schedules for next year. take our pole regarding your availability for the next few montes and fake a look at that schedule and it is the first and third tuesdays of the month. however we do participate canceling a few next year due to legal holidays occurring the day are everbefore fourth of july is an example. beyond that, i wanted to call attention to your new year's eve next week our biggest weekends of the year to be staffed out in the community and make sure that we have our inspectors checks out the venn use and the upon events. we will go ahead and send over a lengthy list of events to emergency operations center that is staffed by department of emergency misdemeanoring. and other colleagues related to emergency management work on that weekend.

now here at meeting. >> welcome. >> we will close public comment and move on the item 5 report from deputy director >> good evening upon happy holidays. we have received 74, 311 complaints since november 15th under a month ago. a few enforcement updates and ask question fist you have them. the first is gastalt. tonight you will hearing from danielle hawkins the owner of gastalt regarding enforce am action. i wanted to update you now about the latest site visit we conducted at the business. on november 19th inspector responded to a 311 complaint at 2. . 15 a.m. he heard loud music the front door was closed and kurt anxiety were pulled closed when he went inside he saw there was

a dj and people drinking. he spoke with the owner about the sound complaint and in violation of permit requiring the entertainment ends at 11 p.m. the owner stop and said the bar was closing thespecter waits and saw more entering at 2:30 and heard the dj playing again of people were served alcohol and i issued a citation after 11. received a complaint about the operating she was not there that night after speaking with the house manager she learned the dj did plan on exiting the club at 4. the music was being played after 4 a.m. we issued a notice of violation for this. and the owner has spoken with her staff and ensuring that the

entertainment ends at the end time for that evening. >> next galleria bo hem, an event space at 2391 mission. 's one time permit for grand opening on december third. we received 4, 311 complaints and the inspectors responded at 8 p.m. and again at 10:30 p.m. had a one time upon event permit did not obtain it from sf sd and could not have more than 49 people inside. this is condition on their permit from our office. when they responded they observed 70 people. there was no entertainment just recorded music. during the second visit at 10. . 30 band was playing and party was over 100 people upstairs and the basement lounge which was where a dj was performing the inspector spoke to owners and

educateod responsibilities of keeping the sidewalk clear. front door closed and patron limit. they advises to evacuate the pat rons in the basement it was a fire hazzard there was a single, deep, unmarked stair well. so the owners did clearwater basement as well as the front side walk. i issued a notice of divagz per door open during entertainment and violating the occupancy load. we received 2 complaints when the inspeckedor responded he benched full compliance with the permit. this business has expressed interest in a poe permit you neigh may see them in the future >> permit approximate agenda tonight applying for an llp

permit. in december had a phone call with an owner and i had -- received holding entertainment without a permit i explained they're not allowed have entertainment without a permit. will of owner understood this we received a sound complaint at 8:36 p.m. a picture of a woman on a drum set in the business. senior inspector responded to the cam plain and the band was on a break and benched a salsa band set up including the house pa system. he did not seat band performance he saw a drum set conga and a vocal microphone. next night the inspector visited at 8:45 and saw 2 classical guitarists playing through the house pa system.

spoke to the owner about the reason for his visit and explained she did not know this was an ampification. and i did issue an nov for hosting entertainment without a permit. next is sky lark final. on saturday november 26, inspectors conducted a follow up compliance check. revised permit and security plan. during the visit they observed violations. when they arrived at 10:15 the front doofrs open. no security and dj inside. they returned at 11:00 there was security at the door and asked to see id's and once they identified themselves they learned there was no manager on site. security guard called down to the head of security, charlie. he was at the end of the block speaking to someone in a car. charlie came and spoke with inspectors it was clear he was not familiar with the revised

security plan the inspect ors asked for the door security guard card he did not have. they seen charlie's they did not ask him. they asked charlie if the cameras were working they are required have video and autorecording chaurl was was able to confirm or if cameras were present. i'm not sure if this was bad timing butt security plan was not followed nor a manager was on site. and of course security should be familiar with permit continuous. we issued citations and the owner was reupon septive and responsive to the message to out line how he would rekt fight situation to meet with the staff for the security plans. they will always have an on site manager thursday-saturday and he had put out an add for mature head of security. and last lite owner shared heel sell the business in the meantime comply

