12:05 pm
a suspension for compliant stratos night club and -- although we can't speak of anybody substantive at this time i want to note that the hearing is currently scheduled for the next commission meeting which is august 1 and per that notice of the hearing we all received so if you have questions prior to the hearing please be advised you should communicate those directly with president bleiman and the commission secretary as you have your city attorney assigned to support you which is separate from director way land and my counsel. thank you. let me know if you have any questions. >> any questions for the acting director? all right is is there public comment on the acting director's report? >> no public comment for this item.
12:06 pm
>> okay. we will close public comment public comment and move to number five which is the report from the senior inspector in the field. >> good evening commissioners. we received 157 complaint since the last meeting a month ago. updates below and first update is for stratos night club at on ocean avenue. they hold the poe permit with our office. due to the violent event on june 10 the inspector dropped off a 72 hour public safety suspension on june 30. the suspension was in effect from 9:00 p.m. on june 30 through on monday july 3. on saturday july 1 the inspectors on staff conducted a compliance check. during the inspection they found multiple violations of the
12:07 pm
approve the security plan conditions. violations were as followed. not all security guards were wearing identifiable clothing. there was no female guard on site and female were not patted down and the metal wand wasn't on use and only three security guards had state issued guard cards. the inspector spoke with the manager about the reason for the visit and acquired about the violations. the manager confronted the security guards and not use the metal detector wand and explained there was a battery issue. they got to work and use it going forward. when asked about the lack of a female guard he asked one from the security company but she didn't show up. all of the female patrons were not patted down. the inspector reiterated that these were all requirements of the their security plan to
12:08 pm
which management stated he understood. stratos night club was issued a citation for the plan conditions on friday july 7. staff continue to visit them every weekend for checks and july 8 and july 15 they were in full compliance. my could update is about trinity irish bar and restaurant on union street. they're in the application process for an llp permit and had the intake meeting with the deputy director on thursday july 6. on friday july 7 i dropped off their yellow poster noticing the public of the applications and the bartender explained they could now host djs and the jello poster is not a permit but a notice to the public of the application and the bartender seemed to know this but nevertheless there was a dj that night.
12:09 pm
the inspector responded to a complaint at 9:00 p.m. and she deserved a dj performing in the back room and the manager stated he was told by the owner they were allowed to have a dj and that jello sign in front of the window was to extend the entertainment permit hours to 2:00 a.m.. the manager was apologetic and admitted there was a dj the night before as well. the manager had the dj stop while the inspector was on site. we received another sound complaint at 10:15 p.m. on july 8 and the inspector returned at 11:30 p.m. although there was no dj the indoor prerecorded music was louder than when the dj was performing. they were issued a tiation on july 11. the deputy director has been in touch with the permit applicant
12:10 pm
who is explained there was i a miscommunication and this won't happen again. the next update is savoy tip oldy and on grant avenue. on july 8 at 9:13 p.m. we received a 311 complaint that the inspector responded to at 10:15 p.m. and observed a lithe jazz band performing and the sound measurement showed that volume of the band to be 7dba and 6d bc over the approved limit and reported that security guard were measured the sound from outside of the front entrance however the approved monitoring location is just inside the front door to the left. it's worth noting that they have a unique layout and essentially open air at the front of the business so when i tested the sound limit with the sound curtains closed to avoid sound waves. when the inspector responded to the complaint the curtains
12:11 pm
were not in use during entertainment. the deputy director noticed a violation for operating above the sound limit and reminded management it's imperative to use the curtains during entertainment and monitored from the designated spot check location so readings from consistent with ours. the next update is the brickon on union street and holds an llp with our office. on july 14 we received a complaint stating excess itch notice at 11:30 p.m.. the inspector responded to the complaint at 11:05 p.m. and upon approval observed a dj performing and the sound level it is were compliant and the performer stated he will be performing until 2:00 a.m.. management told the inspector they had a one time permit for the event and allowed to operate
12:12 pm
entertainment until 1:45 p.m. although they didn't have a one time permit with the office so they were issued a citation for this violation. she will provide more in her report. lastly i would like to hold the page with jam and our office. we received complaint and responded regularly. the inspector has been in communication with the complainants and how the neighborhood has changed. often times the staff come in during the week whether we don't have staff but when the 2347ors respond and there is estimate they are compliant with the conditions. we will continue to visit the business as complaints are lodge said and that is all. >> all right. thank you. questions? .
12:13 pm
>> i notice there's a notice in the enforcement report about the nd playing music. is that new from the last meeting? >> it's not new. >> okay. >> it's not it's old it's the repeat visit so the way the timing cult off from the report -- >> got it >> action is the same as what you read last time. >> got it. thank you. >> i have a question. how many total complaints did you get from the grateful dead or the dead concert? how does is that compare with lady gaga. >> we got 18? >> about 20, yeah. >> it was less than 20 i know for sure. interestingly only eight came in at real time and
12:14 pm
didn't get the rest but over the course of the three days it was minimal in compare sudden to another large act that occurred there. >> like beyonce. >> yes which i used as an example. >> yes, i think we all do and entertainment commission then or lived in san francisco then. >> any from admeada. >> no. >> all right. i have no further questions. anyone? >> no thank you. >> all right. is there any public comment on the senior inspector's report? >> no public comment for this item. >> all right. we will lose this one and move on. the next agenda item is number six which is from a report from senior analyst rice.
12:15 pm
>> great. and if we could have the screen for the laptop? there we go. all right want good evening. dylan rice here from the entertainment commission. in this presentation i'm going to update you on the ec's campaign to prevent overdose prevention in the entertainment and nightlife community. let's go over the background and the need n san francisco and cities across the nation fentanyl has become the accidental driving of overdoses. this year 79% of axal overdoses were from fentanyl from the medical examiner report in june. it's a synthetic opioid that 50 times more potent than
12:16 pm
heroin and 100 more opponent than morphine and a small amount can be fatal and using it to get high and traces have been found in cocaine. people maybe unaware there is fentanyl in it but we want people prepared no matter what. the crisis intersect and impacts the world of our constituents. street drugs laced with feted nal are show up in entertainment spaces. we have the platform and duty how to protect the industry and its patrons by overdose prevention strategies. thanks to the vision and work of commissioner thomas and the city is working with the the city's goals and advocacy so we're committing to respond
12:17 pm
to the crisis and raise awareness and promote the life saving intervention and increasing access to narcan and fentanyl test strips and training and education. so what are the goals of the campaign? well through targeted outreach the campaign aims to raise awareness in the industry on the crisis and how it could access the tools and resources to increase the industry's access to like i said narcan and feted nal test strips and education so our workers are empowered to take action. narcan nasal spray is a life saving tool that reverses the overdose while most first responders carry narcan they might not arrive in time to reverse the opioid overdose and anyone can carry it and can give it to someone having an supervisor dorsey and potentially save a life and
12:18 pm
to the primary goal which is to ultimately save lives. . >> . >> here's an overview of the activities to date. we have done the outreach with dph online and in person trainings, sharing resources and increasing access to splay supplies so the next slides will go over the activities in detail. so at our summit in june we debut the overdose prevention campaign training video that we developed with dph and sfgtv. to give had a nightlife behavior we have drag green and reductionist to star in the video and lead the trainings and has been done trainings in the community and
12:19 pm
nightlife spaces to great acclaim so this video is a step by step of recognizing the signs of an supervisor -- over dos and how to use the narcan and where they can find resources. we're asking stakeholders and outreach to share the video with staff, with their patrons and anyone in the community. i'm going to play a few minutes of the video so you can see her in action. . >> how to recognize the signs of an over dose? won't responding and won't wake up student: sharo or not breathing, blue or grey skin, lips or fingernails. next i'm going to show you ho how to reverse
12:20 pm
an overdose with narcan. if you don't have it call 911 immediately or have a friend call for you. gift dispatcher your location and someone is not responding or breathing. the first thing you want to do is provide verbal stimulation. try to wake the person up. hello. ahh! ahh! if that doesn't work provide physical stimulation. rub your bunkels up and down on the chest to simulate pain. i promise this really hurts. if they still don't wake up it's time to administer narcan. you want to remove the narcan from its packaging. insert the nosal into the most trail and press it firmly. you
12:21 pm
may administer the second dose after two minutes. if somebody has not yet called 911 do so now. give the dispatcher your location and tell them someone is not responding or breathing. now i will show you how to give them life baby or rescue breathing. you want to pinch the nose and tilt the head back and two breaths to start and then one breath every five seconds. one, two, three, four, five. if you've ever made out at a stranger with a bar you can do this. . >> thank you. ms. rude. so there's a lot more to see. there's a whole eight minutes of great
12:22 pm
training including feted nal test springs so to coincide with the video we created a resource page on our ec website with resources geared towards the industry. you will see the url right there. so here are some screen shots on the one page. we host the training video. we have a step by step graphic. there's also one from dph in front of you right now which is their palm cart on the steps where to find narcan and supplies and links to other resources and service organizations. so to help deepen touted sheath at a grass roots level we have tarted piloting in person trainings and distribution of supplies with ms. rude and in partnership with dph. special thanks to commissioner thomas and toretory for your support in making this
