12:00 pm
each comment is limited to three minutes. for those attend ing remotely the commission will hear up to 20 minutes of public comment total for each item. because of the 20minute time limit it is possible not every person in the queue will have a opportunity to provide comment. remote public comment from people receiving accommodation due to disability will not count towards the 20 minute limit. public comment is taken. for each item the commission will take public comment in person and then remotely. for those in person, fill out a speaker card located at the side table or podium. come up to the podium, state your name, any affiliation and your comment. you have three minutes. once finished hand your speaker card to commission staff behind the podium. if using zoom to speak, select the raise hand option. if calling by phone, dial star 9 to be
12:01 pm
added to speaker line when your item comes up. when you are asked to speak unmute by hitting star 6. call from a quite location. speak clearly and slowly. if viewing on s-we recognize you use zoom audio or telephone, you may submit written public comment through the chat function on zoom. commissioners and staff are not allowed to respond to comments or questions during public comment. thank you to sfgovtv and media service. >> thank you very much. let's begin with roll call. >> beginning with roll call, president bleiman, here. vice president fong, here. commissioner davis, here. commissioner poggio, present. commissioner schlander, present.
12:02 pm
and commissioner thomas, present. commissioner perez is excused. >> okay. the next item is 2, general public comment. this is for any items not listed on the agenda. are there any members of the public that wish to speak on an item not on tonight's agenda? you can hand your speaker card to may here. now is your chance. >> good afternoon. good evening. my name is [indiscernible] a professional musician. i have been in the bay area since 1986
12:03 pm
making a living exclusively playing music. before that i was 5 years in europe and amsterdam and doing this professionally since 19 years old. i play music at [indiscernible] a restaurant at the top floor 17 of the luma hotel on channel street, number 100, all most the corner of third street. i want to mention that before playing at that place, we used to play a place called jellys on pier 50 across the parking lot where they put the tent now for the circdisolay. in that area there was a history of latin music every sunday at jellys with the speakers outside, large speakers, dj, et cetera, and it was a very favorable-- >> there is an agenda item so you might-
12:04 pm
>> this is general public comment, so this is for comment on things we are not discussing tonight, but it sound like we are discussing this tonight. >> you are correct. i'm sorry. >> no worries, happens all the time. it isn't normal logic to consider, but if you can come back up and that way your comment will be entered into record. >> you get extra time. >> you got a freebe. is there anymore public comment? one person on zoom. i will bring in berry toronto. berry, if you can hear us unmute yourself. >> good evening. this is berry toronto. i first want to say the chat function is disabled so you are not able to do written public comment on zoom, because it is disabled. that is for your knowledge.
12:05 pm
the next topic is, i took the time to make sure i do public comment because i am for identification purposes i'm active with the san francisco taxi workers alliance and i know a lot about the taxi industry. you can ask me any question and i'll give a straight answer. what discouraged me is being supporter of prop l. among the signatures on the argument is identified two different ways. one, as the [indiscernible] and two as president of the california [indiscernible] the problem is, this entertainment commission vote to oppose prop l and if is only for identification purposes only t is confusing because there are two different ways. two, about this is that the argument against it are false. i will bet you a thousand
12:06 pm
dollars how i can prove it is false. taxies provide a valuable service to seniors and disables through the paratransit debt card program and trip card program and anyone that has a card is provided a subsidized ride so they don't need to take uber or lyft and most of them don't because they get subsidized rides or taxies know where they are going and [indiscernible] taxi zones, et cetera. uber and lyft don't. however, i was disturbed to see that of the opposition and for major-a leader of a major commission to actually attack muni [indiscernible] i challenge you as to say muni is getting more and more ridership and at some
12:07 pm
point, some cases more then pre-pandemic levels. i want to say that other members of the commission should step away from being a part of this ballot measure when it doesn't impact entertainment. if they go to a restaurant that is expensive, i can't afford to go to restaurants because they are expensive or the night clubs and pay the entrance fee or the [indiscernible] the drinks are $10-15 a piece minimum. how about providing a discount in your bars mr. bleiman for people over 65 and disabled if you complain about this-- >> your time berry, thank you so much for your comment. >> thank you very much for your time and letting me speak. thank you. >> no problem. just for everyone who is listening on zoom, you are allowed to a written
12:08 pm
comment in the chat, or speak on zoom, but we don't have both tonight. the chat looks like it is working, but i will double check that mr. toronto. >> anymore public comment? general public comment? close public comment and move to number 3, approval of minutes for the august 20, 2024 commission meeting. do we have a motion to approve the minutes? >> so moved. >> is there a second? >> second. >> is there any public comment on the meeting minutes? >> no comment. >> closed. we can vote. >> president bleiman, aye. wong, aye. davis, aye. poggio, aye. commissioner schlander, aye. >> the minutes are approved. the next is item 4, report from executive director. >> thank you president bleiman. good evening commissioners, good evening everyone. i have a couple updates this evening. as opposed to me giving
12:09 pm
legislative updates that will go to ben vanhelten from oewd joining this evening for his standing item and here to discuss update said in further detail if needed. on my end i want to let you know the fantastic news we were finally approved to hire our second part time sound inspector, so you might have seen the update in our most recent news letter that was published and that job posting will have been posted for two weeks as of this friday, so we might bring it down at that point, but we do already have 100 applicants ck that is really wild, and so we have the ability to bring it down or extend it, so we are going to do digger and check into our applications and see if we have what we need. we would love to hire this as
12:10 pm
soon as possible, as we just had acea on weekends with support from andrew here, so we are really going to love having an additional support in the field and anybody watching this evening that might know someone great that would want to work on evenings and weekends, it is 20 hour week position, it is a great starting salary, it is 1840 junior management assistant with the city. please check online on the sf jobs portal. sfgovjob portal and linked on the website and through the social media. if you have questions you can reach out to staff and you can reach us at entertain.commission at sfgov.org. my other update for this evening is related to our annual entertainment commission retreat.
12:11 pm
it has been a little bit since we hosted one. i believe we skipped a year and we have three new commissioners, which we are really happy to have all these new faces, but we want to make sure that we have a forum to really dig into our grounding principals, our mission, vision, values goals for the next year among other topics over a 4 hour period so that is happening tuesday october 22 at 49 south van ness which is where our office is. we have a nice conference room. this time it actually has windows so a upgrade from the last time so hopefully it will help our brains get in mode for those 4 hours we are together so it is the 7 commissioners, 6 staff, along with ben van houten and carrie from oewd. we are providing lunch so as a reminder, if you have not responded to may with what you prefer for
12:12 pm
lunch that day, please do so by the end of this week so we can put in the ordering. the google drive just for your awareness, i have posted our retreat agenda for that day. it is still in draft mode, but we already started getting moving, so if you do have any suggestions of something you want to hear that isn't on the agenda, please direct message me, but we did create this based off the survey wesent out to all of you asking what you wanted to hear from us. again, we are just digging into what our vision, mission, values and goals are. we will talk about sound measurements and science and dig further into that. we'll bring out the sound meters soy you all have the best understanding how we set our limits, how we regument our sound limits and how those relate to work we do. we will talk about entertainment zone and state and local legislation
12:13 pm
as well as our community outreach at all levels in which we do that. and, we will end the day with happy hour so we can have nice team bonding. looking forward to that. october 22. if you have questions or anything you want to add to the agenda it isn't too late so please do let me know in the next few days before the agenda is posted online, which is required to be done a month in advance for these different meetings. any questions? okay. thank you. >> any questions for our executive director? not seeing any, any public comment on executive director's report? >> there is none. >> we'll close this item and move to number 5, which is report from senior inspector. >> thank you. good evening commissioners.
