evening commissioners, bothprint in present in person and on zoom. we are all happy to see you in which ever form. i have several updates this evening. the first of which is just calling attention to an e-mail i sent to all you last week outlining all of our commission goals and priorities for this fiscal year. these were compiled in response to our in-person retreat this year that we found very productive and they were to be finalized along with ben van houten and oewd and my supervisor in the city administrator's office and so, those are now actually sent all the way up to the mayor's office as our goals for this year and our priorities and so you'll see in attachment of those outlined for all of you, but i rather have you differ to the e-mail that i sent last week because that outlines each of your roles in that process

and your roles in moving some of these priorities forward in the next year within your working groups. so, the biggest take away for all of you is that you should have received an e-mail from may just this afternoon about scheduling ongoing working group meetings for those that are chairing, so vice president camini has a standing meeting so did not receive the e-mail however president bleiman and commissioner (inaudible) need to work with me to figure the best days to work with them and we'll work with the teams to make sure other members of the teams are available and get scheduled and moving. if you have any questions about those goals and priorities, please do let me know, but i'm feeling pretty excited about them and it is great seeing them in one place. the next item i wanted to bring up for all of you i'm going to differ to dylan who is on zoom right now, but this is a update

around our annual survey. dylan, you want to take it away? >> sure. can you hear me? >> yes. >> quick update as we repair to send out another survey to entertainment that (inaudible) this is a follow-up to last two surveys that went out in 2021 and 2020. a copy of the survey draft is in your folder. as you know, the economic and social landscape has changed. the purpose of the survey is gather feedback from local businesses to understand the continued impact of the pandemic on the industry. the latest needs and challenges, priorities for recovery. the plan is to use the data to inform strategies for full recovery of the industry. thank you to president bleiman and vice president

camino and director weiland and ben val houten helping us design the content for this year's iteration of the survey. the survey is translated to spanish and chinese and go out the beginning of the week. >> third update, i included a copy of the job posting in my director's folder, but just wanted to call attention. you may have seen in the news letter we are actively recruiting right now for a part time junior sound inspector to join our compliance team so woe have one full time full inspector and two part time found inspectors in the field supporting and regulating all of our night life establishments. in a moment you will hear deputy director

azevedo around compliance. she manages the team. as all are aware they do the great work insuring all our businesses are supported in the field and that we are able to respond to complaints in real time. when possible. if you have anyone you want to send this job posting to, we strongly encourage it. it is also a great way to get your foot in the door and city government and we are a enthusiastic department to work for i say. we are very small and we like to have fun and get things done and obviously a prerequisite is you enjoy entertainment and want to support thriving entertainment that is responsible in san francisco. that is that position. again, it will be posted online through friday september 30. it goes down at 5 p.m. last update this evening is compliance

update. let me pull up the information here. so, since our last hearing on september 8, 2022, we met with the manager who is also the son of the owner of stratus night club on ocean avenue near san jose avenue. you would have seen this permit application come as a change of ownership in the last few years. it has been very very quite for many years and i think that coming back into covid there have been a lot more programming, so suffice to say we met with cesar mont eseno due to aggravated assault with a gun that occurred on the sidewalk in front of the premises of stratus september 4 at 1:40 a.m. we met with the business owner, again on september 8 and it was kaitlyn and i along with someone from the city attorney's office and ingle side police station captain,

derrick lieu. we discussed the incident, what occurred that evening and our concerns with conditions regarding the security plan, so in response we did two swift actions. one was that we issued a directored order for revised security plan with several specific added security conditions and since then kaitlyn has been working hand in hand with the permit holder to insure the business comes into compliance within the period of time they are required to, which actually will be this thursday september 22, so we are going to be revisiting the business this weekday to check on compliance with that security plan. we also issued a 72 hour suspension for public safety that went into effect the entire weekday following the incident. the business owner at that time decided to close completely instead of just shuttering the entertainment for the weekday which we thought was a responsible action and

