39 miles per hour at j.f.k., 30 newark. 35 teterboro. 17 white plains. in and around some of the cells pushing through and the rain is out here at islip where the wind gusts are 41 miles per hour. as we go into the afternoon, we will look at another shot of a shower and thunderstorm possibility as we go into the afternoon as much of the rain has pushed eastward across suffolk county and around coastal connecticut. back here in eastern pennsylvania, a couple more lines of showers and thunderstorms. now, our futurecast, our guidance is showing that some of that actually could pop up again later on in the next few hours this afternoon. so, if you are on the l.i.e. to the eastern end, we are looking at showers and thunderstorms that are on the heavy side. so far the rainfall over an inch in the park. an inch and a half in white plains. an inch in islip. futurecast shows more cells popping up in central and northern new jersey around 1:00.

watch how they build to 6:00 this evening. showers we can have another round that could be heavy even outside, you know, the flood watch, the flash flood watch that we had until 4:00. there could be flooding issues into the first part of tonight. we will talk about that in the accuweather forecast coming up. we are not done with this yet, david and shirleen. back to you. >> it's causing problems. the storm knocked down trees and power lines in queens. some homes are without power in the douglaston section. eyewitness news reporter a.j. ross is there with that part of the coverage. a.j.? >> reporter: shirleen, you can see con ed crews are very hard at work on 54th in douglas town after this huge tree came toppling down a couple of hours ago bring wearing it several power lines. that's why police have us at a distance for our own safety as crews work on what were live wires a short time ago. now here is a closer look at the damage. this morning's heavy winds and

rains caused this when the tree toppled in the middle of the road. it's an old and large tree. fortunate no one was significantly hurt. a large portion of caution tape was set up as crews noticed live wires nearby. they shut off power as they work on the downed lines and 60 customers in douglaston are affected. >> i noticed the police were here. the tree was down. about 10 minutes ago con edison took the power out to do repairs on the lines. >> everybody on this road lost the power. we are all connected to this line. so, we all >> reporter: what you are looking at now is one of two crews on this side of 54th avenue. there is another crew on the other side of this downed tree. they are keeping everyone, even residents at a distance or asking them to stay there r in their homes because of the power lines. they are trying to ensure the

area as safe and restore power as soon as they can. we will have another update at 12:30. a.j. ross, channel 7 eyewitness news. >> a.j., goes thank you. now let's take a look at the storm photos eyewitness news viewers shared with us on social media. keep them coming. send us your pictures and video using the #abc7ny. we have new details on the deadly crash that injured comedian tracy morgan. federal investigators in washington said the driver of a walmart tractor trailer that slammed into the limo carrying morgan and his friends last year had been awake for more than 28 hours. eyewitness news reporter n.j. burkett in the newsroom with the details. >> reporter: driver fatigue, victims that didn't wear seat belts and botched emergency response. those are the troubling re -- findings of the safety board investigation. it begins with the crash itself. the trucker was awake for 28 straight hours.

according to the ntsb's reconstruction, was barreling into a construction zone at 65 miles per hour. he jammed on the brakes less than two vehicles before impact and the five back seat passengers were tossed like rag dolls. tracy morgan and his entourage were not wearing seat belts. james mcnair was killed in the crash. what is more, the volunteer first responders from heights town, new jersey, took 19 minutes to reach the scene and because of the severity of the crash, it took another 37 minutes to get the victims out. >> as they got them out they didn't have enough basic life support units on scene. that delayed the further delivery to the hospital. >> the fact that during the response to this crash emergency medical personnel moved injured individuals who were not appropriately i am mobilized is evidence of a training problem or a lack of oversight.

