this morning. and good morning, america. boy, that was a real scare at the u.s. open last night. let's take a look again. you see that drone flying over the stadium before it actually lands in the stands and these days you just can't be too sure about what's on that drone. it really did have everybody hold their breath for awhile. a lot more on that ahead. >> first we begin with that news breaking overnight, a deadly shooting. one student dead. two others injured and a manhunt under way right now for the killer. abc's phillip mena is here with more on that. >> reporter: good morning, sacramento city college with 25,000 students in shock as the gunman remains on the loose. a frantic manhunt in sacramento this morning after an on campus shooting at sacramento city college left at least one student dead, two others injured. the gunman firing in the parking

lot near a baseball field. the shooting began 4 p.m. west coast time. the school notifying students by text. >> we've gotten two shelter in place notices. >> reporter: as classes evacuated evacuated the school on lockdown. >> they told us to head to our left and right and that was all we were told. >> reporter: police skied the gunman as a pacific islander with short, dark hair. the motive, not known at this time. as for the two victims, one is in serious condition, but is expected to fully recover. the other grazed by a bullet and will be fine. george. >> thank goodness for that. that county clerk in kentucky jayed by a judge after she refused to issue marriage licenses to same-sex couples and religion belief. the judge said it was her duty under law. alex perez on the story. >> reporter: good morning. those who sued davis were

seeking to have her fined but the judge didn't believe that would be enough to get her to comply so he put her in jail. this morning county clerk kim davis waking up behind bars, transferred to jail, a federal judge finding her in contempt of court after refusing to issue marriage licenses to same sex couples. marriage equality supporters erupting in cheers. davis saying in testimony thursday, my conscience will not allow me. >> under whose authority are you not issuing licenses? >> under god's authority. >> reporter: the controversial clerk citing religious objections has been denying licenses since june when the supreme court legalized gay marriage nationwide. david erermold and david moore refused refused three times. >> you have disrespected us. >> reporter: one couple that sued davis now preparing to wed. >> tomorrow as a couple it'll be an important day in our lives. >> reporter: on the campaign

trail several gop candidates supporting davis from rand paul -- >> i think it's absurd to put someone in jail for exercising their religious liberty. >> reporter: to senator ted cruz to former governor mike huckabee using the #imwithkim tweeting we must defend religious liberty asking supporters to sign a petition to free the clerk but the white house also weighing in. >> the success of our democracy depends on the rule of law and there's no public official that is above the rule of law. >> reporter: now davis can resign. if she doesn't and refuses to comply the judge can hold her in custody until she follows the law. george. >> thanks, alex. more on this now from the lawyer for kim davis, matthew staver. i understand and respect her beliefs here and her conscience but when a public official's conscience conflicts with the law doesn't that public official have a duty to resign? >> well, she's elected by the people and if the people want her to resign then the people can ask her to resign and they

haven't done that, in fact, she's a very well-liked individual in that community. you know, just a year ago the attorney general had a conscience conflict with defending the marriage laws and the governor of the state of kentucky accommodated him and allowed had him to step down and hired outside counsel to protect his conscience rights and that's fine. kim davis is asking for something that doesn't cost anything and she's not the only one. there are lots of clerks in kentucky with the same convictions and have one request, just remove our name from the official licenses. can you have the commonwealth of kentucky, that's fine, they'll record it. that's fine just don't affix their name and title to a marriage certificate that collides with their religious beliefs. >> another fix is that the deputies can sign the marriage licenses. that's expected to happen today. if that does, indeed, happen, do you expect the judge will release miss davis? >> no, i don't think he will because, in fact, it's the same thing for kim davis. it still has her name on it.

yes, the deputies can -- they did not want to originally but then the judge brought them in and threatened them with jail time, as well so five out of the six said they would issue the licenses but it doesn't remedy the situation for kim or anyone else. because it still has kim's name on it. one thing about kim, she may be incarcerated behind the jail bars but her conscience remains free and just knowing kim she's made a decision and can't violate that conscience and she can't have this collision with her religious convictions. i think she represents lots of clerks in kentucky, lots of clerks around the country and i think there's going to be some effort to change and protect kim's religious freedom and many others like her. >> how long is she prepared to stay in jail? >> she will not violate her conscience so whatever the consequences of that is, kim davis doesn't want to be in this situation, but she's prepared to face whatever it is. >> mr. staver, thanks for joining us this morning. >> thank you. my pleasure. unclear if it'll come to that. the judge has the ability to

hold her in jail for up to 18 months. >> i'm sure a lot are watching that around the country. also a lot watching the weather. holiday weekend weather. the west feeling the effect of that newest tropical storm and out east, the heat is making a comeback, ginger, no. >> brief reprieve and a comeback. we'll get to that but first the strong storms rolling across the desert southwest. stunning pictures of those dust storms. about 4,000 without power so not the strongest that they've seen this week but certainly something that you could see more of. not only today but tomorrow thanks to tropical storm kevin. not that it's going to make landfall but turn away from cabo but surge enough moisture into the desert southwest that we could see more flash flooding, gusty wins and dust storms. so many of us going to the beach and look at this. rip currents were a problem last week in huntington and took the lifeguards, the video of all the saves, more than 470 in one week and we've got those rip current statements out for a lot of beefs so do a little extra planning if you do that.