12:23 pm
happen. we kicked off with a event with the lgbtq cultural district and the aids foundation and had 15-20 attendees, just the beginning; right? so next up in august i'm exciting we're planning with her at many drag events and dance parties. she will host them and one at oasis in august for the princess show case and one at del rio and august 20 and i let you know the confirmed dates and doing the training and distributing narcan and test strips and educational materials. these upcoming vent i am excited about and well attended and we will reach at least 500 people. so this is one of my favorite slides . this is impacts on the campaign to date. so i'm excited to report we
12:24 pm
had substantial engagement since the campaign launched in june so by far the highest impact is the training video thanks to our friend's huge following on instagram and tiktok and total combined total of 109,000 views and likes across all platforms and already we're seeing the permit holders hearing about the campaign and reaching out to dph to their office of over dose prevention for in person trainings with staff. irene from the office confirmed she's had trained aces and the hara bar and with bum lows, shanghai kellies and four of nate valentine bars. looking ahead we want to continue this momentum and towards the goals of access and em powersf power --
12:25 pm
empowerment and save lives. we will assess everything and the impacts and expand to more venues and neighborhoods and communities. we will support dph and the ongoing efforts to increase awareness and access and ensure that our industry remains connected and resourced as a part of these efforts and finally as our commission continues to deliberate on this we can explore making policies that would advance over dose prevention goals. for instance could our department require all permit holders to have narcan on site with trained staff as part of the permit conditions? how could we realize this vision of narcan behind every bar which is a vision that commissioner thomas articulated early on and the fda
12:26 pm
approved the nasal splay over the counter but we're waiting to hear about the timeline for implementation and what cost will be for the consumer from both the fda and the drug maker so we will wait and see how that pans out. so that what happens up the presentation. let me know if you have any questions and thank you so much for your time. >> i just wanted to say a huge thanks to dylan and all the rest of the entertainment commission staff for taking this and running with it and also the cross departmental work with the department of public health and it's been really great to be able to you know take the work they do into new and more exciting venues, so i'm excited that we have been able to do it, and you there are a lot of people to
12:27 pm
thank for the video including sfgtv, eileen of course for starring in the video too, so yeah i just want to say thank you and i am excited, and still trying to work to see if we can get more fentanyl test spring supplies for bars and venues in san francisco. i know that's something that people are interested in having them on hand to distributed so that's our next goal. >> thank you. >> i want to echo the words of commissioner thomas. kudos to you and everybody who worked on this campaign and i think this is the first time that ec has been involved in a trending campaign on social media, so let's all feel that, except for my colleagues over here who is i tiktok star, but at the end of the day i really do think this
12:28 pm
is a great project and i hope that we continue to leverage the creativity and also the platform so we can reach larger audiences so congratulations. >> thank you >> and i do want just to say there's folks all over the country working on this similarly. there's musicians against over dose group and there's people who have been doing trainings particularly at large music fest vales around the country so we're not only the ones doing this. new york had narcan behind the bar before we did so we're steps up and splaying our own leadership role and people in the music industry that are concerned about this. >> i to also echo gratitude to dial an and the entertainment commission staff and commissioner thomas for having lead the way on this for so
12:29 pm
long. we really are -- it's just amazing. it feels -- it's just feels great frankly ton that we're actually helping to save lives so thank you. >> yeah. i will make my comments brief but commissioner thomas i think it's amazing that you spearheaded this with our staff and i love each commissioner comes with certain things that they're passionate about outside the specifics of entertainment and leverage that and cultural districts is near and dear to your heart and dory is thinking about communicating more effective way and s yn is working on land use and planning and it's amazing that we do the work during the commission and utilize this team and our
12:30 pm
greater reach. i also want to point out that 100,000 views from cochinna and five for us is the ratio. i think it's a great model, right, rather than asking a city department somehow to go vilal and we partner with people that have that ability themselves. >> yeah, great point. >> all right. is there any public comment on this agenda item? . >> yes there's one online. one second >> an online comment. . >> barry can you unmute yourself? .
12:31 pm
>> mr. toronto can you unmute yourself? . >> okay. so barry i'm sorry but it seems like we can't hear you. we have allowed you to talk but you have to unmute yourself so if you like you can write something in the chat and then we can move forward. and
12:32 pm
then once we receive your comments in the chat we can read it out loud for the record. >> [off mic]. >> so you're allowed to publically comment so that would mean stepping forward and provide comments but it's not a q and a so you can say what is on your mind but there will be no response from the commission. >> [off mic]. >> yeah, you can make a public comment. >> [off mic]. >> no worries, yeah >> and thank you so much. i just curious questions. maybe you answered. you have been doing this for quite a while. what is the name of the drug sorry in. >> narcan. >> how many narcans are required at every event? but if you have one event and run out of narcan what does the
12:33 pm
event manager do then, the number? so that's just the thought process. and whether or not it is the cost of narcan? i know you're saying it's over the counter and i would love to understand the cost of it, and is there -- if the venue owner or organizer runs out of narcan is there any rap ifs for them that you ran out narcan and you didn't have another? is there any liability is all i'm asking? >> thank you. and no, this is not a q and a. our staff can follow up and help you answer those questions. i saw somebody else with a speaker card. if you have a comment on this topic specifically? okay. did we get interesting from the health network. >> . >> internet. >> yeah, let's try barry again. >> my internet went down. i'm sorry.
12:34 pm
right when i am talking. anyway let me finish so we got the story i told but. i think it would be great to make it easier for drivers to get it. i know you can get it from glide but the hours are inconsistent and you have to find parking so it would be great if they provided some doses to the sfmta and give out to us. i am willing to show the video to the san francisco taxi alliance. i saw it twice already and loved it.id was at the entertain summit and saw it and important to make it available to taxi driver who is are outside of these venues and establishments who maybe able to save a life so let's see if we can work together and make it easier for cab drivers to narcan doses. thank you. >> thank you. .
12:35 pm
>> [off mic]. >> after you speak. >> [off mic]. >> all right. any further comments on this agenda item? . >> no more public comment for this item. >> all right. then we can close this and move on to number seven which is hearing and possible action regarding applications for permit under the jurisdiction of the entertainment commission and we're going to start with the consent agenda which commission secretary is going to introduce. >> yes thank you. so there's going to be two possible actions that we're going to take and i will make the report. take the action, take the report and make the action so we have three applications on the consent agenda tonight. two of which are for indoor llp permits and one for is one out door permit with extended
12:36 pm
duration. to note sfpd didn't have any recommended conditions to add to them. okay. first we did learn yesterday that the kick back who is on the consent tonight did not complaint the outreach for the hearing. we would like to continue the hearing until the next time and ensure that the outreach is done correctly. >> all right. so we will begin with that. do we have a motion? >> so moved. >> second. >> all right. is there any public comment on the kick backs specifically and our idea of moving them to a future hearing? >> no comments for this item. >> all right. we will close public comment on that and we can vote. >> president bleiman. >> aye. >> vice president caminong. >> aye. >> commissioner thomas. >> aye. >> commissioner torres. >> aye >> and commissioner wang. >> aye. >> okay. so we will be moving that item to the next
12:37 pm
meeting. okay. so we also received some updates recently regarding the one time outdoor permit with extended duration so that one is for the community youth center of sfdba rose park upper plaza so yesterday an adjustment was made by the applicant for the station upper plaza activation to change the start time on sundays from 11:00 a.m. to 1:00 p.m. following from the church in chinatown to not have activities during the service. the change is reflected in the staff recommendations below. i also received a letter from residents at 940 washington street regarding concerns about noise that may arise and is in the folders. in the letter they stated they are not against the event yet do not support it due to grave concerns over the noise. the letter
12:38 pm
was signed by 12 residents total. i spoke with the complainant about the concerns and the resources regarding the noise and spoke with the applicant about the complaint and should respond quickly if they get requests to turn down the music and the out reach letter wasn't translated to chinese and decreased access to the information and an over sight we hope to remedy as an office and we believe it was sufficient for neighbors to reply with the concerns and from the church and the complainant and i recommend that we continue the item to the commission if you want to go to regular agenda and otherwise staff is recommending that you approve the consent agenda items a and c with the conditions below. >> all right. so
12:39 pm
there's two different motions that somebody could do here. one is approve the consent agenda with the staff recommendations. the other is pull off that one and pull it on the regular agenda. i will open to my fellow commissioners here to see who wants to start. >> i move saturday as written. consent calendar as written. >> second. >> with staff recommendations. >> with staff recommendations. >> i am okay with that personally. is there any public comment on the consent agenda as it is. >> there's one comment online. just one moment. . >> please unmute yourself. you have three minutes. >> hello. can you hear me? >> yes. >> great. i am vince
12:40 pm
i and live near the station and live at home and [inaudible] it's a school day so just wanted to leave a comment there that yeah the extended amplified sound on fridays will be a kind of distraction for not only the school across the street and me when i work from home and i appreciate it wasn't loud during that time. yeah. yeah, that's it for me. thank you so much. >> thank you. . >> is there anymore public comment? >> that's it for public comment on that item. >> okay. any comments from commissioners before we proceed with voting? . >> okay. >> all right.