12:14 pm
we have received 96, 311 complaints since the last commission hearing on august 20. have a few update said. the first update is about [indiscernible] at 1434 grant avenue. a poe with our office on saturday august 24 inspector young visited savoy at 10:40 p.m. in response to sound complaint. he observed dj playing inside and showed the volume at 88.1db a, 96.2dbc why approve is 84db a and 93dbc. we spoke with the manager with on duty and advised to turn the volume down, which he did. per condition 10 of savoy liquor license the business is not permitted to host a dj. the performance was a local legacy act. management expressed they were under the impression the dj was going
12:15 pm
to use the turn tables as a instrument during the group perfomance and aware the dj also played between sets. savoy issued notice of violation for violating the permit by hosting a dj and exceeding allowable sound limit. additionally, inspector young and i provided photos that show 10 people on the sidewalk and streets in front of savoy with what appeared to be open alcohol containers. due to the evidence management was reminded they are required to adhere to security plan and good neighbor policy. security guards monitoring patrons outside to prevent loitering open containers et cetera. deputy director azevedo spoke with the general manager about the violation and in touch with a lu regarding the incident. next update is about we funder, located at 1885 mission street. we funder does not hold permits with our office. inspector young and i responded to
12:16 pm
sound complaint at we funder friday august 30 at 10:30 p.m. and observed patrons congregating in the outdoor area and dj playing inside. he spoke with the management and confirmed that there was no permit in place for the event. that hosted a dj. issued a notice of violation for hosting entertainment without a permit. in the past staff corresponded with the manager regarding permitting requirements for entertainment. we continue to receive sound complaints about the organization, mainly because they are underly adjacent to condo. the sound travels into their homes. management had been educated for need for permitting to legally host events. my final update is about [indiscernible] business does not hold permits with the office. responded to sound complaint
12:17 pm
about the lounge on sunday august 25 at 1:30 a.m. and found indoor entertainment down stairs and sound on the second floor. the bar restaurants advertise being open with food service until 5 a.m. but they do not have permits from our office. after inspector the visit i followed with point of contact, however never received response. as such, visited september 8 and found them hosting unpermitted entertainment. during the second visit the different person identified as the point of contact so reached out to them directly about permitting requirements but never heard back. inspector young and i revisited a third time the past saturday, september 14 at 145 a.m. and upon arrival he again observed dj performing downstair in the restaurant with the front door open. spoke the same owner and
12:18 pm
confirmed there was not a permit in place for dj and provided on site permitting education, which he has done during all his visited. the business was issued nov for hosting entertainment without a permit and based on observation and fact they advertise selling food to 5 a.m. the business should apply for a poe and ehb permit. to our understanding this business currently does not have any active health permits, fire assemby permit or a bc liquor license though these agencies have been alarted alerted to the nov issued and will continue to work with the business to bring them back into compliance. thank you. >> questions? >> def leopard and diplogot got a lot
12:19 pm
of complaints. i know there isn't much we can do. >> unfortunately inspector young rice ran into a tire issue on sunday, so not able to get to the diplo run, got a flat tire in the city vehicle, which consumed too much time unfortunately. we actually are going to revisit oracle sound plan. deputy director and i have a plan to visit with our contact there and rediscuss and spend time since we have been receiving complaints and we want to better familiarize our newer staff members on that sound plan seeing as they do have pretty impactful concerts there. >> since the beyonce concert it seems
12:20 pm
they need substantial changes where and how the speakers are located. it seems def leopard we got a lot of complaints. it seems it is ticking back up in terms of the number of complaints. again, when we get complaints from noe values it seems some of it is the at mus spheric stuff we dont have control over in terms of sound waves bouncing off clouds which i know isn't for the folks that dont want to hear the sound and hearing it it isn't much comfort but some things we have control over and some we don't cht >> hopefully we can update with information once we have discussion with the staff and see if there is adjustments that can be made to help mitigate. >> how many complaints did we get from def leopard? >> i think 20. >> 20 for oracle show doesn't seem so crazy. >> actually, you are right. decent amount.
12:21 pm
>> each of the complaints matters, dont get me wrong, but sometimes- >> it is like i live in bernal heights and live in noe valley--[indiscernible] >> if you didn't want oracle to be so loud you shouldn't move to bernal heights. >> i didn't hear it in bernal heights. >> one thing i will say, we used to have access to next door as a government agency to post on there, and apparently it has been since deactivated so working to reactivate our account and then repost about oracle shows and other potential loud events. another thing that deputy director azevedo is doing just as of this week is she's notified 311 about any events for the upcoming weekend that might get complaints and might be louder
12:22 pm
so the call-takers have awareness-situational awareness where they might be coming from, which we think might help with the mitigation in real time. >> great. thank you. >> great work. >> any further questions? i guess the lounge will just have to check on them again soon. if they are listening it is very likely that we will stop by. >> we will. >> a few times. any other questions? any public comment on the senior inspector report? >> no comment. >> okay. we'll close that item and move on to number 6, which is updates on nightlife business assistance. before you start, a quick story. during covid, we were unable to meet indoors and ben and i would go and talk about the future of nightlife
12:23 pm
and at the park. we were talking about whether or not clubs and venues are able to survive through covid, given the drastic situation and ben was quite for a second, beautiful night and he said, if dreams are like movies, ben memories are films about ghosts. i said, what does this have to do with nightlife? he said honesty, i don't know. i said did you come up with that, it is deep? no, it is my favorite lyric through counting crows. he is one of the biggest counting crows i have ever met. >> how do i return from that? good evening. thank you for the introduction president bleiman. a relatively short update i think for you. all of the state nightlife bill weez
12:24 pm
have been tracking are on the governor desk. the governor has until the end of september to act on all of them, so expecting that activity soon. a birch bunch of work on entertainment zones. the front street entertainment zone will take place this friday from 2 to 10 p.m. and i believe they have entertainment permit. this is the first entertainment zone event in california ever. so, exciting showcase for san francisco's pioneering work here. i know in talking with folks in other cities, there is a lot of interest seeing how it goes and continuing to have conversations with folks in other jurisdictions because as reminder, if sb969 passes, other cities are able to designate entertainment zones so looking to us to lead the way.