this past weekday sfpd visited the location and they let us know the business was actually under occupancy. they had roped off the gas station down the block that is problematic for gathering. they had blind control and they had cooperative and present management so those are good updates we'll keep you apprised and again go out this weekday to check on compliance. my final note on that is that we have also been briefing and updating supervisor sufia office because there have been neighbor concerns the office has been managing around this business. do you have any questions around this or any of our other updates? okay. >> alright. i do not have questions. any public comment on executive director weilands report? >> there are no public comments. >> okay. in that case

report listed a number of times. this is a long standing establishment that held a poe permit over 2 decades and historically hosted jazz musicians like billy holiday on a small stage in the back dated in the 40s. despite the rich history and live music scene the entertainment for the past several years is minimal and contain the front and middle premises closer to the deviz dareo. during the time we havet noreceive complaints about the business however as reopening after covid restrictions lifted the business had more entertainment more frequently utilizing the stage in the back of it business. the folks who submitted a complaint have been neighbors to the business for over 15 years and have a relationship with them and with the recent up take in the entertainment programming the neighbors are impacted by sound so reached out to our office for guidance. in response to the neighbor complaint inspector (inaudible) visited the business on a

second visit during a dj performance was invited into the neighbor home to listen to the volume and observed excessive bass levels. the neighbor is separated from the business by a 5 foot alley way so not adjoining buildings but very close to the stage area in the back of the business. inspector (inaudible) visited the business a number of times now and the owners have been receptive to the situation. our first recourse was setting a sound limit because the permit didn't have one. we also since learned they do not have their own sound system but rather the dj bring in their own speakers. this makes it challenging to set a limit and makes it challenging for the owners to take accurate measurement s from a sound meter app. the past week the inspector responded to 311 complaint and sound measurement was slightly above the

measure: worked to bring the volume down and went to the neighbors home to listen and could hear prominent bass even within compliance. inspector observed patrons were unhappy with the compliant volumes once the dj turned it down so believe the business would benefit from sound proofing in the back room to operate at a desired volume while not causing compatibility issues with neighbors. lastly, i learned mark reny is assisting the business moving forward and i also reached out to supervisor preston's office to breach the stach because staff because this is a legacy business. the next update is about the ramp located at 855 terry francois boulevard. hold a permit for outdoor entertainment. i shared we issued a citation for operating above the sound limit because they were only monitoring the (inaudible) when we visited again august 21 inspector encountered the same issue where a different manager monitored the sound

limit. it is the c weight that cause the complaint. inspector eare educated the manager how to monitor the levels correctly and we did issue another citation for this acurns and i also followed up with support about these two citations. the next business update you on is (inaudible) i think it is french and probably not saying it correctly, but located at 1787 union street. this is previously the brick yard but the premises has never held a entertainment permit from our office. i just want to flag this for you because it came on my radar when the owner contacted me about obtaining a entertainment permit knowing they have a license that says they cant nohave a dj. let them know they have to have the liquor license condition removed. fast forward about a month ago when i heard from the northern station officer about the business causing problems fwr the

neighbors including entertainment. visited the location and nobody was dj he observed full dj equipment. the manager assured him they don't have entertainment but hire mauzic music managers using their equipment and while they control the volume they don't mix the music or use a microphone. (inaudible) consider this entertainment and since the visit they have gone back but they were closed so we are not receiving complaint about having entertainment but i'm in contact with officer wallish northern station and flagging it in case it comes up in the future. the next is abobe books. they hold a llp permit. in the last several months been in touch with the permit holder. the cause of the concern is primary the door open during entertainment. both inspector (inaudible) educated their staff on site about this and also told the permit

holder they have to have the door closed during entertainment per the good neighbor policy so the visit september 2 in response to 311 complaint the door opened during performance and the staff were not aware it needed to b closed so issued a nob. three more. vicko cuvone located at 4248 18 street. holds a jam permit. we visited a couple times in response to neighbor compliant and senior inspector went on september 4, he observed them in violation of the jam permit. the outdoor dj oberate excess of apruchbed sond limit and tables and chairs blocking the sidewalk to not allow clear path of travel. issued a nov for the acurance and revisit on september 8 observed in compliance with the outdoor sound level. oracle park you are likely aware there were two large concerts two weeks ago

