1:47 am
1:48 am
>> this evening okay. commissioner ruiz, i believe you need to request recusal? >> yes. i wanted to inform that commission and the public my employer in the community development center has not taken a position they have been working with the dr requestors. so, yes, i will be asking for recusal. >> thank you. >> thank you. commissioner moore. >> making a motion to recuse commissioner ruiz from the item on the agenda. >> second. >> thank you. on that motion to recuse commissioner ruiz. commissioner braun y. aye yoochl commissioner ruiz.

1:50 am
if you are here come forward. yes, please and you will have a minute. bear with me i will pull update e mill for the continuance if this is okay. >> hello. i'm lawrence michaelsonet experience for 100 broadway this has been my project. i received a continuance this morning in regards to the smoking and variable lounge on the second floor as well as the use of the building and space. all of this has been properly filled out and submitted to planning department where they have told us their position was they believed everything was in compliance with planning and the cannabis rules. there one retail spachls comment 3 well is no 600 foot buffer. there is one cannabis business
1:51 am
on the retail level upon as far as the smoking lounge i will follow up with d ph. until we begin construction to show separation shall be it is an open pace we have not submitted a building permit to make the modifications to be in conformance with d ph which we will do so. those other 3 items. i skw if well is a way not to have it help and allow the project to move forward that would be this is also 4 times. >> that's your time. >> believe me i am equally frustrated as you are this last minute request come from staff. interpreters i will ask to you interpret one more time that we can't have the doors blocked. and if the people intend to peek they lineup on the screen side
1:52 am
of the room. if they are blocking the doors they are kazing a fire hazzard.
1:53 am
>> okay. yes. >> good afternoon. i'm jeremy gladis and i am the commercial broker who leased the space for 100 broadway. and it is very lawrence is an outstanding guy. the space is in the green zone. he complied with the ordinances. you know we are taking comment on the matter of continuance. no reason to continue it. he will provide jobs doing it. we should talk about him running for president now. thank you. next person.
1:54 am
>> i'm upon as i understandy keen with the partnership for the building. lawrence has been working with the city in planning department for over 18 months has been pushed off 4 time and submitted everything the things today with the planning department for up to a year. we many of us come from out of town and rearranged our schedules to be here and find out an hour beforehand is difficult to work watch we ask that you reconsider the continuance and let's move forward with this project. please.
1:55 am
there is usually a good reason for continuance when things have been calendared. helpful to know why and who was asking. thank you. sfu wish to speak on the matter of continuance come forward. will call nothing remote press star 3. we'll go to remote callers.
1:56 am
hello? [translation] my name is suzie.
1:57 am
i oppose to open the store at broadway. in san francisco there is over 2 huh lun marijuana. interpreter i will ask that you notify the caller that we are only taking comments on the matter of continuance not the project.
1:58 am
okay. yea i oppose to open marijuana store and broadway because in san francisco there are more than 200 marijuana store in san francisco. it is more than the [inaudible]. and safe way and also the location live elementary. i will interrupt. one more time. i know it is in the what you were saying and you are intercepting but notify her we are not taking comment on the project just on the matter of continuance. >> you can speak to the matter of continuance it is proposed to
1:59 am
be continued to march ninth it is in the likely tell be heard today. >> continue to? confused what can i say or not say. but i'm opposed the shop opening. >> can you let her know what people is speak to in support of or opposed having it heard on march 9 or today that is the question the commission will be considering at this time.
2:00 am
she said is it 19for the public comment is only to give idea and the opinion and no decision will be made today? >> not exactly. they submit their opinion on whether or not it should be heard today or on march 9 or on the matter of continuing not the project itself i'm not sure how else i can describe that i know it is frust ritting and confusing. at this points this is the
2:01 am
procedural matter at this point. i will take the next caller. she clearly is opposed to the project. go to the next caller. why hello i'm in support of continuance and continue on march 9. i think that as all the people in this here in the cham scombers on line i think there is confusion amongst non-english speakers to what that needs to be continuance. means nothing explain in a way that is understandable to be clearly stated the meeting is march 9. if people are here and have heard and march 9 [inaudible]. i will support the meeting on
2:02 am
march 9. and the [inaudible]. [inaudible]. [inaudible]. thank you. >> thank you. >> so i'm also for the continuance. of the [inaudible] i'm a parent of 2 kids who go to day care on the within the building so. i think it would be good for people to move for the next time. everybody could be appropriated ahead. thank you. >> thank you.
2:03 am
i'm danielle i'm supporting the to hear it today. the public has had april of last year as they were all notified the project that were interested for the good neighbor policy. it was then sent 3 separate times to all the neighbors. there has been -- there has been now 3 -- posters put up. they have known since last october this was going on. so, i feel like is a stal tactic and not sure why. we are ready to go.
2:04 am
upon one more remote caller. >> hello. hi. [translation] i oppose to open the store. thank you very much remind her we are taking comment on continuance. it is not likely to be heard today but she can submit those mentes later.
2:05 am
>> i have a concern because i have a son his mental state is not very stable. and if the marijuana store open near by and -- i am afraid that is [inaudible]. impact on his mental health.
2:06 am
hi. okay. we need to maintain order in the chambers. >> i will say in mandarin.
