code amendment. >> good afternoon audrey planning staff ordinance would amend the planning code require c u authorization in residential mixed, commercial and residential transit or yentsed, except for residential transit oriented mixed districts. residential housing developments that don't max residential density. the maximum density define instead ordinance for each district i mentiond and the max are detailed in the executive summary under the way it would be. additional create a new subsection in the planning code specify conscience present for a project to be exempt from the minimum density and mack unit size or both. they are laid out in the executive sum row. generally to questions of law foil for exemption from the cu authorization, the projects limited to either 2,000 square

8:26 pm
additional cases affected by interim controls both expand a single family home to differing degrees the result was the commission denied the cu authorization for the prokt adding 2,000 square feet to the single family home and approve the project add approximately 900 square feet. the department found the controls appeared to be successful accomplishing incentivize density for mule construction projects. upon new construction accommodate denser buildings from the ground up versus working with existing building contranlt. in addition the interim controls the department found that since the commission discretion to deny cu authorization for code compliant development is limited and cu authorizations for small scale projects are significant drain on the department and the commission's time and resource.
8:27 pm
new requirements for housing should be objective in nature. that said, we like to emphasize support of the goal of the legislation. to facilitate the development of multifamily housing we believe it is better accomplished through objective standardses and simple permit processes for the projects the city krrz ideal. we discuss third degree with president supervisor peskin supportive of creating a new cu requirement. he requested changes to the recommendations in your executive sum row. which the department is spicht of and i will highlight those as i go through our modifications. with that, the department's modifications are as follows. one, modify the ordinance to replace the c u authorization requirement with objective minimum density standards new construction. in the rmrc and rto except rtom districts. and they would require 75% of
8:28 pm
the max density with this mack density energy the proposed ordinance density. max. two, new construction projects in the subject zoning districts require no u night small are then and there a third the size of the smallest in the building. throw, replace the ordinance lives exceptions to minimum and unit sizes where a simple, single exception to the department's recommended objective standards for minimum densities and minimum unit sizes as follows. expansions of single family homes makes the growth no more than 25% over 10 years or to result in a home no more than
8:29 pm
3,000 square feet. which ever is grirt. and number 4 to incentivize project in thes zoning direct to build the projects we are hoping andmenting to see. removing the cu authorization for demolition r317cu authorization. and public initiated dr and only applying objective residential design standards if the project can meet the following criteria. first, mixture the allowable density not including adu. second, mote the unit proportionality requirements. third, not proposing demolition of a previously identified known historic resource. 4, in your packet we will not recommend. is does not propose a building subject to the [inaudible] we are researching whether or not that is possible or allowed. we will wait on the city attorney to determine this for us. next, does not require any exceptions or waivers from planning code requirements other then and there the cu under 3 upon 17. and additional low to when we suggested president supervisor peskin suggested the following
8:30 pm
additional requirements for projects seek the exemption. look similar to you to what you saw in melgar's family housing opportunity sud. gaevenl the these are additional to when we have intdz and spicht of them. we should be no tenant buy out in the property in the last 5 years. no tenant occupancy within the last 5 years and the project not seek to demo a building more than 2 rent controlled units that concludes presentation and i'm available for questions. thank you. >> thank you. members of public this is your opportunity to address if the commission on this matter. if you are here come forward. if you are call nothing remote press star 3. >> commissioners chris. member of the public lower polk i'm speaking in spchlt ordinance
8:31 pm
today. the ordinance is prohousing. there is a lot of not a lot but proposals that upon in zoning districts that are zoned for multihousing. but propoedz single housing or expansion. of single housing, it is just not that is in the when we need. and this ordinance will address that. it is reasonable. and -- i encourage to you move it forward with positive recommendations so we can implement the controls. as we speak the proposals are coming out on a weekly basis. and getting them now is prudent. thank you. >> thank you for your consideration dp support of this ordinance. thank you.
