live at penn station, a.j. ross, channel 7 eyewitness news. new at 5:00, frat brothers facing a judge today over their alleged roles in the death of a pledge in the poconos. >> the students weren't in court long. they are accused of doing nothing to help michael deng then allegedly lying to investigators about what happened. >> eyewitness news reporter kemberly richardson is live in the poconos for us. kem? >> reporter: well, rob, each defendant walked through the doors then left the courthouse without saying a word. among them here today with his mother, andy mang. he is the former national president of this fraternity. his sister is a congresswoman. the judge did not mince words. he ordered the men to hand over their passports, get fingerprinted and play by the rules. if they don't, they will be arrested. do you have anything to say? anything to michael's family? not a single word from thomas lieu or any of the suspects who

police say this group of five all members of a fraternity played a role in the hazing death of baruch college freshman michael deng. >> i won't talk about the facts. we take them seriously. >> reporter: police maintain the group lied to investigators, destroyed and concealed evidence inside the home the poconos two years ago. that's when deng was allegedly subjected to a brutal hazing ritual which included severe blows called spears. authorities say the 19-year-old while blindfolded and wearing a backpack filled with 30 pounds of sand was beaten so badly he passed out. the cep jects carried evening -- subjects carried deng back into the house and plotted how to cover things up. thethey reached out to meng. they recovered deleted text

not have custody of the little girl. police issued an amber alert for celine hicks. we learned it was her mother that took her yesterday and who today negotiated the girl's return. eyewitness news reporter tim fleischer is live on the lower east side with more. tim? >> reporter: and, diana, the amber alert you mentioned is canceled. it was actively worked by detectives on the lower east side today. you mentioned the little girl is safe and sound and her mother is under arrest. here at this office building on lenox avenue in harlem, a little past 2:00 this afternoon, goes 10-year old celine hicks was found unharmed after police were notified as to her whereabouts. an attorney for her mother, jacqueline hendricks, eyewitness news learned negotiated her surrender. >> we were struck we kept hearing the sirens and there were so many police that were out here. that was disturbing. >> reporter: celine was last seen leaving castle middle school on henry street

say her mother came and picked her up. hendricks has a temporary order of protection to stay away from her daughter. that order, eyewitness news was sought by celine's aunt who lives in the building and had custody city of the daughter for the -- custody of the girl for the last eight years. >> that is scary. you have to protect your kids regardless against parents or -- any kind of source. >> reporter: earlier today, police issued an amber alert for celine, her mother and father, carlos hicks. they were thought to be traveling in a white chevy lumina sedan with white plates. the parents have had numerous unsupervised visits with the child over the past several years. it's unclear what prompted the mother to take the child from school this time. school officials say the circumstances surrounding it are the focus of an investigation at cation sell middle school. -- at castle middle school. the investigation is continuing

and the mother will face charges. tim fleischer, channel 7 eyewitness news. >> tim, thank you. the nypd releasing new video of accused bias attackers, two women and one man. over the weekend police say a 27-year-old woman and her mother were the targets of antigay slurs by these suspects manhattan. police say it turned violent when the daughter was thrown to the floor and dragged. american airlines fixed a computer problem that grounded a lot of flights today. it began about noon and lasted nearly two hours. it halted american and american eagle flights from dallas, chicago and miami and caused a ripple effect in other cities. they have yet to say how many flights were affected. long island railroad passengers can expect a normal commute after two days of delays and cancellations. there were scattered delays this morning as crews finished removing debris from the track. two freight cars went off the

rails on tuesday. it caused problems on the ronkonkoma and port jefferson branches. now to vote 2016 one day after the second presidential debate the candidates are trying to build on any momentum they may have gained. carly fiorina was climbing in the polls before last night. her responses at the debate made her stand out. that could begin to put a dent on donald trump's lead. >> donald trump will probably drop in the afternoon math because of his mannerisms and facial expressions and how he treated other people on stage. >> several of the people struggling did little to help themselves. scott walker, mike huckabee, john kasich spoke less than ten minutes during the three hour event. hillary clinton mentioned 32 times during the debate returning to the campaign trail today. the leading democrat in new hampshire.