12:41 pm
>> great. president bleiman. >> aye. >> vice president caminong. >> aye. >> commissioner thomas. >> aye. >> commissioner torres. >> aye >> and commissioner wang. >> aye. >> all right. the consent agenda has been approved. and now we will move on to the first of five permit applications we have the regular agenda. >> thanks president breed. the first permit this regular. >> . >> president president is for the foundry on folsom street and e event space that holds a llp from the office and applying for a poe permit and legislation that extend entertainment controls in soma and exciting for the permit. the foundry hosts private events and live specific, djs and comedy and drag shows and karaoke and will have
12:42 pm
the same entertainment but end time of 2:00 a.m.. they sunday letters to the commercial and neighbors and received one letter of support and in the file. there is no opposition for the permit and san francisco police department southern station approved the with the calendaring condition. here is the owner alan aronoff to speak to you this evening. >> hi. i'm not used to public speaking. i'm the owner of the folsom street foundry. thank you for having me. i am the owner but i like to consider myself as a caretaker for this venue. i consider san francisco having the vibrant nightlife incredibly important and providing a safe and respectful public and private venue serves the wonderful and diverse communities and that exist in the city is something that's very dear to my
12:43 pm
heart. i have a passion for the performing arts. i started as a busboy at the folsom club and a bar back and music producer and djs and in bands. i have been a visual and digital artist in the city that helps produce online live streams for many events and it's been a real passion of mine to be involved in the performing arts and i really do want to thank this commission especially for helping promote the expansion of the place of entertainment zoning in west soma. it's been incredible acts of support and here's some pictures of the venue. this is the
12:44 pm
foundry. so and i just again want to thank for the advocacy of the commission to help promote nightlife in san francisco. we have done out reach as she mentioned and we believe we have the support of our neighbors both residential and commercial and just want to continue to provide a venue for public and private events and be a part of nightlife in the city and thank you so much for your time. thank you. >> you can stay up there in case there are any questions for you. i'm not sure there are. . >> i just had a couple. one was since you are going to be
12:45 pm
all ages venue, correct? >> it is. we have 47 -- actually we had everything from the blue bear school of music have the show cases there, high school prom events. of course no alcohol for under 21 events but it's we enjoy being able to have that type of venue to be accessible to clients who are under 21 like school proms. we had the soda high school prom for the school of the performing art and flu bear school of music and show cases there so it's a combination of over 21 and under 21. >> yeah. i appreciate that because there are very limited venues that are all ages and that's an important component. i want to make sure for your staff that you know that the security because i know there's no formal security plan but that the staff and --
12:46 pm
there is? okay. >> there's a formal security plan. it's part of the application and the last section before the legal attestations. >> we take that incredibly seriously. we have wrist bands and security and chaperones. >> lead certified guard card. >> yes of course everyone is all of the security. >> i only ask because i proud up in a hearing there are more challenges right now and the alcohol beverage control narrowed the for identification and this is challenging i know for myself and other folks that work in this industry so i know this would be another layer to this so i am glad to hear that. the other part that i was going to ask have you engaged with some of the latinos and other lgbtqal and other cultural
12:47 pm
districts? >> we are close with them and do the anniversary events at our ventue. i have not engaged with the filipino organization but i know they're involved in that area and i am happy to have any kind of interaction with them on any use for the space or concerns or help we can give. i mean we had a town hall events for district six at the space last year, and i love being a resource for the area for district six and the community at large, so i'm here to help and to provide my resources venue. >> sounds good and if staff would be willing to help him connect with me i can connect him with them as well. >> thank you.
12:48 pm
>> any further questions? all right. you can have a seat. thank you very much. >> thank you. >> i move approval with staff recommendations. >> i second. >> all right. is there any public comment on this agenda item? >> no public comment for this item. >> close public comment. [gavel] >> and we can vote. >> president bleiman. >> aye. >> vice president caminong. >> aye. >> commissioner torres. >> aye. >> commissioner thomas. >> aye >> and commissioner wang. >> aye. >> [off mic]. >> [laughter] >> all right congratulations you have been approved. just follow up with our staff at yourestiest convenes. thank you. moving along. >> great the next permit is outdoor llp for the east cut landry partners at 250 main street. it was a bus terminal and converted to outdoor area and soccer and movie theater and a gym and hosts
12:49 pm
community events and had a jam permit since november 2021. they're on the regular agenda tonight because they're seeking to increase the allowable hours of music and amplified sound between 9:00 a.m. and 9:00 p.m.. the outdoor amplified sound and entertainment wouldn't occur simultaneously and not extend four hours a day and to use the amplified sound vorring events which may fall between those hours. this conditioning would allow to continue the current conditions and llp if approved. the applicants sent a letter out to the surrounding neighbors and received a letter of support from the hoa president of the lumena building across the street from the crossing as well as 22 signatures from residential neighbors. all of this out reach is in the file tonight and no opposition for the permit
12:50 pm
so out of the calendaring condition. here tonight is their operations manager. >> thank you very much. i'm going just going to put in a -- [off mic]. >> okay. >> all right. thank you very much. so i'm the operations manager at the cut cut. we recently took over the crossing at east cut and the old greyhound terminal and eventually developed into housing and a public park in the middle, 1 acre park but until then we're activating the space for the community trying to revitalize downtown so i will give you some information. so this is the crossing so

outdoor cinema, soccer field, pickleball court and food area and we're trying to ramp up the space in the summer. on the south side is residential towers. on the north side is commercial buildings so our music, our amplified sound will be where this pink bubble is. there will be music. there will be just ambient music, live bands, things like that. there's a picture here. the speakers will be facing north so away from residential buildings and typically most of the music during the week is ambient music towards the bar. all right. and then here's some of the permit usage and photo right next to it so we are a hat -- halloween event and replanting event so they don't make a mess in the apartments and this is a space of public good and free programming community events and help sustain the space
12:52 pm
we do rent the pickleball courts and the beer garden for commercial use for businesss in the area or if there's a convention people can have parties or what not at the space so here's some photoses of things that we've done in the past. i will go clockwise and a farmers market so every thursday we have a farmers market going on. people can come. there's music. there's activities, retail vendors, farmers. the next photo we have part of the summer block party. this was a balloon toss and had a thousand people come and live music and balloon twisting and food and everything for the community. and last probably the most popular is the pickleball courts and very busy. we have some fans here that are here to kind of support the continued usage of this space and the pickleball courts. they're free open to the public whenever
12:53 pm
they want. gets really busy. sometimes the wait can be quite long. and then here going clockwise so we hosted the festival in the top left and then we have some live music and then last november-december we hosted world cup watch parties and do the women's world cup this friday and august 10 there is another and the quarter finals for the women's world cup and the bottom left we have the halloween event we do every year and open to the communities. we have about right now 35% affordable housing in the neighborhood that's coming. i will go back to so two of the residential towers are 100% affordable housing so we definitelier to those resident and free programs and face painting and bounce house and music and this was the out
12:54 pm
reach connected in your packet so about 47 building managers when represent most of the towers around the space and 130 commercial property managers as we are stewards from the neighborhood from second street to embarcadero and down mission street to harrison and 2900 newsletters to our subscribers. if anyone has any questions. >> thank you for your substantial outreach and all the great programming and work you do for the community. it seems like a great public good and i'm sure it's something that has a lot of support and appreciation from the community. i see here you have no opposition in the file so you definitely have my support. >> i just want to say that no matter what music you have outdoors if it's pan
12:55 pm
tera or 9-inch nails or mega death nothing will be louder than your pickleball courts. >> typically not during the day but the lunch hour and >> and drown out and pickleball is not the problem but drowned out by that. all right. no further questions so you can have a seat and we will start with motions and then the public. >> i move to approve the staff recommendations. >> second. >> all right. public comment on this agenda item. if you would like to speak you can step up. you can line up. you can make a mad russ for it. >> yeah, come on up. >> hello. my name is patrick kelly and i live on beale street which is the natalie [inaudible] commons complex and affordable housing building and this is my year anniversary living there and i love the east cut. it's a wonderful neighborhood and the big part is having
12:56 pm
the facilities right next door especially for me pickleball so it's easy go to and play and very fun and so the space has grown and actually our complex recently rented the space for the five year anniversary, so it's a space that is very popular and well used and since i do live directly across from the crossing i do hear the music and it doesn't bother me at all, and having it within a set out period of time is probably one of the biggest benefits. i used to live across the street from dolores park and had no personalities for music so there would be music all night long. >> . >> and i appreciate the music there and the timeframe for me seems reasonable and the way it's set up
12:57 pm
having the live music going north so it's going towards the non residential areas is a big help. that's right behind a big container and that's all i have to say. thank you. >> thank you. . >> again first timer. my name is mr. council and one of the resident and live. >> . >> across the area and a building called infinity so kitty-corner from the area, and mr. president and you're right pickle bale could be right but this area has become the heart of soma or heart of east cut at least. >> >> and we appreciate everything that the east cut team has done and i wanted to provide support
