hitting the beach. but all eyes this morning are on the hoff, wondering, will he be diving in again? and we do say good morning, america, on this tuesday morning. good to have david back in for george and it is coming down out there. the umbrellas are out there. the northeast being hit by strong storms, there's a flash flood watch in effect. ginger will have more on that in just a moment. but first, the other storm that won't go away. we'll begin with donald trump's feud with fox news anchor megyn kelly, she responded saying she will not apologize. hillary clinton now weighing in. and tom llamas covering the campaign. >> reporter: two working strategies right now in the race for president. either ignore donald trump or take him head-on.

capable of defending herself against trump. >> she went after senator marco rubio, because senator rubio said during the debate, future generations will look back on u.s. as barbarians for legalizing abortion. >> all right, tom, thanks. now to ferguson the city on edge again last night, heavy police presence on the streets, you see those heavily armed officers in riot gear, dozens of demonstrators were arrested some of them throwing rocks at officer. abc's kendis gibson is on the ground in ferguson. >> reporter: tense moments on on the streets in ferguson overnight as police and protesters face off. overnight, ferguson, under a state of emergency. >> night fall now and police are already out with riot gear and

many protesters gathered across this street as you can see. heavily armed police dispatched throughout the city, arresting at least 23 demonstrators. using mace to disburse the crowd. after police say they were hit by rocks and frozen water bottles. blocking traffic and shutting down a major highway near downtown st. louis. those protests marking the anniversary of michael brown's death. residents on high alert. any moment this can turn. >> we know that. >> reporter: it can turn august augustly? >> it can turn ugly at any moment. >> reporter: people screaming, running for their lives, dozens of shots fired. >> multiple shots being fired. >> shots fired. canfield. >> reporter: even cap churlg

ferguson's interim police chief by surprise. one of the alleged shooters, is followed cornered in a parking lot. >> he's bleeding out, man, please get him some help. >> reporter: police now using state of emergency to bring calm back to the streets. this morning, police pointing out there were no burglaries, looting or shootings overnight. believing that state of emergency helped the situation. also this morning, white house assistant on leave, arrested and charged with grabbing her boyfriend's gun, a u.s. capitol police officer and firing a shot at him during a heated argument. jim avila is at the white house. >> reporter: most of the white house including the president are on vacation, but one white house staffer may not be coming back after her arrest, charged with domestic violence.

barvetta singletary, proudest moment, air force one behind her after being promoted, special assistant to the president of the united states. this may be her worst moment, this mugshot, when the white house staffer was arrested with first and second degree assault and reckless endangerment after firing a gun at her boyfriend. local prosecutors say she invited the victim to her house in d.c., the couple engaged in a brief sexual encounter after singletary questioned him about another girl, she demanded the boyfriend's cell phone, then reached into the bag where she grabbed his phone and a weapon, when he wouldn't reveal his passwords, she's accused of pointing the gun at him and say, don't think i won't use it. she allegedly fired in his direction. the white house confirmed that

singletary is under investigation saying we are aware of the manner and temporarily placed the employee in question on unpaid leave and revoked her access to the white house complex. the white house staffer is now on bail, she has been charged with domestic violence. as for the officer involved he was not charged but capitol police say are investigate zblg thank you. turning now to that toxic spill in colorado, the tainted water spreading quickly, a state of emergency has been declared in neighboring new mexico. river access expected to be closed until at least next week. clayton sandell with the story. >> reporter: they are warning people here to stay out of this water, not to swim in it, not to drink it. it may not look polluted. let me show you, it's this orange sludge and the toxins in

it that have people worried. this morning, thousands of people who rely on drinking water from two polluted western rivers now told it is toxic. >> avoid showering. don't let the livestock drink it. >> reporter: after an epa cleanup crew accidentally released more than 3 million gallons of toxic sludge last week from this mine. governors of colorado and new mexico have declared states of emergency. towns are shutting down pipes that normally take clean river water into people's homes. >> where i live it's all basically living off the wells. >> reporter: the plume turned the normally clear water to yellow. traveling hundreds of miles from colorado to new mexico, to utah now to arizona. . the epa is testing the water. using fish to test the health

guiding those planes may not be getting enough sleep. david kerley with this report. >> reporter: concerning how many these controllers admitted to being fatigued and the faa has had this report for nearly four years and kept it under wrap until the associated press pushed the agency to release it. kroerl fatigue, examples, tennessee, pilots unable to reach the tower on approach. >> yes, sir, we're trying to get a hold of knoxville approach or knoxville departure. >> reporter: similar situation in reno. >> can't seem to get a hold of the tower here. >> reporter: at washington's own tower, controllers asleep and jets landing without guidance. >> tower is apparently not manned. made a few phone calls, nobody's answering. so you can expect to go in an

uncontrolled airport. >> reporter: prepared back in 2011, controllers come piling worrying statements. 70% caught themselves about to doze off on the midnight shift. some wore wristbands or admitted to getting less than six hours a night or less than four hours before a midnight shift. >> lack of transparency on the faa discussing this. >> reporter: the faa has made changes. but quote, fatigue is an issue in a any around the clock occupation. among those changes the faa now requires two controllers in a tower on that overnight shift, it used to be just one, david. >> that's good news. david kerley live in washington.

right over to amy robach with the breaking headline. >> a u.s. military jet has crashed in southern germany igniting a fire, you see the smoke rising from the scene, the pilots survived by parachuting to the ground. the cause of the crash is still unclear. new concerns about the wildfires raging in northern california, the latest fire, the so-called jerusalem fire has now burned more than 6,000 acres, more gusty winds are expected today and evacuations are now mandatory. three firefighters were injured battling another blaze in southern california. in oregon, a brushfire spread to this train trestle, crews say it may burn for days. and overnight, japan restarted one of its nuclear reactors for the first time since the fukushima meltdown caused by the earthquake and tsunami four years ago.

was a big misunderstanding. it turns out he's a local pastor who just got a little lost. finally, anyone who rebs that nerve-wracking day at the dmv. the test driver ended up not driving to the dmv but through the dmv. she's okay. no one was hurt. just her pride. she jumped the curb hitting the gas instead the brake, shattering all those windows. she's going to come back another time. >> that would be wise. >> and a different staff on duty. >> maybe. >> a different office. now to scary moments at the beach, a little boy playing in the sand, trapped, a cave he was digging suddenly collapsing on top of him.

people racing to save him. story. >> reporter: this morning, a 12-year-old boy recovering after an avalanche of sand fell on top of him. knocking him unconscious. life guards and bystanders rushing to yank him out. giving him cpr. air lifted to a local hospital where he's currently in stable condition. the boy was digging deep holes, an activity that investigators say eit can give way. these accidents can often be fatal. dozens of beachgoers desperately trying to pull him out using anything they could but it was too late. 2011, this 17-year-old survived

7:43. we're back now with that deadly bear attack in yellowstone national park. they have caught the mom and cub responsible for mauling a man. also, a mother lucky to be alive after her encounter with bear in virginia. abc's kayna whitworth has the story. >> reporter: this morning, yellowstone national park officials say they have captured the grizzly bear and her cubs that attacked 63-year-old lance crosby. if officials confirmed the bears killed the montana native, they will be put down. to protect the 3.5 million people who visit the park each year. >> i don't like all the bear stories i have been hearing, so we had to come back. >> reporter: officials tell me there's only been eight deadly bear attacks here in the last a hundred years. when you come face to face with
