ideal performance measurement. i think it can be included. another idea is there are options to extend on the agreement. if you want to have a stronger accountability mechanism you can negotiate now with the contracts department to judiciarying just the amount and board whufl. first of all there is nothing in
1:01 pm
the language this would stop us from requesting did thea we think is important to collect. and at this time. we can ask for this any time the contract does not preclude that. we can work to adjust the language. if there are performance metrics we would want the ventztory perform and adhere to. that could take time to negotiate the agreement took 6 months negotiate. i do worry about opening up the contract again at this point given the criticality. we could enter in a contract men for a shorter duration if not our ideal. we could work with michelin as the contract is in place to amend the contract if that is
1:02 pm
the desire. >> that would be my desire. vice chair mandelman. >> the question i have for the bla is to what end? i mean -- what would we look -- how -- what would be happening during this period and what would the city's -- you know i mean. how this would play. how would the measure of nonperformance show itself and what would the city's response be? how are you thinking that would play out. the tires are wearing out more quickly than the standards specified and then what happened? i think this having it is hard to -- have -- the city you know hold the contractor accountable
1:03 pm
for items that are not specified in the contract. right? so, do we? how would we -- how would this work? how would like a corrective action. >> yea. how likely we continuing is they are not meeting the performance standardses and when would we do we are several years in. right. >> do we terminate. what is the thought. >> first. mt assays they are performing limp we don't know if this is true. rehab the contract without going out to bid again. there would be a way an agreed upon way with the city and condition transactor to hold
1:04 pm
them accountable for when they are supposed to deliver without going back out to bid and take that time and effort. i think that is one of the benefits. the understanding with the department and the contractor. and thank you all for the questions support discussion. our contracts is the detailed scope the contractor needs to deliver tire function and make sure the tires and the wheels serviced society buses can function. they don't get paid. we with hold payment if than i are not delivering on that scope of work. if there are problems the contract includes language regarding termination. that -- wield work with the general practice we work with contractors to get them up to the point where they cured the
1:05 pm
problem. contracts lendses itself to ensure performance. i'm not sure it is necessary if the intent is to make sure they are delivering as expects. if they were a single bidder. i think i know it was set out to be a competitive. bid. but there was only one single bidder and say that this contract has been stloongding since 2014. it has been awhile. i think this previously was bridge stone that was the contractor providing the leasing service to the city. and i think if there were competitive bidders throughout process to allow this body and most important low allow the
1:06 pm
city itself to be able to compare performance. performances on the lease and tires and the lease agreement, i think that some of the question will be have some inspect and comparson. and this case because it is a single bidder it is like michelin is coming in. this is the way we role and the sfmta saying sure that's how it goes and each tire you are correct that the tire is also information is tracked. i want to scale there is no question about how the contract is set up. whether well is accountable or not. what we are trying to say or
1:07 pm
that appoints by comparison. i wanted to meet the few worldses i am in agreement with vice chair mandelman what end? how do we in to a space we can really understand in the event now we have more data what does this money for the condition tract terms? i see that supervisor safai agree with him we want more information and accountability in this. i will finish my thought if that is okay that here is what i'm thinking what i'm hearing from the budget analyst is saying that buzz we have one week to evaluate this, and this is a retroactive contract if i may say we are supposed to amend this back to the april date which i'm happy to do that. i'm happy to intend to retroactively back to april of
1:08 pm
23 of this year this is already in progress. but i would like to give it more time and in this i will ask budget and legislative analyst mr. bernard tell us this in the event we do continue, not to the cough chair but to the date certain to get us a bit better understanding whether well is a matrix to graen on or respecting or tracking requirement we can articulate before we put forward how long would that take for an agreement? i'm happy to work with the department. on any time line. >> great. >> we will about a week, 2 weeks time? that will help us get there. faster would be greater.
