now, new york's number one news. channel 7 eye witness news. >> a tree comes crashing down in a crowded bryant park in manhattan. several people to the taken. people are talking to us about the frightening scene when the tree suddenly snapped. good evening at 11:00, i'm bill ritter. >> i'm sade baderinwa. the tree branch crashing down when a popular park was packed. >> five people were taken to the hospital. josh einiger at bryant park with new exclusive video and details about what happened. >> reporter: bill, almost as quickly as the tree toppled to begin with, tonight it's gone. you have to know what you're

looking for to find the stump workers left behind after they chopped down what was left after this truly terrifying day at the park. for a few minutes on this late summer afternoon it was pandemonium. >> everybody tried to help. everybody was running to the aid. >> reporter: bryant park teaming with people at the beginning of a holiday weekend. >> sit around and enjoying themselves. >> reporter: when the trunk of this enormous tree just snapped. >> nobody seen it coming. >> all you heard was the tree cracking. >> tremendous really loud crack. >> no warning. couldn't get away. there was no stopping it. >> it was too late to yell. >> people were screaming. >> reporter: when it was over five people were hurt. onlookers rushed to help them before paramedics could arrive. the victims' heads in some cases inches from the tree trunk. >> somebody could have got killed.

>> reporter: all five victims wound up in the hospital as the nypd cut up the tree for the parks department, which will inspect it to figure out why it gave way. >> it makes you think how unstable is this whole park? >> reporter: back live for a look at how big this tree was. it was a sibling to all these other trees. that's how much of the tree came down on dozens of people here earlier this afternoon. the bryant park corporation is bryant park. they released a statement saying they have a regular maintenance plan for the trees here but the investigating. live in midtown, josh einiger channel 7 eye witness news. >> josh, thank you. another tree mishap in connecticut leaving a man seriously hurt tonight. the man was getting into his van him. he ended up pinned under the tree and was rescued by

firefighters. several vehicles were damaged. the lack of rain drying up the ground, we know that. gusts of wind we had today. all that helped trigger the tree crashing incidents. lee goldberg checking that out for us. these peak wind gusts don't scream tree damage. we had gusts near 25, 26 miles per hour and only had a couple inches of rain over the past five weeks. if you're talking older tree and maybe a diseased tree, it's a possibility you'll take a limb down. in manhattan the winds get hampered a bit. the winds are backing down from the east. there's the empire state building, red, white and blue for labor day. we're at a comfortable 75 and the humidity continues to drop. the highs no more 90s. last time we had three 90 degrees day this is september 1973. cooler today and humid.

testing now complete at the apartment complex in the bronx where legionnaire bacteria was discovered this week. four of the nine buildings had positive preliminary tests for the bacteria. health officials say there have been four cases at the melrose houses. one was diagnosed this week. a wild west shootout. that's how residents describe a gun battle between a suspect and the nypd. >> it rolled off the bed and we're like stay down. it seemed like it was right outside our window, which it was. >> i couldn't believe how long it went on. i was like is this really happening? it wouldn't end. >> the streets were covered with more than 80 shell casings. a suspect in an earlier shooting fired at them and they returned fire.

the suspect emptied his 11 rounds. the suspect, 27-year-old gerald harris was struck in the leg and in custody and awaited charges. renewed calls for regulations of drones. this time a crash in the middle of a tennis match in the u.s. open. nobody was hurt but this could have been a horrible accident. the operator, a new york city public schoolteacher. he's now under arrest. carolina leid with the latest. she's in queens for us. >> reporter: bill, we try today reach out to the pilot of the drone at his home and by social media. so far nothing. tonight he's charged with wreckless endangerment. some are asking if the tight security here should be tighter. the suspect's father didn't have anything to say to us as he walked into the home two hours ago. we tried to ask him what his son

was thinking when he flew into the drone. look at the upper left corner of your screen. no one was hurt because no one was sitting in the stands. >> i was more nervous if something would happen i was there with my little guy. >> reporter: it belonges to a new york city science teacher. he was allegedly operating it from the marina on the opposite side of citi field. >> i thought someone was trying to get a picture of the tennis match and the drone broke and fell on the court. >> reporter: the da said in a statement we were fortunate no one was injured as a result of last night's incident. we can't rely on happenstance to protect the public. those who engage in this conduct will be held legally accountable for their actions. >> all we need to do is pass legislation that requires that all drones have go fencing. we could have drones but none would fly near an airplane or

the u.s. open or any other sensitive place. >> reporter: the suspect's court appearance is set for september 16th. the department of education says it will monitor those court proceedings to decide whether to discipline him. reporting live in queens, carolina leid, channel 7 eye witness news. >> carolina, thank you. it's still not clear what caused a small plane to crash on a field in new jersey. 41-year-old rosenberg was flying for the coast guard yesterday when he reported engine failure and forced to make an emergency landing. he managed missing kids below and went into a grove of trees. >> they visibly saw how he steered the plane away from the children in the soccer field on one end and buildings on the other. that obviously shows his professionalism and of course that he's going to put his life second to the safety of others.

>> rosenberg and his passenger were hurt. they're in stable condition and expected to survive. not guilty pleas from day care workers. they're accused of provoking shoving matches at the light bridge academy. they posted videos of the fights online. the children weren't hurt and the women have been fired. dozens of homeless encampments are being cleaned up tonight. back. teams of police sanitation workers and homeless advocates are clearing more than 80 encampments. they're offering help and refused. since being on the street isn't illegal, there's little else the city can do. a county clerk in kentucky licenses.

hash tag justice for little maine. aj ross, channel 7 eye witness news. the death of a couple and their two young sons on the jersey shore tonight ruled a murder suicide. firefighters found the bodies all in the bedroom of their long branch home on tuesday. investigators believe he shot his partner first and then his children before setting the home on fire and turning the gun on himself. they might be u.s. citizens but residents cannot vote for president in the united states. a source of much debate. nonetheless hillary clinton campaigning there. she focussed on the island's health care problem. gop presidential marco rubio also campaigning today in the island of puerto rico. clinton's visit comes as andrew

bringing in the dryer air. these are dew points. when you see 50s that's comfort. the morning. wall-to-wall sunshine and a bit of a breeze out of the northeast. it will feel coolish in the morning and the evening hours. skies are cleared out and patchy low cloudiness will wither away. it's all about a big area of canadian high pressure stretching out over the next couple of days. perfect, perfect timing. look at the cooling. it's 50 in caribou, maine. northeast. perfect day on sunday. humidity. labor day. one thing of concern tomorrow, keep this in mind, the rip current risk remains high during the day because of the northeast winds and the water is choppy through the first part of the day and it quiets down in the afternoon. the rest of the weekend the rip current risk should go to moderate if not low.

new at 11, a growing concern in russia, literally. a massive sinkhole is growing. it opened up last november after a mine accident. nearly 400 feet across. engineers trying to figure out how to keep it from expanding further so it won't pose a danger to local residents. weight loss surgery could be more effective than controlling diabetes than medication. 80% of patients who had surgery had their blood sugar under control after five years versus a quarter of patients on meds. half of patients treated with surgery were diabetes free. rob powers up next with sports. >> busy, busy night. big baseball night. the mets and yankees get on the field. we start with one month to go in the regular season. we also head out to the national tennis center where serena williams continues her pursuit of the grand slam.