12:58 pm
that in the city that is very quiet during covid and nobody there we appreciate people coming in to a central location. they come not from our area but they come from everywhere in the peninsula not just to play pickleball. it's one of the blues or honey that brings everybody together but it's a blessing in a way because most of us have been sitting in the towers and waiting on meeting on zoom calls. it gives us the ability to get out and exercise a little. east cut team has done an excellent job of maintaining them and giving us an option frankly to get it going so i wanted to take a few minutes to say that this team is doing an excellent job. we hope this continues to grow. this becomes the heart of our community and we would love to continue to see the
12:59 pm
new park coming there as well as the other amenities that the community is providing so i'm here as a resident that lives across the street from there to support this permit so i just wanted to point that out. thank you so much for your time. >> thank you. any further comments on this agenda item? we have a few on zoom zoom. >> i'm going to bring in veronica. if you can hear me please unmute yourself and you have three minutes. >> can you hear me? >> yes. >> thank you. hello. thanks for the opportunity. my name is veronica. i am also a resident at the east cut crossing. i just wanted to echo the speakers' points about the wonderful work that the cbd team
1:00 pm
has done for the area. i mean other than just increasing traffic, commercial viability it really kept the homeless situation at bay which is appreciated you know by the residents 100% over so i just wanted to share that and i thank you for the opportunity and i definitely support this permit being passed. thank you. >> thank you. . >> all right. we have a caller. caller if you can hear this please unmute yourself and state your name and you have three minutes. >> hi. my name is katrina johnson and i live right in the area and a couple of blocks away from the crossing but i wanted to reiterate by support and echo the things that the
1:01 pm
other folks who have spoken before me have said. the crossing is basically the hub for the community. i of course living here since 2009 and we have been trying very, very hard to build a community and a neighborhood and a neighborhood identity and this is the place for it, so one saturday i went down there and found myself riding a horse and totally not on my bingo card that day but it's a place where everything is going on and the more we can bring into the community the better and i think this is really important to have more activities there, more gatherings and also it's an asset to the folks that come in to work on during the weekdays so i just want to
1:02 pm
reiterate my support. thank you. >> thank you. >> all right. >> no more public comment on this item. >> all right. we will close public comment [gavel] >> and the motions have been made. >> president bleiman. >> aye. >> vice mayor. >> aye. >> commissioner thomas. >> aye. >> commissioner torres. >> aye >> and commissioner wang. >> aye. >> all right. congratulations. it's been approved. please follow up with our staff at your earliest convenience. >> next item is for a amplified sound for bacchus bacchus wine and saki bar and a small business and occupancy of 12 people. they have a parklet but this is for fixed speakers at the front of the business and ambient music and attract customers and seeking
1:03 pm
to host amplified sound tuesday through sunday from 2:00 p.m. to 10:00 p.m. and out 26 letter and one to a near by building and the others went to the near by residential building. we received three inquires voicing concern but this is following bacchus one time block pride party and thought the permit for was entertainment and i put them this close directly conditions were approved and here to speak to you is the representative. >> i'm bringing him in right now. .
1:04 pm
>> hello. hello. >> we can see and hear you. can you hear us? >> yes, i can. >> hi. i am the manager of the back at bacchus. i have been in the industry for almost 20 years. i have been behind the wine bar for over 10. i started -- well, me and former business partner started this kind of venture, this long-term pop up as it were during the pandemic almost three years ago and since then we kind of become very much engrained in the neighborhood. we're a community space that is focus around wine. we're applying for the permit simply to continue playing music for our patrons. maybe you
1:05 pm
can see there's a speaker mounted on the inside of our our business. that windy slides open and a little parklet out on the street, and basically we just want to fun atmosphere for our patrons. i am respectful to the community. i did outreach as was said 26 letters in this building and one across the alley, and yeah i fielded emails from neighbors that i think were a little confused. we put up the yellow notice in the window for this hearing around the same time just before we had the pride block party so i think there was a little confusion and oh this is something more regular but yeah basically we just want to keep on doing
1:06 pm
as we were during the pandemic under the permit and provide music to our patrons. >> okay. thank you mr. freedom. commissioners do you have any questions for the applicant? . >> all right. no questions. i don't have any, so motions first and then we can listen to public comment. >> i will motion to approve with staff recommendations. >> second. >> all right. is there any public comment on this agenda item? . >> no public comment for this item. >> all right. we will close public comment and we can vote. >> president bleiman. >> aye. >> vice president caminong. >> aye. >> commissioner thomas. >> aye. >> commissioner torres. >> aye >> and commissioner wang.
1:07 pm
>> aye. >> all right. that one has been approved. moving on. >> the next permit on the regular agenda is for permit that includes outdoor entertainment and amplified sound at neon on 1974 union street and a co-working space and cafe that is a hub in the marina and applicant is applying to host indoor comedy and mic night and small band and out door music and comedy and open mic nights. they're requesting the ability to host the outdoor entertainment as cited and not exceed six hours total. the applicant did extensive outreach to letters to neighborhoods and 48 to residents and received letters of signed support from neighbors and the union street merchants and northern neighbors. there was no opposition for this
1:08 pm
permit and sfpd northern station didn't have any added recommendations. tonight here to speak to you tonight is the owner teddy kramer. >> good evening. i have a quick presentation i can fly through super quickly. okay. so quickly who i am. i'm teddy kramer owner the neon and one of the co-founders of north beach deliverers and during the pandemic supported businesses and chinatown and russian hill and delivered food for resident who is couldn't get out and generated a little over 250 grand in money for over 50 individual businesses across north beach chinatown and russian hill and the founder of the small business boogie and support small business for crawls throughout san francisco and partnered with the office of small business and

the chamber of commerce and i am the former local business chair the russian hill neighbors until i moved to the inner richmond and the board of next village and supports seniors across san francisco. i of course working on neon since 2018 and two weeks away from the lease in 2020 and budgeted a bullet and working on my dream ever since. i found this beautiful space in summer 2022 and got my keys on march 1 and open said june 1. we're a drop in work space. some people use the term coworking and we try to avoid that and no membership or commitment. people get to work in the space for $5 an hour or $20 a day and the community space and we give it away from free for non-profits and local
1:10 pm
community groups and people want to hire for private events and do that as well and support retailers and sell works on the walls and take zero commission as well. our application for the permit we're doing live music and not much more than a trio and we're small and want djs for private events and our own events and do live comedy and had interest because there isn't none in the area and trivia and during the pandemic and i became a host and do neighbor nights and opportunity to work with non-profit and young groups to recruit young people. you know the area have a lot of young folks and part of the city and active but don't know about the amazing groups in the city habitat for humanity and other groups and we
1:11 pm
blanketed the block for outreach. we dropped over 66 individual letters to residences and the businesses in our block and across the street and received overwhelming support. 65 letters of support as well as from the merchants neighbors as well as perries and while they didn't provide formal letters of support we are essentially on the block with three bars and the bus stop and the blue light and the union street ale house and used to be bar none. with that said i will be quiet and take questions. >> questions? >> thank you for the very well thorough community outreach and coverage and letters and well done. >> thank you. >> i don't have any
1:12 pm
questions but i have known teddy for a while now and i know how hard you have worked on the space and i have yet to go in there i know. i am working on it and excited for you and we will see how this goes and personally i think adding entertainment to it will enhance the community space and i know you're committed to that so it's really cool. >> thanks. >> all right. you can have a seat and we will start with motions. >> i would like to make a motion to approve with staff recommendations. >> seconded. >> all right. is there any public comment on this item? >> no public comment on this item. >> all right. we will close public comment. [gavel] >> we can vote. >> president bleiman. >> aye. >> vice president caminong. >> aye. >> commissioner thomas. >> aye. >> commissioner torres. >> aye >> and commissioner wang. >> aye. >> all right. it has been approved. just follow up with our staff at your earliest convenience. >> okay, the final permit on the regular agenda is llp
1:13 pm
for indoor entertainment and amplified sound at the front of business for mikroblack on 2323 market street. they requested a continuance of the application until the next hearing on august 1, 2023. the applicant is making the request to conduct more thorough neighborhood outreach. i would like to recommend the continuance of this application as i recently began receiving allegation that's landlord or building owner doesn't approve the permit or entertainment in this space and would love to continue the investigation prior to that. as you know they have to comthe meet the attestation to have the property's owners permit and they had
1:14 pm
approval and if you approve the continuance or ask questions. >> continuance seems like the right thing to do. >> yeah. i will motion to continue the item. >> second. >> until the next hearing. >> okay. >> all right. is there any public comment on the continuance specifically, the motion to continue? >> no. >> [off mic]. >> hello. i am jeffrey mark jenkins and a operateon and like to consider myself a ambassador for the space. it's also a social space and a realty community and artists and the community being built. i understand there are concerns from neighbors on the behavior and antithetical to the space and hosts a really fine and dress men's shop and
1:15 pm
from paris and expensive and can't have people out of control nor sound to have interchange of ideas and creativity and lots of cross pollination and creativity of artists who gather there to collaborate and inspire one either. i'm also the out going trierer of the castro club and soberrish community and glad to find a owner of or manager of the space and looking out for the best interest of the space. no one in my time there. i go about twice a week. consumes more than two beverages and if anyone is not able or willing to conduct themselves with a modicum of expression then they're asked to leave because there's also a dress and fine clothing selling business going on at the same time so
