very clear. i think that given the state of the city and looking at the condition of our streets around public safety, around so many issues that our city faces is exactly that we want to make sure that we stop the pay to play culture in san francisco and in our city hall. it is our responsibility as elected and appointed body to make sure we hold ourselves at a higher standard to conduct city

business. this is not about just commissioner honda, this is just all across the board, why we're making sure that everyone, ourselves as elected officials as well as those that we appoint to make decisions on commissions, task force, it is critical. i certainly hope, you know, in january when we start -- when we have the hearing and we have the record, that mr. honda can speak to his record and demonstrate whether there was or was not any conflict of interest. i think the public deserves to know. i would think mr. honda would want the public to know as well. i just wanted to say that i am in support of president walton's request for hearing on this matter and i think that we not only need to continue the hearing but also to make sure

san francisco owes the charm to the unique character of the neighborhood comer hall district. each corridor has its own personality. our neighborhoods are the engine of the city. >> you are putting money and support back to the community you live in and you are helping small businesses grow. >> it is more environmentally friendly. >> shopping local is very important. i have had relationships with my local growers for 30 years. by shopping here and supporting us locally, you are also supporting the growers of the flowers, they are fresh and they have a price point that is not imported. it is really good for everybody. >> shopping locally is crucial.

without that support, small business can't survive, and if we lose small business, that diversity goes away, and, you know, it would be a shame to see that become a thing of the past. >> it is important to dine and shop locally. it allows us to maintain traditions. it makes the neighborhood. >> i think san francisco should shop local as much as they can. the retail marketplace is changes. we are trying to have people on the floor who can talk to you and help you with products you are interested in buying, and help you with exploration to try things you have never had before.

>> the fish business, you think it is a piece of fish and fisherman. there are a lot of people working in the fish business, between wholesalers and fishermen and bait and tackle. at the retail end, we about a lot of people and it is good for everybody. >> shopping and dining locally is so important to the community because it brings a tighter fabric to the community and allows the business owners to thrive in the community. we see more small businesses going away. we need to shop locally to keep the small business alive in san francisco. >> shop and dine in the 49 is a cool initiative. you can see the banners in the streets around town. it is great. anything that can showcase and

grill. >> i am the owner. it all started with banana pudding, the mother of them all. now what i do is take on traditional desserts and pair them with pudding so that is my ultimate goal of the business. >> our goal with the bayview bristow is to bring in businesses so they can really use this as a launching off point to grow as a single business. we want to use this as the opportunity to support business owners of color and those who have contributed a lot to the community and are looking for opportunities to grow their business. >> these are the things that the san francisco public utilities commission is doing. they are doing it because they feel they have a responsibility to san franciscans and to people

in this community. >> i had a grandmother who lived in bayview. she never moved, never wavered. it was a house of security answer entity where we went for holidays. i was a part of bayview most of my life. i can't remember not being a part of bayview. >> i have been here for several years. this space used to be unoccupied. it was used as a dump. to repurpose it for something like this with the bistro to give an opportunity for the local vendors and food people to come out and showcase their work. that is a great way to give back to the community. >> this is a great example of a public-private community partnership. they have been supporting this including the san francisco public utilities commission and

mayor's office of workforce department. >> working with the joint venture partners we got resources for the space, that the businesses were able to thrive because of all of the opportunities on the way to this community. >> bayview has changed. it is growing. a lot of things is different from when i was a kid. you have the t train. you have a lot of new business. i am looking forward to being a business owner in my neighborhood. >> i love my city. you know, i went to city college and fourth and mission in san francisco under the chefs ria, marlene and betsy. they are proud of me. i don't want to leave them out of the journey. everyone works hard. they are very supportive and passionate about what they do, and they all have one goal in

