12:14 am
telling you not tochlt it it is geared it is for newer commissioners. >> thank you. >> commissioner diamond. >> i wanted give a shout out to the entities that organized the free actualip give away in union square on saturday. i happened be in that area for reasons unrelate to the free actualip give away and was astonished by the amount of joy that was in union square not only people lined up 5 or 6 deep encircling the square in order to get 15 free tulips. every where i walked people had tulips in damp, wet weather. clearly lighting up the spirit that the restaurants were packed. stores were packd and seemed -- that it was worth to everybody's note we had a presentation on
12:15 am
downtown. and how one of the ways we need tong about downtown is how we use events to attract people who will then shop hopeful low or have a coffee and saturday was like the most perfect example how that could work and personal low, it was so much fun to see union square alive and vibrant and filled with help people with tulips. thank you for bringing that to our attention that was wonderful. >> commissioner moore? >> another example for civic for something brightens your day, i listened to the historic preservation meeting on march first and there was remarkable presentation on new deal historic context statement 1933 to 1943. and i hope that this commission will very careful low listen to that statement. and if -- secretary ionin would
12:16 am
be so kind to have the commissioners receive i copy of the report. it inspirational that the city did at this time. what the resources are and i think we should organization a tour and experience that together. because those other small elements most low we don't know about them which creates the cohesiveness we need when things seem weak. my kudos to historic preservation a remarkable day had this happened. >> griet and last week it was so good made in a book the report. you will rarely hear that about staff report items. i think i look forward to reading that. president tanner if you upon libbed to the presentation there was the first building for historic designation which relied on racial and social equity the first 2041 market street a church around the
12:17 am
corner wherefrom where i live i republican down to look at it and listen to the history the first historic preservation i hope we can follow it. >> thank you, commissioner moore. >> i will suggest that if you like to receive a hard copy i will print it out t. is already available online through the agenda from the historic preservation commission. which we don't have if you can send the link. >> certainly. >> i don't see other hands thank you, all. >> very good. no additional requests if speak, commissioners we can move to department matters item 7 director's announcements. >> good afternoon. to piggyback on commissioner diamond's comment sponsored by the union square association and felt it was a success. they would like to come and talk to us the commission. about the work we are doing with them you know zoning related work but there are have a
12:18 am
broader focus and economic development focus we'll calendar them. with president tantory talk about their over all efforts. joy think we welcome that for sure. >> okay. item 8, review of past events at the board of supervisors. i don't have a report for board of appeals on historic preservation. did in the meet. >> good afternoon, ashe starr legislative affairs. this week land use considered code enforcement ordinance by ronen. you heard this on january 19th and veted approve the legislation with modifications. your recommended modifications to require the department to record notify violations where penalty would be imposed against the title. instead of the department to serve notices to property owners when titles are transferred. 2 add language to state the one
12:19 am
time fines of 250,000 for lots of residential units up to 500,000 for damage loss to historic structure fine is trigger when notice of violation is issued. remove the 5 year prohibition on construction for violations. amend the ordinance so adding more than 3 units subject to the 250 thousand dollars fine instead of only 2 units. and final low to encourage the board of prierzs to consider a lower limit from the 50,000 minimum amount at the board of appeals may lower illegal demolitions or residential unit cases that are appealed to them. supervisor ronen, incorporated all but one modification for the mittee to consider. the modification she did not take the final recommendation to lore the limit the board miassess for illegal demolition cases there is little discussion and one public commenter in
12:20 am
favor of the ordinance. the mittee voted send it to the full board with positive recommendation. the dwelling unit controls, which you heard a long, long time ago, was on the agenda and continued to march 13th. and the full board this week, village sud passed the first rode and left-hand side mark for the arch starts the landmark designation was adopted. that's all i have today. >> seeing no questions from commissioners. we can move on to general public comment. at this time members may address the commission on items of interest within the jurisdiction of the commission except agenda items with agenda items you will be able to comment when the item is reached in the meeting. each member may address for up
12:21 am
to 3 minute and when the number of speakers exceed the 15 minute limit public comment may be moved to the end of agenda this your opportunity to address the commission come forward if you are here in the chambers. call nothing remote low press star 3 or raise your hand via web ex. no requests to speak. yes or no public comment is closed. item 1 on consent was pulled off and take up that matter now case 2022-interior 09200c. for the property the 101 california street a cu authorization commissioner moore i believability you did not request a report from staff. and so -- to expedite mattersil call public meant for this matter. >> jonas i had one additional addition to conscience of approval we want ed read in the record we can do that now or
12:22 am
later. do it now >> and i wanted go the first time he has been here in an odd case. [inaudible] joined us in planner 1 in june of 2022. prior to joining the department the intern for west hollywood focusing on economic development. originally from davis. but sment years in southern california working on political campaigns and completing masters from cal poly. welcome. >> thank you. director. dakota planning staff. the condition we would like to add that was omitted from the original conscience of approval is standard tdr conditions. apart from that standard admissions apply >> thank you. >> should we hear from the sponsor. >> absolutely.