2:07 am
can you ask them we don't tolerate the disruptions. [translation] >> thank you.
2:08 am
resuit last remote callers, please. i'm call nothing because i think many people i -- there is no choice whether we agree or disagree with the march ninth you have control of everything. so. [no audio] next caller. we are done with remote callers.
2:09 am
good afternoon members of planning. i'm [inaudible] one of the partner of the property owner. i have [inaudible] like to mr. neck son done everything to present the do you meanation. this was the last [inaudible] the gentlemen the last minute is unfair everybody change everything. and the other thing i like to mention when the gentlemen from the asian community speak why don't we have someone to translate to us when they are saying. we respect you hayou are doing and should be treated fairly we don't know what they are saying. >> there are people translate and they are interpreting both ways they say when we say and repeat it back. when the call are speaks they
2:10 am
repeat in english. hopeful low that can work for you has for the commissioners. first, i understand this it is a left minute q. it is in the a request the sponsor we understands the surprise is frustrating. i wonder if you can explain for us as commissioners why this is requested. >> department of public health does not review plans the stage of the process. we did ask them to take a look this morning after receiving questions about the feasibility of the smoking lounge on the second floor. d ph said they would not approve as designed. likely they could approve a
2:11 am
lounge just not where it is shown now. you know, we don't typically bring projects to you where we are aware the plans as po posed can't be approved. the use is not necessary low what is question but wanted to work through the details so the floor plan you look to the second floor smoking lounge you have a solid sense of the place am of everything. location and the details. to make an upon pro decision this is why it it is an 11th hour ask. we don't normally ask for peer review at this stage of the process. but based on questions from the public we did drill in with public health and that's where we landed this morn. >> commissioner diamond. >> i, too, am distressed and
2:12 am
feel bad low for everybody. it it is the last minute request we don't get very many motor vehicling lounges in front of us. they have been areas of concern to the public and the commission because we want to make sure there is no possibility the motor vehicle or smell will affect anyone in the building or the public. and i foal uncomfortable rerowelling plans where d ph is saying the current plans don't work. i would move to continue. at this stage. >> i second the motion. like to add a comment. perhaps there could be a brief sin oppositeis what commissioners are talking and translated what we are talking about is the record of how this body is being looked at. we have questions. we believe that what staff is
2:13 am
telling us is a reason way to give this project when we say another one over. i ask our translators to briefly gift audience the level of comfort that we peel we need to look at this a bit longer. >> yes. agreed. >> thank you.
2:14 am
2:15 am
>> okay issue commissioners. there is a motion and seconded
2:16 am
to continue this to march ninth on this motion commissioner braun. >> aye. >> commissioner ruiz. >> commissioner diamond. >> aye >> commissioner imperial. why aye >> commissioner koppel. >> aye >> commissioner koppel. >> aye >> commissioner moore. >> aye >> commissioner tanner >> if the interpreters notify this will be heard on march ninth. >> thank you.
2:17 am
commissioners that will put us entered commissioner matters the lands acknowledgment. we will give folks a mobile home to leave if you want to leave. we are moving on from 1 huh human broadway heard on march 9. not heard today. if you like to leave we'll give you a moment to do that.
2:18 am
make sure we emsends and thank you to the interpretation staff for hurrying and helping us
2:19 am
manage our meeting. you performed admirablely. i know staff were disash pointed but right to notify us. so. we will move on. to our land acknowledgment. ramaytush ohlone acknowledgement the planning commission acknowledges that we are on the unceded ancestral homeland of the ramaytush ohlone, who are the original inhabitants of the san francisco peninsula. as the indigenous stewards of this land and in accordance with their traditions, the ramaytush ohlone have never ceded, lost, nor forgotten their responsibilities as the caretakers of this place, as well as for all peoples who reside in their traditional territory. as guests, we recognize that we benefit from living and working on their traditional homeland. we wish to pay our respects by acknowledging the ancestors, elders, and relatives of the ramaytush ohlone community and by affirming their sovereign rights as first peoples >> thank you. >> thank you. item 4 adoption of minutes for
2:20 am
january 26 closed session and regular hearing. members of public this is your opportunity to address the commission on minutes if you are here come forward if calling in press star 3 or raise your hands. seeing no requests, public comment on minutes is closed and they are before you. >> >> move to adopt the minutes. >> second. >> on that motion to adopt minutes commissioner braun. aye >> commissioner ruiz. >> aye. >> commissioner diamond. >> aye. >> commissioner imperial. >> aye. >> commissioner koppel. >> aye >> commissioner moore. >> aye >> commissioner tanner. >> aye. >> item 5 commission comments and questions. >> i want to call attention to will the major's executive directive issued on monday. and i was excited see firm and
2:21 am
items soon and i think everything in the next year moving forward on the housing element t. is great to have us have approved and seeing the mayor take steps to help the city organizations and departments get organized to deliver on the housing element and coming from the state of the city this morning, able to hear other priorities in addition to the housing element. rousing unhoused population and exit homelessness and reimagine downtown. a lot of things in terms of priorities. i upon wonder about scheduling a session at the commission where we talk a bit about our role in implementation and when we might see coming forward. obviously there , is a lot of moving pieces and not something i hope has a tremendous writing but opportunity to commissioners weigh in when we might like to