12:25 pm
our approach to entertainment zones has been to both adopt the zones through ordinance and then oewd implement a management plan. the front street management is online and there is a dedicating page. these plans are generally to reinforce rules within other permits. this was developed in consultation with sfpd and sf mta and been a good model for the future of this sort of management of future zones. earlier this month, the mayor introduced legislation to designate four new zones. one in midmarket between 5 and 6 street and one around the block that includes the chase center and thrive city. one on maiden lane and one on harlen place and mark lane. additional ly, president peskin has pending legislation i will also talk about in the downtown activation permit
12:26 pm
context on the next slide, but it would also designate 10 new entertainment zones downtown, so there is a prospect by the end of year we will have a significant number of entertainment zones and we are continuing to hear, interest, questions from folks looking to explore how entertainment zone might work in their neighborhoods. handful of local legislation updates. as i just mentioned president peskin pending legislation to implement the greater downtown activation program. this would create a new multi-year permit issued through public works to support reoccurring outdoor activation of designated downtown areas by community benefit districts. i believe there are 11 areas identified in the legislation that would have access. -cbd have access to multiyear process. initially, this slide was going to include this permit as drafted.
12:27 pm
the legislation eliminated the need for entertainment commission permit from that multi-year public works permit. however, in committee yesterday president peskin announced his plan to restore the entertainment commission based on discussion with commission staff and with the support of cbd. happy director weiland to offer commentary but needed. >> very concise. we are happy to hear that, because we feel there is a lot of value in having us at the table not only on the front end to help with technical assistance with other departments as well as on the back end when sound complaints come in. that really is where we tend to shine mediating between neighbors and those zones, which we had outreach from a neighbor about the first event happening at the front street zone this friday and so, we are really happy to be included.
12:28 pm
>> excellent. additionally, on the outdoor event fee waver legislation that the mayor lead earlier this year, legislation was signed into law and the fee waver request form is online for community outdoor events to apply for that fee waver as a quick reminder, an event has to seek waver before submitting a permit and needs to do that at least 90 days before the event is scheduled to take place. there is additional requirements on applicant and event eligible. all is on the web page. finally, little lit breaking addition to this one, the impact fee removal, the mayor today introduced legislation to remove impact fees for changes of use from production distribution and repair use to non residential use. that is word salsad, but when a
12:29 pm
operator seeks to change a use for a production distribution repair warehouse manufacturing facility into another type of commercial business they can often incur impact fees around anticipated or potential transit impacts or other potential impacts and those fees can be sizable. i know at least one-nightlife operator when they built a new entertainment venue out of what had been a pdr warehouse they incurred a hundred thousand dollars in impact fees. where these fees apply this is a significant piece of relief to support businesses using these spaces. that was introduced today and happy to track that as it moves forward. positive news and that concludes it. happy to answer any questions. >> all i say, 90 day
12:30 pm
period--the requirement is prohibitive and so, happy to work with your office, but a lot of community events don't know they will happen 90 days beforehand and should have the opportunity to apply for a waver within reason. that is a huge for a lot of smaller events, a huge runway that maybe isn't in their mind. they have to like crystal ball out to the future. alright. no questions here. any public comment on the report? >> no public comment. >> we'll close this item and we can move onto number 7, which is hearing and possible action regarding application for permit under the jurisdiction under the entertainment commission. presentation.
12:31 pm
it was written. i read what was written. that is so embarrassing. on number 7 which is in fact a report from or senior director of lots of titles. >> i will lean over a little bit here. good evening commissioners. dylan rice, here with eileen lockren from department of public health and we'll update on our campaign to promote overdose prevention in the entertainment and nightlife
12:32 pm
community. >> thank you. good evening. i will go over slides to set context for the presentation. as you can see from this graph, that's from overdose deaths from fentanyl has significantly increased. fentanyl first showed up in the bay area around approximately 2016 and we are seeing a significant increase nationally. this graph is from the national center for health statistics and it provides a clear visual that not only the rise of fentanyl deaths, but it coincideed with a decrease in heroin deaths. also, a rise in methimphetamine and cocaine. next slide, please. thank you. the office of the chief medical
12:33 pm
examiner releases preliminary data reports every month, and we started to see a significant increase in overdose deaths from approximately 2020. in 2023 there were 810 overdose deaths, which was about 25 percent or 161 additional from 2022. fentanyl was involved in 81 percent of the fatal overdoses in san francisco in 2023, and unfortunately black african americans represent a small percentage of the population in san francisco, but are most significantly impacted by overdose deaths. i like to show this heat map, because it shows where the significant like impact is for overdose deaths,
12:34 pm
which tenderloin, south of market, the polk gulch area, however, overdose deaths are happening throughout the city and this map clearly shows that. deaths occur city wide. mostly people experiencing homelessness or people that are marginally housed in permanent supportive housing or sro but overdose can happen to anyone and that is why we are here today to share our partnership. next slide, please. preventing overdoses is easy. it is safe. it's very simple and it is legal and that's included in all our messaging, so whether we are doing an event at a venue that is like short and quick, or if we are doing one on one trainings, we share that information.
12:35 pm
we are really lucky in california that we have the protections of a b635, which protects people from any liability and so, really the messaging is, it is safe, it is simple, it is free and you can save a life. next slide, please. >> thanks eileen. as explained, accidented overdose from fentanyl is national and local crisis and the crisis intersects with the world of the nightlife constitch wnlts. tuent. fentanyl and street drugs laced with fentanyl are showing up. we have unregulated drub supply and don't know what you are getting and never know when fentanyl will be present. [indiscernible] platform and duty to educate our industry on how to
12:36 pm
protect itself and patrons using overdose prevention strategy. with the guidance of dph eileen lockren and commissioner thomas our public health representative, we forged a strong partnership with public health to respond to the crisis by raising awareness and promote life saving intervention in the night life community. so, just background last year, officially launched the campaign at our summit in june 2023 and the strategy has been to empower with education and resources through online engagement and in person trainings and key was partnering with drag queen [indiscernible] influencer who has been advocating for overdose prevention already to large following. you see here that in terms of
12:37 pm
online engagement released a training video, step by step how to use narcan. we created a resource website for the nightlife industry. we did three in person trainings last year and eileen and her team were continually doing trainings for bar and venue staff. so, here is screen shots from the training video and resources site just to refresh your memory. we have new commissioners too. shots of outreach events last year. you will see that commissioner thomas on the upper left on the cat walk passing out naloxone to the audience members at the performance. talk ing about last year's
12:38 pm
impact and successing, the training video went viral. we had 109 thousand views and distributed 125 doses of naloxone and 300 fentanyl test strips and had 400 to 500 attendees at these events. in terms of figuring the goals for this year, we wanted to take the positive impacts from last year and increase by furthering the reach to the nightlife community so broaden the awareness of the crisis and how to protect yourself and others. increase industry access to naloxone and education, so empowered to take action. also want to talk about serving disproportionately population. lgbtq population and also wanted to be thoughtful including black and african american communities and also the timing was great for august
12:39 pm
because it happened to be overdose awareness month and august 31 is overdose awareness international overdose awareness day. keeping this goal top of mind which is to ultimately save lives. this slide is a outline of the campaign activities in august. we wanted to build on last year's success so in terms of the online messaging, the training, resource training. we beefed up the pr efforts by enlisted the help of dph communication team on doing press release and making media pitches so the next slides will just go over those in more detail. we did four outreach events in august featured training with drag ambassadors.