1:16 pm
having people not [inaudible] is really what we want to see happening there i find it a sanctuary and a lot of safety issues even in the castro and a victim near my building and on market and the safe space is very welcome in the current environment in which we live. thank you. >> thank you very much. . >> hello. i am with the sisters of preputial indulgence and i had on the pleasure of going to mikroblack several times and i found something unique new york there in san francisco and i met people that i never met and felt like friends i wasn't around with harvey milk and it's what existed that and community first that's what the owner is creating for us and i encourage
1:17 pm
to allow compromise and a allow this to foster and something special i haven't seen anywhere else in san francisco. thank you. >> thank you. >> the current motion is a continuance. >> i want to be clear and i know you traveled this way and obviously we more than welcome your comments here and they have requested is that we don't hear it and hear it at the next hearing and requested by the permit holder and absolutely speak about mikroblack in anyway you want. doesn't specifically to be on the continuance. i didn't mean to imply that question just want to reiterate that. >> so thank you. my name is co ymichael. these are light sensitivity and my vision. thank
1:18 pm
you. i'm sorry. i'm so sorry. should have had this up already. >> it's all right. we won't start the time until you start speaking. >> thank you. dear sirs and madam in these extremely challenging economic times for both san francisco as a whole and the castro community in particular i cannot stress enough the singular importance of mikroblack boutique and social blub to our multicultural community. mikroblack is an oasis of cultural and express for the lgbtq plus community and in deed all artists desperately in need of safe venues for expression. mikroblack represents
1:19 pm
economic prosperity and esthetic expression for our community and all the people of san francisco who long for a safe venue to create beautiful art and music. please allow us to continue our efforts to employ and entertain our city, our community and all who crave culture and acceptance. thank you. >> [off mic]. >> hello there my name is g uc h and a local lgbtq photographer in the city here. i work in nightlife and document
1:20 pm
social happenings within our queer community. i am reading this because i get nervous when i am talking because i'm a photographer so i'm here to express my heart felt support for mikroblack. i have experienced first hand the tremendous impact that this store and they have had on the community. mikroblack is a shining beacon of diversity and unclews sievity in the neighborhood and show cases talented artists and safe and supportive environment for everyone is truly commendable. in the store it cultivated a community where all individuals can come together and appreciate art. i want to express my gratitude that the store has shown me. it is given me the ability to show case
1:21 pm
some of my work and has meant the world to me. it's rare to find someone as jewels who understands the challenges faced by artists and typically those that identify as queer. her unwavering support and encouragement helped me and others to grow as an artist and individual and i am very grateful for that presence in my life. moreover i have been impressed with the atmosphere created by mikroblack. the way it's curatedded music making sure it doesn't over power the conversation and the love and enjoyment of the patrons and your neighbors. this attention to detail sets mikroblack apart from other establishments and creates the ambiance for appreciation and art in the community. i stand with mikroblack. thank you.
1:22 pm
>> thank you. . >> i realize this is just for the continuance but i will make it quick. my name is aaron and the general manager of chadwick and a small bake shop on the same block as mikroblack and we strongly support what they're doing over there. and i have heard the word oasis a few times and that was running through my head and for the short time they of there they're very active in the community. for example they're the venue for one of the merchant association mickers and it's just generally a very inviting place. i of course to their other events as well and it's not loud or robing u.s.. they're actually very
1:23 pm
mellow and respectful. in fact as far as noise there are several bars in the neighborhood from the street. >> . >> you can hear quite a bit. so i just wanted to give our support as a local business on the same block. there's still several store fronts on that block that are empty and mikroblack has been a really welcome place in the neighborhood. thank you. >> hello. my name is jerad webster. i am worked at
1:24 pm
mikroblack. i'm a gay male leather man drag queen in san francisco for about 26 years. i fit in a lot of different -- or i fit in a lot of different crowds but what goes with that don't really have one specific crowd, and i fit in here, so i would really like to stay so it's find a compromise and with all the store fronts closing it's good to see one open right now and i really think this could be a anchor store because we reach a lot of people. thank you. >> all right. anymore public
1:25 pm
comments? . >> no more public comments for this councilmember. >> all right. we will close public comment. [gavel] >> and we're talking about a continuance. we've already done the motions. >> okay. voting time. president bleiman. >> yes to continuing this. >> vice president caminong. >> aye. >> commissioner thomas. >> aye. >> commissioner torres. >> aye >> and commissioner wang. >> aye. >> all right. now we're done with the permitting portion of this exciting hearing. and we can move on to the next agenda item which is number eight i believe which discussion and possible action to amend the permit conditions of limited live performance live as cited
1:26 pm
dba brickon on union street. >> thank you president breed. this item was a jeopardized to bring the ownership before the commission to discuss violations of the business and received their permit in december 2021 and applied for the poe permit for the zoning controls this was the only option unless they went through the planning department process. since the permit was issued in 2021 and had three sound complaints and email complaints about the volume and operating after 11:00 p.m. and the cut off time of the permit and we visited business 12 times and violation of the permit during nine of the visits. of the nine violations observed seven were operating entertainment an 11. i think it's important to note operating after 11 for the most part this is
1:27 pm
from 1145 to 145 and well after the cut off time and six citations and five operating after that time. the business has paid for all of the citations. there were two occasions and dealt with a complaint and the dj was performing after 11 but the manager claimed they didn't know about the conditions and the inspectors educated the manager about the requirement and the good neighbor policy and always have someone on site that is aware of the conditions and the business is aware of the one time permits and --. in the case of the last two citations issued for operating after the hours the manager said they had one time event permits which they didn't. lastly municipal police code as cite the entertainment
1:28 pm
commission director or designee has the ability to suspend the permit up to 15 days if we observe three or more violations in this 90 day period and this was the third citation up to 15 days which i do plan to move forward w this is a discussion and possible action and which the commission has the ability to recondition the permit as you see fit. although we don't have specific staff recommendations for conditioning at this time we suggest to remind the owner of following the rules and adhering to the permit conditions namely ending entertainment at 11:00 p.m. so a copy is in the file tonight and here to speak to you is the owner and the general manager rachel. >> .
1:29 pm
>> high wasn't able to attend. this is andy wasserman. as far as our permit goes obviously we have been outside of compliance. i guess the biggest thing there is really no excuse for it. we just tried to find a new avenue of revenue for our business since covid, and it's kind of dependent on entertainment at different hours of the night that are outside the permit hours. unfortunately for some reason union street corridor zoning isn't permitted for full entertainment permits where you go around the corner
1:30 pm
mono lo a on that street and they are so we kind of found the decline of our restaurant business we've had the opportunity to have an incline of revenue through later night entertainment, and trying to be as much a part of the good neighbor policy we're often as well a scapegoat for a lot of the stuff that happens on union street, loitering, litter, things like that which we try very hard to keep our area, our area around our neighbors clean, and kind of like a lot of the other businesses we're just trying to find new innovative ways to
1:31 pm
keep business going. do you have anything? >> no. i mean we have been there for 15 years and we haven't really -- we were there probably a lot longer than most of the businesses in the neighborhood and certainly the neighbors so for us as rachel just said we're just trying to keep -- we're just trying basically to stay alive. it's a matter of survival for us to figure out a way to keep people from coming in and we have been trying to get permits daily permits you know music. we've always had music amplified there, so it's a challenging environment, but we do plan on -- >> we do have plans to kind of change our business model in the upcoming months. it would be include a closure of the business and
1:32 pm
almost rebranding the brickon to create something where we can drive revenue inside those hours and not be so dependent on the 11:00 p.m. to 2:00 a.m. hours. the marina district is a culture of late night drinking, young kids. they like to come in later. they do get loud. they get a little obnoxious outside. it's controlled as much as possible, but our plan is to refocus our business model and go to something where okay then yes we can totally operate within our permit in the dj and live music and maybe change our live music from djs to some other kind of live music, and then end at 11:00 p.m. and be able to continue business to 2:00 a.m.,
1:33 pm
so i guess asking for forgiveness on our permit right now and being able to possibly continue until we shut down or continue our permit permanently with the llp so that we can kind of rebrand, go back to the drawing board, get this kinds of straight, and figure out how we're able to really put a new foot forward to make business stay alive for ourselves. >> anybody want to start? all right. i do have some stuff. i know it's a challenging business environment right now. i'm going through it myself and my bars and the revenue
1:34 pm
is down 60, 70% and can't figure out where the people are. >> [off mic]. >> oh okay. >> thank you so much -- speak up a little bit. >> yes, i will do my best. sorry. so obviously the issue that we have is kind of a willful incompliance with the rules that we have to enforce by law; right? so the entertainment commission has two rules. one is promote nightlife that we try to do at every juncture and the other is at our core is regulate sound especially where neighbors and venues interface; right? and unfortunately you've had quite a few complaints from neighbors who are near by you and then that compels us to act and then we have to act; right? so we're kind of between a rock and a hard
1:35 pm