>> hi everybody., people. i'm san francisco mayor london breed and it's great to see all of you here today and miguel even dressed up for me today. looking good. i like your hair cut. looking real, real good. first of all, let me just say, this is a long time coming. and i know many of you are apart of the fabric of what makes san francisco great and this l.b.e. program was so important to ensuring that businesses in san francisco have an opportunity to succeed and so we were looking at reforming this program to ensure that it is available it's accessible in general and it helps not only those

companies that want to get city contracts and do work in the city, but, also, we wanted to make sure that once companies are part of the fabric that you're able to grow and thrive and to continue to succeed and then to hire and then help raise the next generation of contractors in san francisco. and so the program, of course, has been complicated, it's been challenging, it's difficult to deal with and everything in between. even when i was a member of the board of supervisors, we've been talking about reforming this system and i want to take this opportunity to really thank all of you because especially darilyn and miguel who helped to lead the efforts on getting us to this point where we were able to get legislation finished, passed, and now signed today.

and i want to thank our city administrator carmen chiu. and i said, carmen, we've been talking about this for too long. we have to build some consensus. we have to raise the threshold, we have to get to a better place and she got it done. this is like a major accomplishment for our city and i want to also thank the board of supervisors president shamman walton. he helped to provide these opportunities for all of us to be here to do to sign this legislation, so i appreciate his leadership and the other

board of supervisors members who are involved in our l.b.e. program. thank you supervisor safai and supervisor melgar for being with us here today. and once i sign this legislation, i'm sending all my friends and family from the neighborhood to each and every one of you and i want you to hire them because i know as a result, your businesses are going to grow. you're going to continue to do work in the city and i know the city is not without its challenges. and i hope that you see how all of you working together, how we are able to accomplish so much more than working apart. so much compromise has been made to get us to this point and my hope is that this is the start of what can be transformative about this program so that it doesn't depend on who's the mayor,

who's the supervisor? but we have a structure now in place to allow for consistent increases in the threshold to make it easier for someone to make it into the program and succeed in the program in the first place. so i'm really excited about the future of this. [ applause ] and the last thing i'll say before i turn it over to the president of the board of supervisors shaman walton is, you know, getting an opportunity like this i know has been amazing for you for so many and what i really love about miguel is the conversations we have and the push he has not just to make his company a success, but how he wants other companies in the program and how he has given back he's provided that opportunity and i know so many of you have done the same.

and, what that makes for is really a better san francisco. i want all of you to be working in some capacity with the city and 'i also want all of you to be mentors for the next generation that wants to be apart of the city. that's what this program is about and that's how we're going to make san francisco a better place is continuing to work together and i want to thank all of you and at this time before i sign this legislation, i want to ask the president of the board of supervisors shaman walton to come up and say a few words. >> president walton: we definitely want to say thank you so much, mayor breed and really just want to agree in terms of the fact that this has taken us awhile to get to this day. i can even remember being

at this and talking about l.b.e.s and making sure they have jobs in san francisco and to really make sure that it's advantageous to be a city business that's based in san francisco. and so i'm proud of each and every one of you for working together because when we have conversations with miguel and we have conversations with darilyn and you super conversations with patrick and a whole gamut of business owners, different sectors of employment and then getting everybody to work together was very important. in the beginning of the conversation, some of you remember, i said if you all don't work together and go in a room and have these conversations with each other, we're not going to be successful. and you all did that. and so i really want to commend you for getting together, working through the hard details and am copping to us with a unified front.

i do want to thank city administrator chiu. i also want to thank the city attorney that worked closely to draft this legislation. that is important and so the last thing i'm just going to say is this is one step forward. obviously, we have continued work to do to make sure our contractors have the advantage when it's time to do business here in san francisco, but we're going to do everything we can in our roles to make sure that happens. i do want to thank and acknowledge supervisor safai, supervisor melgar for their co-sponsorship and all their hard work with everyone on this as well. thank you so much. [ applause ] >> hello. it's so exciting to be here today. i think for many of the folks who've been in the room and been in these conversations, i want to thank you all for your patience and continuing to work with us to make sure that we make sure our economic recovery is going to be a strong one and one that's led by our local businesses. i think for many of us who are here, i grew up in a small business as well. we know that when our local businesses succeed, our community succeeds. our local businesses, they go and they shop in the local areas. they go and eat at the local restaurants. they hire from the local community and they know people here and i just want to say thank you for your continued investment in san francisco. it makes all the difference to know that you're with us and