12:40 pm
nicky is bipoc queen. we are grateful to bow and oasis partners with us as host venues and they allowed us to be on site and have presence at their events. in terms of impacts we are 895 attendees for these events and 264 naloxone doses distributed. photos from nicki and kochin a at oasis and more event photos. that is me with commissioner thomas. commissioner secretary is in the second top photo along with ellyse gray from public health and of course our drag stars. just shots of the resource materials and supplies we distributed at
12:41 pm
these events. >> so, on this slide you'll see a list of some venues and this is only scratching the surface of some of the venues we worked with. as dylan mentioned, not only do we do these events that are public, we also provide an opportunity for venues to reach out directly for training and for naloxone, and so, as i said, there is others that have been absolute leaders such as the stud, oasis, 111 minna, elrio. in 2023 and 2024, sfdph lead in person trainings for staff at 18 nightlife venues. we distributed 1600 fentanyl test strips to 6 different venues across the city, and this is only the bars that have ordered directly from the
12:42 pm
dph pharmacy and it does not include venues that are getting supplies from other resources and i think that's really important to note. examples of venues that are regularly coming back for additional supplies are the stud, the pilsner, the chapel, brick and mortar, oasis among others and i think this is a great opportunity because many venues entered very tentatively into wanting supplies and have come back because there was interest and appreciation from their cline entele that the supplies were available. let's see, so we trained over 225 individuals in those past years, and i think the only other thing that would add to that is that, we continue to get
12:43 pm
hits on our website as well from venues or e-mails directly to overdose prevention at sfdph.org asking for additional in person trainings. >> thanks to dph help with issuing the press release and leading the media engagement, our campaign received 9 stories from 8 local media outlets. put the campaign in a positive light and the chronicle ran two stories and you can see in your folders in the clippings folder all these articles and the press release. here is stats to illustrate the reach of the campaign through the online channels. i will not go over them all. instagram channel.
12:44 pm
we had 4495 accounts reached. the kick-off announcement at the very beginning of the campaign received the most engagement. we had 190 likes or shares, and we had 93 percent of those people were non-followers. you can look at the slide and see the metrics there. looking ahead, we want to continue this momentum. i think things are going really well and so, the first thing we are doing is assessing the impacts of the campaign and considering expanding the reach in 2025 looking at our department resources in terms of staffing and supplies, and continuing to look where current gaps exist. excited to report that this afternoon eileen, myself, director weiland and several people working on the campaign met with the white house office
12:45 pm
of national drug control policy. they asked us to share our campaign strategy and interested in sharing our work as a model for other cities and jurisdictions to adopt. they invited us to participate in the white house challenge, so we are going to register our campaign and tell our story to be a part of the larger nation wide effort. we are really honored to be recognized and they are interested staying connected with san francisco on this effort. and then just in terms of ongoing--we want to continue supporting eileen and dph efforts underway in terms of keeping the industry aware, fully resourced, connected, and we also talked about this in the past and commissioner thomas brought it up. how can the ec continue to realize the vision of narcan behind every
12:46 pm
bar. could we require permit holders have narcan on site with trained staff as a part of the permit conditions? just ideas there. >> thank you. so, this next slide is a example of the information we share not only at in person or different events, and the most important thing that we want to drill in is, naloxone is available, test strips are available. you access them for free at this point, and to contact the information that is there. additionally, the other trainings are always available, so that's it for our presentation and we welcome any questions. thank you so much for your time. >> thank you very much. questions? >> i say, a huge huge thanks to
12:47 pm
eileen and dph for partnering with the entertainment commission and dylan for picking this up and running. it has been fun to get out to shows and see some of the fantastic entertainment out there, but just wanting to make sure that all of the staff and participants and all our nightlife events are safe and healthy as possible and keep coming back, so just a huge thanks and in particular to [indiscernible] stepped up and created this [indiscernible] also in the health department who helped with supporting some of the drag queens and being able to do this work, so it's--drag queens have a long history as being out there to educate folks, and share information and use their platform, so really excited the entertainment commission was able to partner with them.
12:48 pm
>> further questions? none? >> i want to say thank you. i was among the first group of officers trained at northern station on naloxone in the end of 2014 i believe. eileen i think you have gone to-- >> [indiscernible] >> yes. so, great seeing you again and thank you and if you walked into any station, tenderloin, northernition, mission and ask how many times you have used [indiscernible] it is easy to use. the big thing in my opinion to hone to the public is, it is one of the few things medicines or treatments out there that won't hurt the person if they are not suffering from a opiate overdose. that was honed into us and yourself and [indiscernible] won't hurt the person. it will only help.
12:49 pm
don't hesitate to use it if you think that is what the problem is. >> he is coming to my next training. [laughter] >> exactly, we'll get you out there. >> absolutely. in fact, at our stations we have naloxone and had a couple officers handling narcotics where it is leaked and they had to breathe it in and we had to use the naloxone on our own staff, and it is scary, but that is also a safety thing for the workers of a bar too. if they pick up a discarded tissue or cleaning up afterwards, it doesn't take much to breathe it in and all sudden the body is suffering a overdose. thank you. >> alright. anymore questions? any public comment on their presentation? >> no public comment.
12:50 pm
>> close public comment. thank you again. good stuff. we will do this for real this time. item 8, hearing and possible action regarding applications for permits under the jurisdiction of the entertainment commission. >> thanks president bleiman. good evening everyone. i'm coming remotely on zoom. so, let me get our agenda here. the only permit on consent tonight is indoor llp permit at 2300 chestnut street. the applicant conducted neighborhood outreach and received two letters of support. there was no added conditions from sfpd northern station. due to the zoning district they are required to end their indoor entertainment by 10 p.m. the staff recommendation is approve the consent agenda with the recommendation listed below. >> thank you. first i will open for public comment. any public comment on the

consent agenda? >> no comment. >> close public comment. motion to approve the consent calendar? >> so moved. >> second. >> let's rock. [roll call] >> consent agenda is approved and move to the first permit application on the regular agenda. >> the first permit on the regular agenda is sound permit [indiscernible] 2263 chestnut street. the location was the restaurant [indiscernible] new ownership team is converting to family style restaurant with a bar. the application includes approval for 1 pool table and since the business has a outdoor patio, the permit application is allow prerecorded music on the patio and in the breezeway for patrons. requested the ability to have outdoor amplified sound daily 10 a.m. to 10 p.m. the owner conduct
12:52 pm
neighborhood outreach and alerted neighbors. the was one letter of concern behind the business and overlooked the patio but [indiscernible] i shared the concern with the applicant who informed he is working with the team to insure music is turned off promptly at 10 p.m. and only ambiiant volume. received a letter of opization a mile away but says they frequent chestnut street and worried the business will be a ruckus and cause issues. thin file is exmail exchange the includes the owner. there is no added conditions from sfpd northern station and here to speak tonight is owner na te valentine. >> thank you for having me.
