10:42 pm
control which parcel before the property is purchased. i now i also understand that -- the negotiations have solved because of the behest legislation. i'm curious how many have gone. you want to be very happy with your investment in this project and know this part of this property you would get. >> this -- are negotiation work in progress is that okay. >> and negotiations solved it. and what were we decided was the best route forward was to look at a section that would be parcelized from the property. it would be clear the areas that rec and park would hold jurisdiction over. one of the upon reasons why this
10:43 pm
is a resolution of a set arc side going forward. we don't have the parcel it is one full parcel. before the city could acquire space the area needs to be parcelized and that portion of the property would be a parcel that the city can take ownership up there is a lot of steps that need to happen before. one could parcelize that section. too doyle have everything arc line with the timing of the needs of the group. >> purchase is first. and then the negotiations go on as to hapart of that propertiure get? >> yes. >> i gotta say i love that neighborhood. i have family members there i worked in this neighborhood but it is -- more sunshine or as much sun as any other place in town. it gets very windy and blustery
10:44 pm
in that neighborhood in the evenings as well. i would think when we talk about open space and talking about solid structures all this included in the parcel that where you put that open space because of those evening conditions would be important. and i know than i have been stalled. >> great question and there has been the community organizations have done a feasibility study of where -- the structures would be focused and where the open space and farm land would be -- likely to be on the parcel. and -- you know it is just that piece has not been so lidified they have plans they have been moving forward with. >> i would really urge rpd or
10:45 pm
the negotiating team that building that solid building could provide an excellent buffer to the open space. in that neighborhood. i said, love the neighborhood. but those other conditions. you have out there. >> thank you, for that. >> thank you. >> thanks, commissioner. commissioner anderson. >> thank you. i wanted to make sure i understood a couple questions i had. if i understand the acquisition could publicly be 47 to 15 million for -- for the whole parcel. and the rec and park portion is 15 it 20% of that parcel that needs to be that is why it needs to be parcelized before the city can acquire it. >> and the friends of 770 woolsey are on track to raise 9 million dollars. i believe so do you have more
10:46 pm
information? >>. and they work with the san francisco parks alliance and stewarding protecting and stewarding the funds and the park avenue alliance helps with grants. right. if they are eligible out there they will help. it it is a multitiered process for bring the funds together to buy this parcel. and -- the resolution that we will be asked to look at there is discussion of that. and the fact that our group recommends that we hold the fund in thes open space acquisition. then there is also a part of the resolution we the commission are supposed to urge the board of supervisors and the ethics commission to take action to support the project and amend
10:47 pm
the payments ordinance to enable a partnership between rec and park and the neighborhood groups. >> when i lynched the comments. for us it it is not an issue of is this a good thing temperature is a great thing. looks like we are tealing with the difficult here and the how can we now do it the way we used to do it and that is open -- transparent public/private partnership. weep don't have the money that in the city koifrs to do when we want to do we work with private organizations and friends groups. i want the public to know that we are not standing in the way of this happening.
10:48 pm
there is something going on legislateively, which i think has unintended consequences of blocking this thing that worked so well. i think san francisco love parks and urban farm and marina. and what are we supposed to do now our hands are tide. i don't know what to do. >> commissioner louie. >> so -- i think we are all in agreement. i mean this new legislation is we would not have the beautiful san francisco park if this ordinance was in place. as things are like withstanding i'm not an attorney, lawyer like commissioner anderson is. but i am a residents of san francisco. and i could see how -- the new
10:49 pm
behested legislation is going to jeopardize projects in the future. and you have the wonderful community groups that are love their partials so much they are donating their funds. but -- the rec and partial department can't -- accept it because we can't allocate it. who is losing out are the residents of san francisco. now that we are here we meet once a month. this is disturbing. and of something needs to be done. the legislation needs to be amended otherwise we will not have beautiful parks and open space. >> thank you, commissioner. >> seeing no other. >> supervisor ronnin's office would like to chime in. >> if i may, around the topic of the behest the payments legislation supervisor speaking
10:50 pm
with ginsburg about this and she is committed to amendments and that is why this it is in the resolution is to urge the supervisors and the ethic's commission to make amendments. we introduced an amendment that would acquire are will let the abway suspicions like these move forward. and the supervisors committed after budget. we are in the thick of it now. to work continue to work on amendments. so that you know -- public/private partnerships can move forward that is something she wanted express her commitment and this is why to support this to sends this message to the board. >> thank you very much. >> seeing no other comments i want to make 2 comments but that answered one for me. the second is for just as an observation for 15 years i chaired the board of the shape in east foundation that had the edable school yard project in
10:51 pm
beshg low. i tell you when kids get their fingers dirty in agan agricultural setting and grow sustainable food and then eat it they guide their parents as michael said. to the rim of a market world where the vejables are and not where the processed food is and changes their life forever. nothing would have a before the influence than this type of project. i'm 100% enthuzd and make the observation that the spriers will be a fan of amend thanksgiving legislation so that the rec and park can get back to collaborative partnerships with the community and with that the chair would entertain a motion. >> so moved. >> seconded. >> all in favor? >> aye. >> unanimously approved. thank you very much.