on wednesday september 7 deaf leopard and motley crew plays and sep 8 lady gaga. we received 30, 311 complaints, e-mail and voice mail. i shared the complaints with oracle park and asked to send a message i can provide to the 17 complaints. included a e-mail address for a staff person at oracle the neighbors can contact if they have questions or concerns along with the hotline active during concerts and confirmed this hot line is the same number for all shows so it isn't a rotating hot line number. the last update i have for you is about jolene's 2700 16 street. inspector responded to 311 complaint september 17. he could hear the music outside the building even with doors closed. took a sound

measurement which showed operating at hundred ddc and allowable is the hundred so 18 decibels bchb. no management or employees aware of the sound limit was able to get the dj to turn the volume down. we issued nov and in conversation with it owner about setting the sound limit. happy to answer questions if you have them. >> i do have a question about (inaudible) it looks like they were on this list about 12 times. >> uh-huh. >> and so, is a lot of these complaints coming from the same neighbor or is it coming from multiple neighbors in the area? >> we identified coming from 3 complainant and in conversation with 2. i had a 45 minute call thursday to address their concerns. you notice many complaints are clustered so they come in groups all around the same exact time sort of repeating themselves and we have

been responsive. the latest visit was september 10 and weresponded within 2 and a half hours of the last complaint coming in and did take a sound measurement which demonstrated operating within compliance of the sound limit so there is much ongoing conversation between myself, director weiland and neighbors and we insure capital gardens is adhering to all permit conditions. >> thank you. >> i did want to just point out hal seon because they popped up twice but occasions they were closed. that is worthy noting. >> the owner was able to provide time stamp images of the security camera but demonstrated completely closed of the complaint. >> which was a intelgent added condition you put on their permit. >> read my mind. >> (inaudible)

>> i never recovered from world class entertainment. >> right. >> one of the commissioners on line, did you have comment to make? >> yeah, that was me. about oracle park concert. i was also-a, i could hear lady gaga in my living room. not loud enough to be a actual concert, just loud enough to be annoying and (inaudible) friends and neighbors saying are you supposed to be doing something about this. i told them all to call 311. i knew there was supposed to be a hot line number, but it wasn't-i couldn't locate it like anywhere online through orical park or the giants. is

this number more easily accessible somewhere else or is there another way to get that hot line number out? also, i imagine people who did have the hot line number were calling it, but that didn't seem to have impact, especially the second night after people were complaining the first night. aside from having an e-mail and hot line, like what more can we do and did the folks at oracle have more of a explanation for why the sound was so loud two nights in a row? >> i can speak to the question about the hot line. so, i did encourage them to publish that more widely. i know they are doing next door posting and they have an adrisery that goes out to the list serve and encourage them to include the hot line moving forward especially that it remains-not changing. i think it was

changeing for all the concerts and now it is one line cht i also suggested they expanded the advertising footprint because there was things happening in between peak jz throughout the city hearing the sound so those two things we know are going to happen and happy to share the e-mail on behalf of oracle park commissioner thomas if that is of 234 interest to you to read that. >> i would also just say that a part of that response oracle park puts out says they will take into account collecting information around complaints and sound issues so it is within your purview of commissioners to invite them for update if you like. i think the we thought about this in the past-it has been a long time since there is oloud concert

door post. >> okay. >> i do think there are a lot of good suggestions here and also making sure that phone number is more widely available. >> but i guess appreciating lieutenant question. what happens when people call that hot line, do they just say sorry it is loud or do they actually take some action to turn down the sound or otherwise mitigate it and then, i know that the conversation after that beonce some was the weather and way the cloud were, but the weather was very different for these two nights. is it a weather issue or a sound design and amp lifiication and ball park issue that could be mitigated somehow? >> i quite frankly