12:53 pm
my first business every in san francisco is chestnut street. my business partner and i are not new to the street. we opened mama sito all most 20 years ago now [indiscernible] we have blue barn down the street and [indiscernible] our goal of adding the permit is to have ambiiant music in the backyard so people with hear music. it isn't a goal having loud music, it is ambeiant music. we have a a v teemp that is very seasoned in bars and restaurants in san francisco and that individual has-we chaimpged our budget and quote. he is adding shut off at 10 p.m. so no i forgot moment. he is also going to add a limiter so have a ability to set a limit to the music and the individual sounds like did not respond that lives behind, i did look, they have windows close to us. i reached out and mentioned we
12:54 pm
are happy to work with them on sound opportunities we might be able to have with them. meaning we are willing to work with them on the possibility of adding two double pain windows if it helps with their concerns. i dont have anything else to add. if anybody has questions i'm happy to answer them. >> i don't have any questions about a fixed place or billiard. >> you can have a seat. open up for public comment. >> good evening commissioners. i practically camped out on chestnut street about 25 years. a buddy used to own judys cafee. it is nice area. [indiscernible] all these
12:55 pm
establishments are bonifyed establishments. the nice thing about mr. valentine and his group, he is a very responsible owner and will take the precautionary steps to make sure the business runs smoothly and he's done that so he has a tremendous track record. so, if you can't trust na te with a permit you can't trust anyone. applaud him and really think there is something special happening in chestnut and also with the addition of joe's on the corner, it is a popular space, but they are all good establishments and we are lucky to have them. >> thank you. any further comments? >> no more comments. >> close public comment. do we have any motions? >> move approval with staff recommendation.
12:56 pm
>> second. [roll call ] >> congratulations mr. valentine. moving along. >> the next permit on the agenda is place of entertainment change in ownership for april jean, 1371 grant avenue. this was previous grant and green and held permit [indiscernible] the new ownership needs to adhere to motion 13725, which requires the entertainment only occur between 9 p.m. to 1:30 a.m. daily. the new team plans to have a weekly vinyl night and like the ability for entertainment for events such as [indiscernible] they conducted neighborhood outreach noticing neighbors and no opposition received. sfpd central station approved
12:57 pm
the application with condition included below and here to speak about this application is nate valentine. >> nice to see you all. we are fortunate to be a new business in north beach. it is fantasticically welcoming and are nice breaths of fresh air. my family and i moved there recently. we are about three blocks away. our goal here is maintain the poe for use as mentioned with vinyl nights monday and the ability to do things other nights without having to apply for permit every time. unfortunately we do not have the stage so won't have a full time every night live music room, but we will do vinyl night. if you have any questions, happy to answer them. >> no questions here. do we have public comment on this
12:58 pm
agenda item? >> no comment. >> close public comment. motions? >> i move to approve with staff recommendations. >> second. >> [roll call] >> okay. congratulations again mr. valentine. you have been approved. and now we are moving on i believe this is d, correct? >> yes. >> i am going to recuse myself from this item. i sold this bar to these individuals, also went to high school with one of them and one point in high school i tried to ram him with my head and he spun around with his backpack and hit me hard and knocked me on the ground and everything laughed and laughed
12:59 pm
at me and not sure i can act impartially so i will recuse myself. [laughter] >> okay. the next permit on the agenda is llp permit that includes outdoor amplified sound and entertainment on the back patio at 2323 mission street. the new ownership team is seeking llp permit to have indoor and outdoor entertainment. not exceed more then 6 hours between 9 a.m. and 10 p.m. also like the ability to have outdoor amplified sound on the back patio monday-thursday 9 a.m. to 6 p.m. and [indiscernible] without the 6 hour limitation on these days. the applicant have been hosted one time outdoor events on the back patio and do not have history of complaints. the application completed
1:00 pm
extensive outreach which included sending letter to commercial and residential neighbors and in the file you see they collected 135 signatures of support for the application. there wasn't any opposition and sfpd mission station has no added conditions. here to speak tonight is the owner, brooke lloyd. >> do i do the presentation or--? cool. perfect. do i skip through? >> you can use the mouse. >> great. thank you. hi, everyone. i'm brooke lloyd. one of the owners and managers of teeth bar. robert sails is my partner and here as well as the other owner of the bar. i got a very short presentation. it is just basically images of our one time permit events. during the past year, we applied for one time permit events to test reception and they were hugely
1:01 pm
popular with the neighborhood and our customers. as you can see from the pictures, this was a pride drive run we had. here are attendees. here is our dj. here we are with some of our staff. we also held a summer sol stis party in coordination with a [indiscernible] a local sports league partner of ours. they host various sports within the neighborhood, so deloris park, mission high school and other facilities. and that was a huge success as well. we heard great things about these events and clear need for more cultural events in our neighborhood. our dear neighbors on the block have done a great job driving more foot traffic to thais area and we got more and more feedback to do this and host these things to revive the neighborhood and especially our block. as for our plans, we intend to
1:02 pm
have outdoor speakers used for light and ambeiant music. we run a very social bar to connect with people and have conversations so don't want to change that. we just want to have outdoor music for people to enjoy. most of our events will be indoors but if we throw special events we'll have complete control of the volume. it is actually written into the dj contracts we have so we have every dj sign and commit to that and that includes all indoor events as well. we are very community focused business and want to be respectful of our neighbors and thoughtful how we crebt to our community. we distributed nearly hundred letters to 40 different addresses. we spoke with many neighbors and when we dropped off the letters to tell them about our event plans and they are
1:03 pm
thrilled we will be providing more programming to help revitalize the area. as part of the outreach, we shared our direct cell phone numbers, personal e-mail addresses to reach out if they have questions, concerns, anything that came up during this process or after, and in addition as kaitlyn mentioned we collected more then 135 signatures of support for the application. in case a situation arises, we are prepared to handled that immediately. the main number is forwarded to my cell phone and robby or i are on site. not at this moment, but generally, yes. the manager and team is aware of the protocol. as far as giving our information so people can reach out immediately. we rather be proactive about it and solve those problems as soon as we can instead of acting later. thank you so much for your time.
1:04 pm
robby and i are thrilled to center the opportunity to provide better experiences fwr our neighborhood and just thank you for your time. >> thank you. and thanks for the background. all the outreach and colorful visuals. they are helpful. commissioners, does anybody have anything to add here? any discussion? which one of you hit ben with your backpack? [laughter] >> that was me. >> good work. [laughter] >> thank you. >> get you extra votes up here. >> right. >> you can take a seat now. >> thank you. >> okay, thank you. any public comment on this item? >> you can come on up.
1:05 pm
please state your name. >> my name is [indiscernible] i am one of the sisters who lives on 19th, close to the--i know the bar is on mission, but unfortunately the backyard is close--surrounded by people who live around and we have people who study, those who work. for it is hard sometimes to have prayer because the noise is too loud, especially when they are on the patio, and we are really concerned about the music that they want to put in the patio. the sound music, because it is going to be very loud and in many
1:06 pm
moments where we have [indiscernible] with our people, it is very hard to pray. very hard. we are really concerned of what they are trying to do, and the front door is on mission, but it impacts [indiscernible] the neighborhood that lives nearby. and also, the amplified sound. we are really concerning. the outdoor events in the patio of this bar, and also the impact that the quality of our life, because the patio directly shares a wall in our
1:07 pm
building. one of our sisters, she hears people speaking word for word, and we cannot imagine how it will be with the music, you know, and because really prevents us from having a good quality of prayer, especially when we have our retreats with people, which not only effects our daily prayer, but our life, but the life of the greater community members who come to our house or silent retreats. excessive noise prevents us doing our work of peace, and our religious community, we have been there since the year 2000, and for us it is not so easy, because you know, we want
1:08 pm
to cultivate--we want to bring--we moved there i was thanking god because i said in the middle of this you came to put your house and now i'm really concerning because noise and music usually-- -okay. >> we do have a time limit on each of the comments. >> okay. thank you. >> may i ask a question? >> is there anyone else the room that has any comments? >> i think commissioner thomas had a question. >> i had question for the woman who just spoke. my question was, how often do you hold your silent retreats? every weekend. okay.