is it catchy but works the note once the jam permit program ends we will reinstate the out door permit. the events have been replaced by the jam permit but will come back in 2023. it is shared space and jam permit program are slated to end on march 31 of 23. this means any business who holds a jam permit and wishes to condition hosting out door entertainment and or amplified sound need to apply for a permanent brick and mortar perimism we encourage all jam permit holders begin application process now to avoid a gap in out door on going programming. and in a moment dylan will share the out reach we have done. the first thing a business must do with our office is get the property property approval.

this will look differents depending with the permit activity is taking place. for a business with a parklet. approval from the share's spaces program. for businesses or events with a roadway closure they need approval from the stay stay or escot and activities on private properties they need approval from the land use agencies planning, port or ocii. once the business has the property approval, they can begin brick and mortar application process with us. either a new brick and mortar or amendment to the existing. >> thank you. so, this next slide is the why. why are we doing this transition in the first place? besidesment to aline with the transition of shared spaces program to per minute nance theis an opportunity to advance

our entertainment commission goals of 1 other creating sustaining and supports arts infrastructure. with over 2 huh human gentlemen permits this would be a significant increase in the number of entertainment spaces in san francisco. and 2, the gospel supporting the live lihood of night life businesses and whoa. we heard that hosting out door entertainment in amplified sound increased the customer traffic and sales >> and it supports the recommendations of the economic recovery task force to driveway our city's recovery that recommendation is -- catalyzed neighborhood recovery through the arts. look at stats. to give you an idea look at the current number of jam permits with entertainment or amplified sound of as of december 15th we

have 276 jam permits with activity across all property types of the pie chart break its down by property type. 82% using parklets. the vast majority. 13% private property and 5% roadway close thurs is on going activity. note, we have issued 387 jam permits f for one timer special events a total of 663 jam permits to date. >> how many of our permit holders started the transition? tow date dpw received 460 applications for permanent parklets and of the applications only 22% are from our jam permit holders. in that group one approved with modifications to the parklet, 5 are posting and waiting for final inspection and 4 have been

closed or denied. important to note that none of the parklets the finished the property approval process to be permanent the final status is element status from dpw. there are still 78% of jams not started to apply for you permanent parklets. priority is to encourage the group to take advantage of this opportunity and get the applications submitted to shared spaces by january 15th for gentlemenos private property, thank you kaitlyn. there are 35 businesses eligible to start the permitting process. 2 submitted to deputy director and lastly there are 3 roadway closures out of 16 recurring closures. here are dates for e c staff and commissioners. january 1, we will have launched the digital brick and mortar

application. i will talk about this in a moment. between now and may third, 2023. we'll process jam to bam applications for new brick and mortar permits or amendments to existing permit who is want to add this out door component. application process for per mists look like the current application process. someone will apply with me intake. post to the conduct. neighborhood out reach and ec hearing. a few ways we plan to manage large volumes of application system instructional videos to replace staff time for in lieu of the intake meetings. we will do that for businesses with no enforcement history. we plan to have faq's for applicants and neighbord and may schedule commission hearings as needed in the new year to accommodate vol unanimous of new applications. and lastly we are exploring fee

waivers for gentlemen to bam permit holders to waist application fee and first license de feo this waiver program would wave now llp permit mrksz. so the cost would be waved for the businesses regardless if than i had a permit or not this is tbd and we'll let you when we have more information. excited share where you that we are in the home stretch for launching our digital permit application on our website. a labor of love and i'm so excited share the final product with you soon. screen shot is what the first page of the application wieblgs will look like. and it is the design to be a choose your adventure application. regardless of the permit type someone is applying for they go through this one form. someone could apply for any allal once through this form.

we are in the staff use are testing phase and i will open up to public use are testing this week. so part feedback is positive and as you imagine this will stream line our process tremendously more user friendly for applicants and efficient for staff. and one cool feature in my opinion is the digitize all the back ends data make it fortunate for pulling data and collecting data and better recordkeeping the goal have this live by january first. and i will share it with you. >> time lines for permit holders date and dead lines. which you will see are fast approaching. january 9 we'll relaunch our original one time permit like kaitlyn mentioned after march 31 when it expires.