12:23 am
>> project experience you have 5 minutes. >> justin from rubin and rose. since this item was on consent i will keep it short if there are questions we are available. >> thank you. >> okay. again members this is your opportunity to address the commission on this matter. miss hester i don't think you intended to but call you out one more time. seeing no requests to speak public comment is closed and this merit is before you. >> commissioner moore. >> i like to briefly summarize my concerns about the application. approximate at a time where we have vacant office space and there is a decline in large office users occupying substantial amounts of square footage using the carefully crafted many years ago for ground floor animation and transparency. >> commissioner moore on i will interrupt you. excuse me folks that areern
12:24 am
everentering the room do so quietly, please. >> thank you. commissioner moore if you want to continue. the downtown ground floor rowels for crafted carefully to create a continuousan mated grounds floor environment for downtown. the fact we retail vacancy system not necessarily for me on open door to say that office of which we have 20% vacancy upon 101 california is a demanding building stands among other high rises some kept the grounds floors open. this grounds floor has been vacant for a long time and the question arises is the owner of
12:25 am
the building doing manage that does in the work because in all directions they are small interesting retail establishments some survived some shut downful i don't believe this is the time to change the protection of ground floor space in downtown to be retail or creatively pop up retail or isolatedan mating use. at this moment i believe there is ample of larger office gathering spaces a conference center use on the retail upper retail level. i used for years large law offices hold gatherings for giving lecture there is. we are not short of large gathering space and i thbl large spaces are not occupied every day. it will be another blank facade except we blocked out the ability for retail to find
12:26 am
itself way to a vibrant downtown. i have worked on this for many years decades. to see we are carefully treating our ground floor transparency, in this point for that reason i will not be able to support what is asked here. >> thank you. >> commissioner imperial. >> i had a question sponsor in our recommendation it looks like it can be also used for nonretail i continue is in front of us change to general office use but looks like there may be potential for nonretail uses in the future. so -- yes. i guess that is -- that is my question in regards to the use of the general office.
12:27 am
how long it will be. what are the projections or what are the plans of the developer in terms of it. >> may be to answer the question before this sponsor responds nonretail sales and services is land use classification for office we call it general office. the planning code considers it as nonretail sales and service. it is 2 and of the same. >> it means the same thing. he can answer the rest the question that is what it means. >> thank you. >> gwen to those entering the chamber here if you can keep your conversations to none if you have a conversation step in the hull and have an over flow room where is this the northern light court on the first floor. you want a conversation and know what is helping go to the first floor to the north light court and you can condition the conversation there and see what is happening here y. we are making that comment now it
12:28 am
appears we're reaching capacity if you don't have a seat in the chamber you will have to exit and vow in the northern light court. >> i the pause could our interpretation staff translate when we are saying to make sure folks are hear when we need to do in terms of direction? >> translation services, could we get that translated? >> we need to translate we need people if they are coming in not to have conversations if they can't find a seat to go to the first floor where there is an over flow room where they can view and come in when their item is up and can give comment. >> okay. [translation instructions] do we
12:29 am
have other languages we have to interpret, this would be welcomed. >> thank you. to the persons in the door way we need to you exit if you cannot find a seat and go to the
12:30 am
first floor and take a seat where there are seats. we can't block the door and make sure we have the right capacity in the roomful >> we will return to the item. commissionerism roll. i'm sorry. >> not yet i think he is. >> thank you. thank you for this clarification this is what it is had it is technically considered an office use the conference would be access row to the office use that said this would be a conference center serving the 10 notes in the building and other this is have a connection there. i want today highlight a thing brought up earlier in terms what the landlord has been doing and a hold out for greener grass. and that's not the case. land loird worked hard to keep the space occupied. prior tenants twof them for the space the frozen yogurt and the cafe receive months of fro rent owen
12:31 am
with this than i could in the survive that's why hay left t. is a changing dynamic with the down ton retail changing increased foot traffic will help us and we're hopeful with the drawing of conferences and meetings we'll bring foot traffic to the stretch of pine street. >> thank you. >> thank you. >> commissioner diamond. i believe commissioner moore raises an important policy question. which is many, many years of work went in to designing a downtown this had offices above and retail below so that the streets would stay live low and safe. the eyes on the streets and places staid open further in the evening. but that's not happening now. we got vacant stores, for me the