comfortable weekend, as i said, much, much hotter as we hit the actual labor day coming up monday on the east coast. >> thanks. the race for president now. your voice, your vote. and vice president biden speaking out publicly for the first time last night about a possible run for president. jon karl covering that from the white house. you can see from biden that this is above all an emotional decision. >> reporter: it sure is, george. joe biden sounds like he really wants to run for president but he's unsure whether or not his family can handle it so soon after the death of his son beau. in an appearance last night at an atlanta synagogue, the moderator asked the vice president the big question. >> so please let us know your present thinking -- [ laughter ] -- about whether or not you'll enter the 2016 presidential race. [ cheers and applause ] >> reporter: after a moment of thought, vice president biden gave this heart felt response. >> the most relevant factor in

my decision is whether my family and i have the emotional energy to run. >> reporter: biden dismissed other factors including fund-raising and whether or not he could take on hillary clinton. >> it's not the factor. the factor is can i do it? can my family undertake what is an arduous commitment that we'd be proud to undertake under ordinary circumstances but the honest to god answer is i just don't know. >> reporter: the biden family is still coping with the death of beau biden to brain cancer in may. in his final days beau reportedly urged his father to run. >> i can't look you straight in the eye and say now. i know i can do that. this is as honest as i can be. >> reporter: biden is expected to take at least a few weeks to make this decision but, george, after those comments last night, it is now more clear than ever why at this point he truly is un undecided. >> yeah, you can see it. his demeanor so striking there. he said hillary clinton not a factor but is she still facing the e-mail questions.

one of her top aides testifying on capitol hill yesterday. >> reporter: no question that it is a factor as far as those close to him. they look at this race, they see that hillary clinton with all the problems dealing with her e-mail issue is clearly vulnerable. they believe she is clearly beatable in a democratic primary and that is the case that they are making to democrats as joe biden maybes this decision. >> okay, jon, thanks. to the republicans now. a new move from donald trump reversing course now signed a loyalty pledge to the republican party ruling out an independent run for president. prompting to support the gop nominee even if it's not him. abc's tom llamas has been tracking the race and joins us now. >> reporter: good morning. all 17 republican candidates have now signed that pledge. trump says there's no scenario where he leaves the republican party to go rogue. this as an interview with a host didn't go exactly as planned. this morning, donald trump's going from this -- this time. >> okay. >> reporter: -- to this.

good morning, ryan. >> reporter: good morning to you, amy. after eight months of deflategate controversy, it's over for now. overnight the nfl appealing a federal judge's decision for brady. that decision focusing on the way the nfl handled brady's case, not ruling on whether brady was involved in an alleged scheme to deflate footballs. >> good to see you. >> reporter: the star quarterback walking the halls of gillette stadium thursday night not addressing the media but this morning he's back on the field for the patriots regular season. his four-game suspension for his alleged role in deflategate flown out by a federal judge thursday. as a sigh of relief heard all over new england. >> thank god it's over. i hope. i hope. >> reporter: saying commissioner roger goodell's upholding of brady's suspension was based on several significant legal deficiencies like not properly warning brady of potential discipline for his alleged role or giving brady requested access to key files and witnesses in his nfl appeal hearing. but the judge not ruling on a

key aspect of the scandal whether brady knew about or encouraged deflating footballs. >> the judge made it crystal clear it was the process that concerned him and that's why he ruled in favor of tom brady. he was not saying that tom brady was innocent. >> reporter: this couple outside gillette stadium divided over this. like much of the country. >> the truth was told. >> i think they cheated. >> protect the ball there. >> reporter: so tom brady is now clear to play when the patriots celebrate their super bowl win and start their title defense against the pittsburgh steelers right here next week but roger goodell won't be there. sources tell us he believes the focus should be on the dame and festivities but will be watching on tv. >> they're appealing this, correct? >> that's correct. this was a surprise decision for many, many thinking the arbitrator is given due deference but the nfl saying they want to protect the

next from your local ab this is a channel 7 eyewitness news brief. good morning it's 7:24 on this friday september 4th. i'm lori stokes. breaking news at this hour, a rough night for police in bushwick brooklyn, a bullet in the door of an undercover police car marks the end of a pursuit for a suspect. he allegedly wounded one man on madison street. he faced off with police opening fire on bushwick avenue. police shot him in the leg. he's now in the hospital. the police officers who arrested him were unharmed. two former new jersey day care workers accused of creating a kids fight club are due in court. prosecutors say erica kenny and sha niece white provoked shoving matches between children and videotaped them. no one was seriously hurt.

