montgomery , clay turning onto sanford are border often includes the part that is one of the first and the city of san francisco downtown parts. it's completely closed off. that particular part for decades has served as an open space for the sro in chinatown. given that there is a high degree of people not having open-space in addition to using this particular open-space for community relief. can we get an update of what the plans are. why this particular part is closed off in that particular project has notcome in front of us . >> we will look into it. i think what's already been approved is some renovations to the ground floor of the tower itself. i think the notion was to add some additional or to repurpose some of the space to retail.

>> we will move on to item 7 review of past events at the board ofsupervisors courtof appeals and historic preservation commission . i can provide an update on all three ofthose. the hbc did not meet yesterday . they had cancel the hearing . relative to the court of appeals i was informed by the deputy zoning administrator that the court of appeals did not hear any items of future planningcommission and then finally for the board of supervisors , legislative affairs manager aaron starr provided to me before plex legislation was continued to the june 6 land use committee and the mission cultural center past landmark nominations past its first three of the board of supervisors . >> if i can add on before plex legislation because we did get a question as to why wouldn't it come back . apparentlythe proposal that the board is considering is to limit those , limited to only property owners who own their property for five or more years

request for adoption of shadow findings on the demolition of 2 existing one story commercial buildings and the construction of a five story over basement 55 foot six inches 36 dwelling unit residential building which will contain 15 occupancy parking spaces, 36 class i bicycle parking spaces, to bicycle parking spaces and is located within the neighborhood commercial transit zoning district and 40 5x height and bulk district. the proposal includes 19 2 bedroom units, 13 one-bedroom units and 4 studios which range in size from 415 to 1215 feet in space. under the individually requested statements the project is seeking approximately 5.1 percent density bonus and waivers from the rear yard, usable open-space, exposure use requirements .

see the commission was granted conditional use for the development of a lot size greater than 4000 square feet . pursuant to planning code section 121.1, 150 5r, 303 and 750 and the adoption of shadow findings pursuant to planning code to 95 and adoption of findings related to the requested waivers pursuant to planning code 206.6 and california government code section 6.515. on february 24, 2022 the commission heard and continue the project and requested the project sponsor evaluate various design changes including relocating the transformer from within the building to within the public right-of-way . providing a dwelling unit with direct access to the proposed rearyard space as opposed to the buildings amenities.

and redesigning the ground-floor fagades to minimize the number of students . aproposal for you is addressed both listed design changes and as a result has created one additional dwelling unit . since february 24 planning commission hearing the department has received concerns regarding traffic, parking, construction effects to recent properties. the project was considered individually valid under the elbow apart nation eir which consider the topics concerned. theapartment recommends approval with conditions and believes the project is desirable for the following reasons .the department finds the project is on balance consistent with theplan. the balboa park station area plan and meets all applicable requirements of the planning code . the project will maximize the use of underutilized lot and construct a five base building within close proximity to public transportation, public

open-space, commercialcorridors and jobs and project will increase the city accounting stock byproviding 36 swelling units , six of which will be designated as on-site rental dwelling units, 18 percent of the project's total units . the project will provide a land-use compatible with an nct one zoning district and a building that is responsive to compatible immediate nadir of its characteristics including size and building mass. this includes staff presentation and i'm available for any questions . >>how long was the project sponsor presentation ? >> three minutes. >> good afternoon, project sponsor. at the very first hearing the commission provided several suggestions to make the projec better . we went back and listened to the tape again very carefully.

and really tried to be responsive with certain revisions. the architecture will go over that in a moment but in your packet and the brief there's also a chart that lists all those comments and how we've responded one of the revisions is to move the transformer below grade under the sidewalk and we would appreciate your expressed support for that move. i want to talk a little bit about outreach. the project has had to notice neighborhood meetings early in april 2019 and another one in november 2020 there have been other discussions with neighbors throughout the process . on march 25 after the first hearing there wasanother meeting in person with several neighbors and supervisors sapphire is a. several revisions have been made . in addition to planning questions one of the neighbors who spokeis on construction and excavationactivities . everything from construction noise to insurancecoverage , cal osha requirements .