12:32 am
decision is right now i would rather have a vacant storm front or the conference center? and yes i'm sure well is space for a conference center above or in another building. but i think i still rather have the conference center on the street so there is eyes on the street and people who are walking the streets to frequent other retail in the area. and i would like staff to confirm one way, if we allow for this change does it preclude the use of retail at the site in the future. >> no and if they wanted go become to retail it is easy. an over the counter permit. since it is permitted. >> staff recommend this we go forward. am i missing anything in the way i just enunciated my thinking. do you have anything you want to respond to commissioner moore's. valid concern about how we think
12:33 am
about street space and this time of. >> absolutely. i think the important thing is they require cu. and we take that seriously. we look at we have historically during the boom times had cu for the types of uses and do look at them case boy case this is the first one this broached on the north of market in the past. but i think we were the same as yours on this. we do take ground floor seriously now we rather get something this can bring something. this is not president setting. the next will receive our support we are being cautious how we look and felt at this moment in time. again something bring foot traffic we need something to bring people in it is the chicken and the egg. retail is harder to support if we don't have other uses coming there. this is the position we took. >> thank you. >> to those who enter if you can
12:34 am
please find a seat or go to the first floor the north light kurt we cannot have people blocking the door. >> commissioner diamond. move to approve. >> there are people on the roster here. you will second for approval but go to commissioner braun and i will make comments. i will call on commissioner braun first and come become to you. >> i wanted to add this i am very sympathetic to the need to maintain an active upon ground floor retail space and understand happening commissioner mor's point the effort to crafting a downtown. uses on ground flower and not ded deadning the sidewalk level it is good it is not precedent setting and easy to change back. if this happens moring from
12:35 am
where we lose restale and restaurant on ground floor it would be helpful to have arounding of the broader mix ground floor use within that block and surrounding blocks to make sure we consider the over all balance of had is an active ground floor use versus situation its might be a dead street scapeful upon upon given the limited impact of this upon one, i'm a one off. i can vote to approve this time >> thank you. il say my second it say conference center. if it was cubicles and an office i would not be supportive that conferences and spaces where people gather for a purpose is part of the future. of when folks will use our business district for tochlt have this amenity is important. >> commissioner mor. i'm not trying to convince anybody i believe the city has other venues that require our
12:36 am
support of the for example mosconi convention center would be a great accomplice to have mall rooms all the infrastructure for large are gatherings to support for a venue like this. this downtown location the fact this the events don't happen often will be another empty store front and a time when it is not used by events that are being thought to take accomplice that is my meant and i will not approve. >> thank you. commissioner diamond. commissioner tanner your comment raised one question i would like staff we are approving this for a conference center they can't use it for general office space without coming become? >> the land use is approves is general office. the upon plans that are buffer that are part of the approval the exhibit b approval does show
12:37 am
it conference. part of any types of change to an approval you made requires the za to see if it is in conformity if you approve it with this intention for this active gather space, that puts more meat on it. that being a significant change should they deviate frafr this use >> do we need to add that. that is the basis which i'm approving wrochl that would be helpful. >> okay. >> your motion. >> project sponsor? you have an objection to our clarification if we approve for the use as conference center in the for general office. >> no that's final. just had one comment. ficould have the over head with regard to the availability of other spaces near by we did a survie, yelp is not the best but
12:38 am
there are not that many others that are near by the 1s that are are cowork paces and than i are in the geared larger meeting spacing. i appreciate the miss coney center is walking distance and the hotels in walking distance than i have learning facility a larger scale and the room rental fees are significant. >> thank you. >> could i amend my motion to may have been clear what this is an approval for the space to be used as a conference center j. and adding the conscience of approval read in the record by staff. >> yes. gi second this motion. >> i'm sorry commissioner diamond i was getting clarity from the city attorney. behalves the amended condition? we are granting approval for the pits to be used for i conference center. joy believe it may be promote to have that legalsed as a finding.