>> reporter: some claim it takes more mandatory training to become a cosmetologist in the state of new jersey than it does to become a volunteer first responder. the trucker pled not guilty to a variety of charges including death by auto. we will have much more on the crash investigation on eyewitness news "first at 4:00." . >> thanks. new at noon, charles schumer revealed his plan to get construction on two new hudson river rail tunnels off the ground. the senator wants to create a development corporation to plan and finance the ram track gateway project. it will build two tunnels from new jersey to new york city replacing current tunnels which are old and damaged from superstorm sandy. sherman says the gateway project will cost upwards of $20 million the development corporation will help get those funds. >> this is the best way to access the various parts of public funding, specifically federal funding. >> the senator says without

this project, the entire rail network on the east coast could be disrupted and cause economic chaos for the country. more unrest in the streets of engineering, missouri. protestors and -- in ferguson, missouri. protestors and demonstrators face off. officers made 23 arrests overnight. abc's brandi hitt is in ferguson with the latest. brandybrandy? >> hi, shirleen. we didn't see a repeat of the violation and gunfire from earlier this week. overnight a heavy police presence on the streets and more confrontations that lead to more arrests. police and protestors face off again on the streets of ferguson, missouri. overnight officers in riot gear used mayes to break up demonstrations after police say they were hit by rocks and frozen water bottles.

armed citizens were out in public. they claim to night of looting. >> trying to get a decease and -- crease and desist. >> reporter: -- cease and desist. >> reporter: it follows days of protests to mark the one-year anniversary of michael brown's death by ferguson police officer darren wilson. demonstrations turned violent sunday with this gun battle erupting between two rival groups. >> shots being fired. >> reporter: plain clothes officers claimed one of the gunman, tyrone harris, shot at them in this parking lot. when they returned fire critically wounding him. >> he is pleading out. get him help. >> reporter: the area is under a state of emergency in the hopes of bringing calm back to these streets. if there is any good news, there were no gunshots overnight, no property damage, no looting.

a swimmer pulled from the ocean in sea bright, new jersey, has died. the 18-year-old from rockaway has been identified as kevin seafrost. he was with a group when they

went swimming yesterday. the two lost control and lifeguards stepped in to help. after being pulled from the water and having cpr performed he was rushed to the hospital. he decide a few hours later. you never know what some people can't live without so much that they will steal for it. the heist of the day involves a case of soda. the crime was captured on east 153rd street in the bronx. not one but two thieves walking off with multiple cases of soda. they took it from a coca-cola truck and haven't been seen since. a car crashed into scaffolding on amsterdam and 69th street this morning. the driver was not seriously injured and nobody on the street was hurd. police have not said what caused the driver to lose control. actress kelly rutherford appeared in manhattan supreme court without her two children, violence of a court order.

the judge told rutherford's attorney she was not in compliance. attorneys for rutherford and her ex-husband will argue over whether her two children should be returned to their father in monaco. she refused to send them back last week. she claims she has no legal obligation to give the children back to their father. >> my priority is their safety and well-being. as their mother, that's what i will continue to fight for. we want to see each other and be together. they are very, very young. >> when the couple divorced six years alleges, a california judge order -- years ago, a california judge ordered the children to live with their father temporarily. she says it has become a permanent situation. air traffic controllers, how fatigued are they? is it putting us at risk when we fly. >> a strange sky chase. why police were anxious to stop this daring guy and what he has to say about it.

this wildfire is several miles south of a massive rocky fire in california continues to grow. the jerusalem fire started sunday and has scorched 6,000 acres. it forced the second evacuation of residents out of their homes.

crews are worried it could eventually merge with the rocky fire which has already burned 70,000 acres. back in our area, bill evans has been busy tracking the storms. >> it's day where we see a two- pronged attack. sometimes a system comes through in the upper air support and in this case as we get the sun working in august, on top of the thunderstorms, the sun is not out right now but above it the sun is working its magic and it could fire up a few thunderstorms toward the everything commute. as we look across the park and to the jackie onassis reservoir, we have cloudy skies. nimbostratus clouds and off to the east, way off to the east you see the kind of clouds that are dark. we have been looking at rain that pushed eastward of the city now. this is the camera at 4 time's square looking south. we have rolling clouds,

nimbostratus clouds, nimbo clouds. through the afternoon some thunderstorms could produce flooding around the area. even though a flood watch has been canceled for the afternoon, in the discussion they say, goes well, there could be a thunderstorm on the heavy side that could produce some flooding rains for the afternoon. that's something we have to watch as we go into the afternoon and the evening hours. we look at a threat of a shower and thunderstorm that could be quite heavy this afternoon. for the afternoon, clouds and eventually what we will find ourselves looking at is the thunderstorms developing around 3:00, 4:00 this afternoon. jeff smith will be here this afternoon looking at that. the afternoon will feature the thunderstorms on the heave side. right now a temperature -- heavy side. right now the wind is out of the south pull up the -- pumping up the moisture. air quality will be good. u.v.

