item 5 , commission comments andquestions . >> any items commissioners. >> there was a distressing article on the front page of the chronicle today about portfolios remaining closed and i was wondering if the director might want torespond to that. there are obviously some concerns . >> happy to and we know through the pandemic it's critical to residents of the city and visitors who work there. so our take is that if the buildings are open the provost should also be open so perhaps we can send a notice to all buildings that do have those and let them know if they do not open we can start enforcing
2:08 am
actions but we can look into that because again our take is if the building is open the provost should be open as well. >>thank you. >> a follow-up question director ruiz . is there more of an active oversight in terms of checking it or it's more based on complaints? >> like most of our enforcement worktends to be complaints . >> vice president more. >> i wanted to ask director ellis question regarding transamerica permit. we understand there's a major change in ownership and refurbishing the building and other activities on the site. however none of that has come in front of us and their speaking about provost at least for three or four weeks now. theentire block that is
2:09 am
montgomery , clay turning onto sanford are border often includes the part that is one of the first and the city of san francisco downtown parts. it's completely closed off. that particular part for decades has served as an open space for the sro in chinatown. given that there is a high degree of people not having open-space in addition to using this particular open-space for community relief. can we get an update of what the plans are. why this particular part is closed off in that particular project has notcome in front of us . >> we will look into it. i think what's already been approved is some renovations to the ground floor of the tower itself. i think the notion was to add some additional or to repurpose some of the space to retail.
2:10 am
i think that'sapproved but to me that would necessarily necessitate closure of the park so we will look into that . >> the building, the tall building at the corner of play. it's all completely closed off. >> there's an application in for the office building on the northwest corner of sansom which will have to come to the commission as ibelieve it's a project allocation . but we will give you an update on the timing of all that as well as questions why the entire block is closed. >> thank you. >> anything else commissioners? thank you. >> i was just notified that we have a caller requesting to speak so through the chair if we don't mind we will see what this remote callerhas to say if they want to speak on one of the items that we've already discussed . >> hello caller.
2:11 am
you're welcome to provide your comments. do you want to speak on one of the itemsthat the commission has already discussed in terms of either the continuance calendar or consent calendar ? >> this is michael cross. it was on the consent calendar and i believe the commission already approved the item i was just going to voice my support for the allegheny project . the formula retail project. >> thank you color, i was going to say if you wanted to speak or for your support we would pull the item on the agenda and hear it on theregular calendar >> i had actually raised my hand whenyou asked for that to pull it off the calendar but it wasn't recognized at the time but that's fine . >> you so much . >> commissioners we can move on to item 6 department matters. directors announcement.
2:12 am
>> we will move on to item 7 review of past events at the board ofsupervisors courtof appeals and historic preservation commission . i can provide an update on all three ofthose. the hbc did not meet yesterday . they had cancel the hearing . relative to the court of appeals i was informed by the deputy zoning administrator that the court of appeals did not hear any items of future planningcommission and then finally for the board of supervisors , legislative affairs manager aaron starr provided to me before plex legislation was continued to the june 6 land use committee and the mission cultural center past landmark nominations past its first three of the board of supervisors . >> if i can add on before plex legislation because we did get a question as to why wouldn't it come back . apparentlythe proposal that the board is considering is to limit those , limited to only property owners who own their property for five or more years
2:13 am
to take advantage of the density increased to go from two units support. and although we didn't necessarily discuss that as a policy issue when it came to us it's limiting and we kind of dramatically limited the abilityfor lots to take advantage so that's why it didn't come back to the building commission . just to limit the number. it's more restrictive. >> we can move on to item e, general public comment. at this time members may address the commission items of interest to the public within the subject matter jurisdiction your opportunity to address th commission will be afforded when the item is reached . each member may address the commission for up to three minutes. when the number of speakers exceeds the 15 minute limit the general public comment may be

an informational on legislation from the state. just thought i'd ask about that today because if anybody's curious i guess you could go look at the ddi provided to the members. it's like 4 to 6pages . local and the state. take care, have a nice day. >> i think that is all of our publiccolors in the queue . we can move on to the next item on our agenda. moving on to the regular calendar. item number 8 a and 8b or 350 ocean avenue case number 2017 01961 spt and record number 2017 001961 see you a request

for conditional use authorization. just for the record on february 24, 2022 the hearing after closing public comments continued item to april 14, 2022 by a vote of 3to 2 . on april 14 the hearing was continued again to maine in 19 by a vote of 7 to 0. since this item hasbeen her we will be limiting public comment time to 2 minutes . >> good afternoon president tanner, commissioners. the case before you is a request for conditional use authorization for incentives and waivers from development standards under the individually requested statement fonts project and

request for adoption of shadow findings on the demolition of 2 existing one story commercial buildings and the construction of a five story over basement 55 foot six inches 36 dwelling unit residential building which will contain 15 occupancy parking spaces, 36 class i bicycle parking spaces, to bicycle parking spaces and is located within the neighborhood commercial transit zoning district and 40 5x height and bulk district. the proposal includes 19 2 bedroom units, 13 one-bedroom units and 4 studios which range in size from 415 to 1215 feet in space. under the individually requested statements the project is seeking approximately 5.1 percent density bonus and waivers from the rear yard, usable open-space, exposure use requirements .
