jefferson and ronkonkoma branches. long island reporter kristin thorne in westbury. >> reporter: crews are here on the scene trying to remove the train as quickly as possible. there is service still coming through here but again that's only happening on one track so, yes, they have suspended some westbound service so they can add some eastbound trains at least through the evening rush. it's still unclear what caused two of the freight train's 16 cars to derail this afternoon. what is clear is that it's going to create a mess for people trying to get home. >> rush-hour is going to operate on main line number 2 and be on restricted since it's only one line running so a little bit of a backup. >> reporter: newscopter 7 was over the tracks just after it happened around 1:00 this afternoon just west of the hicksville train station. the train was carrying construction materials, no injuries were reported. >> i heard the screech, screeching of brakes and

originally i didn't think much about it and then a few minutes later i had realized that like the train was like still there. >> reporter: emergency crews say they will have to bring in a crane to remove the train from the tracks. that should happen sometime tonight, but then they will need to inspect the track which was damaged. >> probably about 100 feet of damaged rail. we are waiting for a crane to come in which will probably be after the rush-hour, roughly around 7:00, 7:30 tonight. >> reporter: and they are hoping to have the train removed by around midnight so that way everything will be all set, all ready to go for the morning rush. anybody trying to go westbound between 4:00 and 8:00 tonight from ronkonkoma, there is no service. right now heading westbound, again, 30 to 40 minute delays. we are live in westbury, i'm kristin thorne, channel 7 eyewitness news. >> kristin, thank you. another developing story, this one in manhattan, investigators are on the scene of a deadly fire on southern place on the east side. they found the 70-year-old

woman dead inside an apartment while responding to the fire on the 14th floor this afternoon. the cause of the fire is still unclear at this point. the victim's identity has not yet been released. another developing story, a shooting near a day care in new rochelle. investigators tell us someone opened fire from an suv on clinton avenue. police believe the target was another vehicle. one victim showed up at mt. vernon hospital with gunshot wounds. minutes later police followed the vehicle to yonkers. a passenger jumped down and was taken into custody. the driver is still on the loose. there are new and disturbing details tonight about the hazing death of a baruch college student. grand jury documents released today reveal what michael deyn was told -- deng was told to do in order to get into the fraternity and what happened after he was left injured and unconscious. eyewitness news reporter kemberly richardson is in pocono summit, pennsylvania with the details. kemberly. >> reporter: well, joe, for the first time we are hearing from

one of the suspects why these fraternity members didn't call an ambulance as michael deng slowly died in front of them, according to those court documents, kenny kwan told investigators, quote, because someone looked it up and the bill, the cost was too high. >> he was singled out and he was treated harsher than the other pledges. >> reporter: and when michael deng tried to make it stop by fighting back, it only made things worse. that's what those who were in this house in the pocono mountains allegedly told investigators. members of pi delta psi fraternity who police say beat the 19-year-old pledge until he lost consciousness. >> he had complained that his head was hurting and was tackled again. >> reporter: now 37 members of the fraternity students from baruch college and saint johns university are at the center of this investigation. so far five have been charged. police tell me they have hit roadblocks around every corner.

>> individuals who had hid evidence and individuals who fled the scene. >> reporter: back in december of 2013, the frat rented this house. police say four other pledges had made it through the final phase of a grueling ritual but deng struggled. the freshman blindfolded wearing a backpack filled with 30 pounds of sand was to run past a line of brothers without getting tackled. in juste released court -- just released court documents one witness saw a suspect, quote, take a 15, 16-foot running start to spear mike. it would be the final blow, he slipped and hit his head. another witness described deng after he fell as quote snoring. the suspects brought him inside and wrapped him in a blanket and put him by the fireplace. he tensed up on the couch and dead weight carrying him to the car. the suspects waited more than an hour before driving deng to the hospital, a car ride during

which they remember deng making, quote, groggy noises. now, some of the evidence collected in this case, text messages from cell phones, again, the first five defendants set to face a judge here on thursday. we will be here. for now we are live in the poconos, kemberly richardson, channel 7 eyewitness news. >> kemberly, thank you. and in new jersey a crossing guard struck by a car is in the hospital tonight. police say 60-year-old joanne hans was directing traffic outside a synagogue on new bridge road as worshipers were arriving for rosh hashanah services when hans was taken to the hospital she was awake but in pain. the driver was not hurt. police in the bronx are looking for the man caught on camera violently attacking a woman. police say the man followed the woman into her apartment on briggs avenue in the bronx. he punched the woman in the face and threw her to the ground. he did not rob her, just ran leaving her with several broken bones in her face and cuts

around her head. the justice department accuses a teenager with plotting to attack pope francis during his visit to the u.s. next week. the fbi arrested the 15-year- old boy near philadelphia last month. he allegedly was planning an isis inspired assault involving explosives and firearms. law enforcement sources described the teenager's plans as aspirational and say the threat was not imminent. this, of course, is the kind of thing law enforcement is concerned about. given that security will be extremely tight during the pope's visit, mass transit may be the best way to get around town. today the head of new jersey transit talked about how they are preparing. michelle charlesworth is at newark penn station with what riders need to know. michelle. >> reporter: oh, yeah, they are definitely preparing. it will definitely be crowded and mass transit certainly the way to go. you have trains, buses,