2:22 am
see and how we may see item in the staff report. open to ideas but i think it would be good to get organized and understand our role in the larger implementation strategy. >> i think that ask a great idea. we can organize you will have a role in most of what the mayor called out in the housing element. executive director will require legislation and changes to the planning code this will come here. so we may want to go about giving you an over all calendar and schedule when you might expect to see those legislation come. you know board members may introduce legislation on their own as well on implementing the
2:23 am
housing leadership. happy to have this discussion. >> thank you. >> like to draw attention to the earth quick in turkey and syria >> the pictures i have seen reading the newspapers are so devastating i only think of us in the earthquake prone country to extend our wishes and support to the people turk and he sir why. i think we all share that. commissioner ruiz. i want to acknowledge my virtual attendance last week and this week the staff are unaware i'm pregnant which means [inaudible] i will be participating virtual
2:24 am
hope loafly for the rest of february then going on [inaudible] i will just say farewell in case something happens in the next week and thank everyone and see you all in a couple months after my leave. >> excellent. congratulations. we are excite exclude thank you for continuing to payment. >> thank you. commissioners. >> okay. seeing no requests to peek from the commission. we will be on item 6 director's announcements. no announcements. >> item 7 the past events don't have a report from the board of appeals. >> good afternoon. this week there were no items at land use that involved planning this week at the full board
2:25 am
supervisor dorsey's ordinance that would prevent night time entertainment on folsom between 7 and division and fronting on howard and division passed the first read. that's all i have for you today. >> thank you. if there are no questions from the commission, we can move on to general public comment. members of the public may address on items of interest in the subject jurisdiction of the commission except agenda items. with respect to agenda items your opportunity is when the item is roached in the meeting. you may address for 3 minutes. general public may be moved to the end of the agenda. >> good afternoon georgia, thank you for putting the executive dprekt if the mir and acceptness
2:26 am
letter from hcd on the commission website. congratulations to commissioner ruiz. going forward i hope that the residential policy must be cod foiled. in thes should be min tain in the existing configuration to preserve this typology and maintained in the existing structure. the resource survey prepared a report on flats. that is a good resource. and it is entertaining. and informative. additionally, efforts must be made for second units or existing inlaws. there was a project had i learned about from the flat study. can i have the over head,
2:27 am
sfgovtv. will that's from the study i did in the know but it is called penthouse. penthouse duplex there was one before you in may you never heard it they settled. my issue is this. is that my issue is you never saw it but you codified it the original flat there is the penthouse duplex. that the mauler unit was put behind next to the garage that
2:28 am
bowling alley is part. i don't think that matches with the flat policy. i know it is one type of thing. everything that happened and 317 b 7 flats or second units disappeared into other units. you saw that the commission saw that with this thing. over head. when it was originally this. and then this . you know that is 21st street. and this was -- this. this was originally.
2:29 am
thank you, have a great day >> anyone else in the chambers? wish to submit public comment. general public comment? go to remote callers. [inaudible]. i couldn't finish my opinion earlier. [inaudible]. [inaudible] the people -- [inaudible]. [inaudible] ma'am you are
2:30 am
muffled. can you hear mow? yes. you got muffled there. >> i got muted in the middle of my conversation. my comment and i don't feel appreciated the people when went out earlier last minute you cancelled this is not okay and i raised my hand and you kept lowering it it is i way for to you say, no we don't want to listen and to block our voice. i [inaudible] they are frustrated and angry you change it the hour beforement should they are angry at you in they should. don't call them [inaudible]. you are being a racist. i think you owe an apology.
2:31 am
>> that concludes your comments. ma'am >> go to the next caller. >> commissioners, i'm francisco decosta. and even though i had my hand raised for some reason -- 3 time s i couldn't get in. i think we did have a meeting at the board of supervisors about those who give and wherever who
2:32 am
is managing your operations should do a good job. having said that, on the [inaudible] that are put for the future -- i see many problems. i see that -- in 4 years. you are in trouble. what i see today going on over the city is that y'all are in the paying attention to quality of life issues.
2:33 am
the citizen of the united states of america [inaudible]. we are not the autoaccuratic government as far as i know. thank you very much. >> caller? >> we can hear you. >> sorry -- hello, [inaudible] 100 broadway a couple of comments what happened earlier. president [inaudible] you spoke about 5 times saying explaining.
2:34 am
but the interpretation of your comments was not made clear in the cantonese. took the sixth try before than i clearly said what you had said that's why the callers -- call in the or confused what you were doing the interpretation was you are not allowed pregnancy but say what your opinion is. that was a confusion there. and the last person speak on the 100 broadway. [inaudible] under tone related interpretation. the interpretation and [inaudible]. having people to try to attends meetings and understand when is going on and [inaudible] in a second language is so the community can participate. [inaudible]. you have people that are still trying to [inaudible] because it is [inaudible] despite it intercepts in english.