first trial ended in a hung jury. >> hello, i'm dr. mike gibson. >> reporter: prosecutors say amarillo plastic surgeon dr. mike dixon seen here in his own tv commercial hired a hit man to kill prominent pathologist dr. joseph sonia in a love triangle turned deadly. ra rashell dated him for a year before ending up in a relationship with sonia. that infuriated dixon, prosecutors say motivating the plastic surgeon to hierd david shepherd to murder the pathologist. >> somebody has broken a window in the back and the doctor did not show up for work today. >> reporter: sonia's body found in his home shot and stabbed in july 2012. >> one of his co-workers went in the house and he says it's not good. >> reporter: shatina told police dixon insisted on seeing her even though she continued to date dr. sonia. but in november last year, a

judge declaring a mistrial after jurors failed to reach a verdict. >> call my office for a consultation today. >> reporter: now dixon back for a new pretrial hearing. prosecutors alleging dixon paid shepherd in three silver bars worth $9,000. the hit man shepherd allegedly confessed to the crime in 2013 but dixon's defense is attacking the credibility of that confession claiming shepherd george. >> boy, a lot of twists in that story, thanks very much. we furnish to that legal drama for tori spelling suing benihana restaurant, the popular chain that cooks at your table. she suffered a bad burn after tripping and falling on one of the grills and abc's kayna whitworth has the story. >> reporter: this morning, tori spelling is lighting up a legal battle with benihana restaurants for a dinner experience she says left her badly burned. the 42-year-old "90110" alum filing a suit against the chain after she slipped and fell on

one of their grills this easter. she sustained deep second and third-degree burn injuries requiring hospitalization and surgery. she's now claiming she suffered general damage and wage loss. >> the real question comes down to, did the restaurant create some kind of dangerous condition that caused her to slip or to fall or to trip, therefore, sustaining the burns on her arm. >> reporter: the mother of four's injuries so severe she grafts. in this photo you can see the burn marks on her arm. in other photos it's covered with bandages and sleeves. her husband telling "extra" she's recovering well. >> she's recovering doing pretty good. she's just at home resting. >> reporter: the restaurant's famously close proximity of diners to the flaming open grills even parodied in the 2014 movie "alexander and the terrible horrible no good very bad day." neither benihana nor spelling

city and state, even their phone number in a matter of seconds. ebay, it's the online marketplace for 25 million sellers, but did you know when you signed up, you've allowed them to give out your personal this was to your bidders. any bidder on an item can request and receive in a matter of second a seller's full name, city and state and phone number. >> it's already too easy to get information on people and why make it even easier. >> reporter: so just how easy it? we played bids -- i'll request it for $1 on a handful of auctions and completed this simple request on ebay's website asking for seller contact information. there it is. i have a name, a city and a phone number. one of those people rerequested information for ebay seller anita. did you know when you signed up they could do this? >> no, i did not.

i thought they protected your information. >> reporter: in ebay's terps and conditions it says they can do this and the company points out the information is meant to help communication between sellers and buyers. and while ebay doesn't release seller's addresses, using anita's name, phone number and city, it took us under a minute to find her address online. now somebody knows where to find you. >> that doesn't feel very good. i have a family here. i'm doing this to make extra money for my family. >> reporter: ebay notified anita after they gave out her information. at the same time also providing her with our info, but cybersecurity expert adam levin says a scammer or thief could use fake information in their profile to try to get your info. >> a process like this is an enabler for bad guys even though it wasn't designed to be. >> reporter: we reached out to ebay. hi, this is rebecca jarvis with abc news. they declined an on camera interview but tell us of the trillions of transactions we're un

family in florida after their home was treated for termites. their young son is now in the hospital unable to speak, unable to move. abc's reena ninan has more on what went wrong. >> reporter: this morning 10-year-old peyton mccaughey hospitalized suffering severe brain damage unable to move his limbs. >> life as he's known it has been stolen from him. it's not going to be the same. >> reporter: the family hired a terminix pest control subcontractor to fumigate their florida home. within hours of returning to the house on august 16th after they say they were told it was safe to re-enter they fell ill. >> he was, you know, having some uncontrollable muscle movements. he couldn't stand up. he couldn't speak. so they took him to a local walk-in and the doctor quickly recognized it was probably a poisoning from the treatment. >> reporter: the family hired a lawyer to help get answers from terminix about the incident. overnight terminix telling abc news, we are saddened to learn

the focus is more about on fun than how fast you run which is my kind of jog. thank goodness. morning to you, ginger. unlike you, any tendency of there being an organized run i have a tendency of running away from it. thought this one. this was not the case. you probably heard of those obstacle races and mud runs that leave you caked in dirt from head to toe but another kind of race that leaves you looking like a human rainbow. i couldn't resist so i had to take a look. kind of awesome. full of fun, full of color, the color 5 kilometer run is exercise in disguise. the runners including yours truly, doused with colors throughout. why? why not? with over 130 races a year, all over the u.s., australia, new zealand and the uk, there is a race for everyone. >> it's a family fun 5k fun run, on time so getting all kinds of people here.
