denied the baby even lived there. >> the police just speaking to the officer, you know, she says we have -- the way how the body was positioned, they threw it out from a window that had no bars. >> reporter: the 21-year-old mother was taken to ma jakob medical -- jamaica medical center for observation and all the other family who were in that apartment or occupants of the apartment still being questioned precinct. they have been working through a language barrier but at this point they are trying to get the full story and no charges have been filed. reporting live in richmond hill, darla miles, channel 7 eyewitness news. new details now on a hit- and-run in the bronx that left two police officers injured. one of them has a broken leg. the officers responded to the call at a home invasion robbery this morning. it happened on university avenue in the morris heights section. there the officers got into a struggle with two suspects. police arrested one suspect at the scene and they are still searching for another person.

the person who called 911 was also taken into custody. the officer's injuries are not life threatening. a mother and child are in critical condition after a ferocious fire in newark. the fire began early this morning on the third floor of a home on bergen street. flames quickly spread, several people were injured and dozens of families faced the weekend without a home. today residents returning to their charred homes searching for whatever was not destroyed but grateful that no lives were lost. >> three of them, boys, and they are too young. >> how did you get them out? >> that's why i have to leave everything, i have to just bring them outside. >> and they are okay? >> they are okay. we thank god. >> the calls to the -- the cause of the fire is under investigation. new york senior senator chuck schumer fending off a lot of criticism right after deciding not to back president obama's deal with iraq.

schumer is in line to lead the senate, a major party fundraiser and while advertise decision won't likely derail the president's plan will it hurt schumer down the road? eyewitness news political reporter dave evans in the newsroom with more. >> the president said to be very unhappy with senator schumer right now, that's why schumer's decision to vote against the iran nuclear agreement is so important. he does have a major leadership role with democrats. he persuades many other members of congress and tonight schumer is laying low not doing interviews trying to explain his vote to supporters and perhaps to some -- do some damage control. >> reporter: the white house today blasted senator schumer and his decision last night to vote no on the iran nuclear agreement. >> but there's no denying that this disagreement, this difference of opinion that emerged overnight is one that has existed between senator schumer and president obama for more than a decade. >> reporter: while the political world was focused on last night's first g.o.p. debate, news that schumer would

break with the president on iran. he released a long statement one line read, i believe iran will not change and under this agreement it will be able to achieve its dual goals of eliminating sanctions while ultimately retaining its nuclear and nonnuclear power. today the white house even hinted schumer's future leadership of senate democrats could be in doubt. >> but i certainly wouldn't be surprised if there are individual members of the senate democratic caucus that will consider the voting record of those who say they would like to lead the caucus. >> reporter: schumer over the last several weeks was pressured by all kinds of groups to vote no. >> now, he came out finally with his "no." however, we are not that thrilled about it because the junior senator from new york, gillibrand at the same time said she is for the deal. >> reporter: congressman he will i don't know the ingall today -- eliot engel today he will be voting now.

criticizing democrat hillary clinton but republican front runner donald trump took his share of heat. he was the only contender saying he would still consider running as an independent. the biggest fireworks came during a clash between chris christie and rand paul over personal liberties. >> when you're sitting in a subcommittee blowing hot air about this you can say things like that. >> i don't trust president obama with our records. i know you gave him a big hug and if you want to give him a big hug again, go right ahead. >> and, you know, senator paul, senator paul, you know, the hugs that i remember are the hugs i gave to the family who lost their people on september 11th. >> many pundits agree that jeb bush and marco rubio did a solid job during the debate. on "good morning america" today, donald trump complained he was picked on and asked tougher questions. eyewitness news reporter stacey sager will take a look at more of trump's comments about women

and how they may impact their vote. >> legionnaire's outbreak may be slowing, only one person added to the list of people infected today and no new deaths. the city's health commissioner tweeted we are optimistic that we have seen the worst of this and our remediation efforts are having an impact. jim hoffer at harlem hospital where one patient is recovering. jim. >> reporter: diana, there have been so many numbers associated with this outbreak, right, the most striking one, the 10 people who have died from legionnaire's in the south bronx but the important numbers today are zero, zero new deaths and zero new cases. >> we haven't seen people with newly sick in the past week. >> reporter: it is the first day since the outbreak began that they can say that. but there is still work to be done and the state is stepping in to do some of it. >> we must get out there, root out the problem, cut it off at the source and prevent further spread so that everyone, obviously, recognizes that the