january 15 the application deadline for permanent parklets and roadway shared spaces and the pandemic permits expire and our goal is to get them transitioned to prevent gap in operations. we have a 60 day wind down period where jam in good standing keep operating at the location until may 30. we are working with shared space team on coordination on the out reach and compliance to adhere to the time line if anything changes we'll update you soon as possible. out reach inform terms of out reach since september promoting the messaging to permit holders. through online channels like the e blast and social and the website. we did special faq. deputy director surveying and providing catered guidance on

somebody that wants to stream line bureaucracy. encouraged by waiving of fees and the application. it is still we're san francisco and bureaucracy heavy and we have the of course we have to get the department of public health and the fire assembly and go through all the neighborhood --the neighbor and vacations and stuff like that. is there a way to cut that red tape because people have been existing jam holders or come from a permit and the neighborhood. there is no like other grandfathering in? >> so. it is codified. right? so they do have to do a public notice. and they do have to do neighbor out reach. and i for one continuing will be helpful because that is what we have been communicating all along to businesses and to neighbors.

francisco. first the back ground and the purpose of the survey. a follow up to last year measuring the impacts and needs of the industry as the city was reopening. this makes the third survey after we start in the 2020 at the beginning of the pandemic. the purpose to understand the continued football and social impacts of covid on entertainment and night life businesses in san francisco to identify the needs, challenges and opportunity a year after reopening and help guide the city strategies to support recovery. during the -- 4 week period in september and october we had 103 respond acts compared to 163 last year responses remember unanimous. th for in year we focused on businesses including business ordinance. managers. nonprofits and self employed importance. there is more work that could be

done in the future to expand networks with employees in the industry. >> we divided the survey in 4 areas to help us understand industry profile. which sectors impacted are we reaching the right people. business impacted we are reopened for a year how are businesses fairing financially and operationally and what are their biggest challenges. our engagement. how well informd and supported in terments of guidance and customer service and last plea industry priority what is do they want the ec and city to do to fully recovery the industry. we wanted know which sector they work in the and the largest said bark live music and/or restaurant. brick and mortar establishments were the largest in the sample.

and in terms of which entertainment permits the businesses held, poe, jams and llp's were the 3 most common. over all 2 thirds said that than i had one entertainment permit. the businesses loeshthed in the city? in terms of where options are most concentrated the list of zip code system reflective. mission, soma, haze valley. russian hill. north beach. the exception of castro only had 3 respondents this year did not pop up on the list. business impacts. to measure financial impacts we started asking them about financial out look over all. good nows to share with the majority 79% said thissier their business could operate beyond 6 months 16% said they could

operate between low and sick months. one said they had gone out of business this is a significant improve freshman last year's numbers 54% said they could operate beyond 6 montes and 28%ed 6 months or less. we asked to rate concern their accident will need to close. the numbers this year tell us more than 1 fourth gave a rateoth higher end of concern 8 and 10. and 1 third gave a rating on the low ends between 3 and 1. compared to last year the improvement is minor. this is between 6 and 10% range difference in both directions. my take away here despite businesses being around 6 plus months there are manner concern they need to close in the long-term. >> we locked at indicators loss

of income and staffing. compared to 2021. people are reporting sales up but many hear saying the sales are down t. is broad distribution. and compare to the 2019 not surprisingly most said sales are down with 35% saying sales are down more than 50%. now look at staffing. compared to 2019 this year has seen the loss of 4fte's on average. this slide here confirmed that more than 2 thirds are dealing with staffing shortage. some of the solutions and adaptations included recruiting. working more hours and rusing showers reducing shifts.

