work policies. there are no hotels on port propertiful we know the hotel occupancy increased. as a sign tourism returning. >> i'm looking at the port's performance. port manages 330,000 square feet of class c and b office there is class a office space on port property, it is managed by master tenants like hudson and ordan. we have about 17.2% vacancy for office higher than the city's rate of 16.8% for class b and 15.3% for class c office. vickancey for industrial our sheds and many have limitations on what you can do with them or
3:26 am
in them. due high docks and older electric system weight limitations is about 11. 9%. higher than the over all industrial vac analysisy for san francisco which is 5%. we have parking leases a rate of 6%. ethernet lease rates not lore than terms up to 5 years up to a million dollars and on the boil are plate lease. the largest i will say i'm sorry the last change was adopt in the
3:27 am
august of last year. at which pyle time 115 rate listed april 40% of rates remained the same. 10% decreased and the balance increased slightly. for fiscal 23-24 propose to keep the majority the same locations where we might have trouble finding tenants given the current market or may have tenants interested but use is not compatible with when we have to offer. there are 2 locations we are propotion a slight rate increase. and these are locations we have a low vacancy rate or high level of interests. this will impact interior space at the add bodiesing and shed space at pier 453 it does not pertain to fishing use. we are looking at a decrease at
3:28 am
round house 2, there is a high bodiesing vacancy one of our office buildings. we are looking to decrease the rates at that location. so. in looking at ways to try to entice tenants to come to port property and retain our existing. we are unable to offer the intentatives some of the landlords are offering in the public sector we can provide for longer terms. we are seeing more office tenants take advantage of the rate for 22-23 and continuing this incentive again as a way to purnew leasing and as a way to retain our existing tenants. based on the recommendation we
3:29 am
would recommend offering a half month free rent for leases 3-4 years with a ramp up rate this . tool would be used where if you have a 3-4 year lease we ramp up your rate to pay 70% of program terand 80% in the second year. 100% in year 3 foreverfor 4 year lease and again wield allow for helpful a month free rent on the anniversary and of the lease term. we are seeing attentives are apprehensive in entering in long-term agreements. so, we would as another tool propose to keep the ability to offer tenants a tomorrowination right if they nernt a lease 3-4 years and things don't go as nay hoped. they can get out by paying a
3:30 am
termination fee equal to a month timers number of years remaining on the lease. along to accounts for the discount they were given in the early years plus unamtorized leasing incentive and port administrative costs for processing the termination. for shed space with the challenges we are seeing in leasing our shed space due to limitations. lack of the the challenges with the electrical distribution and the rate incentive would be similar to the it office incentive a half month free rent for lose of 3 years.
3:31 am
>> the tenant able to get a rate above market we split less than 50% of the court this was highlight in the 2021 and not a common scene it would allow us to keep tenant in accomplice if they are able to sublease even a portion of the stay. with merry time use we are proposing to continue the triple threat incentive aapplies to new and existing tenants the use include 3 of 4 of the types of following types will be office, shed app ron and submerged land. we could then offer a discount on the office rate increase 3% per year. a tenant able to lease all 4
3:32 am
locations. not charge for the submerged land tieed use of app ron space. >> a couple of clarifications. this is pertaining to development items. for when we call dual jurisdictions. this is in cases where public works charges a permit fee for use 5 block in open space on city port owned streets so licensise not paying public works fee on top of port license fee for the same use. port staff proposed to delegated authority given to allow reduction in port licensee in amount equal to the port inotropics the public works permit fee.
3:33 am
occurrence may be things change and people retire we don't have anything in writhe we would like delegated authority for. there are public improve ams port will own. however will be asigning the maintenance and liability to another party as part of the development project. under the license or other real estate agreements, covering the maintenance responsibility. the responsibility for taking care of these yms will be at no cost am again. we don't want them to have to pay us to maintain our improvements that are in the public areas. and so i wanted to touch
3:34 am
previously on special events. we must charge parameter rates special events are not a key revenue generating item for port. revenues for fiscal 22 were 125,000. versus 207,000 in 2019. and last year it made up about 73,000. for fiscal 23, we propose the continuance of fee waivers for port sponsored eventses and fee reduction of nonprofits and equity events and waivers for diversity and inclusion events up to 7 thousand dollars per event can cover entire cost the permitting. we would lim the waiver to 60 thousand per year the year that might apply and if you hit that
