10:12 am
>> madam chair, we are checking to see if there are callers in the queue. please stand by. madam chair, we have two callers. welcome caller, your 3 minutes begins now. >> good morning. my name is ellen lee, zhou. i have been a public health worker for san francisco health department. i worked more then 10 years. i represent the government employees in san francisco. i have been living here in san francisco for more
10:13 am
then 37 years. i care about san francisco. yes, i am the ellen i run for san francisco mayor in 2018 and 2019. yes, your ethic commission has been retaliating me after i run for mayor. ethic commission is the most unethical department that i know of. i have been coming to ethic commission many years. the last time i spoke to you, ethic commission was in april 14, 2023, i spoke to you about san francisco elected officials. some management leaders have been running a (indiscernible) we now learned san francisco has been controlled by the people within our government are enemies for us.
10:14 am
most public elected officials were paid and bought into the office to purposefully impose agenda 21 now changed to agenda 2030, which another (indiscernible) i reported to you last month about pandemic covid-19. its plan and the crime against humanity by forcing covid-19 vaccinations for san franciscans. we now learned more and more people who accept the vaccination dead, dying, sick, but stiff have the (indiscernible) no vaccination, no job until this day. i was retaliated reporting facts, data to government leaders, lie about this pandemic to the public. i
10:15 am
was terminated by my public health department in september 2022 after i report the crime against humanity. as of today, may 5, 2023, we the unvaccinated government employees still have many active lawsuits against the mayor, health officials, and some city leaders lying to the public by forcing vaccination illegally. violate people's medical choice, religious freedom and consitutional rights. >> your three minutes expired. >> more and more people are dying-- >> please stand by as we go to caller number 2. welcome caller, your 3 minutes begins now. >> commissioners, it has been some time since i
10:16 am
participated in your deliberations. ironically you commissioners to strengthen the ethics commission so that you all can address quality of life issues . on every level in the city countsy county of san francisco, we now see corruption. our sunshine task force is dysfunctional. our ethics commission is floating. our controller's office knows about the corruption, but kicks the can down the
10:17 am
street. the director who used to be the ethics commission director has left. we the people do not know what is happening. who has replaced her. we need the ethics commission that was created by the people but is not serving the constituents of san francisco. we have now departments going directly to the board of supervisors introducing resolutions on behest payments. you remember that somebody from the board of supervisors came to
10:18 am
muddy the waters of the ethics commission, soime are asking you all, kindly to address quality of life issues on every level in the city and county of san francisco, we do not have quality of life issues. crime is on the increase. businesses like nordstrom's, whole foods, many other businesses, large businesses are leaving the city, and you ethics commission have to ponder and connect the dots. thank you very much. >> madam chair, there is no further callers in the queue. >> thank you. public comment to to item 2 is closed. now i
10:19 am
call-- >> good morning. >> hold on sir, can you give me a moment? your 3 minutes begins- >> i want fully prepared to come today. my name is (indiscernible) i have a french accent. recently what i have been doing is start talking to the supervisors and different commissions and ethics is key for-i'm on a mission i call that. we need to walk together i believe. the city (indiscernible) i don't know what thoughts you play in-we are playing with fire for the future of humanity is absolutely clear. my words will be, don't let ethics become scripture, because that is what is going on.
10:20 am
it is pretty clear. because you will lose your ability to reach what should be your reason for being like everybody else, happiness, because you can't switch happiness superficially you have to use the energy (indiscernible) towards beauty to reach happiness. artificial intelgence (indiscernible) can't achieve that because (indiscernible) it doesn't work. i think that's it for today. thank you. >> thank you. >> thank you. >> if there is no mf >> madam chair, looks like no further public comment. >> okay, public comment is closed for item 2. now i call consent calendar, item 3, 4, 5, 6, 7, 8 and 9. as noted on the agenda there is no separate discussion on the consent calendar item unless request is made by commission member or member of the public
10:21 am
in attendance, in which event the matter shall be removed and considered as separate item. if any commissioners ask to discuss the item, that item will be taken off following action on the consent calendar on the regular calendar for discussion and action. any commissioners wish to discuss any item on the consent calendar? i see none. let's open up for public comment, please. >> madam chair, looks like we have one phone call in the queue. please stand by. welcome caller, your 3 minutes begins now. >> good morning again. my name is ellen lee, i spoke earlier today. i was cut off before my statement finished. as of today may 5- >> excuse me. >> you have many-
10:22 am
>> this is for the consent calendar item, number 3, 4, 5, 6, 7, 8, 9. this is public comment for that line item. >> (indiscernible) >> public comment is specifically for consent calendar. >> morning commissioners, deputy city attorney. yes commissioner, the public commenters should limit their comments to addressing the item and the commission is considering, which is the consent calendar. >> thank you.