she promoted a ten billion dollars initiative to address drug and alcohol abuse that affected many rural communities in new hampshire. general motors will pay $900 million to settle criminal charges over the faulty ignition switches. the problems have been linked to 124 deaths. gm admitted the employees new about potentially deadly design flaws for nearly a decade before it started to recall affected vehicles. that delay prompted the criminal action. >> the law is the law and the facts are the facts. we are not done and it remains possible that we will charge an individual. >> gm has recalled millions of cars and trucks to fix the faulty ignition switches. the automaker set up a compensation fund to pay families of those killed or injured. stocks on wall street mixed after the federal reserve announced it's keeping interest

we will be in the mid-80s during the middle of the day tomorrow then we cool off because of the sea breeze from new york city south and east during the afternoon hours. inland numbers make a run at the upper 80s. we had a couple of high thin clouds brushing the east end of long island that skirted past ocean county earlier in the day. letter it's the northern edge of low pressure that is soaking the southeast coast and of course florida. this is the remnants of tropical storm grace that went across the atlantic and caribbean. now some of that moisture will scoot offshore. you will see the satellite look like this for several days. an area of moisture will make a closer pass at us. the other thing is this cold front to the west. showers just about to move into the windy city. this low will take a turn up to the hudson bay. instead of dragging moisture through, very little rain when it comes through saturday into sunday day morning. a noticeable temperature change. that will bring an end to this stretch of 80-degree weather.

because it is a personnel issue. i did send several e-mails to her school district e-mail and live in southampton, kristin news. >> thank you. a man convicted for spanking teenage boys in queens is arrested after trying to become a substitute teacher. he was arrested after submitting an application in uniondale, long island. submitting false information. more than 10 years ago he was convicted for luring four boys into his van in queens and spanking them. then he tried to pay a 5th boy to keep the victims quiet. new details in the violent helmet hit during a high school game. supporters including his mother spoke out and what we -- we learned what may have motivated the linden football player to hit his opponent. anthony johnson is live in linden with new information. anthony? >> reporter: well, we

linden high school talked to the linden players, talked about the incident and the consequences. that player has been suspended from the team. we did hear from the mother today. she questions whether or not this was a vicious act or act of frustration. by now you have seen the video described as being a disgusting play of unsportsman conduct. he appears to yank off the helmet of an opposing player and slam it back into the player's head causing a cut needing 10 stitches to close. today his mother spoke saying her son is being unfairly targeted for a mistake in the heat of battle. >> he said it was an accident. my thing is he said his hand got stuck in the helmet. >> reporter: the game between i can make cue la take high and linden had racial overtones. that is not what lead to his out of control response. his supporters say he had

>> the meeting was eat up by mayor de blasio. lauren glassberg has details. >> we wanted to set out certain designated areas where you can be free to walk through without obstacles, without impediments, chairs, tables, elmos. >> reporter: this councilman thinks time's square would be better served with divisions. areas in pink, that is the designated activity zones where you could engage with an elmo if you wish. >> reporter: there would be areas for the so-called characters. areas for public events and zones for people just trying to get through time's square. >> a lot of tourist enjoy interacting with them. they don't bother anybody. >> reporter: don't bother you. >> no. i don't go to time's square a lot. >> reporter: it is being discussed at the first ever task force meeting. another question, whether to finish the pedestrian zones first initiated six years ago

and that seems likely. >> maybe they have to be tweaked, redesigned. we can't make that decision until we have them completed, up and operating and we are -- our goal is to make sure that they are up and operating and function as best as they possibly can and enhance the time square community to the detract. >> reporter: the crossroads of the world remains congested, the police commissioner gave positive perspective. >> we haven't had a reported crime in time's square in six or seven days. that is, despite the issues around the naked late disand elmos, it's a relatively crime free area. >> reporter: another meeting by the task force is scheduled tomorrow at city hall. the hope is there is some resolution about the time's square characters sooner rather than later. >> we will see what happens. still ahead, a toddler found alone at a park in brooklyn. turns out he was at a day care center.

eyewitness news reporter jim dolan at the 72 precinct in sunset park with the breaking news. >> reporter: what a nightmare for the parents. they drop their son off at day care and the next time they see him or picture is in a tweet from the 72nd precinct talking about an abandoned child left at a park. take a look at this little guy, little 2 or 3-year-old boy in the superman shirt. the day care center took him and his classmates to the sunset park playground this morning and when they left, according to police, they miscounted the children and this little guy was left behind there at the playground. someone saw him, called police. police brought him to the 72nd precinct and for a while nobody came to claim him because the parents didn't know he was missing. they sent out the tweet then the parents came running to the