3:35 am
max, we allow 50% reduction for additional events. this is something that was adopted last year. we did not hit that max. we are hoping -- to see more activity with the next fiscal year. we are propose toiment the fee schedule to increase the budget limits from 2 to 3 million for eligibility for 50% fee reduction and proposing to keep discounts for pop ups offering a discounts similar to nonprofits however adding that concession and ticket fees may apply. >> at this time i would like to again recognize staff this helped put this together and take questions you may have. and if we are on a good path, ask that you consider approving
3:36 am
this action. thank you. >> thank you. can i have a motion? >> i move. second >> thank you. open up to public comment. >> is there public comment on item 11a. 91 in the room anyone on the phone? at this time theres no one on the phone wish to comment on this item >> public comment is closed. >> i mean it is fine you know these rates i'm curious -- things similar to restaurants or -- or people that mayment an opportunity are we giving other incentives besides month free rent or a separate category for people who want to take over
3:37 am
renovate and spends half a million dollars to get the restaurant up and running? those are usually improvements but are we offering any incentives to get the restaurantses or even small kiosks going some of the small are spaces to get tourists interested in and when we get more port cruise shipps coming in in a situation got damaged and had nothing to do for 3 days. joof a lot more of the mauler places around the port that can be may be attract otherent preneuros to come in. >> thank you for that question, commissioner lee. you notice not anything mentioned with regard to retail that is because retail upon opportunity require competitive bids unlike the parameter frontey.
3:38 am
this is something handled more on a case by case basis when we start receiving proposals for those opportunities. and then 2, there was the there was the authority that was guaranteed by the commission and the board of supervisors where we can provide certain dollars to businesses to do certain capitol improvements that would come to play with retail use we do have some of the [inaudible]. these here -- do are some of the spaces that have restaurantos them and you can still. work with? these are office and shed and industrial vacant know land.
3:39 am
again it is not -- pertaining to retail uses which do require we bid competitively. >> our retail --ent prenurse say wants to take over a space for a parking lot or you know that is on here it is possible. for park, no that would require competitive bid. >> right. if they like that site. they could. why right if we were solicitings offers and bids. yes. i'm still new there are different things i want to make surety small businesses get a chance. there are people that want opportunity. it scared people you wonder if the rates if helping to attract more people or scaring more or not getting offers at all.
3:40 am
with when we are proposing we are hoping that tell attract people as well as incent sunrise our existing tenants to remain there are we are reducing rates for them to enter in agreements of a longer term. >> okay. >> great >> thank you. opinion comment is closed. >> thank you >> commissioner harrington. >> a lot of work went in this i appreciate this. the first question is, what percentage or dollar vault port revenue are covered? we were does not uncover retail is 30% covered boy in process or any idea.
3:41 am
and the second part of this i realized 96% are staying flat. some were and up some are down i have no sense of the vault increases or decreases is it quarter here worth 50 dollars or 500,000. if we get an idea on the ones that changed and the value of the changes might be? >> yes. >> i will respond to this in writing. >> thank you very much. >> commissioner gilman >> great questions. i had a couple, too much walk me throughout logic why a half month as incentive is this manage we see in the market? how is this compared to others. i found it odd half mont and in the a whole month. i don't know if san tino is on
3:42 am
the line and would like to be ail to sfnld to that. i will say it was recommended by our consultant. so this being said, it is something that is being seen in the marketplace and something that we felt we could match. so -- we supported the recommendation and presenting it to you for consideration. why same here if we don't have to responded back in writing. >> i wanted jump in. if you repeat this i can probably give you a rough. >> my question was why helpful month why not a full month. the methodology and strategy of half know month of rent forgiveness this . is in addition to an r.ed up schedule.
3:43 am
