as he left the federal courthouse in lower manhattan monday, he knew a decision was right around the corner. now the new england patriots quarterback can go in to tonight's preseason game in fox borough against the giants knowing he has scored a victory in court. brady seemed unwilling to negotiate a reduction of his four-game suspension. during the court hearings involving brady and nfl commissioner roger goodell, federal judge richard berman asked tough questions about the validity of the wells report stating brady was probably aware of the scheme to deflate footballs during the game last january against the indianapolis colts. in today's decision, the judge ruled the award is premised upon several legal deficiencies including inadequate notice to brady of his potential discipline and his alleged misconduct. denial of the opportunity for

brady to examine one of the two lead investigators and lastly, denial of equal access to investigative files including witness interview notes. the judge stated the court denies the management counsel or nfl motion to confirm the award and gratis the players association motion to vacate the award there bay vacating the suspension of tom brady effective immediately. what the decision indicates is that the nfl did not adequately prove its case against tom brady. it does not say that brady is guilt free of any awareness of the scheme to deflate the footballs in the championship game. tom brady will be able in the season opener next thursday against the pittsburgh steelers in foxborough. that game is next thursday. so, tom brady will be able to play.

hold on, though, the nfl can go to the appeals court in lower manhattan. we expect to hear about that later on this afternoon. they will try apparently to appeal this decision. that is the latest live from the meadowlands, anthony johnson, channel 7 eyewitness news. >> thank you, anthony. now to a fire in brooklyn that investigators are calling suspicious. the four-alarm fire burned through two homes in the flatbush section injury five people including three children. eyewitness news reporter mallory hoff has been tweeting about the aftermath of this and joins us live from the scene. >> investigators telling us that it's still unclear how this fire started but that they do believe that it was suspicious. i want to give you an idea of what is going on here right now. you can see investigators gathered in the front area of this home. they say they believe this is where the fire started and this is part of what makes it suspicious. they say the fire very quickly

grew and shot across to the home next door. one of these homes appears to be a total loss and the other home significantly damaged. reporter: flames ripped through two homes in the flatbush section of brooklyn. two adults and three children were injured in the blaze. they are expected to be okay. now investigators are looking into the cause of the early morning fire. >> it's certainly suspicious. we do -- we have been told there was a similar fire in the neighborhood. >> reporter: newscopter 7 was above the fire as neighbors watched. >> i saw flames shooting out of the house over there. it was like unbelievable, like a giant inferno. >> reporter: police nearby say arson has been a problem in the area. neighbors are trying to understand what happened here. >> the house was redone, brand- new. everything was new. they just had a baby. lucky nobody got hurt. >> reporter: as you can see

here, this is a street that is lined with old victorian homes that investigators are telling us have a tendency to burn rather quickly. they say that is exactly what happened here. investigators tell us they will be on scene for the better part of this afternoon. live in the flatbush section of brooklyn, mallory hoff, channel 7 eyewitness news. >> thank you. police released new video of a gas station attendant callously dragged by a robber driving away from the scene in new jersey. the robber who is on the loose actually paid for ten dollars worth of gas at a middletown gas station in august. then he grabbed the attendant's apron, full of money, dragging him about 35 feet. the apron wound up ripping and the crook got away with about 1500 bucks. we have an update in the case of a wild police chase in new jersey. the victim has died from his injuries. union county prosecutors say a pickup truck driver was critically injured during a police chase.

the truck crashed through the exit 54 off-ramp in him side after 12:45 a.m. he later died from his injuries in the hospital. no word why police were chasing him. charges are pending against a second person. one man is in the hospital and a driver is under arrest after a chaotic chain of events on the long island expressway. police say a driver ran off after a crash in holtsville. another driver gave chase but ended up in the path of a van. eyewitness news reporter stacey sager is live in patchogue with the details on what happened next. stacey? >> reporter: >> reporter: a crazy span of events. it ends here in patchogue when this man jackknifes a tractor trailer on route 112 then desperately tries to break into this car dealership to [ inaudible ]. this was the end

result when police caught up with jonathan moore. they had to place a bag over his head to restrain him. he is charged with leaving the scene of this car crash on exit 62 on the eastbound side of the l.i.e. three cars in a minor crash but someone chasing after moore is struck by a van on the service road. cops say moore fled on foot. the manager of pride solvents and chemicals picks up the story from there. he said moore stole a giant tractor trailer and in the surveillance video, look carefully as he rams it right into the very pricey metal gate. >> how big was the gate? >> that gate is 45 feet. >> he destroyed it. >> totally destroyed the gate. >> how much damage is that. >> about 25,000 in damage. >> as we said the wild ride didn't end there. moore jackknifed the tractor trailer miles away here in patchogue then breaks a window and tries but fails to steal a car. >> we had bad accidents and

things like that. nothing like this. it just doesn't happen. >> reporter: that was social security reporting. new at noon, new jersey is reporting the first death from the west nile virus in two years. the department of health officials say a 65-year-old man died from the mosquito born illness in passaic county last saturday. the victim was one of seven cases of west nile reported in new jersey this year. most people infected with the virus don't develop symptoms. those over 60 years of age are at greater risk. a bipartisan group of new york lawmakers made an impassioned plea this morning asking congress not to let the james a zadroga health and compensation act expire next month. it will cost to keep the programs covered. it provides compensation to thousands of first responders and survivors of the terror attacks. 35,000 public school students in newark are heading back to school for the first

the low to mid-90s for a feels- like temperature. bottom line hot, stucky, uncomfortable and finding a way to stay cool is what you got to do this afternoon. there is a front approaching. all it does is bring a refreshing air mass in. at the best maybe an isolated shower to areas north of the city. not looking for widespread rain out of this. instead it's one that brings the temperatures down. 93 degrees ahead of this. we had the heat and humidity coming in. when the front passes us, we get new air mass. temperatures are in the low 80s. about on target looking at the averages. air quality not so good. we have air quality alert advisory for the rest of the afternoon until 11:00 tonight when the front passes. that will help to mix-up the air mass. with the hot steamy air it is trapped at the surface. that is making it bad for people who suffer from that kind of situation. hold off exercise, being outdoors until tomorrow.

a reckless driver with a baby in the back seat. a victim takes down a thief and drunk women jump on a school bus. we begin in this ohio. a good samaritan spotted a man weaving on a highway. the car had a baby inside it. shawn french was driving on i- 71 when he spotted the car hitting things. he caught up to the driver, urged him to pull over after he barely missed a road crew. when he got to the median, french took the driver's keys and took the baby out. he called 911. police say the driver failed a sobriety test. he was charged with dui and child endangerment. a car thief got more than he bargained for. security cameras recorded the suspect getting in the car in lake tapps last week. the vehicle's owner dashed out of the store, jumped in the passenger seat as the suspect started driving away. the car's owner tossed the

new at noon, police say they arrested a man from argentina trying to climb the brooklyn bridge last night. they say 23-year-old was spotted by an officer walking on a cable on the manhattan side of the bridge. this is around 8:40 p.m. he is charged with trespassing and reckless endangerment. nypd officers constantly monitor the bridge because it could be a terrorist target. new york university is dropping bill cosby's name from a popular program for high school students. the university removed william h cosby from the future filmmakers workshop. nyu joins other schools in distancing themselves from cosby amid sexual misconduct allegations by dozens of women. cosby said any contact was consensual. >> mayor de blasio is signing a new law today making it tougher