index will be low to moderate with the clouds and low 70s from brookhaven to east hampton, 73, 74 down the shore. everybody is in the low 70s. the wind gusts around the thunderstorm cells working their way through have been high. now in islip 4 miles per hour wind gust. rain from northern branch, southern branch here and right around the south shore a couple of heavy cells out to the hamptons and bridgeport eastward. that will continue for the afternoon. other rainfall amounts newark 11-inch of rain -- 1 inch of rain. there could be more popping up around 4:00 are a shower and a thunderstorm that could in isolated spots produce some flooding. there is not a flood watch in effect. there is that chance into the evening. tomorrow we start off with sunshine. a front will swing through the area. a couple of pop up sprinkles in the afternoon. it's drier air out of canada sweeping in.

that will be a game changer for the end of the week. 80 for the afternoon. still we have a threat of a shower and a thunderstorm. early storms and then partly cloudy skies tonight. the overnight low 7 o, sun and clouds. warm day 85. a spotty shower in the afternoon. the accuweather seven-day forecast, thursday and friday a couple of greats days, up to 87. humidity makes a come back for the weekend. highs will be in the 80s. there could be a chance when you get the heat and humidity, a pop up thunderstorm in the afternoon. saturday is looking hot. 88 in the city. 90 west of so there you go. i would keep the umbrella handy for the afternoon. going to citi field or the game tonight, take your rain gear. it may not cancel the game but delay the start if there is a thunderstorm around. an aide of president obama accused of firing a gun at a capitol police officer. what police say set her off.

days for theft after her sentencing she asked if she could use her cell phone to call home. that's when she made a run for it. she ran down the stairs, out the front door, into the parking lot and when she hopped in her car, she put it in reverse and backed up over the bayliff's leg. he suffered minor injuries. when she is caught, she will face more time behind bars. next a box truck got loads of attention from the california highway patrol as it barreled through the los angeles freeway network. it was packed with an illegal load of diesel fuel hitting speeds of 75 miles per hour. the driver finally headed to the shoulder, slamming into a guardrail and bailing out on foot. his get away attempt did not work. police had plenty of main power and a helicopter above to keep the driver from out running them. >> a different kind of police chase in california.

a sheriff's helicopter going after a motorized hand glider -- hang glider, that is. los angeles deputies say the man was flying too close to a prison. they became concerned he was trying to deliver something there so he was ordered to land. police detained and questioned him. the pilot said the wind accidentally blue him toward the jail -- blew him toward the jail. he was later released. >> excuse me, that is a prison. >> you may not want to go there. >> no. >> not where you want to go. >> thanks a lot. he crossed the grand canyon and niagara falls. tonight nick wallenda will make the most daring walk yet, 1600 feet across a tight rope suspended 118 feet high. that the will be the longest walk ever. he is doing this at the wisconsin state fair. so, is he nervous? >> what you call fear possibly, i call it respect.

nearly a dozen people charged. our top story this afternoon, the ntsb releasing its report on the deadly crash involving comedian tracy morgan. investigators say the driver of the tractor trailer had been awake for more than 28 hours. morgan was seriously hurt when the truck hit their limo. his friend james mcnair was killed. >> more unrest in ferguson, missouri. overnight 23 people were arrested. they were protesting the death of michael brown who died one year ago. sunday night during the protests, two rival groups not connected to the demonstrators got in a gun battle and one person was critically hurt.