1:09 pm
we are willing to work with the budget approximate legislative analyst and move this forward as quickly as possible. you appreciate the flexibility the sense of urgency supervisor mandelman. >> it sounds like a week or 2 will not kill this i have the i'm not an exert in contract administration. we have an expert. the only thing that strikes me as troubling here is the budget and legislative analyst identified a best practice that we are not meeting which i don't know whether the city office contract administration would agree. it is a problem that is -- we don't think they are not performing. we don't think there is an actual problem with the
1:10 pm
relationship between the city and michelin but there is a foaling that as i understand the bla is saying well would be better fros have this contract structure in the a different way. there is a cost to everyone in trying to achieve that, i think. in the sense this now folks in the city administration and the bla's office will trying to work out to put in the agreement if it goes too for tell go back to michelin and further negotiation with them will impact the terms for yous i suppose. i don't have a problem with continuing but have a nagging anxiety weigh may not make it better boy doing it. i will go along. >> i appreciate that. i think supervisor safai? i will end with just i think knowing what each tire life is
1:11 pm
important. it affects the cost of the program and the administration of the program. they could get rid of tying quicker then and there they need to be there is a let of things happening. here that i don't know. because someone says something is working well i don't know if this is troughor not and could impact the number of people thatment to responded. other thing i see here is each one of the tires has to be recycled there is a place in fresno that is the choice of the michelin. that cost of 175 per tire. all things associated with the life, trenth and ain't of each tire to be electroniced i think this is important asspeventh machine torthanksgiving type of program. i mean we need to know. i concurator fact that mta is paying michelin sounding like a
1:12 pm
low dollar but it is adding up zero.where are 05 cents and 0.00 upon 7 cents per tire per mile. i think because the way it is being paid it would be it is understandable tomenting to know that the limp span of each tire and mile. so with that will said, colleagues i first like to make the amendment or will we need go to public comment i will articulate had i will do next make the potion to amend to reflect that this is retroactive starting april first of 2023 and like to move this to continue for a week. to allow the budget and legislative analyst to have more conversation with the sfmta and with our office of contract

with this motion mr. clerk. call the roll. >> on that motion to amend this resolution to add language to reflect retroactive of april 1 of 23. vice chair mandelman. >> aye. >> member safai. >> aye yoochl chair chan. >> aye >> we have 3 aye's >> the motion pass and now i like to make the motion to continue this to our next meeting april 19 and with that mr. clerk call the roll. >> on this motion to continue this to april 19 meeting of this committee as amended vice chair mandelman. >> aye. >> member safai. why aye. >> chair chan. >> aye >> mr. clerk noted that both the item i believe 8 and 9 presentors are running late we would like to call item 10 and 11. out of order. >> just a baptist clone up. i didn't referred your vote for

>> good afternoon. chair person chan approximate supervisor mandelman. i will start my presentation talking benefit first grant. which will authorize the rec and park department to except from volume mettic public restroom company grant of prefebruary indicated mod lawyer strom and installation in noe valley town square valued 425 thousand dollars. noe valley square is 38 skn, 24th street. and it is on the 21st street commercial corridor in noe valley. 2.5 acres in size and surrounded by shops and residents. property was purchased boy rec and park in june 20 then and a plan for the public open space
1:18 pm
approved boy rec and park commission in april 2014. the proposal is to establish the public open space evolved for you years of collaboration with rec and park, community group, residents of noe valley town square, then supervisor scott wiener's office and the san francisco parks alliance the town square opened october 27 of 2016. part of the design there was a support for a strom that would be accomplice in the the northeast corner this was part of the approved site plan at the commission adopted. the addition is approved by the planning department and consistent with the exemption under ceqa. however the restroom was not constructed because there was a short fall in funding.