2:35 am
thank you. >> thank you. last call for public ment this is general public comment. soing noing requests to speak. general public ment is close exclude move on to >> may be say before we move on, the caller who spoke, thank you for hanging on. i think this was helpful insight and clear by last time i think the continuance and explained it did get through. may be manage we can w with our staff to have notes on how to plain that it is hard to do on the fly when they found out today. why indeed commission president tanner. we received internal feedback that the interceptors were not getting the message across properly. what we are going to try to do is formulate standard phrases for interpreters to have handy in the unique situations. so we are strife to improve our
2:36 am
processes daily. >> and commends you and your staff for getting all the things arranged. i know you will have to again of thank you for the future work >> believe mow it is not me its my staff. commissioners under the regular calendar item 8, for fiscal years 23-25 the proposed department budget and for your consideration to adopt. >> good afternoon will commissioners. deb are back in front of you after a 2 week break we were here on january 26 to go over the initial proposal for the budget. not very much has changed in terms of numbers. so today is going to be a very brief presentation. to go over with you. just reminder of the revenue numbers the expenditure numbers.
2:37 am
and the calendar. >> so. as you see, we are taking down our fees by 2 million dollars. and that is intentional. to reflect trendses the past few years. we export grants from current years to in the budget year to remain stead wet current year. with grants the out year we don't know the funding opportunity yet that number is low and adjusted next year when we come the out year is the budget year. in terms of expenditure recovery when we perform work for other departments. so that is expected to remain steady as well. and our general fund support we had one time funding for the
2:38 am
general fund in the prior year. and so that because one time does not show up in the current year. we are also proposing to reduce by half a million dollars. >> and that reduction of the helpful a million was with the major's office had asked us to do. so, as always. salaries and our staff we are the largest part of the department. we are going down by 2 million dollars. and -- the over head number, again this it is something that controller's office put in every year we don't know what tell be yet. it will almost certainly change and that will happen later in the spring probably april or may be may that is something that is centrally loaded after the department phase is finished.
2:39 am
nun personnel services is everything from condition tracts to paying leases on printers and anything that is a service that is not something that staff is providing as a service. little materials and splice are steady. project number that reflects -- grant funding and impact fee funding. other the one time funding from left year we did not know where we would put it yet. that's why you see that decrease in projects buzz we had the one time funding last year. and that was one time. then the interdepartmental service what we pay to other departments and the bigger costs there are rent and our city attorney cost and it is d. technology.
2:40 am
so there is a slight change in the calendar from when we came we were scheduled to be at the historic preservation commission last week. our item got continued. we will present to them next week. usually we have a resolution from them to share with you asking for am this body to approve the proposed budget to submit to the mayor's office. we don't have that resolution because again we got continued and meet with them next week. we have i think full confidence that they will be supportive of when we are proposing. and with that, this is my update from 2 weeks ago. so. happy to take questions after any comments. >> thank you. i will note that the budget was rerowelled with historic
2:41 am
preservation officers. just not the full commission. members of the public you can address the commission on the budget and work program. if you are here come forward. if you are remote press star 3. take our remote callers. hello. hi. sir i will interrupt you you are calling about 100 broadway that matter was already considered and continued we are taking calls on the budget right now. you need to give us time to response. because the agenda is not logical, sir i need to ask you and you need to correct it.
2:42 am
you check everything you are not in the right title to talk about this. thank you, sir, bye. >> i do apologize to the opinion i understand how frustrating that can be believe mow it was equal low frustrating when we received the request for continuance. last call for public comment on the budget and/or work program if you are in the chambers come forward remote press star 3. public comment is closed and the budget and w program are you in before you. >> thank you. for the presentation. i had a few questions or e lab rit on the positions cut. seems to make sense and gets with 5% reduction this we were as a department slated. do we have a sense of 21 out of 250ish total positions we have. not a huge amount. just coarse and i know they are
2:43 am
vacant which is a blessing. any caller you put on how you decided what positions and i know there are 5 planner 2 and 6 planner 3, why some of those have more than one. descriptions can you give on that. >> surety once we are proposing more than one to be cut those are approximate suspicions that the job classification of many of them. you know for example the 16 there are that were cuts 2 in the entire department of the so -- we say, yes we can get rid of one but probably have -- i don't know this off the top of my head say 40 planner 3's. and we have enough vacancies we still have some so we can fill
2:44 am
upon once we have the opportunity to do that. but it seems likeen taking down 20 positions this is something i know tom mentioned a few times we have grown over 100 positions in the last dkdz. rusing by 20 an increase of 80 positions the last several years. we have an opportunity to hire once that is feasible again. and trying to make sure we keep doing our work. and i'm curious how we think about the staffing plan that was detailed this much time fte for
2:45 am
projects. they need more staff. balancing those new deadlines with the staffing plan and not something you need to come back for. it would have been nice to request new staff or hire new staff am given where we are that was not an option. we near good ship to implement the housing element of current planning and process rae form to city wide on the community
2:46 am
equity work different work emerges. >> thank you. >> commissioner diamond. >> commissioner tanner, which is i had asked about the issue when you were here 2 weeks ago. making sure there was staffing to accomplish the priorities now that we have the directive that has deadlineos it and needs to be begin top priority in order to accomplish it by the dates are there items that need to be pushed back. things we would accomplish and