12:39 am
opposed to condition of approval and noting that the exhibits b is conditioned in that space configuration. approving a conference center than a subcategory. why finding approve egg conference center as dem strit in the exhibits b and so to be configured. >> yes. >> and adding. >> silence mobile device catharsis sounding off, please. >> tdr conscience of prove staff presented. >> commissioner moore? >> no, i did not. >> >> very good, commissioners. i'm trying to get this down.
12:40 am
a motion secondeded approve with conditions as amended boy staff to include the tdr standard condition of approval. and adding a finding that the approval the commission making today for a conference center. in the configuration detailed in exhibit b, silence that, please. >> on that motion commissioner braun. >> aye. >> commissioner diamond. >> aye >> commissioner imperial >> aye >> commissioner moore >> no >> president tanner >> aye >> that motion passed 4-1 with commissioner moore voting against. >> everyone who is here if you think you silenced your phone just check it takes 2 seconds to make sure it does in the ring put it on silent or airplane mode so we are not strakted by ring of cell phones. thank you. >> very good this will place us under regular calendar
12:41 am
>> mr. ionin can we have 2 translate the request to silence mobile device. i will ask them to translit to silence mobile devices that you need to find a seat and you cannot stand in front of the door. you are causing a fire hazzard. there is an over flow room on the first floor in the north light court. thank you, mr. schneider. instructions for silencing cell phones and 90ing a seat in the north light court...

and i'm available for questions. >> thank you. >> project sponsor you have a 5 minute presentation. >> hello commissioners i'm david the architect for will 281 immediate son. mr. page provided a break down how we got to this point i want to give detail on project history. 2017 permit made under the previous property owner a marriedcum with no children. got it apruf exclude intended build it but due to changes than i had to sell the property. the currently owners are here today than i have knife children. so we had to make plan chinks to accommodate their family. did over counter revision permit to increase to 5 bedrooms and other measure its save money but the height setbacks and everything else is the same as the 2017 approval.
1:07 am
you heard witness construction begone we exceeded the permitted demo on site, dave and i had michelle are not property developers they managed to find the property in the city this can fit their family with 5 children we hope you will allow their construction to proceed and we are available for questions. thank you. >> thank you. >> that concludes the presentation open up public comment. this is your opportunity to address the commission come forward in the chambers. remote press star 3. seeing no one coming forward. go to remote callers. mr. feeling. hello i'm ryan feeling i live at

privacy. thank you. >> hi. good upon afternoon it is georgia. i sent my e mail in on monday and i made my point there is if you read. i think it is interesting there were 3 sets of calculations. i don't understand why after all the time, i know it was in 2017, but it is a continuing thing the staff as long as you have it is pulling teeth to get them out of the project sponsors. it seems they should be submitted right away when the project hits a certain scope. i appreciate that they are even though they were wrong on the 311 that is unusual. i think it should be there for projects that have a scope like
1:10 am
this so, the niches can have understanding of when is going on. on the 311 most niche don't make a referred's request or know. interesting to me you had a bunch of the projects. than i are most a lot are outside of noe valley. [inaudible] i don't know i wonder how many more there have been you know people have complaints have not filed complaints and how many have not come to your attention? even in the unfortunate matter. and i gots other thing is i want to know about how is this determined to be tandem out to demolition. i know the staff works hard and look at a project but there it is a technology this can be used and the front end before it gets to this.
1:11 am
to the determine how much is going to be removed and it is not just a delivery technology to deliver plans. [inaudible] dot work easily. [background talking]] hard to capture speaker]. the inupon tent of section 317 when it was put in in 2008 and 9. i still think that it would be useful if than i were adjusted to avoid situations like this. so, you know i'm rampbling with this but -- it is confusing. to say the least. miss hester would say, it is confusing. >> thank you, bye. >> last call. >> good afternoon sorry.
1:12 am
>> good afternoon commissioners [inaudible] i just want to bring to your attention that this is not this is going on the past 4-5 weeks every week almost every week you get the tandem to demolition this come to you. i'm not calling to add roicate for changing it but we have a big are problem. and whether the owners have 4 kids and need more space it is not material to the issue. issue is noncompliance with what the city approved for the owner to build. if you are going to approve the plans today xu are going to aproust c u authorization, you are basically leaving the door open for people to continue doing this people can get their entitlement.