dont know how it could be mitigated, but we can discuss more and try to get creative because of the fact that some of these very very large performers they have like lady gaga sign riders with them that they want to be at certain db levels that are essentially supposed to be compliant with the entertainment permit but when in true operation it is sounding like it is getting to places where it shouldn't be and so, then being aible to actually lower the sound while a performer like lady gaga is performing would put them out of compliance with their contract and it is not something that any large operating stadium that does outdoor concerts in america can do. those are just things to bear in mind. it is really a challenging one for us to mitigate. >> i don't want to

belabor but just add and think commissioner thomas is saying, i do think there is a opportunity for them to evaluate, i assume the speaker configuration varies. i know there was a time we were getting calls from east bay and that doesn't seem to happen anymore. this event was san francisco calls it appears. >> yes, the speaker configuration greatry varies depending on the artist. >> i am thinking the stadium itself could start developing best practices where speakers work best if they start studying the complaint ratio to the speaker because i have a feeling they can find a sweet spot that could be better. never going to be perfect, we know that. these are epic events that the city elected to take on. >> it is quite some time since we had discussion about sound with them. >> two years of covid, hasn't been much going on out there. >> happy to. we can

>> thank you commissioners. thank you president bleiman. i wasn't-real nervous when you started out on that but it ended up okay. good evening. ben van houten with workforce development with a short update for you all. we have been talking a lot about state legislation during the updates and finally at the end of the state or approaching the end of the state legislative year. the governor until the end of the month to sign or veto legislation. there are at this point two bills that we are closely following on his desks, sb793, which would create a music venue type liquor license and are then also sb1116, which i have not discussed previously at the commission hearings. it arrived on may radar later but create a new grant program for both non profit performing arts

organizations and fiscally sponsored organizations. grants tied to their payroll expenses. if that is signed that is something to monitor and see how members of our entertainment community can access that fund. there is a laundry list of items that did not move forward or stopped during the process either due to failing in a vote on the assembly floor like the (inaudible) legislation did or other items were stalled in committee or amended out of legislation and committee. a number of different ideas related tonight life, related to economic recovery. left on the cutting room floor at this point. couple abc updates. relevant to the sector. friday afternoon abc released the draft regulations on alcohol service in non contiguous areas, so the idea is that

currently businesses with parklets,ic parking lots not connected to the venue are using temporary pandemic permits to sever alcohol. what abc has done is proposed regulations to serve as a template acknowledging how many businesses are likely to apply across the state to extend their premises permanently into these areas. released the framework. there is a public comment period that is open right now. there will be a hearing on november 1. still digging into those proposed regulations and how they would align or maybe in some cases not totally align with our shared spaces program so i think more to come on that but really encourage anybody in the industry, anybody with a parklet or outdoor shared space to look at those regulations and really unpack whether to what extent the proposal around

alcohol service-for example, there is a part of the proposal is alcohol service into a parklet could only be done by a member of the business. you couldn't traverse inside the business to the parklet as a patron with a alcoholic beverage. it requires service into the parklet. things like that are really important to consider during this regulatory review period. then also, the last time on this slide. responsible service certification. the rbs training program businesses-alcohol service managers were supposed to all be trained and certified by the end of august and so that is a deadline past but still encourage everyone if you haven't gotten rbs trained or new applicant or employees into the industry have to be trained within the first 60 days of employment. couple local updates. there

was a chronicle article a little while back on exploring whether san francisco needs a nightmare and in response to that discussion, supervisor dorsey called for a hearing around how to better support the night life sector and whether a night mayor style model which is really i think more european style model would make since in san francisco. we dont have a specific timeline when that hearing will happen but certainly when it does happen looking forward to working with entertainment commission and then other city stakeholders on the work we do, the opportunities to support that work and this sector further moving forward. >> ben, not familiar with the term. what does it mean, nightmare? >> it originated in amsterdam where there is a member of the public is actually elected by a-it is a

quasi-business improvement district but there is also a public facing vote. the club industry votes to create a position that works with city government as a liaison on night life but is not a city official in different cities there really-including how we interface with the sector in san francisco there is i think over 40 different variations, some in government, some out of government, so that is where that kind of concept originates from. i dont think that that term night mayor is popularly buzzy but don't find it effective what the work does. >> thank you. >> the other item on here, supervisor dorsey is sponsoring legislation that is part planning code reorganization but would also do a lot to support entertainment and other small