the project sponsor has been in the business for decades. has built many projects in san francisco. we have very specificbuilding code requirements in the city and review processes . those are all in addition to conditions of approval and mitigation members by planning so nothing short of full compliance with building code regulations and laws and review processes is planned here on permitting and construction. we want to ask we certainly understand nobody wants to live right next to the construction site however it is temporary and we have laws and regulations and processes and enforcementprocesses to make sure it's all done in a compliant and safe manner so i'll turn it over . >> good afternoon commissioners. sorry, newmicrophone. good afternoon . verybriefly the changes we made , there's an extension of the

light well on the right side of the building and we've demonstrated the nearest building in terms of exposure is about 60 feet away. i should mention our rear wall will align with the neighbor to our right. in thebasement we've relocated some of the bicycle parking and shown the transformer on the sidewalk . again transformer on the sidewalk with a new one-bedroom unit up front and now two bedroom units in the rear with open-space. second floor and not we eliminated property line windows and added our light well facing the neighbor . showing the roof we have increased the occupied roof deck and also shown unoccupied landscaping with railings all around. and updated the front with no residential stoops. i'm available for any questions. thank you. this time the commission will take public comments on item number 8 a and 8b. if there's a number that would

feel free to step up to the dais. >> quite sometime since i've spoken with you. my name is scott kuipers, civil assistance planning task force. and i'm neutral on the project, just want to say the owners have treated us well. i have a gallery on the site and appreciate the time we've been there the neighbors have had concernsand i appreciate their in conversation . it's mostly just taking a moment to advocate for keeping spaces occupied until they are finally approved and demolished and i appreciate the owners been willing to work with us and will keep the building active and looked after and make sure everything goes smoothly if neighbors have concerns on had to be on site and there are several sites languishing and i really like to advocate for programs that

can allow nonprofits or nonprofitssponsored arts groups to keep these spots active. there's a church on market strikes, a church on. at sixth street. the old trophy shop across the street from our place . i moved in our business in 2019 after our block at 3/65 street was in increased and it's a giant lagoon so i want to hope projects areapproved once they're ready to go and all financing is in place that's really as far as the policy . we helped craft x which needs revisiting. it was formerly pdr space but it's still a big facility ther . we're hoping that maybe there can be revisiting that site because the arts community continues to be in crisis and has been kind with any performance arts. so we're hoping there could be continued work to help make sitesespecially as they're in transition with the planning department and other agencies to keep them activeuntil larger

say i was not present for the february hearing and ireceived the hearing and i'm prepared to move today. >> we will go back to you vice president . >> i wanted to acknowledge the fact that this is a great example of how the commission commenting thoughtfully and given some clear guidance to project sponsors can indeed make a big difference. i believe the concerns we had addressed together have all been considered and i have found that they have been satisfactorily resolved. i think we have a better building as we have a better place of large units on the ground floor, we see these four-bedroom unitswhich have family oriented units with their own open-space. i am in support of the project . the only thing i would like to ask the architect is the use of the word unoccupied landscaping

is somewhat unusual can we rephrase that to unoccupied roofers landscaping . i do want to avoid that the deck area spills over into the landscaping and while we have to resurface and there's provisions for specifically the pathway to service the green i do not want it to be confused with the roof decks. i would like to see it be amended to unoccupied with the landscaping if that's possible. otherwise i'm in support and appreciate theadjustments that have been made . >>. >> i did have a lesson for the architect team, a request for the transformer to have support from the commission. if you could explain them preventing agency is it public works? who is it you need topersuade