place and we want to promote nightlife and we have complaints and inspect and then if they're out of compliance we have to follow the rule we have based on police code so i want to be clear. >> can i make one comment on that though? >> yeah. >> as far as having being able to have your in house amplified sound -- >> yeah. >> which every time we've had a complaint i'm not -- >> no, i get it -- i totally understand. >> [inaudible]. >> we have to follow the police code and the code is clear on what is amplified sound and live entertainment and our job is live entertainment and the department has laws to follow that are specifically towards live entertainment and why you keep hearing from us for live entertainment and i totally understand what you -- when it's a choice between the
1:36 pm
business failing or breaking the rules that's a terrible choice to be in; right? and i am actually very compassionate for that. i am not allowed because i'm on the entertainment commission and i would be lying if this doesn't come up and in spaces and if it fails on its own and the choice is clear you have to break the rule in order to survive and i one would be compelled to do that. unfortunately it's gotten to a point now with this commission and like we're all over you and we keep getting complaints and out of compliance and when that happens i would argue that worst things will happen down the line and i want to bring up a couple of things that are important. one is i believe you can get a cu on union street so you can get a conditional use permit from the planning department that would allow to get a place of entertainment permit and we
1:37 pm
have entertained to this other ownerships and i know our staff has and what is stopping is that it's not forbidding but you need to take one additional step and i believe also and i can not say this with certainty but because you have your type of license you can qualify for a expedited permit from the planning doesn't and check on that and that might solve the problems that we're all having. it will take a few months and fill out a lot of forms and before the planning commission and do community outreach and bring people to speak on your behalf and it's annoying and had i to do it and then you come back and get a pilaffs entertainment permit from us and have life entertainment until 2:00 a.m. and when we show up and you have a dj we say they're acting in
1:38 pm
compliance. we checked everything so that's one option so it's not there are no roads available to you. the road to continue violate your llp i don't think that is going to continue to get worse and worse and worse. the consequences will get worse and worse and then that will make it very difficult for to you get a cu; right? it will make it difficult to sell the business. all sorts of things can happen with the track record and you riled up the neighbors so much and they want nothing in there and you can't sell the business and the neighbors "over my dead body. we're going to fight this" so that is important. i don't recommend this but there are things you can do with live entertainment that doesn't requirement a permit and one person with acoustic instrument and i am not recommending this and
1:39 pm
some converting to piano bar style and sing alongs and that is not permit by the entertainment commission -- >> until 10:00 p.m.. >> acoustic, the piano can't be plugged in. >> until 10:00 p.m.. >> okay. all right. and then the other thing they think you should consider as well is that there are -- there maybe if you're going to renovate and change things out maybe sound approaching augmentations you can work with the neighbors. i found sound proofing to be pretty effective on its own but i also found it a way to get to know my neighbors and show we have and my businesses have been putting investment and money and care into their peace and quiet and a lot of times through sound approaching projects i maybe haven't able to mitigated all the noise but i have been able to create a relationship where they know i'm an
1:40 pm
honest broker and actor to try and we end up having a situation where they just text me and say can you turn it down rather than calling flee 11 every time; right? so there's are things you want to consider. >> . >> i don't know you know -- i will let anybody else ask questions to you and we have a discussion and whether conditions are the right way. the only thing that is important to me that you understand our hands are tied. we're going to have to visit you by law and the violations are going to get worse and worse and worse and might have a very adverse effect on you down stream and that's been the law for over 20 years in san francisco now and we're the stewards of the law. usually it works. sometimes it's tricky and it sets up real kind of conflicts and things that have to happen so i want to get those
1:41 pm
points across if that makes sense. any other comments or questions from the commissioners? >> i want to say i am deeply troubled by the fact these violations of so -- they have been consistent. they have been over a long period of time and sounds like tonight they're intentional. they're willful. i'm sympathetic to the struggles of any small business especially as we get through the pandemic but there's having respect for the permit condition and entertainment commission staff and our inspectors and your interactions with them and being honest in those interactions so i would urge you to change course asap especially as there are alternate routes can you take as the president of our commission just outlined. it wasn't that you were hitting a brick wall. you

had further steps to take to get into compliance and still that business operation and you didn't take those steps so if you're planning to take them in the future and come back for an entertainment permit the conduct you're engaging right now is not helpful to our deliberations for that permit later. >> yeah, i mean she said as much. we're getting 311 calls complaining about you being open late so clearly you have neighbors who are paying attention and keeping an eye on what you are playing music or having entertainment after 11. sorry is it easier if i take my mask off? is it easier to see, hear me? you're welcome. clearly you have neighbors calling 311 to -- i mean that's how we know
1:43 pm
you're having entertainment after 11 so you have folks in the neighborhood already who are paying attention to it and know that you are outside -- they know what your permit restrictions are and they're calling 311 to complain so you already have folks in the neighborhood who are concerned about this, and i think both out of respect for the neighbors you know figure out if there's a better way to communicate with your neighbors, but mostly you know just as i know we're all saying about respecting the conditions, and respecting our entertainment commission staff you know like they know whether there's a one time permit or not, so trying to tell our staff there's a one time permit when there isn't is not going to get you anywhere with the entertainment commission in particular because we know whether or not if there are there and i
1:44 pm
appreciate your pulling one time permits. probably you should do that more frequently if you can and transfer you're permitted; right? but you know i think just to echo what cyn wang said in particular it's harder to come back from this if the permit is suspended and you know you're going to have to do more in that case to come back, so i'm not necessarily in support of reconditioning the permit now, but i'm interested in hearing what other -- >> yeah, let's figure out if we have anymore questions for the permit holder. >> thank you for coming in. i know it's uncomfortable but thank you for coming in and meeting with us. >> i just wanted to under line what has been shared with you in terms of reaching out to your neighbors. i
1:45 pm
really do appreciate how difficult things are. i work in the industry myself and like president bleiman i am also experiencing the same decline that you are and he is. one of the beautiful parts of this city is that it's this del cat ecosystem between residents and nightlife and commercial and in order for that to exist and coexist you have to not have us versus them mind set, and it's really -- and i think you know i don't want to take away from you know like you should respect our staff and we're only really here to help you, but there's also a component of this that you really have to think about like these neighbors are -- these are the folks that you have to
1:46 pm
live with moving forward and you need their buy n you need the community's buy in for you to be successful as well, so i understand where the motivation is come in in terms of the willful breaking -- but i -- it's not going to help you moving forward, not evening in regard to the permits. it's not going to help you with the community and i think that's important for you to acknowledge. >> more comments? landlord. can you have a seat and we will discuss this amongst ourselves. thank you. >> are we -- do you continue something on with telling us something or -- >> we're going to keep talking and whether or not we want to condition it or what the plan is here. if we have more questions we will summon you. so
1:47 pm
my thoughts are it did not seem like this permit holder was getting the memo from us about the kind of severity of the increasing and frequent like kind of flagrant violations. i'm not necessarily in support of any conditions. i'm not sure what conditions would even change things. what i -- what i wanted out of this was a chance to talk to them face-to-face and just try to get across that this is a serious issue for us and for them and it's going continue to be this serious if not more serious. i think we accomplished that but i do think it's kind of up to the permit holder going forward on whether or not that bears out to be true, but i'm not sure what conditions we could do right now considering that they're violating
1:48 pm
things after the timing so usually we change times. doesn't seem like that would affect anything at this point. anybody else have thoughts? >> and just for clarification kate lynn interim director acevedo will be proceeding with a 15 day suspension, correct? >> that is my plan, yeah. >> okay. okay. i wonder -- >> just entertainment. >> just entertainment. >> certainly, certainly. i wonder if we could revisit in a certain number of days to see if there of course any additional violations and if so look at allegesser suspension? >> i mean i think we will know if there are violations coming up soon, right, based on our inspectors' reports >> and just to be clear if there are additional violations after that we will look at suspending or at least i am
1:49 pm
personally interested in looking at suspending the permit at that point. >> all right. in that case i just want to say a couple of things so i actually know adam. i have known him for years and outside of my capacity as the president of the entertainment commission he can text me and i am happy to talk with him about what we've done in terms of not having any money in our businesses recently because you're not alone and the struggle -- it's not just it's less money. it's oh we don't know sometimes how we're going to make rent in situations like that that are a lot more dire and i am sympathetic to that. i'm not sympathetic to flagrantly ignoring the rules of this commission and i am happy to text
1:50 pm
with him and hard going out right now. i get that. it's hard out there is there any public comment on this item? . >> no public comment on this item. >> all right. i will think we will close public comment. i think we came to a consensus. there's no motions to make any changes so we can move along to the next agenda item. >> hi commissioners. this agenda item is regarding the llp permit for jones 620 jones street. jones is actually granted our first permit with indoor and out door entertainment in 2011 and had a fee from the planning department that restricting it to sends only. after the commission granted the permit in alignment with the planning motion the owner went back to the planning doesn't and have the hours and days expanded. it took some time and