that you're going to continue to grow your businesses here. the program, the legislation that our mayor is signing today thanks to also the help of our president, shaman walton and members of the board who also co-sponsored. it will do many things. it's going to mean that we see more prompt payments for our local subcontractors who can't afford money not to get paid back or reimbursed. we're going to have pilot programs to make sure we encourage more l.b.e. participation and as the mayor mentioned earlier, this is the program that's going to help us to make sure we incentivize mentor protoge programs and mentorships. so i want to thank folks like miguel and patrick who really

invest back into our community and how important it is to do that. i do want to thank a few folks from the city side who really made it happen. of course, mayor breed, she mentioned the conversations we had from the beginning and i will tell you it was relentless. as you know, every meeting i had with the mayor was about how is this program going? are we getting to consensus? are we figuring out a way forward? so i want to thank her for continuing to push all of us to head in that direction and get to where we are today. and i want to thank jennifer brush on our team. she was an amazing partner. i think yadira was mentioned with our city attorney. she knows so much how contracting works and helped us through all the different complexities of contracting. you know, our job is to make sure a good idea gets married with the right administration. making sure we can carry out

the things that we promise we're going to do. and i want to thank, of course, all of the community members whether it's juliana choy from the economic equity and alex chiu. darilyn, miguel, patrick, all the folks who advocated and came to our office. thank you so much. with that, it is my absolute pleasure to introduce miguel gallarza to come up. above and beyond that, someone with a big heart who continues to reinvest time and again to people to make sure we are successful as a city. thank you, miguel. spirit of the government because it can make a difference for all of our lives. i really appreciate all of my partners have worked really hard from the l.b. advisory committee. from those member that is don't get the recognition. dr. ansani, of course, darilyn and all of them that have taken part in helping us draft this and make sure that we had the right message that we listen to the right community members. people that were not part of the advisory committee, the well bonders and the patrick to make sure they engage with the small community and help that voice come out so that we can listen to them, pay attention to them, focus on their needs and make sure we created the opportunity for them to succeed. and, most of all, i remember 30 years ago when i was a wee young lad and how a civil servant came to me and says,

you know, miguel, we need young entrepreneurs and young people to be engaged in the community. we have older generation that's retiring. we need young blood and that person and he told me be engaged, bepart of the community. focus in on what you can do for your community and you'll benefit greatly and rewardingly. and so i'm taking that to heart. now that i'm looking forward to passing that baton on to those young entrepreneurs that want to make a difference. you know, i was a kid from the mission district. and, yeah, i went to but you know what, at the end of the day, we made a difference and at the end of the day, we're here because this program is meant to empower our people so that we can rise our community. so that we as african american latinos, asians can all benefit and raise your community so we can all strive to be true san

>> i'm going to be very brief. i just want to say most of all thank you to all of the supervisors, to my partners, my friends, people i've gotten to know over the years of working through this legislation for many, many years. i started on this probably about 15 years ago when it was h.r.c. and didn't get much traction then in 2015. thought we were almost there and then at the last minute, there were some changes to the legislation. so ever since then, i've been working on making sure that small businesses like mine who are in san francisco have an equitable opportunity to do business here in the city that i was this legislation is going to allow me and a whole lot of other people. a lot of other small companies continuing to work and do business here in san francisco. so thank you all for all the help in the work. it's been -- we had many long nights. lots of conversations about whether this could happen and it actually hasn't. it's hard for me to believe that we're here because i've been on this fight for so long that actually, we actually have

the checks stand so customers can bring their used clothes to the store and deposit off. >> textile will be accessible in buildings thought the city and we have goodwill a grant for them to design a textile box especially for families. >> goodwill the well-known store has been making great strides. >> we grateful to give the items to goodwill it comes from us selling those items in our stores with you that process helps to divert things it from local landfills if the san francisco area. >> and the textile box will take it one step further helping
