by a fellow worker at the port in elizabeth this afternoon. jones died at the scene. several agencies, including the port authority, are investigating the accident at this time. new at 11:00, james holmes, the colorado movie theater shooter, will spend the rest of his life in prison. jurors dismissed tonight, after failing to reach a unanimous decision on the death penalty, leaving the sentence in the hands of the judge. >> we the jury do not have a unanimous final sentencing verdict. >> the theater killer james holmes will spend the rest of his life in prison without parole. the jury was unable to reach a unanimous verdict for the death penalty after seven hours of deliberating. the 27-year-old who killed 12 people and wounded 70 others will not be executed. >> i think that is outrageous. i still think death is justice for what that guy did. >> the 3 1/2 month long trial was an emotional rollercoaster. for the victims and their families.

deal, all caught on surveillance videos. tim fleischer spoke to the clerk who was still shaken by the encounter in the bronx. >> i couldn't think or anything. i cannot talk. i was shocked. somebody help. i am shocked. i am still scared. >> reporter: frightened beyond belief, wendy came face to face with a dangerous thief, while she was working her usual night shift, at this laundromat. the suspect, caught on security camera, came into the laconia avenue laundromat around 9:00 thursday night. he pulled a handgun. and demanded money. at one point in the video, you can see him grab wendy. >> i had to give him money. if i don't give him, he would have killed me. that is scary. >> reporter: the suspect is wearing a zombie like mask which police are hoping is a telling clue for someone. >> give me money. this money. >> i don't know what he is doing here. there is is a mask. i was shocked. >> reporter: he forced whitney

over here to the counter and once behind it, he shoves her out of the way. >> i have to open the cash register. and then he grabbed money. >> reporter: he pulls the entire cash drawer out and shoves it into a black bag. he gets about $246, police say. and then quickly walks out of the laundromat. >> he should be in prison. >> reporter: police are hoping someone recognizes the suspect's hair or if it is a wig and the mask. as she went about her work this night, wiping down and cleaning the machines, she is relieved she has come through this terrifying or deal. >> i am still scared, you know. real scarry. still scared. >> reporter: police say the suspect got away, in a gray jeep suv, and they are looking for him. reporting from laconia, tim fleischer, channel 7 eyewitness news. a case of legionnaire's disease has been diagnosed in roslyn county, shutting down a factory where the person worked. the orangeburg complex was evacuated and the cooling

towers are being disinfected. it is not known where the workers contracted the disease. and teams will start working tomorrow in the bronx, where the outbreak is out there and they are testing every single cooling tower. >> we must rule out the problems and find the source and prevent further spread. >> 1101 people have contracted the disease -- 101 people have 10 have died. police are looking into what led into the horrifying death of a 20 day old baby found in a court yard after investigators believe he was tossed out of a fourth floor apartment window. police are questioning his parents and the people in the apartment. josh hettinger is joining us with the latest on the story. josh? >> reporter: in the last couple of hour, the medical examiner revealed this two-week-old baby boy died of blunt trauma to the head and torso. and then laid out a list of specific internal injuries that are still disturbing, i will not read them to you.

suffice it to say tonight, that they have ruled this a homicide. >> for hours, tonight, detectives questioned family members of riswon ahmad, a baby boy who never made it to his one month baby, because they think someone hurled him like a piece of trash from a fourth floor bathroom window and didn't care enough to come down stairs. >> i didn't think it was a baby. i thought somebody threw something out. but then i saw it. >> it was this woman who heard the thud and spotted the 20 day old lifeless body in a courtyard and called 911. they tried to get her to perform cpr, she couldn't bring herself to try. >> i saw blood everywhere. >> oh, my god. >> reporter: as the shock steeps through this richmond hill community, eyewitness news says that the baby's seem to show no emotion. police took the 40-year-old fath near question.

the baby's mother hospital hospitalized for observation. >> the way the baby was positioned in the courtyard that there was no possible way this a child, a 7 or 8-year-old could have thrown him out of the window. it definitely was an adult who launched the baby, threw him. and he fell down into the courtyard. >> reporter: there were two other kids in that apartment, ages 3 and 8. it is not clear tonight where they are. in the meantime, detectives from queens homicide continue to interview family members of that little boy, here at the 102 precinct stationhouse. investigators refer to this case as senseless. we're live in the richmond hill queens area tonight, josh hettinger, channel 7 eyewitness news. >> just so tragic, thank you, josh. new video tonight of the nypd officers rescuing a toddler locked in a hot car in brooklyn. the mother of the 2-year-old accidentally locked the child

ensure street stops are lawful, and to clarify a ban on racial profiling. officials say officers want more guidance and instruction about what exactly they can and cannot do under the law. new at 11:00, three people are under arrest in queens tonight, accused of trying to pull off a bizarre mortgage scheme. prosecutors say the defendants broke into a home in jamaica in april and changed the locks. they allegedly claimed to work for a bank holding mortgage company and ordered the homeowners to sign their house over to them. in order to gain access to get their belongings. now that senator chuck schumer announced he is voting against the iran nuclear deal, republican leaders are asking other democrats to follow suit. two house democrats have come out against the deal but the white house says they are still confident there are enough supporters that it passes. and it is suggested that

schumer's decision could jeopardize his position as future senate democratic leader. >> i wouldn't be surprised if there are members of the senate democratic caucus that will consider the voting record of those who say they would like to lead the caucus are. >> republicans are expected to pass the bill denouncing the iran deal but unlikely enough democrats would join them for a presidential veto. president obama will be making calls to congress this weekend looking to win support for the iran nuclear deal, even though he is officially on vacation. they arrived in martha's vineyard tonight. they rented a secluded home in the town of chillmar for the next two weeks. the president planning no public events on the island and return to washington august 23. subway riders, expect disruptions for an entire year. the a and c lines will run on the f track between west fourth street in manhattan and j street in brooklyn. the tunnel needs to be repaired from superstorm sandy damage.