1:51 pm
after it was completed the owner didn't get the llp aligned with that and brings us to here tonight. jones requested to (paused). they're here to have outdoor entertainment and amplified sound at 7:00 p.m. and ambient sound level and 10 events with a higher sound limit and usually for sunday brunches but like to host other events as well. the senior inspector set the where i want and reflected in the conditions below and the current permit says they can host until 10:00 a.m. --
1:52 pm
10:00 p.m. and the rules changed and now until 11:00 p.m.. the general manager had extensive out reach and neighbored the neighbors and two of are hotels and no opposition to the permit -- there was a concern letter that i read yesterday that i responded to and actually was able to put them in touch with the neighbor, a residential neighbor, with the gm of jones and they're open to speaking with the permit holder so that is modified in the memo here. sfpd was notified of the amendment request and didn't have any requests with it and here is the general manager of joans, joanna heinz. >> hello everybody. i'm nervous and like i am back in school. okay. i wrote out my speech but i will try to say it from the heart
1:53 pm
but i might look down here because it helps. maybe not. i am very dyslexic. so hello everybody. so my name is joanna heine and the manager at jones 620 jones street and near geary street and i come to update our pretty utdated performance license and asking specifically to hold 10 special events per month but before i start and the points where we should be supported from it and i would like to tell who 620 jones is. hit it? okay. oh here we g hello. so we are the biggest outdoor bar and restaurant in
1:54 pm
san francisco. we are basically urban oasis with the concrete jungle we're surrounded with and opened our doors in 2011 and valentine's day to show already there's a lot of cash and thinking behind this place and we have been -- so has been established for over a decade and between the theater district and the tenderloin and the upper hill markets. we're an unforgettable delftination that has 8,000 square feet of patio and ms. rises the patrons and life and birds and hummingbird is loving our greenery and always present when i am there and working and we incorporated the hummingbird into our

logo and because pictures can say a thousand words and videos can show more and here's a short clip to get the essence of jones (video) (video). >> so we are basically so 620 jones is aiming to contribute significantly to
1:56 pm
san francisco artistic synergy and the economic growth and community engagement so let's go straight to the point with artistic expression so without art, without art tree the city loses life. without art there's no city vibrance and important to be a platform for such ventures. you can already have a sense at 620 jones we incorporated the gaylord hotel suites and we share the same address with and the style of building and incorporated it throughout the whole space and it's already a journey of art how we built out the space. we firmly believe that cultural expression and help communities where the economy and
1:57 pm
celebrate the right diversity that makes san francisco unique so the request for the 10 events are allocated to the brunches and provide a platform for emerging artist and local talent and established artists to show their correctivity and if you haven't been it's a magical experience. all sorts of people come into the life and laugh and celebrate and cheer for each other and they haven't met each other and each other and people leave happier and a joy to support and we all know there's a creeping shut down as it goes though downtown and vital to not to have us affected and be a space where people can dwhich leads us to the second point. the economy.
1:58 pm
i just missed the slide. hold on. [inaudible]. so the boosting the local economy so the first fact the staff members. the first fact at any given time employ 45 employees whom 80% of them live and work in san francisco, and by giving them a steady income they're able to spend and support the family in the borders of san francisco and there's a saying a rising tide lifts all boats and why we want to be a vibrant place and events day to day for our employee but also the impact that we're on geary street which is a very vital road for san francisco connecting union street, union square sorry with van ness and all the way to ocean beach and it's
1:59 pm
life line in my eyes of san francisco because the bars, restaurants and businesses that line the streets are essential to the vitality of the neighborhood, but having not only our day to day with special events we will attract residents, tourists and also people who are patrons of the hotels. there's about 12 hotels within four blocks of 620 jones have them come in and we're driving foot traffic and boosting the local economy. oh yes and what we always do is we recommend places around us so when we time to close the doors because we know open after midnight anymore and we close the doors and they're at the bar across the street. there's a restaurant across that street. we are booked to date -- thank god but the restaurant on this corner you can check
2:00 pm
out so we're care going our surroundings, not only our residents but our the other businesses, our competition i would guess. all right. which leads me to the third point which is our community impact. so our community impact our venue at 620 jones and works with companies and organizations including tenderloin development corporation which has the mission to build the future of economic and racial equality. then frame line which is a non-profit organization that is changing the world one queer movie at a time and connect film makers and audiences of the bay area and the world around us and the [inaudible] alliance whose mission is protect historic

businesses and protect small businesses and the area alive and this organization that fights homelessness, a company that provides high quality permanent supportive housing to san franciscans who suffer from serious health issues. [inaudible] 620 jones collaborating together and raised in the past over a half million dollars to fight homelessness and if i don't mention jaw neata moore our famous drag known and with the help of 620 jones raised $1 million for charity and in san francisco. actually this year it went to [inaudible] sorry. well, i am dropping the ball on
2:02 pm
it. i will move on. it was for charity and we worked -- i totally didn't do good on this part, so basically in the end what it is we're not trying to reinvent the wheel here. we have been a established business for over a decade and we just want to update and have our permit be more current and be able to have the events that we have the past but be able to make them a little more special because while hopefully you will be off soon at some point and nice to 7:00 p.m. but nice to go a nice walk up to jones. go inside have a glass of wine and maybe there is music playing and have an impact on you and tell my coworkers or bring friends in and why we're here for the little magical moments that are importance to us so in conclusion granting us the
2:03 pm
ability to host 10 special events per month under the updated limited live performance license we will be a pivoted step in enhancing san francisco culture, landscapes. our equipment to artistic express and the economic boost it will provide to local businesses and our history of collaborating with various organizations demonstrating our dedication to the growth and vibrantacy to the city. thank you so much for your attention and your consideration. >> questions? comments? >> so the proposal is to allow indoor entertainment everyday until 11:00 p.m.. outdoor entertainment with amplified sound everyday until
2:04 pm
seven, and then up to 10 special events per month that can go later, and does that suit your goals in terms of your vision for 620 joans? >> yes. because the thing is are we're going to have 10 events this month. this is just to have the freedom to hopefully have more events and more people come back. i wouldn't say it's frustrating but people want to come and they want to be there and no you can't have that. no, you can't have this and obviously i know we are surrounded by a lot of neighbors and by hotel buildings so we always try if there's a event and have it as early as possible so we don't over extend ourselves. >> great. thank you. >> deputy director do you want to clarify? >> yes, i do. commissioner thomas so it's not go later for the 10 special
2:05 pm
events. it's to have a louder sound limit for 10 special events. >> thank you. >> because the planning department has a condition that doesn't allow outdoor entertainment to go later than 7:00 p.m.. >> thank you for the correction. my mistake. >> i just wanted to say thank you. it was already known to me but thank you for your continued commitment to the lgbtq community and centering that community. i am sure you're aware that area has a long and strong queer history and we don't have very many spaces left in that part of town. i guess i have two questions. one is do you have a relationship with the transgender cultural district at all? >> well yes and no. >> okay. >> we had -- i will
2:06 pm
just need to look it up so i don't -- [inaudible]. >> oh so we have connection with them and support them, but i have not reached out to that particular [inaudible]. >> i will say in perhaps what might help make sense to keeping culture alive is reaching out to them, engage with them and seeing if there's possible collaboration with the increase in events that you're going to have and center the long history of the trans community in the tenderloin and i am really happy to hear that you recommend for folks to go to other places after you close and would ask that perhaps you highlight the two queer spaces that are left in the neighborhood which would be the c ynch and
2:07 pm
charlie's because they're legacy businesses and we want them to stay open. >> anymore? all right. you can have a seat. we will deliberate. any conversation before we do motions? one thing acting director can you just if you already said it then repeat, but so they did have one sound limit that was out dated before. can you explain how it's changed or what was done? >> the existing condition states that shouldn't exceed 68dba outside and no element but that's less than the average ambient that the inspector took when he set the limit so it's extremely arching waited so he worked with joanna and the
2:08 pm
team on assessing what the volume would be at the loudest which is during the drag brunches and that is how we came to the arrival of of the special event sound limits as cited. >> thank you. . >> yeah, sounds good to me. >> do we have any motions? . >> i make a motion to accept the staff recommendations for amendments to their permit. >> seconded. >> all right. >> would you like me to say it differently or is that sufficient? >> sounded good. all right. public comment. anybody wants to speak publically can walk to the front. you have three minutes and just please state your name in the microphone. >> good evening commission. my name is kevin despain. i have lived at
2:09 pm
gaylord suites for six years and to me i know for this a few time it is it really is an oasis especially post covid lock down. the neighborhood it's really depressing and we talk about life and art. there is nothing but death and despair. i'm not going to susar code it and it's a joy to live above on the seventh floor. i grew up in the city and worked the door at mono lowa and i don't know why they're throwing them under the bus at brickton and other than they should extend the hours as far as sound and one you never hear anything indoors and you hear a lot of things in this neighborhood where i live and i don't think people laughing and having listening to some good music is a problem and i can't