ferries, a lot of options and we understand service will definitely be added to help out. >> when the pope comes in on thursday and friday, we expect that we will have two jobs to do, one, move our regular commuters in and out of new york, the second job will be moving all of our visitors who aren't normally used to taking new jersey transit. >> reporter: new jersey transit is adding trains and buses to meet demand for the throngs of people who just want to be in the city while the pope is here. >> we think it will be crowded. we think our regular commuters, we are telling them please be patient. we think there will be some delays. >> reporter: one of the biggest tips, go off peak, not during rush-hours when the commuters are going in and out. and buy your round-trip tickets ahead of time so you have your ticket home. also you might want to consider another route. >> our light rail commuters will also continue to be using light rail, there are connections from light rail either to p.a.t.h. here in hoboken or here in newark, new york waterways,

tonight as they return to their community, scorched by wildfire. up to -- many people are only minutes to get out. friends of an elderly woman who was killed when flames engulfed her home in middle town are deaf -- middletown. they say 72-year-old barbara mcwilliams assured them she was fine. >> she is like no, i'm fine. it's going to be fine. she didn't understand the magnitude of it. >> hundreds of crews are continuing to battle the fire near middletown. it is only about 15% contained. the senate is set to hold a new vote later today on a res litigation rejecting -- resolution rejecting the return nuclear -- the iran nuclear deal. this will be the second vote this week to push the resolution forward. republicans of accused -- have accused democrats of refusing to let the senate vote on the deal. democrats say the issue is settled.

it's the picture getting quite a bit of attention today from tim fleischer on twitter. a sanitation truck falling through the roof of a parking garage. right now crews are moving in a crane to remove a garbage truck stuck in the pavement in brooklyn. tim joins us live with an update on the cleanup and how this happened. >> reporter: we've got a developing story at this hour. let me show you what we have been dealing with. here's the carting truck that fell through the top level of this parking garage. you can see the three sets of tires buried within that hole. within the last half hour new york crane has come in with this huge crane, in the process

of setting it up in an effort to try and lift the truck out of that hole. sunk into its axles the five star carting company truck was making its usual early morning pickup around 3:00 a.m. when suddenly its three sets of rear tires crashed through the top level of this parking garage. >> has to go back there and get the garbage. should be at least official enough to hold that if it was driven correctly but it wasn't. >> reporter: fortunately it came to rest on steel support beams as seen in this picture but large chunks of asphalt and concrete were left dangling overhead in the garage below. >> can you imagine that went all the way down? it was beside. >> reporter: the driver jumped out safely but his truck was going nowhere. the company owner would not talk about the accident. >> no comment, guys. >> reporter: city building inspectors are on site checking for structural damage and integrity and have issued this vacate order for the parking lot only, not the four businesses that use it. >> people love the fact they can park here, they feel safe parking here so this is going to be a tough one.

family and friends mourn and remember a 21-year-old woman killed in a freak accident, a boat towed by a truck came loose and hit her. >> yes. alexa coughy was -- chaffey was riding her bike on staten island along with her friend when they were hit. alexa died. eyewitness news reporter darla miles is at staten island university hospital. darla. >> reporter: well, joe, the surviving victim is still being treated here at staten island university hospital north. we are told the very first thing she asked about when she regained consciousness is how is alexa doing and at the time friends and family members did not have the heart to tell her that alexa didn't make it.

>> would always be run up with a big hug, hi, mom, i love you. >> reporter: it's what alexa was all about, hugs, that and sisters. >> she was waiting for her younger sister, vanessa who was graduating this year with my daughter in june they were going to start college together next september. she was going to become a lawyer. >> i would just walk in and yell out family and alexa would always yell out family back and come running down and give me a hug and kiss. >> reporter: it's a greetings gina would have likely received monday afternoon. she was driving to meet alexa and friends at the gateway national recreation area when this boat became unhitched and ran over the 21-year-old on highland boulevard in red -- and red grave avenue in the great kill section of staten island. >> i was running late and got stuck in traffic and happened to see the accident. i saw the boat sitting there and there was no car around it, no nothing, and i just

remembered looking at it just thinking, why is there a boat just in the middle of highland boulevard right now? >> reporter: alexa's 22-year- old friend was also run over by the boat. her neighbor saw the two of them set out that their bikes yesterday. >> we saw her and a friend pulling out and both commented that, oh, she is riding bike and she has her license. good for her. she looks good. she is exercising. >> reporter: the man towing the boat has not been charged but the nypd is trying to determine what happened. >> that girl -- boats just don't fall off of trucks. this is my opinion. >> reporter: now the nypd collision investigation squad is conducting this investigation and they will determine what may have caused that boat to become unhitched. reporting live in south beach, staten island, darla miles, channel 7 eyewitness news. >> thank you. new at 5:00, nypd officers returned to the scene today where a legal aide to governor