business uses in south of market zoning districts. this is something originally introduced by then supervisor haney before he left the board and supervisor dorsey is now championing. that legislation should be coming to the planning commission in the next few weeks or month and looking forward to continuing to share information about it with all you. i think it's-makes a lot of positive steps forward in terms of planning code and entertainment south of market. a plug for the shared spaces program. the pandemic program ends march 31 next year and applications for the legislative program are due november 1. the shared spaces team is constantly putting out new information. there is another training i believe thursday for architects and contractors around how to build compliant shared spaces. there are lists of people who have taken the training before on the website. there are psa have videos and

webinars so a lot of outreach done to help folks prepare and come into compliance and apply for the legislative program for shared spaces. and then just highlight a couple grant opportunities that have come up since we last spoke. first of all, sf shines program has two components, two different grant components, one of which is design service grant which provides free drawings and design service from architect or service from a graphic designer. especially for the people who need professionally drawn plans. having access to an architect is free of charge is really invaluable so encourage folks to look at that. and then there is the complementary construction funds grant for up to $5 thousand to complete construction projects and purchase new equipment. the shared spaces equity grants have also reopened for another cycle. that is up to $2500 to support bringing the

shared space into compliance and the office of small business has a great resource page collecting all the different grant opportunities available. final lee, a couple data points i don't want to focus too much but they popped up in doing review of statistics for the annual report that the commission is doing. this is the number of night life businesses in san francisco, again restaurant bars music venues art galleries mapped from 2010 to 2021. obviously a drop in 2020 and a more significant drop in 2021 after years of steady growth for the 10 years prior to that. the drop-off is more notable obviously when it comes to employment within the industry. just a really sharp drop in 2020 which is not a

surprise, and then into 2021, a slight increase there. those are annualized numbers from bureau labor statistics. there are other data sources that are more current but each data source has its own challenges but we would be happy to continue to provide data points or if you all have ideas of specific data points or specific ways to benchmark the industry health, i'm more then happy to talk about those, dig into what would be helpful for this commission moving forward. and that wraps up my presentation, but happy to answer any questions. >> i got one thought. i think you already know this, but i think very easy way to look at the pattern is bundling the liquor licenses because the data is readily available on the site. go year by clear and

we are doing to help (inaudible) the role we played in this space. >> yeah. that's a great question. happy to differ to director weiland, but i think as this-it has been great to work with his office on the zoma zoning legislation and positive steps happening there. when this hearing gets scheduled it will provide more a roadmap to really drill into what would be most effective in terms of sharing that kind of information. i also think the work on the annual report and is a really-sorry maggie. >> we did speak with supervisor dorsey office and legislative aid immediately after the article and are did a lot of information sharing about the existing departments doing this work and i know ben would never want to be called night mayor, but he is considered a

>> so, okay. hi everyone. i'm sharaoen and i'm executive director of san francisco department of homelessness and supportive housing. i want to welcome everyone today to this joyous occasion. so, this is one of the new buildings that the city is acquiring to add to our permanent supportive housing stock. we know that supportive supportive housing is a try and traoud intervention for people experiencing homelessness. once people go into supportive housing, they do really well. i think we have an 87% retention rate over two years which means people tend to stay ones they come into supportive housing.

our permanent supportive housing portfolio to almost 3000 units which is one of the fastest increases in over 20 years. and these types of project don't get the fanfare support and recognition that they truly deserve. because because sadly we see too many people focused on the challenges of the streets but not necessarily on the people who were once part of the challenges of the streets. seems those people now turn their lives around, not just because they have a roof over their heads, but because they're going to have support from organizations like five keys where there will be case management and supportive services, 24-hour service from a team of people who actually really care about the success of their lives.