2:47 am
might need to push back to a later day as a consequence the items having the intense and important time frames. i know that -- no there are not specific aspects of our work we said we want to push back because of housing element implementation. i think it did not surprise us what was in the execute ever director. we directive we anticipated that the time lines you know we were not necessarily talking about those exact time lines. the good things the housing element is specific. 350 actions were not broad they were specific actions. especially on things like you know where we should target rezoning or constraints and cu's
2:48 am
we are look to modify. a lot of that work was done in the context of the housing element. it is detailed. i add as things e merge if staff turn over does occur from time to time or other things come, this is the highest priority topics and the urgency these first few years of the leadership the majority's down a great time for legislative reform. so that we can hopefully jump start the market. if it catches up you got our circuit break in there. i wanted get the permits done and housing permits issued
2:49 am
before 4 years is up. commissioner moore? i asked the question left week and i don't want to raise red energies but since you lost a number of senior planners who moved on focus on the housing element, was -- shortening staffing requires expert ease. not just in numbers or years how much you served but responsibility did you have during that time. when outside people have been considered. do they have comp republic experience. it is in the just about prosecute meeting from the bottom up but having seasoned planners for this work. make its easier for all of us. we cannot have many side steps. second point is more a directed toward ms. landers grants and
2:50 am
revenues you have a high number, which you will depend on my question is, who do those grants go to? what do they achieve? >> it dependses on the year. the past year and this coming year. the mtc and abag regional early action plan grant and early action planning grants, they go to different jurisdictions based on partially formula and partial low competitive award. we put in the budget the guarantees we think and help we will get but not 100% we will get all of that funding. >> they help you with the priorities which commissioner diamond asked and president tanner touched on. to have grantses for other
2:51 am
things we would like to do at this moment seem to be not necessarily the first order we need to follow but grants that support in a very direct way the urgency of the department to accomplish. do you have grants that we could hope for this directly speak to, at hand. >> absolutely. i think you make a good point. there are grant upon opportunity that are too good to pass up even though they may not be lineuped with our priority plans are. what we are seeing here are grants that are in line with our priorities and housing element and doing community planning work. they are ones we are applying for. there are you know buckets of opportunity regionaly through
2:52 am
abag and the federal government that are alined with when we want to do as part of the housing element. those other ones we are looking at and applying for. >> here we said hear about grant and how they are used in the upcoming year, given emphasizing the constraints we appreciate a hint you got a grant. how it supports with we are trying to do and who is assigned it. it is great to be in the position of working on the grant but i'm more interested to see the grants being used for those people their knowledge and the extracurriculars is in support. >> right. >> thank you. >> thank you. i don't see other commissioners with comments or questions. >> commissioners, there is a motion?
2:53 am
>> commissioner imperial >> move to adopt. >> second. >> thank you. on that motion to adopt the fiscal years 23-25 department budget commissioner braun. >> aye >> commissioner ruiz. >> aye. >> commissioner dimonday. >> aye yoochl commissioner imperial >> aye >> commissioner koppel. >> aye >> commissioner mor. >> aye. >> commissioner president tanner. >> aye >> that passes unanimously 7-zero, for the benefit of the public item 9 for the waterfront plan and item 11 for 98 pennsylvania and item 12 for 100 broadway continued and not considered today but a later date. commissioners that will place us on item 10, 3251, 20th the environmental impact report. the draft environmental impact report. public comment for this draft

2:56 am
>> hi. everybody. good afternoon president tanner and the commission. i'm floralen teen from planning staff for stones town development project. joining me is patcha [inaudible] and courtney on behalf of the sponsor the item is the public hearing on the draft eir for the stones town development project. publishod december 47 of twoochl we are seek comments on the adequacy of the environmental impact report. note that the comments received today will be responded to in writing in the sponse to comment document part of the final eir.
2:57 am
i will go ahead and provide you with a short description of the project and the project site. you see on the map, the project site is at the stones town lake shore in southwest san francisco surrounded by san francisco state university a variety of schools and residential neighborhoods. the propose the project develop existing 27 acres of parking surrounding the galleria to a master plan mixed use community. under the project the existing mall retained changes to facade, entrances and exits the site would be rezoned as part of a special use district. you see, the site include a variety of building type and heights. intent of the master plan is to transform 20th avenue in the
2:58 am
commercial core of the site the western portion dedicated to residential uses and open space. propose the project would include 2, 930 units of housing and new retail, hotel and institutional use as well as 6 acres of open space. the eir analyzed a project variance. the variance would include the.880 are parcel in the eastern portion of the site shown on the slide as e3e. the variance would add an additional 150 residential units. 10 thousand square feet of institutional uses and approximately 200 parking space additional parking spaces. now i will move forward and provide with an over view of the potential environmental impacts out lined in the draft eir. >> the draft eir determined that
2:59 am
the project or variance would result in significant and unavoidable impacts for the following areas. built historic cultural resources the demolition of the ua theatre. a historic architectural resource under ceqa. noise due to construction to the multiphase development. wind hazards result in construction of buildings above 85 feet in height. transit delay for the project variance under conscience. for the routes the transit roourts running on 20th avenue. and air quality impact due to the air pollute ans the construction phases over lap with project operations as well as project operations due to [inaudible]. the eir identified feasible mitigation measures for the
3:00 am
