the acting director's report? no public comment. all right. we'll we'll cl comment. we'll move on to number five, which is a report from our senior inspector. thank you. president bleiman. good evening. commissioners. we have received 34 311 complaints since our last commission hearing on august 6th. i haveck update below. please let me know if you have anyst■@■vio. my only update tonight is about amelie, located at 1754 polk street,holn friday, august 9th. inspector young rice visited amelie at 11:20 p.m. in response to a sound complaint. upon arrival, he observed a dj playing inside andnt showed the volume to be at 93 dba 103 dbc, while the current approved sound limit is 87 dba 94 dbc. inspector youngwith the manager on duty and advised him to have the dj end ch t pre, which he did. he also reminded

him of their llp permit conditions and reiterated that entertainment must end11 p.m. inspector young rice then took another sound measurement of the prerecorded muswhed compe approved sound limit. amelie was issued a $100 violating their llp permit by hosting entertainment after 11 p.m, with the door open and exceeding their allowable sound ha tonight. thank you. u questions i know that outside lands is not under our purview as it's on the parks, site, but was there how did how was sound related to outside lands this year? do we have any sen? we received many outside lands complaints. y i think between outside lands and then the following event at golden gate park last weekend, the deftones system of aow we

received, i'd say about 200. yeah roughly 200, right? that aren't supposed to come to us. so d know if others went to rec and park. yeah, or their hotline. they have a hotline? yeah yeah. so as usual, we'll be able toatio and share it with parks, through just the ec 12 but yeah, it was quite an influx. it was pretty fun to be out in the field. yeah, yeah. sifting through them all. notou, i have to say, in, number of us probably have similar, feelings likets about the noisem outside lands, from people whoet commission, and i have to explain to them that it's noturw because it's in golden gate park, which is under parks and rec. but yeah, i'm just always interested. and in the interests of larger sort of venue neighbor relations, if there are ws to lessons that we can learn from

outside lands or ways that we can assist parks and rec with mitigating t the neighbors. yeah, it's always good for us to see, honestly, it's reallyreally eye opening, the best we can really do at this point is quickly. and directly as possible. and they're usually very responsive to it. you know what they do with that information? i can't say, maybe could help fill in. i was just going to note that right now, the way that 311 is set up, customers can only submit a complaint of generally about outdoor sound. and so i think that that's why complaints come to us in error. so i do have an email out to the11 team asking if they can distinguish between sound coming from parks and plazas and versus, you know, otherwise outdoor sound related to events. and hopefully those can then go to rpd directly so that they ti.

thank you. i guess. thank you, president and commissioners. ben van houten from the office of economic and workforce development, with a nightlife business assistance update. gote session is moving toward its conclusion. i believe bills need to be out of the legislature by the end of this month, and then governor by the end of next month. so we'll have a lot more clariton pending nightlife bills very soon. the three bills that we've bn tracking for the longest time, two of which are sponsored by the city, sb 969 and eight, ab 2359, those two bills and assembly member haney's cannabis cafe legislation are allontinuing good positive, positive momentum

on those, we've also been tracking the drink spiking the, the set of drink spiking related bills that have been moving forward. there have been some amendments to some of these since the last time we talked, but but all three of them are continuing to moverd. d i have it on the slide here. but requiring bars to provide drink lids leaf glasses upon request. and pt, so that, establishing reporting requirements around drink spiking that for type that when a bar operator is notified of a suspected dd theyo contact law enforcement and then follow related instructions conveyed by law enforcement, and then finally incorporating spiking education into therses e required of alcohol servers. so

several bills in the drink spiking field continuing to move forward as well. some good updates locally on entertainment zones. i d't a presentation to this group since. since may. since then, our local legislation to implement entertainment zones and designat was signed in july, we are currently working rs to develop a management plan to guide operation of the front street zone. so the implementing legislation designated office of economic and workforce development to develop a management plan as an additional layer on top of any other street closureliqu licensing, other permits. and we are in dialog with sfpd and mta a stakeholders around the best way to coordinate and alignha plan e other permits and requirements. and hopefully, this process t we are undertaking now will also set a template for management

plans entertainment zones. so it's been a fair amount of work to gethioff the y process perspective. but i think we're we're learning a lot about how to do it more nimbly in the future, because there's certainlyt in entertainment zones elsewhere, we also recently launched an entertainment zones web page for stakeholdersatre interested in learning more at sfgov. slash entertainment zone. a few updates on the local legislative front. the mayor's legislation to waive fees associated with outdoor community events involving street closures was adoptnd following the adoption of that legislation, sfmta board actually earlier this month adopted a companion resolution or motion on their part to waive sfmta fees, so really excited ou this program for outdoor community events under the legislation, mta is