1:09 pm
>> [unable to hear speaker in background] >> do you have specific prayer hours every day? >> wonder if you can provide those if you can speak to each other and provide those hours, so perhaps that could be acknowledged and worked together on finding a better middle ground. >> some kind of compromise here. >> [indiscernible] >> definitely. we encourage you guys to definitely discuss after this, and sister, i also want to say, if we do grant this limited live performance permit, it brings there business under our purview, so they have designated sound
1:10 pm
limits and if there's complaints about them going above those limits, we have sound inspectors that go out and do enforcement as well. any other public comment? >> so, we have one person with their hand raised on zoom. looks like we have no more in the room. >> okay. >> lairen, i will bring you in right now. laren, please unmute yourself. >> okay, can you hear me? >> yes. state your name and you have three minutes. >> okay. my name is laren and yes, i also live on share ground in one of the places around the patio there, so yes, it is-when you hear people on the patio, if they have like a sports game or something they are streaming, we hear every basket made, because of the cheering and so i can't imagine
1:11 pm
amplified music going on in the patio. i think one thing that is important to acknowledge is, yes, we all want entertainment, but for the greater community as well, like quality of life is really important. this is a residential neighborhood, and one thing to note, when we have these amplified music entertainment bars playing music, that attracts gang activity and we know in the mission district we have a problem with gang violence, so how is this helping improve the quality of life which we heard from the owner of the bar that everyone in the community wants this. i'm a second voice saying no, not everyone in the community wants this. let's find ways to create fullness and peace. this negative impacts the quality of life of the neighbors in the neighborhood, and so, yeah, i oppose this permit for this amplified sound, because i have been in contact
1:12 pm
with other bar owners and you know what, they don't turn down the sound. how many times have i called the police and nothing, no action is taken place, so i'm very skeptical when you say that there can be limits. i am disillusioned there can be limits put when these permits are granted, so i absolutely oppose this permitting so i'm not a supporter of this. >> thank you lauren. that's the only hand raised. >> alright. public comment is now closed. commissioners, any other comments here or are we ready for a motion? >> i guess i have a question for staff. is there any history of complaints in this location with this owner
1:13 pm
or prior owner? i think that is for deputy director azevedo. >> now, we don't have a history of complaints through mission street. >> okay, thank you. >> just remind the general public, for noise complaints, best to call 311 because that is how we understand and track and monitor and any noise issues. >> do we have any motions? >> i motion to approve with staff recommendations. >> seconded. >> okay. [roll call] >> congratulations, your llc has been approved and you can just follow up with staff on next steps after
1:14 pm
this. moving to the next item. >> i am watching president bleiman mention the room on the video, so i'll keep going. the next permit on the agenda is for a billiard parler permit and place in entertainment change of ownership including outdoor amplified sond on the rear patio for 834 erving inc. this premises is [indiscernible] from the office since 2011. under the previous ownership and held a active poe since 2003. the new owners who is the owner of the building is reopening the bar and would like to keep the permit to host dj, musicians, bands, comedy and drag shows. senior inspector will set a

sound limit. includes the ability to host outdoor amplified sound mainly for sport said game, monday-friday, 10 a.m. to 6 p.m. and [indiscernible] not to exceed 10 hours per day. the owner applied for permit for single pool table. the owner notified all the commercial and residential buildings, including those in the rear of the business. no opposition received and in the file you find nearly hundred signatures of support for the application. sfpd taraval had no added conditions and here to speak with you tonight is owner martina mcgrath. >> evening commissioners. martina mcgrath applying for place of entertainment 834 irving. there is a place of entertainment permit at that location going back to 2003. i myself operated the bar,
1:16 pm
business from 2005 to 2008 and had a entertainment permit at that time. during my time over the last month canvasing the neighbor neighborhood and speaking with business owners and residents, the general consensus is people want to bring music back to 834 irving known as the black born tavern. i received a lot of nice comments from the neighbors saying they would be excited to have it back there again. >> alright. >> questions? >> no. >> i don't have any. do you? >> i'm in the neighborhood. excited for you guys to get that going. >>eme i'm as well. was there a few months ago and excited to get that place going again. >> thank you. >> you can have a seat. we'll open this to public comment. >> thank you.
1:17 pm
>> no public comment. >> we'll close public comment. do we have any motions? >> i move to approve with staff recommendations. >> i second. [roll call] >> alright. congratulations. moving along. >> the final permit on the regular agenda is llp permit that includes out door amifyed sound for chachacha, the former owner held a llp permit for this business but closed a few years ago during the pandemic. the new owner intends to use the permit for live jazz, small bands, comedy karaoke and dj. [indiscernible] not to exceed 6 hours per day.
1:18 pm
the owner conducted neighborhood outreach and notified all their neighbors of the permit application and there was no opposition and in the file you find signatures of support. sfpd had no added recommendations. here to speak with you tonight is owner, onur ozkaynak. >> i'm the new owner of cha cha, cha restaurant and sure you all have been in the front of the [indiscernible] been around 40 years. i have a video i want to play.

[music playing in the background]
1:20 pm
>> the band and cha cha chathe restaurant have a lot of common. [indiscernible] both are accompanied by live music that is spicy. both are a ton of fun and [indiscernible] as a group and individual. the first [indiscernible] wonderful and easy. i want to bring back the old cha cha cha vibe to mission street and i want to do my part to bring all mission life back since we lost it during covid, and i will give our commit [indiscernible]
1:21 pm
and of course, the neighbors to do our own part to bring more people and hire more employees and just bring back the old mission life to our community. as you saw in the video, i don't want to be a night club, i just want to offer music to our patrons. >> questions? having done business next door to you for 12 years, i am well aware that that area needs to constantly work to get people to it as opposed to other parts in the neighborhood, especially on valencia where they just open their doors. groups wander in. not with the bike lane.
1:22 pm
that ruined everything. anyway, i'm very supportive of this. you can have a seat and we'll open this up to public comment. any public comment on this item? >> no comments on this item. >> close public comment. any motions? >> move to approve with staff recommendations. >> seconded. >> alright. >> [roll call] >> alright. congratulations. been approved. we can move on to agenda item 9. which is discussion and possible action to amend the permit conditions of a place of entertainment permit ec-1665icize cavana located at 108 channel street.