2:18 am
see the commission was granted conditional use for the development of a lot size greater than 4000 square feet . pursuant to planning code section 121.1, 150 5r, 303 and 750 and the adoption of shadow findings pursuant to planning code to 95 and adoption of findings related to the requested waivers pursuant to planning code 206.6 and california government code section 6.515. on february 24, 2022 the commission heard and continue the project and requested the project sponsor evaluate various design changes including relocating the transformer from within the building to within the public right-of-way . providing a dwelling unit with direct access to the proposed rearyard space as opposed to the buildings amenities.

and redesigning the ground-floor fagades to minimize the number of students . aproposal for you is addressed both listed design changes and as a result has created one additional dwelling unit . since february 24 planning commission hearing the department has received concerns regarding traffic, parking, construction effects to recent properties. the project was considered individually valid under the elbow apart nation eir which consider the topics concerned. theapartment recommends approval with conditions and believes the project is desirable for the following reasons .the department finds the project is on balance consistent with theplan. the balboa park station area plan and meets all applicable requirements of the planning code . the project will maximize the use of underutilized lot and construct a five base building within close proximity to public transportation, public

open-space, commercialcorridors and jobs and project will increase the city accounting stock byproviding 36 swelling units , six of which will be designated as on-site rental dwelling units, 18 percent of the project's total units . the project will provide a land-use compatible with an nct one zoning district and a building that is responsive to compatible immediate nadir of its characteristics including size and building mass. this includes staff presentation and i'm available for any questions . >>how long was the project sponsor presentation ? >> three minutes. >> good afternoon, project sponsor. at the very first hearing the commission provided several suggestions to make the projec better . we went back and listened to the tape again very carefully.
2:21 am
and really tried to be responsive with certain revisions. the architecture will go over that in a moment but in your packet and the brief there's also a chart that lists all those comments and how we've responded one of the revisions is to move the transformer below grade under the sidewalk and we would appreciate your expressed support for that move. i want to talk a little bit about outreach. the project has had to notice neighborhood meetings early in april 2019 and another one in november 2020 there have been other discussions with neighbors throughout the process . on march 25 after the first hearing there wasanother meeting in person with several neighbors and supervisors sapphire is a. several revisions have been made . in addition to planning questions one of the neighbors who spokeis on construction and excavationactivities . everything from construction noise to insurancecoverage , cal osha requirements .
2:22 am
the project sponsor has been in the business for decades. has built many projects in san francisco. we have very specificbuilding code requirements in the city and review processes . those are all in addition to conditions of approval and mitigation members by planning so nothing short of full compliance with building code regulations and laws and review processes is planned here on permitting and construction. we want to ask we certainly understand nobody wants to live right next to the construction site however it is temporary and we have laws and regulations and processes and enforcementprocesses to make sure it's all done in a compliant and safe manner so i'll turn it over . >> good afternoon commissioners. sorry, newmicrophone. good afternoon . verybriefly the changes we made , there's an extension of the
2:23 am
light well on the right side of the building and we've demonstrated the nearest building in terms of exposure is about 60 feet away. i should mention our rear wall will align with the neighbor to our right. in thebasement we've relocated some of the bicycle parking and shown the transformer on the sidewalk . again transformer on the sidewalk with a new one-bedroom unit up front and now two bedroom units in the rear with open-space. second floor and not we eliminated property line windows and added our light well facing the neighbor . showing the roof we have increased the occupied roof deck and also shown unoccupied landscaping with railings all around. and updated the front with no residential stoops. i'm available for any questions. thank you. this time the commission will take public comments on item number 8 a and 8b. if there's a number that would
2:24 am
like to providepublic comment please line up on the screen side of the room or, to the dais . seeingnon-we have one remote caller . chan, can you unmute? hello caller. >> speaker: this is ernesto. owner of the 320 ocean avenue immediately adjacent to the project . we did meet with kevin in january and there were two other neighbors. we did make some headway with the privacy issues. we still have concerns and issues on sustainability, excavation on march 25 kevin mcavoy said he would not provide mitigation to code 832
2:25 am
means heis supposed to make an effort and we're supposed to have conversations on that but he immediately said we would not . wehave in terms of the onset parking the dimensions of the cutout with the garage door opening , aren't really going to be conducive to havingcars coming up in and out . we will be hearing the noise of the car alarm system going on. more than anyone would like to hear. and finally, we talked to the neighbor and he has not had a positive issue and that's concerned. i do . >> thank you, if any other memberwould like to provide public comments to the commission , pleaseá3. i do not see there's one more collar. can you unmute ? hello caller.