unavoidable impacts. however, i want to point out the impacts remain significanteen with implementation of said mitigation measures. as shown the mitigation measures include documentation of historic resources. reduction of vehicle miles traveled. signal coordination for transit delay and construction noise control plan. mitigation measures to reduce air quality impact include, usage of tier 4 engines during construction. electric vehicle infrastructure and e missions. winds mitigation measures include additional analysis for any buildings tall are then and there 85 feet as specific design becomes available as well as the winds safety plan during construction. in addition to the topics analyzed in the draft eir it also includes the initial study check list that covers the
3:01 am
remaining topics required under ceqa. additional measures were identified torous impacts to archaeological impacts. next slide. i do hope these brief sliced were useful over view of potential environmental impacts of the proposed project. in addition to environmental impacts, we are required to study ceqa alternatives to the project. the purpose of the alternatives to minimize or e eliminate the project environmental impacts. as such, in consultation with the sponsor and the picture and other city agencies; we developed 5 alternatives to the project. i will quickly walk you through those alternatives. >> the first alternative considered is required no project alternative. under this the site remain as is and no development would take
3:02 am
place. because the project would have a significant and unavoid okay impact on identified historic resource under ceqa, the draft ei includes 2 alternatives that would reduce irm pacts the full preservation alternative as here, would retain the theatre building with minor will alteration and include a new 100 unit building as w5. and then the new 5 unit as nw4. this would construct 2, 870 units or 60 less than the proposed project and include 3.2 acres of open pace or 2.8 less. under the partial preservation and relocated parking alternative, the theatre issue partial low retain exclude parking be relocated to minimize transit impacts the theatre
3:03 am
building incorporate the new nw2 building, an 8 story, 130 residential unit building. this aisle would include 2, 890 residential units or 40 less than the proposed project. and similar other uses including 6 acres of open space. this includes relocation of parking from e3 to the southwest corner to avoid significant transit impacts on 20th avenue. as another alternative, we put forward the code compliant alternative provided to show the development potential at the site under existing land use and zoning regulations. under this alternative, the development would be 46% less than under the proposed project. and there would be no buildings above 65 feet.
3:04 am
this aisle would include about 2,000 housing units one.5 acre of open space and no holing services or institutional use. in addition, this alternative not include any street network changes to 20th avenue and was tailor to avoid or ruse significant impacts related transportation noise, air quality and wind. the reduced density alternative developed reduce significant impact of the proposed project. over all, this would result in 36% less building than the proposal and buildings up to 80 feet in hite. this would produce 1700 housing units. about 75,000 square feet of retail space and min tain the 6
3:05 am
acres of open space. and include a hotel and nonretail uses similar to the proposal. this alternative would avoid or reduce significant and unavoidable impacts related to transportation, noise, air quality and wind. i than i covered a lot of information. upon and i put together the table to show you a comparison of the numbers i through at you. main difference with the 5 aisles are number of housing unit and open space. i will move to the slide you have it in your print out. now, that we covered the proposal project po serb violental impact and alternatives i would give an over view where we near the environmental process and the next steps for this project.
3:06 am
as shown, we are in the public comment period. once the draft eir comment period concludes, we will prepare a response document and final environmental impact report that we anticipate will be back before this commission later this year for certification. as a reminder, we are here to receive comments on the adequacy of the eir. comments received today will be responded to in writing. written comments will be accepted until 5 p.m. on february 13 of 2023. staff is available to answer clarifying questions about the eir process, comments will be fully responded in the response to comments. also note that a court reporter
3:07 am
is here virtual tow record these proceedings. when you speak. be sure to state your name and spelling and speak slowly and clearly so the reporter can make an accurate transcript. thank you for your time. >> okay open up public comment. members this is your opportunity to address the commission on this draft eir. we are taking comment on the adequacy and acres not the project itself. >> good afternoon. ladies and gentlemen of the jury. i'm jim hurley i live in the lakeside subdivision. i'm a member of the lakeside property owner's association. a bit of history. lakeside division consisted of 500 homes. 19th avenue, sometimes it seems like a boulevard going out as far as the chevron gas station.
3:08 am
i said i'm a member of the property association. we live thered since 1987. ceqa guide lines section 15126.6a states that an eir describe and evaluate a range of alternatives to a project that would attain most of the project's basic objectives or lessen identified significant adverse environmental affects on the project. this draft eir fails to mote that standard and should be rejected by the san francisco planning commissionch table 5 opinion 1 out lines alternative it is b, c, d and e which range prosecute 2, 890 units to 1, 758 units. assuming 2 person occupancy per
3:09 am
unit result in 5, 600 on the high end or 3, 500 on the low ends. today, there is no approximate resident on this property. unavoidable negative impacts detailed and were detailed by ms. floorentina the negative impacts are noted and impact transit, traffic, emergency services and infrastructure including sewer and water. no consideration is begin to an alternative of several hundred units low are population and less burdensome on traffic, transit, emergency services and infrastructure.
3:10 am
such an alternative would be more compatible with the existing neighborhoods of lakeside, merced manner and lake shore. i realize my time is up. would like to close by saying that the proposed 18 story, 200 room holing is inconsistent with the goal of mixed residential and commercial and finally, it it is a towering wall of apartments which go from eucalyptis to buckingham way and no analysis done on the environmental impact of having a towering wall on manith. thank you. >> you can submit your written comments. i have copies. anyone in the chamber wish to submit testimony. come forward. seeing none. we will go to remote callers.