1:23 pm
>> this item is regarding the permit for cuvaughania. the permit holder requested to amend the permit conditions. utilizing higher sound limit every sunday 5-8 p.m. the outdoor events which feature a [indiscernible] they were exceeding their allowable sound limit. the permit holder requested to appear before the commission to request amending the permit conditions to allow for special events on sundays from 5 to 8 p.m. with a louder sound limit. prior to the hearing the permit holder posted a yellow notice to the public for 30 days and they alerted the commercial and residential neighbors of the pirmt amendment via outreach mailersent by a mailer service. there was one letter of opposition which is included in your file
1:24 pm
for review and note [indiscernible] and they also contacted the permit holder directly but neither received a response back. the staff recommendation tonight is to approve the request for the sunday special event at higher sound limit at distance of 250 feet outlined in police code. inspector [indiscernible] will take the sound measurements sunday, september 22 when the band is at the venue. i notified sfpd southern station and just moments ago got a e-mail back saying he had no concerns with the amendment request. here to speak with you tonight are the owners john and anthony. >> thank you commissioners. my name is john park. i am owner of cavana restaurants and white chapel in san francisco. a latin american cocktail bar
1:25 pm
at the zuma hotel. we have been hold ing this amazing event that occurs most sundays 5-8 p.m. and end sharply at 8 p.m. the events is taking place on the terrace and when we first moved in there wasn't this development and the building wasn't built yet. we think through the development and occupied buildings that has been there, it is ricocheting music we were not anticipating. we also feel sound we received originally were really low to the point we know decibel levels are probably the level with the trolley go by or giant game is happening or chase center has events so we feel we are a little handicap. the band uses one single
1:26 pm
amplified speaker, we dont use a house speaker and amplifying music in a very small terrace maybe the size of this room or smaller. that being said, this event is incredible. i have been in nightlife and entertainment industry decades in san francisco and this is an amazing event. culturally motivated and fueling the community, the dancers, the local neighborhood and supporting small business in mission bay which sundays are sleeply, there isn't an event there. when we receive complaints, we responded very quickly whether due to the hotel or phone line and proactive adjusting levels even though the customers are like why did you turn down the music. we have done our part to make sure we address. we also for example in the presentation we will show you, the different
1:27 pm
efforts we made to monitor the sounds throughout these events when we have them. not because we receive a complaint but to continue to monitor on our end and proactive know where our sound levels exist in the different corners of the city and surrounding area. we are here to request special permit. it isn't going to 10 or 11 or 12, it ends at 8 p.m. it is sunset event and it such a beautiful event. we put out-we didn't put, the community of the dancers and the event supporters put out a petition to continue this event and we by surprise received 300 plus petitions to keep this event going and that is how strong the event has been cultural and community speaking. i really like you guys to support this event if you can and i'm going to give the microphone to anthony to
1:28 pm
discuz our effort that has been on pp going to mitigate sound complaint and monitor our sound level. >> my name is anthony the operating partner for cavana. i'm essentially the daily general manager. i'm on site for all events we host. we make a effort to be responsible operators. we do host a couple dj events on friday and saturday. these are generally 3 hour events so it is a part of our control is typically only book events on the weekend and try to limit them to 3 hour events rather then extended length events which we know can be bothersome. a event that started organically, we employed ed guardo who today. they have been playing here in san francisco 30 plus years. a very well established salsa
1:29 pm
band. when we started this it was early 2023 and there was--we experienced poor weather so started indoors and all most within the first month the amount of local support at this event quickly grew. the attendance grew beyond or capability to host indoors so came up with new ideas how to manage this. what happened is we couldn't function inside, they took over the entire interior and it got to the point staff couldn't move through the move. if a guest attended that want there for salsa sunday were impacted by it. the terraces break out north to south and the south terrace is a large space that can hold 150 people with no furniture and so our idea is move them to this area and designate away from the general population of the bar and
1:30 pm
so if guests did not want to be a part of it it wouldn't so heavily impact their experience. once we moved this band outside, the event exploded beyond our control. on a weekly basis 200 attendees plus that show up just for this event that travel from east bay, as far out as modesto and south bay as well. this isn't just a mission bay event, this has become a culturally important event in the community which is incredibly supportive of us. after moving to the south terrace we began experiencing a couple complaints and then it became regular complaints and unfortunately these were anonymous complaints on 311, but looking at the language it all most felt to me and to my partner this event, the complaint we were seeing was likely the same complainer over and over, but not able to connect with them directly. we did circle the neighborhood.
1:31 pm
we went to all our sistering-neighboring apartment complex. we mailed out 952 addresses in the mission bay area with a notice of our intent for this program and encouraged anybody who contested or had issue they reach out directly and we did as mention said have one person reach out. the 952 letters sent and i did respond immediately. i forwarded the e-mail to kaitlyn, kaitlyn responded and the person did not get back in touch with me. my general philosophy is, if someone in the neighborhood is effected by something we are doing we want had hear them and cooperate and adjust any way we can. we are big proponent of maintaining a healthy relationship with our neighborhood. this event is more for the community.
1:32 pm
on a financial benefit level, most cases it is a bunch of people dancing but not drinking or eating, but the energy in the room is so special that we really wanted to keep this going. after the continued complaints we received an e-mail from the commission they had finally taken a reading that we were not able to be compliant with. i should mention our decibel levels is 76 decibels which is the sound of the blender. it is all most impossible to host a live band with 150 plus people in the room under those limitations, and so we realized we could not make this work under those limits. that is when we discontinued and when the community created this petition, which motivated to talk to you and see if there is a opportunity to create a special permitting for this one event outdoors and look at our decibel limits because we are a big space and are struggling to maintain that,
1:33 pm
but we have been in constant communication with kaitlyn and entertain commission trying to be compliant and that is high priority of ours. we want to be good and responsible operators, so this is really the reason why we are here. we do decibel readings before every event. a sound check with the band to get set to a level that should be compliant. i think the only time we had actually metered with a inspector when we were over, it was at 84 decibels. we are not far off, but it is a challenge when we get to the crescendo of the night to maintain the limit. we do take readings on the hour throughout the event. we are taking at least 4 readings a day with those bands. again, we have limited this to 8 p.m. sunday once a week and the band doesn't play every sunday. we are asking for the option to
1:34 pm
be able to do that, but we only do this event with edguardo. we don't bring another band. there are times we only host the event twice a month. during the summer we want to work and maintain a regular schedule and love the ability to continue the event so why we are here today. we did also bring in just a couple video clips to show what the looks like. the intent is host outdoors and will continue to do indoors in the winter. and remove the furniture to maintain this, but for us, the real most enticing thing is sunset outdoors on the terrace. it is such a special experience. the band itself only is comprised of 3 to 4 members. five biggest. [music playing]
1:35 pm
all the events are mostly acoustical. they have a keyboard player also miced and those go through one single 10 inch monitor. it doesn't go through the house sound system to minimize the sound. the congoes are han drums. not amplified. the same as the stand up base. our feeling is that [indiscernible] [music playing] upscale event that is fun and beautiful. we are not trying to request a lively massive huge rock and roll band cht this is beautiful music that carries through the neighborhood and hope can be appreciated, versus seen as a nuisance and in general majority of people support the event. [unable to hear speaker over
1:36 pm
music] these are a [indiscernible] this isn't a heavily amplified event. we have done regular reporting so check with the entertainment commission. there was a time when we were receiving regular complaints through 311 where they would do sound readings and we began to take our own sound readings and e-mails to the commission ahead of time during the peak of these complaints. i would say, i think entertainment commission can speak to this. i think there was one warning out of multiple visits of them attendeding where we were unable to achieve that level. every other time we were found to be compliant. we are not ever trying to push the limits beyond what we can actually do,
1:37 pm
but it has gotten to the point we know the scale of this event we just need some slight adjustment in terms of what we are able to permit mptd >> i think we get the just. if cool with you, i like toope open up to public comment. we might have you up if there are more questions. from the first comment to the last comment. >> great to see you in action. >> my name is edguardo, the performer at cavana. i want to say a couple things.