1:19 pm
it was in the constructed with the park. and fiscal year 21/22, budget years rec and park department allocated funs for project plan and evaluating the viability of the modular strom at the site. as well as preparing costs and project funding. before we completes that press the noe valley community advocated a state funds for the project, which is the second grant i will present. this was based on high level mitt for custom designed restroom at the site. since this time we were propped by near of 22, by juan buck low with the building company and chad with the public restroom company who expressed interest in contributing a module
1:20 pm
demonstration public strom for the noe valley town square. it was manufactured off site and a model for trade shoes for a year. the value of this gift is mated to be 425 thousand dollars. this includes the module restroom facility installation and site improvements. it includes design and engineering services for permit drawings and relocation of i drinking funts ain't and electrical and water and plumbing hook up. and agreed to use union confraktors for the work. jot rec and park department's portion funded by the state grant includes lands scape dine other permits. environmental review. architect and engineer work and expect this to total 300 thousand dollars. right nought project is in the planning phase being wrapped up
1:21 pm
and expect permit and construction to be developed through may and bid awards expect in the june-july. we are expect construction to start late sum and early fall. that's my presentation regarding the module restrooms the in kind grant. i will talk about the second grants. this second guarantee is the second action is requesting your recommendation to accept i guarantee from theical cal park's department 1.7 million dollars for the noe valley prefebruary indicated public restroom and future module restroom project in san francisco park and open space. it requested approval of the associated grant agreement and also authorizing the department to enters in an amendment in modifications to the grant
1:22 pm
agreement. i mentioned i gave the backgrounds on noe town skier that opened in october of upon 27, 2016 this park is heavy low used by the community approximate hosted public events weekly farnler markets. exclusive host of weekly class and other programs for children, adult and seniors. a public restroom is really needed they do have high usage. i mentioned the xhounlts advocated for funding from the state which resulted in the department receiving a 1. 7 million dollars grant in the form of the spesified grant by california state pashs office of grant and local services. >> this combined with in kind grant 425, we had 300,000 from
1:23 pm
this grant the project it would meet project budget upon 725 thousand dollars. regarding 1. 7 million dollars grant, our department has been working with senator hene since february and submitted reallocation of the guarantees to allow us to use any funds this were not used at noe valley for other projects. the project this we have identified to use as the remaining balance is precylinder p. this project is still in the works we need to develop a scope and environmental review for that. and should there be funds remaining after facility allocation for noe valley town square and presidio park module restroom we use that for a third site. of the of i have the project
1:24 pm
manager he were if you have project questions. i can answer questions about the grants. vice chair mandelman. you want to thank rec p for your work on this project. probably i think almost from my startoth board i and prior supervisors had somewhere between begging and harasdzing rec p to address upon a final piece of the noe valley town square which is a much loved and used space on 24th. but lacks a bathroom and many of the users of that space mentom lament. we had been trying to figure out how we might find funds member
1:25 pm
hene expressed interest. and then -- things took a curve. i want to thank rec park. and i know the folk in noe valley are look forward to getting their bathroom and if there is money left over for other parks i have been purke for another park in district 8 but we gotta spread the bathrooms around. but we get become to dubose they need a bathroom, too. >> thank you vice chair mandelman. i think my question would issue if there were inform with the upon 1.7 million dollars grant oust which -- 300 thousand dollars is still going to be
1:26 pm
allocated for the installation of the bathroom at noe valley town square. and with the donation of the modular toilet the 425 thousand dollars which totals 725 thousand dollars for just the noe valley town square prefab restrooms remaining how much 1. 4 million. does therapy mean00 autoreason should cover because help me understand. the remaining 've the allocation of funds
1:27 pm
>> sure. your math is correct in left over after spending the city costs out of that 1. 7 from the state. what the language we worked with hene's office on this would go to the future purchase of modular restrooms our estimate for noe valley was about 1.2 million. if we purchase the building. our hope is depending on the timing of all of this. that we would purchase the state funds and dot other w out of a different source or use all of the funds for precylinder if we purchased the unit and dot
1:28 pm
necessary site preparation out another source of funding there will be left over funds from this source. with that, you have 2-300 thousand dollars remaining. i think the question is how does -- this one i understands it is noevilley town square was advocated for noe valley town square folks how did the other come back yoochl upon it was high on list of fasils that need a strom we did an analysis of all parks that have features that lends people it stay for long are than 10-15 minutes that serve kids, multiuse. and it is highway on the list for restroom general low and the analysis of the site indicate that it is a good candidate for
1:29 pm
a modular restroom. >> i z. with the dollars reis the intent not like aloment. i should say. it is. sdpeent amount but not enough to do a third mod lawyer restroom. how would you decide or -- what it would be? >> we have done an analysis of our view of where restrooms are needed. part of that is the distance from other public facilities if there is a library across the street, that ends up lower the rinking. i'm happy to share that with you we worked on it with supervisor ronen and happy to discuss if you agree with her methodology.
1:30 pm
>> once accept and spend you would not need to come back perhaps to become to your own commission for reporting upon purpose but know being for the presidio park or the other million dollars of guarantee funding or approximate for modular strom donation. witness we accept this then we are going to be done you can move forward? >> correct. >> right. >> i think i don't expect you to have the language to clarify how the money is spent here. i wanted to have it on the record public low the remaining of the money is a millennium after noe valley is complete the next is presidio p if any we maining ways to identify either modular restroom somewhere else.