cuomo was shot to look for more evidence. they searched at the ebbitz field houses to look for clues and shell casings. police are still searching for the suspects who shot carrie gabay in the head on labor day. he remains on life support. and new at 5:00, a police officer in new jersey shoots and kills a family dog as it was attacking its owners. it happened in paterson this morning. police say an 11-year-old boy called 911 to report his parents being attacked. when an officer arrived at the home, he says he was forced to shoot the dog. the couple was taken to the hospital with multiple bite wounds. they are expected to survive. police say one of the men accused of stealing a taxi and then crashing it has a long criminal history. investigators say the 25-year- old was taken into custody this morning. he has more than 40 prior arrests on his record. police say the suspect is one of four men who punched a cabdriver and then stole his taxi on wall street about 2:00

a.m. the other three men ran away after crashing the cab a few blocks away. in new jersey, union county rolled out its countywide program to supply body cameras to police officers. today officials demonstrated cameras that are about 1/3 -- that about 1/3 of officers across will get with cameras going to eight different police departments. union county -- >> we think it's a huge step in promoting law enforcement partnerships with the community. it will not only provide transparency, but it will provide accountability both for the citizen and the officer interacting with that citizen. >> and they showed off the docking station where at the end of the day officers relieve the cameras to download video and recharge. new information about that flash flooding in utah. we just learned minutes ago the number of people killed now up to 12. another four are still missing. search and rescue teams are still trudging through mud near

the arizona border looking for them. abc's marci gonzalez has story. >> reporter: a desperate search for the missing, mothers and children swept away yesterday when flash floods tore through this part of utah along the arizona border. two packed vehicles stopped on a gravel road when a wall of powerful rushing water hit them from behind. >> the flash flood was so significant, it overwhelmed them and pushed them into the channel. the vehicles were rolled several hundred yards downstream. >> reporter: just three of the people pulled to safety. the other 13 who were in those vehicles now either dead or missing. the youngest child reportedly just 4 years old. officials saying many residents here in the headquarters of warren jeffs' polygamist said they would not have known about the flash flood warnings. some brought to safety at the

last second. >> pretty powerful. >> reporter: today in the tight- knit town of hildale, search teams scouring the banks and digging in the early morning darkness looking for any sign of the victims. meanwhile at least one of the survivors from those vehicles that were swept away is still in the hospital today. marci gonzalez, channel 7 eyewitness news. police have identified the woman accused of a mid-air meltdown that forced a plane to be diverted. indianapolis police say daniellea velez reyes became unruly during a flight from miami to chicago. other passengers recorded her being escorted from the plane when it made an emergency landing. her behavior allegedly included slapping another passenger, kissing a flight attendant and then punching that same attendant. it is unclear what provoked the outburst. an alligator spotted in queens captured tonight. coming up how the animal -- how the reptile was finally caught and what's happening to it tonight.

an alligator spotted roaming loose in queens captured today in flushing meadows. the parks department had been looking for the reptile since yesterday after it was spotted in flushing meadows corona park. when it was spotted again today officers managed to catch it. >> i spotted him about a week ago, got a couple of good pictures of him, i notified the authorities, they attempted to catch him quite a few times. they couldn't and i seen the commotion, i came over with my rod and got him on the first shot. >> the gator's mouth was taped shut as it was taken away, it appeared to be in good health. a professional hunter in zimbabwe helped kill cecil the line, he's been arrested right now. theo bronchurst is accused of

a woman in his community. >> the elderly woman pressed her life alert button because she needed help making food so she could take medication. and when a jackson township officer responded, he did more than most would. >> new jersey reporter toni yates spoke to the woman and the officer. >> that was a prayer. >> reporter: eleanor metzger lights up recounting for us how the police officer came to her rescue last week when she needed to eat and her meals were frozen and she called her life alert for help. officer james quickly came over. >> i was so hungry and i can't find a plug, no electricity. >> reporter: officer reynolds took care of everything. >> and he fixed the microwave and he heated the whole meal up and then when it was all done, he put it on the table and he cut the meat up and the potatoes and he says, here, now use this here and enjoy it.

the lirr who are trying to get home. good evening, everyone, it's 6:00. i'm bill ritter. >> i'm liz cho. delays and headaches for long island railroad commuters heading home tonight. >> this after a freight train derails west of hicksville this afternoon and that put one of the two lirr tracks out of service for the evening rush. >> long island reporter kristin thorne is at the scene tonight with our lead story. kristin. >> reporter: liz and bill, crews are here on the scene, you can probably hear them right now trying to remove this train from the tracks but that is going to take all night, so, yes, eastbound customers on the port jefferson and ronkonkoma branches are facing 30 to 40 minute delays. it happened around 1:00 this afternoon, two cars of this new york and atlantic railway freight train derailed. it was just west of the hicksville train station. >> i heard the screeching of brakes and originally i didn't think much about it and then a few minutes later i had realized that like the train