when we look at the effective rent. what the rent is and the end of the day after all the free rents and the half rentses as you go the ability to we want to gift port the tools need this is program terse so our assumption is that this is not an automatic give temperature is providing staff with tools to negotiate you know a transaction and may be we don't give away all of it. and we want to expand and give as much as we can away without to try to incent vie and compete that can offer things that unfortunately the port does not have. i if any we have the 70-80-90 and a month free instead.
3:44 am
half month we're giving away a bit. >> okay. i was curious. thank you for that. >> you are welcome >> thank you. >> the, question i had was on the special events increasing the budget for the nonprofits this is curiosity question i'm supportive of giving nonprofits a break when they capitolize port property or for other nonprofits or the community. have we stheen we had nonprofits approach above 2 million is this why oui move to thee? why not 5 j. we have not had and thank you for the question. have not had a number of nonprofits that are even at the 2 million. again we were trying to provide additional opportunity and since we have not had them come to us with the two.
3:45 am
we thought wield increase it by three. so it was arbitrary. >> thank you. thank you for this. my fellow commissioners asked, let of great questions and happy we are keeping a large percentage of reasons the same and not increasing too soon after with the recovery we are going through. and i think you did a great job. i would like to see the information that commissioner harrington. one question was what is at pier 45 and other uses at pier 45 besides the fishing industry. why there was that high demand at pier 45. >> so, with that i don't want to put don on the spot but he is the senior property manager near pier 45. and may like to answer that
3:46 am
question. >> hi. i'm don senior property manager for the port i handle the wharf. pier 45 is primarily related to the fishing industry. and well are 3 sheds, two of them are primary low fish processors. and then the end of shed d is deer storage and shed a is primarily deer storage and c the port maintenance yard and park the primary tenants at pier 45 are all related to commercial fishing industry. >> so. in the report it says low vacancy and high demand and the port rate increase. at pier 45 for nonfishing industry use are there other. >> the typical attentives is
3:47 am
fishing industry it is set up for fishing industry. the only thing that may be at the fronts of shed b prep space for restaurants and so that's a small triangle of the over all total. you got that. there might be park. where the the -- not available to the public but for the processors the restaurant workers. and the like the crab boat deck hands that go out. well is very limited opportunity for anyone other than fish processing. >> i think one thing i would like to add is although don mentioned the primary use is fishing industry and would continue it as such. sometimes we do get requests for storage uses it might be a restaurant space. there are other retail spaces in the area or business this is
3:48 am
might need storage space we could be approached by them not to say that is manage we would use the space for or might not want to use it for that. if you ever been in 45 you will know there is definitely used for fishing. this is really a way in being proactive if for some reason we were approached by a nonfishery fishing use and wish to lease it for that purpose although again you think the likelihood is very small. >> thank you. why commissioner lee. >> i'm -- no. i want to caution the our big draw is the fishing industry. i'm all about beens the book but raising the rent on the fishermen, i would like to use that as a last resort and push
3:49 am
some of the other spaces that we can get more incentive to. i believe if it is empty we are not making money why not give more incentive for spaces that are empty. rather than raising the rent on workers? and mom and pop operations you know because it is full? but i want to caution not to okay. yea it is doing well. raiset rent because you know we gotta keep them in business. and we than the fishing and crabbing and with -- climate change they don't get the sell their products on time so -- i want to make sure that we are keeping -- you know -- let's not put pressure on them. why commissioner lee, thank you
3:50 am
for your comments. definitely appreciate it and understood. i want to mention again this what was proposed is in the manage this would affect fishing use. again it would be for nonfishing use but the like lihoofed us doing that is fairly small. we are again doing this more as a proactive measure. somebody who wants space they are not fishermen they could go market value on those? if visible? >> correct. >> any other questions or comments. we have a motion and a second. all in favor? >> aye. >> aye. >> any opposed? >> resolution 2336 is adopted thank you. >> thank you.
3:51 am
>> next item. >> item 11d is informational presentation to consider possible action to approve a resolution recommending the board of supervisors wave requirements of the competitive bid process with respect to the unsolicited proposal from wharf revitalized for the losing and development of sea wall 3 huh human, 301 and pier 31 and the wharf located jefferson between tailor and powell street and resolution 2337. the parking lot area and pier 45 shed a and c.