8:32 pm
>> thank you. georgia i was going to come i saw the 317 thing and my antenna goes upon when i see that. but i think that supervisor supervisor peskin's amendments and i was distressed to see this there would be no cu. i have to question the issue of subjective virs objective. years people thought 303 findings were enough. now they are subjective because the haa is overwhelmed us in everything. . wham i was going to the talk about where my mother lives. she lived for 30 years and 5 unit building. a huge lochlt 30 by 150 lot in the richmond in rm1 and like this sliver rm1 there and there
8:33 pm
are others scattered. and i think that you know -- it would have been terrible to see this taken down. but i think what i have read mrs. maloney said i think this is okay. the other issue i have is a huge yard that house covered half the lot t. conceivable they could build on the rear of the lot and the tenants have no say so. may be that is what i want to say, is here is another building close to the home. that is 2 units. but hopeful low that will be protected. if this will 2 rent control units. i don't know i understand the need for this. but the other thing is a lot of the rm districts are next to rh2. you know is this a problem? and -- i guess that's it.
8:34 pm
here is the map had made. you see all the yellow on the rrh district and it is yellow are not in the concentrated your they are adjacent to rh2 and 1 and 3. on corners. so there may be other things that affect that i do think that the whole idea -- i -- i think that is -- think that is troubling that, that you are not relying on the criteria that is on the light on for years. you know. go back to the century europe and feasibility studies. the one may 6 where they talk about that. that's all. thank you. irthink president supervisor peskin's amendments take care of nile occurrence i had about the
8:35 pm
staff recommendations. >> if there is no one wish to submit testimony. let's go to our remote callers. >> good afternoon president tan and commissioners. this ask jake price on behalf of the housing action coalition. we are appreciative of planning amendments we are in strong opposition to adding any cu requirements. which have is constraints imposed on housing construction something they committed to not degree in the housing element unless paired with a reduction in contranlt. a housing project max miegz denseit 1151 washington was blocked at the board of supervisors which came after planning rejected the initial
8:36 pm
project application because maximize density. do we want density or not want typeset? we are in the being consistent and we are confusing those who looking to build housing. let's stop lucking with people and let them builted housing they need. thank you. >> good afternoon will good afternoon commissioners. i'm mark mason prince pelf ace architecture i was the architect for the 1151 washington that jake mentioned. i believe this is a cynical peels of legislation it isancy housing masquerading as prohousing. it will result in gentification of add to housing status quo in d3 the districts not primarily of the zoning district affected by this legislation. the legislation is the opposite of what the city should do and promsed do in the hozing

8:39 pm
clarin park i'm calling to apose adding additional use requirementses i appreciate planning amendmented but this legislation is not helpful who are tremendous housing. shortage and crisis in san francisco there are 10,000 people experiencing homelessness any time. and rent for 2 bedroom apartment is 3 thousand dollars. and we need to start making easier to build housing not adding loopholes or hurdles for 6 to prevents construction of housing. we have seen last 3 decades this in general building now house nothing san francisco is difficult. and this -- proposed piece of addition to the process will make it harder. i appreciate [inaudible].
8:40 pm
thank you very much, again i'm a d8 resident and oppose this. last call for public comment on this item. if you are here come forward and call nothing press star 3. seeing no requests to speak. public ment is closed. and this planning code amendment is before you. >> thank you. president supervisor peskin and staff for analysis and suggestions. i have a couple questions to make sure i understands how the proposed staffing modifications would function and understand it right. i understands this we are trying to focus on where we did see good traction with the controls. new construction. so what happens to a single family home that wants to add size is this where they would be in limitations i think number throw? would be for the expansions and everything on new construction or you know since not a lot of
8:41 pm
vacant lots in case demoing an existing building and building new and expansions would just be like help me understands what happens with expansions. >> your presumption is correct. recommended modification number three is the only one real recommend if somebody wants to expand an existing single family home versus demo and construction of creating new unit. the 10 years there is this in 10 years you get 25% up to 3,000 and the next 10 years you get more. and or 3,000 how are we america that. i worry burden of proof things that have time relativity. as like projects could have something happen if this is an ordinance going on forever. they get one hot for one decade and that's it? or you know help me understand.