1:38 pm
i was going to get the speaker from my car because i have it in my car. since i can't get into security, i like to show, this is bigger then the speaker that i use for my vocals for my musician vocals. [indiscernible] i just want to say that we only amplify our vocals. you heard it there. it didn't sound or look like a very loud place. i also want to also utilize this as a second piece that i want to show. these are ear plugs. i'm 64 years old and don't want to have [indiscernible] sometimes my friend say, what are you playing next and have to go to this because i put these on. i care for my ears as much as i care for all the customers and people that come to see me play, including
1:39 pm
the ears of the particular person that is sending the complaints. i understand and feel that. i take care of my ears. to summarize what i want to say, in the bay area there was a history of latin music every day of the week. maybe 5 years before the pandemic, mondays there was [indiscernible] tuesdays there was glass cat on 4th street. wednesday there was the down low [indiscernible] played in all those clubs, including cha cha cha. i played at the haight location many years back. on thursdays and friday and saturday there was cafe [indiscernible]
1:40 pm
and sunday el rio have music sundays and now only twice, sometimes only once and sometimes we dj, especially after the pandemic. the point i'm trying to make is that the bear bay area is starving for an event like this. it is free of charge. doesn't mean it will be for that. it is a great opportunity. that is why it was so successful so quickly. during 2023 i was approached by cavana and i did three months of the whole summer without complaints or possibly no complaints that came to me. when the complaints come out in 2024 i turned the speaker towards us and use as a monitor. i want to close by telling you, imagine you are in a drone and go up and see this event, 17 floor is down the street. one block and a half. it can't be that loud to

1:42 pm
mission rock so the residential building within the new development neighborhood of mission rock. i like to say, this development came to a finish, we have worked closely with with events and partnerships. i can advocate cavana is for the community. this event brought so much liveliness to the neighborhood as mission bay as a whole is developing it self and there isn't a ton of places on this side of town that bring together people the way cavana does and i have family members and friends that come outside the bay area just to experience what cavana gives you, which is laughter, dance, great food, great drinks. it is place to be and i think that if you kept this it would be a great addition to the neighborhood and just like anthony said, we are between oracle park and chase center
1:43 pm

business separate but vertically adjacent to cavana. i am here to express strong support for the amendment of the permit. these events cavana puts on are much more then just fun evening of music and dance. they over time have become a vibrant cultural gathering that brings people from all walks of life together. it is much more [indiscernible] when we first constructed the project and exactly the life san francisco needs today. i also note this location is on the roof top bar on the 17th floor much higher then the standard ground floor location that the permit is typically-the permit conditions are typically written for. to extent the noise impacts are mitigated by the fact there is physical separation. urge you to approve the amendment and help our community continue to thrive through the uplifting events.

thank you. >> thank you jeremy. >> we'll close public comment. staff can you remind what we are voting on here? complete sound retesting of the sound levels or resetting or just special event for this one item? >> requesting to keep the existing permit conditions and then add in two additional conditions, which allow them to have special events that are on sundays on the south terrace from 5 to 8 p.m. utilizing a higher sound limit that would be measured at distance of 250 feet. >> got it. if we want the operator mentioned they might want to revisit the sound level because maybe the level has gone up since theest latime we checked. is that something we have to

[music] >> really special, because of the rich history of service and that service is rooted in resident centered care. addressing the needs of the whole person. it served generations of people probably in some pretty dire times of need. for more then 150 years, laguna honda has sort of woven itself into san francisco's history. when we heard that laguna honda didn't regain our certification, our hearts sank. >> in april 2022, the center for medicare and medicaid, cms, took away laguna honda participation in its program, which is extremely devastating. participation in the cms program is the way laguna honda is funded and able to keep its doors open.
1:55 pm
laguna honda takes that very seriously and we report incidents appropriately, and cms and [indiscernible] come out to review those facility reported incidents. what happens during that is enforcement cycle begins and the cycle is only 6 months, so any time there is a deficiency noted you have to train all your staff and the expectation is you get 100 percent of staff with training and the entire time the clock is ticking, there is no pause on the clock. >> our office legal strategy to figure out that we could through the federal government and the actual lawsuit itself, was a important part in allowing the facilities to not transfer any resident out of the facility and also to buy additional time and funding for another year to allow the facility
1:56 pm
to do all the important changes that are necessary to resociety in medicare and medicaid. the settlement agreement didn't just expend the funding and the pause on transfers, it also set out fairly stringent requirements for improvements that laguna honda had to do. cms and cdph survey the survey which means they inspect the facility. any sort of interpretation and advice around the surveys, around inturperateing the laws and regulations that applied to the facility, we were all-- >> after each survey we had, we identified gaps in knowledge that needed to be closed before our next monitoring survey. the turn around was pretty intense, but we had to do it because of the timeline with the recertification, and

we had 1300 staff on average go through different modules. everyone has a role in this building to help contribute to the best care of our residents. kitchen staff, security, people who are not traditionally thought of in skilled facilities who are a huge support to all the clinical care and it was really exciting to watch the whole community come together. >> the relationships with our federal and state partners, the center and medicare and medicaid service and department of public health, so important. the open lines of communication we had with them from the very beginning is going to serve laguna honda very well in the long-term success. >> congratulations to teams from department of public health and city attorney office for leading the fight to save laguna honda hospital. >> together you helped secure the future of a critical piece of our healthcare safety net.

>> we celebrate front line staff and union partners mptd >> we are in ah of your and responding to a challenging situation can such grace, compassion and tenacity. >> gratitude to residents and their loved ones throughout recertification. >> the future is bright for laguna honda hospital. >> congratulations! >> hello. i'm jaime gutierrez. san francisco is a marfbalist city full of diversity and culture. district 9 is a embodiment of diversity. the mission showcases latino

culture with mural street vendors and cuisine. buno heights is aging hippies and young families. [indiscernible] most people know neighbors and value a sense of community. portola is mix of old native and new residents around the world. all these district 9 neighborhoods exlempify what is great about san francisco. yet the neighborhoods are under economic stress. a shortage of housing and exorddant rent. we need a 2 prong effort to address housing. first, provide rental assistance to service workerss working immigrant families and elderly until affordable housing becomes available. second, home owners option to convert homes to duplexes providing zero permit fees. encourage more housing and promote [indiscernible] anchored to properties rather then corporate landlords

that care less about tenants. the city problem about crime is because policing isn't seen as honorable profession, therefore as recruitment and retention tool, i propose a gi bill style solution as incentive to join the sfpd. overlooked obligation is elder care. many in the community are over 60 years old. i fight to insure budgets are not cut to critical services. what is needed for san francisco is a leadership that is not part of a political machine. district 9 needs leadership with unique perspective that is not thriving and here to stay. i am that leadership. vote for me. thank you. >,