10:52 pm
>> okay. we are on item 9. marina rules and regulations. reminder to the public we are not hearing item 10 today. good morning. good to be vertical for once you've good to see you >> [inaudible]. i did bring a great perspective to boating safety. huare in the water the bay water for an hour with no help and as well as other things go with ad a i'm going from a cast to walktory cast and other. now a cane >> nice to see you upright >> seeing things with it. it is good toee that we have
10:53 pm
members of the boating community here. what i'm presenting is a modification the rules what is temporary suspension. i reached out also to partnerships of my pacific coast congress [inaudible] which is alaska, british columbia, washington, oregon, california and the bay area marina operators. which is 60 marinas. this is a very rare if not found way of running a marina. is to give back at discount to your boaters. it is like having an apartment building and you are renting rooms out in that apartment building or apartments out and saying i will be gone and i need to have a discount while i'm gone. there are modifications to how
10:54 pm
to rent apartments but the general intent is the same. impacting us around 70,000 a year and if you add up over 10-12 year its is a chunk of change. and the hard part is it is difficult one it manage. many of the boaters who do use it is not -- say willing is a problem they call up the day of or on the water or gone and say, by the way i need temporary suspension. it is always a business hurry up and run mode versus a planned 1. it is a hassle for the staff we have to deal with that. and may not show up when they say they would. they are out longer or they come in earlier and we have to either redo all the book work on the billing for that. may be they were not qualified at this time.
10:55 pm
this rule the modification is to allow us to credit back when the birth is rented by us. and it does it after they returned. we are basically they give us a notification, they are gone whchl they come become we go and figure out how many times we rented the space. make its easier for us and it is a shared thing. if we have ref now that came in they get credit back. it is a win/win. may not be in the boater's perspective but we have some who are taking their boats out of the bay area. or up in the delta embarrassed storing their boats in the cheaper locations that are covered or taking a worldwide cruising by truck for races and such. and we are as the citizens of san francisco. are paying for that time they are gone. by having a credit that way.
10:56 pm
and you know we are trying to find a win/win situation. i will take questions. i do have a question. is this practice that you are proposing twhoon is general low accept in the the industry? een this is not common. to give a credit. they don't give anything back. why thank you. >> we will move to public comment on item 9. first with people in room 416. and if you dw not fill out a card just come up you have 2 minutes to speak. take this off. i support the idea of making a change i like to go back to the
10:57 pm
previous situation years ago where a birth holder put his second boat in the same slip he is paying for already. subject to providing documentation of the boat's insurance and sea worthiness and title to the bolst that the person able to he's the slip is available and perhaps gift harbor 25% of what he gets for tr hassle of looking at the paperwork. the reason is that the harbor masters head no incentive to give them ref now he has others i dent cal slips available. and that is in the going to get 25% they will get zero they are not renting the slips out they don't do advertising. fileft for 3 mont i have an incentive to dot work nodeed fill my slip. now well is no incentive. i have none and he does not. he will get revenue filling another slip. harbor does no marketing of the slips.
10:58 pm
i see a modification to the proposal is this a birth holder able to put their other boat in the slip at no cost arc meets approval and if they allow to advertise and market t. the contract for rental subletting be approved bite harbor mast and let the harbor collect 25% done by many building in new york if you rent your co-op out for a year the building collects the 25%. it is fair. now there is sne market mechanism that will make opt maluse of the space and it is dead space. thank you >> thank you. >> next speaker. good morning, commission. i'm teresa. i have been birth holder since 2004 and have slips in both the
10:59 pm
east and west harbors over that time. i sent a letter this morning. scott nice to see you up walking. i want to share that this change okay. this change does affect me significantly. and the reality is i bought a boat it sail not to keep up at the dock. sometimes that is for the afternoon or for a day a week and i go cruising with my 9 year old daughter in the summer the 2 of us. i'm a single mom parent we take her friends give girls access to boating they would nohave had. i take disabled sailors and at risk sailors out. and sometimes i dot summer
11:00 pm
cruising. this upon adversely affects the cost effectiveness of that. and i heard the this might be an apartment and the difference in the upon traen is not like an apartment is because apartment holders don't pay property tax on the slip and i do. harbor master can rent out the slip the landlord would not. i understand that this might seem similar but it it is quite different. there is a significant number of vacant slips the previous speaker mention tldz is not incentive to market this i used to have a slip in east harbor and i would go away for a month in the summer and i would sublet that slip and at the time the rules allowed mow to do that. i wanted pay for the slip i did not earn extra money the rule change the 2013 more than happy to have the harbor collect that
11:01 pm
and give me a discount. but i have no ability to hospital harbor master find a person for the slip and give more access to the marineasm i love to collaborate and work with that as well. i think that others would, too. >> thank you very much. our bell is in the work. anyone else who wanted to speak on item 9? seeing none. i will give the folks on the line one more opportunity to raise their hand in case. folks call nothing dial star 3 to raise your hand. give them a couple seconded and let me finish it it is zero. public comment is closed. commissioners. commissioners. i had a question. sometimes changes like this i'm
11:02 pm
wondering if i'm reading here in the memo about the prove posed change resolves misuse of the regulation and improve sustainability of the revenue in the marina. are we able to comment a bit on what this misuse was? is it -- >> i give you. was it substantial. giving individual boats [inaudible]. >> we have a couple that are classic woodys. this come in for a quarter of the year. and they are in the 75 foot range. it is a dollar amount for the birth. and the hard part is when they are gone they go to a delta marina they put it under cover in a boat house like a garage with a door. that abuse. >> scott.