10:23 am
>> we are going to continue with your public comment. >> as of today may 5, 2023, many unvaccinated government employees still have many active- >> excuse me, [multiple speakers] i need to cut you off. any other callers? >> looks like we have no further callers in the queue. >> okay. thank you. since there is no other public comment, do i have a motion to adopt the consent calendar, 3, 4, 5, 6, 7, 8, and 9. >> so moved. >> second? >> second. >> roll call, please. >> on the motion to
10:24 am
adopt- >> actually, let's try the old method. if no objection can we just have do we need to do individual roll call? no objection to the motion? >> do need to take a roll call or without objection. i don't know whether the bylaws address this. during covid you needed roll call but since you are present i think you can probably do unanimous consent. >> do i have unanimous consent for this item? >> unfortunately not. >> okay. roll call. let's do roll call. >> on the motion to adopt consent calendar. commissioner florez feng >> aye. >> commissioner finlev. >> aye. >> chair lee. >> aye. >> commissioner romano. >> no. >> three votes in the affirmative and one opposed. the motion is approved.
10:25 am
>> i now call item 10, which is proposed closed session item to discuss personnel matters. this includes proposed closed session item number 10 for public employee appointment executive director. this item has been scheduled for the commission discussion and possible action. for purposes of this item today, there are four steps involved. first, 10a we received public comment on all matters pertaining to agenda item 10 including whether to meet in closed session. second, we'll vote whether to meet in closed session under california government code section 54957.6 and sunshine ordinance 67.10e to discuss the public employee appointment. this will be action item as noted in item 10b. third is closed session held the commission initiate the closed session meeting. fourth, pursuant to
10:26 am
brown act and sunshine ordinance and as shown on the agenda item discuss and vote on the motion regarding whether or not to disclose any action taken or discussions held in closed session regarding the public employee appointment. does any commissioners have any questions about today's process? i see none. i like to ask our city attorney if there is anything you wish to add about the commission's closed session process? >> you may proceed. >> thank you. let's proceed to public comment on specifically agenda item number 10. >> madam chair, we are checking to see if there are callers in the queue and we have two callers standing by. please stand by. welcome caller, your 3 minutes begins now. >> commissioners, you are going
10:27 am
to go into closed session, and you know that we really need a good ethics director. the last three ethic directors tried their best and i know that you are going to make every effort to choose a good director, but please make sure that whoever this director is has sufficient staff. without staff-without various staffing (indiscernible) latest technology, software, we cannot serve the city and county of san francisco, so we do need a director.
10:28 am
the director is linked to good staffing. thank you very much. >> thank you. >> we have one more caller in the queue. welcome caller, your 3 minutes begins now. >> my name is ellen lee. yes, i spoke to you this morning. yes, i got cut off by you the lawlessness criminals running the government. i work for the city of government, i was terminated. >> excuse me, are you commenting specifically on this agenda item 10? >> yes, you not allow me to speak and finish my statement. you are no different then a criminal. this is public statement. this is public ethic commission. i am here to ask you today, because this is a closed session and it is
10:29 am
about government employee, government hiring, public taxpayer business. i pay for property tax. i pay for sales tax. i am paying for the salary of public government employee. because this is closed session, we are not allowed to participate and do not cut me off. i told you already, you are no different then a criminal by cutting me off. i am here to ask you all public officials and those in charge to come back to (indiscernible) reevaluate our failed city policy in all departments. because you have a closed session, do not allow public opinion to be (indiscernible) that means you are doing illegal business against we the people government. the government must set up to evaluate by the people, not the government set up by the government. you are
10:30 am
running a (indiscernible) about companies leaving san francisco. the ethic commission has been working with so many departments closed behind doors do not allow the public to know the truth nothing but the truth. i'm here to report to you the ethic commission that you have discriminate against those who do not agree with you. the public opinion. just like you did this morning. you shut me off after i spoke less then a minute when i'm having three minutes. where is my civil rights? where is my freedom of speech under god given right? where is my taxpayer money go when all this behind the policy comment is not publicly? yes, i run for san francisco government mayor
10:31 am
representing the people. what have you done to me? you have been fire me by after i spoke the truth to you ethic commission, and the mayor and board of supervisors. you know, you close behind the door about employee- >> your three minutes has expired. madam chair, looks like no further caller in the queue. >> okay, public comment for agenda item 10 is closed. do i now entertain a motion to proceed whether to meet in closed session under california government code section 54957.6 and sunshine ordinance section 67.10e to discuss the public employee appointment? >> so moved. >> second. >> okay. >> motion has been made and seconded. i will now
10:32 am
call the roll. >> we have unanimous consent. we do. let us proceed to closed session, and i just want to make the announcement that because of the closed session item, we will reconvene in open session around 145 or 2 o'clock, so we thank members of the public for your patience and continued engagement. let's go to closed session.