attendance was both financial and social impacts. the vast majority of venn use and event organizers reported attendance was down compared to 2019 with 42% reporting that attendance was down 50%. pretty significant. to see how numbers compare to the city wide economic recovery here are slides from the city economy and the controller's office. job growth, here is what they found. in september and october of this year the hospitality industry saw the first growth since the pandemic begone a few thousand more jobs hopefully that is a sign staffing short okays will find relief soon. and looking at the opening of

new restaurants and borrows in san francisco the numbers from the controller's office say new business locations have been increasing since may of this year. you seat orange line. the next will illustrate concern and challenges by businesses across search issue areas. with public safety occurrence at locations 68%ed they agree or strongly agree with the statement. the most common concern selected were, safety to employees and to pat rons and property damage. in terms of concerns about public health. most responded 42% said agree or strategyly agree selecting covid and drug over doses the the common occurrence a kwsht neutral and a quarter in

disagree, strongly disagree range. now vast majority 3 fourths said they had concerns about street clean liness and with transit 55% had sxrns a third said they were neutral. the next 2 slides delve in the top 3 challenges to successly operating the accident. you see that staffing shortages got most with 41 mentions followed by low attendance, lower sales and neighborhood and street safety. the next challenges reported were street and sidewalk conscience due to homelessness, emcampness and street cleaning and higher costs of doing business and inflation challenges.

upon switch gears to see how businesses view the education and customer service. like last year the e news all right with the primary channel that people used to receive guidance followed by the website and social media. there is room to improve a third of respondents said they were not using the online channels at all. and when poleod the topic they want education on. music licensing and safety and security best practice received the most response followed by mediation with neighbors and harm reduction. how did businesses feel about our staff's responsiveness to the needs or question sns like left year high ratings in this area. 2 thirds ratings 8 and 10. on the responsive their responsive side.

15% of a rating of 5 or lower. the slides will cover what businessesment from us and the city in terms of help and biggest priorities. in terms of what the ec can do, moror different low to help businesses the common priorities mentioned were, advocate for over all industry recovery. one person said help us stay alive. more funding. grants for businesses. advocate for street cleanliness and public safety. they said they wanted us to promote specific night life businesses. they want us to make the permitting process easier to clarify and stroll line the rules, applications and ways to be compliant and improve mediation for neighbor complaintses. a neighbor's complaint should

carry less weight in the decisionmaking. of now in terms what the city can do to the help the industry recover the common themes were. measure funds to support grants and fee waivers. cleaning streets and improve safety on streets and at businesses. reduce crime. less red tape for permits from the city side and abc. hospital homeless population. get them in housing. and increase late night transportation and more resources for businesses like trainings and networking. that is the end. thank you for your time and i'm here to answer questions. the complete finding in your folder if you want to dig deep and look at data more closely. thank you very much.

the the over dose prevention needs and desires for support around this stood out and i think that is consistent with the w that we are plan to do around providing more training for staff and -- venue owners. on entering the prevention tools and on site. so, yea that validates the need. >> great. i had a couple comments/questions. in my business we have been dealing with staffing shortages issues and part of it is that staff e vaperate exclude hard to find good people and part is custodied mers disappeared it it is hard to attract good staff if they are not making as much money and many cases like one of my businesses tips are down 70%.

311 sound complaints. 18 of the complaints prior to the business granted the llp permit on july 29 of 21. the remaining 60 complaints made since the permit was guaranteed in total the business in violation of permit 12 out of the 45 times we visited in response to complaints to date gastalt received 2nov and 6 citations. as you are aware the violations at the business have been about operating above sound limits or past hours of entertainment that require an 11 ends time. the latest 2 on october 29 and november 19th for operating entertainment beyond the permit condition and time of 11 p.m. 2 a.m. and 2:30 a.m. n. last 12 months the business done operating after 11 p.m. on sick occasions.

midnight during the weekday and on those occasions i reached out and said we get complaints about loud music after midnight. he admitted on 3 occasions he was hanging out in with the music turned up with friends and said he will stop. we can't get eyeos it ourselves it is a self atestacean he shared with me. the good thing for us we are really laser focused on the live music. so complaintses come in if they don't have to be live music we can work with a permit holder and decide there may be not responsible to have live music it is in the our lane. my recommendation is that we limit live music 10 p.m. on friday and saturday nights and a time i feel comfortable that