disease has diminished. >> reporter: 101 people have been diagnosed with legionnaire's disease in south bronx now but the numbers are dropping since five water cooling towers tested positive for legionella bacteria has been disinfected which may be an important lesson. >> situations like this where we have explosive outbreaks do serve to educate the public, that this is a disease that is very common, it's often difficult to diagnose and it's very, very difficult to trace. >> proactive rather than reactive we wouldn't be sitting here. >> and your client wouldn't be sitting in the hospital? >> yes and my client wouldn't be sitting in a hospital unable to walk and on dialysis. >> reporter: marvin montgomery is 36 years ago and works near lincoln hospital, one of the places that had a cooling tower that tested positive for legionella. his lawyer says since the city owns the hospital, it is the city that was negligent for not maintaining the water system properly. >> there are certain checks

that they are supposed to be doing, osha recommended checks and i don't believe the city was complying with those. >> because once they actually started looking for it, they found it without a problem? >> exactly. >> reporter: that man recovering here at harlem hospital but still so weak, he can't even lift a fork. the one case that was added to the list of people with legionnaire's disease yesterday was actually diagnosed several days ago. just wasn't added to the list until now. but the curve as they say is going in the right direction. reporting live from harlem hospital, jim dolan, channel 7 eyewitness news. >> that is encouraging to hear. thank you. officials in new jersey have released a name of the swimmer whose body was found this morning in the waters off sandy hook. 25-year-old andros vega pea disappeared while swimming with a group of friends on wednesday. authorities have been searching for him since. a park service official says a fisherman found his remains at

about 6:30 and called them. mourners gathered at a church in westchester county for the funeral of a woman found dead in her jail cell. dozens paid their respects to 42-year-old raynet turner in mt. vernon. turner died in a holding cell two days after she was arrested for shoplifting. today one of her eight children says his grief is made worse by the questions he has about her death. >> just imagine your mom being taken from you and you have to tell your little brothers and sisters about your mom and how she passed and all of that and you still don't know. >> the new york state attorney general has launched an investigation into turner's death. he says it will be i am partial and completely -- impartial and completely independent and will follow the facts wherever he lead. breaking news, in about two hours we expect to learn the sentence in the colorado movie theater shooting trial. about an hour ago the court administrator announced the jurors had completed their verdict forms. this jury found james holmes guilty of murdering 12 people

>> reporter: plenty of voters like donald trump, he is the clear republican front runner at least right now and he can afford to stay in this race no matter what. but can he afford to alienate an entire block of voters, women? and is that what happened last night? in a city with no shortage of democrats and, of course, women, just the names seem like a loaded question today. >> when someone says donald trump -- >> no way. >> i think it's bad entertainment. >> that is if they watched last night's republican presidential debate, and this exchange between trump and fox's megyn kelly. >> you have called women you don't like fat pigs, dogs, slobs and disgusting animals. your twitter account -- >> only rosie o'donnell. >> you once told a contestant on celebrity apprentice it would be a pretty picture to see her on her knees. does that sound to you as the

temperament as a man we should elect president? >> i think the biggest problem this country has is being politically correct. >> reporter: then today on "good morning america," a little bit of misremembering. >> some of the statements made about the women, i don't recognize those words whatsoever. >> reporter: but this was right after trump had retweeted a supporter who called megyn kelly a bimbo. >> donald trump didn't help himself with women but i don't think he was likely to do all that well with women to begin with. his appeal is to men primarily and to people who think it's great to just, you know, say it like it is, put it out there, not have any grays, deal in blacks and whites. that's not the way women operate. >> reporter: many of them who would agree political correctness can be tossed, but purpose cannot. >> i think what trump is doing is just straight up name calling. there's no purpose behind his comments except to kind of degrade the women that he's calling out. >> reporter: and they say at