we are tracking rain moving across the tri-state area today. the storms are causing flooding and bringing trees down. hello again, i'm shirleen allicot. >> i'm david novarro. here is a look at central park where the rain has let up but at times we are dealing with wind gusts as high as 30 miles per hour. >> we have two reports. a.j. ross is in queens where trees and power lines are down. first an update on the exclusive forecast with meteorologist bill evans. >> it looks gloomy and it's humid. temperature at noontime, 72 degrees. by the time we go through the afternoon, we will continue to see what will be more in the way of showers and thunderstorms across the area. these showers and thunderstorms at times are going to be heavy this afternoon. these thunderstorms coming are not going to be as numerous as this morning. we had over an inch of rain in a lot of spots. more thunderstorms are possible as we head through the afternoon and into the evening hours. i think we will see a chance of some of the heavy downpours could be across the area north

evening commute. we will talk about that in the seven-day forecast in a moment. we have seen trees falling in part of the tri-state area. >> eyewitness news reporter a.j. ross is live in douglaston queens with more. >> reporter: nearly 68 people are without power at this hour after this massive tree came crashing down in the middle of 54th avenue bringing with it several power lines. con ed crews were hard at work the past several hours cleaning up downed live wires and trying to repair other damaged lines. this is a closer look at the tree that came crashing down shortly before 9:00 after heavy winds and rain forced it to up root. neighbors say it was an old and large tree leaning toward the road for several months. it's fortunate no one was significantly hurt. a large perimeter of caution tape was set up as crews worked to control live wires.

con edison temporarily shut off power as they work on the lines. several neighbors are worried other trees in the neighborhood that long needed to be cut or trimmed will present future problems. >> the forest department needs to maintain the trees around here. there are trees that need trimmed. there are dry branches on them and people have been calling them but we feel that they should be more responsive, the forest department here. >> reporter: this is obviously an ongoing process with con ed trying to make sure that the area is safe and ensure that the lines are not a danger to anybody and of course restore power. then they have to get crews in here to cut down the tree before they can open the road. they are asking people that live in the area to stay in their homes or give them the room they need to continue their work. a.j. ross, channel 7 eyewitness news. >> thank you, a.j. new at noon, nine people are charged with an

international insider trading scheme. officials say ukrainian hackers stole unpublished business press releases. then security tradessers traded stocks on the information before it became public. officials say the defendant dance traded on more than 800 stolen press releases resulting in millions of illegal profits. the men face charges. police in brick, new jersey, hope video can lead them to the three people who stabbed a motorist during a road rage incident. the video begins with the victim on the ground. he had called 911 to complain about another car's aggressive driving. then he made the mistake of getting out of his own car to confront the driver. that's when three people attacked him, one with a knife. >> do not get involved with someone over a traffic violence. if you are in fear, keep your windows closed, drive to a safe location and call police. >> the three attackers fled in a dark colored acura with new york plates.

the victim's stab wounds were super fish has. he is recovering. a dog stolen from a home in the flat lands section. you can see two women approaching 9-year-old lovey. the dog was wondering in the street. the dog's owners reported it stolen. a disturbing new study involving safety in the skies. chronic fatigue continuing to be an industry-wide problem for air traffic controllers. two out of 10 questioned admitted to making mistakes due to fatigue. stephanie ramos is live in washington with more on what they found. >> reporter: good afternoon, david. the faa just released this report on air traffic controller fatigue. many of them dangerously tired while on the job. a study of air traffic controllers kept hidden for several years reveals that many controllers are having trouble staying awake on the job. 49 people were killed in this crash.

that is the year safety investigators decided to focus on controller fatigue. >> the problem is we have air traffic controllers working very, very hard to be 100% perfect 100% of the time and cumulative fatigue is a problem. >> reporter: in situations, similar problems with controllers asleep and jetliners landing without guidance. >> the power is apparently not manned. made a few phone calls, nobody is answering. expect to go in as an uncontrolled airport. >> reporter: according to the report, controllers reported an alarming lack of sleep. three quarters of the more than 3,000 surveyed said their schedules lead to chronic fatigue. more than six out of tone control tears reported falling asleep or losing focus during the midnight shift. two in 2e7b admitted to making -- ten admitted to making errors blaming it on fatigue. all of this information combined four years ago and