>> specifically on that concern. i was just looking at the plan. it is about 30 feet away from his property line. that should be sufficient in maneuvering area. and i think generally speaking we don't want to make garage openings larger than they need to be . and in this case the garage is around as soon as the door is open and there's enough space to pull in. personally there's not enough cueing. we do think it is an appropriatelocation and a safe location . >> thank you. i don'tknow if other commissioners have comments . >> i certainly want to appreciate the concerns the neighbors haveabout as far as turning into and out of the driveway . i don't know that much can be done about the noise but in

revised drawing. to the proposed project i sent you earlier this morning . these include providing a 7 and a half foot site set back to the east starting 10 feet nine inches from the dr requester's rear building wall.and maintaining money as an unoccupied roof with a current higher than four or six inches. number two reducing the extent of the third floor rear wall b six feet . number three, providing a five foot side setback on the west side . to the third floor deck. and number for lowering the ceiling height of the proposed addition from 10 feet to nine feet .number five removal of the stair pan handles to be replaced by a four foot five inch high sliding skylight and parapet along the west side. will a maximum of seven feet high with a parapet. number six finally a reduction on the roof deck with setbacks of three feet from the rear,

so how is that? >> the residential flats policy was intended to preserve that type of housing with double exposure as a type that's not beingreadily replaced in the city . the commission left the details in that policy relatively vague but there were some specific intent and that is the idea that our flat is a flat.it's defined assomething that has double exposure typically . in the application of the residential policy in this case you could see the aperture or the exposure on the street fronting side is pretty much limited to a width of seven feet partially due to the accommodation of the parking in the front as well at that level. we've determined as an internal interpretation to the department to some extent that for it to have exposure, to mean something it has to be a

minimum width of the room and a minimum width of the room the building code is seven feet per bedroom. in this case that's what they have provided in that long looking always room configuration where seven feet is wide enough for a mission inhabitants. the other in this particular case the other mitigating circumstance is looking at the original flat ontop of the third floor flat. it was somewhat compromised by the stairs that access it . to a degree that yes, it had double exposure but one might say it had less than full exposure on the rear wall side. that's essentially our flat. the plaque removal policy in our application with that. >> thank you for that clarification. yes, in terms of the exposure and i think these are kind of like an interpretation of how

francisco contributed an additional $200,000 and the stadium was built in a year. in the 1930s it was home to several colleges such as usf, santa clara and st. mary's for competition and sporting. in 1946 it became home to the san francisco 49ers where they played nearly 25 years. the stayed de yam sat 60,000 fans. many caught game the rooftops and houses. the niners played the last game against the dallas cowboys january 3, 1971 before moving to candlestick park. the stadium hosted other events before demolition in 1989. it suffered damages from the earthquake. it was reconstructed to seat 10,000 fans with an all weather track, soccer field and scoreboards. it hosts many northern california football championship

games. local high schools sacred heart and mission high school used the field for home games. the rivalry football games are sometimes played here. today it is a huge free standing element, similar to the original featuring tall pink columns at the entrance. the field is surrounded by the track and used by high school and college football and soccer. it is open for public use as well. >> once i got the hang of it a little bit, you know, like the first time, i never left the court. i just fell in love with it and any opportunity i had to get out there, you know, they didn't

[♪♪♪] >> we have been able to participate in 12 athletics wheelchairs. they provide what is an expensive tool to facilitate basketball specifically. behind me are the amazing golden state road warriors, which are one of the most competitive adaptive basketball teams in the state led by its captain, chuck hill, who was a national paralympic and, and is now an assistant coach on the national big team. >> it is great to have this opportunity here in san francisco. we are the main hub of the bay

area, which, you know, we should definitely have resources here. now that that is happening, you know, i i'm looking forward to that growing and spreading and helping spread the word that needs -- that these people are here for everyone. i think it is important for people with disabilities, as well as able-bodied, to be able to see and to try different sports, and to appreciate trying different things. >> people can come and check out this chairs and use them. but then also friday evening, from 6:00 p.m. until 8:00 p.m., it will be wheelchair basketball we will make sure it is available, and that way people can no that people will be coming to play at the same time. >> we offer a wide variety of adaptive and inclusion programming, but this is the first time we have had our own