3:19 am
i [inaudible] my main concern is the traffic situation. on the going to south bay. many resident in this neighborhood travel to the silicon valtow work. in fact, we are known to be the suburb of the palo alto area. i'm really concerned about the number of residents that are burglar to be in this neighborhood and traffic will be generated. and -- lack of public transportation if the area to -- silicon roll and he the way to travel or to check bus system by cars. precovid, the situation is already a problem. and the number of residents, parking spaces is going if gent rit more traffic.
3:20 am
as long as the developer address that stretch if 19 to silicon valley, i would appreciate that. i can't see how the number of people added this location can eliminate or relieve the traffic situation. >> can you hear mow? >> we can.
3:21 am
>> grit i'm karen cert aty, i live about a mile away if stones town. and i can't tell you how excited i am to see something like this in our area that is so close. we lack housing, as everybody knows, in the city. and um -- i'm thrilled with this proposal. and i for many reasons, the housing, walkable space, proximity to san francisco state how fortunate for college stounts to be so close to a proposed live and mixed use space. i absolutely ask you to move forward to approve this eir as it is. and i think it is i wonderful contribution to our area. thank you very much and this will make the west side so much more excite and liveable than it is now. thank you.
3:22 am
>> hello. yes. >> thank you. i'm [inaudible] lee. i am in spchlt stones town project. and i hope that it moves forward and hope that the planning commission will take [inaudible] will be to with the [inaudible] eir, i spent my time going over to high school on eucalyptis. [inaudible] the state toward polk and [inaudible] is unactivated space. when i was i you know student in that area it it is a quiet area. being able to see that [inaudible] or residents [inaudible] thank you.
3:23 am
i'm mark, call nothing support of the draft eir for the stone's town redevelopment. because um a mall like stones town was built during a time in which a lot of development was car centric and this created a huge scar throughout the city where it is in the walkable. you can't really feel comfortable unless you are in a car. this will correct the whereons of the pass adding housing and walkable and green spaces and it is on a muni line will be grit for people. often times the west side has great parks and schools not enough housing to be able to take advantage. this development will right those wrong and hope you agree
3:24 am
and pass and, prove this eir. thank you. speaking on my own behalf. had this item was on the agenda for the february second meeting i was caught off guard for different reasons. i have been following this project since prepandemic attending in person and virtual meetings. each of these involved upon only sponsors and consultants. planning staffs not included there is an opportunity but only by invitation. the site lists muni as the assigned planner the department staff directory was to add a current planner for district 6.
3:25 am
on september 7 of left year. during the walk tour the consultants would be demolished. stated that the cinema had come before the historic preservation commission and even h pc was not listed on the project website as a mile stone. public comment period started overnight holidayos december 14th. the department hen criticized for in the pedestrian. the commissioner comments from february second meeting, on how this is made to come before the commission as half of the plans and half of the community benefits have already been completed. i would add the following impacts include admit only sf state housing and parkmerced but the balboa reservoir.
3:26 am
the evacuation cites should be investigated. issues of climate change as the project will have emergency firefighter water pipes the city stated there are not funds to connect them to the city's pipeline network. besides fires the issue of the impact on drinking water has not been addressed. experienced water rationing and i large project would impact on the water system further. it should be noted the city has commissioned i report by usrs to identify cites for the desalination facility. the preferred site in the report is the ocean side treatment facility in the far from the project site. thank you.
3:27 am
>> good afternoon, i'm calling and strong passport this is steve marso a residents in the engle side nishgd down the street of the stones town development. i go to the mall all the time of i'm a big fan of the mall. i strong low believe it should be used for more housing x. looking at the eir it looks to be add way the purposes of environmental review. and you know let's get this passed so we can get more house nothing an fran because we need it. thank you for your time. please pass the eir. >> last call for public comment. in forward in the chambers if you are remote press star 3. in web ex raise your hands. public comment is closed.
3:28 am
and this is now for your review and comment. >> thank you. good to see so many callers getting in on it. are there commissioners who have comments than i would like to make in response to the eir. >> commissioner diamond. we are at the point in time where not only is ceqa an important consideration in the approval of the project, which is in the in front of us. but we are also now doing dealing with a new housing element that has been adopted and cert foild that mandates we finds room for 82,000 additional units. with the focus on the west side. and this is one of the prime opportunity cites where we can
3:29 am
really add a significant amount of housing as long as it is done in an appropriate manner with urban design and with the appropriate infrastructure and parks to ensure whatever we adhere is beautiful and liveable and adds to the quality of life in the city. but approving units on paper does not do us good we need the developtory build them. so i'm hoping that when we get to the next stage that the entitlements for the project will will build in necessary flexibility that will allow the developer to pursue parts of project at puerto rican times to meet market demand and make changes as necessary. what i'm curious about is whether or not it is the limits of the existing analysis that hen done to allow for had flexibility in the future. i will give a couple examples if than i decide not to build the
3:30 am
hotel and add housing instead. is the eir deteriorated adequate to handle this without the need for you know a supplemental eir? same if they decide to take out the retail or institutional oozes and add in more housing instead to go above the 3,000 with the variance or if than i decide to add an extra flower or 2 or 4 or whatever it is, on various parts of project because that is hamakes sense from an economic perspective to move it forward, without having to do a supplemental. the ceqa question i have i hope you can independent to is, the limits of the document, you how far it can go in terms of providing coverage for the entitlements? and i say entitlements include flexibility to allow for shifts.