why her family we have breaking news in the child custody battle of accuweather forecast federal reserve kelly rutherford. a judge in manhattan ordered rutherford to return her two children to their children in monaco. earlier she declined to appear in court with the two children in violation of the judge's order. the children were eventually brought to court when the judge ruled against her. the children will now leave the u.s. today. the family of a woman killed by a metro north train last week challenging a ruling

that her death was a suicide. officials say 28-year-old tamar lewis went on the tracks to retrieve a dropped purse and struck. the medical examiner ruled yesterday that it was a suicide. but her family reportedly said she wouldn't have done something like that and is planning its own investigation. a new poll shows 65% of new york voters believe campaign contributions from the yellow cab industry are behind city efforts to limit the growth of uber. mayor de blasio agreed to a four-month study of uber's impact on traffic congestion. that the followed a failed proposal to cap uber's growth. now to a white house assistant placed on leave this afternoon. she was arrested and charged with grabbing her boyfriend's gun. a u.s. capitol police officer and firing a shot at him during a heated argument. jim avilla has the story.

>> reporter: this may have been her proudest moment, air force one behind her, just after being promoted to the white house as an assistant to the president of the united states. this may be her worst moment, a mugshot from this weekend when the white house staffer was arrested and charged with first and second-degree assaulted and reckless endangerment after allegedly firing a gun at her boyfriend, a police officer, at the u.s. capitol. local prosecutors saying she invited the victim to her house in suburban dc. the couple engaged in a brief sexual encounter after singletary questioned him about another girl. she demanded his cell phone and reached into his bag where she grabbed the phone and service weapon, a .40 caliber glock like this one. when he wouldn't recell his password, she is accused of pointing the gun at him and saying don't think i won't use it.

then she allegedly fired it in his direction ten feet away on the couch. the white house confirmed that she is under investigation saying we are aware of the matter and temporarily placed the employee in question on unpaid leave and revoked her access to the white house complex. the white house staffer is out on bail. the officer involved has not been charged but capitol police say they are investigating. jim avila, abc news, the white house. vote 2016. no polling on either side between donald trump and fox news host megyn kelly. trump was unhappy with questions kelly was asking during the republican debate. since then trump made remarks that many consider offensive. he won't apologize p. neither is kelly. >> you may have heard there was a dust up involving yours truly and donald trump. he will not apologize. i certainly will not apologize

for doing good jour that lifnl. >> fellow republicans including rand paul and jeb bush are distancing themselves from trump. hillary clinton has publicly condemned trump's comments. rick perry is in serious money trouble. his campaign is running on empty and fund-raising has just about dried up. perry's exam pain workers are not getting paid at his headquarters in austin as well as iowa, new hampshire and south carolina. some say they will continue working as volunteers for now. concerns over a large plumb popping up in new jersey bay. a drone taking photos of the six-block wide slick and it has lawmakers getting involved.

around astoria,ing queens, looking south down the east river at noontime. i did want to show you that view down the east river. you see these clouds, there are showers and thunderstorms that are off to the west and starting to slide our way. you can see it in this line right there. so, in this haze and all this moisture outside, we are looking at the threat of another thunderstorm this afternoon. humidity 91%. pressure falling. the barometer and the atmosphere all very unstable as we go into the afternoon. southerly winds 12 to 18 miles per hour. on the eastern end, the same thing, a southerly to a southwest wind. the last of the first batch of rain is here around riverhead. this next batch is producing a thunderstorm now in pike county. this is the batch i was talking about that will come on i-80 into -- through sussex and warren county to passaic and bergen and morris county and eastern end. it is moving east of gardeners

and out to montauk and fishers island. the next line with the sun on top of that will fire up some of these through the evening and into tonight. that is showing up on the computer model. by the time we get to 2:00 this line fires up here. look at the cell. the computer model shows around 3:00, sparta, andover and morristown. this line gets hot and heavy this evening as we go into the evening commute and into tonight. we will have updates throughout the afternoon. why the national weather service dropped the flood watch i have no idea. there could be flooding in these cells in parts of the area through the everything. there is that kind of threat tonight. so, we have 75 for the temperatures. after sunset this is gone. smacked. waves are 4 to 6 feet. tomorrow we have sunshine.