8:42 pm
>> it is my understanding it would start over every 10 years i get to 3,000 and i want to do more can i do 25% more of 3,000. why sure. over 20 years i suppose you could do up to a 50% expansion. of existing. joy want to understands this. this is we really tried reframe it minimum for new construction it is present for districts we are focussed on. should there be a mack home size in this case it was heard to see one appropriate for the entire city. i like about this is focus on the planning department's suggestions. focusing on areas we know we want more density not one size fits all. i do appreciate that. and one other question. for number 4 under the letter c. a known historic resource is
8:43 pm
this known the time the application is complete and we not do evaluation or you apply but have historic resource to determine if you are a, b or c or b when you apply you stay a b? sure. the this is something you will see a lot for future recommendations on legislation. we will have to come become to you for legislation where we had programs set up it said a historic resource versus a known historic resource. and what we are trying to say if you come in under one of these applications and you are a b building you would be eligible to continue through the application press and apply through this program. upon we would still go through our historic resource evidence for b build and if it turns out you are an abuilding all of the requirements subject that a buildings subject 2 would apply.
8:44 pm
might require to you modify your project to meet that. however it it is not going to necessary low require you or exclude you'd from applying from the program and going through the process. if you are prosecute potion demolition of a resource that would 86 your entire project. why it would. >> i don't know. are we getting more specific or more confusing. seems unhelpful. this is something we required to do because of advice from our city attorney. and so we have to make sure that projects object day they apply if they are eligible or not and so if a project historic stats is in the known it is in the known whether they are eligible to apply. >> eligibility until proven otherwise. >> exactly. >> good luck to the folks with b buildings. >> i can help. practically no one applies for cu to demo a category b without
8:45 pm
dig manage that first. woeful are processes available where somebody can get a determination before they invest in the cu. and that is when people do. >> good to know. thank you for clarifying. to make sure for the amendments that president supervisor peskin is also added no tenant buy outs or sxoups looking on whether or not no demo one more rents controlled unit; or any rent controls. more than two. looking at projects that occurred are not that many. i think 6-8 you found 2 more temperature is manage and now we continue is a sle time for construction maybe not the time we seat most. i'm curious if we look at those if it would have stop them? if we think this will apply mainly to single family homes that would be increasing density
8:46 pm
or conceivable could be a multifamily home 2 units thats to become larger now it would had attentives within the last 5 years would are rented out a unit now this is preclouded. they could go through a cu in the process. but i'm trying to understands how we see that happening and if we know from the projects we have that would shed light on that. >> sure. great question. you know these are suggestions this came in so we have not taken them and locked back at the 8 projects specifically. i reminds you that is an any of program. so it will not prevent projects from going forward with applications especially if they are prosecute posing to mixture moiz the density on the lot which is manage we want. yes they may have to go through the cua for under 317.
8:47 pm
they would be subject to an initiated dr did not prevents the project from moving forward. >> with that i know i see commissioner imperial. i'm spicht of the modifications staff med and i want to support and thank president supervisor peskin for wing with our staff and for coming up with additional items to add and i'm supportive of given this is trying be incentive based program encouraging when we want to see and not catch being everything in the net. and having unintended consequences. commissioner imperial n. terms of the additional requirements, is that part of the recommendation number under number 4. >>ing correct. >> so -- that means remove the cu additional with the no buy out and no occupancy within 5 years. you mentioned earlier and you
8:48 pm
mentioned early they're it will not in is more for the commission, public and plan nothing terms of looking in the demolition. this is how i see the legislation is? right. however, i want to be clear there are a lot of conversations in terms of eliminating cua and the dr review. this is more of the clarification. or more out reach, or we need to be mindly reminded of that the cua the public the dr review processes in a way isup hold. but this is just the press we are taking in not guilty demolition process for
8:49 pm
districts. not sure i understands your question think i catch your meaning the dr, the cua, exists for projects we, some of the expressed not as desirable projects. you know where somebody could say, i want to build i mansion and i don't care. they exactly to us. and -- so -- those are coming but ones we think these we are okay with. or you can go pass go without coming we want to see you. and the, folk catharsis applicants we may look less on for various reasons they have to come here first. >> i nap to be clear. in public. at the same time. this know that -- because and i do agree in terms of the you
8:50 pm