2:26 am
hello. i think you need to silence your tv or your computer and speak into your might. we can't hear you. there we go. we got you now. >> are you readyfor me to speak? >> yes, feel free to provide your public comment . >> this is camille at 120 ocean avenue. i have a concern as obviously the parking is turning into the property and also leaving the property with the amount of pedestrians. we'velived here for a while. we've seen the amount of pedestrians on the street . and also we know that emergency vehicles going down there's an abundance of them. in fact when we turn onto our property we can backup traffic so that's a big concern for me. thank you.
2:27 am
>> thank you. i see no other members of the public. one more. canyou please unmute ?color, you'rewelcome to provide your public comment to the commission on 350 ocean avenue . >> hi. i would like to ask commission to consider delaying the project to get more time to the local communityand neighbors . many of which are elderly and were impacted by the pandemic. i would also import the commission to consider that. thank you. >> thank you. last call for public comment on items eight a and 8b april 3, 1950 ocean avenue. if there's any member of the public that would like to provide public comments please
2:28 am
feel free to step up to the dais. >> quite sometime since i've spoken with you. my name is scott kuipers, civil assistance planning task force. and i'm neutral on the project, just want to say the owners have treated us well. i have a gallery on the site and appreciate the time we've been there the neighbors have had concernsand i appreciate their in conversation . it's mostly just taking a moment to advocate for keeping spaces occupied until they are finally approved and demolished and i appreciate the owners been willing to work with us and will keep the building active and looked after and make sure everything goes smoothly if neighbors have concerns on had to be on site and there are several sites languishing and i really like to advocate for programs that
2:29 am
can allow nonprofits or nonprofitssponsored arts groups to keep these spots active. there's a church on market strikes, a church on. at sixth street. the old trophy shop across the street from our place . i moved in our business in 2019 after our block at 3/65 street was in increased and it's a giant lagoon so i want to hope projects areapproved once they're ready to go and all financing is in place that's really as far as the policy . we helped craft x which needs revisiting. it was formerly pdr space but it's still a big facility ther . we're hoping that maybe there can be revisiting that site because the arts community continues to be in crisis and has been kind with any performance arts. so we're hoping there could be continued work to help make sitesespecially as they're in transition with the planning department and other agencies to keep them activeuntil larger
2:30 am
economic interests move forward . the owners have been supportive to us, and help with rent during the worst parts of the pandemic and again i just appreciate the conversation they are taking place . >> i see no additionalpublic comment either remotely or in person . through the chair i think a couple of our commissioners have some disclosures . >> if there's disclosures you should make them work if you want to. >> computer diamond. >>. >> thank you. i just wanted to notify everyone including the public that they arrived late for the last hearing and therefore the city attorney was unable to vote.i want to assure everyone that i since then review the entire transcript from the last hearing of course with all the materials today. >> thank you commissioner diamond. >> i just wanted to follow commissioner diamond and also
2:31 am
say i was not present for the february hearing and ireceived the hearing and i'm prepared to move today. >> we will go back to you vice president . >> i wanted to acknowledge the fact that this is a great example of how the commission commenting thoughtfully and given some clear guidance to project sponsors can indeed make a big difference. i believe the concerns we had addressed together have all been considered and i have found that they have been satisfactorily resolved. i think we have a better building as we have a better place of large units on the ground floor, we see these four-bedroom unitswhich have family oriented units with their own open-space. i am in support of the project . the only thing i would like to ask the architect is the use of the word unoccupied landscaping
2:32 am
is somewhat unusual can we rephrase that to unoccupied roofers landscaping . i do want to avoid that the deck area spills over into the landscaping and while we have to resurface and there's provisions for specifically the pathway to service the green i do not want it to be confused with the roof decks. i would like to see it be amended to unoccupied with the landscaping if that's possible. otherwise i'm in support and appreciate theadjustments that have been made . >>. >> i did have a lesson for the architect team, a request for the transformer to have support from the commission. if you could explain them preventing agency is it public works? who is it you need topersuade
2:33 am
to allow you to have a transformer there and it is there a possibility they might say no . what would happen in that situation ?>> there is already a conditional tool that always says here is the preference from planning departments perspective as to where thetransformer should be located but we appreciate you as the commission could also say yousupport placing it onto the sidewalk. it would help us when we go to dpw to get approved the commission strongly supports the duplication on the sidewalk . that would be our presence . >> do you have concern they might not confer with that? >> we spoke with the civil engineerfor the project and he believed we can place it on the sidewalk but we're just trying to cover our bases . >> i wanted to makesure if we were nervous about it or if we were confident we could get that to happen . >> president chan, in the past few years we had a number of high density projects on the street where that was a
2:34 am
necessity in each case may ultimatelyrealized the transformer on the sidewalk . >> i don't see any other commissionershands. is there anybody who was interested ? >> i'm in general support of this. ido have a question in the nearby neighbor . in conversations it seems like the main issue still is that his driveway and the gate entry to the building are perhaps there's going to be some sort of a trafficor intersection. are there mitigation measures , are you guysthinking of in terms of how to avoid his driveway ? i understand that the curbside has already been inplace . but what kind of discussion has been with him?