2:10 pm
speak for the hundred plus residents at the gaylord suites but if we had a list of negative living in the apartments i don't think jones and it's more of an attribute and that'sule i have to say but that's cool. thank you. >> thank you. anybody public comments? please. >> . >> hi commissioners. my name is margo. i'm one of the drag entertainers that has the privilege of being a part of the regular programming at 620 jones and it's an honor to get to represent the artists that get to be there regularly. just a quick couple of things to add to what has been already said. as an entertainer i know that i personally as well as a lot of my community have been very impacted by the pandemic and the closure of so many
2:11 pm
incredible historic queer venues and i know that 620 jones really stands as a pillar in the community and as a space that is literally keeping entertainers like myself i believe to do what we do, able to also as a drag performer survive in very expensive city like san francisco. additionally just speaking behalf of drag i think that drag has always been political. drag has been an art form that existed across cultures and across many centuries but especially now i think drag stands as a testament to the resilience of the lgbtq plus community and i know that every time i have the opportunity to perform and/or host at 620 jones that it is an opportunity to create a space of safety, a space of self love,
2:12 pm
and a space of celebration with the community, both our alleys and members of the lgbtq plus community, so that's -- yeah, that's basically all i had to say but really grateful to get to speak with you all today. thank you. >> thank you. . >> hi. my name is mary. i'm a resident at 620 jones. i have a disability that makes it i'm struggling to talk so please if you could bear with me. i was there at the gaylord when they were building the bar and i lived there from time before and i raised my child there. i have
2:13 pm
-- it has been an ongoing issue and it actually the gaylord suites is a great place for single parents and working and students because it's an affordable sro to be in and it's a beautiful building, but a lot of people cannot put up with the sound and all sorts of different problems that come because of it. i knew this day would come eventually where it didn't seem worthwhile to keep submitting complaints, and it's very difficult for them to be investigated given the fact that the courtyard is not visible for the in whichor and you really need to be inside the building so
2:14 pm
for several years i have been routinely documenting at of the recommendations they have and not just amplified sound from all parts of the building but being late playing music longer than it's supposed to. there is also a lot of safety issues with that probably need to be addressed by other departments. in dealing with documentation my request here is that you defer right now making any approval, and provide me an opportunity to give you a really, really extensive list of video evidence that is time stamped and showing all of the problems because it
2:15 pm
needs to be addressed before -- it really needs to be addressed. it does make the building unlivable. but there's a lot of people who are drunk. there's a lot of people not showing their best and this is something i have a problem up loading to out because it might because embarrass anagement to people and that's the conflict in documenting it and how do i submit it to be reviewed? so that's a request they have. otherwise i will edit it and i guess to try to blur out peoples' faces the best way i can and document and through the complaint process and in that case there will be hundreds
2:16 pm
unfortunately because i apologize for not having the chance to be prepared. this was the notice given to residents that was posted by our manager in our elevator amongst -- he puts a lot of signs. there's signs everywhere. it wasn't noticeable. it's very difficult to read and elevator rides are quick. i had no idea. there was nothing in the mailbox and by chance i was looking and saw this is happening and for that reason as well the public didn't really get informed especially people in the building properly or be aware of what their rights are to express their concern. most people are they're told by the apartment building there's nothing you can do. they don't even take complaints on our
2:17 pm
behalf anymore. anyhow thank you for listening to me. >> thank you. . >> [off mic]. >> sorry. you get one chance at public comment because of the law. >> i just want to put on the record that person asked for an ada request so they went longer for the three minutes which is allowed. >> got it. thank you. so we have made a motion. we have seconded that motion. is there any discussion about that before we go to voting? okay. we can vote. >> president president. >> aye. >> vice president caminong. >> aye. >> commissioner thomas. >> aye. >> commissioner torres. >> aye >> and commissioner wang. >> aye.
2:18 pm
>> all right. that has been approved so please follow up with our staff at your earliest convenience. and now we on to the fun stuff. number 10 election of a vice president of the entertainment commission. anybody want to kick this off? >> so do we just kick off with a nomination? >> sure. >> okay. all right. i would like to nominate president like to mom bleiman for the vice president of the entertainment commission. >> second. >> before we do vote i want to say that i had initially agreed to be vice president but i decided to run for president -- no, i am just kidding. [laughter] >> sorry. is there any public comment on that nomination?
2:19 pm
[laughter] >> there are no public comments. >> okay. then i will close public comment and we can vote. [gavel] >> . >> oh right president bleiman. >> i'm going to abstain. >> abstain. vice president caminong. >> aye. >> commissioner thomas. >> aye. >> commissioner torres. >> aye >> and commissioner wang. >> aye. >> okay. >> congratulations. and now to number 11 which is the election of a president of the entertainment commission. >> i would like to nominate vice president caminong as president. >> second. >> okay. public comment on this agenda item? none? >> no public comment. >> [gavel] >> president bleiman.
2:20 pm
>> aye. >> vice president caminong. >> i'm going to abstain. >> abstain. commissioner thomas. >> aye. >> commissioner torres. >> aye >> and commissioner wang. >> aye. >> great. >> all right. that was 11; right? yes. >> 11, yep. >> so number 12 is the final -- >> congratulations. can we just say congratulations to you two for making this significant changing from moving one chair to the other but i already forward to another year of well run meetings. perhaps less bleiman humor but more dory humor so it will work out. >> thank you guys. >> all right. questions and comments? last agenda item. i want to say serving on this commission as the president is truly one of the most rewarding things i have ever done and honored to do it and definitely time for somebody more capable than i to step
2:21 pm
forward and i have just so much confidence and respect for you commissioner caminong and i look forward to not speaking as much and letting you do that. >> we will see. >> now i get to save my comments for when they matter. >> do i want to say today's meeting kind of blows my mind just the diversity of our communities, and with all of the negative narratives that are in the press right now there's so many beautiful moments. there's so many beautiful story and we represent a very resilient community and i look forward to actually pushing culture forward in our work in this new fiscal year and doing more to amplify stories and maybe
2:22 pm
one day the sf entertainment commission social channels will trend on their own but for real though there's so many stories and an honor to tell them and hold that space and i am looking forward to working with everyone. >> i just wanted to congratulate you both and thank you for making me feel welcome and supporting me as the junior member of this commission and i really appreciate it and staff and commissioners alike and congratulations and i do have one announcement from the castro lgbtq cultural district. we have our monthly advisory board meeting this coming thursday at 5:00 o'clock and as part of that meeting we're doing a special recognition of a former board members of ours chris vasquez for recognition for his continued work and advocacy in memorializing those
2:23 pm
that we lost at the pulse night club massacre and now part of our work in the cultural district because mostly because of him. he has kept it going and he lives in orlando and knew a lot of people at pulse so this was very close to his heart and i just i encourage anyone at a public meeting just like this one so if you're in the castro and want to stop by the bank of america community room and honor chris and yeah. >> thank you. all right. is there any public comment on our comments and questions? . >> no public comments on this item. >> okay. then we will close public comments. [gavel] >> and we will adjourn this meeting

>> we can sweep by in front of a house in a matter of seconds. the only people who don't like it are the people who get the tickets. >> this is a street sweeping sign. don't let it get you. pay attention. [♪♪♪] >> in the morning, when we first go out, we start at six in the morning or seven in the morning. we call that our business run. we sweep all the main arteries of the city. after 8:00, we go into the residential areas and take care of all the other customers. >> the idea with the street sweeping program is to get the leaves and the debris off the ground. >> we -- for not only appearance and cleanliness but safety as well. >> we will get anywhere from 2-

7,000 pounds per truck depending on the season and the route. the street sweeper and the choice of the use right now is an error sweeper. they have a motor in the back and it blows winds down one side and carried by air into the hopper. what will mess this up is new -- large pieces of cardboard or sticks or coat hangers. anything that is more than 12 inches. the tube on the tracks is only 12-inch diameter. >> people asked what they can do to help to keep the city clean. there are people that letter. leaves are one thing. any of the garbage you see is from people being careless. [♪♪♪] >> one cars parked in the way,
2:28 pm
we can't sweep under the congress. to deal with this, we have parking control officers that are provided by m.t.a. and they go in front of our sweepers and pass out citations to people that are parking the wrong way. once the sweepers sweep past in san francisco, you may park behind the street sweeper. we all know parking is a big issue. north beach hasn't been swept since the eighties because of opposition. but we are getting a lot of requests to sweep. basically our trucks are 10 feet wide. we stick the brooms out and they are may be 12 feet wide. >> there are a lot of blind spots when driving a large truck pedestrians and bicyclists and cars. and navigates this 22,000-pound truck through the city. >> we involve the public here -- to adhere to traffic laws.
2:29 pm
these routes were developed back in the eighties around the capability of the sweeper. things have changed since then so we have to adapt. luckily, public works is embracing technology and working on a system to alter our maps. this is literally cut and paste -- cut and paste. we will have a computer program soon that will be able to alter the maps and be updated instantly. we will have tablets in the checks for all of the maps. we will send a broom wherever it needs to go and he has the information he needs to complete the safety. what is needed about these tablets as they will have a g.p.s. on it so we know where they're at. you do get confused driving along, especially the inner sunset. recall that to the be made a triangle. >> thanks for writing along with us today. i enjoyed showing you what we do and i urge you to pay attention to the signs and move your car and don't litter.