know in terms of the on the spirit of had the inter~im control mean and for us in the commission support planning department we need have objective standards. someone come in the cua when we are 21 also gives direction and clarity for the commissioner and to see project in a more objective manner. so in this waive, i see now you know what -- clearly in terms of and as mow in terms of you know -- upon the issue with the c you a is also the tenant history. how dot commission vote when well ask a tenant history. i know there are still laws that perhaps that is why the city attorney is looking into. and yea, i mean planning commission is not rent board but affects how things are built or
8:51 pm
rehabbed or expanded. so, because -- thank you for the intrangz i will support all the recommendations of the planning and the additional one by supervisor supervisor peskin. >> thank you. commissioner diamond. >> if there are no other comments i move to approve the ordinance. as modified by staff recommendations and supervisor supervisor peskin's modification we heard. >> i want to call on director hill us. joof supervisor peskin and the hearingos melgar's legislation 317 in cases in our districts 2 issues came up. supervisor peskin wanted to make sure you talked about them or considered them in case they mum. one was, limiting the use of
8:52 pm
short term rentals for new construction. in those case under supervisor melgar's legislation they are getting a density increase. also, applying conscience where rent control would be applicable to those units. that are bonus units. i'm not sure that is applicable. to this i wanted to bring it up. for to you discuss it may come up. i want to make sure i repeat this to heard the right, first, procedurally in order for the legislation to not come back we want to discuss and known they could be discussed and possibly added at the board level and those 2 itemers elementing the use of these resulting units to short term uses or ilo use and perhaps prohibiting it.

and then the second limitation can you repeat that part. >> melgar, if you are going from rh1 in the program and correct mow if i'm wrong. if you add 3 additional units they would be subject to rent control. i wanted three it out this it is a discussion this is helping that may not be applicable. to this. >> i guess to say my thoughts on that. in order to like be supportive of that concept you want to know more. i think in the programs we have seen it valley a bonus program we are trying to say, if you want to take this path you got the code compliant path and you
8:54 pm
want the other path here is the option and the trade off. in this case, if a base density we are trying to get people to meet we like to do what you are allowed do under zoning. it is hard to add different restrictions there in terms of other side you know kinds of is that rent control units new start out as the current market rate. making projects feasible they put in pro forma the rate. allowable rent increases allowed in the ordinance and so they can i would will presume make it work at the current market rate if not why would you builted project? that is on both sides reluctant if we get.
8:55 pm
commissioner. i was saying i'm taking comments and i want to thank staff for providing the case stsd how this legislation or how the interism legislation applied projects i appreciate having the examples. the items to clarify. the -- rent control question. projects take advantage of this, ordinance that is apply to recommendations for the incentive program? [inaudible]. >> i don't continuing is applicable. i want to make sure this came up at the boards. of of the buoy will agree with the president tanner probably
8:56 pm
not applicable to this ordinance. because we are not adding additional density. the city attorney can weigh in there. i think president tanner is right. that -- it is -- like low not applicable to this. we are not providing any density bonus of the >> right. >> i want to echo that. i don't think it is applicable in this situation to this program. and as far as limiting the use of allowing short term rentals. and the units constructed under incentive program. i'm -- okay with this being a restriction. i agree with that. we do similarity state does it for adu's and other thing fist it can be applied i would be okay with this. >> thoughts issue commissioner. commissioner imperial? >> i'm lost with the ilo in rent
8:57 pm
control is that or ilo in new construction. that would being, yea. i'm fine with in terms of ilo's within the new constructions. i think the thing is rent controlled it is still relatively affordable i'm in the saying but -- i would say you know it it is not on the market value. you would say that because i was looking forward to the density. yea. there are rent controlled units not 3,000. there are less that are less than half of it. and i'm not saying these are not affordable but -- what i'm saying that i money that's why well is that conversation or the push to preserve the rent controlled buildings. this is the affordable market
8:58 pm
that the public can have. the reason control buildings. new construction are not you have been affordable as all. so -- give in the construction and everything. this is my thought on this. makes sense. we are preserving buildings 2 or more rent control units may be it is. i understand. >> i was going to chime in on the ilo issue when it miss to it ordinance is reminder prohibited from doing them in 1-3 unit buildings. good chunk of this ordinance is for mull are scale. in buildings with 4-9 you do 25% of the units ilo and you cannot do an ilo on a unit subject to price control. where that 96 us could happen. irrelevant the ilo's focused more in the 10 plus units you need a cu for ilo in this bucket they would come to us.