leading implementation. and once a waiver is available through this program, an event will have to seek a waiver before bmitting an escape permit. so i know we've had a couple of questis eople saying, when is the waiver coming online, there's i'm sure there's going to be more information about, but, and i'm excited to see that move forward. additionally, the to create an annual permit for food vendors that partats was adopted, another another really positive development for our small food operators, who oftenf events every year. they can get an annual permit instead of having to pay for a food permit for each event that they participate iourse of the year. and then final note here around around permit or process streamlining is maybe another way to think of it, the to remove the announced new requirement forhiteural plans for certain changes of use. so this is

technical, but really does will have a significant impact in the nightlife and entertainme, wheno change a use, even if that involves no, modification of the space or construction on the space,t ange of use can require the submission of architectural drawings, which can cost thousands or, you know, $10,000,ve is just adding a beer and wine license and else to the space, or they're adding a place of entertainment permit ing nothing else to an existing space, so streamlining tothe requirement for plans in these cases is going to be really impactful for small businesses who you know, again, people can get their their firss another this is another way of continuing to support our businesses, were excited to recently announce the

awardees of the downtown energy grants. that's our newraram to n arts, culture, and entertainment activities during and weekends, with a focus really on existingusorganizations that are work in our downtown neighborhoods to help those neighborhoods thrive. 14 grantees across downtown for a total of $500,000 in awards with a goal of in addition toery eneo be doing eprograming as part of their work. but what'seay exciting to me, i think about about the awardees here is that, additionally, there's work to or the grantees are going to be working to tir own long term capacity collaboration between businesses, investing in new equipment, deloping new marketing campaigns and new festivals ro multiple businesses, which i think is really an exciting level of collaborationhai think we're really we're really pleased to of the grantees on sf newabout

deal's website. and then finally, quick update. just another plug for our sf live concert which is outdoor free events in parks and plazas around local live music and entertainment venues. there was are concert that the great american music hall put on on saturday at china basin, the. i was pleased to deliver a proclamation from the mayor na great american music hall day in support of o ennt live music venue in san francisco, more information about allupcong conl a whole bunch more. and, september is going to be incredibly busy for sf live, so that happy to discuss anything more. do you know when the escort waiver fees will be available, you know, i will. i will wto

will close public comment and we can move on to number seven, which is. hearing and possible action regarding applications for permits under the jurisdiction of the entertainment commission. i believe, acting executive director will be introducing the applications on the consent agenda. thanks, president bleiman. the only permit on our consent agenda tonight isor amee function located at 1414 market street, which you recall, was also before you at our hearing in july. you' proved this this lp permit for indoor entertainment. however, i did make an administrative error and i failed to include their outdoor amplified sound on that permit memo. so tonigthent agend the outdoor amplified sound at the front of the which they've requested to have daily between 9 a.m. and 10 p.m, not toee per day in advance of the last hearing. the applicant correctly notifiede fe of their permit application, which includes both indoor entertainment and outdoor amplified sound, and there was

working relationship that, you know, has for the last two colaints since we came beforeund the entertainment commission. we are also now a recognized legacy s we too. and so what we're looking to do is really help co invitalize the mission street corridor. we're looking at doing that by having extended hours to have basically food service as well as, late night parties going till 4 a.m. only on the en friday and saturday, but then additionally as well to, you know, looking at in service just late come to baobab, you know, they're able to go dance, have a great time. but then also be able to have some of the food indoors as well too. so that way they're able to sober up, thisnd hours permits on mission street. particularly within the missiono be a really good addition for the neighborhood. and,d we're e,

at this time, you know, not having any opposition coming in, t the same time having, you know, like, more thr neighbors. and there's been a lot of intentional work to really kind of bridge that going forward. so, you know, we're excited to come here really with good news and, you know, and great intentions. but we're also available for any questions wl tono, no questions. sounds great, give us a sense of what whatkind of entertainment you're hoping to do till for just a continuation of what you're doing currently. yes, absolutely. so the entertainment that baobab has is recognized as a live international music venue. so e from flamenco to, salsa to afrobeats to francophone, we're looking at continuing to do all of that. but i think for the weekends, majority of the time it will be really afrob and francophone with some salsa parties going on

the next item. thank we can you. the next permit on our rer for a jam to bam f pass permit for lokma at . lokma is an authentic turkish and mediterranre that held a jam permit from november 2022 until the program ended in september of 2023. and they and then they obtained an extended duration one time outdoor amplified sound permit in the interim, as they awaited their legislat sspaces permit for their parklets. now that their parklets are finalized, they are applying for an f pass permit so they can continue to host outdoor amplified outdoor diners. the reason they are on the regular agenda ve ags because they are seeking to expand their programing hours. this permit applicatioqu the ability to play prerecorded music at the front of the business forewal diners and in their parklet for their parklet diners. monday through wees 4 p.m. to 10 p.m. and thursday through sunday, 9 a.m. to 10 p.m, not to exceed eight hours per day. the owner conducted neighborhood