3:31 am
>> thank you. commissioner moore. i believe that the draft eir in front of us iskerate and complete. a large number of alternatives mostly 2 or 3 is stretches it approximate gives everybody that is happen this is only these are comments for the draft eir not an exchange with us and staff. one thing i like to suggest the graphics which show the theatre punch out the theatre more strong. because your eye gets lost language the line of how that object, which is much of the alternatives, pop in your eye when you look at alternatives. it may be the smallness of had the eir shows, but i suggest it is more strategy low dliniate exclude popped out in the graphics. the other thing, that is my own
3:32 am
personal comment probably not really deir comments; the new formula style theatre and value eludes me. i looked at it and been there. the site is complicated due to the fact the theatre is in a bowl, so to speak. makes usability of that site under any theatre configuration, difficult. the theatres built does in the meet ad a requirements of how you get there. that said, i would like to see a slightly larger e laberation historically with pictures or whatever, to explain the new formalist style. having a practice in my feeled in my entire education, dh is extensive in architecture the style of new formist has never crossed my desk.
3:33 am
there is obviously similar styles practiced by -- concrow that takes forms similar to that is attempted here. without trying to [inaudible] i would like to see a slightly more in depth explanation of value of the building and the stylistic importance. those are my comments, otherwise, i believe that is in front of us is thorough and goes into all of the aspects we need to consider. thank you. >> thank you. commissioner koppel >> thank you to the environmental review staff you do a thorough job. i would like to echo commentings of commissioner diamond, you said it best you said opportunity site in 20 acres. in this 7 by 7 mile wide city is a huge opportunity. i want to make sure we are not
3:34 am
limited with our limited horizontal fop in when we can do anything up. >> thank you. i will aline myself with the comments as limp and i thinking about some of the megamultiphased projects in the city that you know get going and run in a problem and need to rethink when they are doing and how the eir does or does not allow the flexibility for a future unknown and we are trying to plan for. having a ceiling that is higher than we need it to be in terms of dwelling units in order to shift as needed or shift space around may be the holing or another use now but dwelling units is better for the future. i again thank the staff for work. and again for the project sponsor for forward we are excite body this and want to commend a transformtive
3:35 am
proposal. but that keeps the mall and brings it in a new part of the neighborhood. into being. very excited and thank you to staff and the public for calling in. >> i don't see other hands or comments from other commissioners. >> commissioners, that will conclude your agenda today. why thank you. >> thank you all for short and interesting hearing. we are adjourned.
3:36 am

thank you. [applause]. >> i gotta say, in 24 years since we start in the 1999, never was this moment ever a part of our thought process. when i was asked or tasked with creating a program in the bay vow to give kids an opportunity for a program where they receive youth leadership opportunity, i initiately said, amount i'm from the western edition. and as a good friends of mine judge perkins asked mow to come up, and asked me why did i tell this young lady, no. and so i turned and told her i will think about it, low and

>> my family's starts in mexico in a small town. my parents are from a very, very small town. so small, that my dad's brother
3:57 am
is married to one of my mom's sisters. it's that small. a lot of folks from that town are here in the city. like most immigrant families, my parents wanted a better life for us. my dad came out here first. i think i was almost two-years-old when he sent for us. my mom and myself came out here. we moved to san francisco early on. in the mission district and moved out to daily city and bounced back to san francisco. we lived across the street from the ups building. for me, when my earliest memories were the big brown trucks driving up and down the street keeping us awake at night. when i was seven-years-old and i'm in charge of making sure we get on the bus on time to get to school. i have to make sure that we do our homework. it's a lot of responsibility for a kid. the weekends were always for family. we used to get together and whether we used to go watch a movie at the new mission theater
3:58 am
and then afterwards going to kentucky fried chicken. that was big for us. we get kentucky fried chicken on sunday. whoa! go crazy! so for me, home is having something where you are all together. whether it's just together for dinner or whether it's together for breakfast or sharing a special moment at the holidays. whether it's thanksgiving or christmas or birthdays. that is home. being so close to berkley and oakland and san francisco, there's a line. here you don't see a line. even though you see someone that's different from you, they're equal. you've always seen that. a rainbow of colors, a ryan bow of personalities. when you think about it you are supposed to be protecting the kids. they have dreams. they have aspirations.
3:59 am
they have goals. and you are take that away from them. right now, the price is a hard fight. they're determined. i mean, these kids, you have to applaud them. their heart is in the right place. there's hope. i mean, out here with the things changing everyday, you just hope the next administration makes a change that makes things right. right now there's a lot of changes on a lot of different levels. the only thing you hope for is for the future of these young kids and young folks that are getting into politics to make the right move and for the folks who can't speak. >> dy mind motion. >> even though we have a lot of fighters, there's a lot of voice less folks and their voiceless because they're scared.