worst, undo what the republican party has tried to build up these past few years. >> republicans after 2012 said we have to revisit this. we have to appeal to latinos, we have to appeal to women if we are going to win nationally, and now they are stuck in a position with candidates like donald trump who are making that very, very difficult. >> reporter: now, the only republican woman in this race, carly fiorina, she denounced trump's remarks and scored high marks in her own debate. problem is, that was with candidates who didn't have high enough numbers to get into the main debate. as for democrats, some experts say all they need to do right now is nothing. we are live in union square, eyewitness news. >> thanks, stacey. new at 5:00, authorities in new jersey say a burglar was caught after he accidentally dispatchers. 42-year-old scott esser of elizabeth now faces charges including burglary and theft. somerset county dispatchers got

a call last month in which they burglary. the cell phone number was tracked to esser. he was put under surveillance and on wednesday detectives say they followed him as he burglarized another home in stafford township. >> so smart, turn off the phone. also new at 5:00, the san francisco 49ers have released star linebacker aldon smith after was arrested on dui charges once again. smith was arrested in santa clara last night for allegedly driving under the influence committing a hit-and-run and vandalism. the 25-year-old denies being drunk behind the wheel. the team cut smith this afternoon. this is his fifth arrest since being drafted by the 49ers in 2011. right now overseas type typhoon is starting to hit taiwan. wind gusts up to 160 miles an hour are expected. look at those waves. they are washing ashore right now as well. mountain villages could be destroyed as this storm passes through. taipei, taiwan's major city, is bracing for some high winds and

all sorts of stuff that's going to come with this storm. millions of people hoping this storm is going to lose at least a little bit of strength before it hits them and, lee, you're shaking your head there? >> you will see. i mean, i have a loop right now on the computer and i looked at the last frame as it's starting, as the eye wall is just coming ashore and it looked like it tightened up before. it was already 120-mile-per- hour winds. it looks like it strengthened a little bit. >> is the width still the same? >> looks like it's still running about eight, 900 miles but at this point when it tightens up like a skater doing it's strengthening at this point so that eye wall is coming in in taipei, taiwan right there, taipei is on that northern tip so you ethe eye wall going toward taipei there so a direct hit. the old updates had cat 3. i wouldn't be surprised if it was closer to a cat 4 strength with miles an hour. it will go through taiwan, reemerge into the ocean waters and then hit china as a strong cat 1 or two storm and couldn't

hour loop showed some sprinkles over southern ocean county to start the morning but those have now retreated into the atlantic. two lows we are watching. one here, this is us today, another one over the weekend here, this one is actually going to go to our north or east on saturday, the good news is there's enough westerly flow out of the jet that it's pushing it offshore rather than curling it up into the northeast. the other thing is this storm isn't teaming up with these other two so that would merge into a storm that would have given us a washout today or tomorrow but not the case. this is going to actually weaken in place and arrive on sunday afternoon in the catskills has a few patchy clouds at worse would be an isolated storm. the storms are safely south and east. storm number 1 goes to the east, we are mostly sunny tomorrow and on sunday with that one skirting offshore by about 300 miles again a couple high clouds may cruise the coast. this low off to the west is weakening so a late day shower and isolated threat north and west looks great. mainly clear and comfortable overnight. 50s north and west, 68 in the city, tomorrow it's 85, sun mixing with heavy high clouds, nice and warm and low humidity.

police tried to respond in time to prevent the crash but they couldn't get there in time. >> it's hard to believe but this is yet another wrong-way crash in westchester county, that's a pretty horrendous accident. >> reporter: newscopter 7 was above the damage this morning, the highway still shut down hours after the crash. the force of the collision plain to see. a head-on crash that police say was caused by a drunk driver. it happened just after 1:00 a.m. on the saw mill river park way, police say a 22-year-old woman got on the highway's northbound lanes driving southbound. it wasn't long before other motorists took notice and called 911, but police couldn't get there fast enough to prevent the crash just south of route 120 in chappaqua. >> three minutes between the time of the first call to the time of the accident, so, you know, we assumed she was not on the parkway that long before the accident happened. >> reporter: police have charged tess kegan with dwi, felony vehicular assault and reckless driving.