1:13 am
basically and go beyond the scope and come become and ask for forgiveness. this it is going on for the task force for weeks. i'm urging to you look it's the wagz and see if is is sustained. this is nothing to do with the calculations it is a comupon pliance and matter of people being able to break the law with impunity. and i am stunned for the sponsor to talk about people having 4 kids i'm sure they did not end up with 4 kids yesterday when they applied they did have the 4 kids and it is in the about kids it is compliance with the law. and that's all we can ask for and that's all we can hope for. i urge you to reject this cu authorization and if you are approving it at least penalize the people that are break the law. thank you.
1:14 am
>> last call for public comment. >> need to press star 3 if you are in the which i am bers come forward. no additional requests it speak public comment is closed this merit is before you. >> thank you. commissioners i will say this i'm supportive of this project i think it another example of the challenges over demo calculations it is a unique san francisco thing. hard to comply with we heard testimony about how it works or supposed to work and hopefully there are new thing in accomplice and dbi does prebuilding inspections with folks to inform them of the need to call if there are changes. i don't see this changing the previous approval. and i would hope we can support this project. with this i will call on commissioner more andism roll and braun. >> i would consider this project the least egregiousous we have seen in a long timeip want to
1:15 am
ask the architect to come and answer a few questions. you designed the original project the childless family. >> didesign original. >> yes. >> yes. >> you still stood by the building and you forward now with a reduction of 40 square feet to construct a 2009 [inaudible]. square foot building. >> correct. joy like the audience and people who call in the to acknowledge this is in the a tends emout demolition to build a megamansion to get, way with it. this is an honest respiratory we have an architect stand by his work. which we in many case don't very much we have something later we don't have an architect. i will leave that as a snied comment. i appreciate what you are trying to dom we do acengine
1:16 am
unfortunately our am diagramo calculations leave a lot tordesired. i don't think we can resolve this here. there is nothing penalize in the this project except the support family is redesigning the project to accommodate 5 children. i looked at the plans carefully. they are presented i like to be the commission to be aware and i like to comper se this to other projects this don't do this. and just express my support for the project >> thank you for clarifying the size of the project. why commissioner imperial. >> am yea. i understand this in it is less then and there 3,000 square feet in terms of changes, yes this is in the a big mansion. however, in terms of again this pattern we are seeing every
1:17 am
week. again, it seems like there are issues now than i see as well that previous owner then having a new owner and then again the demolition or the calculation demolition is out of compliance. i still find this even though this it is not a big project butt pattern this i see every week is still a concern to me. and so again, i'm not questioning the intent of the project but at the end of the day, tooshg we are getting the entitlement and then it men for sale. and so that is my usually my question when it miss to when we have issues legalizing a tandem out demolition is how is this irrelevant going to house a family. again, its -- can be for sale.
1:18 am
and i don't want the planning commission to be used as you know -- just a process for entitlements and not people being house said in there. so -- you know in this way, yes, you know i don't see this this it is a big project but it it is still parent that i think we need to be reminded of. in terms of the legalizing of the tandem out demolition. >> thank you. commissioner braun? >> yes. i do i'm okay with approve thanksgiving item. i dom agree we are looking at a single family home that will be a single family home. design does not change significantly and not that any sort of intentional exceeding of the demolitioning calculations just to build a large home and
1:19 am
get, way with temperature i have a question for staff. i'm curious this might be [inaudible]. we have been seeing a lot of the items where they exceeded the demolition that was allowed. and i'm wonder figure this pattern is buzz we are working through a moment in time where we have a backlog of the items or -- are we seeing a surge in approximate complaints coming forward there is more activity with the exceeding the demolition calculationings y. part is we are working through these diligent low and realigned staffing and we are following up and making sure we move these throughout process. this one i believe was issued a bit more recently than the others you have seen this was issued in 2021 at some point. which is more recent previously are permits issue in the 2017 or
1:20 am
2018 or earlier than that. there is often a bit of an issue the crux of the problem and my opinion and when we are continuing to seat tandem to demolition calculations really -- expect this people have figured out how they will put their building together in a site permit level we don't require plans. site permit plan don't have structural plans is to get through schematics and then instruct later this . is the disconnect it is either something different gets submitted this reflect a different scope of demolition than in the site permit and they don't get remedied during the plan check at db ian issue that we are working on and i think when we dom plan check there is is an over lay tool [inaudible].