2:35 am
>> specifically on that concern. i was just looking at the plan. it is about 30 feet away from his property line. that should be sufficient in maneuvering area. and i think generally speaking we don't want to make garage openings larger than they need to be . and in this case the garage is around as soon as the door is open and there's enough space to pull in. personally there's not enough cueing. we do think it is an appropriatelocation and a safe location . >> thank you. i don'tknow if other commissioners have comments . >> i certainly want to appreciate the concerns the neighbors haveabout as far as turning into and out of the driveway . i don't know that much can be done about the noise but in
2:36 am
regard to the system it's alerting people, it's so noisy i think that's the purpose of it which is to provide analert to pedestrians to avoid conflict. the solution to one thing can create another challenge and i think that's just part of expanding the trade-off . i'd rather have a little bit of noise then have someone get hit by a car. i want to thank the project sponsor and members of the community that participated and to provide her safai's office. is there a commissioner that would like to make a motion? >> i'm going to approve. >> second. >> we have a motion from commissioner moore to approve the items . item eight a and 8b and second from commissioner imperial. we will take a roll call vote. [roll call vote] that item
2:37 am
passes 72 zero. we will move on to our next item. the discretionary review calendar . and item numbernine 42230 washington street .case number 2021 004022 crp. request for discretionary review. >> good afternoonpresident tanner, vice president more . the item before you, well the dr requester william and project sponsor have come to an agreement they would like to have memorialized by having the position approve building permit number 2021 c0329 7048. with the followingmodifications as incorporated into the
2:38 am
revised drawing. to the proposed project i sent you earlier this morning . these include providing a 7 and a half foot site set back to the east starting 10 feet nine inches from the dr requester's rear building wall.and maintaining money as an unoccupied roof with a current higher than four or six inches. number two reducing the extent of the third floor rear wall b six feet . number three, providing a five foot side setback on the west side . to the third floor deck. and number for lowering the ceiling height of the proposed addition from 10 feet to nine feet .number five removal of the stair pan handles to be replaced by a four foot five inch high sliding skylight and parapet along the west side. will a maximum of seven feet high with a parapet. number six finally a reduction on the roof deck with setbacks of three feet from the rear,
2:39 am
five feet from the west and sorry, 7 and a halffeet from the east.this concludes my presentation and i'm happy to answer questions . >> through the chair it sounds like the dr requester has come to agreement. do the dr requester's want to speak at all or public comment ? we will limit yourtime to 2 minutes .>> thank you commissioner scott, i'd be happy to bring our requesters. i'd like to thank mister whitfield for his efforts at getting this to an agreement and mark graham the project architect for being flexible to try to address some of the concerns. >> just for thesake we will take public comment on this item . if any member of the public would would like to provide publiccomment on item number nine please come up to the dais . and seeing none we also have no
2:40 am
remote colors in our queue. so commissioners. >> questions, comments, motions. >> is your winslow did they inform us of the changesagreed to by the dr staff ? >> yes. >> thank you very much. >> commissioner imperial. >> just a question in terms of the residential policy. as i see on the first ground floor, as defined in the residential policy in terms of occupying. he, i guess i'm trying to educate myself here. as i see it as more of a full occupying story and the full flat from the transfer down to the ground floor but there is a
2:41 am
garage in there. so how is that? >> the residential flats policy was intended to preserve that type of housing with double exposure as a type that's not beingreadily replaced in the city . the commission left the details in that policy relatively vague but there were some specific intent and that is the idea that our flat is a flat.it's defined assomething that has double exposure typically . in the application of the residential policy in this case you could see the aperture or the exposure on the street fronting side is pretty much limited to a width of seven feet partially due to the accommodation of the parking in the front as well at that level. we've determined as an internal interpretation to the department to some extent that for it to have exposure, to mean something it has to be a
2:42 am