it slammed into a toyota driven by an unidentified man from connecticut who had to be can you tell out of his car. both drivers were taken to westchester medical center. this is hardly the first wrong- way crash on westchester's parkways, five years ago diane shuler killed herself and seven others on the taconic state parkway. this winter an nypd detective wrong-way driver that police say was drunk. police actually have advice for anyone driving on westchester's narrow winding parkways. >> if you encounter someone that's disoriented or impaired lane, chances are they are going to be in the left lane because they think they are in the right lane. so stay in the right lane is my advice to people traveling especially late at night especially on the parkways. >> reporter: now as for the motorist who was hit, he broke his leg and his foot, suffered some internal bleeding. his injuries not considered life threatening. keyingen charged with a felony due back in court at the end of the month. we are live in valhalla, marcus solis, channel 7 eyewitness

news. tragedy on the tracks in connecticut, a metro north train striking and killing a woman in greenwich. the express train to new haven hit the woman as it traveled through the cos cob station at around 9:30 this morning. eyewitnesses say the victim dropped a wallet or handbag onto the tracks and was trying to retrieve it. the passengers on board the train were transferred to another train. a boil water advisory has been lifted tonight in new jersey for united water customers in fort lee and englewood cliffs. the advisory was issued after a construction crane crushed a 24- inch water main on anderson avenue in cliffside park on wednesday. united water is recommending customers take precautions before using the water such as five minutes. police in the bronx are hoping surveillance video will help lead to the arrest of two men who attacked a disabled man in his home. police say two men entered the apartment in williamsbridge last week, they threatened the resident with with a gun, knocked him out of his wheelchair and beat him.

the men took off with about $230 and the victim's iphone. police also want to question a woman who was seen in the video. the family of a young man who committed suicide after spending three years locked up at rikers is now planning to sue new york city for $20 million. khalif router spent much of the time in solitaire confinement after he was jailed for stealing a backpack when he was a teenager. he was released in may of 2013 and took his own life two months ago. a nightmare for a brooklyn family already mourning the death of their father. when gregory gutinickoff passed away, his family arranged for his burial at a cemetery in staten island. during the burial service they noticed a name tag on the cass get wearing a woman's name -- casket bearing a woman's name. they say they were horrified when they looked inside. >> performed the service for the woman that was actually in the casket that my grandfather was supposed to be in. at that point we came to the conclusion that it's possible

that they buried my grandfather in the resting place of the woman. >> well, crews had to dig up his casket. his daughter who was tasked with identifying her father's body says she hasn't been able to sleep since. the family is now suing the cemetery and the funeral home. the ntsb is stepping in to investigate the cause of the serious crash involving comedian tracy morgan. the government organization will review the details of the deadly 2014 accident next week. the crash involved morgan's limo van, a tractor-trailer and other vehicles. a passenger in the limo carrying morgan died. morgan and three other people were seriously injured. semi was being driven for walmart and the driver said he had been awake for 24 hours. the retailer wound upsetling with morgan. black hawk down, tonight a chicago blackhawks player on thin ice after a woman accuses him of sexual assault. the latest on the investigation coming up. plus -- >> you could lose your dream apartment to another renter in

police are searching for a man in an attempted rape in williamsberg. police say this man grabbed a 24-year-old woman around the neck, fondled her then told her he was going to have sex with her. she pleaded with him and offered him money not to harm her. the two then went to an atm where she withdrew $20 and gave it to the suspect who fled. a pro hockey player appears to be at the center of a rape investigation. >> chicago blackhawks star patrick kane reportedly has been accused of sexual assault.

police acknowledge they are investigating an incident at kane's home in buffalo last weekend. searched the interior of the home. >> at this time we are gathering information and are waiting forensic testing results. >> would not say if kane is cooperating. he has been accused of physical violence in the past pleading guilty to a disorderly conduct charge in 2009. he has not responded to requests for comment. the fbi has just released never before seen surveillance video from a half billion dollar art heist at an art museum in boston. these grainy images were taken 25 years ago. they show a night watchman letting an unauthorized visitor into the isabella stewart garden or museum. about 24 hours later two men posing as police officers enter the museum and stole 13 pieces of valuable art. >> we were unable to enhance it to the degree that we would like so we decided to ask the