with vending. we feel that urgency. the thing that we know is that we have a number of issues along the water front. and another set of urien issues minot be a today issue but soon. seismic and resilience risk. we know that our portfolio needs an amount of investment we can't pay for from our own budget. we see not that this proposal from the wharf revitalizes ignores this urgency of you in we continuing is a necessary and responsible way to been tomorrow. as well. and we continuing is important for us to consider that this investment might help us along the path to recovery. if we shape it not under cut the things in the short term on goat that recovery. the second is process. the bidding press is there t for

losing that by not having a competitive process. hatch it does is allow project experiences to bring conceptual idea when is they vision for port property and what tell cost and how they will get there. you get air chance to look at those and say this is the path we want. and that has value. what the rfi show system there is in the another development proposal that wants to invest in the way this one does. a competitive process to port staff would be a delay, use of time this is not project cal does not veterans public policy it is in this process here that we'll figure out the questions this people have that we heard during the stake holder this year. so, to close, port staff's recommendation is this this froefl provides an opportunity for need victim at the wharf that can be shaped through a

negotiation process. this picture is not developed yet we want to develop t. and we don't believe this is another vision worthy of that consideration now. we have not heard it through 5 months of talking with the community and inrighting people to tell us. we recommend that you adopt the resolution we attached to today's item and direct us to ask the board to give us the waiver of the competitive bidding policy to figure out what is possible. that concludes my presentation i'm happy to answer questions. >> thank you, mike. can i have a motion. gi move the item. >> i will second it. >> thank you. well is public comment. john barnet.

i'm president of the crab boat owner's association. representing the fisherman that have the gear storage in pier 45. agree with steven. this proposal makes it is kinds of using a pace that is already being rented to the fishermen accessible space we keep our gore in. it is very fishery oriented not really pleas analysis for the public to be there. gear the men work. nothing this people to see. i have a charter boat. depend on the tourism. i know the cruise ships are up the tourism and the wharf is way down. besides the covid year in 25 years of doing tours, this is the slowest year because of the salmon closure and still the

slowest business year at the wharf. what propose the uftz buildings that are empty. i agree with the competitive bid topic the restaurants are empty. don't need to competitive bid there is no competition to take over now. than i could not rent it out. some incentive too to get the restaurants to open revitalize the triangle ping lot but move to pier 45 when you have vacant building sns makes no sense. you will build a now structure on a pier next to the vacant building its will be the same there. people are walk to pier 39 and not if any the walk down to the merry time museum or argue gnaw or the cable cars they go around to go to the cable cars the wharf is dead now. we are supportive of keeping the

4:05 am
i don't understand the location for the project. pour 45 is in the vacant we have a waiting list for the storage space i'm on the waiting list and i know people who have been on that for a long time. especially after shed c burned and we don't have enough storage for what we needed there. i don't understand where the float is supposed to do business. you know the saying we have other storage pace and send you down to the ballpark or sends you down to 48 or whatever is a misconception of how we use that space had is not just storage it is where we work like asking to you do 50% of your job here and the other in city hall you go back and fourth 10 time in one day it is not atenable for the way we use that pace it is misconception to just call it storage. i don't know where we are with the environmental review process

4:16 am
there is no one on the phone. public comment is closed. >> thank you all for being here today i do appreciate your comments and if i could reiterate had micheal said we are not talking about what this proposal might do today we are talking about when they want to move forward to have it be discussed i get your frustration. and that -- the idea of purke the fishermen out this is in the the intent of anybody here or the port. the question is -- who i we are doing the thing this is we agree with you are urgent and what will happen 3-15-20 years from now? this is the only proposal out there now. this talks about what is that future for the wharf.
4:17 am
and i don't think the future of the wharf is to get rid of the fishermen. i do think that our choices are do nothing. we could wait for who knows how much year until the economy gets better and staff puts a vision for the wharf. how that is vetted with the community and may be in several years the compel be good enough to do a request for proposal and have competitors come in and see what they want to do. what this does instead is starts us now being able to have the conversations. with the partner that can take the things happen and allows you to say yes or no. there will be so much make us crazy process in the next several years but so much going on that will allow all of this discussion to take place. it is pier 45 needs to be what the differents what the proposal is i bet that will happen. or not going to go through or be something this we are for the
4:18 am
people involved. i think again, i'm help to support the move to move forward to waist bid process to allow conversation to happen. abcents this nothing happens for years that is in the healthy for the organization or the wharf. not for any of us. i hope this people can see we'rure not jumping on this proposal and adopting it we are saying we want a discussion to help and this is the only tool we are to have that discussion help. i think na -- upon to do this, it will be good to have a couple changes to the item before us today. one says we receive 2 letter was interest there was one all right of interest and one of opposition. that is good to clarify the board will be trying to make hay decision and rely on our
4:19 am
resolution will be better if it was clearer about why we think this is qualifies for that waiver of the bid process. adding words to that would make this a strong are thing. i want to asurety folks here today. nothing here is going forward. without a lot of additional conversation and a lot of process that will allow all these things to come out and the things to be heard. i would hope you stick with us. for the only real possibility i see on the out there for the next couple dwroers do interesting about the health of the wharf. >> thank you. commissioner lee. so. i think you guys than i'm about small business. i'm all in your court. you know. i'm champion or try to be of the people this don't get a paycheck