1:21 am
and i think the other issue is that the true one we hear over and over as muchs dbi is doing a presite inspection if you find driveway rot stop and call us first this is where the disconnect happen system this most the withins you seen late low most of them has been a sort of damaged part of the structure intendsed be retained allowed to be removed you can remove it without [inaudible] they have demolition crew on the site. i think that is we are seeing the couple ways we see this go arye. i see in punch line this is something part of the housing leadership implementation demolition policy is on the table. we are planning looking at the
1:22 am
[inaudible] i think this is a failed policy. not achieving objectives we intent to come back with a robust discussion about demolitions. their purpose is and perhaps a better policy would be. we do have that energid and will be moving that forward sooner rather than later part of housing element implementation >> could you explain that most are complaint base today is in the all the sudden we discover temperature since it is complaint based many things may fall didn't the cracks only somebody noticed it is brought forward. a good number are complaint bases others inspect are goes out and benches that it is beyond. rather than call in the advance. yes. >> and imented explore the idea more there is a surge and -- there are pieces and i'm glad
1:23 am
we'll revisit the policy. commissioner diamond. i will add my voice that the policy needs revisiting we talked about this in the past and i know it is coming up the policies should be straightforward and easy low implemental and recognize the way industries work and not come up with policy this is flit in the face of reality of older houses that have mold and need to be dell demolished. this process spensdz too much time, staff time, commission time. contractor time and project sponsor time getting to a result we need to figure out how to get the houses built faster. i'm adding my voice butt faster better. >> so i our job to focus on the use not the user temperature is
1:24 am
noir possible may be probable that the family of 5 may not live there for long the fact is we are producing a house that you can outable for a large family. so if not this family, some other family with many children can live there. so it does not bother me we have no way of knowing whether in family stay or not because we have no idea with any approval we give. i move to approve. >> second. no further deliberation there is a motion that has been seconded. commissioner braun. aye >> commissioner diamond. >> aye >> commissionerism roll >> aye >> commissioner moore. >> aye >> president tanner >> aye >> the motion passes unanimously five 5-0 and we are going to
1:25 am
take a brief break. >> hold on one moment. i'm making a few announcements. we will call 100 broadway next. some of you are here for the hearing we will call this next. when we are going to do is we are going to take a brief recess in a mobile home if you want to come interpretation staff we will need interpretation of when i'm saying. >> if the -- we are taking up 100 broadway next but a brief recess. i need to you translate what i'm saying. thank you. >> [translation] >> during this recess when i need people to do if you like to have simultaneous translation

or consume or smoke cannabis in public space but i think each us in the room have walked the streets of san finish and seen it and smell it. our issue is that. right? and thirdly, for you to run a safe site is to reduce risk. i read throughout information. i met the sponsor i think his plans are great. i think this for to be so close to the center there are no garnts. as a parity in youth development for 20 years we want torous that risk. right? and i thank you there is more this can be done in that regards. if this is passing. i read the plans and than i mention about 50 feet. so -- the marijuana store is not the problem the problem is the location selected. 1 huh human broadway project is [inaudible] and our 2 departments made a mistake. one, we can check that this is website of the ooc department. san francisco office of cannabis instructions tell people how to apply for the permit. and this is the [inaudible]. you should wait good labor policy that is the requirement. and also say this one. you should labor meetings that this is no and writing of good

hearing is going in recess. we are in the going to continue the you have 10 minutes. members of planning thank you for your time. i'm lawrence the project sponsor at 100 broadway. i wanted it go head and address the continuance from the left time we had there were modifications the health department wanted us to make in the place am of the smoking and vaping lounge from up stairs to
2:07 am
downstairs k with modification. egress we worked with d ph and mr. boba. we have a solution had fit the department of health requirements. we then went ahead and started working with plan to make the modifications necessary. we took the time to go head and address the modifications and worked with our architect who is here today. >> and made the modifications where the planning upon department was able to sign off and in compliance. secondly, what i would like to address the statements with community out reach and our neighborhood good policy. we sent out multiple notices. go head to the next slide.