clement for over 21 years, located right above lacma, which has occupied the downstairs business since february 2018. several neighbors havell this nr decades. we have never had thi many problems until 2020, when they moved more than when they had more than double their capacity from the parklets and increased sidewalk tables,increg other things. this has caused us all tremendous stress and has negatively impacted our quality of life. la fema owners have demonstrated repeatedly that they only care about their bottome and not neighbors concerns. they don't take owrsons, but instead blame the neighbors and me. when the city issues a violation for being out of compliance, they should not be issued a fixed place amplified sound permit because during their jamwas played at various volumes from morning to nights. music carries and vibrates into my and the neighbor's homeso they cony

music even after their jam permit expired in september. they continuously played music cled after 10 p.m. i have repeatedly asked their workers to turn off the nothing changes. customers a aand need to speak over the music, creating increased noise. when i toldhe owner, his answer was simply the music makes myers ppo keep my customers happy. signs to keep voices down are never enforced, and customers continue to talk at high volumes and the signs. by the way, we had to ask multiple■ tim for those signs to be put up. these examples demonstrate that they do not follow thees regulations mandated by the city, and this commission, due to their do over capacity, noise has been layered upon noise upon noise, upon noise. in addition to the points me working in a kitchen built for 40 customers ratherhan plus currently

has created loud metal on metal noise, loud pounding, often star a 7 a.m. to after 10 p.m, especially on the brunch days. this comes directly into my neighborsy apartment. lacma's response is that we as neighbors are being too sensitive,nd to solve the issues, we should move somewhere quiet we've lived there for over 20 years. is that being a good neighbor since i have lived there previous restaurant owners have beenlso made an effort to t to know the neighbors. not in lacma's case. 25 neighbors have come to the neighbor and i to express lacma's negative impact on the neighborhood. i have a i have names with addresses if you want them. they weren't able toe, interacted ans over several years. on behalf of these 25 neighbors, iu to not issue a fixed place, amplified soundhis will not impact their business and it will be a small contribution to our quality of

in our 70s and i'm the primary caregiver for my husband,. he has serious health issues this past year, including major surgery and complicated medical problems. in the past, we had no issue with the restaurant next to us. however since the landmark began operating and constructing the public during the encountered a lot of problems which are mentioned in my email sent to san francisco entertainmenmm last month. don't care about our concerns, especially the noise issues■f such as overcrowding of the sidewalk with their customers, loud, smoking from them while they are waiting for seating, especially one time

they even their employee parked the car. the customer r by our driveway. my husband has an emergency need to pull out the car to emergency, but cannot because theblocked our driveway. so i have to call 911 ambulance. he us several thousand to send my husband to emergency. lucky saved h life and then the noises from their kitchen travel up to our bathroom winw, which is in the middle of our houses. noises from the backyard. they installed two fans, which is loted underneath one of their unit and one in thevery day, loud noises start from early in the morning to midnight. those noises impact my husband and m. our concern have led to healtharent, fire department and building

comment for this item. okay. close public comment. i just ■? for the record here. so we're here tonight to decide whether or not lama has a the ability to play ambient music from outdoor speakers, the noise of people speakingrocted by the first amendment, which we are not don't have on or the sounds of pots and pans and things that are small business related of the machinations. that's while i'm sure it'sery disruptive or feels very disruptive to some of the neighbors, it's not our jurisdiction. so our jurisdiction is specifically whether or notcaplay ambient music on their, outdoor speakers. the other thing i will say, too, is that, no matter what h happened in the past during covid and jam,the jam permit, if we were tois a te neighbors as well, if that does

issues, like, for that whenare example, let's say music was playing after a certain te, you would have access directly to our inspectors who show up os possibleainl if they can't come in real time, they come regularly and oftenafds. ds evidenced by our long track record of working with them. so i think what happens here a lot is that ineo and they think, oh, if this business gets a permit, they're going able to run rampant and willy nilly, when actually the opposite has experience in that the business now is under our jurisdiction and they're subject to our rules and our inspectors. and you have somebody to call that's not the police, because the poli often are very busy and don't have the bandwidth to respond to noise complaints. so i just to get that that down. so that sai, does anybody have any comments? want to call the operator back up any any questions? i have a question. so, the staff

write up said that we hadn't had anys th year. have we had 301 complais 2020? i looked at the queue today and i'mappy to pull it up right now. i have access to it in real time, but i can confirm that in 2024 to calendar date, we have not received any 311 complaints about lacma also looked at tia margarita because they're immediately across the street from one another, had two about tia margarita, but the inspector checked o because they're they're. yep, and so no ol of those 2023. i recall one complaint, and i don't think it was responded to in real time, but i'm happyo check back to 2022 right now. if you want to give me a moment, i would you like? is that a yes, sure. we wr conversation while we're. i think you explained it best,