8:59 pm
out line the program p.m. where they would apply. thank you. commissioner ruiz. could the city attorney spoke to rents control applicable? . she should unmute herself. can you rephrase the question . i heard the last half. rent control what saturday whole question? >> we were talking about the idea of ilo's in rent control being applicable to this legislation. that this is something potential low come up at the board of supervisors and we wanted get the city attorney's opinion. whether rent control imposed to new construction? >> yes. >> you know my colleague audrey
9:00 pm
has been i'm not sure that is a question he is looking at it is in the one i have been asked i'm not able to ascii answer it here. >> thank you. >> if you are there, you know supervisor melgar's ordinance we are allowing additional units there was discussion in her ordinance. that the additional units on the existing density subject to rent control. through a. agreement n. this case we are not allowing for additional use. >> right. the upon general rowel is have you to meet the type requirements. [inaudible] offering a counter beens benefit financial or other benefit in order to apply rent control to a new unit. i think my colleague is look at this question among others and i'm not able to give you off the cuff answer today. >> okay.
9:01 pm
>> i would men add before i call commissioner diamond if the board is interested in obtaining more reason controlled unit fist than i are expensive to star they have the process sxroel increase moderation for residents going forward would be if there is a further bonus to add to this this . is like, in the program tom mote and build when you are allow exclude if there was a bonus whether a % or number or other additional square footage or whatever it is that knowledged this be another part of the program. commissioner diamond. seems like ilo is unlikely it it is not worth a lot of conversation at the commission now. but on the rent control subject i believe the goal of the
9:02 pm
ordinance is to incentivize people to produce the how doing we want general increase in density in districts that already allow it is i would be opposed putting hurdles. whether or not it affects the process or not tell be per received a regulation requirement and we should not do that. one thing i i would in the consider i don't remember recommendation 4. and removing dr and make the process faster i don't consider that a bonus which we should penalize people adding rent control on top of it. and second low. not now this we are talking about other stuff raises the question a possibility this state density bonus legislation
9:03 pm
9:04 pm
state density bonus could apply already they are eligible. they can do it. and so far could it layer with this. use it and state density. right? >> yes. >> i think is. i was trying to understands when you do the 75% test, what the denominator is? when is permitted under the ordinance or what is permitted under the ordinance as could be increased by state density bonus. iot ordinance. >> just the number under the ordinance. >> correct >> without take nothing accounts potential increases with state density. >> no. >> thank you. >> all right. i don't see commissioner lightos we have a motion. >> there is a motion that seconded to approve this amendment with modifications presented by staff and supervisor peskin on this motion commissioner braun >> aye yoochl ruiz. why aye >> diamond. >> aye >> imperial. >> aye. >> koppel. >> aye >> and president tanner. why aye.

i appreciate the capacity building we are doing so folks know here are things you could do and other districts w have done and i think i come become the design, i'm impressed a few months ago a diagonaled 'll building the way it was shaped was dynamic and the district which out and support it. unbalance level you know and so to me its a successful store and he hudo we are more. versus my fwosh this is happening and like, you know 13th hour and trying to figure it out. i want to considering projects take 2-3 years [inaudible]. i want to make sure folks know the options and what we can put resources? create design standards does not happen over night. shudder to think a board of volunteers is taskeded with this

bruno is correct this he has had meetings with neighbors. but the upon owner of the llc not revealed himself and unable to establish communication. i think it is unfortunate. relate to a trait system allows me i will explain it. there is currently a low wall between my property and the redevelopment it is 6 feet in height subject to an agreement in the public records for the repair and maintenance of the wall. in the redevelopment, this low wall is exterior wall on the western side of the dwelling. and that wall be got height of 30 feet. that means the current wall needs to be demo new foundation and new wall of 30 feet