2:08 am
so on the first day we did the mailers sent out on april fourth the preplanning phase. we invited the neighborhood we have a list of all of the addresses the mailers were sent tochlt there are people who received that on the call following that. we were requested there were issues with the mailers. from the mailing company. this did in the get on every unit at the broadway cove. mr. chu from the y requested this i set up in person or video conference with the neighborhood and the community this did not receive the notification. i went ahead and med a presentation and brought a translator to translate multiple languages. i was unfortunately asked to leave because it was unsafe for mow to be there. the people were spitting on the floor and ripping up sign in sheets and it was a hostile environment for myself as a
2:09 am
presenter. i spoke with mr. chu following this i spoke with him yesterday in regards did i not have enough xhoungz and did i do something wrong. we believe it was an issue of the mailers. i have been attempting to have interactions and for the ccdc i had mr. phil lesser attends meet and explain the project in regards to addressing the vent shown in the previous photos. we make sure in the plan and accordance to d ph there will be no smoke or fumes exhausted anywhere outside of that building toward 810 battery. we replyed question and e mails with maggie donning part of the ccdc and other neighbor who is had question in regard to the neighborhood plan and good
2:10 am
neighbor pol. we addressed those and today with the continued report of the planning department made modifications to our good neighbor policy to make sure we included our staff will not have the right or permission to smoke in and around the building. in excess of a thousand feet. as well asas the smoke vaping lounge there are high rise buildings outside of the 2 buildings this make up thousands of residential units and residents in the area who are not a lotted to motor vehicle in their property due to homeowner guidelines and rules and being the attendance and so we wanted go ahead and our -- as we heard and mr. chu's comments, there are people had are outside motor vehicle nothing san francisco we
2:11 am
knows we walk by we memarijuana. we believe it was a vielth part of our community plan to create a safe space that are not permitted to smoke in their home and they are cannabis consumers to give them a safe place to smoke. and yet today i don't believe there is a crime outside of the smoking lounge due to the intoxication of marijuana. i believe may be a heightened you know -- may be line at the pizza parlor and people are hung row and settled down versus a borrow they come out rowdy alcohol is more of a different inhibitor. um -- also, in regards to you know being too close to a preschool, children you know we believe or i believe in the under the k-12 we don't plan to
2:12 am
have paraphernalia on the exterior. wh they read or not they would not know it was cannabis inside of this building. as well as the approximate suspicioning of the store itself. we are not trying to promote this it is i cannabis store with marijuana signs. we want to make sure to have it fit in the community. you know as of now, this is a vacant building with unfortunately, we clone it up and get graffiti sometimes. there is a lot of needles and empty bottles from different buildings, there is very shady cars in front of the corn 30 do acts. we want to patrol the area for ourselves and the communities we address those issues in the community and the community we are going to be 100 broadway. there are many dispense easier approved today. that are within closer
2:13 am
prongimity than ourselves and 175 feet and sometimes 2 doors down from current dispensaries. and -- additionally, there was a couple questions this -- some members of planning had in regards to display approximate cases and seen from the street level. i want to point out we want to be flexible as possible with this process. you see to the right there we have prototypes that we created for the project. as you see there, the backing of our display case are not transparent. the signs are magnetic, removeable. the actual display caseos wheels. so if we are not happy with the position or well is exposure we
2:14 am
feel is street facing we can make the modifications within minutes by rolling and moving the cases to different positions of the store and the backs completely in a black color. we recommending this we possibly use some of that similar style of art highlighting san francisco with beauty. you know golden gate bridge and have this be the back groujd of our displays. community members, children may be walking by they would see art that is noncannabis relate exclude not see inside the store this would have paraphernalia, marijuana or a negative affect in our opinion, on the community. going back to the primary point about the vent. you may know the d ph plans rivered have a sealed smoking and vaping lounge at the corner of the building will have an
2:15 am
exhaust will nod be near 810 battery if we have to spend money and run it to the roof tell. however that exhaust as going through processes goes through carbon charcoal and different fit terse so there is in smell of the marijuana on the building unlike a cultivation center which does have a lingering marijuana smell. a lot of the people today are also smoking vapor pens they have a minimal impact to smell outside of the room or the area. you know -- i believe i addressed most of the comments in most complaint and most of the questions that are dr requestors had today. i have been open to take egg comment and being as open minded to working with the community around me and -- i understand that -- you know i will never convince american is okay or
2:16 am
okay near where they foal is home. all i ask to give me the opportunity to work with the mount if you have modifications and requests, i would be happy to consider those and develop a better plan to make sure we are all happy. i thank you for the time commission today. and thank everybody here in support and opposition. thank you. refrain from applause. i did realized i want to make a disclosure. i want to say i did meet with the project sponsor and members of commune organizations hazel, forest and [inaudible]. about the project and they relayed the occurrence we heard and heard in others. thank you for that. >> very good. i will ask interpreters to come