11:03 pm
can you speak closer. to that mic they can't hear you >> can you hear me now. >> good. >> okay. yea. i think part of the problem is that it it is also you know we have in the language that is there says, may. the problem with that is hathe argue every boater if i say, no. with this word, may. creates another caveat of work. it is also a nightmare for the process. you should be able to say this is how it is. this is what we do. not oh , we had the harker master may be we doll it for you. i came in this morning to the office and the first thing 2mented to go on temporary suspension. they are saying we are already leaving. it is this thing hay recommended now we gotta e mail the furthermore they were not ready. well is this process hagoes
11:04 pm
through. and for me not to have the opportunity to say let mow see if you are credible before they leave. are they behind in payments. all those things that go on with this. you know from is their credit good than i are paying bills? do that i have violations? there other thing this is go on not just this. and so we had to look at their account when we can't have the opportunity to do that they are leaving. jumpoth plane the boat is going. it make its difficult. it was like empty slips we are 95% full. and any marina you go to there is a 2-5% turn over. and we have a wait list of 220 boats. and it was mentioned one of the past meetings the 40 foots will never be full they are full. 5 taken were snagged up by the
11:05 pm
others called on the wait list. that is an issue in the marina but not a design problem it it is a some of the spots have a maximum depth they can go for the birth because of that is under the capped sand contamination or other requirements under the birthing permitting of others. so -- when we offer when we offer a birth we say here is the depth now. we are doing that because we had conplains they did in the realize it was than i thank you they needed a deeper birth. i'm a bet owner i came in a birth at oyster point i had 5 feet of water and now i sit on the bottom the ferries dump sand. and so -- i understand the wagz. but it come down to we have -- a 5% turn over a full marina on
11:06 pm
the west side. the east side we are closing down because. conscience of marina and push everyone together in the good birth and close down the others for removal soon. can i ask the question about an individual market their own birth. what is liability of that from the management stand point? if they were to go out and say, put a sign up i will be gone my birth is available they have to contact the office. get this birth or any birth of this size. and you know we try to work with everybody like we have a few when they call and say i will be gone for sick months here is my big boat. 80 footer space. can you find if you see anybody let them rent it. how about if they want want to find someone. they have to refer them to my office >> i have to liable.
11:07 pm
>> yes. i have to see. >> valid. >> there is not prohibition. >> no. >> not at all. >> you will say i than you person a would like me to -- give your slip first because you will bring me the person. you work with them. >> the more notice we get when they go on suspension helps us more. and you know advertise thering is a lot of advertising that is in the by paper. but i foresee us doing more. we issue full house urg the holiday science of fleet week. we have sprays and percentage of 2% all the time. we have 7 to 8% all the time.
11:08 pm
>> thank you. what is the shortest period of time someone can rent a slip. a day >> rates change. this commission approved i think i lost track. 2 plus years ago. in the off season 2 dollars a foot. and that is a form of advertising >> yes. >> >> good. any other questions? >> let's entertain a motion. sorry. denny. denny. >> please. thanks, president. i wanted to reenforce the points scott made. in that weres it is in the a common practice in marina operation anywhere to the pacific coast. it is i think scott's documented
11:09 pm
the lost revenue that is subject to hear the mirna fund as funds all marina operation fist we have a lost revenue the taxpayers make it up. and number 3, really had the scott's propose to do is take the word, may out of the regulation because when it is may it leaves us with the department at large exposed a high definiting subjectivity which is argumentive and if this person why not the other. circumstances are different. no, they are not. and it continues and so it goes. i wanted to make those points >> thank you very much. >> seeing no other questions the chair entertain a motion. did you want to speak to the issue? i will defer not secretary. >> we have not vote federal you like to reopen public comment.
11:10 pm
since you have not spoken yet. i'm greg. i don't have i boat but i have it some place else and i'm familiar with harbor rule in other harbors. to the point it not common practice for subletting that is in the true. as the nature of having the boat is to travel with. it it is common practice in my harbor up to a year and that happens often if there is i demand for slips. there are people more than happy to take over a slip for the period of time a mont, 3 or whatever. it is a limed resource and as a boater i tell actual is hard to find a slip in any harbor yet my experience in the city marina is it is wide open all the time. quite a few places. i think there nodes to are
11:11 pm
verification on that the use is and what the vacancies are and subletting policies and some statos how afternoon they have been sublet in the past. what i heard here does not much hay witnessed. >> thank you very much. >> okay. we will close public comment again and the chair will entertain a motion. a motion? yes? so moved >> yes. >> is there a second? second? all those in favor? aye. >> any opposed? it is unanimous. thank you very much. >> all right. thank you, everyone. we are going to be in closed