minimum width of the room and a minimum width of the room the building code is seven feet per bedroom. in this case that's what they have provided in that long looking always room configuration where seven feet is wide enough for a mission inhabitants. the other in this particular case the other mitigating circumstance is looking at the original flat ontop of the third floor flat. it was somewhat compromised by the stairs that access it . to a degree that yes, it had double exposure but one might say it had less than full exposure on the rear wall side. that's essentially our flat. the plaque removal policy in our application with that. >> thank you for that clarification. yes, in terms of the exposure and i think these are kind of like an interpretation of how
2:43 am
the practice is at the planning department. so yes, that's all for me. >> thank you. i believe commissioner moore. >> i see your name before me. >> i had already been called o . >> i just wanted a few questions ontransportation policy . the double back says a king size bed is 84 incheswide. this is seven feet by 42 feet . and i question that to be a viable bedroom for a plaque. and i believe that's the interpretation that the department uses. while it's labeled as a hallway that's fine but a substandard bedroom because you can't out of bed on the other side. i question that perhaps this
2:44 am
commission should revisit what minimal room sizes are when you are indeed exchanging a fully viable flat that occupies the full width is now being squeezed down for more than 290 square feet to a width of seven feet by 42 feet long. i question that. those are my comments. >> i'd have staff recommendation for doctor. >> commissioner koppel. >> motion to approve with the recommendation as agreeable . >> second. >> so we have a motion on the floor to take the r and approve with modifications as recommended by staff by commissioner koppel and seconded by commissioner dimond.
2:45 am
commissioner ruiz. [roll call vote] >> that motion passes 6 to 1. commissioners i've been informed by mister winslow that item number 10 or 46 homestead street case number 2017 013615 erp has beenwithdrawn . so this concludesour agenda for today . >> is this record for shortest meeting ever? that was prettyshort. thank you members of the public and thank you commissioners, this meeting is adjourned . >>
2:46 am
2:47 am
and she's here to talk with us about art and the san francisco art commission. well come, miss chu. >> thanks for having me. >> it's great to have you. let's talk about art in the city and how art installations are funded. >> the arts committee was funded in 1932 and support civic review, design investments and art galleries. projects we have are funded by the city's art enrichment ordinance which provides 2% of construction costs for public art. >> so art is tied to construction.
2:48 am
there's been a great deal in the southwest of the city. can you talk about some of the projects there? >> sure. our city has some exciting projected in the bayview-hunters point coming up. one artist created a photo collage. in the picture pavilion, one artist formed a collage of her one-year residency coming together with residents, and anchoring the new center is a landmark bronze sculpture, inspired by traditional ivory coast currency which the artists significantly enlarges
2:49 am
to mark that it's a predominantly african american community in bayview hunters point. >> are there any art installations around town that uses light as a medium? >> yes. the first is on van ness between o'farrell and geary. it's funded with the m.t.a.s van ness geary street project. another project is for the central subway. it is one of ten artworks commissioned for the new line. it's over 650 feet long, consists of 550 l.e.d. panels between the powell street station and the union street station. it's called lucy in the sky,
2:50 am
and the lights are patterned with unique sequences so that commuters can experience a unique pattern each time they pass through. >> perfect. what about the early day sculpture that was removed from the civic center? >> this is a question that cities have been grappling with nationwide. following the removal of early days in 2018, there was a toppling of statues in golden gate park as well as the removal of the christopher columbus statue. we are partnering with the parks department as well as the community to engage with the public to develop guidelines to
2:51 am
evaluate the existing monuments and memorials in the civic arts collection and evaluate the removal of a monument or statue but also installing new ones. >> finally, it seems like the weather might be nice this weekend. if i fancy taking a walk and seeing some outdoor art, where would you suggest i go? >> well, i would suggest the embarcadero. this work was commissioned with funds from the fire station 35. this suggests the bow of a boat and the glass panel surrounding the structure depict the history of fireboats in the bay
2:52 am
area. >> and where can i go from there? >> then, i would walk up to the justin herman plaza to check out the work of the art vendors. then check out the monuments like the mechanics monument. also, be sure to check out the poster series, installed in bus kiosks along market street, which features four artists each year. >> well, thank you. i appreciate you coming on the show, miss chu. thank you for your time today. >> thank you, chris. >> that's it for this episode. we'll be back with another sho it across the city.