that's a big deal. and what i see constantly because many people say, what are we going to do about the homeless. and my push back is this, it's not a one size fits all. everyone you see on the streets is not necessarily homeless and has different challenges. so for us, to be as affective as we are in helping people and meeting them where they are, we have to get more creative and more importantly, we have to provide spaces like this. 114 units added to the portfolio with a team of people as i said from five keys. our goal is to make sure that the people that we are directly pulling off the streets and moving in this building never make it back out to the streets. never get back out there for any apparent reason.

it takes a lot of work and money and resources and it really takes a village. of course, sharene and the office of homelessness and housing play a key role in managing a lot of the properties that we have been able to acquire but we can't do it again. and having partners on properties like this and being actively engaged is going to really be a game changer for the city. this was not something that we focused on in the past. and in fact, by 2023, we'll

have about 14,000 units of permanent supportive housing in our portfolio. so that's going to be a big increase. and let's also talk about the data and work we've done and how we're finally seeing results. more than almost any other city not only in the bay area but the entire state of california. san francisco saw a 3.5% reduction in homelessness overall and a 15% reduction in unsheltered homelessness. so we have a lot to be proud of. we know something is working. we see the challenges every single day. but just because people are outside, hanging out whatever going on, does not always mean that they're homeless. and part of our foc sus making sure that we have support and a roof over folks head and the other part is services. the other part is assistance in various capacities. and five keys has been a tremendous partner in helping us in this work. so we appreciate the opportunity to open this space to make sure that we highlight the space.

this is one of the, bases that we were able to acquire fast, unlike most spaces we're able to purchase. wefrp approved in february and we started to move people in may. it was brought to mia tension late last time, that's rocket time in san francisco. but every delay, means a denial to safe affordable housing. i want to thank you for helping us make this building part of this reality and maintain this partnership and great opportunity for san franciscoians to have a safe affordable place to call home. and with that, i want to introduce the supervisor who represents this district. it threw me off, i used to be

supervisor of district 5 and after redistricting, supervisor stefani is the supervisor of this district which i think is great because she will give this building, this side of the community a lot of love and attention. but more importantly our city is changing. it's changing and we have to make some hard decisions redistricting. and in fact, we saw district 6 grow significantly. we saw district 10 grow. but we didn't see a lot of our other parts of our city grow because we were not building enough housing. we have to get aggressive in building housing all over our city. that's really important. but in the meantime this is a lucky building to have supervisor catherine stefani and without further ado, the supervisor of your district. i have the privilege to introduce one of our residents. david has been unsheltered for approximately 20 years. enter the system about 3 years ago. he's one of our residents right now. david? >> hello my name is david, david rogin and i'm a resident here. i'm a resident of san francisco born and raised 66 years ago. you know what, i'm lucky to be here. this is the first i can say this is my house. you know, i've got my own key. and now that i'm here my goal is to really get myself together.

i got a place where i can come in every night to eat and be safe. you know it's my room, it's my place. what is better is, the first thing i got into the building, staff made me nervous because they kept asking if i'm all right. i'm all right, they got me a place. i didn't move around like him. but he got it for me and i'm here, you know.

now that i'm here i can concentrate on my health. not only my health but my relationship with my sister. everybody else is gone. i can ask my sister to come over so i can cook her something to eat. i wish i did that with mom but, it's a little too late for that. i hung in there on this ride, i was living in sip, shelter in place. and first day, they said they would guarantee me housing and

years later, i'm here right here. that's what is going on right now in my life. who ever thought i would be doing something like this. it's the like the movies, the mayor is next to me and all of these people. makes me feel like i'm somebody today, you know. [applause] the numbers that are out there, it may be understand a whole lot about what is happening in san francisco with the homelessness and addictionness going on. yeah, it is a problem but my results is if you stick with it, you can get here in san francisco.

something must be happening, you know. i can walk through some of the old neighbors and show. it's different now. i don't know how much they had to clean up around here. this is a nice neighborhood, two blocks away from st. marie's church. one of the parks away, i used to play baseball. now it's about 50 years ago. but, i'm here now and i can look at the park every day and enjoy the sunshine. and just come back and kick it in my place, you know.