grouch people that are interested and trying to help example we are far from approving anything but to hear the proposal we gotta get over this. so, trust me we are not losing the fishing industry at the wharf. this is like you said we are fisherman's wharf. you have a lot to say to the developers and may be they'll work it out and men they will focus on one other area and help with your sheds. who knows but we can't get there until we can take this per out and move not negotiation's stage. so -- be patient and i have your back that we for small business. so. that's all rito say. >> commissioner gilman. >> thank you, everyone for public comment i think you will hear me pile on the love for the

our team is exceptional. they are very talented engineers and analysts who work to deliver the data and the services and the technology every day. >> i love working with linda because she is fun. you can tell her anything under the sun and she will listen and give you solutions or advice. she is very generous and thoughtful and remembers all the special days that you are celebrating. >> i have seen recent employee safety and cyber security. it is always a top priority. i am always feeling proud working with her. >> what is interesting about my work and my family is my experience is not unique, but it is different. i am a single parent. so having a career that is demanding and also having a child to raise has been a challenge. i think for parents that are
4:53 am
working and trying to balance a career that takes a lot of time, we may have some interruptions. if there is an emergency or that sort of thing then you have to be able to still take care of your family and then also do your service to your job. that is probably my take away and a lot of lessons learned. a lot of parents have the concern of how to do the balance i like to think i did a good job for me, watching my son go through school and now enter the job market, and he is in the medical field and starting his career, he was always an intern. one of the things that we try to do here and one of my takeaways from raising him is how important internships are. and here in the department of technology, we pride ourselves on our interns. we have 20 to 25 each year. they do a terrific job contributing to our outside plant five or work or our network engineering or our
4:54 am
finance team. this last time they took to programming our reception robot, pepper, and they added videos to it and all of these sort of things. it was fun to see their creativity and their innovation come out. >> amazing. >> intriguing. >> the way i unwind is with my photography and taking pictures around the city. when i drive around california, i enjoy taking a lot of landscapes. the weather here changes very often, so you get a beautiful sunset or you get a big bunch of clouds. especially along the waterfront. it is spectacular. i just took some photos of big server and had a wonderful time, not only with the water photos,
4:55 am
but also the rocks and the bushes and the landscapes. they are phenomenal. [♪♪♪] my advice to young ladies and women who would like to move into stem fields is to really look at why you are there. if you are -- if you are a problem solver, if you like to analyse information, if you like to discover new things, if you like to come up with alternatives and invent new practice, it is such a fabulous opportunity. whether it is computer science or engineering or biology or medicine, oh, my goodness, there are so many opportunities. if you have that kind of mindset i have enjoyed working in san francisco so much because of the diversity. the diversity of the people, of this city, of the values, of the talent that is here in the city. it is stimulating and motivating
4:56 am
and inspiring and i cannot imagine working anywhere else but in sannnnnnnnnnnnnnnnnnnnnn

>> when o'shaughnessy dam opened 1923, there was a grand celebration that was an achievement of ensuring san francisco's new water supply but it was the beginning of a unique collaboration between the city of san francisco and yosemite national park. >> lands around the dam are critically important. we, along with the park service have a very common goal thereof protection of that watershed, both for national park values and water supply values in yosemite is the cub tree's premiere national park visited
4:58 am
by millions of visitors but the protection of our watershed and the city provides significant outside funding for the national park, over $8 million a year is for trail maintenance and wilderness education and park operations and security keeping the water safe and the park a haven. >> one hundred years ago when the dam was first built, there was a different view of the environment back then, than there is today. and the dam was part of changing that view across the nation. that brings an importance to our work here at o'shaughnessy dam, how we manage this dam and manage our releases and the environment downstream, it's very important to san francisco that we need that challenge. >> for 100 years, o'shaughnessy dam and the park service ensured the bay area has clean water, along with ongoing stewardship much our precious natural

resources. >> this o'shaughnessy
